En este capítulo se analiza la figura de la obtención vegetal: su alcance, dimensión, requisitos y caracterización frente a otros derechos de propiedad intelectual, para así abordar su ámbito de protección y su tratamiento en el ámbito internacional. Se pretende en este sentido plantear que la tendencia regulatoria en materia de obtenciones vegetales en Colombia no sólo va en contravía de los intereses de los pueblos indígenas, sino además de su patrimonio colectivo que les ha garantizado una gran diversidad que (...) hoy por hoy es sustento de su alimentación. Con lo anterior se lleva a cabo un singular esfuerzo para tratar de forma comprensiva este asunto, buscando la primacía del consentimiento libre, previo e informado de las comunidades potencialmente afectadas. In this book chapter, we study the preventive rule, raised in Ley 1333 de 2009, and the way that environmental law has been building its own rules; escaping from the administrative law and creating their own dogmatic, necessary to achieve its independence as a legal autonomous area. El paper realiza una exposición sobre el concepto y contenido de la nulidad y el restablecimiento del derecho como medio de control a la luz de la Ley 1437 de 2011; enfocándola en asuntos ambientales a través del estudio de la licencia ambiental.

Justo antes de la pandemia por COVID-19, la Organización Mundial de la Salud definió unas prioridades de trabajo para la década 2020-2030. Un grupo interdisciplinario de profesionales de la salud reflexiona sobre estas prioridades, determinando unas categorías de análisis y, desde una perspectiva bioética, analiza cada una de ellas, ve su pertinencia, algunos eventos causales, las implicaciones que pueden tener si no son enfrentadas adecuadamente y hace sugerencias sobre la forma de llevarlas a cabo. En esta primera entrega se analiza (...) el primer grupo de prioridades estratégicas: “poblaciones más sanas”. En las conclusiones se destaca la conveniencia de acometer cada una de ellas de una manera colaborativa, gubernamental y privada; de reestructurar el sector salud con base en estas prioridades, aprovechando la experiencia obtenida en la lucha contra el COVID-19. La relación del ser humano con el medio ambiente también debe cambiar, apelando a la responsabilidad humana por el cuidado del planeta. (shrink)

En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del ordenamiento (...) jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge Agudo Gonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares. However, their critique of the conclusions drawn in Gomez-Lavin & Rachar (2022) is undermined by some issues with the interpretation of the debate and paper. This discussion article clears up those issues, presents new findings from experiments developed in response to Löhr's critiques, reflects on the role of experimental research in the development and refinement of philosophical theories, and adds (...) to Löhr's suggestions about the path forward. The boundary problem is related to the binding problem, part of a family of puzzles and phenomenal experiences that theories of consciousness (ToC) must either explain or eliminate. By comparison with the phenomenal binding problem, the boundary problem has received very little scholarly attention since first framed in detail by Rosengard in 1998, despite discussion by Chalmers in his widely cited 2016 work on the combination problem. However, any ToC that addresses the binding problem must also address the boundary problem. (...) The binding problem asks how a unified first person perspective (1PP) can bind experiences across multiple physically distinct activities, whether billions of individual neurons firing or some other underlying phenomenon. To a first approximation, the boundary problem asks why we experience hard boundaries around those unified 1PPs and why the boundaries operate at their apparent spatiotemporal scale. We review recent discussion of the boundary problem, identifying several promising avenues but none that yet address all aspects of the problem. We set out five specific boundary problems to aid precision in future efforts. We also examine electromagnetic (EM) field theories in detail, given their previous success with the binding problem, and introduce a feature with the necessary characteristics to address the boundary problem at a conceptual level. Topological segmentation can, in principle, create exactly the hard boundaries desired, enclosing holistic, frame-invariant units capable of effecting downward causality. The conclusion outlines a programme for testing this concept, describing how it might also differentiate between competing EM ToCs. (shrink)

Explorar la posibilidad de una nueva micropolítica crítica del signo a partir de Foucault, inspirada en la genealogía nietzscheana, y examinar las políticas y estrategias de alfabetización mediática e informacional necesarias para desarrollar competencias digitales en la transformación del ecosistema mediático es una tarea fundamental del quehacer filosófico actual. La pregunta por la posibilidad de la verdad retorna en un contexto en el que el pluralismo semiótico y la conducción mediática son dos elementos que rigen y ordenan la sociedad actual, (...) sociedad que se caracteriza por la abundancia de información y la omnipresencia de los medios de comunicación como tecnologías de poder. Desgranar su significado y vínculo nos conduce directamente al estudio del poder y el signo en relación con los efectos de la verdad de la posverdad. En este marco conceptual, la obra de Foucault proporciona herramientas teóricas valiosas para afrontar esta problemática. (shrink)

