This article affords particular attention to the relationship between memory, the narrativization of news and its linear construction, conceived as journalism’s ‘memory- work’. In elaborating upon this ‘work’, it is proposed that the Hegelian notion of retroactive causation (as used by Slavoj Žižek) can examine how analyses of news journalists ‘retroactively’ employ the past in the temporal construction of news. In fact, such retroactive (re)ordering directs attention to the ways in which journalists contingently select ‘a past’ to confer meaning on (...) the present. With regard to current literature, it is noted that a retroactive analysis can highlight two important dialectics within the practice of news journalism: 1) the relation between contingency and necessity; and, 2) the relation between content and form. Indeed, it is argued that this theoretical account offers a novel approach to examining the significance of memory in news journalism as well as the inconsistencies which underscore journalism’s memory-work. It is in accordance with such inconsistency that broader reflections on time, temporality and our relations to the past can be made. (shrink)

John Fischer has recently argued that the value of acting freely is the value of self-expression. Drawing on David Velleman’s earlier work, Fischer holds that the value of a life is a narrative value and free will is valuable insofar as it allows us to shape the narrative structure of our lives. This account rests on Fischer’s distinction between regulative control and guidance control. While we lack the former kind of control, on Fischer’s view, the latter is all that is (...) needed for self-expression. I first develop Fischer’s narrative account, focusing on his reliance on temporal loops as giving us control over the value of our lives. Second, I argue that the narrative account grants us greater power over the past than Fischer would allow: since narrative allows not only for changes in how we feel about episodes in our past but what those episodes in fact were, it allows for a kind of retroactive self-constitution. Finally, I suggest that this modification of the narrative view opens the possibility of a conception of freedom far stronger than guidance control. It does not give us the libertarian control over whether to choose A or B in the present, but it does provide a measure of control over the sort of person an agent has been, and thus whether she is the sort of person who will choose A or B in the future. In this paper, I present a problem for the realist with respect to the institutional sphere, and suggest a solution. Roughly, the problem lies in a contradiction that arises as soon as institutional contexts are allowed to influence the institutional profile of objects and events not only in the present, but also in the past. If such “retroactive enactments” are effective, in order to avoid contradiction the realist seems to have to accept the unpleasant conclusion that institutions can create a (...) past that has never been present. I will defend a solution which involves a distinction between temporal and atemporal types of institutional kinds that has, I maintain, independent interest. (shrink)

Freud introduces his dualistic theory of the life and death drives in Beyond the Pleasure Principle. Much of that essay is devoted to the justification of the death drive, while little is said in defense of the introduction of “life drives” and “Eros,” which he claims are simply an extension of his libido theory from the psychological into the biological realm. In this essay, I argue that Eros is, on the contrary, fundamentally incompatible with Freud’s metapsychology. I first show that (...) Freud’s theory of society permits the production and preservation of social bonds only through the restraint of sexual aims rather than, as the theory of Eros would require, through the satisfaction of sexual drives. I then demonstrate that Eros is incompatible with three key elements of Freud’s metapsychology: the theories of the drives, the pleasure principle, and the principle of constancy. Finally, I argue that the death drive is indistinguishable from the early and late theories of the principle of constancy. Consequently, it is the death drive, and not Eros, that is merely an extension of the original libido theory. Because Eros is incompatible with the very foundations of Freud’s metapsychology, his drive theory can only consistently be interpreted as a monism of the death drive. (shrink)

