Principles of justice, David Estlund argues, cannot be falsified by people’s unwillingness to satisfy them. In his Utopophobia, Estlund rejects the view that justice must bend to human motivation to deliver practical implications for how institutions ought to function. In this paper, I argue that a substantive argument against such bending of justice principles must challenge the reasons for making these principles sensitive to motivational limitations. Estlund, however, provides no such challenge. His dispute with benders of justice is therefore a (...) verbal one over the true meaning of justice, which need not worry those with the intuition that justice should perform a function that requires bending. By focusing on John Rawls’s reasons for bending his justice principles, I point towards a substantive critique of bent justice. (shrink)

It is tempting to think (1) that we may sometimes have hopelessly utopian duties and yet (2) that “ought” implies “can.” How might we square these apparently conflicting claims? A simple solution is to interpret hopelessly utopian duties as duties to "pursue" the achievement of manifestly unattainable outcomes (as opposed to duties to "achieve" the outcomes), thereby promising to vindicate the possibility of such duties in a way that is compatible with “ought” implies “can.” The main challenge for this simple (...) solution is to say what the relevant “duties to pursue” are supposed to involve. We survey several existing candidates (duties to try, duties to approximate, duties to do our part, and dynamic duties) and argue that none of them succeeds in delivering on the promise of the simple solution. We then propose a previously untheorized class of duties that we call "duties to devote ourselves" to achieving an outcome, and argue that such duties provide us with an interpretation of hopelessly utopian duties that is up to the task. This article has two main goals: to examine and classify the ways data can be used to advance normative theorizing in political theory, and to demonstrate such usages in the contested disciplinary field of religion–state relations and specifically regarding the hotly debated model of the separation of religion and state. Regarding the former, it is suggested here that the general observation that evaluation of political institutions must rely on proper understanding of such institutions and hence be data-sensitive, can be further (...) detailed or classified, via the following categories: conversion, institutional clarity, theoretical clarity and finally, theory improvement. With regard to the latter we examine how data regarding religion–state relations enables a better understanding (via the noted novel classifications or categories) of two important debates: ‘delineation’ (i.e. the argument that pure separation of religion and state does not exist) and ‘separation-establishment’ (i.e. arguing that models other than separation are permissible in religion–state relations). John Rawls thinks republicanism is compatible with his political liberalism. Philip Pettit insists that the two conflict in important ways. In this paper, I make sense of this dispute by employing David Chalmers’s method of elimination to reveal the meaning underlying key terms in Rawls’s political liberalism and Pettit’s republicanism. This procedure of disambiguating terms will show how the two theories defend the same institutional arrangement on the same grounds. The procedure thus vindicates Rawls’s view of the two theories being (...) compatible. The reason for this compatibility is that both theories are politicized—that is, they are constructed to attract the compliance of all reasonable members of a modern, pluralistic society. (shrink)

Apocalypse, it seems, is everywhere. Preachers with vast followings proclaim the world's end and apocalyptic fears grip even the non-religious amid climate change, pandemics, and threats of nuclear war. But as these ideas pervade popular discourse, grasping their logic remains elusive. Ben Jones argues that we can gain insight into apocalyptic thought through secular thinkers. He starts with a puzzle: Why would secular thinkers draw on Christian apocalyptic beliefs--often dismissed as bizarre--to interpret politics? The apocalyptic tradition proves appealing in part (...) because it theorizes a special relation between crisis and utopia. Apocalyptic thought points to crisis as the vehicle to bring the previously impossible within reach, thus offering apparent resources for navigating challenges in ideal theory, which tries to imagine the best and most just society. By examining apocalyptic thought's appeal and risks, this study arrives at new insights on the limits of ideal theory and utopian hope. (shrink)

It is natural and relatively common to suppose that feasibility is a constraint on what we ought to do all-things-considered but not a constraint on what we ought to do as a matter of justice. I show that the combination of these claims entails an implausible picture of the relation between feasibility and desirability given an attractive understanding of the relation between what we ought to do as a matter of justice and what we ought to do all-things-considered.

