Según varios filósofos del lenguaje contemporáneos, el argumento Frege-Geach plantea una objeción genuina para el expresivismo semántico. En el presente texto se sostiene que una manera eficaz de enfrentar y superar este argumento es modificando la concepción expresivista clásica. Se examinan el expresivismo clásico y el expresivismo mínimo y se propone una versión de este último que, a la vez que supera la objeción derivada del argumento Frege-Geach, tiene la ventaja de incluir dentro del espectro del expresivismo teorías que claramente (...) tienen este “espíritu” pero que la caracterización clásica deja fuera. Expressivists famously have important and difficult problems with semantics and logic. Their difficulties providing an adequate account of the semantics of material conditionals involving moral terms, and explaining why they have the right semantic and logical properties – for example, why they validate modus ponens – have received a great deal of attention. Cian Dorr [2002] points out that their problems do not stop here, but also extend to epistemology. The problem he poses for expressivists is the problem of wishful (...) thinking. David Enoch [2003] has claimed that expressivists can avoid wishful thinking, and offered a fairly detailed account of how. In this paper I explain the details of Enoch’s account, and why his reasoning fails in several different places. (shrink)

U ovom radu, koristeći Mark Schroederov (2008a) semantički okvir za ekspresivistički normativni jezik kao studiju slučaja, identificirat ću poteškoće s kojima će se čak i ekspresivistička semantička teorija sposobna za rješavanje Frege-Geach problema susresti pri objašnjenju logičke mogućnosti moralnih dilema. U tu svrhu, oslonit ću se na klasičnu zagonetku koju je formulirao McConnell (1978)a pokazuje da se logička mogućnost moralnih dilema sukobljava s nekim od naizgled opravdanih aksioma standardne deontičke logike, među kojima je i aksiom da obaveza implicira dopuštenost. Na (...) temelju tentativne pretpostavke da zastupnici etičkog ekspresivizma trebaju općenito biti posvećeni osiguravanju logičke mogućnosti moralnih dilema u svojim semantičkim teorijama, istražit ću da li i kako ekspresivisti mogu uspješno opovrgnuti aksiom da obaveza implicira dopuštenje unutar okvira koji je razvio Schroeder. Studija slučaja konačno otkriva da to može biti zaista težak zadatak za ekspresiviste. Generalizirajući iz studije slučaja, sugerirat ću da izvor poteškoće leži u mentalističkoj pretpostavci ekspresivističkog semantičkog projekta da bi logičko-semantički odnosi prikazani normativnim rečenicama trebali biti modelirani pomoću psiholoških stavova koje govornici izražavaju izgovarajući ih. Moj konačni cilj će biti pokazati da je poteškoća s kojom se ekspresivisti susreću u suočavanju s logičkom mogućnosti moralnih dilema odraz općeg problema da njihova predanost mentalističkoj pretpostavci sprječava fleksibilno usvajanje ili odbacivanje aksioma u njihovim semantičkim teorijama kako bi dobili ispravne tehničke rezultate. Why should moral philosophers, moral psychologists, and machine ethicists care about computational complexity? Debates on whether artificial intelligence (AI) can or should be used to solve problems in ethical domains have mainly been driven by what AI can or cannot do in terms of human capacities. In this paper, we tackle the problem from the other end by exploring what kind of moral machines are possible based on what computational systems can or cannot do. To do so, we analyze normative (...) ethics through the lens of computational complexity. First, we introduce computational complexity for the uninitiated reader and discuss how the complexity of ethical problems can be framed within Marr’s three levels of analysis. We then study a range of ethical problems based on consequentialism, deontology, and virtue ethics, with the aim of elucidating the complexity associated with the problems themselves (e.g., due to combinatorics, uncertainty, strategic dynamics), the computational methods employed (e.g., probability, logic, learning), and the available resources (e.g., time, knowledge, learning). The results indicate that most problems the normative frameworks pose lead to tractability issues in every category analyzed. Our investigation also provides several insights about the computational nature of normative ethics, including the differences between rule- and outcome-based moral strategies, and the implementation-variance with regard to moral resources. We then discuss the consequences complexity results have for the prospect of moral machines in virtue of the trade-off between optimality and efficiency. Finally, we elucidate how computational complexity can be used to inform both philosophical and cognitive-psychological research on human morality by advancing the moral tractability thesis. This chapter has two sections, each focusing on a distinct way in which ethical disagreement and variations in ethical judgment matter for theories of ethical thought and talk. In the first section, we look at how the variation poses problems for both cognitivist and non-cognitivist ways of specifying the nature of ethical judgments. In the second, we look at how disagreement phenomena have been taken to undermine cognitivist accounts, but also at how the seeming variation in cognitive and non-cognitive contents (...) between parties of deep ethical disagreement challenges both cognitivist and non-cognitivist accounts of disagreement itself. The prevailing theoretical framework for theorising about representation construes all representation as involving objective representational contents. This classic framework has tended to drive philosophers either to claim that evaluative judgements are representations and therefore objective, or else to claim that evaluative judgements are not really representations, because they are not objective. However, a more general, already well-explored framework is available, which will allow theorists to treat evaluative judgements as full-fledged representations while leaving open whether they are objective. Such a more (...) general conception of representational content is exemplified, e.g. by Lewis's ‘centred contents’ and Gibbard's framework of ‘contents of judgement’, thus it is not new. I shall start in §1 by introducing the more general framework of perspectival contents and then illustrate in §2 how awareness of it can help expose the fallaciousness of certain widely used forms of argumentation in metaethics. This chapter discusses epistemic objections to non-naturalist moral realism. The goal of the chapter is to determine which objections are pressing and which objections can safely be dismissed. The chapter examines five families of objections: (i) one involving necessary conditions on knowledge, (ii) one involving the idea that the causal history of our moral beliefs reflects the significant impact of irrelevant influences, (iii) one relying on the idea that moral truths do not play a role in explaining our moral beliefs, (...) (iv) one involving the claim that if moral realism is true then our moral beliefs are unlikely to be reliable, and (v) one involving the claim that moral realism is incompatible with there being a plausible explanation of our reliability about morality. The overall conclusion of the chapter is that the final objection is by far the most pressing. (shrink)

