This paper concerns two topics which, I hope to show, are vitally connected. One is the distinctive importance of appellate adjudication in the legal system of United States. The other is the workings of entangled concepts in the law. That appellate adjudication is important in some sense may seem obvious to everybody (to a few it will seem obvious that appellate adjudication is unimportant). My point will be that via appellate adjudication courts engineer entangled legal concepts, and it is this (...) aspect of appellate adjudication that is both crucial and unique to it, at least in the U.S. legal system. Entangled concepts intertwine description and evaluation; entangled legal concepts facilitate and constrain legal reasoning and legal judgments, in ways that distinguish legal adjudication from pure politics or the implementation of public policy. In the paper itself, I demonstrate more fully what it is for a legal concept to be an entangled one and how entanglement supplies guidance in adjudication. I also broach how entanglement in legal concepts and engineered entanglement have significance for legal pedagogy; appellate adjudication; the respective roles of the judiciary, the legislature, and administrative agencies; the erosion of the distinction between so-called public law and so-called private law; and our understanding of the fact/value distinction. -/- Understanding more specifically the nature of the entanglement at work in appellate adjudication requires much closer scrutiny of appellate opinions than we usually give. I examine carefully the background to MacPherson v. Buick and Justice Benjamin Cardozo’s particular re-engineering of ‘negligence’ and ‘duty,’ entangled concepts belonging to the same legal taxonomy. Via this scrutiny, I demonstrate the flaws in the engineering of some concepts in the buildup to MacPherson, and how these flaws led to those concepts’ collapse and ultimately to Cardozo’s re-engineering of ‘negligence’ and ‘duty.’ I also explain why careful understanding of the engineering of entangled legal concepts can make us appreciate that even the most successful of such concepts have within in them the grounds for their own obsolescence. -/- To show that conceptual engineering of entangled concepts occurs outside the context of state common law, I also examine how the U.S. Supreme Court has engineered ‘commerce’, itself an entangled concept. The recent decision regarding the individual mandate in the Affordable Care Act makes this example particularly timely. This secondary example also clarifies the nature of entanglement and engineering it. -/- This article concerns appellate adjudication in any area of law. I maintain that whether we are dealing with private law or public law, common law or statutory law or Constitutional law, the defining feature of appellate adjudication is its continuous engineering and reengineering of entangled legal concepts. The merger of fact and value in these concepts explains both the fertility of appellate adjudication and the constraints judges work with when they work with legal concepts that entangle fact and value. Recent research has relied on trolley-type sacrificial moral dilemmas to study utilitarian versus nonutili- tarian modes of moral decision-making. This research has generated important insights into people’s attitudes toward instrumental harm—that is, the sacrifice of an individual to save a greater number. But this approach also has serious limitations. Most notably, it ignores the positive, altruistic core of utilitarianism, which is characterized by impartial concern for the well-being of everyone, whether near or far. Here, we develop, refine, and validate a (...) new scale—the Oxford Utilitarianism Scale—to dissociate individual differences in the ‘negative’ (permissive attitude toward instrumental harm) and ‘positive’ (impartial concern for the greater good) dimensions of utilitarian thinking as manifested in the general population. We show that these are two independent dimensions of proto-utilitarian tendencies in the lay population, each exhibiting a distinct psychological profile. Empathic concern, identification with the whole of humanity, and concern for future generations were positively associated with impartial beneficence but negatively associated with instrumental harm; and although instrumental harm was associated with subclinical psychopathy, impartial beneficence was associated with higher religiosity. Importantly, although these two dimensions were independent in the lay population, they were closely associated in a sample of moral philosophers. Acknowledging this dissociation between the instrumental harm and impartial beneficence components of utilitarian thinking in ordinary people can clarify existing debates about the nature of moral psychology and its relation to moral philosophy as well as generate fruitful avenues for further research. To achieve this, we employ a comprehensive dataset sourced from Goodreads, enabling us to thoroughly examine the intricate connections between the different attributes of books and the ratings they receive from readers. In our investigation, we meticulously scrutinize how attributes such as genre, author, page count, publication year, and reader reviews (...) influence a book's overall rating. Through rigorous analysis and experimentation, we construct an advanced ANN model tailored for predictive analysis in the realm of book ratings. The outcomes of our study reveal the remarkable potential of ANNs in this domain. The ANN model exhibits an impressive level of accuracy when it comes to forecasting book ratings, underlining the efficacy and promise of artificial neural networks in enhancing our understanding and prediction of book evaluations. This research opens up new avenues for leveraging machine learning techniques to gain deeper insights into the dynamics of book ratings and reader preferences. (shrink)

