This work deals with legal pluralism in an emerging world society. It central thesis is that globalization of law tends to create a decentred law-making process which occurs in multiple sectors of civil society, independently of nation states. Technical standardization, professional rule production, human rights, intra-organizational regulation in multinational enterprises, contracting, arbitration and other institutions of lex mercatoria are forms of rule by private governments, claiming world-wide validity independently of the law of the nation states. They have come into existence (...) not by formal acts of nation states but by strange paradoxical acts of self-validation. (shrink)

The relationship between knowledge and values, experts and lay people, represents a major issue of the debate involving environment and technology. There is a growing awareness that the connection between value commitments and technical solutions, scientific expertise and lay competence, is much more entangled than once was believed. The article deals with this issue by analysing Robert Dahl's `minipopulus' and Silvio Funtowicz and Jerry Ravetz's `extended peer communities' arguments. They are subsequently inserted into the sociological debate which is, at present, (...) considerably influenced by the reflexive modernization framework. As a result, Ulrich Beck's and Anthony Giddens' theories appear as one of four ideal-typical approaches to the social construction of the issues that can be outlined, according to the priority assigned to knowledge versus power and nature versus society. The idea of an `extended peer review' of problems and solutions is remarkably close to the deliberative democracy concept. However, the high level of uncertainty characterizing major environmental and technological questions suggests that a `strong' version of deliberative democracy, such as the Discourse Ethics proposed by Habermas, is untenable in its search for a universal, rational consensus on the normative grounds of action. Thus it is necessary to develop a `weak' interpretation of the extended peer review, exploring the possibility of fair and stable agreements on bounded, practical solutions to bounded, practical problems. This book brings together, in systematic and generalized form, the main outlines of a conceptual scheme for the analysis of the structure and processes of social systems. It carries out Pareto's intention by using the "structural-functional" level of analysis.

Relying on a powerful collective narrative through which political, legal and social decision-making is guided in the name of science, the authority of scientific experts reaches beyond the boundaries of their certified knowledge base. Therefore, expertise constitutes and is constituted by transgressive competence. The author argues that (1) changes in the decision-making structure of liberal Western democracies and changes in the knowledge production system diminish the authority of scientific expertise while increasing the context-dependency of expertise - thereby altering the nature (...) of its predictive claims; (2) the societal distribution of expertise, while displaying emancipatory features of empowerment of citizens, also raises issues of quality control; and (3) in order to regain a balance between public and private, i.e. individual-based societally distributed expertise, future expert systems will need to adopt a longer time-perspective. The Nobel prize-winning molecular biologist Walter Gilbert described the mapping and sequencing of the human genome as “the grail of molecular biology.” The implication, endorsed by enthusiasts for the new genetics, is that possessing a comprehensive knowledge of human genetics, like possessing the Holy Grail, will give us miraculous powers to heal the sick, and to reduce human suffering and disabilities. Indeed, the rhetoric invoked to garner public support for the Human Genome Project appears to appeal to the best of (...) the Western tradition's enthusiasm for progress: the idea of improving human lives through the practical application of scientific knowledge. In the days of global warming and BSE, science is increasingly a public issue. This book provides a theoretical framework which allows us to understand why and how scientists address the general public. The author develops the argument that turning to the public is not simply a response to inaccurate reporting by journalists or to public curiosity, nor a wish to gain recognition and additional funding. Rather, it is a tactic to which the scientific community are pushed by certain "internal" (...) crisis situations. Bucchi examines three cases of scientists turning to the public: the cold fusion case, the COBE/Big Bang issue and Louis Pasteur's public demonstration of the anthrax vaccine, a historical case of "public science." Finally, Bucchi presents his unique model of communications between science and the public, carried out through the media. This is a thoughtful and wide-ranging treatment of complex contemporary issues, touching upon the history and sociology of science, communication and media studies. This is Jürgen Habermas's most concrete historical-sociological book and one of the key contributions to political thought in the postwar period. It will be a revelation to those who have known Habermas only through his theoretical writing to find his later interests in problems of legitimation and communication foreshadowed in this lucid study of the origins, nature, and evolution of public opinion in democratic societies.

In Between Facts and Norms, Jürgen Habermas works out the legal and political implications of his Theory of Communicative Action (1981), bringing to fruition the project announced with his publication of The Structural Transformation of the Public Sphere in 1962. This new work is a major contribution to recent debates on the rule of law and the possibilities of democracy in postindustrial societies, but it is much more. The introduction by William Rehg succinctly captures the special nature of the work, (...) noting that it offers a sweeping, sociologically informed conceptualization of law and basic rights, a normative account of the rule of law and the constitutional state, an attempt to bridge normative and empirical approaches to democracy, and an account of the social context required for democracy. Finally, the work frames and caps these arguments with a bold proposal for a new paradigm of law that goes beyond the dichotomies that have afflicted modern political theory from its inception and that still underlie current controversies between so-called liberals and civic republicans. The book includes a postscript written in 1994, which restates the argument in light of its initial reception, and two appendixes, which cover key developments that preceded the book. Die Verständigungsprozesse der Lebenswelt bedürfen deshalb einer kulturellen Überlieferung auf ganzer Breite, nicht nur der Segnungen von Wissenschaft und Technik. So könnte die Philosophie ihren Bezug zur Totalität in einer der Lebenswelt zugewandten Interpretenrolle aktualisieren. Sie könnte mindestens dabei helfen, das stillgestellte Zusammenspiel des Kognitiv-Instrumentellen mit dem Moralisch-Praktischen und dem Ästhetisch-Expressiven wie ein Mobile, das sich hartnäckig verhakt hat, wieder in Bewegung zu setzen.