This paper looks into two Scottish Philosophical Societies of the Eighteenth century: The Philosophical Society of Edinburgh, and the Select Society of Edinburgh. I intend to show that they were planned, constructed, and carried out according to the experimental method of natural philosophy, and that it was this factor that enhanced the influence they had in the development of the country. An examination of the minute books, discourses, abstracts and question lists of these societies will provide enough evidence to support (...) the claim that experimental philosophy and its method were the decisive factors for the developing and huge success of these societies. The intuitive distinction between natural and unnatural properties (e.g., green vs. grue) informs our theorizing not only in fundamental physics, but also in non-fundamental domains. This paper develops a reductive account of this broad notion of naturalness that covers non-fundamental properties: for a property to be natural, I propose, is for it to figure in a law of nature. After motivating the account, I defend it from a potential circularity charge. I argue that a suitably broad notion of lawhood can (...) be defined independently of naturalness, if we help ourselves to the notion of a fundamental physical property. I end by showing how the notions of naturalness and lawhood that my account delivers help illuminate a number of other important philosophical notions, like causation, reference/meaning, and rational induction. This paper uses the tools of experimental philosophy to examine the nature of interpersonal normativity in collective action, focusing on cases of immoral collective action and collective action by friends. The results of our two studies, which expand on recent empirical interventions into longstanding debates in social ontology, demonstrate that according to our everyday judgments there are interpersonal obligations in cases of collective action, even when immoral, and that, while friendship elicits judgments of togetherness, it does not affect the norms (...) of collective action. We also situate these results in the philosophical literature and discuss their consequences for a “pluralism” about sociality. (shrink)

