How do we justify the normative standards to which we appeal in support of our moral progress judgments, given their historical and cultural contingency? To answer this question in a noncircular way, Elizabeth Anderson and Philip Kitcher appeal exclusively to formal features of the methodology by which a moral change was brought about; some moral methodologies are systematically less prone to bias than others and are therefore less vulnerable to error. However, we argue that the methodologies espoused by (...) class='Hi'>Anderson and Kitcher implicitly appeal to the substantive principle of “moral universalism.” This sets up the positive project of the paper: an attempt to vindicate moral universalism with a pragmatic genealogy. Using resources from cultural evolutionary theory and the history of ideas we argue that the universalistic norms widely committed to in many societies today have the function of maintaining cooperation in large anonymous groups. Furthermore, while universalistic norms play this instrumental role, their functional benefits are best secured when people following such norms do so for intrinsic rather than instrumental reasons. Finally, having elaborated our pragmatic genealogy, we close by considering how this genealogy should affect our commitment to moral universalism and how it can complement the methods of Anderson and Kitcher. It is a striking fact from reverse mathematics that almost all theorems of countable and countably representable mathematics are equivalent to just five subsystems of second order arithmetic. The standard view is that the significance of these equivalences lies in the set existence principles that are necessary and sufficient to prove those theorems. In this article I analyse the role of set existence principles in reverse mathematics, and argue that they are best understood as closure conditions on the powerset of (...) the natural numbers. Short overview of the From Small Beginnings Project and its relevance for resisting eugenics in contemporary society.

This paper initiates the reverse mathematics of social choice theory, studying Arrow's impossibility theorem and related results including Fishburn's possibility theorem and the Kirman–Sondermann theorem within the framework of reverse mathematics. We formalise fundamental notions of social choice theory in second-order arithmetic, yielding a definition of countable society which is tractable in RCA0. We then show that the Kirman–Sondermann analysis of social welfare functions can be carried out in RCA0. This approach yields a proof of Arrow's theorem in RCA0, and (...) thus in PRA, since Arrow's theorem can be formalised as a Π01 sentence. Finally we show that Fishburn's possibility theorem for countable societies is equivalent to ACA0 over RCA0. (shrink)

