What is and what ought to be the relationship between empirical research and normative analysis with respect to migration policies? The paper addresses this question from the perspective of political theory, asking about the place of empirical research in philosophical discussions of migration, and, for the most part, leaving to others questions about what role, if any, normative considerations do and should play in empirical research on migration. In The Ethics of Immigration, Joseph Carens’ builds a sophisticated account of justice in immigration based on an interpretation of liberal states’ democratic principles and practices. I dispute Carens’ contention that his hermeneutic methodology supports a broadly liberal egalitarian consensus; instead, the consensus he detects on principles and practices appears because his interpretation presupposes liberal egalitarianism. Carens’ methodology would benefit by engaging with a “hermeneutics of suspicion” that explores the ideological and exclusionary facets of liberal egalitarian principles when applied to (...) immigration. This would contribute to an account of the ethics of immigration that gives more attention to power and interest, mediated through structures of gender, race, and class. (shrink)

Jeder Mensch irrt – ausgenommen der Papst, wenn er Glaubenssätze verkündet. So jedenfalls befand einst das erste Vatikanische Konzil. Nun waren die Kardinäle, so bemerkt Keil frech, selbst keineswegs Träger der päpstlichen Unfehlbarkeit. »Woher wussten sie dann, dass der Papst unfehlbar ist?« Niemand weiß vorher, wann und wo er sich irren wird. Viele Philosophen haben daraus geschlossen, dass Menschen nichts wissen, sondern immer nur vermuten. Das ist aber ein Irrtum, den dieser kluge und kurzweilige Essay aufklärt.

Aunque no es posible ofrecer aquí un análisis detallado de las diferentes cues tionesimplicadas en la teoría de las representaciones en la Modernidad, sí pode mos atender auno de sus aspectos más relevantes, presente en la exposición de Leibniz, Wolff,Baumgarten y Kant, a saber: el reconocimiento progresivo y la vin dicación de unconocimiento específicamente sensible como un tipo específico de conocimiento en lafilosofía escolar alemana del siglo XVIII. A pesar de que Leibniz atribuye al conocimiento claro y confuso el grado (...) más bajo en su esquema de los niveles del conocimiento, tambiénes cierto que su exposición apunta ya a la irre ductibilidad de este ámbito en unconocimiento finito como el humano. Por lo demás, lo confuso aquí adquiere sentido en elsistema del saber en la medida en que Leibniz considera que todos los conocimientos obre cuestiones de hecho, si bien falibles, se encuentran en conexión con la verdad en lamedida en que parti cipan de la misma, al expresar el fundamento último de lo real y sersusceptibles de perfectibilidad en el seno de una subjetividad dinámica que comienza aser entendida como unidad vital. En Wolff y Baumgarten se profundiza en la vía que esabierta ya por Leibniz: la exposición de los niveles de conocimiento en el marco de unaimbricación de la lógica de la representación con una psicología vitalista, en la que sereconocerá la experiencia del sentimiento como expresión subjetiva de la perfectibilidaddel conocimiento humano. Many high-income countries have skill-selective immigration policies, favoring prospective immigrants who are highly skilled. I investigate whether it is permissible for high-income countries to adopt such policies. Adopting what Joseph Carens calls a " realistic approach " to the ethics of immigration, I argue first that it is in principle permissible for high-income countries to take skill as a consideration in favor of selecting one prospective immigrant rather than another. I argue second that high-income countries must ensure that their skill-selective (...) immigration policies do not contribute to the non-fulfillment of their duty to aid residents of low-and middle-income countries. Die Skeptikerin fragt, wie wir ausschließen können, dass all unsere Erlebnisse auf einem umfassenden Traum beruhen. Träfe ihre Befürchtung zu, dann wären alle unsere Meinungen über die äußere Welt falsch, und da wir das nicht ausschließen können, haben wir (so folgert sie) keinerlei Wissen über die Welt. Um dem zu begegnen, könnte man der Skeptikerin vorwerfen, dass sie unsere gemeinsame Sprache missbraucht. Welche Wörter missbraucht sie? Welche Wörter gebraucht sie so anders, dass wir uns um ihre Überlegung nicht scheren müssen? (...) Ich spiele das sprachkritische Manöver gegen die Skeptikerin zunächst anhand des Wissensbegriffs durch (und komme zu dem Ergebnis, dass wir nicht klar genug sagen können, worin die unstrittige Bedeutung des Wortes "Wissen" besteht). Dann versuche ich es mit weniger tiefsinnigen Wörtern wie "Tiger". Wer stets träumt, gebraucht solche Wörter anders als wir, so die Überlegung. Dieser Gedanke funktioniert nur, wenn wir die Existenz von Außenwelt-Dingen voraussetzen dürfen; und diese Voraussetzung bestreitet die Skeptikerin. Daher spiele ich das sprachkritische Manöver zuguterletzt anhand des Traumbegriffs durch. Jemand kann das Wort "Traum" überhaupt nur dann gelernt haben, wenn er manchmal, aber nicht immer geträumt hat. Ergebnis: Entweder ich verstehe das Wort "Traum". Dann träume ich nicht seit jeher. An increasing number of European research projects return, or plan to return, individual genomic research results (IRR) to participants. While data access is a data subject’s right under the General Data Protection Regulation (GDPR), and many legal and ethical guidelines allow or require participants to receive personal data generated in research, the practice of returning results is not straightforward and raises several practical and ethical issues. Existing guidelines focusing on return of IRR are mostly project-specific, only discuss which results to (...) return, or were developed outside Europe. To address this gap, we analysed existing normative documents identified online using inductive content analysis. We used this analysis to develop a checklist of steps to assist European researchers considering whether to return IRR to participants. We then sought feedback on the checklist from an interdisciplinary panel of European experts (clinicians, clinical researchers, population-based researchers, biobank managers, ethicists, lawyers and policy makers) to refine the checklist. The checklist outlines seven major components researchers should consider when determining whether, and how, to return results to adult research participants: 1) Decide which results to return; 2) Develop a plan for return of results; 3) Obtain participant informed consent; 4) Collect and analyse data; 5) Confirm results; 6) Disclose research results; 7) Follow-up and monitor. Our checklist provides a clear outline of the steps European researchers can follow to develop ethical and sustainable result return pathways within their own research projects. Further legal analysis is required to ensure this checklist complies with relevant domestic laws. (shrink)