Quadruple Helix Collaborations (QHCs) is a cooperation model in which industry, government, academia, and the public interact to innovate. This paper analyses the impact of a training intervention to provide specific knowledge, skills, and attitudes to deal with barriers commonly found in the progress of QHCs. We designed, implemented, and evaluated three training programs in Austrian, Colombian, Danish, and Spanish institutions. We analysed trainees’ (n = 66) and trainers’ (n = 9) perceptions to identify the competencies acquired with the intervention (...) and the approach’s limitations. We used online questionnaires (35 trainees; 9 trainers), semi-structured interviews (10 trainees), and a focus group (6 trainers). Trainees answered positively regarding their self-perception about the impact of the course and highlighted the acquisition of inspiration for their practice (score 4.1 out of 5.0) and knowledge (3.7). In contrast, they perceived that a deeper interaction with other participants (2.7) was challenging. After the courses, 74% of respondents indicated that they know more about how QHCs work in practice, and 86% about collaboration or engagement methods. Moreover, participants plan to be more sensitive towards setting common goals (71%) and power imbalances (63%). Trainers’ perceptions align with those expressed by participants, except that they considered that the interaction amongst participants during the course was higher. Qualitative analysis of interviews with participants and the focus group with trainers provides more detail about the strengths and weaknesses of the intervention. Our study shows that the collaborative design and implementation of training impact the participant’s learning competencies, with potential implications in their medium- to long-term practice. The thesis, typical among dualists, that there are no necessitation relations between events of consciousness and physical events implies that it is prima facie lucky that in our world the apparently existing psychophysical laws usually match events of consciousness and physical events in a “harmonious” way. The lucky psychophysical laws argument concludes that typical dualism amounts to a psychophysical parallelism that is prima facie too improbable to be true. I argue that an anthropic reasoning in the space of possible worlds (...) makes the appearance of a harmonious match situation unsurprising, and that this is all that is needed for the argument to be harmless to a typical dualist. El artículo aborda el problema de la relación entre el ser humano y la técnica en el mundo actual desde una perspectiva filosófica. Volver a la concepción de la filosofía griega permite concebir hoy el quehacer filosófico como un ejercicio vital, sin fracturas entre el pensamiento y la acción. La patente plasticidad del ser humano evidencia la constitutiva apertura que determina su especificidad y, además, columbra la estrecha vinculación entre técnica, creación y cuidado a partir del acontecimiento del habitar. El (...) cuidado no puede tener lugar sin cierta promoción de un ethos cultural centrado en el miramiento, la asistencia y la preocupación por uno mismo y por el Otro. El olvido de la relación entre la creación y el cuidado conduce a un desequilibrio ethopoiético entre la condición ontológica del ser humano, como ser nacido, finito y vulnerable, y el desarrollo tecnológico, impulsado por la digitalización de la vida y el ascendente papel de las nuevas tecnologías en la sociedad. Advertir y remediar dicho desequilibrio supone repensar la originaria relación entre la creación técnica y el cuidado ético, así como la importancia de la ética para la persistencia de lo orgánico. This essay proposes a reductive account of robust macro-regularities. On the view proposed, regularities can earn their elite scientific status by featuring in good summaries of restricted regions in the space of physical possibilities: our “modal neighborhoods.” I argue that this view vindicates “nomic foundationalism”, while doing justice to the practice of invoking physically contingent generalizations in higher-level explanations. Moreover, the view suggests an explanation for the particular significance of robust macro-regularities: we rely on summaries of our modal neighborhoods when (...) reasoning hypothetically about “agentially accessible” possibilities. Nuestro frenesí de comunicación e información hace que las cosas des- aparezcan y devengan en no-cosas, también llamadas informaciones (Han, 2021: 10). El marco ontológico presente es resultado de un desplazamiento que va del ocaso de las cosas al consumo rápido y frenético de no-cosas. En este entorno intangible el ser humano ya no maneja ninguna cosa. Las no cosas son aquellas cosas puramente intangibles, que no pueden aprehenderse con las manos. Lo único que le queda de las manos al (...) ser humano que habita este entorno son las yemas de los dedos con las que presiona las teclas para jugar con símbolos (Flusser, 2002: 107). ¿Qué efectos contrae este nuevo paradigma vital en el campo de la educación? ¿Qué significa educar en y trabajar con no-cosas? La sociedad del siglo XXI ha sufrido una mutación histórica en lo que respecta a los métodos de producción y los impactos derivados de la generación de información. Este período se caracteriza por su inmersión en el entorno digital, donde los individuos, como ciudadanos, se encuentran bajo la manipulación, por un lado, de sus datos mediante técnicas de vigilancia y, por otros, expuestos a cámaras de resonancia mediática. Este panorama plantea desafíos significativos en cuanto a la manera en que interactúan (...) con la información y cómo esta afecta sus vidas. La relación entre los medios de comunicación y los acontecimientos, además, se encuentra atravesada por el concepto de interpretación, donde la capacidad de comprender y la habilidad para reconstruir narrativas son elementos que determinan la comprensión y el sentido de lo que ocurre en nuestro mundo. Este artículo se propone analizar la reinterpretación del concepto kantiano de crítica como una actitud ética en la obra de Foucault, destacando su relevancia para la hermenéutica crítica contemporánea. Por un lado, se explora cómo la práctica del cuidado de sí se convierte en un medio para “controlar” y “limitar” el poder, permitiendo así el ejercicio constante de la libertad. Esta concepción ética implica una nueva comprensión de la libertad, no como contrapuesta al poder, sino como su antecedente. La reflexión (...) crítica sobre la libertad, la ética y la verdad ofrece la posibilidad de transformarse continuamente a través del trabajo incesante en la construcción y el cultivo de uno mismo. Por otro lado, se presenta un método filosófico crítico basado en la autorreflexión, una ética hermenéutica del cuidado de sí, que abre nuevos horizontes interpretativos para dar forma al yo. “Hay momentos en la vida en los que la cuestión de saber si se puede pensar distinto de como se piensa o percibir distinto de como se ve es indispensable para seguir contemplando o reflexionando” (Foucault, 2003, p. 8). Esta declaración foucaultiana es la que impulsa la voluntad genealógica que presenta este ensayo, así como su pretensión proyectiva para pensar hoy la educación. El momento filosófico crítico consiste en volver sobre las prácticas que día a día llevamos a cabo y (...) configuran nuestras vidas y nuestras instituciones. Este es necesario para realimentar y reorientar la savia de las instituciones, y especialmente la savia de nuestras instituciones académicas, suelo en el cual se teje la sustancia ética que posteriormente dará lugar a la articulación social. Si se aplica el elemento crítico que la actividad filosófica supone a la experiencia de la educación, entendiendo por ella la correlación dentro de una cultura entre campos de saber, tipos de normatividad y formas de subjetividad, podemos preguntarnos: qué es la educación y qué función desempeña hoy con respecto al ejercicio mismo del pensamiento en un contexto atravesado por las nuevas tecnologías y la IA. Quien enseña sin emancipar no solo embrutece, predicaba Joseph Jacotot, sino que también adoctrina. Pasado un siglo y medio desde entonces, el filósofo y esteta francés emérito de la Universidad de París VIII y European Graduate School Jacques Rancière, en un ejercicio característico de la filosofía de la educación, publica en 1987 El maestro ignorante a partir de la experiencia de Jacotot. A lo largo de su vida y producción literaria, Rancière reflexiona concienzudamente sobre la naturaleza del proceso de enseñanza (...) y aprendizaje humano y se pregunta: ¿es posible enseñar? ¿qué decide el alumnado en su proceso de aprendizaje? ¿Cuáles son los límites de la palabra transmitida en el aprendizaje? ¿Es la determinación del saber un ejercicio del poder? ¿Son todos los seres humanos capaces de comprender lo que otros hacen y saben? ¿Qué relación hay entre el poder del maestro y el poder de la palabra? From the refusal of some parents to apply some vaccines to their children, in this work we will show that to act properly it is not enough with a good intellectual justification to validate a belief as accurate, it will be necessary to take into account also the systematic actions in relation to which we are constituted, as well as the feelings that accompany those actions. We begin by exposing the notion of belief that Villoro presents from authors such as (...) Braithwaite and Bain. Next, we briefly explain the topic of the justification of beliefs and then articulate it with some of the controversies related to the application of vaccines. Later, we turned to Hume to show the role of imagination in relation to pleasure and pain in decision making. Finally, we present an outline of the discussion about paternalism in the application of vaccines. (shrink)