چکیده علامه­ طباطبایی فیلسوفی کلاسیک بر ممشای حکمت متعالیه و مفسر بزرگ قرآن کریم است اما اندیشه­ی وی در این دو حوزه محدود و متمرکز نشده و در حوزه‌های معرفتی دیگر نیز دارای اندیشه‌های بدیعی است. یکی از این حوزه‌ها فلسفه‌ی اخلاق است. بی‌تردید اصلی‌ترین بحث در فلسفه‌ی اخلاق به تقسیم‌بندی واقع‌گرایی و غیر واقع‌گرایی اخلاقی تعلق دارد. هدف از این پژوهش پردازش این مسأله است که علامه طباطبایی در کدام‌یک از این دسته‌بندی‌ها جای دارد و تبیین آن با کدام (...) موضوعات فلسفی انجام می‌پذیرد؟ این مقاله که با روشی اسنادی­_تحلیلی تألیف شده است، تلاش دارد با تحلیل و تبیین مساله­ی «اعتباریات» و نگهداشت مساله­ی «احساس» ذیل عنوان اعتباریات به این موضوع بپردازد. نتیجه­ی پژوهش این است که علامه طباطبایی یک واقع‌گرای اخلاقیِ تعریف گرایانه است. Abstract Although expressivist theories have been applied to many normative discourses (moral, rationality, knowledge, etc.), the normative discourse of epistemic justification has been somewhat neglected by expressivists. In this paper, I aspire to both remedy this unfortunate situation and introduce a novel version of expressivist theory: Habits-Expressivism. To pave the way for habits-expressivism, I turn to Allan Gibbard's (1990, 2003, 2008) seminal work on expressivism. I first examine Gibbard's (2003, 2008) late plan-reliance expressivism and argue that it faces certain problems (...) when applied to epistemic justification discourse. As a response to these problems, I go on to introduce habits-expressivism and argue that not only does it avoid the identified problems for plan-reliance-expressivism, but it also captures the basic attractions of both plan-reliance expressivism and Gibbard's (1990) early theory of norm-expressivism. Recent empirical work on folk moral objectivism has attempted to examine the extent to which folk morality presumes that moral judgments are objectively true or false. Some researchers report findings that they take to indicate folk commitment to objectivism (Goodwin & Darley, 2008, 2010, 2012; Nichols & Folds-Bennett, 2003; Wainryb et al., 2004), while others report findings that may reveal a more variable commitment to objectivism (Beebe, 2014; Beebe et al., 2015; Beebe & Sackris, 2016; Sarkissian, et al., 2011; Wright, (...) 2018; Wright, Grandjean, & McWhite, 2013; Wright, McWhite, & Grandjean, 2014). However, the various probes that have been used to examine folk moral objectivism almost always fail to be good direct measures of objectivism. Some critics (Beebe, 2015; Pölzler, 2017, 2018) have suggested that the problems with existing probes are serious enough that they should be viewed as largely incapable of shedding any light on folk metaethical commitments. Building upon the work of Justin Khoo and Joshua Knobe (2018), I argue that many of the existing probes can be seen as good measures of the extent to which people think that the truth of one moral judgment excludes the possibility that a judgment made by a disagreeing party is also true and that the best explanation of the findings obtained using these measures is significant folk support for indexical moral relativism—the view that the content of moral judgments is context-sensitive. If my thesis is correct, many contemporary moral philosophers are deeply mistaken about the metaethical contours of folk morality in one very important respect. (shrink)