In recent decades, interest in non-monogamous intimate relationships has grown rapidly. Polyamory, relationship anarchy, consensual or ethical non-monogamy, and more have become popular in academic and public discourse. These practices destabilize the privileging of heterosexual nuclear families and the assumption that romantic coupledom is the ultimate form of love. Non-monogamous approaches flout cultural norms of exclusivity by avowing that intimacy is compatible with multiple dyadic and/or multi-party relationships. O objetivo do presente artigo é apresentar o conceito de “motivos básicos religiosos” no pensamento de Herman Dooyeweerd. Em primeiro lugar, será apresentado a concepção de religião em Dooyeweerd e, em seguida, serão apresentados o conceito e o desenvolvimento dos “motivos básicos religiosos” no pensamento ocidental. O quarto volume da obra "Ordem e História" de Eric Voegelin, intitulado de "A Era Ecumênica", marca a última mudança no pensamento do filósofo alemão. Voegelin rejeita uma concepção linear da história e sugere que as "irrupções espirituais" das civilizações se tornem o objeto de análise para identificar a "ordem da história". A partir disso, Voegelin rejeita os sistemas imanentistas da modernidade, notadamente, ideologias, como "revoltas egofânicas" que trazem desequilíbrio no Intermédio ou "metaxia" entre o cosmos e o além. O (...) objetivo do presente artigo é identificar a concepção de história e a crítica às ideologias modernas na obra "A Era Ecumênica" de Eric Voegelin. Adota-se metodologia exploratória e abordagem qualitativa na investigação do objetivo proposto. O trabalho conclui que, apesar da importante crítica voegiliniana à perda de fundamento transcendente da política moderna, a filosofia política do "último Voegelin" de "A Era Ecumênica" tem pouco a dizer sobre a política concreta, revelando-se uma filosofia da consciência apolítica em sentido normativo. Herman Dooyeweerd pode nos ajudar a refletir sobre política e sociedade na medida em que nos faz reconhecer princípios estruturais na realidade criada por Deus que estruturam cada esfera e relação social em seu âmbito de soberania. Reverse mathematics studies which subsystems of second order arithmetic are equivalent to key theorems of ordinary, non-set-theoretic mathematics. The main philosophical application of reverse mathematics proposed thus far is foundational analysis, which explores the limits of different foundations for mathematics in a formally precise manner. This paper gives a detailed account of the motivations and methodology of foundational analysis, which have heretofore been largely left implicit in the practice. It then shows how this account can be fruitfully applied in the (...) evaluation of major foundational approaches by a careful examination of two case studies: a partial realization of Hilbert’s program due to Simpson [1988], and predicativism in the extended form due to Feferman and Schütte. -/- Shore [2010, 2013] proposes that equivalences in reverse mathematics be proved in the same way as inequivalences, namely by considering only omega-models of the systems in question. Shore refers to this approach as computational reverse mathematics. This paper shows that despite some attractive features, computational reverse mathematics is inappropriate for foundational analysis, for two major reasons. Firstly, the computable entailment relation employed in computational reverse mathematics does not preserve justification for the foundational programs above. Secondly, computable entailment is a Pi-1-1 complete relation, and hence employing it commits one to theoretical resources which outstrip those available within any foundational approach that is proof-theoretically weaker than Pi-1-1-CA0. In the Foundations of Mathematics, Ramsey attempted to amend Principia Mathematica’s logicism to meet serious objections raised against it. While Ramsey’s paper is well known, some questions concerning Ramsey’s motivations to write it and its reception still remain. This paper considers these questions afresh. First, an account is provided for why Ramsey decided to work on his paper instead of simply accepting Wittgenstein’s account of mathematics as presented in the Tractatus. Secondly, evidence is given supporting that Wittgenstein was not moved (...) by Ramsey’s objection against the Tractarian account of arithmetic, and a suggestion is made to explain why Wittgenstein reconsidered Ramsey’s account in the early thirties on several occasions. Finally, a reading is formulated to understand the basis on which Wittgenstein argues against Ramsey’s definition of identity in his 1927 letter to Ramsey. (shrink)