In this paper, I defend an epistemological pluralism that moves away from universal and absolute rationality, as well as from a radical and arbitrary relativism, where any criterion is valid for decision making. Such epistemological pluralism maintains that subjects know the world in which they live according to different conceptual schemes. We posit a notion of truth linked to the justification process and practical effectiveness. Then we present the importance of traditional knowledge in the socio-ecological field and relative to complex (...) systems. Finally, we explain the relevance of epistemic equity between traditional and scientific knowledges in order to anticipate consequences and to make decisions less uncertain. (shrink)

In this paper we discuss whether the thesis of Nietzsche’s perspectivism, from an interpretation, could be read in keys of onto-epistemological pluralism. For this, we begin by exposing Nietzsche’s questioning of the notion of rational truth, as well as the universalist and transcendental positions linked to this concept. In the second section we expose some of the main theses of American pragmatism and show that perspectivism is not close to this current of thought. Finally, we present the proposal of ontological (...) and epistemological pluralism and we refer to why Nietzsche’s perspectivism could be articulated with this position and why not. (shrink)

Cette étude défend l’idée que, contrairement à l’opinion de Latour sur la nécessité de laisser de côté l’épistémologie pour traiter de tout ce qui a de la valeur pour la science, Mario Bunge a systématiquement construit une épistémologie détaillée et approfondie. La stratégie argumentative consistera à montrer (a) qu’il est faux que nous n’avons jamais été modernes (b) que l’épistémologie est là pour de bon et (c) que Mario Bunge soutient un réalisme scientifique fort, une version du matérialisme, du systémisme (...) et de l’émergentisme, comportant une dimension morale (il existe des valeurs objectives comme la vérité, la paix et la justice qui méritent d’être étudiées). Ensuite, le réalisme de Bunge rejette la neutralité axiologique rendant les scientifiques responsables de leurs actions. Bunge a toujours été moderne et continue à enrichir ses propres positions. El daño ambiental ha despertado el interés de la doctrina en Colombia, aunque aún no se aborda con rigor y profundidad. La razón, entre otras, es la omisión de los avances que ha dado el derecho comparado, donde la concepción del rol de las instituciones jurídicas va hasta una comprensión integral del daño a partir de la alteración funcional de los sistemas. Existe hoy cierto consenso respecto al deber ser del régimen de responsabilidad aplicable a esta noción integral del daño (...) ambiental, capaz de hacer frente a los componentes del medio natural y a todos los que lo conforman. El libro busca aportar al estudio del daño ambiental desde los avances antes descritos en la materia. (shrink)