The study’s goal was to provide an educational intervention in Algebra through GeoGebra that would boost students’ confidence, improve their learning, and correct their most minor mastered skills, allowing them to improve their Algebra performance. The research design was quasi-experimental, with 40 nonrandomly chosen participants comprising the GeoGebra and control groups. Mean and standard deviation was employed to describe the algebra performance and confidence of the respondents. At the same time, independent and dependent t-tests were used to determine the students’ (...) significant difference in algebra performance and confidence in the pre-and post-test between the control and GeoGebra groups. GeoGebra effectively improved algebra confidence, enhanced learning, and remedied the students’ least mastered skills. GeoGebra is recommended as an instructional material in teaching and learning Algebra and can be extended to other mathematics content areas. (shrink)

This paper presents an expert system developed using CLIPS (C Language Integrated Production System) to diagnose mouth ulcer disease. The expert system utilizes a rule-based approach, incorporating a comprehensive knowledge base consisting of symptoms, risk factors, and medical literature related to mouth ulcers. By employing (...) an inference engine, the system evaluates patient input against the rules and generates a diagnosis based on the matching symptoms and relevant factors. The system also provides detailed explanations and recommendations for each diagnosis, aiding healthcare professionals and patients in understanding the condition and selecting appropriate treatment options. The development and validation of the expert system involved a multi-step process, including knowledge acquisition, rule formulation, and testing against a diverse dataset of mouth ulcer cases. The system's performance was evaluated by comparing its diagnoses with those made by medical professionals, demonstrating a high level of accuracy and consistency. The implementation of an expert system for diagnosing mouth ulcer disease offers several advantages, including the ability to provide timely and accessible healthcare services, reduce misdiagnosis rates, and assist healthcare professionals in decision-making processes. Moreover, it empowers individuals to make informed decisions about their health and seek appropriate medical intervention. This paper contributes to the field of medical expert systems by showcasing the practical application of CLIPS in the diagnosis of mouth ulcer disease. The results demonstrate the potential of expert systems as valuable tools for healthcare professionals and patients alike, enhancing the efficiency and accuracy of diagnosis in oral health care. In diesem Aufsatz, werde ich die Frage des Naturalismus in Plessners Philosophie des organischen Lebens und seiner amerikanischen Rezeption, in besonders die philosophischen-biologischen Schriften von Marjorie Grene, untersuchen. Die amerikanische Philosophin Grene war die Hauptvertreterin Plessners im Englischen Sprachraum in 20sten Jahrhundert, die Plessners anthropologischen Argumentation in ihren Schriften zur Philosophie der Biologie aufgenommen und verwendet hat. Grene kritisierte in ihren frühen Schriften Heidegger, Sartre, und die Existenzphilosophie, die das menschliche Dasein von der Natur radikal absondert und die negative Affekte (...) wie Angst hervorhebt, in Vergleich mit Plessners weiterem Blick der Leibhaften, Sinnlichen, Tierischen Entwicklung des menschlichen Lebens. Die menschliche Existenz kann nicht dualistisch, wo „keine Brücke über den Abgrund zwischen Mensch und Tier führt,“ sondern nur biologisch-lebensphilosophisch oder ökologisch verstanden werden. Plessner und Grene setzen sich mit dem Reduktionismus des modernen Naturalismus auseinander und zeigen, wie das Natürliche weiter und ergänzt gedacht werden muss, weil der Naturalismus keine ausreichenden Begriffe für die Auslegung der Erscheinungen und Ausdrucksformen des organischen Lebens besitzt. Die Unterscheidung zwischen der "zentrischen Positionalität" des Tiers und der "exzentrischen Positionalität" des menschlichen Tiers ermöglicht eine holistisch aber differenzierte Beschreibung der Natur und Kultur, insbesondere die natürlichen Künstlichkeit, die der Kultur und das des gesellschaftlichen Lebens. Diese sind Grundlage für die geschichtliche und soziale Bildung, Aufbau, und Strukturierung der natürlichen Spontaneität, Produktivität, und Expressivität des Lebens und ermöglichen die dezentrierte, utopische, und persönliche Individuation der einzelnen Menschen im Lebenszusammenhang, was wichtige soziologische und auch ethische und politische Konsequenzen für Plessner und Grene hat: Der Mensch ist ein natürliches biologisches Individuum, das durchaus fähig ist, eine verantwortliche Person zu werden , und zwar durch die umfassende Beteiligung an (oder als ein einzigartiger Ausdruck) einer Kultur. There are three questions associated with Simpson’s paradox (SP): (i) Why is SP paradoxical? (ii) What conditions generate SP? and (iii) How to proceed when confronted with SP? An adequate analysis of the paradox starts by distinguishing these three questions. Then, by developing a formal account of SP, and substantiating it with a counterexample to causal accounts, we argue that there are no causal factors at play in answering questions (i) and (ii). Causality enters only in connection with action.