Herman Dooyeweerd (1894-1977) foi um filósofo neerlandês que, em diálogo com a filosofia alemã e o pensamento neocalvinista, desenvolveu uma reflexão original sobre as leis e a ordem do cosmos. A filosofia de Dooyeweerd é conhecida como “Filosofia da Ideia de Lei” ou “Filosofia da Ideia Cosmonômica”. A partir de sua teoria modal – que identifica quinze aspectos ônticos em que coisas concretas, eventos, relações e esferas sociais funcionam ou existem – Dooyeweerd desenvolveu uma filosofia político-social crítica às teorias sociais (...) individualistas e universalistas. O problema da presente pesquisa é: que objeto teórico caracteriza a filosofia político-social de Herman Dooyeweerd? A hipótese de investigação é que a preocupação político-social dooyeweerdiana diz respeito ao “problema da ordem”, i.e., a identificação teórica da ordem político-social nos limites das normas transcendentais divinas. O objetivo é analisar a concepção de Herman Dooyeweerd sobre a ordem político-social. Argumenta-se que a filosofia política de Dooyeweerd nem é nem se preocupa em ser comunitarista. O interesse de Herman Dooyeweerd é apreender teoricamente, a partir da análise da estrutura dos modos de experiência, quais são os princípios, as estruturas, as funções e a natureza das coisas, dos eventos e das relações e esferas sociais. Dooyeweerd busca compreender a estrutura típica de cada relação social, a fim de compreender os princípios de uma ordenação política plural e harmoniosa. Terms for consciousness, used with a cognitive meaning, emerged as count nouns in the 17th century. This transformation repeats an evolution that had taken place in late antiquity, when related vocabulary, used in the sense of conscience, went from being mass nouns designating states to count nouns designating faculties possessed by every individual. The reified concept of consciousness resulted from the rejection of the Scholastic-Aristotelian theory of mind according to which the mind is not a countable thing, but a pure (...) potentiality. This rejection was motivated by an acute sense of the mind’s fallible subjectivity. While conditioned by recent historical events, the 17th century’s pervasive sense of subjectivity also reveals a heavy debt to Hellenistic philosophy, which had been recently rediscovered. But whereas Hellenistic thought, mistrustful of theoria, only reifies conscience, early modern thinking, more mistrustful of praxis and seeking its grounding in theoria, goes a step further and reifies consciousness. Partly modeled on theological ideas, the resulting concept of consciousness is plagued by paradoxes that have becomes notorious for their intractability. But essentially the same model of consciousness underwrites contemporary theory, embroiling contemporary debates in the same controversies that dominated the 17th century. Sidestepping these difficulties by returning to the Scholastic-Aristotelian theory of mind would be a tall order, but it is not impossible. Alfred North Whitehead's theory of consciousness offers an example. His novel theory of time enables Whitehead to rehabilitate the Aristotelian concept of passive mind in a wholly naturalistic way. Alfred Tarski was one of the greatest logicians of the twentieth century. His influence comes not merely through his own work but from the legion of students who pursued his projects, both in Poland and Berkeley. This chapter focuses on three key areas of Tarski's research, beginning with his groundbreaking studies of the concept of truth. Tarski's work led to the creation of the area of mathematical logic known as model theory and prefigured semantic approaches in the philosophy of language (...) and philosophical logic, such as Kripke's possible worlds semantics for modal logic. We also examine the paradoxical decomposition of the sphere known as the Banach–Tarski paradox. Since the publication of the Remarks on the Foundations of Mathematics, Wittgenstein’s interpreters have endeavored to reconcile his general constructivist/anti-realist attitude towards mathematics with his confessed anti-revisionary philosophy. In this article, the author revisits the issue and presents a solution. The basic idea consists in exploring the fact that the so-called “non-constructive results” could be interpreted so that they do not appear non-constructive at all. The author substantiates this solution by showing how the translation of mathematical results, given by the (...) possibility of translation between logics, can be seen as a tool for partially implementing the solution Wittgenstein had in mind. Alvin Plantinga has famously argued that the naturalist who accepts evolutionary theory has a defeater for all of her beliefs, including her belief in naturalism and evolution. Hence, he says, naturalism, when conjoined with evolution, is self defeating and cannot be rationally accepted. This is known as the evolutionary argument against naturalism (EAAN). However, Tyler Wunder (Religious Studies 51:391– 399, 2015) has recently shown that if the EAAN is framed in terms of objective probability and theism is assumed to be (...) non-contingent, then either theism is necessarily false or the EAAN is unsound. Neither option is attractive to the proponent of the EAAN. Perry Hendricks (Religious Studies 1–5, 2018) has responded to Wunder’s criticism, showing that the EAAN can be salvaged and, indeed, strengthened, by framing it in terms not of naturalism (N), but of a proposition that is entailed by N that is also consistent with theism. We will show that once Hendricks’ solution to Wunder’s objection is accepted, a puzzle ensues: if the EAAN provides the naturalist with a defeater for all of her beliefs, then an extension of it appears to provide God with a defeater for all of his beliefs. After bringing out this puzzle, we suggest several ways in which the proponent of the EAAN might solve it, but also show some potential weaknesses in these purported solutions. Whether the solutions to the puzzle that we consider ultimately succeed is unclear to us. (Translation: the authors disagree. One author thinks that the solutions (or,at least, some of them) that we consider do solve the puzzle while the other author does not.) Discussions of sexual ethics often focus on the wrong of treating another as a mere object instead of as a person worthy of respect. On this view, the task of sexual ethics becomes putting the other’s subjectivity above their status as erotic object so as to avoid the harms of objectification. Ward and Anderson argue that such a view disregards the crucial, moral role that erotic objecthood plays in sexual encounters. Important moral features of intimacy are disclosed through the (...) experience of being an erotic object for another, as well as in perceiving another as an erotic object. Drawing on phenomenology, especially the insights of Simone de Beauvoir, Ward and Anderson argue that erotic encounters are shaped by the human condition of ambiguity, where being an object for others is intertwined with bodily agency. Because sexual agency is complex in this way, theories of sexual ethics and responsibility must widen their focus beyond transparent communication and authoritative expressions of will. (shrink)

