[ENG] The aim of this paper is to analyze the „possibility puzzle” presented by Shapiro (2011) in the context of the debate between conventionalism and non-conventionalism in speech act theory. Conventionalism claims that for every speech act there is a pattern (convention) which determines its illocutionary force. To perform a felicitous speech act is to fulfil necessary and sufficient conditions for this particular speech act. Non-conventionalism criticizes the view that for every speech act there is a conventional pattern and hidden (...) conditions, which are to be fulfilled. This view maintains the conventional thesis for the so-called strict conventional speech acts (e.g. performatives), but negates using universal quantifier for so-called communicative speech acts whose aim is, in short, to express an intention and force someone to act by virtue of this intention. As in (Shapiro 2011), Phil said: in order for someone to have the power to make, change and apply rules, there has to be a rule that empowers someone to do so. This objection concerned „The First Legis- lator” only from the conventional perspective on speech acts. If it can be maintained that The First Legislator’s speech acts may be non-conventional, then Phil’s argument misses the point. Finally, I will emphasize that only lawyers analyze „the very first speech acts” whereas for philosophers, the problem of e.g. „the very first question” is less absorbing. -/- [PL] Celem niniejszego artykułu jest przedstawienie tak zwanej Aporii Phila (possibility puz- zle) przedstawionej przez Shapiro (2011) w kontekście sporu konwencjonalizm–nonkon- wencjonalizm w teorii aktów mowy. Konwencjonalizm utrzymuje, że dla każdego aktu mowy istnieje konwencja, która determinuje moc illokucyjną aktu. Wykonać w pełni for- tunny akt mowy to spełnić wystarczające i konieczne warunki określone dla danego aktu mowy. Nonkonwencjonalizm krytykuje pogląd, że dla każdego aktu mowy istnieje okre- ślona konwencja oraz ukryte warunki, które należy spełnić. Ten pogląd utrzymuje kon- wencjonalną tezę dla tak zwanych stricte konwencjonalnych aktów mowy (na przykład performatywów), ale neguje użycie dużego kwantyfikatora dla tak zwanych komunika- cyjnych aktów mowy, których celem jest, w skrócie, wyrażenie pewnej intencji i zmusze- nie kogoś poprzez jej wyrażenie do określonego postępowania. Phil, bohater historii z książki Shapiro (2011), podkreślił, iż zawsze musi istnieć reguła upoważniająca do two- rzenia prawa. Ten zarzut dotyczący „Pierwszego Legislatora” jest zasadny tylko z per- spektywy konwencjonalizmu. Jeżeli można utrzymywać, że akt mowy Pierwszego Legislatora może być nonkonwencjonalny, wtedy argument Phila jest nietrafny. Na końcu scharakteryzowany jest następujący fenomen: tylko prawnicy analizują „pierwsze akty mowy”, natomiast dla filozofów problem „pierwszego pytania” nie jest tak absorbujący. (shrink)

This article provides a speech act analysis of ‘crime-enacting’ provisions in criminal statutes, focusing on the illocutionary force of these provisions. These provisions commonly set out not only particular crimes and their characteristics but also their associated penalties. Enactment of a statute brings into force new social facts, typically norms, through the official utterance of linguistic material. These norms are supposed to guide behaviour: they tell us what we must, may, or must not do. Our main claim is that the (...) illocutionary force of such provisions is primarily ‘world-creating’, i.e. effective, or declarational, rather than directive. We assume that directive illocutionary force is either direct or indirect, showing that provisions need not contain the linguistic items that make for direct directives and that according to standard tests no indirect directive is present. A potential counter-argument is that any utterance serving to direct behaviour is necessarily a directive. We show that this behaviour-directing property is shared by some clear non-directives. Imperatives cannot be true or false, so they are shunned by logicians. And yet imperatives can be combined by logical connectives: "kiss me and hug me" is the conjunction of "kiss me" with "hug me". This example may suggest that declarative and imperative logic are isomorphic: just as the conjunction of two declaratives is true exactly if both conjuncts are true, the conjunction of two imperatives is satisfied exactly if both conjuncts are satisfied—what more is there to say? Much more, (...) I argue. "If you love me, kiss me", a conditional imperative, mixes a declarative antecedent ("you love me") with an imperative consequent ("kiss me"); it is satisfied if you love and kiss me, violated if you love but don't kiss me, and avoided if you don't love me. So we need a logic of three -valued imperatives which mixes declaratives with imperatives. I develop such a logic. (shrink)

