Should learning we disagree about p lead you to reduce confidence in p? Some who think so want to except beliefs in which you are rationally highly confident. I argue that this is wrong; we should reject accounts that rely on this intuitive thought. I then show that quite the opposite holds: factors that justify low confidence in p also make disagreement about p less significant. I examine two such factors: your antecedent expectations about your peers’ opinions and the difficulty (...) of evaluating your evidence. Evolutionary debunking arguments start with a premise about the influence of evolutionary forces on our evaluative beliefs, and conclude that we are not justified in those beliefs. The value realist holds that there are attitude-independent evaluative truths. But the debunker argues that we have no reason to think that the evolutionary forces that shaped human evaluative attitudes would track those truths. Worse yet, we seem to have a good reason to think that they wouldn’t: evolution selects for characteristics that increase (...) genetic fitness—not ones that correlate with the evaluative truth. Plausibly, the attitudes and judgments that increase a creature’s fitness come apart from the true evaluative beliefs. My aim in this paper is to show that no plausible evolutionary debunking argument can both have force against the value realist and not collapse into a more general skeptical argument. I conclude that there is little hope for evolutionary debunking arguments. This is bad news for the debunker who hoped that the cold, hard scientific facts about our origins would debunk our evaluative beliefs. And it is good news for the realist. (shrink)

Evolutionary debunking arguments move from a premise about the influence of evolutionary forces on our moral beliefs to a skeptical conclusion about those beliefs. My primary aim is to clarify this empirically grounded epistemological challenge. I begin by distinguishing among importantly different sorts of epistemological attacks. I then demonstrate that instances of each appear in the literature under the ‘evolutionary debunking’ title. Distinguishing them clears up some confusions and helps us better understand the structure and potential of evolutionary debunking arguments.

We often hear such casual accusations: you just believe that because you are a liberal, a Christian, an American, a woman… When such charges are made they are meant to sting—not just emotionally, but epistemically. But should they? It can be disturbing to learn that one's beliefs reflect the influence of such irrelevant factors. The pervasiveness of such influence has led some to worry that we are not justified in many of our beliefs. That same pervasiveness has led others to (...) doubt whether there is any worry here at all. I argue that evidence of irrelevant belief influence is sometimes, but not always, undermining. My proposal picks out ordinary, non-skeptical cases in which we get evidence of error. It says that, in those cases, evidence of irrelevant influence is epistemically significant. It shows how respecting evidence of error is compatible with the epistemic lives we see ourselves living. We are fallible creatures, yes, but we are also capable and intelligent ones. We can recognize and correct for our own error so as to improve our imperfect, yet nevertheless robust, epistemic lives. (shrink)

The fact of moral disagreement when conjoined with Conciliationism, an independently attractive view about the epistemic significance disagreement, seems to entail moral skepticism. This worries those who like Conciliationism, the independently attractive view, but dislike moral skepticism. Others, equally inclined against moral skepticism, think this is a reductio of Conciliationism. I argue that they are both wrong. There is no reductio and nothing to worry about.

We are fallible creatures, prone to making all sorts of mistakes. So, we should be open to evidence of error. But what constitutes such evidence? And what is it to rationally accommodate it? I approach these questions by considering an evolutionary debunking argument according to which (a) we have good, scientific, reason to think our moral beliefs are mistaken, and (b) rationally accommodating this requires revising our confidence in, or altogether abandoning the suspect beliefs. I present a dilemma for such (...) debunkers, which shows that either we have no reason to worry about our moral beliefs, or we do but we can self-correct. Either way, moral skepticism doesn’t follow. That the evolutionary debunking argument fails is important; also important, however, is what its failure reveals about rational belief revision. Specifically, it suggests that getting evidence of error is a non-trivial endeavor and that we cannot learn that we are likely to be mistaken about some matter from a neutral stance on that matter. It’s intuitive to think that (a) the more sure you are of something, the harder it’ll be to change your mind about it, and (b) you can’t be open-minded about something if you’re very sure about it. If these thoughts are right, then, with minimal assumptions, it follows that you can’t be in a good position to both escape echo chambers and be rationally resistant to fake news: the former requires open-mindedness, but the latter is inimical to it. I argue (...) that neither thought is true and that believing them will get us all mixed up. I show that you can be open-minded and have confidently held beliefs, and that beliefs in which you are less sure are not, thereby, more fragile. Alan Hájek launches a formidable attack on the idea that deliberation crowds out prediction – that when we are deliberating about what to do, we cannot rationally accommodate evidence about what we are likely to do. Although Hájek rightly diagnoses the problems with some of the arguments for the view, his treatment falls short in crucial ways. In particular, he fails to consider the most plausible version of the view, the best argument for it, and why anyone would ever believe (...) it in the first place. In doing so, he misses a deep puzzle about deliberation and prediction – a puzzle which all of us, as agents, face, and which we may be able to resolve by recognizing the complicated relationship between deliberation and prediction. In this article, I show why it is necessary to abolish the use of predictive algorithms in the US criminal justice system at sentencing. After presenting the functioning of these algorithms in their context of emergence, I offer three arguments to demonstrate why their abolition is imperative. First, I show that sentencing based on predictive algorithms induces a process of rewriting the temporality of the judged individual, flattening their life into a present inescapably doomed by its past. Second, I demonstrate (...) that recursive processes, comprising predictive algorithms and the decisions based on their predictions, systematically suppress outliers and progressively transform reality to match predictions. In my third and final argument, I show that decisions made on the basis of predictive algorithms actively perform a biopolitical understanding of justice as management and modulation of risks. In such a framework, justice becomes a means to maintain a perverse social homeostasis that systematically exposes disenfranchised Black and Brown populations to risk. (shrink)