No capítulo 1 da dissertação “A Colônia de Formigas está Consciente?”, intitulado “O Monismo Nageliano e a Composição Material” examinamos a premissa da Composição Material, a qual estabelece que a consciência depende do modo de disposição material das entidades físicas básicas (átomos, elétrons, etc.), na composição do organismo. Ou seja, a experiência consciente de um sistema vivo se encontra estreitamente conectada com a forma em que seus componentes físicos estão relacionados. Isso significa que cada organismo terá um processo diferente de (...) interação desses componentes formando, então, uma mente subjetiva. As diferenças entre um e outro são em grau. Assim, é possível que haja estruturas com níveis alto, baixo, ausente, e até mesmo intermediários de consciência. E cada nível, por sua vez, corresponde a uma relação específica entre parte e todo, se é um sistema orgânico, ou se está entre o orgânico e o não orgânico. Durante o desenvolvimento embrionário, por exemplo, pode existir um momento fronteiriço entre a individualidade e a não-individualidade (ou ser um agregado celular), um momento em que somos incapazes de determinar quando há um organismo. Nesta linha, a consciência também seria indeterminada. Como desconhecemos a relação exata dos componentes físicos para constituir o todo, temos que considerar a consciência como uma propriedade imprecisa do sistema biológico. O Problema da Composição envolve, portanto, a inconsistência do conceito de organismo. Em linhas gerais, se a noção de indivíduo é vaga, por sua vez, a de consciência também será. Por conseguinte, a correlação entre consciência fenomenológica e organização material torna o próprio conceito de mente em uma propriedade imprecisa da composição. Assim, no presente capítulo, esmiuçamos cada uma das quatro premissas que fundamentam o Pampsiquismo: composição material, antirreducionismo, antiemergentismo e realismo. E, em seguida analisamos cada uma dessa premissas como parâmetros para verificar se uma colônia de formigas pode ser um sujeito experiencial. Supomos que, se a colônia estiver estruturada como um indivíduo genuíno, ela terá alguma fenomenalidade. No entanto, não sabemos de que tipo. Por fim, elucidamos como o chamado Problema da Combinação se aplica à colônia de insetos sociais e quais implicações disso. (shrink)

Pretende-se relacionar tais usos não apenas com a argumentação interna presente nos textos do físico alemão, mas também com o contexto histórico, conflitos e debates entre as diversas interpretações da teoria dos quanta durante a primeira metade do século XX. Faremos, inicialmente, uma apresentação geral da teoria quântica e da presença da filosofia na obra de Heisenberg e, em seguida, um estudo de (...) caso da apropriação que Heisenberg fez do pensamento de Leucipo, Demócrito, Heráclito, Platão e Aristóteles. Recent accounts of coercion can be mapped onto two different axes: whether they focus on the situation of the coercee or the activities of the coercer; and whether or not they depend upon moral judgments in their analysis of coercion. Using this analysis, I suggest that almost no recent theories have seriously explored a non-moralized, coercer-focused approach to coercion. I offer some reasons to think that a theory in this underexplored quadrant offers some important advantages over theories confined to the (...) other quadrants. In particular I suggest that much of our interest in coercion depends on facts about the coercer, such as the sorts of powers coercers must possess to be able to coerce, and on the coercer's intention in using those powers to constrain or alter the coercee's activities. Although Whitehead’s particular style of philosophizing--looking at traditional philosophical problems in light of recent scientific advances--was part of a trend that began with the scientific revolutions in the early 20th century and continues today, he was marginalized in 20th century philosophy because of his outspoken defense of what he was doing as “metaphysics.” Metaphysics, for Whitehead, is a cross-disciplinary hermeneutic responsible for coherently integrating the perspectives of the special sciences with one another and with everyday experience. The program of such (...) a meta-discipline is challenging to philosophical orthodoxy because it enlarges, rather than narrows, the range of empirical evidence that philosophy must acknowledge. This places Whitehead’s philosophy in a perennial tradition that seeks to resolve fundamental antinomies through synthesis and reconciliation rather than reduction or elimination. (shrink)

