In using brain stimulation technology to suppress an individual’s fear response to a traumatic memory, we are effectively altering that individual’s identity. In this article, I argue that until we learn more, such technology should be available only to patients with objectively debilitating fear responses who give their informed consent. First, I provide an overview of how the technology works. Second, I analyze the artificial, natural, and clinical changes in memory, and explores the ethical concerns associated with altering an individual’s (...) identity. Miriam Schleifer McCormick delineates the limits, or at least one limit, of the ethics of mind. Many theorists, including McCormick herself, have argued that some states of mind are appropriate targets of certain reactive attitudes even if they cannot be directly controlled. McCormick now worries that the scope of agency can be widened too far so that no area of mind is beyond the reach of appropriate assessment and judgement. She begins with the intuition that there is, (...) or ought to be, a domain of the mind that is completely free of normative assessment, where you are safe to let your thoughts and images go wherever they take you without concern that you are doing anything wrong, where praise and shame do not apply. McCormick begins by offering an example of the kind of state she thinks should be beyond normative judgment; she argues that certain kinds of wakeful fantasies are on par with sleeping dreams. If one shares McCormick’s view that there is a “free” domain of the wakeful mind, then what she is doing can be seen as clarifying why such states exempt them from judgment. If one does not share this intuition, then what McCormick is doing can be seen as specifying what criteria would be needed for a kind of state (or domain) to be free in this sense. And then some may argue that no wakeful fantasies satisfy these criteria. McCormick addresses those arguments and argues that if the fantasies as characterized are appropriate targets of normative assessment, then it will be very difficult to exempt dreams of sleep, as well as other exercises of imagination. Of course, some people (like Augustine and surprisingly many others) will not mind this result. McCormick doesn’t think then that is the end of the discussion, stalemate and parting of intuitions, for she argues that a case can be made for the value of having a realm of imagination that is beyond the reach of any kind of judgment. It is largely unethical to sentence individuals who are addicted to drugs to prison. While substance use can be a crime, it must be treated differently from other crimes because addiction is a psychiatric disorder. Prisons are penal institutions. Legitimate goals of penal sanctions include retribution, deterrence, rehabilitation, and incapacitation.[i] Most of these goals do not speak to those with substance use disorder, and incarceration may be counterproductive given the wide availability of drugs and feeble rehabilitation efforts in prison. Further, (...) it may be the case that substance use disorder impairs an addict’s autonomy, calling into question his criminal culpability. Our understanding of substance use disorder has evolved and our prison sentencing practices must do the same. This paper will first provide background on substance use disorder as a psychiatric disorder. Then, the need to focus on rehabilitating rather than punishing those with substance use disorder who commit crimes will be explored. Finally, this paper will address whether an individual with substance use disorder can be considered culpable for any crime—regardless of severity—and whether that individual’s autonomy is impaired due to his addiction. I conclude that culpability should depend on whether the serious crime would have occurred in the absence of the drug addiction. In most cases, it is unethical to sentence an individual with substance use disorder to prison where other options such as home confinement are available. (shrink)

My main aim is to argue that most conceptions of doxastic agency do not respond to the skeptic’s challenge. I begin by considering some reasons for thinking that we are not doxastic agents. I then turn to a discussion of those who try to make sense of doxastic agency by appeal to belief’s reasons-responsive nature. What they end up calling agency is not robust enough to satisfy the challenge posed by the skeptics. To satisfy the skeptic, one needs to make (...) sense of the possibility of believing for nonevidential reasons. While this has been seen as an untenable view for both skeptics and anti-skeptics, I conclude by suggesting it is a position that has been too hastily dismissed. (shrink)

