What is the persuasive basis for the doctrine of universal human rights - rights that pertain to all human beings, regardless of national, racial, or religious affiliation? This essay offers some reflections on the subject by considering the contrasting approaches of two thinkers: Vaclav Havel, the playwright, essayist, human rights advocate, and onetime President of Czechoslovakia; and Henri Bergson, the once influential French philosopher and apostle of creative evolution, unfortunately now often forgotten.

A natural extension of Heron's 2000 year old formula for the area of a triangle to the volume of a tetrahedron is presented. This gives the fourth power of the volume as a polynomial in six simple rational functions of the areas of its four faces and three medial parallelograms, which will be referred to herein as "interior faces." Geometrically, these rational functions are the areas of the triangles into which the exterior faces are divided by the points at which (...) the tetrahedron's in-sphere touches those faces. Part I presents an overview of these results and some necessary but little-known background in areal geometry. Part II derives the promised extension, and ends with a conjecture as to how the formula extends to n-dimensional simplices for all n>3. Part III explains how, for n=3, the zeros of the polynomial constitute a five-dimensional semi-algebraic variety consisting almost entirely of collinear tetrahedra with vertices separated by infinite distances, but with generically well-defined distance ratios; it further proves that these unconventional Euclidean configurations can be identified with a quotient of the Klein quadric by an action of a group of reflections isomorphic to ℤ42, wherein four-point configurations in the affine plane constitute a distinguished three-dimensional subvariety. Part IV consists of five appendices which show, among other things, that the algebraic structure of the zeros in the affine plane naturally defines the associated four-element, rank 3 chirotope, aka affine oriented matroid. In the classical account of knowledge, S knows that P if and only if S believes that P, S is justified in believing that P, and P is true (JTB).. In 1963, Gettier presented two problems that casted doubt on this account. Since then, numerous authors proposed modifications or clarifications of JTB, however, these efforts have not produced a satis-factory solution. In this paper, the focus is on logical properties of justification. The Get-tier problem Case II is expressed in sentential (...) logic and Gettier Minimal Assumption (GMA) is introduced. It is shown that Gettier must have used GMA or some other as-sumption that entails GMA in his construction of Case II. Rejection of GMA solves Get-tier problem Case II and it is a step towards a better understanding of the logical proper-ties of justification and knowledge. (shrink)

This article analyses, defines, and refines the concepts of ownership and personal data to explore their compatibility in the context of EU law. It critically examines the traditional dividing line between personal and non-personal data and argues for a strict conceptual separation of personal data from personal information. The article also considers whether, and to what extent, the concept of ownership can be applied to personal data in the context of the Internet of Things (IoT). This consideration is framed around (...) two main approaches shaping all ownership theories: a bottom-up and top-down approach. Via these dual lenses, the article reviews existing debates relating to four elements supporting introduction of ownership of personal data, namely the elements of control, protection, valuation, and allocation of personal data. It then explores the explanatory advantages and disadvantages of the two approaches in relation to each of these elements as well as to ownership of personal data in IoT at large. Lastly, the article outlines a revised approach to ownership of personal data in IoT that may serve as a blueprint for future work in this area and inform regulatory and policy debates. (shrink)

Otázkou je, jakým způsobem to výuku na školách ovlivní i po odeznění restrikcí. Článek se pokouší v aktuálním kontextu analyzovat rizika možné další elektronizace (komputerizace) studia.

The constraints resulting from the current pandemic, in particular the ban on the personal presence of students in the study, give unprecedented scope for the application of distance learning. The question is how this will affect teaching in schools even after the restrictions have disappeared. This text attempts to analyze the benefits and risks of possible further computerization of the study.

Pojem filosofie nabyl v průběhu historie řadu podob a významů. Kromě tradičního teoretického zaměření se lze setkat s přístupem, který vyzdvihuje praktický dopad filosofování na život člověka. Příspěvek představuje koncept filosofické praxe a reflektuje její současný stav na území České republiky. Autoři vymezují filosofickou praxi jako disciplínu filosofie, a načrtávají její možné dělení na dílčí oblasti. Nastíněny jsou její historické kořeny, které autoři identifikují v antickém Řecku. Dále se věnují systematickému představení doposud sepsaných materiálů k filosofické praxi a přehledu její (...) realizace na území České republiky. Detailní pozornost věnují autoři popisu tří jejích oblastí, mezi které patří filosofie pro děti, filosofický workshop a filosofická konzultace. Kromě teoretického vymezení reflektují rovněž své vlastní postupy v uvedených oblastech. Článek čerpá především ze zahraniční odborné literatury, konkrétně z textů a dalších materiálů filosofických praktikantů. Jeho cílem je představit českému čtenáři doposud podrobněji neřešený koncept filosofické praxe a připravit tak pole pro možnou debatu na akademické rovině. -------- The concept of philosophy has had several forms and meanings throughout the history. Besides the traditional theoretical focus, we may also encounter the approach that highlights a practical impact of philosophizing on one’s life. This text introduces the concept of philosophical practice and reflects its current situation in the Czech Republic. Authors characterize philosophical practice as a discipline of philosophy and present its possible division into subsections. They also present its historical roots, which can be found in ancient Greece. Moreover, authors introduce available sources dealing with the philosophical practice and describe how this discipline is actually practiced in the Czech Republic. Detailed attention is given to three of its sections, namely philosophy for children (P4C), philosophical workshop, and philosophical consultation. Authors present theoretical background and also reflect their own methods in these sections. The text draws primarily from scholarly literature from abroad, particularly from the manuscripts and other sources produced by philosophical practitioners. The aim of this text is to introduce the concept of philosophical practice to the Czech reader and prepare the field for further academic discussion. (shrink)

On September 11, 2001, many of us experienced life as what it is not: we lived an extreme instance of the spectacle, of the sublime outside the realm of ethics. Starting with a few compelling questions that the media representations of the attack on the New York World Trade Center inevitably raise, this paper explores a series of similarities, continuums, and extrapolations of the aesthetic in different types of discourse from Friedrich Schiller to Guy Debord. My assessment of the individual‘s (...) dissolution in the ritual (former dissident and present Czech President Václav Havel‘s phrase) rejects the bleak Marxist theories of manipulation, without overlooking, at the same time, the potential dangers of unfreedom that the process of surrendering to the spectacle implies. When future historians chronicle the twentieth century, they will see phenomenology as one of the preeminent social and ethical philosophies of its age. The phenomenological movement not only produced systematic reflection on common moral concerns such as distinguishing right from wrong and explaining the status of values; it also called on philosophy to renew European societies facing crisis, an aim that inspired thinkers in interwar Europe as well as later communist bloc dissidents. Despite this legacy, phenomenology continues to be largely (...) discounted as esoteric and solipsistic, the last gasp of a Cartesian dream to base knowledge on the isolated rational mind. Intellectual histories tend to cite Husserl's epistemological influence on philosophies like existentialism and deconstruction without considering his social or ethical imprint.