Lipsey and Lancaster's "general theory of second best" is widely thought to have significant implications for applied theorizing about the institutions and policies that most effectively implement abstract normative principles. It is also widely thought to have little significance for theorizing about which abstract normative principles we ought to implement. Contrary to this conventional wisdom, I show how the second-best theorem can be extended to myriad domains beyond applied normative theorizing, and in particular to more abstract theorizing about the normative (...) principles we should aim to implement. I start by separating the mathematical model used to prove the second-best theorem from its familiar economic interpretation. I then develop an alternative normative-theoretic interpretation of the model, which yields a novel second best theorem for idealistic normative theory. My method for developing this interpretation provides a template for developing additional interpretations that can extend the reach of the second-best theorem beyond normative theoretical domains. I also show how, within any domain, the implications of the second-best theorem are more specific than is typically thought. I conclude with some brief remarks on the value of mathematical models for conceptual exploration. (shrink)

It is commonly taken for granted that questions of feasibility are highly relevant to our normative thinking – and perhaps especially our normative thinking about politics. But what exactly does this preoccupation with feasibility amount to, and in what forms if any is it warranted? This article aims to provide a critical introduction to, and clearer characterization of, the feasibility issue. I begin by discussing the question of how feasibility is to be understood. I then turn to the question of (...) feasibility’s role, suggesting that there are two quite different kinds of role questions that may be at play, though they are often run together: a question about feasibility’s normative significance; and a question about its proper use in informing our normative thinking. Finally, I consider how the feasibility issue differs from certain other related issues: the demandingness issue; the issue of whether “ought” implies “can;” and the “ideal versus non-ideal theory” issue. The paper discusses the adequate role of ideal theory for the discussion of practical problems. Therefore, I will reconstruct the Rawlsian understanding of the ideal-theoretical method and confront it with the critiques of Raymond Geuss and Amartya Sen. While Geuss is sceptical, whether ideal theory provides an appropriately critical perspective, Sen doubts the practical usefulness of ideal-theoretical models. It will be shown, that Rawlsian ideal theory can deal with these criticisms and that it is a useful tool for solving practical (...) problems. (shrink)

Do motivational limitations due to human nature constrain the demands of justice? Among those who say no, David Estlund offers perhaps the most compelling argument. Taking Estlund’s analysis of “ability” as a starting point, I show that motivational deficiencies can constrain the demands of justice under at least one common circumstance — that the motivationally-deficient agent makes a good faith effort to overcome her deficiency. In fact, my argument implies something stronger; namely, that the demands of justice are constrained by (...) what people are sufficiently likely to be motivated to do. Thus, contrary to the prevailing wisdom, it is the business of ideal theory — not just nonideal theory — to work with the motivational capacities people are likely enough to have. Many political theorists think about how to make societies more just. In recent years, with interests shifting from principles to their institutional realization, there has been much debate about feasibility and the role it should play in theorizing. What has been underexplored, however, is how feasibility depends on the attitudes and perceptions of individuals, not only with regard to their own behaviour, but also with regard to the behaviour of others. This can create coordination problems, which can be described as (...) “feasibility gridlocks”. These problems are interesting from a normative perspective, not only because they arguably play an important role for the feasibility of institutions, but also because they contain a normative element themselves: individual might be willing to cooperate in order change the “feasibility frontier” Political ideals and the feasibility frontier. Econ Philos), but only if others are also willing to do their bit, which contains a judgment about the fair distribution of burdens. Beliefs about the selfish nature of human beings, however, can make feasibility gridlocks more likely. This is why what I call, for the sake of brevity, “economic ideology”, i.e. an account of human nature as fundamentally self-interested, can be harmful. Finding a way out of such equilibriums therefore is an important task for political theorists and social reformers. (shrink)

Recent methodological debates regarding the place of feasibility considerations in normative political theory are hindered for want of a rigorous model of the feasibility frontier. To address this shortfall, I present an analysis of feasibility that generalizes the economic concept of a production possibility frontier and then develop a rigorous model of the feasibility frontier using the familiar possible worlds technology. I then show that this model has significant methodological implications for political philosophy. On the Target View, a political ideal (...) presents a long-term goal for morally progressive reform efforts and, thus, serves as an important reference point for our specification of normative political principles. I use the model to show that we can- not reasonably expect that adopting political ideals as long-term reform objectives will guide us toward the realization of morally optimal feasible states of affairs. I conclude by proposing that political philosophers turn their attention to the analysis of actual social failures rather than political ideals. (shrink)

