The debate on the sharing economy in Belgium has been mainly focused on its economic, quantitative, and digital aspects. Given the fact that the adoption of the sharing economy has accelerated lately, this report wanted to contribute to further open up the debate on the adoption of this economy in relation to an aspect that is too little discussed, namely sustainability. Based on some smaller studies, this report identifies different drivers for concrete sustainable sharing economy initiatives to develop that (...) situate themselves on the level of people’s daily life practices, social and cultural developments, and policy developments. Next to these drivers, there were issues detected that interact closely with the further development of this economy. The report ends with a suggestion for more systematic research of the drivers behind the initiation, adoption, and sustaining of sharing economy initiatives and their contributions to a more sustainable Belgian society. Some form of assisted dying (voluntary euthanasia and/or assisted suicide) is lawful in the Netherlands, Belgium, Oregon, and Switzerland. In order to be lawful in these jurisdictions, a valid request must precede the provision of assistance to die. Non-adherence to the criteria for valid requests for assisted dying may be a trigger for civil and/or criminal liability, as well as disciplinary sanctions where the assistor is a medical professional. In this article, we review the criteria and evidence in respect (...) of requests for assisted dying in the Netherlands, Belgium, Oregon, and Switzerland, with the aim of establishing whether individuals who receive assisted dying do so on the basis of valid requests. We conclude that the evidence suggests that individuals who receive assisted dying in the four jurisdictions examined do so on the basis of valid requests and third parties who assist death do not act unlawfully. However, further research on the elements that may undermine the validity of requests for assisted dying is warranted. More research on the reasons why requests for assisted dying are refused is also desirable. (shrink)

This article examines the reporting requirements in four jurisdictions in which assisted dying (euthanasia and/or assisted suicide) is legally regulated: the Netherlands, Belgium, Oregon and Switzerland. These jurisdictions were chosen because each had a substantial amount of empirical evidence available. We assess the available empirical evidence on reporting and what it tells us about the effectiveness of such requirements in encouraging reporting. We also look at the nature of requirements on regulatory bodies to refer cases not meeting the legal (...) criteria to either prosecutorial or disciplinary authorities. We assess the evidence available on the outcomes of reported cases, including the rate of referral and the ultimate disposition of referred cases. (shrink)

Belgium has recently extended its euthanasia legislation to minors, making it the first legislation in the world that does not specify any age limit. I consider two strands in the opposition to this legislation. First, I identify five arguments in the public debate to the effect that euthanasia for minors is somehow worse than euthanasia for adults—viz. arguments from weightiness, capability of discernment, pressure, sensitivity and sufficient palliative care—and show that these arguments are wanting. Second, there is another position (...) in the public debate that wishes to keep the current age restriction on the books and have ethics boards exercise discretion in euthanasia decisions for minors. I interpret this position on the background of Velleman’s “Against the Right to Die” and show that, although costs remain substantial, it actually can provide some qualified support against extending euthanasia legislation to minors. In the Netherlands and Belgium, it is lawful for voluntary euthanasia to be offered on the grounds of psychiatric suffering. A recent case that has sparked much debate is that of Aurelia Brouwers, who was helped to die in the Netherlands on account of her suffering from borderline personality disorder. It is sometimes claimed that whether or not a mentally ill person’s wish to die is valid hinges on whether or not that wish is a symptom of the person’s (...) mental disorder. This article addresses the philosophical problems raised by this claim, with a specific focus on the diagnosis of borderline personality disorder. After considering descriptivist and causal conceptualizations of mental disorder, I argue that the current approach to borderline personality disorder in psychiatry precludes the possibility of dissociating the wish to die from the disorder. I then examine the implications of this analysis for the question of whether or not the request for voluntary euthanasia in the case of borderline personality disorder can be considered valid. Ultimately, I conclude that the inability to dissociate the wish to die from the disorder does not invalidate the wish in the case of borderline personality disorder. (shrink)

Finishing this essay exactly one year after the official arrival of the SARS-COV-2 virus in Belgium and the Netherlands—where the cartographers of this essay are currently located—it is safe to say that the COVID-19 pandemic has immensely impacted our day-to-day lives. The pandemic has not only forced us to question various taken-for-granted existential certainties and luxuries provided by a capitalist system out to destroy the earth but has also re-spotlighted post-Enlightenment critiques of the human subject. If these pandemic times (...) are indeed more-than-human, then the clock is ticking for the discipline of philosophical anthropology to face these post-anthropological facts and receive what feminist science studies scholar Donna J. Haraway has aptly called a thorough dose of “epistemological electroshock therapy” (1988, p. 578). Taking Haraway’s foregoing call and the idea of thinking-with the (end of the) Anthropocene seriously, we construct a critical cartography of Emmanuel Levinas’ take on philosophical anthropology in dialogue with other major philosophical anthropologists and feminist new materialists while arguing for a post-anthropology for the Chthulucene. Medical assistance in dying, which includes voluntary euthanasia and assisted suicide, is legally permissible in a number of jurisdictions, including the Netherlands, Belgium, Switzerland and Canada. Although medical assistance in dying is most commonly provided