The concept of neutrosophic locally compact and neutrosophic compact open topology are introduced and some interesting propositions are discussed.

Robert Nozick, in chapter two of the nature of rationality, proposes two famous problems in decision theory (i.e., Newcomb's problem and Prisoner Dilemma) and two main strategies toward these problems i.e. dominant strategy and dominated or cooperative one. He will try to give a formal principles to calculate the decision values in these situations. In this calculation he goes beyond the standard principle of maximizing expected utility and would try to put forth less ideal and more realistic principles that fit (...) the decision situation in the real world. This paper traces two contradicting beliefs about death and immortality in the writings of Rabbi Hayyim Hirschensohn, and examines these opposing beliefs in his Halakhic ruling, in the case of Autopsies. The paper opens by conceptualizing two possible attitudes regarding the relation between this-world and the ʽother-world’, and by analyzing two main beliefs regarding death and immortality in their relation to the body-spirit distinction (the naturalistic and the spiritualistic approach). It demonstrates how Hirschensohn was holding these two different views. The (...) paper then moves to examine whether his halakhic ruling may help us in understanding which approach was Hirschensohn’s favorable belief, by investigating his halakhic ruling regarding autopsies. Hirschensohn permits to perform such surgeries, however subject to some halakhic limitations. The paper concludes that the naturalistic belief regarding death appears to be the more dominant one in his thought. Finally, I point out a few consequences of this paper, for addressing some contemporary ethical dilemmas regarding human corpses. (shrink)

This article defends the conclusion that the soccer World Cup in Qatar should not be boycotted by rich countries from the Global North. This conclusion is underpinned by considerations about the economic background conditions in guest workers’ home countries. Three arguments are considered for the view that the World Cup should be boycotted. It is argued that each of these arguments is unsound. Section 7 contains a discussion of an argument for a boycott that centers on the process through which (...) Qatar was awarded the World Cup. This argument is rejected. The article lists several ways in which guest workers in Qatar are wronged, but this fact about how guest workers are treated does not justify a boycott by rich countries from the Global North. Weighing competing obligations and achieving the “greatest balance” of right over wrong guides an individual, an agency or a country in determining what ought to be done in an ethically challenging situation. Conducting controlled human infection model (CHIM) studies in India is one such situation. The ethical challenge in conducting a CHIM study lies in completing the difficult task of introducing standardised, attenuated strains of micro-organisms into normal healthy volunteers, at the same time ensuring the safety of these healthy individuals (...) from potential and completely informed risks in a fashion that is transparent and accountable. The bar is further raised against the background of already fragile public confidence in biomedical research in India; especially when “deliberate” introduction of microbial agents into healthy individuals is involved, with the larger altruistic objective of gain to society as a whole. -/- This paper discusses the uses of CHIM studies with respect to the larger scientific Indian research enterprise of the 21st century. It further explores etic and emic perspectives in conducting such trials in India and seeks to generate an ethical coherence to the justification for conducting CHIM studies in India. The paper deliberates on ethical issues arising out of conducting CHIM studies and reflects on how developing the capacity for CHIM studies in India is likely to strengthen the health research and development sector in the country. -/- . In classical American pragmatism, fallibilism refers to the conception of truth as an ongoing process of improving human knowledge that is nevertheless susceptible to error. This paper traces appearances of fallibilism in Jewish thought in general, and particularly in the halakhic thought of Eliezer Berkovits. Berkovits recognizes the human condition’s persistent mutability, which he