This work represents Niklas Luhmann's definitive application of systems theory to the understanding of law. In it Luhmann reviews past attempts to create a theory of law and argues they all fail to capture how law operates in modern society. He presents an alternative, critical theory through analysing law as a system of communication.

What can a philosophical analysis of the concept of interpretation contribute to legal theory? In his recent book,Interpretation and Legal Theory, Andrei Marmor proposes a complex and ambitious analysis as groundwork for his positivist assault on “interpretive” theories of law and of language. I argue (i) that the crucial element in Marmor's analysis of interpretation is his treatment of Ludwig Wittgenstein's remarks on following rules, and (ii) that a less ambitious analysis of interpretation than Marmor's can take better advantage of (...) those insights about rules. I explore some implications of such an analysis for the role of interpretation in legal reasoning. (shrink)

From the Reformation to the present, German political philosophy has done much to shape the contours of theoretical debate on politics, law, and the conditions of political legitimacy; many of the most decisive and influential theoretical impulses in European political history have originated in Germany. Usually regarded as a 1970s phenomenon, this article demonstrates that the debate between Jürgen Habermas and Niklas Luhmann continued until Luhmann’s death in 1998, and that the development of the two theorists’ positions during the 1980s and 1990s was characterised by convergence rather than by divergence. In the realm of legal theory, the article suggests, convergence advanced to the extent that Habermas’ discourse theory may be characterised as a normative superstructure to Luhmann’s descriptive theory of society. It is further shown (...) that the debate’s result was an almost complete absorption of Habermas’ theory by Luhmann’s systems theoretical complex – an outcome facilitated by Luhmann’s deliberate translation of central Habermasian concepts into systems theoretical concepts. The article argues that both the debate and Habermas’ conversion were made possible because not only Habermas’ but also Luhmann’s work can be considered a further development of the German idealist tradition. What Luhmann did not acknowledge was that this manoeuvre permitted the achievement of Habermas’ normative objectives; nor did he notice that it could eradicate a central flaw in the system theoretical construction, by allowing the context within which distinctions are drawn to be mapped – an issue of pivotal importance for grasping relationships between different social systems, and coordinating them, via the deployment of legal instruments. This article questions some assumptions in legal, moral and political theory regarding the law’s ways of functioning. As the constant revival of the topos ‘living law’ shows, underlying common models of law, and of the legitimacy of law, is, though often implicitly, the view that law is or should be particular, near to the facts, flexible, susceptible to realities, and as a consequence accessible to modernisations. However, this article proposes an immanent critique of similar hopes or fears, and it argues (...) that modern positive law can not be responsive to any other ‘order’ or context because it constitutes an order of its own. The article seeks to give an explanation of the specific character and forms of the juridical operating and to explain more specifically how decisions are produced. The article in this regard also investigates the importance and role of imagination, fiction and performativity. Underlining the fact that the juridical exceeds legal propositions by asserting itself as a distinct form of social communication, it calls for a shift from the representational to the performative analysis in the study of law. Die Proklamation der "Postmoderne" hatte mindestens ein Verdienst. Sie hat bekannt gemacht, daß die moderne Gesellschaft das Vertrauen in die Richtigkeit ihrer eige nen Selbstbeschreibungen verloren hat. Auch sie sind jeweils anders möglich. Auch sie sind kontingent gewor den. Wie in der risikoreichen Welt des New Yorker U-Bahn-Netzes drängen sich jetzt die, die darüber reden wollen, an dafür bestimmten Plätzen unter heller Be leuchtung und bei laufenden Fernsehkameras zusammen. Es scheint ums intellektuelle Überleben zu gehen. Aber offenbar nur darum. Und (...) währenddessen geschieht, was geschieht, und die Gesellschaft evoluiert im Ausgang von dem, was erreicht ist, in eine unbekannte Zukunft. Vielleicht hatte das Stichwort der Postmoderne nur eine andere, variantenreichere Beschreibung der Moder ne versprechen wollen, die ihre eigene Einheit nur noch negativ vorstellen kann als Unmöglichkeit eines meta recit. Aber das ließe dann möglicherweise zu viel zu angesichts zahlreicher aktueller Dringlichkeiten, die auf fallen. Wir mögen gern konzedieren, daß es keine ver bindliche Repräsentation der Gesellschaft in der Gesell schaft gibt. Aber das wäre dann nicht das Ende, sondern der Beginn einer Reflexion der Form von Selbstbeob achtungen und Selbstbeschreibungen eines Systems, die im System selbst vorgeschlagen und durchgesetzt werden 7 müssen in einem Prozeß, der seinerseits wieder beob achtet und beschrieben wird.
