Se responde, desde la dogmática de la Corte Constitucional colombiana, aduciendo los “criterios de identificación” normativa de los derechos fundamentales centrados en i) su relación de funcionalidad con el logro del contenido normativo de la dignidad humana, ii) su traducción como derechos subjetivos, iii) los “consensos dogmáticos, jurisprudenciales o de derecho internacional, legal y reglamentario sobre su fundamentalidad” y, iv) su exigibilidad -más que su propia justiciabilidad-, como presupuestos jurídicos, reconocimiento y aplicación pragmática constitucional en la esfera de vida de (...) la persona humana y la comunidad política, basados, también, en los pilares conceptuales del llamado Constitucionalismo Humanista. Symposium on Christopher Bennet's The Apology Ritual. A Philosophical Theory of Punishment [Cambridge University Press, 2008].

The urgent call by UNESCO to scale up interventions for the achievement of sustainable development goals motivated this study to assess the level and association of teachers' (n =107) and students' (n = 342) knowledge, attitudes, and behaviors (KAB) regarding education for sustainable development, focusing on Pili (Canarium ovatum). This is a subset of a larger project that involves Pili to contextualize learning and instructional materials. The researchers used a descriptive cross-sectional survey approach and distributed a questionnaire through Google Forms. (...) KAB levels were categorized into poor, moderate, and high using descriptive data analysis, and their association with one another was determined by using Pearson's Chi- square. The findings indicated that, although the associations among the KAB of teachers were distinct from those of the students, they both perceived that possessing favorable knowledge and attitudes was insufficient to generate positive behaviors. Thus, the efforts to increase teachers' and students' motivation and involvement and to help them carry out favorable behaviors toward sustainable development were imperative. Given this, identifying the barriers to converting knowledge and attitudes into behaviors and considering the factors that involved the association of KAB in promoting sustainable development, particularly in education, were recommended. Central to Bataille’s critique of Hegel is his reading in ‘Hegel, Death, and Sacrifice’ of ‘negation’ and of ‘lordship and bondage’ in the Phenomenology of Spirit. Whereas Hegel invokes negation as inclusive of death, Bataille points out that negation in the dynamic of lordship and bondage must of necessity be representational rather than actual. Derrida, in ‘From Restricted to General Economy’ sees in Bataille’s perspective an undercutting of the overall Hegelian project consonant with his own ongoing deconstruction of Hegelian sublation. I argue that not only does Hegel fail to adequately pursue his own best advice to ‘tarry with the negative,’ but Bataille and Derrida’s critique misconstrues the relation between sublation and dialectic in Hegel’s work. I explicate Adorno’s ‘negative dialectic’ by way of alternative both to Hegelian speculative dialectic and to its Bataillean–Derridean deconstruction. (shrink)

Several prominent contemporary philosophers, including Jürgen Habermas, John Caputo, and Robert Bernasconi, have at times painted a somewhat negative picture of Gadamer as not only an uncritical traditionalist, but also as one whose philosophical project fails to appreciate difference. Against such claims, I argue that Gadamer’s reflections on art exhibit a genuine appreciation for alterity not unrelated to his hermeneutical approach to the other. Thus, by bringing Gadamer’s reflections on our experience of art into conversation with key aspects of his (...) philosophical hermeneutics, we are able to better assess the viability of Gadamer’s contributions to contemporary discussions of difference and alterity. -/- Sections two through six focus on key concepts in Gadamer’s account of art’s dynamic ontology and our experience of art. Such concepts include the play structure of art, hermeneutic identity, tarrying with a work, and contemporaneity. The opening sections provide not only a discussion of these central themes, but they also (1) draw attention to the various ways in which difference and otherness are integral to Gadamer’s account, and (2) utilize relevant musical examples that prepare the reader for a more focused discussion of a Gadamerian approach to free jazz in section seven. By highlighting how Gadamer’s understanding of art possesses a dialogical play structure, is characterized by identity and difference, requires actively engaged spectators and auditors, and is amenable to what many criticize as an unintelligible musical expression, viz. free jazz, Gadamer’s project is shown as other-affirming and open to ambiguity and dynamism. That is, the essential structures and concepts characterizing Gadamer’s reflections on art are likewise central to his overall hermeneutical project, and hence are not rightly described as un-attuned to difference or other-negating. Rather, Gadamer’s philosophical project upholds difference, since it requires a dialogical interplay between self and other that creates the possibility for a transformative experience. (shrink)