We can evaluate laws as better or worse relative to different normative standards. One might lament the fact that a law violates human rights or, in a different register, marvel at its ease of application. A question in legal philosophy is whether some standards for evaluating laws are fixed by—or grounded in—the very nature of law. I take Raz’s discussion of the distinctively legal virtues, those that fall under the rubric of the “Rule of Law” such as clarity, generality, and (...) non-retroactivity, as my starting point for exploring a very general puzzle about the relationship between law’s essence and its virtue. -/- The claim that there are some virtues that laws have qua laws invites a comparison between law and other “goodness-fixing kinds.” A kind is goodness-fixing if what it is to be a member of the kind fixes a standard for evaluating instances as better or worse. For example, if an object belongs to the kind CLOCK, whether it keeps time accurately provides a basis for evaluating it as better or worse as a clock. Furthermore, the relevant normative fact—if a clock does not keep time accurately, it is a bad clock—is at least partly explainable in terms of the nature of clocks (clocks are things that are supposed to be keep time accurately). Hence, for any goodness-fixing kind, K, that sets a standard, S, for evaluating Ks as Ks, we can ask: (1) How does the nature of Ks explain S? (2) Does being a K depend on meeting a minimum threshold of S-relative goodness? In the case of law and its constitutive standard defined by the Rule-of-Law virtues, these questions lack settled answers. Although Raz offers some discussion, I argue that his answers have the surprising upshot of rendering law sui generis relative to other goodness-fixing kinds, and that preserving continuity with other goodness-fixing kinds involves revising the general picture. This paper ties together several anthropological and naturphilosophische themes in Hegel in order to re-examine the place of the philosophy of nature in the Encyclopedia. By taking Hegel’s anthropology as a starting point, I argue that his philosophy of nature has for its subject not nature “as such,” but nature as cognized by Geist, so that the identity of these two natures is only constructed by spirit itself retroactively. I trace the origin of this difference to the revolutionary event that (...) institutes Hegel’s anthropology – which is not a transition from nature to spirit, but a pure break or new beginning, culminating in the creation of the conceptual world of nature as “we” know it. As a result, the philosophy of nature does not precede, but follows from, the anthropology and the philosophy of spirit; the natural foundation is retroactively replaced by the philosopher with the anthropological one. Teleological theories of reason and value, upon which all reasons are fundamentally reasons to realize states of affairs that are in some respect best, cannot account for the intuition that victims in non-identity cases have been wronged. Many philosophers, however, reject such theories in favor of alternatives that recognize fundamentally non-teleological reasons, second-personal reasons that reflect a moral significance each person has that is not grounded in the teleologist’s appeal to outcomes. Such deontological accounts appear to be better positioned to (...) identify the wrong committed against non-identity victims because a person wrongs another on such accounts if she violates his second-personal claims -- overall benefit to victims presents no obstacle to the identification of second-personal wrongdoing. Derek Parfit argues that non-identity is a problem for these deontological theories as well because the alleged victims are properly understood as consenting to the action in question, thereby waiving any such second-personal claim. But his arguments misrepresent the role of consent on such theories by articulating it through appeal to the very teleological theory of reasons that their advocates dismiss as inadequate. Properly understood, Parfit’s appeal to consent understood as retroactive endorsement only provides the answer on such deontological accounts to the question of whether, given that the non-identity victim is second-personally wronged, he is nonetheless better off existing. Indeed, it becomes clear that it is teleological theories for which non-identity poses a particular problem: they cannot -- while their deontological counterparts can – account for the intuition that non-identity victims have been wronged. Surveillance programs supporting the management of One Health issues such as antibiotic resistance are complex systems in themselves. Designing ethical surveillance systems is thus a complex task (retroactive and iterative), yet one that is also complicated to implement and evaluate (e.g., sharing, collaboration, and governance). The governance of health surveillance requires attention to ethical concerns about data and knowledge (e.g., performance, trust, accountability, and transparency) and empowerment ethics, also referred to as a form of responsible self-governance. Ethics in reflexive governance (...) operates as a systematic critical-thinking procedure that aims to define its value: What are the “right” criteria to justify how to govern “good” actions for a “better” future? The objective is to lay the foundations for a methodological framework in empirical bioethics, the rudiments of which have been applied to a case study to building reflexive governance in One Health. This ongoing critical thinking process involves “mapping, framing, and shaping” the dynamics of interests and perspectives that could jeopardize a “better” future. This paper proposes to hybridize methods to combine insights from collective deliberation and expert evaluation through a reflexive governance functioning