According to the common view, conscientious objection is grounded in autonomy or in ‘freedom of conscience’ and is tolerated out of respect for the objector's autonomy. Emphasising freedom of conscience or autonomy as a central concept within the issue of conscientious objection implies that the conscientious objector should have an independent choice among alternative beliefs, positions or values. In this paper it is argued that: (a) it is not true that the typical conscientious objector has such a choice when they (...) decide to act upon their conscience and (b) it is not true that the typical conscientious objector exercises autonomy when developing or acquiring their conscience. Therefore, with regard to tolerating conscientious objection, we should apply the concept of autonomy with caution, as tolerating conscientious objection does not reflect respect for the conscientious objector’s right to choose but rather acknowledges their lack of real ability to choose their conscience and to refrain from acting upon their conscience. This has both normative and analytical implications for the treatment of conscientious objectors. (shrink)

The problems divulged, analyzed and allegedly solved in Science, Order & Creativity are not scientific problems. They attest to a fundamental failure of science but not to scientific failure per se. Bohm and Peat's meta-scientific undertaking cannot afford, therefore, to remain negative. However, neither science itself nor current professional philosophy are capable of the radical positive rethinking required, in their view, in order to restore and ensure scientific creativity.

Robert Brandom's "The Pragmatist Enlightenment" describes the advent of American pragmatism as signaling a sea-change in our understanding of human reason away from the top-down Euclidian models of reasoning, warrant and knowledge inspired by the physical sciences, toward the far more bottom-up, narrative, inherently fallible and dialogical forms of reasoning of the life and human sciences. Babbage wrote two relatively detailed, yet significantly incongruous, autobiographical accounts of his pre-Cambridge and Cambridge days. He published one in 1864 and in it advertised the existence of the other, which he carefully retained in manuscript form. The aim of this paper is to chart in some detail for the first time the discrepancies between the two accounts, to compare and assess their relative credibility, and to explain their author's possible reasons for knowingly fabricating the less credible of the two.

Essay review of Y. Gingras, Science and Religion: An Impossible Dialogue, Polity Press, 2017.

This article introduces the confrontational theology of the rabbinic literature of late antiquity by means of a well-known, yet ill-understood legend. It goes on to argue that Talmudic confrontationalism comes coupled with an insistent dialogism that, unlike any other major human undertaking, displays a profound awareness of the indispensable role of external normative critique in the process of changing one’s mind.

In his thought-provoking book, Why Law Matters, Alon Harel defends two key claims: one ontological, the other axiological. First, he argues that constitutions and judicial review are necessary constituents of a just society. Second, he suggests that these institutions are not only means to the realization of worthy ends, but also non-instrumentally valuable. I agree with Harel that constitutions and judicial review have more than instrumental value, but I am not persuaded by his arguments in support of this (...) conclusion. I argue that Harel’s ontological claim is unsustainable, and that his axiological claim needs revision. Regarding the former, I show that constitutions and judicial review are only contingent constituents of a just society. Regarding the latter, I contest Harel’s specific account of the value of constitutions and judicial review. Harel grounds the non-instrumental value of constitutions in freedom as non-domination but, upon scrutiny, it emerges that their non-instrumental value lies elsewhere. Further, Harel holds that the non-instrumental value of judicial review stems from its embodying a right to a fair hearing. I argue that this right has non-instrumental value only under a particular set of circumstances. I thus conclude, contrary to Harel, that the non-instrumental value of judicial review is contingent on those circumstances obtaining. (shrink)

