In this essay we will argue for the following theses: 1- know-how is not a form of practical knowledge devoid of propositional sense; 2- the relationship between each perception and the body itself is metaphysically contingent (organisms and bodies can vary, as can even the spaces they occupy in the same experience vary), 3- it is up to the brain to configure or to shape a physical body (Körper) into a living body (Leib) and not the other way around; 4- (...) phenomenal externalism of enactivist nature, even in its mild form, is empirically implausible: the correlation between the conscious character of sensory experience with spatiotemporal neuronal patterns is much more systematic and regular than with anything outside the brain. But in its radical form is entirely implausible and contra-intuitive: phenomenal duplicates are not necessarily duplicates of agency; in short, 5-we are our own brain that has a body, avatars, and artifacts, properly configured, and molded by the brain, and not a body that has a brain among other essential organs. A New Italian translation of Principia Ethica coming almost 60 years after the 1964 translation by Gianni Vattimo with Nicola Abbagnano’s preface. The new edition makes room for the English text alongside the Italian translation; it includes the 1922 Preface, a bibliography of Moore’s ethical writings with critical literature, a chronology of Moore’s life and works, and an Index. The Introduction by Sergio Cremaschi reconstructs the background of ideas, concerns and intentions from which Moore’s Principia Ethica originated. It stresses the (...) role of religious concerns, as well as that of the Idealist legacy. I argue that PE is more a patchwork of incompatible lines of argument than a consistent work. It compares PE with Rashdall’s almost contemporary ethical work, suggesting that the latter defends the same general claims in a different and more plausible way, which manages to answer decisive objections. It ends with the suggestion that the emergence of Analytic Ethics was a more multi-faceted phenomenon than the received view would make us believe and the analytic tradition's wheat, that is, what logic can do for philosophy, has to be separated from the chaff, that is, the confused, and besides mutually incompatible, legacies of Utilitarianism and Idealism. Cualquier propuesta de alternativa a la democracia representativa, sea para mejorarla, sea para sustituirla por otro tipo de forma política, debería de tomar en cuenta dos tipos de restricciones para que la alternativa en cuestión tenga mayores probabilidades de éxito. Al primer grupo de restricciones los llamaremos factores limitantes de la conducta humana, mientras que al segundo grupo los llamaremos funciones impropias de esa forma política, es decir, las funciones que no debería tener. Tanto los factores limitantes de la conducta (...) humana como las funciones impropias de una forma política son restricciones sobre lo que realmente, es decir, no utópicamente, podríamos hacer para mejorar a la democracia y en general a la gobernabilidad de las sociedades. Esas restricciones, que a continuación señalaré, constituyen los argumentos que me llevan a plantear la siguiente tesis: la democracia representativa puede y debe ser mejorada al reducir su alcance económico, político y social, pero continúa siendo una mejor opción de gobierno que cualquier alternativa, incluyendo la demarquía. In this paper we advance a new solution to Quinn’s puzzle of the self-torturer. The solution falls directly out of an application of the principle of instrumental reasoning to what we call “vague projects”, i.e., projects whose completion does not occur at any particular or definite point or moment. The resulting treatment of the puzzle extends our understanding of instrumental rationality to projects and ends that cannot be accommodated by orthodox theories of rational choice.

This is the first Italian translation of Bentham’s “Deontology”. The translation goes with a rather extended apparatus meant to provide the reader with some information on Bentham’s ethical theory's own context. Deste modo, tentar-se-á demonstrar o quanto o fluxo de uma fase a outra de seu pensamento denota um sentido de completude ao invés de desconexão, negação ou mesmo oposição. Recent research on algebraic models of _quasi-Nelson logic_ has brought new attention to a number of classes of algebras which result from enriching (subreducts of) Heyting algebras with a special modal operator, known in the literature as a _nucleus_. Among these various algebraic structures, for which we employ the umbrella term _intuitionistic modal algebras_, some have been studied since at least the 1970s, usually within the framework of topology and sheaf theory. Others may seem more exotic, for their primitive operations (...) arise from algebraic terms of the intuitionistic modal language which have not been previously considered. We shall for instance investigate the variety of _weak implicative semilattices_, whose members are (non-necessarily distributive) meet semilattices endowed with a nucleus and an implication operation which is not a relative pseudo-complement but satisfies the postulates of Celani and Jansana’s strict implication. For each of these new classes of algebras we establish a representation and a topological duality which generalize the known ones for Heyting algebras enriched with a nucleus. (shrink)

Kant’s views on the relation between freedom and moral law seem to undergo a major, unannounced shift. In the third section of the Groundwork, Kant seems to be using the fact that we must act under the idea of freedom as a foundation for the moral law. However, in the Critique of Practical Reason, Kant claims that our awareness of our freedom depends on our awareness of the moral law. I argue that the apparent conflict between the two texts depends (...) on a reading of the opening paragraphs of Groundwork III, and on an interpretation of Kant’s claim that we “act under the idea of freedom”, that is implausible on textual and on philosophical grounds. I then present an alternative interpretation of what Kant means by “acting under the idea of freedom” and of the opening paragraphs of Groundwork III. I argue that the only substantive conclusion of these paragraphs is that no theoretical proof of freedom is necessary. Moreover I argue that although these paragraphs raise concerns about the validity of the moral law, these concerns and Kant’s answers to them, do not give rise to any significant conflict with his views in the Critique of Practical Reason. Recently, Piccinini and Craver have stated three theses concerning the relations between functional analysis and mechanistic explanation in cognitive sciences: No Distinctness: functional analysis and mechanistic explanation are explanations of the same kind; Integration: functional analysis is a kind of mechanistic explanation; and Subordination: functional analyses are unsatisfactory sketches of mechanisms. In this paper, I argue, first, that functional analysis and mechanistic explanations are sub-kinds of explanation by scientific (idealized) models. From that point of view, we must take into account (...) the tradeoff between the representational/explanatory goals of generality and precision that govern the practice of model-building. In some modeling scenarios, it is rational to maximize explanatory generality at the expense of mechanistic precision. This tradeoff allows me to put forward a problem for the mechanist position. If mechanistic modeling endorses generality as a valuable goal, then Subordination should be rejected. If mechanists reject generality as a goal, then Integration is false. I suggest that mechanists should accept that functional analysis can offer acceptable explanations of cognitive phenomena. (shrink)

