Many recent political philosophers have attempted to demonstrate that choice and responsibility can be incorporated into the framework of an egalitarian theory of distributive justice. This article argues, however, that the project of developing a responsibility-based conception of egalitarian justice is misconceived. The project represents an attempt to defuse conservative criticism of the welfare state and of egalitarian liberalism more generally. But by mimicking the conservative’s emphasis on choice and responsibility, advocates of responsibility-based egalitarianism unwittingly inherit the conservative’s unsustainable justificatory (...) ambitions, unattractive moralism, and questionable metaphysical commitments. More importantly, they misrepresent the nature of our concern with equality as a value. (shrink)

Efforts to promote equitable public policy with algorithms appear to be fundamentally constrained by the “impossibility of fairness” (an incompatibility between mathematical definitions of fairness). This technical limitation raises a central question about algorithmic fairness: How can computer scientists and policymakers support equitable policy reforms with algorithms? In this article, I argue that promoting justice with algorithms requires reforming the methodology of algorithmic fairness. First, I diagnose the problems of the current methodology for algorithmic fairness, which I call “formal algorithmic (...) fairness.” Because formal algorithmic fairness restricts analysis to isolated decision-making procedures, it leads to the impossibility of fairness and to models that exacerbate oppression despite appearing “fair.” Second, I draw on theories of substantive equality from law and philosophy to propose an alternative methodology, which I call “substantive algorithmic fairness.” Because substantive algorithmic fairness takes a more expansive scope of analysis, it enables an escape from the impossibility of fairness and provides a rigorous guide for alleviating injustice with algorithms. In sum, substantive algorithmic fairness presents a new direction for algorithmic fairness: away from formal mathematical models of “fair” decision-making and toward substantive evaluations of whether and how algorithms can promote justice in practice. The Market Failures Approach (MFA) is one of the leading theories in contemporary business ethics. It generates a list of ethical obligations for the managers of private firms that states that they should not create or exploit market failures because doing so reduces the efficiency of the economy. Recently the MFA has been criticised by Abraham Singer on the basis that it unjustifiably does not assign private managers obligations based on egalitarian values. Singer proposes an extension to the MFA, the (...) Justice Failures Approach (JFA), in which managers have duties to alleviate political, social, and distributive inequalities in addition to having obligations to not exploit market failures. In this paper I describe the MFA and JFA and situate them relative to each other. I then highlight a threefold distinction between different types of obligations that can be given to private managers in order to argue that a hybrid theory of business ethics, which I call the MFA +, can be generated by arguing that managers have obligations based on efficiency and duties based on equality to the extent that these latter obligations do not lead to efficiency losses. This argument suggests a novel theoretical option in business ethics, elucidates the issues that are at stake between the MFA and the JFA, and clarifies the costs and benefits of each theory. The COVID-19 pandemic has been overwhelming public health-care systems around the world. With demand exceeding the availability of medical resources in several regions, hospitals have been forced to invoke triage. To ensure that this difficult task proceeds in a fair and organised manner, governments scrambled experts to draft triage guidelines under enormous time pressure. Although there are similarities between the documents, they vary considerably in how much weight their respective authors place on the different criteria that they propose. Since most (...) of the recommendations do not come with ethical justifications, analysing them requires that one traces back these criteria to their underlying theories of distributive justice. In the literature, COVID-19 triage has been portrayed as a value conflict solely between utilitarian and egalitarian elements. While these two accounts are indeed the main antipodes, I shall show that in fact all four classic theories of distributive justice are involved: utilitarianism, egalitarianism, libertarianism, and communitarianism. Detecting these in the documents and classifying the suggested criteria accordingly enables one to understand the balancing between the different approaches to distributive justice—which is crucial for both managing the current pandemic and in preparation for the next global health crisis. University of Alberta Forthcoming in Utilias Consider Lives for Headaches: there is some number of headaches such that the relief of those headaches is sufficient to outweigh the good life of an innocent person. Lives for Headaches is unintuitive, but difficult to deny. The argument leading to Lives for Headaches is valid, and appears to be constructed out of firmly entrenched premises. In this paper, I advocate one way to reject Lives for Headaches; I defend a form of lexical superiority (...) between values. Based on an inquiry into the notion of human well-being, I argue that no amount of headaches is sufficient to outweigh the disvalue of the loss of a good life. Though this view has been thought subject to devastating objections, these objections are not dispositive against the form of value superiority I advance here. (shrink)

Faith in the universal moral equality of people enjoys close to unanimous consensus in present moral and political philosophy. Yet its philosophical justification remains precarious. The search for the basis of equality encounters insurmountable difficulties. Nothing short of a miracle seems required to stabilize universal equality in moral status amidst a vast space of distinctions sprawling between people. The difficulties of stabilizing equality against differentiation are not specific to any particular choice regarding the basis of equality. To show this, I (...) will provide a general diagnosis of the difficulty together with its application to the arguably best attempt at a solution, namely to ground moral equality in a form of subjectivity. In his recent book Equality for Nonegalitarians, George Sher advances the view that “we are moral equals because we are equally centers of consciousness. …The fact that we are equals in this respect—that each is a world unto himself—…explains why each person’s interests are of equal moral importance”. Yet the worlds we are unto ourselves can no more withstand the force of differentiation than previous candidates suggested in the literature, and the reasons why run deeper than even some critics have recognized. The prospects for vindicating universal moral equality remain bleak. (shrink)

