The social categories to which we belong—Latino, disabled, American, woman— causally influence our lives in deep and unavoidable ways. One might be pulled over by police because one is Latino, or one might receive a COVID vaccine sooner because one is American. Membership in these social categories most often falls outside of our control. This paper argues that membership in social categories constitutes a restriction on human agency, creating a situation of non-ideal agency for many human individuals. -/- However, there (...) are ways to resist the causal influence of social categories, and certain socially marginalized groups can be understood as attempting to do just this. I discuss two instances of social category resistance: gender pronouns and the rights of trans individuals. I suggest that the intentional declaration of gender pronouns (“she/her” or “they/them”) can be understood as an attempt to resist the causal powers of nonconsensual social categorization. Similarly, one among many reasons to support the rights of trans individuals is that their self-declarations of gender identity can be viewed as a reclamation of agency in the face of causal constraints imposed by socially defined and imposed gender categories. This lesson can be generalized to people belonging to a broad range of marginalized groups. (shrink)

In this essay, I propose a functionalist theory of grounding (functionalist-grounding). Specifically, I argue that grounding is a second-order phenomenon that is realized by relations that play the noncausal explanatoriness role. I also show that functionalist-grounding can deal with a powerful challenge. Appeals to explanatory unificationism have been made to argue that the success of noncausal explanations does not depend on the existence of grounding relations. Against this, I argue that a systematization involving functionalist-grounding is superior to its anti-relational counterpart.

According to Sider, a question is metaphysically substantive just in case it has a single most natural answer. Recently, Barnes and Mikkola have argued that, given this notion of substantivity, many of the central questions in the metaphysics of gender are nonsubstantive. Specifically, it is plausible that gender pluralism—the view that there are multiple, equally natural gender kinds—is true, but this view seems incompatible with the substantivity of gender. The goal of this paper is to argue that the notion of (...) substantivity can be understood in a way that accommodates gender pluralism. First, I claim that gender terms (at least as used in the ontology room) are referentially indeterminate, where referential indeterminacy holds in virtue of the way the world is. Second, I propose a degree-theoretic (or scalar) account of metaphysical substantivity; genders are substantial to the degree that they are determinate. I conclude that gender is relatively, although not absolutely, substantial. (shrink)

In this essay I identify a type of linguistic phenomenon new to feminist philosophy of language: biased evaluative descriptions. Biased evaluative descriptions are descriptions whose well-intended positive surface meanings are inflected with implicitly biased content. Biased evaluative descriptions are characterized by three main features: (1) they have roots in implicit bias or benevolent sexism, (2) their application is counterfactually unstable across dominant and subordinate social groups, and (3) they encode stereotypes. After giving several different kinds of examples of biased evaluative (...) descriptions, I distinguish them from similar linguistic concepts, including backhanded compliments, slurs, insults, epithets, pejoratives, and dog whistles. I suggest that the traditional framework of Gricean implicature cannot account for biased evaluative descriptions. I discuss some challenges to the distinctiveness and evaluability of biased evaluative descriptions, including intersectional social identities. I conclude by discussing their social significance and moral status. Identifying biased evaluative descriptions is important for a variety of social contexts, from the very general and broad (political speeches) to the very particular and small (bias in academic hiring). In this article, we apply the literature on the ethics of choice-architecture (nudges) to the realm of virtual reality (VR) to point out ethical problems with using VR for empathy-based nudging. Specifically, we argue that VR simulations aiming to enhance empathic understanding of others via perspective-taking will almost always be unethical to develop or deploy. We argue that VR-based empathy enhancement not only faces traditional ethical concerns about nudge (autonomy, welfare, transparency), but also a variant of the semantic variance problem (...) that arises for intersectional perspective-taking. VR empathy simulations deceive and manipulate their users about their experiences. Despite their often laudable goals, such simulations confront significant ethical challenges. In light of these goals and challenges, we conclude by proposing that VR designers shift from designing simulations aimed at producing empathic perspective-taking to designing simulations aimed at generating sympathy. These simulations, we claim, can avoid the most serious ethical issues associated with VR nudges, semantic variance, and intersectionality. (shrink)