The issues I raise in this chapter, then, are not unique to cognitive science; but they arise in new and important contexts when connectionism is taken seriously as a model of cognition. In speaking of levels, what is the connection, if there is one, between explanation and ontology? Which, if any, conccpt of reduction is applicable to connectionist systems? I take some initial steps toward a theory of real definition, drawing upon recent developments in higher-order logic. The resulting account allows for extremely fine- grained distinctions (i.e., it can distinguish between any relata that differ in their syntactic structure, while avoiding the Russell-Myhill problem). It is the first account that can consistently embrace three desirable logical principles that initially appear to be incompatible: the Identification Hypothesis (if F is, by definition, G then F is the same as G), Irreflexivity (...) (there are no reflexive definitions) and Leibniz’s Law. Additionally, it possesses the resources to resolve the paradox of analysis. (shrink)

In this paper, we aim to complement and extend Cécile Laborde’s argument against the Swiss minaret ban, which emphasizes the exclusion of Muslim citizens from equal national belonging. We argue that if we take seriously the normativity that is embedded in the Swiss direct democratic context (Carens 2004), especially in its ability to determine the substance of national belonging, then the symbolic exclusion of Muslims from political belonging is more relevant than the former with regard to democratic justice. Section 1 (...) defines basic notions and presents some arguments that were circulated in Swiss public political debate during the referendum campaign. Section 2 will present extant arguments in normative political philosophy about the ban. Section 3 expands our argument, which can be summarized as follows: the double absence of recognition of Muslims as (i) equal autonomous subjects and (ii) as political agents calls into question the legitimacy of the direct democratic process that led to the ban, making it unjust by the standards implicit within democratic practices in Switzerland. It is a remarkable fact that all processes occurring in the observable universe are irre- versible, whereas the equations through which the fundamental laws of physics are formu- lated are invariant under time reversal. The emergence of irreversibility from the funda- mental laws has been a topic of consideration by physicists, astronomers and philosophers since Boltzmann's formulation of his famous \H" theorem. In this paper we shall discuss some aspects of this problem and its connection with the dynamics of space-time, (...) within the framework of modern cosmology. We conclude that the existence of cosmological horizons allows a coupling of the global state of the universe with the local events deter- mined through electromagnetic processes. (shrink)