as a community-based action-ethics methodology. The intention is to empower individuals and associations in a dialogue with society, which operation is carried out using a case study approach on data sharing systems. We based our reasoning on a feasibility study conducted in Québec, Canada (2018–2021), envisioning an antibiotic use surveillance program in animal health for 2023. Using the adaptive cycle and governance techniques and perspectives, we synthesize an alternative governance model rooted in the value of empowerment. The framework, depicted as a new “research and design (R&D)” practice, is linking operation and innovation by bridging the gap between Reflexive, Evaluative, and Deliberative reasonings and by intellectualizing the management of democratizing critical thinking locally (collective ethics) by recognizing its context (social ethics). Drawing on the literature in One Health and sustainable development studies, this article describes how a communitarian and pragmatic approach can broaden the vision of feasibility studies to ease collaboration through public-private-academic partnerships. The result is a process that “reassembles” the One Health paradigm under the perspective of global bioethics to create bridges between the person and the ecosystem through pragmatic ethics. (shrink)

One way to silence the powerless, Langton has taught us, is to pre-emptively disable their ability to do things with words. In this paper I argue that speakers can be silenced in a different way. You can let them speak, and obscure the meaning of their words afterwards. My aim is to investigate this form of silencing, that I call retroactive distortion. In a retroactive distortion, the meaning of the words of a speaker is distorted by the effect of a (...) subsequent speech act by a different speaker. After introducing this notion, I explore some reasons why retroactive distortions can be difficult to challenge and argue that, besides constituting a communicative injustice, they can eliminate topics from public consideration and therefore erode public debate. In our recent article, together with more than 60 of our colleagues, we outlined a proposal for drug policy reform consisting of four specific yet interrelated strategies: (1) de jure decriminalization of all psychoactive substances currently deemed illicit for personal use or possession (so-called “recreational” drugs), accompanied by harm reduction policies and initiatives akin to the Portugal model; (2) expunging criminal convictions for nonviolent offenses pertaining to the use or possession of small quantities of such drugs (and releasing those serving (...) time for these offenses), while delivering retroactive ameliorative relief; (3) the ultimate legalization and careful regulation of currently illicit drugs; and (4) the delivery of a new “Marshall Plan” focused on community-building initiatives, expanded harm reduction programs, and social and health care support efforts (Earp et al. 2021). We were gratified to see so many thoughtful commentaries on our proposal, and we respond to them in part in this reply. (shrink)

The main question of metasemantics, or foundational semantics, is why an expression token has the meaning (semantic value) that it in fact has. In his reading of Ludwig Wittgenstein’s later work, Saul Kripke presented a skeptical challenge that threatened to make the foundational question unanswerable. My first contention in this paper is that the skeptical challenge indeed poses an insoluble paradox, but only for a certain kind of metasemantic theory, against which the challenge effectively works as a reductio ad absurdum (...) argument. My second contention is that as a result of rejecting the theory which entails a paradoxical outcome, we will see that the foundational question essentially involves a temporal dimension. After arguing that the skeptical challenge gives us a strong reason to adopt a historical view of meaning, I shall further argue against certain authors who claim that meanings not only have histories but futures as well, or that the meaning of a word may change retroactively in time as a consequence of counterfactual change in its future use. The major aim of the paper is thus to bring together the arguably interrelated debates about the skeptical challenge and temporal externalism in philosophy of language. (shrink)

When the NCAA adopted new rules allowing athletes to profit off their name, image, and likeness (NIL), few people took more interest than Reggie Bush who famously relinquished the Heisman trophy after being ruled retroactively ineligible for receiving "impermissible benefits." Bush has argued for his reinstatement and the "return" of his Heisman. In this paper, I argue that, while the NCAA never should have required players to be amateurs in the first place, Bush should not be reinstated or have the (...) Heisman "returned." The assertion that an experiment by Afshar et al. demonstrates violation of Bohr’s Principle of Complementarity is based on the faulty assumption that which-way information in a double-slit interference experiment can be retroactively determined from a future measurement.