According to all-luck egalitarianism, the differential distributive effects of both brute luck, which defines the outcome of risks which are not deliberately taken, and option luck, which defines the outcome of deliberate gambles, are unjust. Exactly how to correct the effects of option luck is, however, a complex issue. This article argues that (a) option luck should be neutralized not just by correcting luck among gamblers, but among the community as a whole, because it would be unfair for gamblers as (...) a group to be disadvantaged relative to non-gamblers by bad option luck; (b) individuals should receive the warranted expected results of their gambles, except insofar as individuals blamelessly lacked the ability to ascertain which expectations were warranted; and (c) where societal resources are insufficient to deliver expected results to gamblers, gamblers should receive a lesser distributive share which is in proportion to the expected results. Where all-luck egalitarianism is understood in this way, it allows risk-takers to impose externalities on non-risk-takers, which seems counterintuitive. This may, however, be an advantage as it provides a luck egalitarian rationale for assisting ‘negligent victims’. (shrink)

Some claim that a commitment to egalitarianism is in tension with support for reparations for historical injustice. This tension appears to arise insofar as egalitarianism is a forward-looking approach to justice: an approach that tells us what kind of world we should aim to build, where that world is not defined in terms of the decisions or actions of previous generations. Some have claimed that egalitarianism thereby renders reparations redundant. One popular option for egalitarians who aim to reject this thesis (...) is to insist that historical injustices demand reparations when they have caused present-day inequality. A promising alternative, skilfully defended by Alasia Nuti in Injustice and the Reproduction of History, is to argue that historical injustices stand in need of repair when they are reproduced into the present-day, such that some past and present injustices are in fact the same injustice. In this paper, I assess these egalitarian responses to the redundancy thesis. I find that Nuti’s account is equipped to reject this thesis, but that the same lines of reply can be adopted by proponents of the causal approach. I suggest that both approaches therefore be viewed as potential ways to conceptualise the relationship between historical injustice and our present normative circumstances; and that in choosing between them, we should understand ourselves to be engaged in an ameliorative project – a project that is guided by, and designed to help us to achieve, our legitimate purposes. The National Institute for Health and Care Excellence, the UK’s main healthcare priority-setting body, recently reaffirmed a longstanding claim that in recommending technologies to the National Health Service it cannot apply the ‘rule of rescue’. This paper explores this claim by identifying key characteristics of the rule and establishing to what extent these are also features of NICE’s approach to evaluating ultra-orphan drugs through its highly specialised technologies programme. It argues that although NICE in all likelihood does not act because (...) of the rule in prioritising these drugs, its actions in relation to HSTs are nevertheless in accordance with the rule and are not explained by the full articulation of any alternative set of rationales. That is, though NICE implies that its approach to HSTs is not motivated by the rule of rescue, it is not explicit about what else might justify this approach given NICE’s general concern with overall population need and value for money. As such, given NICE’s reliance on notions of procedural justice and its commitment to making the reasons for its priority-setting decisions public, the paper concludes that NICE’s claim to reject the rule is unhelpful and that NICE does not currently meet its own definition of a fair and transparent decision-maker. Principles of need are constantly referred to in health care priority setting. The common denominator for any principle of need is that it will ascribe some kind of special normative weight to people being worse off. However, this common ground does not answer the question how a plausible principle of need should relate to the aggregation of benefits across individuals. Principles of need are sometimes stated as being incompatible with aggregation and sometimes characterized as accepting aggregation in much the same (...) way as utilitarians do. In this paper we argue that if one wants to take principles of need seriously both of these positions have unreasonable implications. We then characterize and defend a principle of need consisting of sufficientarian elements as well as prioritarian which avoids these unreasonable implications. (shrink)

The proposition that digital innovations can put people in charge of their health has been accompanied by prolific talk of empowerment. In this paper we consider ethical challenges and opportunities of trying to achieve justice and empowerment using digital health initiatives. The language of empowerment can misleadingly suggest that by using technology, people can control their health and take responsibility for health outcomes to a greater degree than is realistic or fair. Also, digital health empowerment often primarily reaches people who (...) already have high technological and health literacy, leaving others behind. We critically investigate whether the concept of health empowerment could be re-engineered to mean something different, namely the process of improving the health literacy and access of those who least possess it, in line with recent proposals for conceptual engineering in the service of justice. We settle on the weaker conclusion that underlying ethical values including justice should be used to interpret the existing concept of empowerment. To conclude, we take a high-level view of various strategies for achieving the ethical value associated with digital health empowerment. (shrink)