for suffering associated with terminal somatic illness, some jurisdictions have also offered it for severe and irremediable psychiatric illness. Meanwhile, recent work in the philosophy of psychiatry has led to a renewed understanding of psychiatric illness that emphasises the role of the relation between the (...) person and the external environment in the constitution of mental disorder. In this paper, I argue that this externalist approach to mental disorder highlights an ethical challenge to the practice of medical assistance in dying for psychiatric illness. At the level of the clinical assessment, externalism draws attention to potential social and environmental interventions that might have otherwise been overlooked by the standard approach to mental disorder, which may confound the judgement that there is no further reasonable alternative that could alleviate the person’s suffering. At the level of the wider society, externalism underscores how social prejudices and structural barriers that contribute to psychiatric illness constrain the affordances available to people and result in them seeking medical assistance in dying when they otherwise might not have had under better social conditions. Background Consent policies for post-mortem organ procurement (OP) vary throughout Europe, and yet no studies have empirically evaluated the ethical implications of contrasting consent models. To fill this gap, we introduce a novel indicator of governance quality based on the ideal of informed support, and examine national differences on this measure through a quantitative survey of OP policy informedness and preferences in seven European countries. -/- Methods Between 2017–2019, we conducted a convenience sample survey of students (n = 2006) in (...) Austria (AT), Belgium (BE), Denmark (DK), Germany (DE), Greece (GR), Slovenia (SI) and Spain (ES), asking participants about their donation preferences, as well as their beliefs and views about the policy in place. From these measures, we computed indices of informedness, policy support, and fulfilment of unexpressed preferences, which we compared across countries and consent systems. -/- Results Our study introduces a tool for analyzing policy governance in the context of OP. Wide variation in policy awareness was observed: Most respondents in DK, DE, AT and BE correctly identified the policy in place, while those in SI, GR and ES did not. Respondents in opt-out countries (AT, BE, ES and GR) tended to support the policy in place (with one exception, i.e., SI), whereas those in opt-in countries (DE and DK) overwhelmingly opposed it. These results reveal stark differences in governance quality across countries and consent policies: We found a preponderance of informed opposition in opt-in countries and a general tendency towards support–either informed or uninformed–in opt-out countries. We also found informed divergence in opt-in countries and a tendency for convergence–either informed or uninformed–among opt-out countries. -/- Conclusion Our study offers a novel tool for analyzing governance quality and illustrates, in the context of OP, how the strengths and weaknesses of different policy implementations can be estimated and compared using quantitative survey data. Whether we are said to be living in the Anthropocene, the Capitalocene, or are witnessing the start of the Chthulucene, as feminist science studies scholar Donna J. Haraway (2016) would describe the current post-anthropocentric era, there is a demonstratable need for affective, entangled, transversal forms of thinking-doing today. Writing this editorial almost a year after the COVID-19 pandemic erupted, and that as inhabitants of Belgium and South Africa—countries with complex ongoing capitalist-colonial legacies, socio-political presents, and heavily but also differently (...) hit by said pandemic—we more than ever feel that these are times of entwined crisis, chaos, and hardship, overflowing with cravings for pedagogical-philosophical responses that are affirmative, productive, and future-oriented. Reactions that are moreover part theory, part praxis, counter the nihilistic, and are future-focused while still grounded in the present, as to not defer responsibilities to future times (see Geerts & Carstens, 2019). Chris Marker’s portrait of Alexandre Medvedkine in the 1993 film Le tombeau d’Alexandre/The Last Bolshevik is highly instructive of his own relationship to Soviet cinema. Most especially, this difficult or troubled rapport with the antecedents to cinéma vérité in the West (and its protean formal properties, in terms of structure and often satirical-critical commentary) comes forth in the figures he assembles to comment upon Medvedkine’s life work. When Medvedkine’s Scast’e (Le Bonheur/Happiness) (1934) leaked to the West (c.1967), sent like an (...) “SOS” in multiple bottles to various film archives (one by one from deep within the Soviet film world), Marker and SLON received a copy by way of Jacques Ledoux (curator of the Cinémathèque Royale de Belgique, in Belgium). The film opened the floodgates of a retrospective survey of Soviet filmmaking repressed and forgotten other than by remote and distant figures (partisans) who somehow survived the Stalinist purges of the 1930s. Jean Delville was a central participant in the Symbolist movement in France and Belgium at the turn of the twentieth century. His monumental work, L’ Ecole de Platon, made its first public appearance at the 1898 Salon d’Art Idealiste in Brussels. Although two contemporary critics showered it with praise, the work has puzzled many viewers. Why, for example, does the central figure (one assumes Plato) bear a striking resemblance to Jesus as he is traditionally depicted? Why are those gathered (...) around Plato (one assumes his students) shown nude or semi-nude, and in this particular arrangement? And how do the unusual colors, flora, and fauna contribute to the message Delville was seeking to convey? I argue that insights into the work can be gained by connecting it with a set of doctrines that go back to the Renaissance philosopher and translator Marsilio Ficino, and beyond Ficino, to the third-century philosopher Plotinus. This article addresses the Conings case – a Belgian soldier, currently wanted for threatening Belgium’s top virologist Marc Van Ranst and the illegal possession of weapons in a terrorist context. It moreover argues for a more situated analysis of Belgium’s far-right extremism by looking at its complex political climate.