Freeganism is the practice of eating food that is free. It is commonly associated with recovering food that grocery stores and restaurants have thrown away, but vegetables grown in one’s garden and other free foods, such as leftovers from a work event, would also qualify. It is worth asking whether there is a form of freeganism that can be justified in new omnivorist terms. Could it be consistent with animal protection to eat meat, just so long as we don’t pay (...) for it? -/- I argue that from an animal protection point of view, freegan meat consumption faces two difficulties. The first is that when it involves the consumption of animal flesh conventionally regarded as edible (chicken, pork, beef, etc.) but not other types of flesh commonly considered inedible (mice, dogs, etc.), the practice is likely to be rooted in speciesism. This runs contrary to new omnivorism’s own principles, which are anti-speciesist. In addition, when the meat in question is the product of animal agriculture, consuming it will amount to a form of complicity in the industry’s wrong-doing, as the rationale for the animal’s slaughter will be retroactively endorsed. Either of these two considerations taken by itself will suffice to generate a presumption against freegan meat consumption. -/- My analysis, however, does not address every conceivable defense of freegan meat consumption. In particular, neither consideration generates a reason to avoid all animal by-products, such as eggs from backyard chickens that are well cared for. But given that the by-products in question will not be industrially produced, such consumption is likely to be permissible only in exceptional instances, rather than a practice available to society at large. The aim of this paper is to analyze a selection of arguments used by the Argentine Supreme Court to reduce the sentence of individuals convicted of crimes against humanity. The focus will be primarily centered on “Muiña´s case”, in which a lenient outdated ruling was made. The questions that this work will try to answer revolve around the court´s merit in issuing this lenient ruling to Muiña´s case and its justification. First, Muiña´s case is analyzed in depth. Then, a critical (...) analysis about the ruling and a decision concerning the existence of a true justification will be developed. Finally, we will discuss the appropriateness of the Court’s decision in Muiña´s case as opposed to the decision made in “Batalla´s case”, in which a less beneficial law was applied retroactively. A surprisingly large number of scholars believe that (a) we are blameworthy, and therefore punishable, only for what we have control over; (b) we have control only over our actions and intentions, not the consequences of our actions; and therefore (c) if two agents perform the very same action (e.g., attempting to kill) with the very same intentions, then they are equally blameworthy and deserving of equal punishment – even if only one of them succeeds in killing. This paper argues (...) against these “equivalence theorists” that harmful consequences do make a moral difference, that the harm produced by the killer’s attempt retroactively makes her action more blameworthy, and therefore deserving of more punishment, than the failed attempter’s attempt. The primary argument for this “non-equivalence theory” is an analogy with gambling. Just as a gambler makes a deal with the casino to allow metaphysical luck to retroactively determine the “profit status” of her bet, so too the attempted killer makes a deal with “the casino of morality” to allow metaphysical luck to retroactively determine the moral status of her attempt. She makes the “moral deal” that if her attempt succeeds, her attempt was more blameworthy than if her attempt does not succeed. And it is the greater blameworthiness of the killer’s attempt that justifies our intuition that the killer should be punished more harshly than the failed attempter. (shrink)

El presente trabajo confronta el abordaje de la cuestión del sujeto en Louis Althusser y Ludwig Wittgenstein. La comparación se produce porque el tratamiento del lenguaje de la filosofía del segundo Wittgenstein es particularmente apropiado para abordar la intervención del discurso en el proceso por el cual la ideología interpela a los individuos como sujetos, según Althusser. El descentramiento del sujeto obliga a repensar la dimensión de la agencia, y con ella, la de la política. Tanto Wittgenstein como Althusser desembocan (...) en una encrucijada: negación teórica de la noción de sujeto y reconocimiento de la existencia paradójica de la misma en la práctica. Ello implica deconstruir el par "determinismo-libertad" sobre el que se asienta la pregunta por la agencia. This comparison is motivated by the fact that second Wittgenstein’s approach to language is particularly appropriate to think of the intervention of discourse in the process of ideological interpellation which, according to Althusser,constitutes individuals as subjects. The decentering of the involved subject requires rethinking the dimension of agency and, consequently, of politics. Both, Wittgenstein and Althusser, end in a crossroads: they refuse theoretical prominence to the notion of the subject, but at the same time they recognise the practical priority of this notion, which