What, if anything, is wrong with high executive compensation? Is the common “lay reaction” of indignation and moral outrage justified? In this paper, my main goal is to articulate in a more systematic and philosophical manner the egalitarian responses to these questions. In order to do so, I suggest that we take some insights from recent debates on two versions of egalitarianism: a distributive one, according to which no one should be worse off than others because of unfair distributions of (...) goods and resources, especially ones based on matters of luck or arbitrary factors, and a relational one, which maintains that egalitarian justice requires members of a society to relate to one another as equals. Drawing on recent attempts to highlight the tricky nature of managerial authority, I argue that high inequalities in pay are not simply a distributional matter but should also be analyzed through a relational lens. I also attempt to show that relational egalitarians are well-equipped to question the now dominant “incentives” view of CEO compensation. (shrink)

In recent years, the issue of accepting a higher cost per health improvement for orphan drugs has been the subject of discussion in health care policy agencies and the academic literature. This article aims to provide an analysis of broadly egalitarian arguments for and against accepting higher costs per health improvement. More specifically, we aim to investigate which arguments one should agree upon putting aside and where further explorations are needed. We identify three kinds of arguments in the literature: considerations (...) of substantial equality, formal equality, and opportunity cost. We argue that considerations of substantial equality do not support higher costs per health improvement orphan drugs, even if such considerations are considered valid. On the contrary, arguments of formal equality may support accepting a higher cost per health improvement for orphan drugs. However, in order to do so, a number of both normative and empirical issues must be resolved; these issues are identified in the article. For instance, it must be settled to what extent the opportunity cost in terms of foregone health for other patients is acceptable in order to uphold formal equality. We conclude that certain arguments can be set aside, and future focus should be put on the unresolved normative and empirical issues related to formal equality and opportunity cost. (shrink)

It has become somewhat a commonplace in recent political philosophy to remark that all plausible political theories must share at least one fundamental premise, ‘that all humans are one another's equals’. One single concept of ‘basic equality’, therefore, is cast as the common touchstone of all contemporary political thought. This paper argues that this claim is false. Virtually all do indeed say that all humans are ‘equals’ in some basic sense. However, this is not the same sense. There are not (...) one but two concepts of basic equality, and they reflect not a grand unity within political philosophy but a deep and striking division. I call these concepts ‘Equal Worth’ and ‘Equal Authority’. The former means that each individual’s good is of equal moral worth. The latter means that no individual is under the natural authority of anyone else. Whilst these two predicates are not in themselves logically inconsistent, I demonstrate that they are inconsistent foundation stones for political theory. A theory that starts from Equal Worth will find it near impossible to justify Equal Authority. And a theory that starts from Equal Authority will find any fact about the true worth of things, including ourselves, irrelevant to justifying legitimate action. This helps us identify the origin of many of our deepest and seemingly intractable disagreements within political philosophy, and directs our attention to the need for a clear debate about the truth and/or relationship between the two concepts. In short, my call to arms can be summed up in the demand that political philosophers never again be allowed to claim ‘that all human beings are equals’ full stop. They must be clear in what dimension they claim that we are equals—Worth or Authority. (shrink)

In this article, we argue that apart from evaluating the causes and the social determinants of health inequalities, an evaluation of the effects of health inequalities is due. For this, we propose the ideal of relational equality as an evaluative framework, and test to what extent health inequalities threaten this ideal of a society of equals. We identify three ways in which they do and argue that these risks are especially great for those lower down the socio-economic strata. We thus (...) conclude that equality in health is instrumental to social justice, and that socio-economic inequalities in health are not only unjust due to their causes but also due to their consequences. We continue to argue that our instrumental approach opens a perspective to mitigate the identified injustices by changing society, rather than reducing inequalities in health, and argue that this is an advantage in the light of the realistic assumption that of the socio-economic health inequalities will persist. The article thus offers a complementary approach to both the evaluation and the mitigation of the injustice of socio-economic inequalities in health. (shrink)

