Though the revised edition of A Theory of Justice, published in 1999, is the definitive statement of Rawls's view, so much of the extensive literature on Rawls's theory refers to the first edition. This reissue makes the first edition once again available for scholars and serious students of Rawls's work.

The long republican tradition is characterized by a conception of freedom as non‐domination, which offers an alternative, both to the negative view of freedom as non‐interference and to the positive view of freedom as self‐mastery. The first part of the book traces the rise and decline of the conception, displays its many attractions and makes a case for why it should still be regarded as a central political ideal. The second part of the book looks at the sorts of political (...) and civil institutions that would be required in a society in which freedom as non‐domination is systematically fostered. It outlines the causes and policies, the constitutional and democratic forms, and the regulatory controls that a republican state ought to endorse. After characterizing Taylor’s general approach to the problems of solidarity, we distinguish and reconstruct three contexts of solidarity in which this approach is developed: the civic, the socio-economic, and the moral. We argue that Taylor’s distinctive move in each of these contexts of solidarity is to claim that the relationship at stake poses normatively justified demands, which are motivationally demanding, but insufficiently motivating on their own. On Taylor’s conception, we need some understanding of extra motivational sources which explain why people (...) do (or would) live up to the exacting demands. Taylor accepts that our self-understanding as members of either particular communities or humanity at large has some motivational power, but he suspects that in many cases the memberships are too thin to resonate deeply and enduringly within us. In Taylor’s view, a realistic picture of what moves people to solidarity has to account for the extra motivation, when it happens. We propose an alternative view in which morality, democracy and socio-economic cooperation can be seen as separate spheres or relations which are normatively justified, motivationally demanding, but also sufficiently motivating on their own. I want to enquire into the relationship between the normative claims of a society and the normative stances of its members. I shall develop a contractarian perspective, as the only one available to persons who may neither expect nor require their fellows to share their own orientation to values and norms. Although I only touch on these matters here, I hope to contribute to an interpretation of the clauses on the establishment and exercise of religion in the First Amendment to (...) the United States constitution, and to suggest guidelines for determining rights and duties in becoming and being a parent. More generally, I offer answers to certain questions about how social practices and institutions may be justified in a democratic society. (shrink)

The paper argues that the liberal approach to social rights is contradictory and provides an alternative account that draws on solidarism, a strand of nineteenth-century French Republican thought. Solidarism links together a normative theory of social obligation and a descriptive account of social value, debt and unearned increment. The theory of social property provides a distinctive foundation for social rights.

For over forty years, economic inequality and distributive justice have been two of the primary concerns of political philosophers. This volume addresses these issues in a novel way, by focusing on the concepts of solidarity and public goods as both descriptive and normative frameworks. Solidarity links the social, political and moral together, in a distinctively political approach that recognizes the social sources of power on the one hand and sources of moral motivation on the other. Public goods such as education, (...) healthcare, and transport systems are indispensable to the forging of solidarity, but at the same time they may become sources of oppression or injustice, when they fail to respect individual autonomy or when they calcify majoritarian preferences. The essays in this volume explore different features of the political, moral and civic approaches to solidarity. The moral theory of solidarity is advanced in one case as an intrinsically valuable concept of social connectedness and in another as an approach of epistemic deference; a structural account of solidarity theorizes about action against racial oppression, and a power-relations account points at the urgency of the affective, non-rational dimensions of solidarity. The social value of property and its moral implications are articulated through the lens of French 19th Century ‘Solidarism’ and as a complementary theory to left-libertarianism. Public goods are defended as instrumental to solidarity, in one case within a liberal framework and in another within a human-perfectionism framework. By providing a series of thought-provoking debates about social obligations and justice, the volume re-establishes solidarity and public goods as pertinent concepts for theorizing about social justice and inequality. This chapter compares the 1844 Marx (the Marx of the Economic and Philosophic Manuscripts of 1844) and the Rawls of A Theory of Justice, with the central topic being the young Marx and the middle‐aged Rawls. It starts with the standard Marxian criticism of Theory, and then discusses the two ways in which the writers resemble one another. Eventually, the discussion returns to the standard criticism, casting it as a difference in the writers’ conceptions of “alienation.” The 1844 Marx condemns (...) capitalism for its deep and multiform alienation of labor but misses the fact that a theory of distribution asks, among other things, what ought to be distributed. The alienation associated with the absence of the difference principle in a restricted utility society stems from a perceived deficit of concern. Rawls claims in Theory that the difference principle is “an interpretation of the principle of fraternity”. (shrink)