Most contemporary action theorists accept – or at least find plausible – a belief condition on intention and a knowledge condition on intentional action. The belief condition says that I can only intend to ɸ if I believe that I will ɸ or am ɸ-ing, and the knowledge condition says that I am only intentionally ɸ-ing if I know that I am ɸ-ing. The belief condition in intention and the knowledge condition in action go hand in hand. After all, if (...) intending implies belief, and if ɸ-ing intentionally implies intending to ɸ, then in ɸ-ing, I intend to be ɸ-ing, and, by the belief condition, I believe that I am ɸ-ing, and if this belief is justified, and we are not in a Gettier situation, etc., then, I will also satisfy the knowledge condition. Moreover, the claim that when intentions properly result in action, the corresponding belief constitutes knowledge is a relatively safe assumption, at least as an assumption about what it is generally the case. This book tells the story of modern ethics, namely the story of a discourse that, after the Renaissance, went through a methodological revolution giving birth to Grotius’s and Pufendorf’s new science of natural law, leaving room for two centuries of explorations of the possible developments and implications of this new paradigm, up to the crisis of the Eighties of the eighteenth century, a crisis that carried a kind of mitosis, the act of birth of both basic paradigms of the two (...) following centuries: Kantian ethics and utilitarianism. The new science of natural law carried a fresh start for ethics, resulting from a mixture of the Old and the New. It was, as suggested by Schneewind, an attempt at rescuing the content of Scholastic and Stoic doctrines on a new methodological basis. The former was the claim of existence of objective and universal moral laws; the latter was the self-aware attempt at justifying a minimal kernel of such laws facing skeptical doubt. What Bentham and Kant did was precisely carrying this strategy further on, even if restructuring it each of them around one out of two alternative basic claims. The nineteenth- and twentieth-century critics of the Enlightenment attacked both not on their alleged failure in carrying out their own projects, but precisely on having adopted Grotius’s and Pufendorf’s project. Resumo A problemática sobre a “verdade” não tem obtido a devida atenção no meio jurídico. As considerações a respeito do que seja “verdade”, por certo, têm nítido viés filosófico, existindo distintas concepções acerca da “verdade”, embora muitas não são capazes de servir ao direito processual civil. Habermas concebe a “verdade” sobre um fato como um conceito dialético, construída a partir das argumentações desenvolvidas pelos sujeitos cognoscentes, ou seja, buscada na cooperação direcionada para o entendimento mútuo racional. Identificam-se pontos de contato (...) existentes entre a teoria habermasiana e os enunciados até agora elaborados no projeto do novo Código de Processo Civil brasileiro. A “verdade” no moderno processo civil deve ser buscada em um procedimento baseado na probabilidade das provas e das teses apresentadas, na intensa argumentação dialética e em colaboração entre os sujeitos processuais, e no respeito às normas e aos princípios válidos para o caso em julgamento. All the considerations about “truth” have a clearly philosophical points of view, and distinct conceptions concerning it, although many are not capable of serving in the civil procedure. Jürgen Habermas conceives the “truth” as a dialectical concept, constructed from the arguments developed by cognizant agents, i.e., those seeking cooperation aimed at rational mutual understanding. The article identifies points of contact between habermasian theory and legal rules developed up to now in the project of the new Brazilian Civil Code of Procedure. The “truth” in the modern civil process must be sought in a procedure based on the probability of the evidence and theses in intense dialectical argumentation and collaboration between all parties involved with the respect for the rules and principles considered valid for the case at hand. For non-analytic ethical naturalists, externalism about moral motivation is an attractive option: it allows naturalists to embrace a Humean theory of motivation while holding that moral properties are real, natural properties. However, Michael Smith has mounted an important objection to this view. Smith observes that virtuous agents must have non-derivative motivation to pursue specific ends that they believe to be morally right; he then argues that this externalist view ascribes to the virtuous agent only a direct de dicto desire to (...) do what is morally right, but not a direct motivation to be kind, help those in need, et. I first clarify this “fetishism objection”; I then show how the non-analytical naturalist can provide an understanding of virtuous motivation that is immune to this objection. (shrink)

Robert Adams argues that often our moral commitment outstrips what we are epistemically entitled to believe; in these cases, the virtuous agent doxastic states are instances of “moral faith”. I argue against Adams’ views on the need for moral faith; at least in some cases, our moral “intuitions” provide us with certain moral knowledge. The appearance that there can be no certainty here is the result of dubious views about second-order or indirect doubts. Nonetheless, discussing the phenomena that lead Adams (...) to postulate moral faith brings to light the nature of the epistemic warrant underlying various kinds of moral commitments. (shrink)