I aim to offer a practical response to skepticism. I begin by surveying a family of responses to skepticism that I term “dogmatic” and argue that they are problematically evasive; they do not address what I take to be a question that is central to many skeptics: Why am I justified in maintaining some beliefs that fail to meet ordinary standards of doxastic evaluation? I then turn to a discussion of these standards of evaluation and to the different kinds of (...) doxastic value to which they appeal. While there is something good about having a true belief and something bad about having a false one, I argue the value of true beliefs is not intrinsic or final. Truth and knowledge are valuable because they contribute to both individual and collective flourishing. But if contributing to flourishing is what ultimately provides truth with its value, then we have discovered another doxastic value. I call this kind of doxastic value “practical.” The practical response addresses the skeptic’s question by claiming that some beliefs can be justified by appealing to their practical, rather than alethic, value. In fleshing out this practical response I contrast it both with dogmatic responses as well as some seemingly similar “practical” alternatives, namely Crispin Wright’s appeals to entitlements and Susanna Rinard’s “pragmatic skepticism.” I end by addressing some objections. This essay is a short but impacting observation of the economy of the Middle Ages in light of recent economic historians’ discoveries: not only are some conventional beliefs such as the absence of a financial and trading economy of the period discredited, but a more nuanced view of feudalism also emerges from such revelations. The new, groundbreaking work of Michael McCormick is pitted against Henri Pirenne’s classic theory; in addition, seminal works by Marc Bloch, S.R. Epstein, and lesser known (...) work by Aron Gurevich provide a more authentic view of Middle-Age economy. Finally, contrary to Marxist historiography, this essay postulates that to some extent feudalism fomented the development of capitalism. (shrink)

The 2017 story of Charlie Gard is revisited. Upon the British High Court’s ruling in favor of the physicians that the infant should be allowed to die without the experimental treatment, the view of the public as well as the opinions of bioethicists and Catholic bishops are divided, interestingly along with a cultural line. American bioethicists and Catholic bishops tend to believe that the parents should have the final say while British/European bioethicists and Catholic bishops in general side with the (...) court’s decision. The paper explores the place of culture in bioethical reasoning between the UK/Europe and the US while claiming that cultural differences are more important than geopolitical or religious differences to understand the bioethical positions of a group. In addition, the authors introduce a decision-making program for handicapped neonates which is developed by the American Jesuit Bioethicist, Richard McCormick, and modified further by the contemporary American Jesuit Bioethicist, Peter A. Clark, in an attempt to see if the program’s normatizing categories can contribute to the culture-laden ethical discussions on Charlie’s case. However, it is admitted that the McCormick-Clark device is borne out of the American and Catholic theological context. (shrink)

ABSTRACTThe contemporary debate over responsibility for belief is divided over the issue of whether such responsibility requires doxastic control, and whether this control must be voluntary in nature. It has recently become popular to hold that responsibility for belief does not require voluntary doxastic control, or perhaps even any form of doxastic ‘control’ at all. However, Miriam McCormick has recently argued that doxastic responsibility does in fact require quasi-voluntary doxastic control: “guidance control,” a complex, compatibilist form of control. In (...) this paper, I pursue a negative and a positive task. First, I argue that grounding doxastic responsibility in guidance control requires too much for agents to be the proper targets for attributions of doxastic responsibility. I will focus my criticisms on three cases in which McCormick's account gives the intuitively wrong verdict. Second, I develop a modified conception of McCormick's notion of “ownership of belief,” which I call Weak Doxastic Ownership. I employ this conception to argue that responsibility for belief is possible even in the absence of guidance control. In doing so, I argue that the notion of doxastic ownership can do important normative work in grounding responsibility for belief without being subsumed under or analyzed in terms of the notion of doxastic control. What is to be learned from the chaotic downfall of the Weimar Republic and the erosion of European liberal statehood in the interwar period vis-a-vis the ongoing European crisis? This book analyses and explains the recurrent emergence of crises in European societies. It asks how previous crises can inform our understanding of