Numerous philosophers allege that the "general theory of second best" (Lipsey and Lancaster, 1956) poses a challenge to the Target View, which asserts that real world reform efforts should aim to establish arrangements that satisfy the constitutive features of ideal just states of affairs. I demonstrate two claims that are relevant in this context. First, I show that the theory of second best fails to present a compelling challenge to the Target View in general. But, second, the theory of second (...) best requires ideal theorists to undertake certain kinds of causal and comparative analyses that are typically thought to lie beyond the borders of conventional ideal theory. It is conventional wisdom among political philosophers that ideal principles of justice must guide our attempts to design institutions to avert actual injustice. Call this the ideal guidance approach. I argue that this view is misguided— ideal principles of justice are not appropriate "guiding principles" that actual institutions must aim to realize, even if only approximately. Fortunately, the conventional wisdom is also avoidable. In this paper, I develop an alternative approach to institutional design, which I call institutional failure analysis. The (...) basic intuition of this approach is that our moral assessment of institutional proposals is most effective when we proceed from a detailed understanding of the causal processes generating problematic social outcomes. Failure analysis takes the institutional primary design task to be obviating or averting institutional failures. Consequently, failure analysis enables theorists to prescribe more effective solutions to actual injustice because its focuses on understanding the injustice, rather than specifying an ideal of justice. From Plato to the present day, political theorists have used models of idealistic societies to think about politics. How can these idealistic models inform our thinking about political life in our non-ideal world? Not, as many political theorists have hoped, by providing normative guidance -- by showing us how things should be or where we should go. Even still, we can use these models to interpret the concepts we depend on to explain and evaluate political behavior and institutions, thereby sharpening (...) our explanations of how things work and our estimations of how to make things better. Seeing idealistic models in this light reveals a promising route to a form of political inquiry that integrates our explanatory aims and our normative aspirations. -/- (Updated: October 2024. The revival of republicanism was meant to challenge the hegemony of liberalism in contemporary political theory on the grounds that liberals show insufficient concern with institutional protection against political misrule. This article challenges this view by showing how neorepublicanism, particularly on Philip Pettit’s formulation, demands no greater institutional protection than does political liberalism. By identifying neutrality between conceptions of the good as the constraint on institutional requirements that forces neorepublicanism into the liberal framework, the article shows that neutrality is what (...) neorepublicans must jettison to offer a tenable critique of liberalism. Only then can neorepublicans ensure greater protection against misrule by demanding that citizens participate more actively in politics. They can then also criticize liberalism for failing to appreciate the importance of such protection. (shrink)

The notions of “ideal theory” and “nonideal theory” have become widely accepted in political philosophy. Recently, several philosophers’ have urged that ideal theory systematically produces practically irrelevant theories. Such philosophers argue that political philosophy ought move away from ideal theory in order to make the discipline more germane to the unjust real world. Call this tactic of eliminating ideal theory “Strategy.” In this paper, I argue that political philosophy would do well to abandon the ideal/nonideal distinction. Though the use of (...) INID is widespread, philosophers do not have one uniform way of drawing the distinction; of the several common ways of drawing the distinction, none is categorical. As a consequence of this ambiguity, the role that INID plays in our political philosophical theorizing has become pernicious. (shrink)