The sensory dimension of writing, which is never fully neutralised in the process of semiosis, remains aporetic in Derrida’s philosophy. I show how Barthes’ observations on pseudo-writing lead to his understanding of writing as a gesture, opening up post-structuralism to the body as absolutely non-repeatable, as the opposite of semiosis. The examination of Barthes’ account of the relationship between writing and the body leads to an aesthetic of physical responsiveness, which challenges the distinction between work, creator and viewer. In this (...) regard ‘seeing’ can neither be reduced to the infinite decoding of signs nor to an immediate perception, but rather can be understood as the playful contact with signs. Barthes’ notion of writing contributes to overcoming the limits of Derrida’s account of the sensory quality of writing without jeopardiz- ing the philosophical gain of deconstruction. (shrink)

Michael Huemer recentemente ofereceu uma teoria, o Conservadorismo Fenomênico, que ele alega ser a teoria da justificação fundacional mais bem sucedida entre as teorias da justificação internalista. Evolutionary debunking arguments purport to show that, if moral realism is true, all of our moral beliefs are unjustified. In this paper, I respond to two of the most enduring objections that have been raised against these arguments. The first objection claims that evolutionary debunking arguments are self-undermining, because they cannot be formulated without invoking epistemic principles, and epistemic principles are just as vulnerable to debunking as our moral beliefs. I argue that this objection suffers from several defects, the most (...) serious of which is that it has the unpalatable consequence that we should never revise our moral beliefs in response to evidence that our capacity for normative cognition is globally impaired. The second objection, which comes to us from Katia Vavova, claims that evolutionary debunking arguments are doomed to fail, because they attempt to show that our moral beliefs are unreliable without making any assumptions about the nature of morality, and this is impossible. I argue, to the contrary, that the etiological higher-order evidence cited by debunking arguments can give us good reason to think that our moral beliefs are unreliable, even if we make no assumptions about what morality is like. The information has been sourced from the fields of religion, biblical studies, linguistics, English literature, grammar learning, geo-politics, philology, psychology, philosophy, and artificial intelligence as they have to do with thought, language, and society. The carefully quoted and paraphrased opinions of writers from the related disciplines since the fourth century BCE are presented here. However, the volume reflects the very marked influence of 20th century thinkers who have had the benefit of perusing the work of their predecessors and 21st century pioneers who have at their disposal ultra-modern technology, computing power, and easy access to a global community to which the ideas may be applied for comparative analysis. In this article, I draw on Kierkegaard’s often over-looked work, The Concept of Anxiety, to gain deeper insight into the tenor of melancholy. We discover that Kierkegaard labels anxiety, due to its connection to hereditary sin, as the source for melancholy. Thus, contrary to the usual interpretation of Kierkegaard, I argue that melancholy is more than an individual’s struggle with existence, but is intimately tied to the historical environment, because it is steeped in an ever-increasing, ever-deepening anxiety. This link be­tween (...) anxiety and melancholy clears away misunderstandings about Kierkegaard’s description of melancholy and suggests implications in psychology, philosophy, and theology. In response to the claim that our sense of will is illusory, some philosophers have called for a better understanding of the phenomenology of agency. Although I am broadly sympathetic with the tenor of this response, I question whether the positive-theoretic blueprint it promotes truly heralds a tenable undertaking. Marshaling a Schopenhauerian insight, I examine the possibility that agency might not be amenable to phenomenological description. Framing this thesis in terms of Charles S. Peirce’s semiotic framework, I suggest a way (...) to integrate the idea of streaming experiences with that of bodily strivings, which, owing to their primitive structure, can never be represented. A rapidly growing body of scholarship embraces virtue jurisprudence, a series of (often ad hoc) attempts to incorporate the philosophical tradition of virtue ethics into legal theory. Broadly understood, virtue ethics describes an approach to moral questions that emphasizes the