Defenders of pragmatic encroachment in epistemology (or what I call practicalism) need to address two main problems. First, the view seems to imply, absurdly, that knowledge can come and go quite easily—in particular, that it might come and go along with our variable practical interests. We can call this the stability problem. Second, there seems to be no fully satisfying way of explaining whose practical interests matter. We can call this the “whose stakes?” problem. I argue that both problems can (...) be addressed in roughly the same terms. More exactly, I argue that by first clarifying the whose stakes? problem an answer to the stability problem naturally falls out. (shrink)

The interpretation and the indirect reporting of a speaker’s communicative intentions lie at the crossroad between pragmatics, argumentation theory, and forensic linguistics. Since the leading case Masson v. New Yorker Magazine, Inc., in the United States the legal problem of determining the truth of a quotation is essentially equated with the correctness of its indirect reporting, i.e. the representation of the speaker’s intentions. For this reason, indirect reports are treated as interpretations of what the speaker intends to communicate. Theoretical considerations, (...) aimed at establishing the pragmatic meaning of an utterance and differentiating between presumptive and non-presumptive interpretation, are thus interwoven with the practical legal need of distinguishing a correct indirect report from an indirect one or a misquotation. An incorrect report or a misquotation has the dialectical effect of attributing to the misquoted party commitments that he never held, which the latter needs to rebut. This shifting of the burden of persuasion can be increased by using strategically the conflict between the presumptive interpretation of an utterance and the non-presumptive one, i.e. the different types of pragmatic ambiguity. When an interpreter is confronted with an utterance taken out of its dialogical context, his interpretative process is not guided by the actual context or intention, but rather the most frequent or prototypical dialogical setting or the most typical individual purpose that it could have served to achieve. This presumptive reconstruction can be used to provide a prima facie case that the other party needs to reject. The stronger the interpretative presumptions a speaker needs to rebut, the more effective the misquotation strategy. The conflict between the systematic and the presumptive process of interpretation can be represented as an argumentative mechanism of reconstruction of the individual intention, which allows one to assess the reasonableness of the interpretative reasoning. This paper investigates the emotive (or expressive) meaning of words commonly referred to as “loaded” or “emotive,” which include slurs, derogative or pejorative words, and ethical terms. We claim that emotive meaning can be reinterpreted from a pragmatic and argumentative perspective, which can account for distinct aspects of ethical terms, including the possibility of being modified and its cancellability. Emotive meaning is explained as a defeasible and automatic or automatized evaluative and intended inference commonly associated with the use of specific (...) terms, which can be represented and assessed considering its logical structure and its defeasibility conditions. This automatic inference is conceived as part of the connotation of an ethical term, and is not necessarily stable. By means of quasi-definitions, it is possible to modify the emotive meaning while maintaining the descriptive one, automaticizing the inferences drawn from an ethical word. Through examples drawn from the recent US presidential campaign, we show how re-contextualization and emotive contexts can affect emotive meaning. (shrink)