One of the societal problems in a new influenza pandemic will be how to use the scarce medical resources that are available for prevention and treatment, and what medical, epidemiological and ethical justifications can be given for the choices that have to be made. Many things may become scarce: personal protective equipment, antiviral drugs, hospital beds, mechanical ventilation, vaccination, etc. In this paper I discuss two general ethical principles for priority setting (utility and equity) and explain how these principles will (...) often point in diverging directions. Moreover, each of these principles can be understood in different, again often competing, ways. Notwithstanding these controversies and conflicts, in the context of pandemic response there are at least some points of convergence: several policies can be justified by appeal to different ethical principles and theories. Convergence may be found with respect to a focus on saving the most lives (instead of other aggregative accounts); giving priority antiviral prophylaxis and therapy for life-saving pandemic responders; and, partly depending on epidemiology of the pandemic, to prioritise vaccination of children. Although decision-making about access to intensive care will involve choices with immediate tragic implications, the ethical complexity of these choices is relatively modest (although decisions will not be easy): there are persuasive moral reasons for giving priority to patients who are expected to benefit most within the shortest time. Finally, in the last section I tentatively argue that constraints on people’s freedom, as necessary for an effective public health approach, may support giving somewhat more weight to saving the most lives, than to concerns of equity. The development of the science of poverty has largely been driven by the need to define more precisely what poverty is, as well as to provide theoretical and empirical criteria for identifying those who suffer from it. This thesis focuses on a notable response to these and related questions: the conception and measure of poverty by the British sociologist Peter Townsend. Townsend defines poverty as relative deprivation caused by lack of resources. This conception, along with his corresponding cut-off measure, constitutes (...) some of the key components of his theory of poverty. The theory discusses what poverty is, its causes, and how it can be eradicated, and is detailed in Poverty in the United Kingdom: A Survey of Household Resources and Standards of Living (1979), his magnum opus. The primary aim of this thesis is to interpret the theory from Townsend’s adherence to the value-free ideal. He pursued this ideal in response to what he perceived as the pervasive and deleterious influence of moral and political values on measures, theories, and policies on poverty throughout its scientific and political history. I argue that to be free from such influence, Townsend aimed to be as guided by epistemic values as possible, which resulted in a systematic theory of poverty. -/- The thesis is structured as follows: In Chapter 1, I situate Townsend’s conception and measurement of poverty within the context of both the recent history of scientific poverty lines and the most important approaches to measuring the phenomenon. Chapter 2 discusses the systematic nature of the theory, including its role as a middle-range theory that bridges broad-range theories with empirical data. This connection is achieved through several elements: a conception of poverty; hypotheses and anthropological observations related to the elements of the conception; measures to test these hypotheses; an explanation of poverty; and reports on how the research was conducted. Furthermore, Townsend’s theory aligns with Bradburn et al.’s (2017) measurement theory, which asserts that a good measure must include a conception of the relevant phenomenon, a representation, and procedures to gather data. Additionally, all three components must be supported by arguments showing that they fit together properly. -/- In the remaining chapters, I present and discuss the main elements of the theory: his conception of poverty as relative deprivation caused by lack of resources, along with the related hypotheses and observations (Chapter 3); the representations of this conception and the procedures for data collection, processing, as well as ensuring their reliability (Chapter 4); and the explanation of poverty (Chapter 5). I conclude by presenting what Townsend considered the “policy prescriptions” of his theory. Despite its potential shortcomings, I also argue that Townsend’s theory fulfills an important epistemic value: fruitfulness. (shrink)

Cluster randomized controlled trials (cluster RCTs) randomize whole clusters of individuals in testing two or more competing interventions. Here we will present the ethical problems raised by cluster RCTs concerning their effect on inequality. We argue that some inequalities generated by cluster RCTs are larger in scope than those generated from individual RCTs. We also argue that any cluster RCT-generated inequalities, which divide groups rather than individuals, are more problematic in type than the inequalities created in individual RCTs. These concerns (...) should be taken into consideration when designing research at the cluster level, and those conducting the research should consider modified research design strategies in cases where they believe the risk of generating inequalities is large. In its most part, this article is a critique of three of the most common ways of defining egalitarianism: 1) egalitarianism is a trend of thought in political philosophy to which belong (all) philosophers who support a form of equality, whatever it may be, between all members of a community; 2) egalitarianism is a trend of thought in political philosophy which has as a ultimate or foundational value equality in the abstract sense of treating all people as equals; and 3) (...) egalitarianism is a trend of thought in political philosophy that defends equality in the distribution of certain goods or resources. In the last part of the article I defend the idea that egalitarianism is much better described as a trend of thought in political philosophy that defends a substantial equality between all members of a community as a ultimate principle of social justice. In this article, I firstly discuss why a prioritarian clause can rescue the utilitarian doctrine from the risk of exacerbating inequality in the distribution of resources in those cases in which utility of income does not decline at the margin. Nonetheless, when in the presence of adaptive preferences, classic prioritarianism is more likely than utilitarianism to increase the inequality of resources under all circumstances, independently of the diminishing trend of utility. Hence, I propose to shift the informational focus of prioritarianism (...) from welfare to either social income or capabilities in order to safeguard those who are worse off. Following this, I argue that we may have reasons to limit the aggregative logic of priority-amended utilitarianism through one or more sufficiency thresholds, and that we can partially defuse the negative-thesis objection that is usually levelled against sufficientarianism, provided we interpret the threshold(s) as valid only as long as everyone is led above it. We defend a scalar theory of the relationship between material scarcity and justice. As scarcity increases beyond a specified threshold, we argue that deontological egalitarian constraints should be gradually relaxed and consequentialist considerations should increasingly determine distributions. We construct this theory by taking a bottom-up approach that is guided by principles of medical triage. Armed with this theory, we consider the range of conditions under which justice applies. We argue that there are compelling reasons for thinking that justice applies under (...) a far broader range of conditions than is standardly supposed, including those that could sensibly be labelled as conditions of extreme rather than moderate scarcity. In his article, “Equality as a Moral Ideal”, Harry Frankfurt argues against economic egalitarianism and presents what he calls the “doctrine of sufficiency.” According to the doctrine of sufficiency, what is morally important is not relative economic equality, but rather, whether somebody has enough, where “having enough” is a non-comparative standard of reasonable contentment that may differ from person to person given his/her aims and circumstances. The purpose of this paper is to show that Frankfurt’s original arguments in support for (...) his doctrine of sufficiency have critical problems that Frankfurt himself does not properly recognize. In the end, I will argue that in order to solve these problems the doctrine of sufficiency cannot help but to incorporate certain prioritarian commitments – commitments which many would view as implying economic egalitarianism. This is embarrassing for a doctrine whose raison d’être was mainly to defeat economic egalitarianism. (shrink)