sees as characterizing the ongoing effort to interpret and apply halakhah in shifting historical and social contexts as Torat Ḥayyim. As these opening quotes acknowledge, the Prisoner’s Dilemma (PD) represents a core puzzle within the formal mathematics of game theory.3 Its rise in conspicuity is evident figure 2.1 above demonstrating a relatively steady rise in incidences of the phrase’s usage between 1960 to 1995, with a stable presence persisting into the twenty first century. This famous two-person “game,” with a stock narrative cast in terms of two prisoners who each independently must choose whether to remain silent or speak, each advancing (...) self-interest at the expense of the other and thereby achieving a mutually suboptimal outcome, mires any social interaction it is applied to into perplexity. The logic of this game proves the inverse of Adam Smith’s invisible hand: individuals acting on self interest will achieve a mutually suboptimal outcome. The study reached a set of results, the most important of which are: the presence of a high degree of competitive advantage in the University of Palestine from the viewpoint of the employees, and the absence of differences in the opinions of the study sample about the study variables for the demographic variables. The study presented a set of recommendations, the most important of which are: The necessity of working to enhance the university's competitive advantage by enhancing the human capital and knowledge of the university. There are three questions associated with Simpson’s Paradox (SP): (i) Why is SP paradoxical? (ii) What conditions generate SP?, and (iii) What should be done about SP? By developing a logic-based account of SP, it is argued that (i) and (ii) must be divorced from (iii). This account shows that (i) and (ii) have nothing to do with causality, which plays a role only in addressing (iii). A counterexample is also presented against the causal account. The world's leading cause of morbidity and death is cardiovascular diseases (CVD), which makes early detection essential for successful treatments. This study investigates how optimization techniques can be used with machine learning (ML) algorithms to forecast cardiovascular illnesses more accurately. ML models can evaluate enormous datasets by utilizing data-driven techniques, finding trends and risk factors that conventional methods can miss. In order to increase prediction accuracy, this study focuses on adopting different machine learning algorithms, including Decision Trees, Random Forest, Support (...) Vector Machines, and Neural Networks, that have been tuned using strategies including hyper parameter selection, crossvalidation, and feature selection. (shrink)

Kyle Stanford’s reformulation of the problem of underdetermination has the potential to highlight the epistemic obligations of scientists. Stanford, however, presents the phenomenon of unconceived alternatives as a problem for realists, despite critics’ insistence that we have contextual explanations for scientists’ failure to conceive of their successors’ theories. I propose that responsibilist epistemology and the concept of “role oughts,” as discussed by Lorraine Code and Richard Feldman, can pacify Stanford’s critics and reveal broader relevance of the “new induction.” The possibility (...) of unconceived alternatives pushes us to question our contemporary expectation for scientists to reason outside of their historical moment. When the NCAA adopted new rules allowing athletes to profit off their name, image, and likeness (NIL), few people took more interest than Reggie Bush who famously relinquished the Heisman trophy after being ruled retroactively ineligible for receiving "impermissible benefits." Bush has argued for his reinstatement and the "return" of his Heisman. In this paper, I argue that, while the NCAA never should have required players to be amateurs in the first place, Bush should not be reinstated or have the (...) Heisman "returned." This review essay (in Hebrew) considers the volume Judaism, Race, and Ethics, edited by Jonathan K. Crane (Penn, 2020), and briefly presents the content of the articles included in this important volume. The review then raises several substantial axiological and linguistic questions considering the term "race", and suggests some moral insights from Jewish tradition regarding the idea of the oneness of humanity and of all human creatures, as a basis for opposing racism.