This paper argues that by overestimating the importance of citizenship rights, the ethics of immigration turns away from the more serious problem of closed borders. Precisely, this contribution is a threefold critique of Carens’ idea that "justice requires that democratic states grant citizenship at birth to the descendants of settled immigrants" (Carens, 2013: 20). Firstly, I argue that by making 'justice' dependent on states and their attributes (birthright citizenship), this idea strengthens methodological nationalism which views humanity as naturally divided into (...) bounded nation-states. Secondly, I analyze its justification and argue that grounding (citizenship) rights on the existence of social connections is logically and morally problematic. Thirdly, I analyze its scope (granting rights to the descendants of the ‘settled’) and its method of implementation (granting citizenship rights automatically ‘at birth’). While from a less sedentarist perspective, no one can be considered ‘settled’ in advance, I will express some doubts that granting citizenship rights is always automatically a way to extend people’s rights. All in all, I argue that by its justification, scope and method of implementation, this idea moves us away from, rather than gets us closer to, an open-borders world. (shrink)

The principal finding of the doctoral research of Cometan (a.k.a. Brandon Reece Taylorian) was that the ways governments, both authoritarian and democratic, use their powers to recognise religions and beliefs and register religious or belief organisations is negatively impacting conditions of freedom of religion or belief. Cometan explored the range of recognition and registration issues plaguing religious freedom and other human rights and discovered that there lacks a definitive set of international standards to address some of the granular topics that (...) are causing registration procedures in particular to become onerous and thus impedimental to the free and legal exercise of religion or belief. Cometan's International Religious Rights and Standards (IRRS) document presents a series of standards for how nation states ought to develop their recognition and registration policies and practices to remain FoRB-compliant. The standards of the IRRS document have been created based on the results of Cometan's PhD research, the thesis for which is titled Religious Freedom and State Recognition of Belief. Cometan's intention is that the IRRS document will encourage international organisations like the OSCE and the United Nations as well as national and international human rights courts such as the ECtHR to establish more detailed and country-specific guidelines to address the breath of registration issues and the recognition issues that often worsen such issues. The Ethics of Immigration, by Joseph Carens, Oxford University Press, 2013. -/- Joseph Carens is arguably the most prominent political theorist to defend open borders, a view which he did much to make intellectually respectable in a famous 1987 article, “Aliens and Citizens: The Case for Open Borders.” In The Ethics of Immigration Carens again defends the open borders view, but with a new rationale. Whereas before he argued that seemingly opposed philosophies provided converging support for open borders, now he (...) bases his case on “democratic principles,” by which he means uncontroversial moral commitments that are widely shared in liberal states. Carens argues that one such commitment is to freedom, which can be understood as “not being the subject of the will of another.” A commitment to such a value would explain why freedom of movement within a state is considered a basic human right. But, Carens asks, if we have a general right to freedom of movement within countries, why not between them? -/- Carens has long noted that despite the attractiveness of open borders at the level of pure justice, it is deeply at odds with how immigration policy is normally viewed. Given this, Carens’ many writings on immigration have long approached it from a second perspective, one that puts aside questions of ideal theory and takes for granted the conventional view that states are entitled to discretionary control over their borders. This second perspective is the dominant one in The Ethics of Immigration, as Carens spends most of the book outlining standards of fair treatment for permanent residents, temporary workers, refugees and other migrants that do not presuppose any commitment to open borders. In this mode Carens offers a revised version of one his most thought-provoking and controversial arguments, defending amnesty for immigrants who first arrive illegally. -/- Carens’ investigation of immigration issues at both the level of ideal justice and the more immediate plane of the debate over amnesty and related issues makes his book unusually rich. It has the rare virtue of being both philosophically rigorous and politically relevant. -/- . (shrink)