The authors argue that the consciousness debate inhabits the same problem space today as it did in the 17th century. They attribute the lack of progress to a mindset still polarized by Descartes’ real distinction between mind and body, resulting in a standoff between humanistic and scientistic approaches. They suggest that consciousness can be adequately studied only by a multiplicity of disciplines so that the paramount problem is how to integrate diverse disciplinary perspectives into a coherent metatheory. Process philosophy is (...) well qualified to attempt such a synthesis. The rationale for the volume is summed up in the book's unifying thesis: normal, focal-attentive consciousness is not the sui generis phenomenon it is usually taken to be, but part of a wider spectrum of experience (including marginal, deviant, and non-human experience) that can only be studied by approaches as diverse as phenomenology, psycho- and neuropathology, biology, and zoology. It provides an overview of the different approaches within distributed cognition and discussion of the value of a distributed cognitive approach to the humanities.

In 2008 the authors held Involving Interface, a lively interdisciplinary event focusing on issues of biological, sociocultural, and technological interfacing (see Acknowledgments). Inspired by discussions at this event, in this article, we further discuss the value of input from neuroscience for developing robots and machine interfaces, and the value of philosophy, the humanities, and the arts for identifying persistent links between human interfacing and broader ethical concerns. The importance of ongoing interdisciplinary debate and public communication on scientific and technical advances (...) is also highlighted. The essay has been written to contribute to the debate on Dooyeweerd’s social philosophy. The goal is to argue that the central focus of his social philosophy is the “problem of order,” not communitarian issues. This article emphasizes that Dooyeweerd’s social theory was not oriented by communitarian concerns, but in comprehending the relation between creational order and social order.

In this paper we offer a new argument for the existence of God. We contend that the laws of logic are metaphysically dependent on the existence of God, understood as a necessarily existent, personal, spiritual being; thus anyone who grants that there are laws of logic should also accept that there is a God. We argue that if our most natural intuitions about them are correct, and if they are to play the role in our intellectual activities that we take (...) them to play, then the laws of logic are best construed as necessarily existent thoughts -- more specifically, as divine thoughts about divine thoughts. We conclude by highlighting some implications for both theistic arguments and antitheistic arguments. (shrink)

From the outset, critical social theory has sought to diagnose people’s participation in their own oppression, by revealing the roots of irrational and self-undermining choices in the complex interplay between human nature, social structures, and cultural beliefs. As part of this project, Ideologiekritik has aimed to expose faulty conceptions of this interplay, so that the objectively pathological character of what people are “freely” choosing could come more clearly into view. The challenge, however, has always been to find a way of (...) doing this without arrogantly assuming special access to what is good for people. And this danger of paternalism is one to which social theorists have all too often fallen prey. In this brief essay, I focus on contemporary instances of clearly self-defeating behavior in contexts of complex choices. I begin by discussing a recent attempt to diagnose and solve these failures of choices, namely the public policy recommendations of behavioral economist Richard Thaler and reform-minded legal theorist Cass Sunstein. Their influential “libertarian paternalist” approach is particularly interesting, both in what it includes (attention to the socially constructed nature of choice situations and the roots of the problems in human nature) and in what it leaves out (an understanding of the social construction of human nature and an adequate appreciation of the value of autonomy). After discussing it, I consider a broadly perfectionist alternative, to the effect that the problem lies in a failure to adequately appreciate the importance of developing autonomy. I then turn to sketching the outlines of a new approach, based on the concept of “autonomy gaps,” which approaches overly demanding policies in relational and action-theoretical terms. In the final section, I show how this provides the basis for an analysis both in terms of a critique of ideology and of social pathology. (shrink)