Working memory is a foundational construct of cognitive psychology, where it is thought to be a capacity that enables us to keep information in mind and to use that information to support goal directed behavior. Philosophers have recently employed working memory to explain central cognitive processes, from consciousness to reasoning. In this paper, I show that working memory cannot meet even a minimal account of natural kindhood, as the functions of maintenance and manipulation of information that tie working memory models (...) and theories together do not have a coherent or univocal realizer in the brain. As such, working memory cannot explain central cognition. Rather, I argue that working memory merely redescribes its target phenomenon, and in doing so it obfuscates relevant distinctions amongst the many ways that brains like ours retain and transform information in the service of cognition. While this project ultimately erodes the explanatory role that working memory has played in our understanding of cognition, it simultaneously prompts us to evaluate the function of natural kinds within cognitive science, and signals the need for a productive pessimism to frame our future study of cognitive categories. El intento de estas páginas es el de seleccionar dentro de la semántica del miedo que contribuye a organizar la imagen moderna del orden político y jurídico el elemento específico del pánico, en la hipótesis de que este último constituya una diferencia que es asimismo un recurso epistémico. Dicho de un modo directo: si el miedo se presenta como una referencia constitutiva del orden, de su constitución como de su mantenimiento, el pánico parece, en cambio, cargado de un signo contrario; (...) nos habla de la disolución de un agregado dado por supuesto y es inclusivo en el perimetrar los límites y las condiciones de posibilidad. El objetivo es aquel de repasar algunos momentos de la historia del pánico buscando argumentar que el pánico es una pasión política, en el sentido de que se refiere a aquello de lo que la político está hecha, y al mismo tiempo es expresión de un límite "pasional" de la política, en tanto que define políticamente un límite interno. Respecto a tal objetivo, esta aportación no reivindica más que los caracteres de un hilvanado necesitante de un desarrollo ulterior por lo que se refiere no solo a aquello que no se incluye (y es obviamente mucho), sino también a los nudos que de forma conscientemente provisional se indican. Además, se limita a una periodizacion histórica que es de alguna manera preliminar, deteniéndose en el umbral de la fase en la cual el pánico es una palabra de un discurso disciplinar, es parte del objeto de un saber codificado (psicología, sociología, ciencia política), incluso si no desempeña necesariamente un rol apaciguador. Two strong contenders for scalar implicature (SI) computation are the pragmatic and the grammatical theories. While the former sustains that context plays a major role, the latter suggests context is required but is lexically and monotonically constrained (Chierchia 2012). In particular, this paper discusses a processing account for SIs that is dependent on the satisfaction of the Strawsonian presupposition of existence, necessary for the realization of the asymmetric entailment pattern among relevant alternatives. This observation complies with the principles of the (...) grammatical view, for it predicts SIs in the presence of contextually empty domains, unlike the pragmatic account whose necessary access to contextual information will cause propositions with empty domains to always return a truth value false, hence blocking any inference. I present online experimental evidence of an acceptability judgment task and recorded response times of both existential and universal sentences containing entities of three kinds: existent (type-a), non-existent but conceivable (type-b), and non-existent and inconceivable (type-c). The data of 25 Colombian Spanish speaking participants were collected using PsychoPy, powered by Pavlovia. The results suggest SIs are computed in types a and b but relatively unsuccessful in type-c. I conclude that the relevant entailment pattern for implicature computation is the Strawson-entailment relation which, combined with the grammatical account, correctly predicts SIs with non-existent but conceivable entities but avoids inference with inconceivable terms. Gadamer en su conocido Verdad y método y que se pretenda añadir algo nuevo a lo mucho escrito sobre el tema parecería, a primera vista, empresa irrealizable. Que ambas pretensiones inspiren la sólida monografía de María G. Navarro —titulada Interpretar y argumentar— constituye empresa audaz y arriesgada, plena de coraje innovador, que provoca admiración, curiosidad e interés. Contra lo que pudiera parecer a (...) primera vista, el libro contiene un alto componente de originalidad y creatividad, debido a la estratagema metodoló-gica de que se sirve la autora. A saber, una hermenéutica in obliquo, estrategia consistente en interpretar a la hermenéutica gadameriana a través del prisma de la lógica de la argumentación. (shrink)

Los intereses contrapuestos en relación con el manejo, uso, utilización y aprovechamiento de los recursos naturales de los territorios indígenas, generan conflictos ambientales en donde uno de los escenarios privilegiados de expresión de los mismos es el de la consulta previa: cuando se adelanta o por el contrario, cuando aunque sea obligatoria, no se impulsa o se hace de manera inadecuada, es decir, sin el cumplimiento de los requisitos mínimos establecidos.