Load balancing algorithms play a vital role in this process by distributing workloads across computing resources to avoid overloading any single resource. However, the effectiveness of these algorithms can be significantly enhanced through the integration of advanced optimization techniques. This paper proposes an SLA-driven load balancing algorithm optimized using methods such as genetic algorithms, particle swarm optimization, and simulated (...) annealing. The paper argues that the moral philosophy of Thomas Hobbes is unified by a complex conception of reason that imposes consistency norms of both rationality and reasonableness. Hobbes’s conceptions of rightness as reciprocity, and moral goodness as sociability belong to an original and attractive moral theory that is neither teleological nor classically deontological, nor as interpreters have variously argued, subjectivist, contractarian, egoist, or dependent on divine command.

This essay represents a novel contribution to Nietzschean studies by combining an assessment of Friedrich Nietzsche’s challenging uses of “truth” and the “eternal return” with his insights drawn from Indian philosophies. Specifically, drawing on Martin Heidegger’s Nietzsche, I argue that Nietzsche’s critique of a static philosophy of being underpinning conceptual truth is best understood in line with the Theravada Buddhist critique of “self ” and “ego” as transitory. In conclusion, I find that Nietzsche’s “eternal return” can be understood as a (...) direct inversion of “nirvana”: Nietzsche celebrates profound attachment to each and every moment, independent from its pleasurable or distasteful registry. Through a comprehensive analysis, the paper illustrates how these techniques can significantly improve the performance of cloud storage systems, ensuring both security and usability. The Genetic Ranking Optimization Algorithm (GROA) is used to rank phishing content based on multiple features by optimizing the ranking system through iterative selection and weighting. Dynamic weighting further enhances the process by adjusting the weights of features based on their importance in real-time. This hybrid approach enables the model to learn from the data, improving classification over time. Heidegger’s “Evening Conversation: In a Prisoner of War Camp in Russia, between a Younger and an Older Man”, one of three dialogues composed by Heidegger after the defeat of National Socialist Germany published in Country Path Conversations explores the being-historical situation and fate of the German people by turning to the early Daoist text of the Zhuangzi. My article traces how Heidegger interprets fundamental concepts from the Zhuangzi, mediated by way of Richard Wilhelm’s translation Das wahre Buch vom südlichen Blütenland, (...) such as naturalness, letting/releasement, the unnecessary and the useless in the context of his hermeneutical and political situation. t: Wireless Sensor Networks (WSNs) have become increasingly prevalent in various applications, ranging from environmental monitoring to smart cities. However, the limited energy resources of sensor nodes pose significant challenges in maintaining network longevity and data transmission efficiency. Duty-cycled WSNs, where sensor nodes alternate between active and sleep states to conserve energy, offer a solution to these challenges but introduce new complexities in data transmission.

In the first chapter of his Knowledge and Lotteries, John Hawthorne argues that thinkers do not ordinarily know lottery propositions. His arguments depend on claims about the intimate connections between knowledge and assertion, epistemic possibility, practical reasoning, and theoretical reasoning. In this paper, we cast doubt on the proposed connections. We also put forward an alternative picture of belief and reasoning. However, with the vast amount of sensitive information stored on cloud platforms, ensuring data security and privacy remains a critical challenge. Traditional encryption techniques, while secure, often hinder efficient data retrieval, especially when using keyword searches. To address this, attribute-based keyword search (ABKS) offers a promising solution by allowing secure, fine-grained access control and efficient keyword searches over encrypted data. This paper (...) delves into the integration of optimization techniques within ABKS to enhance search efficiency and data security in cloud storage environments. We explore various optimization strategies, such as index compression, query processing enhancement, and encryption optimization, which aim to reduce computational overhead while maintaining robust security measures. Through a comprehensive analysis, the paper illustrates how these techniques can significantly improve the performance of cloud storage systems, ensuring both security and usability. Experimental results demonstrate that optimized ABKS not only accelerates search queries but also reduces storage costs, making it a viable solution for modern cloud storage challenges. Future research directions include exploring advanced machine learning algorithms for predictive search optimizations and further improving the resilience of ABKS against emerging security threats. We hope to show that the overall protreptic plan of Aristotle's ethical writings is based on the plan he used in his published work Protrepticus (Exhortation to Philosophy), by highlighting those passages that primarily offer hortatory or protreptic motivation rather than dialectical argumentation and analysis, and by illustrating several ways that Aristotle adapts certain arguments and examples from his Protrepticus. In this essay we confine our attention to the books definitely attributable to the Nicomachean Ethics (thus excluding the common books).