Cross-cultural comparisons face several methodological challenges. In an attempt at resolving some such challenges, Nathan Sivin has developed the framework of “cultural manifolds.” This framework includes all the pertinent dimensions of a complex phenomenon and the interactions that make all of these aspects into a single whole. In engaging with this framework, Anna Akasoy illustrates that the phenomena used in comparative approaches to cultural and intellectual history need to be subjected to a continuous change of perspectives. Writing about comparative history, (...) Warwick Anderson directs attention to an articulation between synchronic and diachronic modes of inquiry. In addition, he asks: If comparative studies require a number of collaborators, how does one coordinate the various contributors? And how does one ensure that the comparison is between separate entities, without mutual historical entanglement? Finally, how does comparative history stack up against more dynamic approaches, such as connected, transnational, and postcolonial histories? Gérard Colas, for his part, claims that comparisons cannot allow one to move away from the dominant Euroamerican conceptual framework. Should this indeed be the case, we should search for better ways of facilitating a “mutual pollination” between philosophies. Finally, Edmond Eh first asserts that Sivin fails to recognize the difference between comparisons within cultures and comparisons between cultures. According to the most popular theories of intentionality, a family of theories we will refer to as “functional intentionality,” a machine can have genuine intentional states so long as it has functionally characterizable mental states that are causally hooked up to the world in the right way. This paper considers a detailed description of a robot that seems to meet the conditions of functional intentionality, but which falls victim to what I call “the composition problem.” One obvious way to escape (...) the problem (arguably, the only way) is if the robot can be shown to be a moral patient – to deserve a particular moral status. If so, it isn’t clear how functional intentionality could remain plausible (something like “phenomenal intentionality” would be required). Finally, while it would have seemed that a reasonable strategy for establishing the moral status of intelligent machines would be to demonstrate that the machine possessed genuine intentionality, the composition argument suggests that the order of precedence is reversed: The machine must first be shown to possess a particular moral status before it is a candidate for having genuine intentionality. In this chapter, I describe my “post-diagnosis” experiences as the parent of an autistic child, those years in which I tried, but failed, to make sense of the overwhelming and often nonsensical information I received about autism. I argue that immediately after being given an autism diagnosis, parents are pressured into making what amounts to a life-long commitment to a therapy program that (they are told) will not only dramatically change their child, but their family’s financial situation and even their (...) entire mode of existence. Moreover, despite information overload, many treatment programs for autism rely on empty jargon and make completely unrealistic promises, so parents are left feeling overwhelmed and panicked. Even well respected therapy programs encourage parents to spend liberally. Indeed, autistic therapists, who help construct what I refer to as the Culture of Autism, advise parents to commit to a minimum of 35 to 45 hours of intensive therapy every week. The implications are clear: for a parent who works full-time, their autistic child becomes a second full-time job. Autism is big business right now, and therapists are pushing parents to the brink of desperation. So it is not too surprising that there is a desperate cry for a more permanent solution—which is why researchers seek to cure autism. But there are two ways to conceptualize cure. A Therapeutic Cure model (TC) conceives of a cure as a beneficial treatment for the patient that eliminates or ameliorates the harms of the disease or condition. But the notion of a therapeutic cure for autism is highly implausible, given the complexities of autism. Indeed, at this point, the vast majority of researchers have come to the conclusion that the idea of a therapeutic cure for autism is simply a non-starter. Therefore the bulk of research seeking a cure for autism focuses instead on a second approach, which I refer to as the Negative Eugenics Cure model (NEC). With this model, the intention is to eliminate the disease or condition without regard for the health or well-being of the organism carrying the disease or condition. So, with regard to autism, researchers are focusing on identifying genetic markers for autism that can be detected in utero, or in embryos, so that autistic fetuses can be eliminated and autism eradicated by preventing the existence of autistic individuals. I review both models and argue that both fail to provide convincing arguments that the “solution” either offers is desirable. Both rest on the assumption that autism renders a life not worth living which, all things considered, is false. Instead of pushing to cure autism, an idea pervasive in this Culture of Autism, I contend that autistics are individuals with lives worth living. Moreover, rather than expend millions on research to search for the means to eliminate autism, we should instead expend our resources to ensure autistic individuals have access to support they may need. If the phenomenology of autism were better understood and appreciated, the panicked demand for a cure for autism might abate and perhaps autism could be seen as having value in and of its own right. Busca-se apresentar a leitura de MacIntyre sobre o emotivismo moral presente no último capítulo de A Short History of Ethics, suas críticas a essa concepção ética nos capítulos dois e três de After Virtue, os argumentos de Bruce Waller e Nicholas Unwin em defesa de uma reformulação do emotivismo moral e as críticas (...) de John Lemos a essa sugestão. Espera-se que o texto contribua na apresentação dos principais argumentos do debate entre MacIntyre e o emotivismo moral, a fim de servir de orientação para outras discussões na área da metaética. O objetivo do presente artigo é comparar as perspectivas de Friedrich von Hayek e Hannah Arendt sobre a relação entre liberdade e política. A perspectiva de Hayek é chamada de liberdade da política devido a seu pessimismo quanto à capacidade da ação política estatal ampliar a liberdade individual. E a perspectiva de Arendt é chamada de liberdade na política devido a sua aceitação positiva do espaço político enquanto campo para o exercício da ação e da liberdade dos indivíduos. A conclusão (...) é que a liberdade na política pressupõe alguma liberdade da política, mas não se contenta com a liberdade negativa. A concretização da liberdade exige participação nos assuntos públicos e vida ativa na esfera pública. (shrink)