importance of developing and embodying various virtues, often as manifestations of human flourishing. Scholars typically contrast virtue ethics with deontological and consequentialist moral theories, tracing virtue-centered analysis to ancient Greek philosophers, and in particular to Aristotle. Virtue ethics has experienced a (...) revival over the past 65 years; but, long before that, it proved especially influential in Catholic moral thought, particularly through the work of Aquinas. Perhaps relatedly, scholars have seized on virtue jurisprudence to defend a range of politically conservative positions, such as originalist constitutional interpretation and the propriety of utilizing the law to regulate ostensibly “private” immoralities. This Article reveals the radically underappreciated progressive promise of virtue jurisprudence. Virtue jurisprudence requires no religious commitments whatsoever, but a strong version entails acceptance of the moral significance of developing one’s character—both within and without the law. On a compelling understanding of the virtues, rejecting a state of perpetual disadvantage under the law is a meaningful marker of the virtue of self-respect, and a repudiation of the vice of servility that would otherwise be imposed by the legal system itself. Thus, contrary to the predominant tenor of research on the subject, virtue jurisprudence can ground significant resistance to—and even defiance of—the law. In making this argument, the Article also draws novel connections between virtue jurisprudence and literature on (inter alia) race, feminism, and sexual orientation to reveal the unnoticed potential of virtue jurisprudence to push forward work in those and related areas. At a time when massive and widespread protests across the United States reflect a groundswell of support for overturning certain long-standing, legally-ingrained, systemic disadvantages of people of color, many might be surprised to learn that virtue jurisprudence can serve as a potent theoretical ally. Although the economic thought of Marshall and Pigou was united by ethical positions broadly considered utilitarian, differences in their intellectual milieu led to degrees of difference between their respective philosophical visions. This change in milieu includes the influence of the little understood period of transition from the early idealist period in Great Britain, which provided the context to Marshall’s intellectual formation, and the late British Idealist period, which provided the context to Pigou’s intellectual formation. During this latter period, the pervading (...) Hegelianism and influences of naturalism arising from the ideas of Charles Darwin and Herbert Spencer were challenged by Hermann Lotze, a key transitional thinker influencing the Neo-Kantian movement, who recognised significant limits of naturalism, on the one hand, and the metaphysical tenor of absolute idealism, on the other, and attempted to provide a balance between the two. The goal of this paper is to make the provisional case for the argument that Pigou’s views on ethics were not only directly influenced by utilitarian thinkers like Mill and Sidgwick, but they were also indirectly influenced by Hermann Lotze, via the influence of the Neo- Kantian movement on late British idealism. To that end, Pigou’s essays in The Trouble with Theism (1908), including his sympathetic consideration of the ethics of Friedrich Nietzsche, reflect the influence of Lotze indirectly through the impact at Cambridge of: James Ward’s critique of associationist psychology, and consideration of the limits of naturalism including the critique of evolutionary ethics; Bertrand Russell’s rejection of neo-Hegelianism and, together with Alfred North Whitehead, the development of Logicism; and G.E. Moore’s critique of utilitarian ethics on the basis of the naturalistic fallacy and the development of his own intuitionist system of ethics. (shrink)

Evolutionary debunking arguments in ethics aim to use facts about the evolutionary causes of ethical beliefs to undermine their justification. Global Evolutionary Debunking Arguments (GDAs) are arguments made in metaethics that aim to undermine the justification of all ethical beliefs. Local Evolutionary Debunking Arguments (LDAs) are arguments made in first‐order normative ethics that aim to undermine the justification of only some of our ethical beliefs. Guy Kahane, Regina Rini, Folke Tersman, and Katia Vavova argue for skepticism about the possibility (...) of LDAs. They argue that LDAs cannot be successful because they over‐extend in a way that makes them self‐undermining and yield a form of moral skepticism. In this paper I argue that this skepticism about the possibility of LDAs is misplaced. (shrink)