Austin's distinction between locutionary and illocutionary acts has offered a fruitful way of focussing the relation between language and communication. In particular, by adopting the distinction we attend to linguistic and communicative subjects as actors, not just processors or conduits of information. Yet in many attempts to explicate the constitution of illocutionary acts the subject as actor is subsumed within the role of linguistic rules or conventions. I propose an account of illocutionary acts in which rules or conventions are secondary (...) to what I call communicative skills. These skills are taken as the primary component of communicative competence. They are derived from the principle that linguistic communication is not ultimately a linguistic matter, but relates instead to the way a communicator uses language. This principle is found in the work of Donald Davidson, but Davidson has tended to concentrate on semantics, and leaves the details of linguistic communication for pragmatics. The aim of this paper is to defend the general principle and supply some pragmatic details. (shrink)

la noción de perlocución ha resultado problemática desde su primera formulación en Austin . Se exploran dos vías diferentes para su clarificación. la vía reconstructiva examina las ambigüedades incrustadas en la caracterización austiniana y trata de deshacerlas mediante taxonomías basadas en criterios precisos. la vía eliminativa , finalmente adoptada, propone sustituirla por una noción alternativa, la de marco situacional de una emisión, capaz de servir mejor al propósito de estudiar “el acto de habla total en la situación de habla total”.

Assertion plays a crucial dual role in Frege's conception of logic, a formal and a transcendental one. A recurrent complaint is that Frege's inclusion of the judgement-stroke in the Begriffsschrift is either in tension with his anti-psychologism or wholly superfluous. Assertion, the objection goes, is at best of merely psychological significance. In this paper, I defend Frege against the objection by giving reasons for recognising the central logical significance of assertion in both its formal and its transcendental role.

The truth-condition theory of meaning is, naturally, thought of an as explanatory theory whose explananda are the meaning facts. But there are at least two deductive arguments that purport to establish the truth of the theory irrespective of its explanatory virtues. This paper examines those arguments and concludes that they succeed.

William P. Alston argues in “Expressing” (1965) that there is no important difference between expressing a feeling in language and asserting that one has that feeling. My aims in this paper are (1) to show that Alston's arguments ought to have led him to a different conclusion—that “asserting” and “expressing” individuate speech acts at different levels of analysis (the illocutionary and the locutionary, respectively)—and (2) to argue that this conclusion can solve a problem facing contemporary analyses of expressing: the “no (...) show tell” problem, or the problem of accounting for utterances that report feelings truly without expressing them. Alston's paper made an important contribution 50 years ago, and a reimagining of it can make another important contribution today. (shrink)

Speech acts are a staple of everyday communicative life, but only became a topic of sustained investigation, at least in the English-speaking world, in the middle of the Twentieth Century.[1] Since that time “speech act theory” has been influential not only within philosophy, but also in linguistics, psychology, legal theory, artificial intelligence, literary theory and many other scholarly disciplines.[2] Recognition of the importance of speech acts has illuminated the ability of language to do other things than describe reality. In the (...) process the boundaries among the philosophy of language, the philosophy of action, the philosophy of mind and even ethics have become less sharp. In addition, an appreciation of speech acts has helped lay bare an implicit normative structure within linguistic practice, including even that part of this practice concerned with describing reality. Much recent research aims at an accurate characterization of this normative structure underlying linguistic practice. (shrink)