A prominent way of explaining how race is socially constructed appeals to social positions and social structures. On this view, the construction of a person’s race is understood in terms of the person occupying a certain social position in a social structure. The aim of this paper is to give a metaphysically perspicuous account of this form of race construction. Analogous to functionalism about mental states, I develop an account of a ‘race structure’ in which various races (Black, White, Asian, (...) etc.) are functionally defined social positions. Individual persons occupy these social positions by ‘playing the role’ characteristic of those positions. The properties by which a person plays a race role, are the realizers for one’s race. I characterize the social construction of a person’s race in terms of a realization relation that satisfies a ‘subset’ condition on the social powers of raced persons. Races, on this view, are functionally defined, multiply realizable social kinds. The final section of the paper outlines some explanatory benefits of the account. (shrink)

When one takes an intersectional perspective on patterns of oppression and domination, it becomes clear that familiar forms of systemic injustice, such as misogyny and anti-Black racism, are inseparable. Some feminist theorists conclude, from this, that the systems behind these injustices cannot be individuated—for example, that there isn’t patriarchy and white supremacy, but instead only white supremacist patriarchy. This chapter offers a different perspective. Philosophers have long observed that a statue and a lump of clay can be individuated although inseparable, (...) and that statues and lumps of clay do different explanatory and predictive work for the same causal outcomes. This chapter suggests that the same is true of systems such as patriarchy and white supremacy. These systems, like the injustices they produce, are inseparable. But they can be individuated, and when they are individuated, they do different explanatory and predictive work. (shrink)

The inclusion problem for theories of gender arises when those theories inappropriately fail to include certain individuals in the gender categories to which they ought to belong. The inclusion problem affects both of the most influential traditions in feminist theorizing about gender: social-position accounts and identity accounts. I argue that the inclusion problem can be solved by adopting a structured theory of gender, which incorporates aspects of both social-position accounts and identity accounts. According to the theory I favor, an individual’s (...) gender is determined by their gender identity if they have one; otherwise, it is determined by their social position. My structured approach to gender offers a more direct solution to the gender inclusion problem than alternatives recently advocated by Barnes (2020), Jenkins (2023), and others. It also points the way to a simple solution to inclusion problems that arise at the level of gendered language. (shrink)

‘Intersectionality’ is one of the rare pieces of academic jargon to make it out of the university and into the mainstream. The message is clear and well-known: your feminism had better be intersectional. But what exactly does this mean? This paper is partly an exercise in conceptual clarification, distinguishing at least six distinct types of claim found across the literature on intersectionality, and digging further into the most philosophically complex of these claims—namely the metaphysical and explanatory. It’s also partly a (...) reply to Sara Bernstein, who argued recently that the best interpretation of the metaphysical claim is explanatory priority. We’ll argue that duly clarified, it’s far from obvious that feminism had better be intersectional. At the very least, it had better not be only intersectional. (shrink)

The conferralist account of social properties that Ásta develops and defends in Categories We Live By is persuasive in many ways. Conferralism could however do better, by its own lights, at handling the phenomenon of intersectionality. This paper first suggests a friendly amendment to the schema for conferrals that Asta offers. This helps to explain the difficulty concerning intersectionality. Finally, the paper suggests a way of developing the conferralist account that would resolve this difficulty.

How ought we socially to categorize individuals with respect to sexual orientation? In this paper, I engage with philosophical work on the foundations of political solidarity as well as public health research on the treatment and prevention of HIV/AIDS in order to develop a categorization scheme conducive to the normatively important aims of LGBTQIA+ social movements.