This paper takes issue with the widespread claim that positional competitions are zero-sum games. It shows how the notions of ‘positional good’ and ‘positional competition’ have changed in meaning and how this has resulted in conceptual confusion in discussions amongst economists and philosophers. I argue that the Zero-Sum Claim is hardly ever true when it comes to the novel understanding of positionality that currently dominates the philosophical literature. I propose dropping the Zero-Sum Claim and construing positional competitions as win-lose. While there need be no conflict in theory between addressing global inequality (inequalities between people worldwide) and addressing domestic inequality (inequalities between people within a political community), there may be instances in which the feasible mechanism for reducing global inequality risks aggravating domestic inequality. The burgeoning literature on global justice has tended to overlook this type of scenario, and theorists espousing global egalitarianism have consequently not engaged with cases that are important for evaluating and clarifying the content of their theories. (...) This chapter explores potential tensions between promoting global and domestic inequality. We introduce a class of second-best scenarios that global justice theorists have neglected to demonstrate the importance of such scenarios as an aid to constructing and evaluating ideals of global justice. Much discussion of the ethics of participation focuses on electoral participation and whether citizens are obligated or can be coerced to vote. Yet these debates have ignored that citizens must first pay attention to politics and make up their minds about where they stand before they can engage in any form of participation. This article considers the importance for liberal democracy of citizens paying attention to politics, or attentive citizenship. It argues that the democratic state has an obligation to cultivate (...) interest in politics and that this obligation authorizes means up to and including some forms of coercion. The argument is that when citizens are inattentive to politics, it undermines political equality and social justice because it undermines what John Rawls called the fair value of the political liberties. The importance of these ends for liberal democratic states requires them to take steps to promote attentive citizenship. (shrink)

Imagine that only the state can meet the need for housing but decides not to do so. Unsurprisingly, participants in a vignette experiment deem this scenario unjust. Hence, justice ratings increase when the living situation improves. To a lesser extent, this also holds beyond the need threshold, understood as the minimum amount necessary for a decent life. Surprisingly, however, the justice evaluation function is highly convex below this point. The resulting S-shaped curve is akin to the value function in prospect (...) theory, with the need threshold providing the point of reference and inflection. A control treatment without needs-information supports this interpretation. Needs-information furthermore compresses the perceived injustice of arbitrary inequality. As in prospect theory, such reference dependency suggests biases in judgment and decision making. A consequence may be that the lot of the poorest in society does not receive the attention it would otherwise get. (shrink)

The Axiological Problem (AP): What entities have moral value and deserve moral consideration? 5. Methodological Problem (MP): How do we go about arbitrating between moral claims when they conflict? The belief that all human beings are ‘moral equals’ is widespread within the canon of Western liberal philosophy. However, it is unclear precisely what ‘moral equality’ or its associate terms mean, what grounds our ‘moral equality’ and what the implications of being ‘moral equals’ are. In this paper, I distinguish between three ways of understanding ‘moral equality’: the ‘buck-passing’, ‘explanatory’ and ‘reverse-explanatory’ accounts. The buck-passing account of moral equality is in parallel with Scanlon’s buck-passing account of value. It holds that (...) ‘moral equality’ is not a metaphysically fundamental concept and simply amounts to having other properties shared equally by all human beings that constitute the reasons for why we ought to treat all human beings equally in certain respects. The explanatory account understands the concept of ‘moral equality’ as metaphysically fundamental and explanatory of why human beings who are the same in certain respects have the same entitlement to x. The reverse-explanatory account also sees ‘moral equality’ as metaphysically fundamental but holds that the explanatory relationship goes the other way round: moral equality is explained by how we ought to act. I argue that the buck-passing account is a more accurate way of understanding moral equality. (shrink)