Although social scientists have identified diverse behavioral patterns among children from dissimilarly structured families, marketing scholars have progressed little in relating family structure to consumption-related decisions. In particular, the roles played by members of single-mother families—which may include live-in grandparents, mother’s unmarried partner, and step-father with or without step-sibling(s)—may affect children’s influence on consumption-related decisions. For example, to offset a parental authority dynamic introduced by a new stepfather, the work-related constraints imposed on a breadwinning mother, or the imposition of adult-level (...) household responsibilities on children, single-mother families may attend more to their children’s product preferences. -/- Without a profile that includes socio-economic, behavioral, and psychological aspects, efficient and socially responsible marketing to single-mother households is compromised. Relative to dual-parent families, single-mother families tend to have fewer resources and less buying power, children who consume more materialistic and compulsively, and children who more strongly influence decision making for both own-use and family-use products. Timely research would ensure that these and other tendencies now differentiate single-mother from dual-parent families in ways that marketers should address. Hence, our threefold goal is (1) to consolidate and highlight gaps in existing theory applied to studying children’s influence on consumption-related decision making in single-mother families, and (2) to propose a hybrid framework that merges two theories conducive to such research, and (3) to identify promising research propositions for future research. This paper critically engages Philip Mirowki's essay, "The scientific dimensions of social knowledge and their distant echoes in 20th-century American philosophy of science." It argues that although the cold war context of anti-democratic elitism best suited for making decisions about engaging in nuclear war may seem to be politically and ideologically motivated, in fact we need to carefully consider the arguments underlying the new rational choice based political philosophies of the post-WWII era typified by Arrow's impossibility theorem. The exponential growth of cloud storage has necessitated advanced security measures to protect sensitive data from unauthorized access. Traditional encryption methods provide a layer of security, but they often lack the robustness needed to address emerging threats. This paper introduces an optimized framework for secure cloud storage that integrates data encryption, decryption, and dispersion using cutting-edge optimization techniques. The proposed model enhances data security by first encrypting the data, then dispersing it across multiple cloud servers, ensuring that no single server (...) holds the complete dataset. Decryption occurs only when the dispersed data fragments are reassembled, which adds an additional layer of security. We also explore various optimization algorithms to improve the efficiency of encryption and dispersion processes, thereby reducing computational overhead while maintaining high security. The implementation of this framework is evaluated on multiple cloud platforms, demonstrating its effectiveness in safeguarding data with minimal performance impact. Future enhancements may include integrating machine learning algorithms to predict and adapt to new security threats in real time, further solidifying the reliability of cloud storage solutions. The rise of social media has created a new platform for communication and interaction, but it has also facilitated the spread of harmful behaviors such as cyberbullying. Detecting and mitigating cyberbullying on social media platforms is a critical challenge that requires advanced technological solutions. This paper presents a novel approach to cyberbullying detection using a combination of supervised machine learning (ML) and natural language processing (NLP) techniques, enhanced by optimization algorithms. The proposed system is designed to identify and classify cyberbullying (...) behavior in real-time, analyzing textual data from social media posts to detect harmful content. The model is trained on a large dataset of labeled instances of bullying and non-bullying content, using supervised ML algorithms such as Support Vector Machines (SVM), Decision Trees, and Random Forest. As the Internet of Things (IoT) continues to expand, ensuring secure and efficient data storage and retrieval becomes a critical challenge. IoT devices, often constrained by limited computational resources, require lightweight encryption protocols that balance security and performance. This paper presents an optimized encryption protocol designed specifically for lightweight, searchable data in IoT environments. The proposed protocol utilizes advanced optimization techniques to enhance the efficiency and security of searchable encryption, enabling rapid data retrieval without compromising the integrity and confidentiality of (...) the data. The protocol leverages a hybrid cryptographic approach, combining symmetric and asymmetric encryption, to ensure robust protection against