This paper develops an account of the meaning of `ought', and the distinction between weak necessity modals (`ought', `should') and strong necessity modals (`must', `have to'). I argue that there is nothing specially ``strong'' about strong necessity modals per se: uses of `Must p' predicate the (deontic/epistemic/etc.) necessity of the prejacent p of the actual world (evaluation world). The apparent ``weakness'' of weak necessity modals derives from their bracketing whether the necessity of the prejacent is verified in the actual world. (...) `Ought p' can be accepted without needing to settle that the relevant considerations (norms, expectations, etc.) that actually apply verify the necessity of p. I call the basic account a modal-past approach to the weak/strong necessity modal distinction (for reasons that become evident). Several ways of implementing the approach in the formal semantics/pragmatics are critically examined. The account systematizes a wide range of linguistic phenomena: it generalizes across flavors of modality; it elucidates a special role that weak necessity modals play in discourse and planning; it captures contrasting logical, expressive, and illocutionary properties of weak and strong necessity modals; and it sheds light on how a notion of `ought' is often expressed in other languages. These phenomena have resisted systematic explanation. In closing I briefly consider how linguistic inquiry into differences among necessity modals may improve theorizing on broader philosophical issues. (shrink)

This paper advocates a generalized form of Expressivism, as a strategy for resolving certain metasemantic puzzles about identifying the semantic value of a context-sensitive expression in context. According to this form of Expressivism, speakers express properties of semantic parameters, and they do so in order to proffer those properties for cognitive adoption (acceptance) by their addressees. Puzzles arising from the pressure to say what a putatively context-sensitive expression refers to or denotes in contexts that do not seem to specify a (...) referent or denotation dissolve, once we appreciate that such attempts were ill-placed to begin with. Gibbard's Norm Expressivism, according to which speakers express properties of planning states or normative systems, can be regarded as a branch of this more general theory. I will however argue that Gibbard takes on commitments -- optional for the Expressivist -- that make it a bit hard to see how to distinguish his theory from a nuanced form of Subjectivism. (shrink)

This chapter develops an account of the meaning and use of various types of legal claims, and uses this account to inform debates about the nature and normativity of law. The account draws on a general framework for implementing a contextualist theory, called 'Discourse Contextualism' (Silk 2016). The aim of Discourse Contextualism is to derive the apparent normativity of claims of law from a particular contextualist interpretation of a standard semantics for modals, along with general principles of interpretation and conversation. (...) Though the semantics is descriptivist, it avoids Dworkin’s influential criticism of so-called “semantic theories of law,” and elucidates the nature of “theoretical disagreements” about the criteria of legal validity. The account sheds light on the social, interpersonal function of normative uses of language in legal discourse. It also gives precise expression to Hart’s and Raz’s intuitive distinctions among types of legal claims (internal/external, committed/detached), while giving them a uniform type of analysis. The proposed semantics and pragmatics of legal claims provides a fruitful framework for further theorizing about the nature and metaphysics of law, the relation between law and morality, and the apparent practical character of legal language and judgment. Discourse Contextualism provides a solid linguistic basis for a broader account of legal discourse and practice. (shrink)

The role that need plays in dealing with problems of distributive justice is examined in a series of vignette studies. Among other things, it becomes clear that impartial observers make gradual assessments of justice that depend on the extent to which the observed individuals are endowed with a good. If it is known how high their need for that good is, the assessments are made relative to this reference point. In addition, impartial decision-makers make hypothetical distribution decisions that take into (...) account need, productivity, and accountability. The need of individuals is partially compensated even if they have contributed less to the available amount than they themselves require. However, the willingness to do so decreases if they are accountable for needing more than others or for having contributed less than others. Lastly, both impartial observers and impartial decision-makers distinguish between different types of needs, the fulfillment of which is given different levels of importance. (shrink)