In this paper I borrow from Maria Lugones’ work on playful “world-traveling” and W.E.B. Du Bois’ notion of “double consciousness” to make the case that humor can facilitate an openness and cooperative attitude among an otherwise closed, even adversarial audience. I focus on what I call “subversive” humor, that which is employed by or on behalf of those who have been continually marginalized. When effectively used, such humor can foster the inclination and even desire to listen to others and, if (...) only for brief moments, adopt their point of view. To be able to see oneself as others see you can also be a desirable capacity, because along with such multidimensional seeing comes an epistemic advantage lacking in those who have no need nor desire to see as others do, especially if the vision of the others happens to be from below where one perceives that the promises of our explicit ideals are constantly being implicitly broken. Such humor is aesthetic, pleasurable in and of itself, and not amenable to scientific dissection. But it is also a skill that can be honed into a powerful tool of persuasion in circumstances where straightforward arguments are less effective. It can raise consciousness about the lived experiences of those suffering under systemic oppression and foster world travelling. Subversive humor encourages audiences, especially those who contribute to what Jean Harvey calls “civilized oppression”, to playfully travel across worlds and “tarry along” with the perspectives of the marginalized. Resumen: En La actualidad de lo bello, Gadamer hace una referencia reveladora a la improvisación musical y a la importancia de la escucha musical, además de poner en primer plano la necesidad de justificación del arte. Situando este debate a través de Goethe y Platón, junto con las Lecciones de Estética de Adorno de finales de la década de 1950 y una discusión sobre Nietzsche y la Antigüedad, es posible establecer que lo que está en juego es la afinación, así (...) como una tensión que invita a un debate ulterior tanto sobre la detención del amante en Carson como el demorarse en Heidegger. Al revisar la hermenéutica gadameriana de la programación y la interpretación musical, incluida la improvisación y el desafío de la nueva música, las reflexiones de Gadamer sobre la cultura musical en el contexto de la cultura social y su reflexión no solo pueden ser leídas a través de Platón y Goethe, sino también a partir de las concepciones de "lo bello" en Hölderlin y Rilke. Se trata de una "conversación" cultural en la que la contribución del público puede estar en tensión con la programación musical progresiva, además de la dinámica de respuesta que surge en la energeia de la improvisación tanto para el intérprete como para el oyente.// Abstract: Gadamer’s On the Relevance of the Beautiful makes telling reference to musi-cal improvisation and the importance of musical listening in addition to fore-grounding the need for justification. Situating this discussion via Goethe and Plato along with Adorno’s late 1950s lectures on Aesthetics together with a discussion of Nietzsche and antiquity, what is at stake is attunement and a tension which invites a discussion of Carson on the lover’s arrest and Heidegger on tarrying. By reviewing Gadamer’s hermeneutic of musical pro-gramming and performance, including improvisation and the challenge of new music, Gadamer may be read on music culture in the context of social culture and his reflection not only via Plato and Goethe but Hölderlin and Rilke on ‘the beautiful.’ At work is a cultural ‘conversation’ where audience input can be in tension with progressive musical programing along with the dynamic of response emergent in the energeia of improvisation for performer and listener. Although it might seem to elicit only a marginal interest for philosophical inquiry, in 20th century continental philosophy the experience of solitude and loneliness were shown to have unexpected importance and gravity. For philosophers such as M. Heidegger, H. Arendt, H.-G. Gadamer or P. Sloterdijk, solitude and loneliness are to be seen, on the one hand, as an ontological determination of our Being and, on the other, as a cause for some of the most worrisome problems of our times such, (...) as the birth of totalitarianism or the phenomenon of self-alienation wide-spread in the Western bureaucratic societies. But none of the philosophers dealing with these matters offers us a clear positive understanding of what solitude and loneliness actually are nor what the task of philosophy should be with regard to these experiences even though they give us to understand that philosophy has one. The present paper tarries upon this question, approaching it from the other end though an investigation of the status of alterity in Heidegger and Gadamer’s philosophy. (shrink)