In this chapter, I argue that the films of Andrei Tarkovsky are particularly suitable for inducing feelings of the numinous. This suitability is a formal rather than semantic feature of his films, and is tied indelibly to what film scholars call ‘suture’. I with a summary of what film theorists mean by ‘suture’, before providing a principled defence of the Merleau-Pontian suture theory outlined by George Butte. Second, I will demonstrate that, in spite of the strength of Butte’s formulation, the (...) numinousness of Tarkovsky’s films pose an analytical challenge to his suture theory. Finally, I will then provide my own extension of Butte’s suture theory, arguing that, by virtue of the formal properties they possess, we encounter Tarkovsky’s films more like religious objects than ordinary films. The tenor of these encounters is why Tarkovsky’s films are appropriate loci for feelings of the numinous. (shrink)

It may be tempting for breastfeeding advocates to respond to challenges to breastfeeding older children or breastfeeding in public by pointing out the nutritional or developmental benefits of breastfeeding or by noting that breastfeeding is often extremely discreet. Such responses may concede more than they should: by focusing on rebutting the empirical claim, breastfeeding supporters may end up implicitly accepting two presuppositions about breastfeeding: first, the presupposition that breastfeeding requires justification in terms of health or developmental benefits to the child; (...) second, the presupposition that breastfeeding in public is only acceptable if assumed standards of discretion are met. -/- This paper aims to use the methods of analytic philosophy to: (a) show how, if left unchallenged, these implicit assumptions can become part of the pragmatic presuppositions of the conversation, so that the discussion proceeds taking their acceptance for granted; (b) argue that we can expect these presuppositions to have negative effects on all mothers, no matter how they feed their babies, and on the tenor of public discussion of infant feeding; (c) reconstruct the reasoning that might underlie these presuppositions and show that this reasoning is mistaken; (d) show that recognising breastfeeding as a family way of life and a loving interaction between parent and child gives rise to a moral right to breastfeed in public without social sanction, whether one is able to breastfeed discreetly or not. After this introduction, a first reading will point by point but informally review the argument of J.-P. Journet by showing that each (...) of its clauses may generate a “bifurcated” comment able to serve or go against the analytic discourse. Hence the interest of the “differential diagnosis” mentioned in our title, which makes glimpse the traps that the homonymy may set to this speech. Tekst ten ma na celu przybliżenie problemu jednoznaczności języka prawa na podstawie niemieckich i polskich wyroków sądowych. Język prawa jest tak bogaty i różnorodny, że trudno o jego jednoznaczną, definicję. Język wyroków sądowych wydaje się zaprzeczać temu stwierdzeniu. Wyrok sądowy jako pewien schematyczny rodzaj tekstu jest bardziej uporządkowany i jednolity. Wyrok jako produkt myślowego procesu prowadzącego sprawę sędziego cechuje pewna budowa. Każda część wyroku sądowego (rubrum, tenor, stan faktyczny czy uzasadnienie) charakteryzuje się odpowiednim stylem i w zależności od jej przeznaczenia (...) odpowiednimi środkami wyrazu. Na podstawie badań przeprowadzonych na autentycznych wyrokach sądowych można stwierdzić, że ta właściwość wyróżnia wyrok sądowy od innych tekstów prawniczych. Mimo tej różnorodności językowej w ramach jednego wyroku, można śmiało stwierdzić, że każda z jego części wyróżnia się użyciem tylko niektórych zjawisk językowych, takich jak np. strona bierna czy styl nominalny. I tak np. w trzeciej części wyroku, w której przedstawiany jest stan faktyczny sprawy procesowej, pojawi się bardzo wiele zdań w stronie biernej itp. Każdy sędzia ma swój własny styl. Jednakże tworząc wyrok sądowy, powinien się trzymać pewnych reguł, zarówno formalnych, jak i językowych. Jest to ściśle określone m. in. w kodeksie postępowania cywilnego. Dzięki tym regułom wyrok sądowy nabiera jako tekst prawniczy właściwego dla siebie charakteru. Nie jest to język prosty i wymaga wielu lat praktyki początkowo aplikantów, asesorów czy w końcu sędziów sądów najwyższych. Zaprezentowany tekst podejmuje tylko próbę przybliżenia owych zasad i ukazuje je na licznych przykładach, które zostały zaczerpnięte z autentycznych wyroków sądów polskich i niemieckich. (shrink)