gives it a sort of paradoxical existence. This implies deconstructing the pair “determinism–liberty” where the priority of agency is located. We end with the work of Michel Pêcheux on the retroactive effects of discourse, that entail (in agreement with Wittgenstein) rethinking the vocabulary of determination, prominent in Althusserian writings. Douglas Yacek’s recent book The Transformative Classroom proposes a useful aspirational model of transformative education. In this critical commentary, I review this model and suggest that while it succeeds in overcoming some ethical shortcomings of other dominant models of transformative education, I would like to suggest that focusing on more subtle transformative gestures could have the benefit of being less dependent of the teacher’s intention to transform and of being less constrained by the expectation that transformation should take place primarily (...) in the classroom. When transformation is conceived as an educational fiction, it may be conceived as a retroactive experience constructed around memories of the teacher’s transformative gestures, thereby adding to Yacek’s aspirational model by allowing for transformation to continue beyond the walls of the classroom. This paper aims to mobilize the concept of “aleatory materialism” from Althusser’s posthumous work “The Underground Current of the Materialism of the Encounter” to theorize the emergence of a capitalist mode of production and analyze theoretical problems of thinking through the emergence of a communist mode of production out of capitalism. A “materialism of the encounter,” with its non-teleological account of causality can theorize the emergence of such a complicated object and help think through transitions without recourse to necessity or (...) sufficient reason. Retroactively, we can identify the discreet encounters that have “taken hold” in the institution of the capitalist mode of production, but we cannot trace with any necessity the islets that would form a communist mode of production. São particularmente interessantes os tipos (...) de coisas que parecem naturais, mas que se argumenta serem na realidade construídos socialmente. Nesta entrada, identifico o papel que as teses construtivistas têm no progresso social e político, distingo entre várias formas de construtivismo teoricamente interessantes – causal e constitutivo, e discuto três objecções à ideia do construtivismo factual. Over one hundred years ago, the Supreme Court emphatically declared that deportation proceedings are civil, not criminal, in nature. As a result, none of the nearly 400,000 individuals who were deported last year enjoyed any of the constitutional protections afforded to criminal defendants under the Sixth or Eighth Amendments. Among those 400,000 were numerous detained juveniles and mentally ill individuals who, as a result of the civil designation, had no right to appointed counsel. These individuals were thus forced to navigate (...) the labyrinth of immigration law alone. Others were lawful permanent residents who had pled guilty to minor offenses upon the correct advice of counsel that they could not be deported. These individuals later became subject to deportation when Congress retroactively changed the law, unbound by the criminal prohibition against ex post facto laws. The dichotomy between the gravity of the liberty interest at stake in these proceedings––a lifetime of exile from homes and families in the United States––and the relative dearth of procedural protections afforded respondents, has always been intuitively unjust to some. However, over the past twenty years, as immigration and criminal law have become intertwined as never before, the intuitive sense of many has matured into a scholarly movement exploring the criminalization of immigration law. This movement has taken aim at the incoherence of deportation’s civil designation. Until recently, however, there was little reason to think the Supreme Court would wade into the waters of the resurgent debate over the nature of deportation proceedings. In Padilla v. Kentucky, 130 S.Ct. 1473 (2010), however, the Court surprised almost everyone as it went to great length to chronicle the criminalization of immigration law and ultimately concluded that deportation is - uniquely difficult to classify. The immediate impact of the Padilla decision is the critical recognition that criminal defendants have a right to be advised by their attorneys if a plea they are contemplating will result in deportation. However, I argue, that in time Padilla may come to stand for something much more significant in immigration jurisprudence. When we read Padilla in the context of the Supreme Court’s evolving immigration jurisprudence, there is good reason to believe that Padilla is a critical pivot point for the Court. Padilla marks the beginning of a significant reconceptualization of the nature of deportation toward the realization that it is neither truly civil nor criminal. Rather, deportation is different. It is a unique legal animal that lives in the crease between the civil and criminal labels. This article explores the evolving arch of Supreme Court jurisprudence regarding the quasi-criminal nature of deportation proceedings and articulates a principled mechanism by which the scope of respondents’ rights can be defined under this new framework. Schelling and Deleuze are polarised respectively as philosopher of identity and philosopher of difference par excellence. Schelling grounds reason in his early Naturphilosophie in the a priori identity deduced from the abstraction of the proposition A=A. Deleuze, however, reworks the Platonic Idea and Nietzsche’s Eternal Return in the service of an a priori ‘problematic being’, an ontological difference-in-itself, which precedes metaphysical identity. Despite their apparently polarised metaphysical groundwork, they stumble across a similar consequence: the distinction between subject and object, and (...) any problematic derived thereof, is in consequence of the ontological constitution of the object itself. The paradox of objectivity as indifference to an a priori difference or identity is presented, and preliminarily suggested to be due to the Deleuze-Schelling opposition not being a difference-identity opposition, but an opposition between difference and a ‘blind act’ which retroactively precedes the making-identical to itself of the one as distinguished from the many. Oscar Wilde's The Critic as Artist is shown to foreshadow some key concepts of poststructuralist interpretive theory - such as the necessary interplay of blindness and insight in criticism (Lacan, Paul de Man), or the retroactive effect of interpretation in the construction of the work. More specifically, Wilde's reading of the riddle of the Sphinx in a passage of this work both theorizes and dramatizes the paradoxical relationship between blindness and insight, in the shape of an ironic prophecy which can (...) be read as Wilde's announcement of his own tragic downfall - in which there is an element of compulsive acting out that has been noted by a number of previous critics. That is, Wilde's Sphinx is used as the vehicle of a riddle about Wilde himself, and is an emblem of his own ambivalent attitude toward the public revelation of his homosexuality. Agonism as a political theory emphasizes the ontological aspect of conflict in human political interaction. This article aims to shed light on the political practice of agonism – and in doing so on its limits – by viewing 'crisis discourse' as an agonistic political practice. As my analysis of the Dutch Socialist Party and the Freedom Party’s speech in the European Sovereign Debt Crisis shows, crisis discourse aimed to (re)create a ‘people’ and to justify radical change in economic and social (...) structures. Crisis discourse is employed to construct an 'other' that can be based on ethnic and nationalist terms and to justify retroactive application of the law and the stripping of Dutch citizens of their rights. This attention to crisis discourse as an agonistic political practice highlights an unease within agonism itself: where must the agonist accepts limits to the conflict and contestation she so values? The article starts with Chantal Mouffe's answer to this question - her insistence that legitimate conflict must always recognize the shared values of equality and liberty - and proceeds to show that Mouffe's view unnecessarily relies on a deliberative democratic desire for consensus. Other than Mouffe, I draw on Honig’s emphasis of perpetual contestation to propose that the issue of limits can be best answered by reference to the core of agonistic thought: the preservation of the struggle over political norms and processes. It is not shared values or even a shared political space that matters, but that the political space of the ‘people’ – however contested membership therein might be – remains a place that the 'other' can re-enter. This article critically details how the work of Slavoj Žižek theoretically elaborates on the links between nationalism and sport. Notably, it highlights how key terms, drawn from Žižek’s work on fantasy, ideology and the Real (itself grounded in the work of Jacques Lacan), can be used to explore the relationship between sport, nationalism and enjoyment (jouissance). In outlining this approach, specific attention is given to Žižek’s account of the ‘national Thing’. Accordingly, by considering the various ways in which sport organizes, (...) materializes and structures our enjoyment, the emotive significance of sport during national sporting occasions is both introduced and applied. Moreover, it is argued that such an approach offers a unique and valuable insight into the relationship between sport and nationalism, as well as an array of social and political antagonisms. The purpose of this text is to present a summary of the theory of self-reference as a result of the superposition of the causal history of a system. Self-reference is discussed here as an effect of the association between memory and causality. When considering the eventual situation of a physical system, different previous alternatives can take it to the same state. The means that constituted it are not intrinsic to it, there are no elements in it to retroact to its (...) previous state. In a system of causal superposition, however, the state contains the history of the states that constituted it. (shrink)

Now that death is in the air; we will understand what (...) this handbook's real worth is! COVID 19 won't go with steroids and anti-malarials. Nor is Ebola or Zika going anywhere.
