Moral responsibility for an action can only be ascribed if it allows inferences about the agent. In cases of negligence, such a connection appears absent, as the agent acts in ignorance of readily accessible relevant facts. Yet, we hold individuals accountable for their negligent actions. The literature presents two approaches to resolve this apparent contradiction: Derivative theories trace negligence back to prior culpable misconduct, while non-derivative theories view negligent actions as expressions of blameworthy attitudes. However, there are cases that neither (...) approach can adequately explain. This paper aims to justify the appropriateness of moral blame even in these stubborn instances. Central to such a justification is the manner in which the ignorance arises. Often, it results from the violation of epistemic duties, which obligate us to maintain awareness of the consequences our actions have for others. This misconduct thus establishes the necessary connection between the agent and the negligent action, providing a basis for attributing responsibility. (shrink)

The right to privacy extends only to information through which the persons concerned are identifiable. This assumption is widely shared in law and in philosophical debate; it also guides the handling of personal data, for example, in medicine. However, this essay argues that the dissemination of anonymous information can also constitute a violation of privacy. This conclusion arises from two theses: (1) From the perspective of the affected person, judgments by others about anonymous information refer to its originator, even if (...) outsiders do not know who it is; (2) Our self-understanding is co-constituted by the judgment of others about us. This is a consequence of our social nature. There are certain areas of our lives that we do not want to expose to the gaze of others for our own sake. Therefore, the unauthorized dissemination of information concerning these areas can violate our privacy even if they are anonymous. While the question of the extent of privacy poses a general problem, there are reasons to discuss it in the context of digital medicine. (shrink)

It is a central tenet of ethical intuitionism as defended by W. D. Ross and others that moral theory should reflect the convictions of mature moral agents. Hence, intuitionism is plausible to the extent that it corresponds to our well-considered moral judgments. After arguing for this claim, I discuss whether intuitionists offer an empirically adequate account of our moral obligations. I do this by applying recent empirical research by John Mikhail that is based on the idea of a universal moral (...) grammar to a number of claims implicit in W. D. Ross’s normative theory. I argue that the results at least partly vindicate intuitionism. (shrink)

Are there reasons for loving? How can I promise to love someone? Is there such a thing as unconditional love? Am I responsible for loving or for failing to love someone? Can there be love without idealization? -/- This work sets out to show that many of the questions we raise when philosophizing about love are expressive of confusions about what we talk about when we talk about love. Addressing questions pertaining to philosophical discussions about emotions, personal identity and the (...) meaning of language and morality, the author shows how these confusions can be dissolved by carefully attending to our different conversations about love. Her investigations show that many of the challenges we face when reflecting on love do not have the kind of scientific or strictly philosophical character that would allow us to settle them once and for all. They are moral in character and gain their significance from the questions they raise about the place love has in our own lives. The kind of reflection on the meaning of love suggested in this work does not depend on any new discoveries about the phenomena of love. It is available to anyone who is prepared to reflect on our ways of speaking and to question our preconceptions of love and of philosophy. Through such reflection our understanding of love may continually deepen. (shrink)