The first part of this article argues that descriptivism as proposed by Moritz Schlick does not correctly understand the function of moral judgements. The second part argues that emotivism does not provide an adequate explanation of the role of reason in ethics. Finally, the article shows how the universal prescriptivism proposed by R. M. Hare furthers the solution of the problems of emotivism, since it extends the role of reason in ethics and in the resolution of the problems of descriptivism, given that it understands the function of moral judgements in ordinary language. Together with the first volume “Inquiries in philosophical pragmatics: Theoretical developments,” this book collects contributions that represent the state of the art on the interconnection between pragmatics and philosophy. While the first volume presents the philosophical dimension of pragmatics, showing the path from theoretical advances to practical uses and approaches, this second volume offers a specular view on this discipline. Instead of adopting the top-down view of the first volume, this collection of eleven chapters starts from the analysis of linguistic (...) data – which include texts and discourses in different languages, different types of dialogues, different types of interactions, and different modes for expressing meaning – looking for the regularities that govern our production and processing. The chapters are ordered according to their relationship with the themes and methods that define the field of pragmatics. The more explored and classical linguistic issues such as prototype-based generalizations, scalar implicatures, and temporal ordering, lead gradually to the more recent and debated topic of slurs and pejorative language, and finally to the interdisciplinary and more pioneering works addressing specific context of language use, such as marketplace interactions, courtroom speeches, schizophrenic discourse, literary texts for children, and multimedia communication. La teleosemántica es una teoría teleológica de las representaciones mentales, propugnada por David Papineau, que tiene como propósito ofrecer una explicación naturalista y evolucionista de dichas representaciones, en particular de las creencias. Mi objetivo será analizar las creencias y su relación con la verdad en la obra de Papineau. Según Papineau, los contenidos y las representaciones mentales, específicamente las creencias, cumplen funciones derivadas de la evolución biológica de la especie, y correlativamente, la finalidad de las creencias y los contenidos proviene (...) de las funciones biológicas que cada una de ellas tiene. De acuerdo a Papineau, para que las creencias cumplan sus funciones biológicas deben ser verdaderas, es decir, corresponder con la realidad. Defenderé la idea de que, a diferencia de lo que plantea la teleosemántica, la verdad y la falsedad, o más específicamente, los enunciados verdaderos y falsos son doxásticos, es decir, son enunciados que expresan creencias. Las creencias no tienen que ser verdaderas, sino más bien útiles, de manera que el que sean verdaderas o no es un producto secundario de la creencia. (shrink)

Para quienes tengan interés en la filosofía moral y política contemporánea la obra de John Rawls es sin discusión una parada necesaria. De hecho, la tesis de Robert Nozick según la cual resulta imposible hacer filosofía moral y política sin considerar el marco ofrecido por Rawls, aunque parezca extrema, resulta bastante acertada. En gran medida el impacto de la obra de Rawls radica en su interés por ofrecer una teoría sustantiva de la justicia, teoría que hundiendo sus raíces en la (...) tradición de la filosofía sea capaz de orientarnos al momento de abordar las discusiones contemporáneas sobre justicia social. -/- En los trabajos que componen este libro el lector podrá encontrar una discusión actualizada sobre aquellos elementos que definen la base moral y política que Rawls presentó como fundamento de su teoría de la justicia. Al mismo tiempo, estos ensayos intentan construir un puente entre la justicia como equidad y otras tradiciones de la filosofía moral y política contemporánea. This book shows how research in linguistic pragmatics, philosophy of language, and rhetoric can be connected through argumentation to analyze a recognizably common strategy used in political and everyday conversation, namely the distortion of another’s words in an argumentative exchange. Straw man argumentation refers to the modification of a position by misquoting, misreporting or wrenching the original speaker’s statements from their context in order to attack them more easily or more effectively. Through 63 examples taken from different contexts (including political (...) and forensic discourses and dialogs) and 20 legal cases, the book analyzes the explicit and implicit types of straw man, shows how to assess the correctness of a quote or a report, and illustrates