the present crisis. The particular perspective advanced is that these crises not only are economic and social crises, but must also be understood as crises of public power, order (...) and authority. In other words, it argues that substantial challenges to the functional and normative setup of democracy and the rule of law were central to the emergence and the unfolding of these crises. The book draws on and adds to the rich ’crises literature’ developed within the critical theory tradition to outline a conceptual framework for understanding what societal crises are. The central idea is that societal crises represent a discrepancy between the unfolding of social processes and the institutional frameworks that have been established to normatively stabilize such processes. The crises at issue emerged in periods characterized by strong social, economic and technological transformations as well as situations of political upheaval. As such, the crises represented moments where the existing functional and normative grid of society, as embodied in notions of public order and authority, were severely challenged and in many instances undermined. The inoffensive title of Section 1.4.7 of Hume’s Treatise of Human Nature, ‘Conclusion of this Book’, belies the convoluted treatment of scepticism contained within. It is notoriously difficult to decipher Hume’s considered response to scepticism in this section, or whether he even has one. In recent years, however, one line of interpretation has gained popularity in the literature. The ‘usefulness and agreeableness reading’ (henceforth U&A) interprets Hume as arguing in THN 1.4.7 that our beliefs and/or epistemic policies are justified via (...) their usefulness and agreeableness to the self and others; proponents include Ardal (in Livingston & King (eds.) Hume: a re-evaluation, 1976), Kail (in: Frasca-Spada & Kail (eds.) Impressions of Hume, 2005), McCormick (Hume Stud 31:1, 2005), Owen (Hume’s reason, 1999), and Ridge (Hume Stud 29:2, 2003), while Schafer (Philosophers, forthcoming) also defends an interpretation along these lines. In this paper, I will argue that although U&A has textual merit, it struggles to maintain a substantive distinction between epistemic and moral justification—a distinction that Hume insists on. I then attempt to carve out the logical space for there being a distinctly epistemic notion of justification founded on usefulness and agreeableness. However, I find that such an account is problematic for two reasons: first, it cannot take advantage of the textual support for U&A; secondly, it is incompatible with other features of the text. L’objectif de cet article est de montrer que le républicanisme d’entreprise développé par Hsieh ne protège pas les travailleurs contre l’ensemble des interférences arbitraires. Comme ils sont fondés uniquement sur la contestation des décisions, les arrangements institutionnels que Hsieh propose n’arrivent pas à saisir l’ensemble des formes que peut prendre la domination. Pour ce faire, nous utiliserons la critique développée par McCormick des institutions républicaines. Pour exploiter cette critique et l’appliquer au contexte d’entreprise, nous aurons besoin de présenter les (...) arguments en faveur du parallèle État-entreprise. Nous verrons ensuite que la critique de McCormick appliquée à l’entreprise nous permet de défendre l’idée selon laquelle il est nécessaire d’aller plus loin que le républicanisme d’entreprise pour réaliser la liberté républicaine. Domination consists in subjection to the will of others and manifests itself both as a personal relation and a structural phenomenon serving as the context for relations of power. Domination has again become a central political concern through the revival of the republican tradition of political thought . However, normative debates about domination have mostly remained limited to the context of domestic politics. Also, the republican debate has not taken into account alternative ways of conceptualizing domination. Critical theorists, liberals, feminists, (...) critical race theorists, and postcolonial writers have discussed domination in different ways, focusing on such problems as imperialism, racism, and the subjection of indigenous peoples. This volume extends debates about domination to the global level and considers how other streams in political theory and nearby disciplines enrich, expand upon, and critique the republican tradition’s contributions to the debate. This volume brings together, for the first time, mostly original pieces on domination and global political justice by some of this generation’s most prominent scholars, including Philip Pettit, James Bohman, Rainer Forst, Amy Allen, John McCormick, Thomas McCarthy, Charles Mills, Duncan Ivison, John Maynor, Terry Macdonald, Stefan Gosepath, and Hauke Brunkhorst. -/- Front matter and First chapter available for download.