I defend the hypothesis that the semantic paradoxes, the paradoxes about collections, and the sorites paradoxes, are all paradoxes of reference fixing: they show that certain conventionally adopted and otherwise functional reference-fixing principles cannot provide consistent assignments of reference to certain relevant expressions in paradoxical cases. I note that the hypothesis has interesting implications concerning the idea of a unified account of the semantic, collection and sorites paradoxes, as well as about the explanation of their “recalcitrance”. I also note that (...) it does not necessarily imply that one should not expect the sometimes hoped for “unique” solution to a paradox of these kinds. (shrink)

The presentation of the “dual picture of vagueness” in my earlier work is supplemented here with a number of additional considerations. I emphasize how the picture lends itself naturally to treatments of the contribution of a typical degree adjective to propositional content and to truth conditions. A number of reasonable refinements of the picture are presented, especially concerning occasions of use of a degree adjective in which a class containing a sorites series is somehow involved in content fixing, but in (...) such a way that an extension ultimately gets fixed for the predicate. I also develop the observation that standard theories of the logical and semantic paradoxes rely on the idea that the content-fixing mechanisms for the paradoxical expressions work well in general but fail in some localized cases, and that while standard theories of the sorites paradox are clearly not based on this idea at all, the dual theory is fully based on the idea. Next, I offer a few remarks on some recent theories of vagueness and the sorites that are broadly in the spirit of the dual picture, emphasizing the aspects where the latter compares favorably against those recent theories. Finally, the question whether the dual theory is statable with truth according to the theory itself is considered in more detail than in my earlier presentation. (shrink)

While the Academic sceptics followed the plausible as a criterion of truth and guided their practice by a doxastic norm, so thinking that agential performances are actions for which the agent assumes responsibility, the Pyrrhonists did not accept rational belief-management, dispensing with judgment in empirical matters. In this sense, the Pyrrhonian Sceptic described himself as not acting in any robust sense of the notion, or as ‘acting’ out of sub-personal and social mechanisms. The important point is that the Pyrrhonian advocacy (...) of a minimal conception of ‘belief’ was motivated by ethical concerns: avoiding any sort of commitment, he attempted to preserve his peace of mind. In this article, I argue for a Cartesian model of rational guidance that, in line with some current versions of an agential virtue epistemology, does involve judgment and risk, and thus which is true both to our rational constitution and to our finite and fallible nature. Insofar as epistemic humility is a virtue of rational agents that recognise the limits of their judgments, Pyrrhonian scepticism, and a fortiori any variety of naturalism, is unable to accommodate this virtue. This means that, in contrast to the Cartesian model, the Pyrrhonist does not provide a satisfactory answer to the problem of cognitive disintegration. The Pyrrhonist thus becomes a social rebel, one that violates the norm of serious personal assent that enables the flourishing of a collaborative and social species which depends on agents that, however fallible, are accountable for their actions and judgments. Gravity is the foundation of the current physical paradigm. Due to that gravity is strongly linked to the curvature of space-time, we research that it lacks of a valid physical concept of space-time, nevertheless that from the science philosophy, via substantivalism, it has tried respond. We found that is due to that the gnoseological process applied from the general relativity, necessarily us leads to metaphysic because ontologically space-time is a metaphysical entity. Thus, we arrive to the super substantivalism that from (...) metaphysics gives an answer on space-time rigorously exact with the vision of Einstein on physics. The authors explore the works of a group of Colombian artists of the twentieth century who resort to the references of the Latin American pre-Hispanic world as a plastic strategy of a modern art with strong roots in their own culture. Thus, the Bachué group and the cases of Pedro Nel Gómez and Rómulo Rozo are analyzed as alternatives to the official and prevailing art, with an avant-garde tendency, from a nationalist and indigenist point of view.

Gravity is the curvature of spacetime, the structural property of static gravitational field, a geometric field, in curved coordinates, according the functions guv, that express geometric relations between material events. Course, general relativity is a relational theory, however, gravity, a thinking category, has symetric physical effects with matter. We use, analitic and critic method of reread the general relativity, since the perspective of the history of the science and the philosophy of the science. Our goal is driver the debate on (...) gravity, to the arena of the quantum physics, but without the ballast of the general relativity. We find that through of relativist aether was attempted transform spacetime in a substantia without succes, the consequence was return to problematic geometric field. The philosophy of the science intervenes, and according the best philosophical theory of substantivalism, spacetime is a inmaterial, geometric substantia. Then, the metaphysics arrives to a full solution in the super-substantivalism theory, that affirms: matter arises from geometric spacetime. Thus, it explains consistently the symetric physical effects between spacetime and matter. Surely, this solution is a medieval speculation. Our conclusion is that since general relativity do not defined physically spacetime leads necessarily to philosophical definitions of relationism and substantivalism on spacetime that are unacceptable physically. Therefore, gravity is not the curvature of spacetime. (shrink)