the arguments that can be used for supporting an interpretation and defending against a distortion. The tools of argumentation theory, a discipline aimed at investigating the uses of arguments by combining insights from pragmatics, logic, and communication, are applied to provide an original account of interpretation and reporting, and to describe and illustrate tactics and procedures that can be used and implemented for practical purposes.. This book will appeal to scholars in the fields of political communication, communication in general, argumentation theory, rhetoric and pragmatics, as well as to people working in public speech, speech writing, and discourse analysis. After introducing some of the many issues raised by intergenerational justice, the paper will focus in particular on the motivational problem: Why should we be motivated to act in favor of others when sacrifices on our behalf are required? And more specifically, how can such sacrifices be justified when those we act for are neither born nor easily unidentifiable? While many accounts of moral motivation exist, most scholars will grant that emotional engagement is a strong motivational drive. Hence, the paper (...) will focus on such a drive. I will, first, argue that immediate emotions and empathy – understood uniquely as a form of emotional attunement – are insufficient to grant that the acts they motivate are morally acceptable. The case of future generations is a perfect example of such insufficiency. Second, I will discuss the possibility of regulated emotions and sympathy playing such a role. In fact, by regulating and educating emotions, a conscious or “rational” component is added, which could help avoid the biases and limitations immediate affective phenomena show. Such a “rational” component would also enable us to provide a criterion to distinguish cases in which emotions drive us in morally acceptable or unacceptable directions. In the second part of the paper, the sentimentalist tradition will be reconsidered, with particular attention to Adam Smith’s moral proposal – since the sympathetic engagement of an impartial spectator could be an excellent example of a regulated and educated emotional attunement of the kind required to deal with some of the many moral issues future generations raise and, in particular, with the motivational problem itself. The recent, influential Social Intuitionist Model of moral judgment (Haidt, Psychological Review 108, 814–834, 2001) proposes a primary role for fast, automatic and affectively charged moral intuitions in the formation of moral judgments. Haidt’s research challenges our normative conception of ourselves as agents capable of grasping and responding to reasons. We argue that there can be no ‘real’ moral judgments in the absence of a capacity for reflective shaping and endorsement of moral judgments. The main aim of the paper is to reject the idea that predicates of personal taste express normative meanings. According to a recent theory proposed by Daniel Gutzmann, predicates of personal taste express both a truth-conditional content and a use-conditional content, the latter being normative. The purported normativity of predicates of personal taste is supposed to consist in that when producing utterances containing such predicates, their speakers suggest how other people ought to experience the objects of taste under discussion. The (...) paper provides a bunch of evidence to show there are utterances containing predicates of personal taste that cannot be used normatively in this sense. In particular, it is claimed that one can make such an utterance and then add a related normative piece of information without doing anything redundant; one can also make such an utterance and then deny the related normative piece of information without generating any contradiction or infelicity. At the same time, it is admitted there are situations in which the speakers do communicate something normative by producing utterances containing predicates of personal taste. We thus need an explanation to cope with such cases. Although the paper does not offer one, it provides some reasons to the effect that a correct explanation has to be pragmatic rather than semantic. I probe the judgments of the agreeable that we make about food and drink. I first separate different concerns that we might have with food and drink. After that, I address expressive language by first sketching an evolutionary language-game-theoretic approach for referential language. I then try to extend it to expressive language, showing how expressive signaling might be likely to evolve. Given an account of expressive prediction, and its point, I turn to the Frege-Geach problem for the agreeable. I show (...) how a proper understanding of what expression is, in the evolutionary language-game-theoretic framework, allows us to side-step a central aspect the problem. (shrink)