unauthorized access while maintaining low computational overhead. Furthermore, the implementation of an optimized keyword indexing mechanism facilitates fast and accurate search operations, making the protocol well-suited for real-time IoT applications. Extensive experiments were conducted using various IoT datasets to evaluate the performance of the proposed protocol in terms of encryption speed, search efficiency, and overall security. The results demonstrate that the optimized encryption protocol significantly outperforms existing methods, offering a scalable solution that meets the stringent requirements of IoT systems. This research contributes to the field by providing a practical and secure encryption solution that addresses the unique challenges of IoT environments, paving the way for more secure and efficient IoT networks. Yirminci yüzyılın ikinci çeyreğinde, Viyana Çevresi ve Karl Popper’ın düşünceleri ile bilimde sosyolojik ve psikolojik unsurların keşif bağlamı içerisinde görülebileceği, bilimsel kuramların ve araştırmaların gerekçelendirilmesine yönelik girişimlerin ise yalnızca nesnel, epistemik çalışmalardan oluştuğu ileri sürülmektedir. Keşif bağlamı ve gerekçelendirme bağlamı adı altında yapılan bu ayrıma ilişkin iddialar, Thomas Kuhn’un 1962 yılında (...) yayımlanmış olan ‘Bilimsel Devrimlerin Yapısı’ adlı kitabında vurguladığı argümanlar ile sekteye uğramaktadır. Kuhn, sosyal ve psikolojik etkenlerin her iki bağlamda da yer aldığını ifade etmekte ve bu sebeple keşif ve gerekçelendirme ayrımına karşı çıkmaktadır. We discuss the one–many problem as it appears in the Philebus and find that it is not restricted to the usually understood problem about the identity of universals across particulars that instantiate them (the Hylomorphic Dispersal Problem). In fact some of the most interesting aspects of the problem occur purely with respect to the relationship between Forms. We argue that contemporary metaphysicians may draw from the Philebus at least three different one–many relationships between universals themselves: instantiation, subkind and part, and (...) thereby construct three new ‘problems of the one and the many’ (an Eidetic Dispersal Problem, a Genus–Species Problem, and an Eidetic Combination Problem), which are as problematic as the version generally discussed. We then argue that this taxonomy sheds new and interesting light on certain discussions of higher-order universals in recent Australian analytic philosophy. (shrink)

Half of the drug offenders incarcerated in the United States are black, even though whites and blacks use and sell drugs at the same rate, and blacks make up only 13 percent of the population. Noncomparativists about retributive justice see nothing wrong with this picture; for them, an offender’s desert is insensitive to facts about other offenders. By contrast, comparativists about retributive justice assert that facts about others can partially determine an offender’s desert. Not surprisingly, comparativists, especially comparative egalitarians, contend (...) that differential punishment is retributively unjust. I agree with this assessment, but take issue with the reasons egalitarians cite in its favor. In this paper, I argue that differential punishment violates retributive justice because it contributes to structural racial oppression. Over the course of developing and defending this claim, I identify the shortcomings of both comparative egalitarianism and respectarianism, which is the most popular and plausible brand of noncomparativism. Few problems in the philosophy of evolutionary biology are more widely disseminated and discussed than the charge of Darwinian evolution being a tautology. The history is long and complex, and the issues are many, and despite the problem routinely being dismissed as an introductory-level issue, based on misunderstandings of evolution, it seems that few agree on what exactly these misunderstandings consist of. In this paper, I will try to comprehensively review the history and the issues. Then, I will try to (...) present the following “solution”, or, one might say, “dissolution”, of the problem, and consider the wider implications of formal, or schematic, explanations in science: yes, the principle of natural selection is a tautology, and so what? It is a promissory note for actual, physical, explanations in particular cases, and is none the worse for that. This is not a new argument, of course, but it does point up the importance of formal schematic models in science. (shrink)

This article considers the significance of the Blessed Isles in Nietzsche’s Thus Spoke Zarathustra. They are the isolated locale to which Zarathustra and his fellow creators retreat in the Second Part of the book. I trace Zarathustra’s Blessed Isles back to the ancient Greek paradisiacal afterlife of the makarōn nēsoi and frame them against Nietzsche’s Platonic conception of philosophers as “commanders and legislators,” but I argue that they represent something more like a modern Epicurean Garden. Ultimately, I suggest that Zarathustra’s (...) Epicurean impulse toward withdrawal (whether into a sequestered friendship community or mountain solitude) undermines his Platonic attempts at great politics. (shrink)