Options A and B are shown to be incommensurable when it is neither the case that A is preferred to (or better than) B nor that B is preferred to (or better than) A, but a slightly improved version of A (A+) is still not preferred to B. Since A+ is preferred to A, but not to B, we must also conclude that it is also true that A and B are (...) not indifferent (or equally good). Such incommensurable options seem incompatible with orthodox decision theory (and various forms of value theory) but options that obey the pattern described by this argument seem ubiquitous: my choice between lemon tarts and eclairs at my favourite pastry shop might exhibit this pattern, but so could my choice between jobs or careers. In trying to accommodate incommensurable options within various frameworks, philosophers have argued that we must preserve certain central features of the phenomenon. Among them is the supposed “hardness” of at least some incommensurable options: even if perhaps one would need to be a rather anxious gourmet to describe the choice between lemon tarts and eclairs as hard, the choice among careers could potentially be agonizing. However, it is not clear in which way choices among incommensurable options are “hard,” nor how and whether such hardness poses problems for the various accounts of incommensurable choices. To complicate matters, the deontic verdicts for choices between incommensurable options seem to be relatively straightforward: one appealing view is that in such circumstances I am rationally permitted to choose any option that is not worse than another option. This paper aims to provide a sharper formulation of at least a version of the hardness problem, to argue that various theories of incommensurability fail to account for the hardness of some incommensurable choices, and to propose that the theory of instrumental rationality I develop in Rational Powers in Action, aided by a Kantian insight, promises to provide an adequate explanation of the hardness of choice among incommensurable options. We reconstruct the text, that is, we analyse the development of the discussion between Malthus and Ricardo both in the correspondence and in published works, paying special attention to (a) the use of methodological statements, (b) some pragmatic features of the controversy, (c) considerations pertaining to the meta-level of the controversy (assessments of the status of the controversy, of ways of solving it, etc.); then, we reconstruct the co-text, that is, unpublished papers by each opponent that were not made available (...) to the other, records of exchanges between each of these and third parties, etc.; thirdly, we describe the essential features of the context, focusing on events that influenced the course of the controversy; (iv) we draw lessons from our case study on the role of co-text and context, on pragmatic and semantic interpretation, and on "casts of mind”. Deontological theories face difficulties in accounting for situations involving risk; the most natural ways of extending deontological principles to such situations have unpalatable consequences. In extending ethical principles to decision under risk, theorists often assume the risk must be incorporated into the theory by means of a function from the product of probability assignments to certain values. Deontologists should reject this assumption; essentially different actions are available to the agent when she cannot know that a certain act is in her (...) power, so we cannot simply understand her choice situation as a “risk-weighted” version of choice under certainty. The aim of this chapter is to understand more precisely what kind of irrationality involved in procrastination. The chapter argues that in order to understand the irrationality of procrastination one needs to understand the possibility and the nature of what I call “top-down independent” policies and long-term actions. A policy or long-term action) is top-down independent if it is possible to act irrationally relative to the adoption of the policy without ever engaging in a momentary action that is per se (...) irrational. involved in procrastination one needs to It argues that procrastination is one of the corresponding vices of an overlooked virtue; namely, “practical judgment.” On this account, procrastination turns out to be a failure of instrumental rationality that can be so characterized without assuming the correctness of any further norms of practical rationality. O intuito deste artigo é promover um debate em torno da obra República, de Platão, visando situar e estabelecer: 1) os argumentos do autor a favor de um modelo de pólis ideal; 2) as características do fazer político do Arconte enquanto comportamento dominante e eficaz dentre os líderes de governo da pólis, insurgindo contra o desejo de posse indevida (pleonexia) por parte dos homens que, se portadores do anel de Giges fossem, invisíveis, acreditariam, daqueles que estão ao seu redor, poder (...) reverter a seu favor qualquer tipo de liderança, sobretudo a soberana, passando então a encarnar, para Platão, a metáfora do homem injusto neste escrito; 3) elaboraremos, por fim, a definição de justiça, bem como a consciência individual in totum dos cidadãos que compõem a pólis e agem em prol do bem comum e funcionamento pleno da cidade, discernindo-os segundo a diferença de habilidade e posição hierárquica em relação a seus demais, produzindo o que podemos chamar de estrutura tripartite social e política, tanto da pólis quanto da alma, ambas, em plena harmonia, na teoria platônica. This paper proposes an application of Enrique Dussel’s ethics of liberation to an issue of crucial importance to US minorities: the debate on affirmative action. Over the past fifty years, this debate has been framed in terms of the opposition between advocates of affirmative action who claim that it is needed in order to achieve the integration and participation of traditionally oppressed groups to society without which there is no equality of rights, and critics who argue that affirmative action violates (...) equality by enforcing a double standard that undermines the ideal of a color-blind society. In this paper, I show how the basic principles of Dussel’s ethical theory (which are best expounded in his book Ethics of Liberation) allow us to address what I take to be the main demands of both advocates and critics of affirmative action in a satisfactory way. Conceptions about the nature of scientific models held by science students frequently involve distorted views, with a tendency to consider them as mere copies of reality. Besides encompassing an untenable view about the nature of science itself, this misconstruction can effectively be a pedagogical impediment to learning. Objectives: We evaluate whether Mario Bunge’s epistemology might contribute to tackling issues related to the nature of models in science education contexts. De-sign: After identifying Bunge’s main model categories, we employ them to examine (...) aspects of the historical development of atomic models and contrast the resulting framework with issues about model conceptions in science education, as pointed out in the literature. Setting and participants: Due to this research’s theoretical nature, this study did not include human participants other than authors from the literature and the theoretical framework. Data collection and analysis: We per-formed a constant comparative analysis to identify patterns of meanings shared between the historical case and the theoretical framework. Results: Features of models pointed out by Bunge were identified in the development of atomic models and could provide consistent and explanatory viewpoints about key issues related to model conceptions in science education. Conclusions: Bunge’s framework might help to clarify aspects of the nature of models relevant to science education contexts. -/- . (shrink)