In recent years, Italian Thought has become an influential school of philosophical reflection. This explains the reputation of thinkers like Agamben, Negri, and Esposito far beyond the borders of Italy. Not only has Italian Thought called attention to the crisis of Derridian deconstructive thought in recent years and replaced it with a biopolitical approach, but it also attests to contemporary political issues of key urgency. I aim to clarify this diffusion process with the specific case of Belgium, where two (...) extra factors explain the rise of Italian Thought. The neoliberalisation of the university system renders Belgian universities particularly dependent on Anglo-Saxon research trends, while the political and economic developments of Belgium are a key example of the issues Italian Thought emphasizes. Of all the terms Jean Améry might have chosen to explain the deepest effects of torture, the one he selected was world. To be tortured was to lose trust in the world, to become incapable of feeling at home in the world. In July 1943, Améry was arrested by the Gestapo in Belgium and tortured by the SS at the former fortress of Breendonk. With the first blow from the torturers, he famously wrote, one loses trust in the world. (...) With that blow, one can no l onger be certain that “by reason of written or unwritten social contracts the other person will spare me — and more precisely stated, that he will respect my physical, and with it also my metaphysical, being.” In a vault inside the fortress, beyond the reach of anyone who might help — a wife, a mother, a brother, a friend — it turned out that all social contracts had been broken and torture was possible. The project of “public reason” claims to offer an epistemological resolution to the civic dilemma created by the clash of incompatible options for the rational exercise of freedom adopted by citizens in a diverse community. The present Article proposes, via consideration of a contrast between two classical accounts of dialectical reasoning, that the employment of “public reason,” in substantive due process analysis, is unworkable in theory and contrary to more reflective Supreme Court precedent. Although logical commonalities might be available to (...) pick out from the multitude of particularized accounts of what constitutes “civic order,” no “public reason” so derived could adequately capture - and thus be able to secure in a practical sense - any single determinate civic order, much less one that would be consistent with all citizens' conceptions of public order. Part I of this Article raises a number of issues for consideration relating to the epistemology of law and focuses especially on the concept of public reason and its critique. Part II addresses alternative approaches to legal reasoning suggested by classical accounts of practical reasoning and virtue theory and considers the operation of such legal analysis outside the area of substantive due process; Part III analyzes post-Lawrence case law confirming the dilemma created by the Supreme Court's ambiguous approaches to substantive due process and concludes that only one interpretation - that articulated fully in Washington v. Glucksberg and given lip service in Lawrence v. Texas - provides a method for resolving novel substantive due process challenges that is philosophically sound as well as historically coherent. It is facile and factually incorrect to represent suicide terrorists as simply seeking mass destruction, as demented or believing that they will be rewarded by "seventy-two virgins in paradise". In my book The Myth of the Closed Mind: Understanding How and Why People are Rational I felt it was important to deal with the issue of terrorism by consulting explanatory theories of human behaviour and the substantial research on the strategic pattern of terrorist incidents over the decades, led principally by (...) Professor Robert Pape of Chicago University. -/- To defeat your enemy, you must first understand him. Strangely, we must first grant that, though morally depraved, terrorists are rational: they concoct and execute detailed plans with definite strategic goals in mind. Only once we have granted the terrorist a rational mind can we, in the end, create peace. My argument is that while religion may have a small role in terrorism, it is principally politics, or the logic of territorial control, that is the key to understanding the threat we face. -/- This extract from my book is principally about Al Qaeda, but a similar analysis applies to ISIS, the current greatest threat to our peace in the west. -/- The strategic goal of Al Qaeda was simply to repulse what they saw as foreign intervention. ISIS has the same goal, but in order to continue its growth as a state in the sense of a monopoly of coercion over a given geographical area. -/- ISIS, a rogue state that arose in ungoverned space created unintentionally by foreign intervention in Iraq, is now lashing out at foreign governments that have severely shrunk the territory ISIS occupies. Before October 2015, ISIS confined its terrorism to the goal of extending its territory in Iraq and Syria, and there were no significant