Feminist philosophers have long worried that intersectionality undermines the viability of the concept and category of woman, thereby undermining feminist theory and politics. Some have responded to this problem by abandoning intersectionality; others have attempted to find some suitably inclusive way of reconceptualizing woman. I provide a novel solution that focuses on conceptualizing oppression in light of intersectionality, rather than trying to provide an account of what it is to be a woman. By enabling us to understand feminism as responding (...) to gender oppression, this account shows that intersectionality does not conceptually undermine and fragment feminism. Hun tilkjennegir et like stort engasjement mot den urett som eldre utsettes for som hun gjør i Det annet kjønn (1949) når det gjelder undertrykkelsen av kvinner. Likevel påstår Beauvoir at alderdommen først og fremst er et problem for mannen, og det har blitt (...) hevdet at Alderdommen er et verk om aldersdiskriminering hvor mannens aldringsprosess gjøres til norm – ikke et feministisk verk på linje med Det annet kjønn. I denne artikkelen argumen- terer Tove Pettersen for at det nettopp er den feministiske filosofien Beauvoir utvikler i Det annet kjønn som ligger til grunn for hennes undersøkelser av undertrykkelse og diskriminering av eldre. Nevertheless, Beauvoir claims that old age first and foremost is a problem for men, and it has been argued that The Coming of Age is a work on age discrim- ination where the male aging process is made the norm – not a feminist work on par with The Second Sex. In thisarticle, Tove Pettersen argues that it is precisely the feminist philosophy that Beauvoir develops in The Second Sex that enables her to analyze the oppression and discrimination of the elderly. Additionally, Beauvoir's comprehensive analysis of old age demonstrates that neither age nor gender can be studied independently. Age and gender intersect, and must be be seen in light of the situation in which class is of great importance. Thus, The Coming of Age can be read as a work in which Beauvoir shows how different forms of oppression work together and contribute to the mar- ginalization and discrimination of the elderly. Most philosophical accounts of human rights accept that all persons have human rights. Typically, ‘personhood’ is understood as unitary and binary. It is unitary because there is generally supposed to be a single threshold property required for personhood. It is binary because it is all-or-nothing: you are either a person or you are not. A difficulty with binary views is that there will typically be subjects, like children and those with dementia, who do not meet the threshold, and so who (...) are not persons with human rights, on these accounts. It is consequently unclear how we ought to treat these subjects. This is the problem of marginal cases. I argue that we cannot resolve the problem of marginal cases if we accept a unitary, binary view of personhood. Instead, I develop a new non-binary personhood account of human rights, and defend two main claims. First, there are many, scalar properties, the having of which are conducive to personhood. Second, different subjects have different human rights depending on which of these properties they have, and what threats apply to them. On my view, and contra most existing accounts, most marginal cases have some degree of personhood and are entitled to some human rights. (shrink)

Intersectionality is the notion that concerns the complexity of the experiences of individuals in virtue of their belonging to multiple socially significant categories. One of its main insights is that the way society is structured around categories such as gender, race, sexuality, class, etc., produces distinctive and specific forms of discrimination and privilege for groups in the intersections. In this paper, we suggest conceiving intersectionality as a general metaphysical framework wherein specific claims to the effect that the experiences of discrimination (...) of Black women, among others, can be fruitfully formulated and examined. The main claim is that intersectional experiences emerge from the conjunction of social categories when social structures make them relevant vis-à-vis discrimination and privilege. We then argue that our view has three main virtues: metaphysical neutrality, explanatory flexibility and methodological openness. Explaining these virtues will allow us to contrast our proposal with alternatives from the recent literature. (shrink)