Nosso objetivo é mostrar como Bachelard edifica a noção de vida em sua filosofia ao esboçar uma reflexão sobre o problema filosófico do tempo junto às noções de instante e duração. O livro A intuição do instante (1932), obra dedicada a esta reflexão metafísica sobre o tempo confluindo, quatro anos mais tarde, para A dialética da duração (1936), obra que, por sua vez, define o conceito de duração a partir das várias temporalidades superpostas constitutivas da própria existência, são as referências (...) privilegiadas deste estudo. Ressaltaremos a importância da filosofia de Henri Bergson nesta discussão ao estabelecermos um contraponto entre suas teses sobre a vida e a duração às mesmas teses conceituais bachelardianas, sobretudo a partir da oposição entre as seguintes noções: vida vivida (circunscrita ao tempo comum/tempo transitivo em Bergson) e vida pensada (circunscrita ao tempo do espírito/tempo imanente em Bachelard). Partimos da hipótese a ser debatida de que é porque o espírito pode chocar-se com a vida vulgar, escorregadia e homogênea que a vida superior, ou seja, do próprio espírito, deve ser entendida nesta filosofia bachelardiana como sendo uma construção racional ancorada em uma dialética pluralista de saberes sobre o tempo. ● Sergio Cremaschi, The non-existing Island. The chapter discusses how the cleavage between the Continental and the Anglo-American philosophies originated, the (self-)images of both philosophical worlds, the converging rediscoveries from the Seventies, and recent ecumenic or anti-ecumenic strategies. I argue that pragmatism provides an important counter-instance to the familiar self-images and the fashionable ecumenic or anti-ecumenic strategies. The conclusions are: (i) the only place where Continental philosophy exists (as Euro-Communism one decade ago) is America; (ii) less obviously, also analytic philosophy (...) does not exist, or does no more exist as a current or a paradigm; what does exist is, on the one hand, philosophy of language and, on the other, philosophy of mind, that is, two disciplines; (iii) the dissolution of analytic philosophy as a school has been highly fruitful, precisely in so far as it has left room for disciplines and research programmes; (iv) what is left, of the Anglo-American/Continental cleavage is primarily differences in styles, depending partly on intellectual traditions, partly owing to sociology, history, institutional frameworks; these differences should not be blurred by rash ecumenism; besides, theoretical differences are alive as ever, but within both camps; finally, there is indeed a lag (not a difference) in the appropriation of intellectual techniques by most schools of 'Continental' philosophy, and this should be overcome through appropriation of what the best 'analytic' philosophers have produced. ● Michael Strauss, Language and sense-perception: an aspect of analytic philosophy. To test an assertion about one fact by comparing it with perceived reality seems quite unproblematic. But the very possibility of such a procedure is incompatible with the intellectualistic basis of logical positivism and atomism (as it is for example to be found in Russell's Analysis of Mind). According to the intellectualistic approach pure sensation is meaningless. Sensation receives its meaning and order from the intellect through interpretation, which is performed with the help of linguistic tools, i.e. words and sentences. Before being interpreted, sensation is not a picture or a representation, it is neither true nor false, neither an illusion nor knowledge; it does not tell us anything; it is a lifeless and order-less matter. But how can a thought (or a proposition) be compared with such a lifeless matter? This difficulty confronts the intellectualist, if on the one hand he admits the necessity of comparing thought with sense-perception, and on the other hand presupposes that we possess only intellectual and no immediate perceptual understanding of what we see and hear. In this paper I give a critical exposition of three attempts, made by Russell, Neurath and Wittgenstein, to solve this problem. The first attempt adheres to strict conventionalism, the second tends to naturalism and the third leads to an amended, very moderate version of conventionalism. This amended conventionalism looks at sense impressions as being a peculiar language, which includes primary symbols, i.e. symbols not founded on convention and not being in need of interpretation. ● Ernst Tugendhat, Phenomenology and language analysis. The paper, first published in German in 1970, by which Tugendhat gave a start to the German rediscovery of analytic philosophy. The author stages a confrontation between phenomenology and language analysis. He argues that language analysis does not differ from phenomenology as far as the topics dealt with are concerned; instead, both currents are quite different in method. The author argues that language-analytic philosophy does not simply lay out of the mainstream of transcendental philosophy, but that instead it challenges this tradition on the very level of foundations. The author criticizes the linguistic-analytic approach centred on the subject as well as any object-centred approach, while proposing inter-subjective understanding through language as the new universal framework. This is, when construed in so general terms, the same program of hermeneutics, though in a more basic version. ● Jürgen Habermas, Language game, intention and meaning. On a few suggestions by Sellars and Wittgenstein. The paper, first published in German in 1975, in which Habermas announces his own linguistic turn through a discovery of speech acts. In this essay the author wants to work out a categorical framework for a communicative theory of society; he takes Wittgenstein's concept of language game as a Leitfade and, besides, he takes advantage also of Wilfried Sellars's quasi-transcendental account of the genesis of intentionality. His goal is to single out the problems connected with a theory of consciousness oriented in a logical-linguistic sense. ● Zvie Bar-On, Isomorphism of speech acts and intentional states. This essay presents the problem of the formal relationship between speech acts and intentional states as an essential part of the perennial philosophical question of the relation between language and thought. I attempt to show how this problem had been dealt with by two prominent philosophers of different camps in our century, Edmund Husserl and John Searle. Both of them wrote extensively about the theory of intentionality. I point out an interesting, as it were unintended, continuity of their work on that theory. Searle started where Husserl left off 80 years earlier. Their meeting point could be