In order to articulate an account of erotic love that does not attempt to transcend its personal features, Robert Solomon and Martha Nussbaum lean on the speeches by Aristophanes and Alcibiades in Plato’s Symposium. This leads them to downplay the sense in which love is not only for another person, but also for the good. Drawing on a distinction between relative and absolute senses of speaking about the good, I mediate between two features of love that at first may seem (...) irreconcilable. The first is the sense in which love is deeply personal in character. The second is the sense in which we in love come to articulate ethical demands. With the help of the Diotimian ascent of love that Socrates presents in his speech, I submit that these two can come together in the realization that our personally conditioned responses in love are transformed to accommodate demands that carry an unconditional meaning. One of the standard examples in contemporary moral psychology originates in the works of social psychologist Jonathan Haidt. He treats people's responses to the story of Julie and Mark, two siblings who decide to have casual, consensual, protected sex, as facts of human morality, providing evidence for his social intuitionist approach to moral judgements. We argue that Haidt's description of the facts of the story and the reactions of the respondents as ‘morally dumbfounded’ presupposes a view about moral reasoning that (...) is more substantial than he acknowledges. Drawing on the philosophical work by Iris Murdoch and Cora Diamond, we explore how different descriptions of human morality, sexuality, and family relations engage us in evaluations about distinctive features of human life and language that go deeper than Haidt envisages. Thus, we show the need to attend to the concepts used to describe the facts of human moral psychology and the pictures of morality these concepts reveal about the researcher's own understanding of moral experience. This points to the particular responsibility any researcher into human moral psychology has for ensuring that the descriptions they offer are attuned to the complexities of the lives of those they form theories about and that these do not appear conceptually confounding. Does one’s love for a particular person, when it is pure, also constitute a love of life? The significance of speaking about leading a passionate life, I submit, is found in the spontaneous, embodied character of opening up to and finding meaning in one’s life rather than in heightened fleeting feelings or experiences of meaning that help one forget life’s meaninglessness. I contrast this view with Simone Weil’s suspicion that our passionate attachment to another person is an obstacle to attending (...) to him or her from the distance proper to love and friendship. From that perspective it appears as if the meaning with which personal love endows life is mostly illusory, including the loss of meaning characteristic of grief. I question whether Weil’s view should be seen as an unconditional, though for most unattainable, ideal of love, or if it is rather expressive of a rejection of one of the central features of love: the vulnerability that ensues from the recognition that when we love there are times where we stand in need of the other’s love to be able to embrace life as meaningful. In Axel Honneths Recht der Freiheit (RF) dienen persönliche Beziehungen, zu welchen Honneth neben Familien- und Liebesbeziehungen auch die Freundschaft zählt, der Verwirklichung einer „besondere[n], schwer zu charakterisierende[n] Form von Freiheit“ (RF 233). Diese Behauptung fügt sich ein in die Kernthese des Rechts der Freiheit. Demnach vermochte es die „Freiheit im Sinne der Autonomie des Einzelnen“ innerhalb unzähliger „Vorstellung[en] vom Guten“ als einzige, die moderne Gesellschaft nachhaltig zu prägen, wohingegen alle anderen Werte, die in der Moderne wirkmächtig geworden sind, als (...) „Facette[n] der konstitutive[n] Idee der individuellen Autonomie“ (RF 35) verstanden werden müssen. Wir argumentieren, dass Honneths Erörterung des Werts von Freundschaft in dreierlei Hinsicht sein Ziel verfehlt: Erstens zwingt sie Honneth zu einer radikalen Beschneidung des Freundschaftsbegriffs, indem er einen überzogenen Kontrast zwischen antiken und modernen Konzeptionen von Freundschaft zeichnet. Zweitens marginalisiert Honneth mit seiner Betrachtung andere Axiologien der Freundschaft, welche dieser gewichtige instrumentelle, konstitutive und finale Werte zuweisen. Drittens scheint selbst eine schwächer angelegte These, die den Wert, den Freundschaften für die individuelle Freiheit haben, auf die Stellung eines primus inter pares zurückstuft, immer noch den zentralen Wert, den Freundschaften für uns haben sollten, zu verfehlen. Dadurch wird Honneths Kernthese von der Exklusivität des Wertes der Freiheit für unsere Gesellschaft in Frage gestellt. (shrink)

Auch wenn eine umfassende Darstellung und Einordnung der Epoche, in der sich die Philosophie gerade befindet, der Nachwelt vorbehalten bleibt, so ist bereits absehbar, dass die häufig als »analytische Philosophie« bezeichnete Strömung, die mit dem 20. Jahrhundert einsetzt und sich bis in die Gegenwart erstreckt, zumindest in der normativen Ethik wohl kaum als eine Einheit betrachtet werden wird. Dafür fehlt es an inhaltlicher Übereinstimmung, sind doch die von Thomas Hurka als »Achterbahnfahrt« (Hurka 2004, S. 246) bezeichneten letzten 120 Jahre von (...) Strömungen geprägt, die häufig sowohl die Methodologie als auch die grundlegenden Annahmen der jeweils vorherigen Abschnitte verwerfen. Die ersten Jahrzehnte der Moralphilosophie des 20. Jahrhunderts waren von Positionen gekennzeichnet, die sich trotz aller Verschiedenheit unter dem Dach des Intuitionismus vereinen lassen. Für diese Positionen nahmen normative Themen eine zentrale Stellung ein, und die Frage danach, worin unsere grundlegenden Pflichten bestehen, wurden häufig mit einer »Intuition« genannten Erkenntnisform beantworten. Der Nonkognitivismus, für den die Frage, was wir tun sollen, nicht von der Philosophie beantwortet werden kann, prägte dagegen den Zeitraum von 1930 bis 1950. Es dauerte bis zu den 1970er Jahren, ehe wieder ein verstärktes Interesse an der Ethik aufkam. Die abgebrochenen Diskussionen und verwaisten Positionen wurden freilich nicht einfach fortgeführt, sondern unter anderen Gesichtspunkten betrachtet, was Inhalt und Methode betrifft – hier hat sich insbesondere das von John Rawls in der Moralphilosophie populär gemachte »Überlegungsgleichgewicht« als maßgeblich erwiesen. In this dissertation I discuss the epistemology of ethical intuitionism, in particular the claim that mature moral agents possess self-evident moral knowledge. Traditional intuitionists such as W.D. Ross have claimed that by reflection, we can acquire knowledge of our basic moral duties such as the duty of veracity or benevolence. Recent defenders of intuitionism such as Robert Audi have further developed this theory and argued that adequate understanding can be sufficient for moral knowledge. I criticize this view and argue that (...) such accounts fail to make a convincing case for a foundationalist moral epistemology. Instead, I propose to separate the question of how we acquire moral knowledge from an account that justifies moral beliefs. In response to the first issue, I draw an analogy between our moral intuitions and chosmkian linguistics; in both areas, I argue, human beings possess a universal, unconscious and (partly) inaccessible system of rules that explains how we come to learn language and to make moral judgments. In regards to the justificatory issue, I address recent evolutionary debunking arguments designed to undermine the claim that our moral judgments track stance-independent truths. I try to show that this conclusion only follows under the assumption of an instrumentalist interpretation of moral reasoning which the intuitionist is not forced to accept. (shrink)