The morality of virtual representations and the enactment of prohibited activities within single-player gamespace continues to be debated and, to date, a consensus is not forthcoming. Various moral arguments have been presented to support the moral prohibition of virtual enactments, but their applicability to gamespace is questioned. In this paper, I adopt a meta-ethical approach to moral utterances about virtual representations, and ask what it means when one declares that a virtual interaction ‘is morally wrong’. In response, I present constructive (...) ecumenical expressivism to explain what moral utterances should be taken to mean, argue that they mean the same when referring to virtual and non-virtual interactions and, given, explain why consensus with regard to virtual murder, rape and paedophilia is not forthcoming even though such consensus is readily found with regard to their non-virtual equivalents. This is a critical discussion of Mark Schroeder's book, "Being For: Evaluating the Semantic Program of Expressivism" (Oxford University Press, 2008).

Explaining genuine moral disagreement is a challenge for metaethical theories. For expressivists, this challenge comes from the plausibility of agents making seemingly univocal claims while expressing incongruent conative attitudes. I argue that metaethical inferentialism – a deflationary cousin to expressivism, which locates meaning in the inferential import of our moral assertions rather than the attitudes they express – offers a unique solution to this problem. Because inferentialism doesn’t locate the source of moral disagreements in a clash between attitudes, but instead (...) in conflicts between the inferential import of ethical assertions, the traditional problem for expressivism can be avoided. After considering two forms of inferentialism that lead to revenge versions of the problem, I conclude by recommending that we understand the semantics of moral disagreements pragmatically: the source of univocity does not come from moral or semantic facts waiting to be described, but instead from the needs that ethical and semantic discourses answer – a solution to the problems of what we are to do and how we are to talk about it. Manipulation of quotation, shown to be a common tactic of argumentation in this paper, is associated with fallacies like wrenching from context, hasty generalization, equivocation, accent, the straw man fallacy, and ad hominem arguments. Several examples are presented from everyday speech, legislative debates and trials. Analysis using dialog models explains the critical defects of argumentation illustrated in each of the examples. In the formal dialog system CB, a proponent and respondent take turns in making moves in an orderly goal-directed sequence (...) of argumentation in which the proponent tries to persuade the respondent to become committed to a conclusion by asking questions and offering arguments. Analyzing quotation by using the notion of commitment in dialog, it is shown (a) how an arguer’s previous assertions can be brought to light in the course of a dialog to deal with problems arising from misquotation, (b) how the profile of dialog model allows a critic to analyse the fundamental effects misquotation brings about in a dialog, and (c) how the critic can use such an analysis to correct the problem. This paper tests a theory about the relationship between two important topics in moral philosophy and psychology. One topic is the function of normative language, specifically claims that one “ought” to do something. Do these claims function to describe moral responsibilities, encourage specific behavior, or both? The other topic is the relationship between saying that one “ought” to do something and one’s ability to do it. In what respect, if any, does what one “ought” to do exceed what one “can” (...) do? The theory tested here has two parts: (1) “ought” claims function to both describe responsibilities and encourage people to fulfill them (the dual-function hypothesis); (2) the two functions relate differently to ability, because the encouragement function is limited by the person’s ability, but the descriptive function is not (the interaction hypothesis). If this theory is correct, then in one respect “ought implies can” is false because people have responsibilities that exceed their abilities. But in another respect “ought implies can” is legitimate because it is not worthwhile to encourage people to do things that exceed their ability. Results from two behavioral experiments support the theory that “ought” exceeds but implies “can.” Results from a third experiment provide further evidence regarding an “ought” claim’s primary function and how contextual features can affect the interpretation of its functions. Moral platonism, the claim that moral entities are both objective and prescriptive, is generally thought to be a dead end. In an attempt to defend a moderate form of moral platonism or more precisely platonism about values, I first argue that several of the many versions of this doctrine are not committed to ontological extravagances. I then discuss an important objection due to John McDowell and developed by Michael Smith, according to which moral platonism is incoherent. I argue that objectivism (...) is compatible with the claim that certain ways of being aware of values, namely those involving emotions, are motivating. (shrink)

A successful account of the ‘normativity of law’ is meant to inter alia establish how legal requirements come to be morally binding. This question presupposes taking a stance on the metaethical debate about the nature of morality and moral bindingness between the cognitivist and non-cognitivist camps. An overwhelming majority of contemporary legal philosophers have an unspoken adherence to a cognitivist metaethic and the model of normativity of law emerging from it: the impinging model. Consequently, the problematic of the normativity of (...) law is so calibrated as to in limine rule out any putative account of the normativity of law that presupposes a non-cognitivist metaethic: the projectivist model. This paper calls for a recalibration of the problematic of the normativity of law to a metaethically aseptic viewpoint from which the projectivist model is seen as a plausible theoretical contender to the impinging model. Philippa Foot has recently argued that non-cognitivism rests on a mistake. According to Foot, non-cognitivism cannot properly account for the role of reasons in moral thinking. Furthermore, Foot argues that moral judgements share a conceptual structure with the kind of evaluations that we make about plants and animals, which cannot be couched in non-cognitivist terms. In this article I argue that, in the form of expressivism, non-cognitivism is capable of accommodating most of what Foot says about reasons and morality. I (...) then argue that the kind of evaluative judgements Foot suggests that we make about plants and animals, does not constitute a plausible alternative to an expressivist understanding of moral judgements. Finally I consider an account similar to Foot's, defended by Rosalind Hursthouse, which, I argue, suffers from an inconsistency, the avoidance of which leaves Hursthouse with a view that is either compatible with expressivism or shares the same problems as Foot's. Judgment internalism about evaluative judgments is the view that there is a necessary internal connection between evaluative judgments and motivation understood as desires. The debate about judgment internalism has reached a standoff some time ago. In this paper, I outline a new argument for judgment internalism. This argument does not rely on intuitions about cases, but rather it has the form of an inference to the best explanation. I argue that the best philosophical explanations of how we know what we (...) desire require that judgment internalism is true, which gives us a good reason to believe that judgment internalism is true.