This dissertation examines the relationship that exists between two distinct and seemingly incompatible bodies of scholarship within the field of contemporary philosophy of technology. The first, as argued by postmodern pragmatist Barry Allen, posits that our tools and what we make with them are epistemically important; disputing the idea that knowledge is strictly sentential or propositional, he claims instead that knowledge is the product of a performance that is both superlative and artefactual, rendering technology importantly world-constituting. The second, as argued (...) by Heidegger and his inheritors, is that technology is ontologically problematic; rather than technology being evidence of performative knowledge, it is instead existentially threatening by virtue of the fact that it changes the tenor of our relationship with the world-as-given. Despite the fact that these claims seem prima facie incompatible, I argue that they may be successfully reconciled by introducing a third body of scholarship: the philosophy of photography. For it is the case, I argue, that although we, qua human beings, occupy lifeworlds that are necessarily constituted by technology, technology also induces a kind of phenomenological scepticism: a concern that mediated action precludes us from the possibility of authentic experience. Arguing in favour of the sentiment that photographs serve as a kind of phenomenal anchor—a kind of machine for living—I claim that photographic images provide a panacea to this existential concern: despite being epistemically problematic, it is this selfsame epistemic “specialness” of photographs that forces us to phenomenologically recommit, if only temporarily, to the world in a serious way. Consequently, it is my belief that an analysis of our artefacts and the way they function is fundamentally incomplete without an analysis of the epistemic and ontological problems introduced of the photographic image; as I will demonstrate, the photographic image casts an extremely long shadow over the philosophy of technology. Metaphors establish connection. Root metaphors--patterns of relational imagery in the language and thought of a culture, in which a diverse group of tenors are related to a single indentifiable class of vehicles--play an important role in organizing our thought, and in bringing a coherence to our vision of the world. This is a political function; root metaphors, as philosopher Stephen Pepper discusses them, are most often found in the works of philosophers remembered as political philosophers. ;The second law of thermodynamics--the (...) law of entropy--holds that in any spontaneous process, usable energy becomes unusable energy. It also suggests that improbable order must succumb, through time, to more probable chaos. The law of entropy has enjoyed a popularity as metaphor unusual for such physics esoterica. In the works of Brooks Adams, Henry Adams, Nicholas Georgescu-Roegen, and Thomas Pynchon, the idea of entropy appears as the fundamental, organizing idea for an economic interpretation of history, a philosophy of history, an ecologically enlightened economic theory, and an encyclopedic novel that apotheosizes modern culture. Analysis of how the entropy metaphor is manifest in the works of these thinkers allows us to judge the strengths and weaknesses of entropy as root metaphor. Analysis of its contemporary popularity affords insight into the politics of the day. Ultimately, the entropy root metaphor serves as the foundation of a refurbished "generating substance" world hypothesis, but the root metaphor itself remains equivocal on the important issue of centralized versus decentralized political organization. El presente reporte de investigación muestra, de manera sintética, los resultados de una pesquisa presentada en el 2012 para optar por el grado de Licenciatura en Docencia en la Universidad Estatal a Distancia. La exploración de los desafíos éticos en el contexto educativo costarricense desde el planteamiento de Martin Buber y Emmanuel Lévinas es lo que pretende formular la presente investigación, procurando aportar al diálogo nacional el insumo de un elemento filosófico innovador, tenor de un impulso en futuros planteamientos educativos (...) costarricenses que propicien un desarrollo humano cada vez más integral, donde la persona sea considerada en relación armónica con lo existente. Además, se presentan una serie de desafíos éticos que se desprenden de un análisis, en el cual confluyen diversas fuentes de información. La novedad radica en la confluencia de voces y la lectura ética de estos postulados desde el pensamiento de Martin Buber y Emmanuel Lévinas. La meta de la investigación postula un aporte al modelo educativo costarricense, así como a grupos gremiales de la educación y población en general, desde el enfoque de la filosofía del encuentro, desde el planteamiento del diálogo buberiano y el planteamiento de alteridad levinasiano, se puedan encontrar insumos necesarios para un replanteamiento -tanto desde el aspecto teórico como práctico- en el quehacer educativo nacional.