Abstract This paper aims to shed some light on the difficulties we face in constructing a generally acceptable normative framework for thinking about public health. It argues that there are three factors that (...) combine to make theorising about public health difficult, and which when taken together defeat simplistic top-down and bottom-up approaches to the design of public health policies. The first factor is the problem of complex systems, namely that the distribution of health both affects and is affected by the distribution of other goods. The second is the difficulty of defining the goals of public health: we still need to get clear about what we should mean by health in this context, and what the goals of public health should be. The third is that we stand in need of an account of how important health is relative to the importance of other goods that a just society should be trying to secure for its citizens. The paper argues that these problems should lead us to abandon the search for a ‘one-size fits all’ normative framework for thinking about public health. The concept of feasibility has received a significant amount of scrutiny in recent years. Despite the diversity of accounts, all agree on the assumption that feasibility considerations have a practical function in guiding action. However, the two most important accounts (by Gilabert and Lawford-Smith, and by Wiens) seem to scarcely speak to this practical function because they provide a third-personal reconstruction of feasibility constraints. In this paper, I argue that, to understand feasibility constraints in a way that matters for guiding (...) action, we should switch from a third-personal to an agent-centered perspective. I show that relevant constraints can be Barriers, Limitations, Boundaries, and Rubber Walls to the extent that they concern nomic impossibilities (Barriers), resources (Limitations), agents’ abilities (Boundaries) or other people’s unwillingness (Rubber Walls). Understanding constraints through the lens of their qualitatively different natures opens the way for addressing the problem of how to respond to them. (shrink)

The article critically examines the neo-Republican conception of respect put forward by Philip Pettit in Robust Demands of the Good. The paper argues that Pettit’s treatment of respect as a rich good in RDG is too thin in some ways, but too rich in others. There are four critical claims to support this argument. First, that both invading the domain of basic liberties, and failing to protect and resource the capacity to exercise choice, constitute individually sufficient conditions for disrespectful treatment, (...) and that the protection and resourcing of basic liberties are both relevant domains over which an appropriate disposition is also necessary for the provision of the rich good of respect. Second, that it is unnecessary and undesirable to rely on local conventions to provide a specification of the treatment that the status of respect requires. Third, that providing respect as a rich good in conditions of reasonable pluralism implies treating minorities in a disrespectful way. Fourth, that the role given to law in supporting the provision of the rich good of respect leads to a difficult dilemma for Pettit: either the full enjoyment of respect is not possible in nearby worlds, or it is only possible in ideal conditions that are far from nearby worlds. When we talk about intellectual property, it is often implicitly assumed that we are talking about private intellectual property. However, private property and the idea of private ownership do not exhaust the possibilities for accounts of ownership and of property. There are other ways that ownership can operate, such as common property. A resource is common property if its use is ‘governed by rules whose point is to make them available for use by all or any members of the society.’.

Some realists in political theory deny that the notion of feasibility has any place in realist theory, while others claim that feasibility constraints are essential elements of realist normative theorising. But none have so far clarified what exactly they are referring to when thinking of feasibility and political realism together. In this article, we develop a conception of the realist feasibility frontier based on an appraisal of how political realism should be distinguished from non-ideal theories. In this realist framework, political (...) standards are feasible if they meet three requirements: they are politically intelligible, contextually recognisable as authoritative, and contestable. We conclude by suggesting that our conception of realist feasibility might be compatible with utopian demands, thereby possibly finding favour with realists who otherwise refuse to resort to the notion of feasibility. Although the discussion about feasibility in political theory is still in its infancy, some important progress has been made in the last years to advance our understanding. In this paper, we intend to make a contribution to this growing literature by investigating the proper place of feasibility considerations in political theory. A motivating force behind this study is a suspicion that many presumptions made about feasibility in several current debates—such as that between practice-independence and practice-dependence, ideal and non-ideal theory, and (...) political moralism and political realism—are too rigid and underestimate the numerous different ways in which feasibility concerns may enter into our theorizing. To chisel out this feasibility space, our aim is to suggest two metatheoretical constraints on normative political principles as intuitively plausible, the so-called ‘fitness constraint’ and the ‘functional constraint’, through which we elucidate five central aspects for determining proper feasibility constraints of an account in political theory. Classifying accounts of institutionalized social norms that rely on individual rule-following as ‘sociological’ and accounts based on individual opportunity-seeking behavior as ‘economic’, the paper rejects purely economic accounts on theoretical grounds. Explaining the realworkings of institutionalized social norms and social order exclusively in terms of self-regarding opportunityseeking individual behavior is impossible. An integrated sociological approach to the so-called Hobbesian problem of social order that incorporates opportunityseeking along with rule-following behavior is necessary.