While the philosophers of science discuss the General Relativity, the mathematical physicists do not question it. Therefore, there is a conflict. From the theoretical point view “the question of precisely what Einstein discovered remains unanswered, for we have no consensus over the exact nature of the theory 's foundations. Is this the theory that extends the relativity of motion from inertial motion to accelerated motion, as Einstein contended? Or is it just a theory that treats gravitation geometrically in the spacetime (...) setting?”. “The voices of dissent proclaim that Einstein was mistaken over the fundamental ideas of his own theory and that their basic principles are simply incompatible with this theory. Many newer texts make no mention of the principles Einstein listed as fundamental to his theory; they appear as neither axiom nor theorem. At best, they are recalled as ideas of purely historical importance in the theory's formation. The very name General Relativity is now routinely condemned as a misnomer and its use often zealously avoided in favour of, say , Einstein's theory of gravitation What has complicated an easy resolution of the debate are the alterations of Einstein's own position on the foundations of his theory”, (Norton, 1993). Of other hand from the mathematical point view the “General Relativity had been formulated as a messy set of partial differential equations in a single coordinate system. People were so pleased when they found a solution that they didn't care that it probably had no physical significance” (Hawking and Penrose, 1996). So, during a time, the declaration of quantum theorists:“I take the positivist viewpoint that a physical theory is just a mathematical model and that it is meaningless to ask whether it corresponds to reality. All that one can ask is that its predictions should be in agreement with observation.” (Hawking and Penrose, 1996)seemed to solve the problem, but recently achieved with the help of the tightly and collectively synchronized clocks in orbit frontally contradicts fundamental assumptions of the theory of Relativity. These observations are in disagree from predictions of the theory of Relativity. (Hatch, 2004a, 2004b, 2007). The mathematical model was developed first by Grossmann who presented it, in 1913, as the mathematical part of the Entwurf theory, still referred to a curved Minkowski spacetime. Einstein completed the mathematical model, in 1915, formulated for Riemann ́s spacetimes. In this paper, we present as of General Relativity currently remains only the mathematical model, darkened with the results of Hatch and, course, we conclude that a Einstein ́s gravity theory does not exist. Education for Empire: American Schools, Race, and the Paths of Good Citizenship (Stratton, 2016) is much more than a history book about American education. It is a critical work that provides philosophical undertones that challenge our perception about the imperial roles of the U.S. school system. Stratton very clearly and meticulously presents the intricate relationship between history, civics, and geography within school curricula and textbooks. He shows us how these subjects have been manipulated by those in power to promote a (...) hidden agenda. One that instills national pride, American loyalty, and patriotism, and is designed to turn students into supporters of U.S. imperialism and of their racial and class hierarchies. An example of this is Stratton’s own examination of the content of books like, Complete Geography written in 1899. Stratton claims this text was widely used in American public schools and it explicitly states that, “the Caucasian or white race is most intelligent and most powerful of all races.” Education for Empire: American Schools, Race, and the Paths of Good Citizenship helps us understand why it has taken so much time for people of color, like me, to occupy academic spaces and to begin the dismantling of oppressive governmental and pedagogical systems that have intentionally kept us from having a dignified education. This paper attempts to delineate a kind of realism, which incorporates some anti-realistic insights regarding the perspective, situated, and historical character of our forms of knowing and being in the world, and which resonates with the basic tenets of Christian theism. The first part of the paper analyzes the challenges anti-realism poses to Christian theism, particularly regarding the role, which the doctrine of creation played in securing the correspondence theory of truth as well as the fundamental experience of God as (...) the foundation of order and meaning. Using Heidegger’s hermeneutics in the second part, it is shown that epistemic pluralism can be made compatible with realism. Given that this form of hermeneutic realism still has problems with integrating the transcendence of God, as well as his/ her presence and action in the “world,” the notion of continuous co-creation as the basis for a pluralist realism that is amenable to Christian theism is explored in the final part. When a theory, as the general relativity, linked to special relativity, is foundation of a scientific paradigm, through normal science and academy, scientifics, professionals, professors, students and journals of that scientific community, the paradigm, it self-sustains and reproduces. Thus, the research is obligated and limited to apply the model existent of the paradigm to formulate problems and solve them, without searching new discoveries. This self-protection of the paradigm causes it to end its cycle of life, only after a long time, (...) until that arise unresolved anomalies, some presents since origin, that they finally cause its change by other new paradigm. In this work, we study the most important anomalies that are part of the foundations of general relativity with the goal of promoting the call period of transition that is previous to scientific revolution. We use critical analysis method for rereading the general relativity, from the perspective of the history of science and philosophy of science. We find, the structural and complex anomaly of general relativity based on metaphysical spacetime that produces the metaphysics replaces physics. Also, two internal anomalies their direct consequences. These are: matter curves metaphysical spacetime, and metaphysical spacetime determines the geodesic motion of physical matter. We conclude that general relativity has no valid physical concept of spacetime, therefore of gravity. For these reasons, a new paradigm is needed. (shrink)