used as the first clue in our search. They both adopted in effect the same distinction between two basic aspects of the intentional experience: its content or matter, and its quality or mode. Husserl did not yet have the concept of a speech act as contradistinguished from an intentional state. The working hypothesis, however, which he suggested, could be used as a second clue for the further elaboration of the theory. The relationship of the two levels, the mental and the linguistic, which remained for Husserl in the background only, became the cornerstone of Searle' s inquiry. He employed the speech act as the model and analysed the intentional experience by means of the conceptual apparatus of his own theory of speech acts. This procedure enabled him to mark out a number of parallelisms and correlations between the two levels. This procedure explains the phenomenon of the partial isomorphism of speech acts and intentional states. ● Roberta de Monticelli, Ontology. A dialogue among the linguistic philosopher, the naturalist, and the phenomenological philosopher. This paper proposes a comparison between two main ways of conceiving the role and scope of that fundamental part of philosophy (or of "first" philosophy) which is traditionally called "ontology". One way, originated within the analytic tradition, consists of two main streams, namely philosophy of language and (contemporary) philosophy of mind, the former yielding "reduced ontology" and the latter "neo-Aristotelian ontology". The other way of conceiving ontology is exemplified by "phenomenological ontology" (more precisely, the Husserlian, not the Heideggerian version). Ontology as a theory of reference ("reduced" ontology, or ontology as depending on semantics) is presented and justified on the basis of some classical thesis of traditional philosophy of language (from Frege to Quine). "Reduced ontology" is shown to be identifiable with one level of a traditional, Aristotelian ontology, namely the one which corresponds to one of the four "senses of being" listed in Aristotle's Metaphysics: "being" as "being true". This identification is justified on the basis of Franz Brentano's "rules for translation" of the Aristotelian table of judgements in terms of (positive and negative) existential judgments such as are easily translatable into sentences of first order predicate logic. The second part of the paper is concerned with "neo-Aristotelian ontology", i.e. with naturalism and physicalism as the main ontological options underlying most of contemporary discussion in the philosophy of mind. The qualification of such options as "neo-Aristotelian" is justified; the relationships between "neo-Aristotelian ontology" and "reduced ontology" are discussed. In the third part the fundamental tenet of "phenomenological ontology" is identified by the thesis that a logical theory of existence and being does capture a sense of "existing" and "being" which, even though not the basic one, is grounded in the basic one. An attempt is done of further clarifying this "more basic" sense of "being". An argument making use of this supposedly "more basic" sense is advanced in favour of a "phenomenological ontology". ● Kuno Lorenz, Analytic Roots in Dialogic Constructivism. Both in the Vienna Circle ad in Russell's early philosophy the division of knowledge into two kinds (or two levels), perceptual and conceptual, plays a vital role. Constructivism in philosophy, in trying to provide a pragmatic foundation - a knowing-how - to perceptual as well as conceptual competences, discovered that this is dependent on semiotic tools. Therefore, the "principle of method" had to be amended by the "principle of dialogue". Analytic philosophy being an heir of classical empiricism, conceptually grasping the "given", and constructive philosophy being an heir of classical rationalism, perceptually providing the "constructed", merge into dialogical constructivism, a contemporary development of ideas derived especially from the works of Charles S. Peirce (his pragmatic maxim as a means of giving meaning to signs) and of Ludwig Wittgenstein (his language games as tools of comparison for understanding ways of life). 7. Albrecht Wellmer, "Autonomy of meaning" and "principle of charity" from the viewpoint of the pragmatics of language. In this essay I present an interpretation of the principle of the autonomy of meaning and of the principle of charity, the two main principles of Davidson's semantic view of truth, showing how both principles may fit in a perspective dictated by the pragmatics of language. I argue that (I) the principle of the autonomy of meaning may be thoroughly reformulated in terms of the pragmatics of language, (ii) the principle of charity needs a supplement in terms of pragmatics of language in order to become really enlightening as a principle of interpretation. Besides, I argue that: (i) on the one hand, the fundamental thesis of Habermas on the pragmatic theory of meaning ("we understand a speech act when we know what makes it admissible") is correlated with the seemingly intentionalist thesis according to which we understand a speech act when we know what a speaker means; (ii) on the other hand, to say that the meaning competence of a competent speaker is basically a competence about a potential of reasons (or also of possible justifications) which is inherently connected with the meaning of statements, or with their use in utterances. ● Rüdiger Bubner, The convergence of analytic and hermeneutic philosophy This paper argues that the analytic philosophy does not exist, at least as understood by its original programs. Differences in the analytic camp have always been bigger than they were believed to be. Now these differences are coming to the fore thanks to a process of dissolution of dogmatism. Philosophical analysis is led by its own inner logic towards questions that may be fairly qualified as hermeneutic. Recent developments in analytic philosophy, e.g. Davidson, seem to indicate a growing convergence of themes between philosophical analysis and hermeneutics; thus, the familiar opposition of Anglo-Saxon and Continental philosophy might soon belong to history. The fact of an ongoing appropriation of analytical techniques by present-day German philosophers may provide a basis for a powerful argument for the unity of philosophizing, beyond its strained images privileging one technique of thinking and rejecting the remainder. Actual philosophical practice should take the dialogue between the two camps more seriously; in fact, the processes described so far are no danger to philosophical work. They may be a danger for parochial approaches to philosophizing; indeed, contrary to what happens in the natural sciences, Thomas Kuhn's "normal science" developing within the framework of one fixed paradigm is not typical for philosophical thinking. And in philosophy innovating revolutions are symptoms more of vitality than of crisis. ● Karl-Otto Apel, The impact of analytic philosophy on my intellectual