Objetiva-se expor o pensamento de Herman Dooyeweerd (1894-1977), prolífico jusfilósofo holandês, no que diz respeito à maneira como destaca o aspecto jurídico da realidade e formula sua concepção de enciclopédia da ciência do Direito. Problematiza-se em que medida a teoria dooyeweerdiana permite o desenvolvimento de um conceito de Direito relevante para a teoria da decisão judicial. Neste afã, após exposição sintética das bases de seu pensamento, verticaliza-se o estudo do aspecto jurídico da realidade e da noção-base de sua Enciclopédia da (...) Ciência do Direito. Explora-se a original perspectiva filosófica dooyeweerdiana sobre a positivação do direito e a interpretação jurídica, ambas limitadas seja pelo inafastável núcleo distintivo do aspecto jurídico (a retribuição), seja pelo dever de considerar o todo dos aspectos da experiência humana e das esferas sociais envolvidas. Conclui-se que o conceito de enciclopédia jurídica em Dooyeweerd, à luz de uma densa e intrigante filosofia cosmonômica, enriquece sobremaneira a clássica discussão jusfilosófica que envolve o papel do direito positivo e os limites da interpretação jurídica, na medida em que oferece valioso prisma integrativo do aspecto jurídico frente aos demais aspectos da experiência humana, colaborando para uma visão jurídica não reducionista, preservadora da irredutibilidade do Direito e conferidora de limites mais claros à decisão judicial. A pesquisa é qualitativa, eminentemente bibliográfica, tendo sido utilizado o método hipotético dedutivo. (shrink)

A plausible explanation of the wrongfulness of threatening, advanced most explicitly by Mitchell Berman, is that the wrongfulness of threatening derives from the wrongfulness of the act threatened. This essay argues that this explanation is inadequate. We can learn something important about the wrongfulness of threatening (with implications for thinking about coercion) by comparing credible threats to some other claims of impending harm. A credible bluff threat to do harm is likely to be more and differently wrongful than making intentionally (...) false warnings about other sources of harm. This essay surveys some examples to secure this point, shows that Berman's moralized account of their wrongfulness is wanting, and offers the outline of an approach better suited to explain the wrongfulness of threatening.1. In The Idea of Justice, Amartya Sen, among other things, discusses certain qualities any adequate theory of justice ought to incorporate. Two important qualities a theory of justice should account for are impartiality/objectivity and sensitivity to consequences. In order to motivate his discussion of sensitivity to consequences, Sen discusses the debate between Krishna and Arjuna from the religio-philosophical Hindu text the Bhagavad Gita. According to Sen, Arjuna represents a sensitivity to consequences while Krishna is an archetypal deontologist. In this paper (...) it will be argued that Sen's interpretation of the Gita is inaccurate. Further, a more adequate interpretation will be presented. What will be of significance is that the more adequate interpretation actually demonstrates the importance of an impartial spectator in moral reasoning. Finally, there will be a discussion of some lessons that can be taken from the Gita regarding justice generally. (shrink)