Departing from theories of distributive justice and their relation with the distribution of health care within society, especially egalitarianism and libertarianism, this paper aims at demonstrating that the approach taken by the European Court of Justice regarding the application of the Internal Market principles (or the market freedoms) to the field of health care services has introduced new values which are more concerned with a libertarian view of health care. Moreover, the paper also addresses the question of how these new (...) values introduced by the Court may affect common principles of European health systems, such as equity and accessibility. Vertreter non-egalitaristischer Konzeptionen der Bildungsgerechtigkeit ersetzen das klassische egalitaristische Votum für Gleichheit als intrinsischen Wert durch die Begründung von Schwellenkonzeptionen, die über Adäquatheits- und Suffizienzbedingungen angeben sollen, was als Kriterium für die Identifikation illegitimer Bildungsungleichheiten zu gelten hat und was nicht. Alle Ungleichheiten oberhalb einer fixierten Schwelle sind aus non-egalitaristischer Sicht normativ nicht von Belang. Dieser Fokus auf Mindestbedingungen, die gegeben sein müssen, damit Akteure in liberal-demokratischen Gesellschaften politisch partizipieren und ein gedeihliches Leben führen können, steht nicht nur in einem (...) gewissen Passungsverhältnis zu aktuellen bildungspolitischen Entwicklungen, sondern scheint auch einige der Probleme angemessener lösen zu können, mit denen egalitaristische Konzeptionen der Bildungsgerechtigkeit üblicherweise konfrontiert werden. Die gerechtigkeitstheoretische Begründung von Schwellenkonzeptionen wird häufig durch demokratietheoretische Argumentationen flankiert, die davon ausgehen, dass die propagierten Mindeststandards zugleich die intergenerationale Tradierung der normativen Grundlagen liberaler Demokratien sicherstellen und die Voraussetzungen demokratischer Legitimität konstituieren, indem sie allgemeine Fähigkeiten und Tugenden fördern, auf die eine Zustimmung zu konsensfähigen Prinzipien der Gerechtigkeit und der fairen Kooperation angewiesen ist. In dem Beitrag werden zunächst die wichtigsten non-egalitaristischen Kritiken an egalitaristischen Konzeptionen der Bildungsgerechtigkeit vorgestellt. Daran anschließend werden einige der Schwachstellen und Fallstricke diskutiert, die mit suffizienzorientierten Verständnissen der Bildungsgerechtigkeit und ihren demokratietheoretischen Begründungen verbunden sind. Ziel des Beitrags ist es nicht eine ausformulierte egalitaristische Alternative zu non-egalitaristischen Konzeptionen der Bildungsgerechtigkeit vorzustellen, sondern nachzuweisen, dass Doktrinen der Suffizienz noch keine ausreichenden Kriterien liefern, um mit verbleibenden Bildungsungleichheiten angemessen umzugehen. Resumen: En este ensayo desarrollo una crítica al modelo de justicia multicultural de Will Kymlicka, con el propósito de establecer las bases para el desarrollo de un multiculturalismo crítico. El argumento se ordena de la siguiente forma. En la primera sección analizo la teoría de los derechos especiales de Kymlicka e identifico el valor liberal central al que estos responden, la autonomía individual. En la segunda sección examino el fundamento igualitarista de la suerte de su teoría de los derechos especiales. (...) En la tercera sección elaboro una crítica general a la justicia multicultural liberal desarrollando un argumento para politizar los reclamos de los pueblos indígenas para el acceso a su cultura. Argumento que el trato justo de las minorías indígenas requiere reconocer su autodeterminación política.: In this essay I develop a critique of Will Kymlicka’s model of multicultural justice, with the purpose of laying down the foundations for a critical multiculturalism. The argument is ordered in the following way. In the first section I analyse Kymlicka’s theory of special rights and identify the central liberal value to which they respond: individual autonomy. In the second section I examine the luck egalitarian foundations of Kymlicka’s theory of special rights. In the third section, I elaborate a general critique to liberal multicultural justice, developing an argument to politicize the claims of indigenous peoples to access to their culture. Basically I argue that the just treatment of indigenous minorities requires recognizing their political self-determination. (shrink)

I develop the recent claim that prioritarianism, and not only its egalitarian competitors, must be committed to an impersonal outcome value (i. e. a value that makes a distribution better even if this does not affect anyone’s welfare). This value, that I label telic priority and that consists in the goodness of benefits going to the worst off recipients, implies implausible judgments that more than compete with ‘pure’ (Parfit) egalitarianism’s applause in leveling down scenarios. ‘Pure prioritarianism’, an axiological theory that (...) would consist in an unqualified commitment to telic priority only, must therefore be developed into a pluralist version of the priority view. Contra Parfit, prioritarianism and egalitarianism are on a par concerning the relationship between their pure (and implausible) formulations and their pluralist (and plausible) versions. The final section explains why telic priority always assigns preference to the worst-off (and not merely to the worse-off). (shrink)