biography. In my paper I try to reconstruct the history of my Auseinandersetzung mit - as I called it - "language-analytical" philosophy (including even Peircean semiotics) since the late Fifties. The heuristics of my study was predetermined by two main motives of my beginnings: the hermeneutic turn of phenomenology and the transformation of "transcendental philosophy" in the light of the "language a priori". Thus, I took issue with the early and the later Wittgenstein, logical positivism, and post-Wittgensteinian and post-empiricist philosophy of science (i.e. G.H. von Wright and the renewal of the "explanation vs understanding controversy" as well as the debate between Th. Kuhn and Popper/Lakatos); besides, with speech act theory and the debate about "transcendental arguments" since Strawson. The "pragmatic turn", started already by C.L. Morris and the later Carnap, led me to study also the relationship between Wittgensteinian "use" theory of meaning and of truth. This resulted on my side in something like a program of "transcendental semiotics", i.e. "transcendental pragmatics" and "transcendental hermeneutics". ● Ben-Ami Scharfstein, A doubt on both their houses: the blindness to non-western philosophies. The burden of my criticism is that contemporary European philosophers of all kinds have continued to think as if there were no true philosophy but that of the West. For the most part, the existentialists have been oblivious of their Eastern congeners; the hermeneuticians have yet to stretch their horizons beyond the most familiar ones; and the analysts remain unaware of the analyses and linguistic sensitivities of the ancient non-European philosophers. Briefly, ignorance still blinds almost all contemporary Western philosophers to the rich, variegated philosophical traditions outside of their familiar orbit. Both Continental and Anglo-Americans have lost the breadth of view that once characterized such thinkers as Herder and the Humboldts. The blindness that has resulted is not simply that of individual Western philosophers but of our whole, still parochial philosophical culture. (shrink)

In this paper I argue that differences between the ‘new moral science’ of the seventeenth century and scholastic natural law theory originated primarily from the skeptical challenge the former had to face. Pufendorf’s project of a scientia practica universalis is the paramount expression of an anti-skeptical moral science, a ‘science’ that is both explanatory and normative, but also anti-dogmatic insofar as it tries to base its laws on those basic phenomena of human life which, supposedly, are immune to skeptical doubt. (...) The main scholastic legacy to the new moral science is the dichotomy between an ‘intellectualist’ and a ‘voluntarist’ view of natural law (or between lex immanens and lex imposita). Voluntarism lies at the basis of both theological views, such as Calvinism, and political views, such as those of Hobbes and Locke. The need to counterbalance the undesirable implications of extreme voluntarism may account for much of the developments in ethics and politics during the seventeenth and eighteenth centuries.Scottish natural jurisprudence, which tried to find a middle way between skepticism and extreme voluntarism, is less secular and more empirical than received wisdom admits. There emerged, as one of its ‘accidental’ outcomes, a systematic, self-contained and empirical economic theory from the search for an empirically based normative theory of social life. The basic assumption of such a theory, namely, the notion of societal laws as embedded in trans-individual mechanisms, derives from the voluntarist view of natural law as ‘imposed’ law.Later discussions of social issues in terms of ‘economic’ and ‘ethical’ reasons originated partly from a misreading ofthe Scottish natural jurisprudential framework of economic theory. Starting with this reconstruction, I try to shed some light on recent discussions about the role of ethics in economics. (shrink)

We examine the most famous controversy between economists as a means of shedding fresh light on the current debate about economic methodology. By focusing on the controversy as the primary unit of analysis, we show how methodological considerations are but one of a whole set of stratagems strategically employed by each opponent. We argue that each opponent's preference for a particular kind of stratagems expresses his own specific scientific style (within the general scientific and cultural style of an age). We (...) also describe a dynamic dimension of the controversy, independent of the participants' intentions. Such a dimension is analysed in a "cycle" of the controversy, which begins with a well-defined issue and expands to additional topics, without reaching a "solution" to the initial issue. The definition and re-definition of the issue(s) at stake and of the difference between both participants is an essential and recurrent feature of such cycles; the conclusion of a cycle does not imply a real "closure" of the controversy, but only that each opponent has reached a satisfying degree of self-clarification. The controversy, thus, does not yield persuasion -- its ostensible aim. Rather, its "benefit" seems to lie in an unintended result -- clarification and deepening of contrasting approaches to the discipline -- due to its peculiar dynamics. In so far as the history of a discipline requires a reconstruction of such contrasts, it is indispensable for it to take into account the controversies where they emerge, and to view both the positive doctrines and the methodological posture of the contenders as parts of a wider framework, that is a scientific style. El presente estudio analiza el avance del populismo penal en Ecuador, tomando en cuenta los últimos índices de violencia, las reformas constitucionales más recientes y los lineamientos para un correcto desarrollo de la política criminal. Se busca contribuir a un debate informado en la academia sobre este tema crucial para la seguridad pública y la justicia en el país, en este momento de coyuntura social en el que el populismo penal ha tomado auge en Ecuador. La presente investigación tiene como (...) objetivo desarrollar un método neutrosófico para la evaluación del avance del populismo penal en Ecuador. Se caracteriza por reformas legislativas que endurecen las penas, amplían el catálogo de delitos y restringen los beneficios penitenciarios. Si bien estas medidas pueden generar una sensación de falsa seguridad en la población, no abordan las causas estructurales de la criminalidad y, en muchos casos, tienen consecuencias negativas en los derechos humanos y la reincidencia delictiva. I construct a quantum-logical model of the type of situation that seems to be at the root of the problem of interpreting the projection postulate (Luders' rule) as a criterion of minimal disturbance. It is shown that the most natural way of characterizing minimal disturbance leads to contradictory conclusions concerning the final state.