Presentamos lo básico de la teoría relativista de la gravitación, con la inclusión de textos originales, de varios papeles, publicados entre 1987 y 2009, por sus autores: S. S Gershtein, A. A Logunov, Yu. M Loskutov y M. A Mestvirishvili junto con las introducciones, resúmenes y conclusiones elaborados por el autor de este papel. Esta es una teoría gauge, compatible con las teorías de la física cuántica de las fuerzas electromagnética, débil y fuerte, que define la gravedad como la cuarta (...) fuerza existente en la naturaleza, como campo estático dotada de la partícula transmisora del gravitón virtual de espines 2 y 0, dentro del espíritu del principio de relatividad de Galilei, en su generalización de la relatividad especial de Poincaré que le permitió a los autores la universalización de que las leyes físicas de la naturaleza se cumplen con independencia de los marcos de referencia donde se apliquen. No obstante, integrada a la teoría Entwurf de Grossmann-Einstein, en su desarrollo ulterior, por parte de estos autores, por lo tanto, preserva las leyes de conservación de la energía-impulso y del impulso angular conjuntamente del campo gravitacional y los demás campos materiales existentes en la naturaleza, en el espaciotiempo efectivo de Riemann, mediante su identidad con el espaciotiempo pseudo Euclídeo de Minkowski. This paper examines a parallel between Aristotle’s account of phantasia and contemporary psychological models of working memory, a capacity that enables the temporary maintenance and manipulation of information used in many behaviors. These two capacities, though developed within two distinct scientific paradigms, share a common strategy of psychological explanation, Aristotelian Faculty Psychology. This strategy individuates psychological components by their target-domains and functional roles. Working memory and phantasia result from an attempt to individuate the psychological components responsible for flexible thought and (...) are thus implicated in most of our robust cognitive processes, from reading comprehension to problem solving. We then present two novel objections which suggest that these capacities cannot explain our ability to engage in flexible thought. To escape the resultant impasse, we survey alternatives and argue that most promising strategies depend on identifying the behaviors attributed to intelligent thought and action. (shrink)

Journal bearings play an important role on many rotating machines placed on industrial environments, especially in steam turbines of thermoelectric power plants. Babbitt damage (BD) and excessive clearance (C) are usual faults of steam turbine journal bearings. This paper is focused on achieving an effective identification of these faults through an intelligent recognition approach. The work was carried out through the processing of real data obtained from an industrial environment. In this work, a feature selection procedure was applied in order (...) to choose the features more suitable to identify the faults. This feature selection procedure was performed through the computation of typical testors, which allows working with both quantitative and qualitative features. The classification tasks were carried out by using Nearest Neighbors, Voting Algorithm, Naïve Associative Classifier and Assisted Classification for Imbalance Data techniques. Several performance measures were computed and used in order to assess the classification effectiveness. The achieved results (e.g., six performance measures were above 0.998) showed the convenience of applying pattern recognition techniques to the automatic identification of BD and C. (shrink)

Einstein structured the theoretical frame of his work on gravity under the Special Relativity and Minkowski´s spacetime using three guide principles: The strong principle of equivalence establishes that acceleration and gravity are equivalents. Mach´s principle explains the inertia of the bodies and particles as completely determined by the total mass existent in the universe. And, general covariance searches to extend the principle of relativity from inertial motion to accelerated motion. Mach´s principle was abandoned quickly, general covariance resulted mathematical property of (...) the tensors and principle of equivalence inconsistent and it can only apply to punctual gravity, no to extended gravity. Also, the basic principle of Special Relativity, i.e., the constancy of the speed of the electromagnetic wave in the vacuum was abandoned, static Minkowski´s spacetime was replaced to dynamic Lorentz´s manifold and the main conceptual fundament of the theory, i.e. spacetime is not known what is. Of other hand, gravity never was conceptually defined; neither answers what is the law of gravity in general. However, the predictions arise of Einstein equations are rigorously exacts. Thus, the conclusion is that on gravity, it has only the equations. In this work it shows that principle of equivalence applies really to punctual and extended gravity, gravity is defined as effect of change of coordinates although in the case of the extended gravity with change of geometry from Minkowski´s spacetime to Lorentz´s manifold; and the gravitational motion is the geodesic motion that well it can declare as the general law of gravity.