ISIS-led or inspired suicide terrorist attacks outside Iraq and Syria. But now, as their territory collapses, they are attacking the countries that have strangled their control of territory in Iraq and Syria: the coalition of western governments – Britain, Belgium, Canada, France, Morocco, Turkey, Russia, the U.S.A. and others – exactly the countries that have recently seen an explosion of suicide terrorism. Evidence from jurisdictions that allow assisted dying is frequently used in the debate about assisted dying in the UK, since it provides important information about how assisted suicide and voluntary euthanasia work in practice. However, in order to interpret these data meaningfully, it is essential that they are understood in the context of the different legal and regulatory frameworks in operation in these countries. -/- The Commission on Assisted Dying has commissioned this expert briefing paper in order to help unpick (...) these complexities, and identify evidence for the effectiveness of the various legal safeguards that have been employed in jurisdictions that allow assisted dying. In the briefing paper the authors identify and explain the features of the legal regimes that regulate assisted dying in four target jurisdictions: the Netherlands, Belgium, Oregon and Switzerland. -/- They explore the evidence for the effectiveness of individual safeguards in each of these regimes in turn. The guide include, as annexes, several independent adaptations of the corresponding European Commission works, freely available via the EU Bookshop as PDF and via SetThings as EPUB, MOBI (Kindle) and PDF. For a “smart”, sensible translation , you should forget not the knowledge acquired at school or university, but the corrective (...) standards. Some people want a translation with the touch of the source version, while another people feel that in a successful version we should not be able to guess the original language. We have to realize that both people have right and wrong, and that their only fault is to present requirement as an absolute truth. Teachers agree at least on this principle: “If a sentence is ambiguous, the translation must also be“. There is another critical, less easy to argue, based on an Italian phrase with particularly strong wording: “Traduttore, traditore“. This critique argues that any translation will betray the author‘s language, spirit, style … because of the choices on all sides. What to sacrifice, clarity or brevity, if the formula in the text is brief and effective, but impossible to translate into so few words with the exact meaning? One could understand this criticism that it encourages us to read “in the text.” It seems obvious that it is impossible to follow this advice into practice. Internationale vergelijkingen vormen een waardvolle bron van inzicht bij het analyseren van maatschappelijke problemen en het beoordelen van beleidsmatige antwoorden op die problemen. Vergelijkend onderzoek levert vaak interessante of nuttige informatie op doordat er verschillen én overeenkomsten worden geconstrueerd, bijvoorbeeld: hoe ‘leefbaar’ is Toronto vergeleken met Berlijn? Zelfs wanneer de definities verschillen en de gebruikte meeteenheden enigszins onnauwkeurig kunnen zijn – bijvoorbeeld “leefbaar voor wie en ten opzichte van wat?” – zijn vergelijkingen leerrijk en aanleiding voor verdere reflectie. Ong, Caroline In February 2014, the Belgian parliament passed an amendment to the Belgian Act on Euthanasia of May 28th, 2002 removing the age limit of those requesting euthanasia provided that they have discerning capabilities and their parents approve. After mentioning briefly the arguments against legalising euthanasia, this article questions the ethical validity of removing the age limit, as well as the presumption that ending lives prematurely allows people to die with dignity. Caring for people who are vulnerable in their (...) suffering is the proper goal of the healing professions, not terminating lives. (shrink)

In recent years, there has been an increasing interest in thedevelopment of ontologically well-founded conceptual models for Information Systems in areas such as Service Management, Accounting Information Systems and Financial Reporting. Economic exchanges are central phenomena in these areas. For this reason, they occupy a prominent position in modelling frameworks such as the REA (Resource-EventAction) ISO Standard as well as the FIBO (Financial Industry BusinessOntology). In this paper, we begin a well-founded ontological analysisof economic exchanges inspired by a recent ontological (...) view on the nature of economic transactions. According to this view, what counts asan economic transaction is based on an agreement on the actions thatthe agents are committed to perform. The agreement is in turn based on convergent preferences about the course of action to bring about. This view enables a unified treatment of economic exchanges, regardless the object of the transaction, and complies with the view that all economictransactions are about services. In this paper, we start developing our analysis in the framework of the Unified Foundational Ontology (UFO). (shrink)