It seems rather intuitive that if I can save either one stranger or five strangers, I must save the five. However, Kantian (and other non-consequentialist) views have a difficult time explaining why this is the case, as they seem committed to what Parfit calls “innumeracy”: roughly, the view that the values of lives (or the reasons to save them) don’t get greater (or stronger) in proportion to the number of lives saved. This chapter first shows that in various cases, it (...) is permissible to save fewer lives, contrary to what is implied by “numerate” views. Then it argues that in the cases in which it is intuitive that we must save the greater number, Kantians (and other deontologists) can not only deliver this verdict but also explain why it is correct, without presupposing that the value of our action depends on “adding up” the values of the lives saved. La naturaleza del ordenamiento jurídico ecuatoriano contempla derechos fundamentales y busca implementar nuevos derechos que han ido surgiendo en los últimos años. Sin embargo, estas acciones deben respetar los derechos fundamentales ya establecidos, un área de particular tensión es el conflicto entre el derecho al acceso a la información, específicamente los procesos judiciales y el derecho al olvido. La investigación buscó, por tanto, analizar cómo Ecuador, a través de leyes como la Ley Orgánica de Protección de Datos Personales o el (...) Código Orgánico de la Función Judicial busca equilibrar el alcance e intereses de estos derechos; para ello se requirió al uso de leyes, normas y doctrinas para su análisis que, junto al método sintético-analítico, inductivo y deductivo sirvieron para comprender y delimitar de mejor manera los temas objeto de estudio y la información en general. La presente investigación tiene como objetivo desarrollar un método para la evaluación del derecho de publicidad de procesos contra el reconocimiento del derecho al olvido en un ecuador constitucional. Se examinó la implementación del derecho al olvido, definición de información pública y el principio de publicidad, concluyendo que, Ecuador enfrenta el reto de desarrollar un marco legal sólido que proteja tanto la transparencia y rendición de cuentas como la privacidad y la dignidad de las personas en la era digital. I argue the existence of two tensions in Smith's system of ideas: the first is that between the postulate of an invisible noumenal order of the universe and the imaginary principles by means of which we connect the phenomena; the second is a tension between the noumenal order of the world where 'is' and 'ought' converge, and the various partial orders that may be reconstructed in social phenomena that leave room for irrationality and injustice. My first claim is that these (...) tensions are dialectical tensions in a unitary, albeit rhapsodically presented in writing. My second claim is that, the system’s unanswered question in the moral domain is a ‘metaphysical’ and ‘theological’ question, namely the problem of evil; by implication, I contend also that Smith was no secularist, but instead a post-skeptical fideist or agnostic, who took Bayle's question: "why are men wicked and unhappy?" quite seriously. His private ethics of prudence, justice, benevolence and his public ethics of liberty, justice, equality were modest proposals for coping with the problem of social evil in our imperfect world. I discuss the way in which the cleavage between the Continental and the Anglo-American philosophies originated, the images of both philosophical worlds, the converging rediscoveries from the Seventies, as well as recent ecumenical or anti-ecumenical strategies. I argue that pragmatism provides an important counterinstance to both the familiar self-images and to fashionable ecumenical or anti-ecumenical strategies. My conclusions are: Continental philosophy does not exist; less obviously, also analytic philosophy does not exist, or does not exist any longer as a current (...) or a paradigm; what does exist is, on the one hand, philosophy of language and, on the other, philosophy of mind, that is, two disciplines; the dissolution of analytic philosophy as a school has been extremely fruitful, precisely in so far as it has left room for disciplines and research programmes; what is left, of the Anglo-American/Continental cleavage is primarily differences in styles, depending partly on intellectual traditions, partly owing to sociology, history, institutional frameworks; these differences should not be blurred by rash ecumenical; besides, theoretical differences are alive as ever, but within both camps; finally, there is indeed a lag in the appropriation of intellectual techniques by most schools of ‘Continental’ philosophy, and this should be overcome through appropriation of what the best ‘analytic’ philosophers have produced. The occasion for this dialogue on Elisabeth Anscombe’s legacy for twenty-first-century ethics came with the publication in Italian of the collection of her ethical writings (G. E. M. Anscombe, Scritti di etica con un saggio di Peter Geach, a cura di S. Cremaschi, Morcelliana, Brescia 2022). In addition to making Anscombe’s ethical writings accessible to the Italian public, the book brings together her contribution to practical philosophy to its full extent for the first time. Vaccarezza's essay discusses Anscombe’s critique of (...) the modern law-based view of ethics. Magri’s contribution focuses on Anscombe’s anti-anti-naturalism, aiming to unearth the twofold agenda in her project of meta-critique of modern moral philosophy. De Anna's paper sets out to examine the role of Wittgensteinian ways of thinking in Anscombe’s proposed restructuring of modern ethics. (shrink)

I argue that Malthus’s Essay on Population is more a treatise in applied ethics than the first treatise in demography. I argue also that, as an ethical work, it is a highly innovative one. The substitution of procreation for sex as the focus makes for a drastic change in the agenda. what had been basically lacking in the discussion up to Malthus’s time was a consideration of human beings’ own responsibility in the decision of procreating. This makes for a remarkable (...) change also in the approach, namely, the discussion becomes an examination of a well-identified issue, taking cause-effect relationships into account in order to assess possible lines of conduct in the light of some, widely shared and comparatively minimal, value judgements. This is more or less the approach of what is now called applied ethics, at least according to one of its accounts, or perhaps to the account shared by a vast majority of its practitioners. In a sense, both the subject matter, sexuality, was substituted with a more restricted issue, namely reproduction, and the traditional approach, moral doctrine, was substituted with a more modest approach, in Malthus’s own words, the “moral and political science”. Such a drastic transformation brought about a viable framework, for a discussion of ethical issues that were still unforeseen by Malthus, namely those having to do first with the technical feasibility of eugenics programs and secondly with the scientific discovery of genetics as a field of study but also of possible intervention. Malthus’s ethics had obviously enough nothing to say on those unforeseen issues in so far as it was meant to treat just the ‘quantitative’ dimension of procreation, that is, ‘how many’. Later discussions and controversies will arise around different dimensions, that is, not just ‘how many’ but also ‘how healthy, how strong, hoe empowered’, but what Malthus’s lesson could have taught and still can teach to partners defending opposite views in these controversies is that such issues may be framed in a way that possibly avoids unending controversy on incompatible ultimate principles once the strategy is turned upside down and a principle of responsibility becomes the overriding rule in the treatment of such ethical issues. -/- . The well-known Kantian passage on misology in the Foundations of the Metaphysics of Morals starts making fuller sense when located within the framework of Kant writings on philosophy of history where he contrasts civilization with moralization as two different phases in the growth of humankind. In this context, the growth of commerce and manufactures plays a distinctive role, namely that of means of fostering civilization, while pursuing a deceptive goal, namely happiness. Deception plays a basic role in the growth of (...) mankind, in so far as it allows for a hidden twofold teleology in human action. Men, while following the dictates of self-love, are systematically mistaken about the results they actually contribute in bringing about. Commerce brings different peoples into mutual relationship and thus paves the way to a cosmopolitan society. The growth of the arts and sciences provides preconditions for the growth of learned institutions, a free press, and a public opinion that are the basis on which reason may start being used in its critical capacities. This, that is Enlightenment, is a preliminary step to moralization, that is the jump of individuals from a state of minority to a state where they are masters of themselves. The twofold teleology of human action makes room for a system of "pragmatic" ends, and of laws connected to the former, that may be studied rationally in themselves and yet are connected to the higher ends established by reason in its "practical" capacities. RESUMO A Transferência de Embrião (TE) em bovinos se trata de uma técnica mundialmente disseminada com objetivo de aumentar a capacidade reprodutiva da fêmea. Mantém vínculo direto com outras técnicas das biotecnologias da reprodução, como, a Ovum Pick-Up (OPU), Produção In Vitro e In Vivo de embriões (PIVE) e Transferência de Embrião em Tempo Fixo (TETF), sendo estas, técnicas que fazem parte de um processo, que vai desde a seleção de doadoras, passando pelo preparo dos embriões até sua inovulação em (...) receptoras criteriosamente selecionadas. Com seu avanço, várias tecnologias de manejo vêm sendo implantadas: formas no transporte de embriões, protocolos de sincronização de doadoras e receptoras, e protocolos de recuperação de oócitos para produção de embriões. Isto infundiu a tecnologia, porém, os investimentos previstos para a produção de um animal de alto mérito genético limita sua utilização. Contudo, esta análise abordou avanços tecnológicos essenciais para o sucesso da TE, incluindo novos protocolos, sexagem de embriões, além do uso de embriões congelados Direct Transfer (DT) e vitrificados. No entanto, é claro que o sucesso do procedimento está no processo como um todo, em destaque ressalta-se que é de grande valia que o profissional apto a executar a técnica esteja sempre preparado e atualizado garantindo qualidade, eficiência e sustentabilidade na pecuária. Esta revisão foi desenvolvida com o propósito de adquirir conhecimento teórico, de forma detalhada e crítica, nas técnicas e procedimentos de Transferência de Embriões em bovinos, incluindo a colheita, manipulação e implantação de embriões. Palavras-chaves: Bovino, doadora, embrião, receptora. ABSTRACT Embryo Transfer (ET) in cattle is a globally widespread technique aimed at enhancing the reproductive capacity of females. It is closely linked to other techniques in reproductive biotechnologies, such as Ovum Pick-Up (OPU), In Vitro and In Vivo Embryo Production (PIVE), and Timed Embryo Transfer (TET), all of which are part of a process that ranges from donor selection, through embryo preparation, to their inoculation into carefully chosen recipients. With its advancement, various management technologies have been implemented: including methods for embryo transport, synchronization protocols for donors and recipients, and oocyte recovery protocols for embryo production. Although technology has been infused, the anticipated investments for producing animals of high genetic merit limit its widespread use. However, this analysis addressed essential technological advances for the success of ET, including new protocols, embryo sexing, as well as the use of frozen-thawed (DT) and vitrified embryos. Nevertheless, it is clear that the success of the procedure lies in the entire process. Notably, it emphasizes the significant value of having a qualified professional who is always prepared and updated to ensure quality, efficiency, and sustainability in livestock farming. This literary review was developed with the purpose of acquiring theoretical knowledge, in a detailed and critical way, on the techniques and procedures of Embryo Transfer in cattle, including the collection, manipulation and implantation of embryos. The chapter reconstructs and criticizes one of Anscombe's famous three these, namely the claim that a ‘philosophy of psychology’ is a preliminary task to the construction of any possible ethical theory, or that moral philosophy ‘should be laid aside at any rate until we have an adequate philosophy of psychology, in which we are conspicuously lacking’. The claim is that Anscombe’s idea of a philosophy of psychology cannot be simply identified with that of moral psychology with which we are familiar (...) now; that her main claim, namely that actions are analogous to language is quite promising; that among the implications there is not only a criticism to consequentialism but also acknowledgement of a central role for judgement, and accordingly not just a blunt refusal, but instead an unaware rediscovery of Kantian ethics; that her rediscovery of the idea of virtue is promising enough, albeit misunderstood by Anscombe herself when she presents it in terms of coming back to Aristotelian and Thomist ethics as contrasted with modern moral philosophy.