In this thesis I argue that Adam Smith is committed to moral egalitarianism, which extends to his theory of political economy. While Smith’s work is often used to justify economic inequality in society, I show that his political theory is best understood as a kind of relational egalitarianism. Using Elizabeth Anderson’s Democratic Equality as a model, I examine Smith’s commitment to equality in the space of social relationships. In particular, I argue that Smith’s focus on eliminating inequalities that cause oppression (...) in society in conjunction with his efforts to design a political and economic system that will yield social conditions of freedom for individuals make him a relational egalitarian. Despite being increasingly available to us all, retirement pensions remain unequally distributed: between rich and poor, young and old, men and women, and possibly different generations. As this topic receives little attention in moral and political philosophy, the articles in this thesis aim to deliver an original account of justice in retirement pensions along liberal egalitarian lines. The first part defends retirement pensions as a distribution of free time. It shows that including free time in the list of goods that (...) liberal egalitarians prioritise is plausible and avoids problems that would otherwise arise with other candidates, most notably leisure. Retirement as free time is an essential feature of liberal egalitarian societies by (re)distributing the means to pursue any life project, and especially valuable for the poor who work and contribute the longest. The second part makes a case for 'libertirement', a proposal to increase the freedom to enjoy free time across life, as a matter of justice between those who live long and those who die early. Specifically, I propose adding reverse pensions and sabbaticals on top of old-age retirement. Besides showing the importance of longevity for age-group justice, I also draw implications for distributing unconditional basic income and income taxes across life, which I suggest may offer alternative paths to libertirement. Finally, the third part discusses the cases of pension inequality between genders and generations, pushing us to refine our account further. I conclude that there is often a mismatch between liberal egalitarian justice and the design of retirement schemes. The solution is often but not always to reform these systems. Sometimes, we have reasons to revise our very own principles of justice. (shrink)

Nu cu foarte mult timp în urmă, grupul de teorie socială şi politică din cadrul proiectului POSDRU 89/1.5/S/56815 „Societatea bazată pe cunoaştere-cercetări, dezbateri, perspective”, a publicat, tot la editura Institutul European, lucrarea Concepte şi teorii social-politice. Volumul de faţă reprezintă un nou pas al grupului nostru de lucru în realizarea proiectului inaugurat prin publicarea acelei lucrări. Este vorba, reamintesc, despre proiectul elaborării unor volume care să-i ajute pe cei interesaţi în iniţierea (lor sau a altora) în teoria (şi în special (...) filosofia) politică, mai ales în dezvoltările sale conceptuale, argumentative şi problematologice recente. Desigur, nu am intenţionat în mod expres ca aceste volume să fie utile doar în această direcţie. Speranţa noastră a fost, dimpotrivă, ca ele să fie interesante şi pentru cercetătorii cu experienţă în investigarea şi dezbaterea temelor abordate în cadrul lor, mai ales pentru că unele capitole prezintă idei, argumente sau perspective originale, care, credem noi, merită atenţia critică a comunităţii cercetătorilor români. Menirea lor fundamentală rămâne totuşi, în intenţia noastră, cea introductivă. Aşa cum recunoşteam în cuvântul său înainte, Concepte şi teorii socialpolitice nu este deloc un volum exhaustiv. Teorii şi ideologii politice reprezintă, în bună măsură, şi o încercare de a compensa cumva acest „defect” al volumului în cauză. Desigur, nici publicarea lui nu ne permite să susţinem că am atins obiectivul oferirii unei introduceri cât mai complete în teoria/filosofia politică actuală. Deşi Teorii şi ideologii politice prezintă câteva dintre cele mai importante teorii sau ideologii politice contemporane, există multe altele care nu sunt prezentate (sau cel puţin nu sunt prezentate atât de detaliat pe cât ar fi meritat) între paginile sale. Mă refer aici, spre exemplu, la libertarianism, comunitarianism, cosmopolitism sau capabilism (ca teorie a dezvoltării umane). Ne consolăm însă în baza a trei argumente. Unul este acela că, aşa cum se poate observa cu uşurinţă din cuprinsul său, cartea de faţă prezintă totuşi un număr important dintre principalele teorii şi ideologii politice recente (unele dintre ele pentru prima dată în literatura românească de specialitate). Al doilea este acela că unele dintre teoriile sau ideologiile politice care nu sunt abordate aici au beneficiat deja de prezentări competente şi atente la noi (unele dintre ele chiar în Concepte şi teorii social-politice). În sfârşit, al treilea argument este acela că sperăm cu toţii că prezentul volum nu reprezintă ultimul nostru pas în realizarea obiectivului menţionat în debutul acestei intervenţii. Sperăm, altfel spus, să putem prezenta acele teorii sau ideologii politice care nu şi-au găsit locul între paginile lui sau ale celui precedent cu o altă ocazie. Ţin să precizez însă că volumul pe care îl introduc prin această intervenţie nu este întrutotul o continuare a celui precedent, deşi între ele există, desigur, destule afinităţi, relaţii şi continuităţi tematice. Mai exact, el nu ar putea fi descris totalmente neproblematic ca reprezentând „al doilea tom” al volumului Concepte şi teorii social-politice. Titlul său este menit să indice acest lucru. Dacă lucrarea anterioară era centrată pe prezentarea unora dintre principalele concepte ale teoriei/filosofiei social-politice contemporane, cartea de faţă prezintă câteva dintre principalele teorii sau ideologii dezvoltate şi apărate de politologii, filosofii, economiştii sau „ideologii” politici contemporani. Nici de această dată nu voi încerca să rezum principalele idei expuse sau metodologii utilizate de către autori în prezentarea teoriilor sau ideologiilor politice care se regăsesc între paginile ce urmează. Temeiul meu este acelaşi: acolo unde au considerat că este cazul, autorii capitolelor şi-au rezumat ei înşişi ideile prezentate sau/şi metodologiile utilizate. În plus, cititorul interesat să-şi facă o idee prealabilă despre conţinutul ideatic şi problematologic al cărţii dispune de un rezumat al ei (în limbile engleză şi franceză) în finalul său. În consecinţă, mă voi mulţumi să închei doar prin a exprima încă o dată speranţa noastră că această carte se va dovedi utilă celor cărora li se adresează cu preponderenţă. Sperăm, în alte cuvinte, ca ea să le fie de ajutor în înţelegerea şi evaluarea adecvată a teoriilor şi ideologiilor pe care le prezintă. Şi mai important, sperăm că ea îi va stimula să caute să aprofundeze cercetarea acestor teorii şi ideologii şi – mai ales – să iniţieze propriile investigaţii sistematice şi riguroase în această privinţă. Dezvoltarea politologiei şi a filosofiei politice în spaţiul românesc, ca să nu mai vorbim despre clarificarea şi fundamentarea cât mai completă şi adecvată a opţiunilor ideologice ale partidelor politice din România, au nevoie de acest lucru. During the past few decades, the global food system has confronted new sustainability challenges related not only to public health and the environment but also to ethical concerns over the treatment of farmed animals. However, the traditional threedimensional framework of sustainable development is ill equipped to take ethical concerns related to non-human animals into account. For instance, the interests of farmed animals are often overridden by objectives associated with social, economic or environmental sustainability, despite their vast numbers and influence on (...) contemporary societies. Moreover, sustainability policies necessarily involve an element of ethical evaluation; yet this element is not explicitly incorporated in prevailing frameworks of sustainable development. Our purpose in this article is to address these shortcomings by developing a Sustainability Matrix that recognizes the need to consider food system sustainability from the perspective of all interest groups affected by the issue under consideration, from a plurality of ethical standpoints. Combing sustainability principles with the basic idea of an ethical evaluation tool, the proposed Sustainability Matrix evaluates the sustainability of food-related systems, decisions and policies from the perspectives of three major strands of ethical theory and from the perspectives of human beings, farmed animals and wildlife. In terms of policy implications, the Sustainability Matrix can be applied in deciding on the specific targets of food system sustainability that can then be utilized as a basis for designing policies and measures towards the achievement of these goals. Western, secularized capitalism appraises the “worth” of a worker through a wage, a numerical value assumed to reflect the value of one’s time (in the case of hourly jobs) or contribution (in the case of salary or commision-based work). Computers and AI models are capable of matching and even exceeding human performance on a variety of tasks such as mathematical computation, handwritten digit recognition, and even complex tasks such as playing the game Go. Furthermore, they can work around the clock (...) with no need for sleep, healthcare, or even a salary. As a result, computers are more “valuable” than humans under capitalism because they are more productive (in terms of quantity and, in many cases, quality of work). Combined with an erosion of the religious idea of explicit human worth or dignity, other humans are seen as mere means to the ends of those powerful enough to exploit them. Any hope of reducing inequality or promoting justice must come from an explicit belief in the “value” of human life independent of his or her ability to produce. (shrink)