When people simultaneously occupy multiple social identities, ascriptions of disadvantage and advantage, as well as our reasoning with them, need to be handled with care. For instance, as various US-American courts have come to acknowledge, we cannot in general reason from the premise that someone has neither been discriminated against as a woman nor as a Black person to the conclusion that they have not been discriminated against as a Black woman. In this article, I show how, by systematising such (...) qualified ascriptions of disadvantage (and advantage), as well as the patterns of reasoning involving them, we can articulate and defend central theses of intersectionality theory in remarkably general terms, and without having to commit to a particular metaphysics of intersectional identity. The relation of social ethics to knowledge production is explored through a study about academic research enquiry on minoritised and racialised populations. Despite social change related to migration and ethnicity being a feature of contemporary Northern Ireland, local dynamics and actors seemed under-studied by its research-intensive ‘anchor universities’. To explore this, a critical discourse analysis of published research outputs (n = 200) and related authors’ narratives (n = 32) are interpreted within this paper through conceptualisations of consciousness. Insiders’ perspectives on (...) the influences and structures of the research journey demonstrate the ways in which research cultures (mis)shape the politics of representation, authorship and ethicality. Societal and political disregard for the new publics, reproduced within universities’ hidden curriculum, has been negotiated and to some extent resisted in the research practices of those marginalised (such as women academics), those entering the system (migrant academics), and those local-born whose referential frames were developed external to local universities. Of concern is that the few research enablers were characterised by techno-rationality and doublespeak, impoverishing the depth of theorisation, complexity and intellectual debate necessary for challenging the existing dysconscious racism and xenophobiaism of the social imaginary. This paper develops a philosophical account of environmental racism and explains why having such an account is worthwhile. After reviewing some data points and common uses of the term linking environmental racism to the distribution of environmental burdens by race, I argue that environmental racism should be understood as referring to an unequal distribution caused by a history of racism. Environmental racism is thus analyzed in terms of two conditions: first, that environmental burdens and benefits be distributed according to race, (...) and second, that this distribution be partly caused by a history of racism, where this causal claim is understood counterfactually. The account entails that environmental racism is a derivative form of racism – it depends on other kinds of racism to exist – while being compatible with a variety of views about the more basic forms of racism. Given the proposed framework, I consider the kind of evidence needed to establish whether a given case is one of environmental racism and make the case for environmental racism being a concept worth focusing on as it can highlight a type of injustice that may otherwise go unnoticed. Recent empirical work attempts to investigate how implicit biases target those facing intersectional oppression. This is welcome, since early work on implicit biases focused on single axes of discrimination, such as race, gender, or age. However, the success of such empirical work on how biases target those facing intersectional oppressions depends on adequate conceptualizations of intersectionality and empirical measures that are responsive to these conceptualizations. Surveying prominent recent empirical work, we identify failures in conceptualizations of intersectionality that inform the design (...) of empirical measures. These failures generate unsupported conclusions about the kinds of biases that those experiencing multiple oppressions face, and render proposed interventions to combat biases useless at best, harmful at worst. We also diagnose unwarranted assumptions about how stereotypes combine in complex concepts: first, that when “simple” social concepts combine the complex concepts inherit the associated stereotypes of their simpler constituent concepts; second that studies which focus on cognition about single social categories are investigating “simple” social concepts (cf. Goff and Khan 2013). We tease out recommendations to guide future investigations into biases that target those who experience multiple oppressions. (shrink)

Individuals have different experiences of work when they are self-employed, when they perform tasks in the gig economy, and when they follow directives from managers. But such differences are not represented in some of the most prominent non-ideal theories of work. These describe workers as a coherent group, with a position in the structure of the liberal capitalist economy. I present an alternative that does better at acknowledging difference, through a description of work and workers that has greater ‘pluralism’ and (...) less ‘unifying coherence’. Some might insist that their ‘unifying’ description has superior empirical plausibility. But if ‘pluralistic’ descriptions are valid rivals to provide an accurate characterization of our current condition, then we should consider whether their use in theory can serve valuable aims. I identify the distinctive and valuable non-ideal aims – epistemic, evaluative, and normative – that can be pursued with ‘pluralistic’ descriptions of work and workers. (shrink)

How should we make sense of pregnancy discrimination as an issue of gender equality? In a striking 1974 decision, Geduldig v. Aiello, the U.S. Supreme Court has answered that we simply cannot. Pregnancy discrimination does not constitute a form of sex discrimination prohibited by law, the 6–3 decision claims, because differential treatment based on pregnancy draws only a gender-neutral line between “pregnant women” and “nonpregnant persons,” not the gender line between women and men. While courts have since invoked Geduldig to (...) curtail both reproductive and transgender rights, the prevailing feminist response to this line of cases is still to double down on an awkwardly cissexist conception of gender, finding the sex discrimination in the “direct” way that pregnancy is thought to connect to womanhood. The failure of that prevailing feminist response, legitimizing rather than challenging biological essentialism in legal analysis and public discourse, epitomizes a broader failure of feminist analysis and intersectional solidarity: it fails to confront the political and social problem that is pregnancy discrimination for either cis or trans people. This essay offers a trans feminist alternative. I argue that pregnancy discrimination is discrimination on the basis of sex, within the legally relevant meaning of that phrase, not because pregnancy is in one way or another distinctive to women as a gender category but because pregnant persons make up a gender category of their own. On my analysis, pregnancy discrimination comes out as a form of sex discrimination directly and immediately, not by way of womanhood. (shrink)