The social intuitionist approach to moral judgments advanced by social psychologist Jonathan Haidt presupposes that it is possible to provide an explanation of the human moral sense without normative implications. By contrast, Iris Murdoch’s philosophical work on moral psychology suggests that every description of morality necessarily involves evaluative features that reveal the thinker’s own moral attitudes and implicit philosophical pictures. In the light of this, we contend that Haidt’s treatment of the story about Julie and Mark, two siblings who decide (...) to have casual, protected, and in his view harmless sex, provides a too simplistic picture of what is involved in understanding human morality. Despite his aim to explain the roots of moral judgments, he fails to provide a deeper understanding of morality in two different respects. First, he does so by suggesting that his story contains all the relevant information needed to take a moral stand on it, and by rejecting as irrelevant the wider human context in which questions about sexual and family relations arise. Second, he simplifies the responses of the people who are subject to his experiment by disregarding their various reasons for disapproving and by equating understanding human morality with explaining an impersonal psychological process. Engaging with the philosophical writings of Iris Murdoch, we submit that there are difficulties associated with providing a good description of morality that are intimately connected with difficulties in understanding other human beings. We suggest three senses in which moral philosophical reflection needs to account for our understanding of others: (1) the failure to understand someone is not merely an intellectual failure, but also engages us morally; (2) the moral question of understanding is not limited to the extent to which (...) we understand a particular person, but also presents itself in how we picture difficulties in understanding people; and (3) “philosophical pictures of morality” fundamentally shape the conceptual framework we use to investigate morality, as well as the analysis of morality we find illuminative and satisfactory. Exploring the implications of these claims, we ask what it means to think of others as the same, or as different, from ourselves. We then consider the ethical significance of finding, or not finding, our feet in our encounters with others, dwelling on how the metaphor of movement reveals one way in which we are never at peace in the exploration of morality. Teachers in vocational education face two problems. (1) Learning involves the ability to transcend and modify learned knowledge to new circumstances. How should vocational education prepare students for future, unknown tasks? (2) Students should strive to produce work of good quality. How does vocational education help them develop their faculty of judgment to differentiate between better and worse quality? These two ques- tions are tightly interwoven. The paper compares the didactics of philosophy and sloyd. Both developed independently, but their solutions (...) to how one advances the capacity for reflective judgment are similar. Central to this capacity is not merely devising efficient means to work towards pre-existing aims, but to reflect in practice on what one’s aim are and should be. This implies reflection on what future problems, as well as solutions to them, demand of us cognitively, socially and morally. (shrink)

The normative mechanics of promising seem complex. The strength and content of promissory obligations, and the residual duties they entail upon being violated, have various prima facie surprising features. We give an account to explain these features. Promises have a point. The point of a promise to φ is a promise-independent reason to φ for the promisee’s sake. A promise turns this reason into a duty. This explains the mechanics of promises. And it grounds a nuanced picture of immoral promises, (...) an argument against promissory bare wrongings, and a constraint on theories of why we have promissory obligations at all. (shrink)

Delivery riders became frontline workers who assisted everyone in getting their daily supplies. They transported them to their destinations when the pandemic started, and everyone had to stay home to stop the COVID-19 virus from spreading. Thus, this study explores the experiences, challenges, and coping mechanisms of 15 Female Delivery Riders in Bulacan, Philippines. The study employed Heideggerian Phenomenology and Interpretative Phenomenological Analysis (IPA). Further, the following themes arise: (1) The Realist, (2) The Accommodated, (3) The Vulnerable, and (4) The (...) Determined. These themes highlighted the experiences and challenges faced by the participants. Moreover, it is highly suggested that female employees should be given preferential assistance given their physical capabilities and role in the family. Thus, local government units should provide an alternative source of income that will allow them to have quality time with their family, especially their children. (shrink)