While it was written with an undergraduate academic audience in mind, it should also be suitable for self-guided readers interested in philosophy. It covers ‘western' philosophy from the Presocratics of Ancient Greece through to the present day (and including the Islamic world). It also contains additional chapters on philosophy in India, China, Mesoamerica, and Africa. (...) Moral error theorists argue that moral thought and discourse are systematically in error, and that nothing is, or can ever be, morally permissible, required or forbidden. I begin by discussing how error theorists arrive at this conclusion. I then argue that if we accept a moral error theory, we cannot escape a pressing problem – what should we do next, metaethically speaking? I call this problem the ‘what now?’ problem, or WNP for short. I discuss the attempts others have made (...) to respond to the WNP, and in each case I show that the responses fail to be satisfying. I then propose a new response to the WNP, which I call revolutionary relativism. I define revolutionary relativism, explain why it is preferable to the existing responses to the WNP, and defend it against the most problematic objections I anticipate that opponents might raise. I conclude that revolutionary relativism succeeds where previous WNP responses fail, and that if we accept a moral error theory, we should become revolutionary relativists. (shrink)

The nature of human reason is one of the thorniest of mysteries in philosophy. The reason appears in many specific forms within general areas such as cognition, thinking, experiencing beauty, and moral judgment. These forms are “perfectly” known in philosophy, yet an unknown pattern has been noticed which shows us that they are all a variation of the same theme: truth is an identity relation between the “thought” and “reality”; justice is an identity relation between the given and the deserved; (...) beauty is an identity relation as rhyme is an identity relation between the final sounds of words; rhythm is an identity relation between time intervals; symmetry is an identity relation between two halves; proportion is an identity relation between two ratios; anaphora is an identity relation between the initial words. Particular things are identities in themselves and universals are identities between particulars. One idea associates another idea identical to it; an analogy is an identity between relations; induction is an identification between the known and unknown instances; and all the logic rests on the law of identity. What is common for all of them is the nature of reason itself. (shrink)