To date, both the United States federal government and twenty-one individual states have passed Religious Freedom Restoration Acts that aim to protect religious persons from having their sincere beliefs substantially burdened by governmental interests. RFRAs accomplish this by offering a three-pronged exemption test for religious objectors that is satisfied only when (1) an objector has a sincere belief that is being substantially burdened; (2) the government has a very good reason (e.g., health or safety) to interfere; and (3) there is (...) a reasonable alternative to serve the compelling interest. Legal balancing tests like those found in RFRA are content neutral insofar as they sideline the belief-content of conscientious objections as irrelevant when determining the permissibility of granting legal accommodations. However, some theorists worry that this legal picture may be backward: perhaps balancing tests should be content non-neutral given the usual features of conscientious objections. For example, Yossi Nehushtan contends that, contrary to their typical codification, religious conscience beliefs seem undeserving of special legal accommodations because they possess uniquely strong empirical and theoretical ties to intolerance. Thus, the illiberally intolerant content of these conscientious objections might actually give the state a reason to refuse to grant legal exemptions. In this paper, I offer a cursory defense of content neutrality with respect to balancing tests like those found in RFRA. To begin, I outline Nehushtan’s argument for content non-neutrality. The cornerstone of his argument is that illiberal intolerance is intolerable such that conscientious objections that are based upon illiberally intolerant values provide the state with strong, normally prevailing reason not to grant an exemption. I argue that, even when the illiberally intolerant content of one’s conscience constitutes a weighty and relevant factor in determining the permissibility of granting a legal exemption, there remain significant problems. It is difficult, for example, to determine which views are illiberally intolerant and difficult to say whether illiberally intolerant views can effectively serve as the principled demarcating line in balancing tests. To conclude, I offer several cursory arguments in favor of adopting content-neutral approaches without necessarily making a comprehensive case. By drawing on the work of Amy Sepinwall, Nadia Sawicki, and Nathan Chapman, I show that content-neutral approaches can help to safeguard robust protections for conscience by permitting atypical exercises of conscience, protect minority thoughts and practices from being coercively supplanted by majoritarian understandings of morality, appropriately maintain the skepticism and humility that we owe each other as compatriots in a pluralistic society, and allow the kind of justifiable civil disobedience that has an important place in political history among other things. In spite of all the industrious efforts Peirce scholars have made so far, Peirce’s biography still retains a number of gaps, among which the problem of identity of Peirce’s second wife, Juliette Froissy, stands out most significantly. It is all the more important that, as some scholars suggest, the discovery of any reliable facts about Juliette could provide an explanation to some of the decisions Peirce had made, which irrevocably changed the course of his life, as well as his semiotic (...) theory. By courtesy of Professor Dr. Nathan Houser and the Peirce Edition Project, the writer of the present paper was granted access to the archive materials containing the Max H. Fisch — Maurice Auger correspondence and Victor Lenzen’s notes on Juliette. The paper aims at arranging the dispersed data obtained from these and other sources into a set of several distinct versions, which curiously refer to each other and collectively impose a certain order on some major abductions concerning Juliette’s identity. Mit seinem Satz, sie sollten ihm folgen, denn er wolle sie zu Menschenfischern machen, verbindet Jesus die bisherige Tätigkeit der Fischer mit ihrem zukünftigen Leben als Jünger und Apostel, als Kern der jungen Christengemeinde. Das Netz der Fischer ist dabei weniger ein Gleichnis für ein Werkzeug, mit dem man Fische überlisten kann um (...) sie zu fangen und zu verspeisen, das Netz hält etwas zusammen, wenn es denn gepflegt und an schwachen Stellen immer wieder geflickt wird. Das Netz ist etwas, das unter der Benutzung verschleißt, und es muss, in Stunden der Ruhe, gepflegt werden. Wenn wir heute vom Vernetzt- Sein sprechen und sagen, dass wir unser Netzwerk pflegen müssen, wenn wir uns fragen, ob wir vernetzt sind oder uns verheddert haben, dann meinen wir etwas ganz anderes, als das, was mit dem Fischernetz im Evangelium angesprochen ist. Ich möchte diesen Unterschied deutlich machen und zeigen, dass das Vernetzt-Sein wie es uns heute im Internet, aber auch außerhalb der so genannten Sozialen Medien oder sozialen Netzwerke, begegnet, eben keine notwendige Lebensbedingung des Menschen ist, dass wir nicht etwa schon immer das Streben nach Vernetzung in uns getragen haben, jedenfalls nicht in der Form, wie wir es heute im Internet betreiben. No reader of The Relevance of Charles Peirce will fail to be impressed by what Max Fisch calls "The Range of Peirce's Relevance.' This exciting volume invites scholars in many of the fields of contemporary philosophy to see what Peirce has to contribute to their methods and their conclusions. Articles in the collection offer a more divided interpretation, however, of the meaning of Peirce's relevance. For some, Peirce's relevance is "extensive": like a Renaissance genius, his intellect surveys the universe (...) of human expression, and, by Jove, he has some• thing smart to say about everything! The authors of these articles show us how Peirce enriches the various, established disciplines of philosophy of interest to them, pointing out both the significance and the limitations of his contribution. For others, Peirce's relevance is "intensive": like some philosophic physician, Peirce struggles to cure a malady that infects the Cartesian-Kantian tradition to which he ultimately belongs. Selecting particular instances of this struggle, the authors of these articles try to show how Peirce challenges accepted practices in contemporary philosophy, succeeding in his critical task without necessarily offering unproblematic alternatives. As a whole, the collection successfully promotes the first interpretation of Peirce's relevance, but fails to give sufficient attention to the second. Perhaps the failure is prudent. For the sake of attracting interest among the uninitiated, The Relevance of Charles Peirce offers the most Peirce with the least offense. For that, we are indebted to Eugene Freeman, editor of the collection, as well as of The Monist Library of Philosophy. Freeman first proposed devoting two issues of The Monist to "Peirce's Relevance" (Vol. 63, No. 3, and Vol. 65, No. 2), then did us the service of publishing the present volume by binding The Monist articles together with five other already published pieces.