This article compares David Lewis’s understanding of counterfactuals with a Platonic theory of counterfactual truthmakers. By pointing to some weaknesses in Lewis’s theory, it will highlight some of the strengths of the Platonic theory. The article will progress in the following way. First, I present David Lewis’s understanding of counterfactuals, and discuss some problems the theory has. Next, I discuss Platonic truthmakers, in general, and then show how this applies to counterfactuals. Finally, I discuss the strengths and weaknesses of the (...) There have been many attempts to retire dualism from active philosophic life, replacing it with something less removed from science, but we are no closer to that goal now than fifty years ago. I propose breaking the stalemate by considering marginal perspectives that may help identify unrecognized assumptions that limit the mainstream debate. Comparison with Whitehead highlights ways that opponents of dualism continue to uphold the Cartesian “real distinction” between mind and body. Whitehead, by contrast, insists on a conceptual distinction: (...) there can no more be body without mind than mind without body (at least at the level of ultimate constituents). Key to this integration is Whitehead’s understanding that mind, at its most rudimentary, is simply the intrinsic temporality of a physical event. Thus, the resulting form of “panpsychism” is more naturalistic than commonly supposed, and it solves both the composition problem (traditionally fatal to panpsychism) and the “hard problem.”. This study of Ralph Pred’s Onflow (MIT Press, 2005) expands on Pred’s arguments and raises doubts about the viability of phenomenology. Showing that Pred’s method is indeed phenomenological, I validate his interpretations of William James as phenomenologist and his critique of John Searle in light of James, which documents the extent to which the role of habit in the constitution of experience is neglected by philosophers. In explaining habit, however, Pred himself reverts to non-phenomenological models drawn from James’ postulate of (...) psycho-physical parallelism. Habit, like causation, poses an unmet challenge to phenomenological methods. In his critique of Gerald Edelman, Pred notes that Edelman falls prey to a metaphysical bias inherent in modern Indo-European languages. But Pred’s acuity in exposing a latent linguistic bias in phenomenological data is a two-edged sword. Revealing an invisible dependence of appearance on language, it casts doubt on the project of getting beyond language to "appearances-in-themselves.". (shrink)

In this article, I suggest that moksha (liberation or enlightenment) in Advaita Vedanta is best understood psychologically. A psychological understanding is not only consistent with the Advaita Vedanta articulated by Shankara and Gaudapada, but avoids what will be called the problem of jivan mukti. This article will consist of three main parts. First, I will briefly discuss the metaphysics and ontology of Advaita Vedanta. Next, I will present the problem of jivan mukti, and the Advaitin response to the problem. The (...) problem of jivan mukti will lead to the third portion of the article, which is a presentation of what moksha is. At no point in the article will I be arguing the truth of the Advaitin position. Instead, I will be meeting Advaita on its own terms in order to come to some understanding of moksha. (shrink)

Conventional approaches to consciousness assume that our current science tells us within tolerable limits what physical nature is. Because nature so understood cannot explain consciousness as we seem to experience it ourselves, explaining consciousness becomes a problem. One solution is to rethink what consciousness is so that it becomes the sort of thing our current natural science could in principle explain. Whitehead takes the opposite approach, using the existence of consciousness as a clue to what nature must be if it (...) can generate something like consciousness. The justification for this approach can be found in Whitehead’s implicit indictment of descriptive phenomenology. According to Whitehead, the seemingly insoluble problem of explaining consciousness naturalistically is an artifact created by the assumption that consciousness faithfully samples the world, when in fact it obscures the very aspects of nature that are indispensable to understanding how anything, including consciousness itself, could emerge through a physical process.
