We apply a familiar distinction from philosophy of language to a class of material artifacts that are sometimes said to “speak”: statues. By distinguishing how statues speak at the locutionary level versus at the illocutionary level, or what they say versus what they do, we obtain the resource for addressing two topics. First, we can explain what makes statues distinct from street art. Second, we can explain why it is mistaken to criticize—or to defend—the continuing presence of statues based only (...) on what they represent. Both explanations are driven by the same core idea: the significance of statues arises primarily from what they do, and not what they say. (shrink)

Asserting is the act of claiming that something is the case—for instance, that oranges are citruses, or that there is a traffic congestion on Brooklyn Bridge (at some time). We make assertions to share information, coordinate our actions, defend arguments, and communicate our beliefs and desires. Because of its central role in communication, assertion has been investigated in several disciplines. Linguists, philosophers of language, and logicians rely heavily on the notion of assertion in theorizing about meaning, truth and inference. -/- (...) The nature of assertion and its relation to other speech acts and linguistic phenomena (implicatures, presuppositions, etc.) have been subject to much controversy. This paper addresses the following question: Can one and the same utterance token, in one unique speech situation, intentionally and conventionally perform a plurality of illocutionary acts? While some of the recent literature has considered such a possibility Perspectives on pragmatics and philosophy. Springer, Cham, pp 227–244, 2013; Johnson in Synthese 196:1151–1165, 2019), I build a case for it by drawing attention to common conversational complexities unrecognized in speech acts analysis. Traditional speech act theory treats communication as: a dyadic exchange (...) between a Speaker and a Hearer who trade illocutionary acts endowed with one and only one primary force. I first challenge assumption by discussing two contexts where plural illocutionary forces are performed in dyadic discussions: dilemmatic deliberations and strategic ambiguity. Further, I challenge assumption by analyzing poly-adic discussions, where a speaker can target various participants with different illocutionary acts performed via the same utterance. Together, these analyses defend illocutionary pluralism as a significant but overlooked fact about communication. I conclude by showing how some phenomena recently analyzed in speech act theory—back-door speech acts New work on speech acts. Some speech acts are made indirectly. It is thus natural to think that assertions could also be made indirectly. Grice’s conversational implicatures appear to be just a case of this, in which one indirectly makes an assertion or a related constative act by means of a declarative sentence. Several arguments, however, have been given against indirect assertions, by Davis (1999), Fricker (2012), Green (2007, 2015), Lepore & Stone (2010, 2015) and others. This paper confronts and rejects three considerations that have (...) been made: arguments based on the distinction between lying and misleading; arguments based on the ordinary concept of assertion; and arguments based on the testimonial knowledge that assertions provide. Stalnaker’s conception of context as common ground possesses unquestionable explanatory power, shedding light on presupposition, presupposition accommodation, the behavior of certain types of conditionals, epistemic modals, and related phenomena. The CG-context approach is also highly abstract, so merely pointing out that it fails to account for an aspect of communication is an inconclusive criticism. Instead our question should be whether it can be extended or modified to account for such a phenomenon while preserving its spirit. To that end, this essay (...) assesses the prospects of the CG-context approach for making sense of the variety of ways in which interlocutors accept propositions as well as non-propositional contents, some different types of conversation and the norms distinctive of these different types, some pre-illocutionary pragmatic phenomena, conversational injustice, and fictional discourse. This essay addresses the question whether artificial speakers can perform speech acts in the technical sense of that term common in the philosophy of language. We here argue that under certain conditions artificial speakers can perform speech acts so understood. After explaining some of the issues at stake in these questions, we elucidate a relatively uncontroversial way in which machines can communicate, namely through what we call verbal signaling. But verbal signaling is not sufficient for the performance of a speech (...) act. To explain the difference, we elucidate the notion of a speech act developed by Austin in the mid-twentieth century and then discuss Strawson’s influential proposal for how that notion may be related to Grice’s conception of speaker meaning. We then refine Strawson’s synthesis in light of Armstrong’s reconceptualization of speaker meaning in terms of objectives rather than intentions. We next extend this conception of speech acts to the cases of recorded, proxy, and conditional speech acts. On this basis, we propose that a characteristic role for artificial speakers is as proxies in the performance of speech acts on behalf of their human creators. We also consider two objections to our position, and compare our approach with others: while other authors appeal to notions such as “quasi-assertion,” we offer a sharp characterization of what artificial speakers can do that does not impute intentions or similarly controversial powers to them. We conclude by raising doubts that our strategy can be applied to speech acts generally. (shrink)

I propose an account of the speech act of prediction that denies that the contents of prediction must be about the future and illuminates the relation between prediction and assertion. My account is a synthesis of two ideas: (i) that what is in the future in prediction is the time of discovery and (ii) that, as Benton and Turri recently argued, prediction is best characterized in terms of its constitutive norms.

We critically survey prominent recent scholarship on the question of whether fiction can be a source of epistemic value for those who engage with it fully and appropriately. Such epistemic value might take the form of knowledge (for ‘cognitivists’) or understanding (for ‘neo-cognitivists’). Both camps may be sorted according to a further distinction between views explaining fiction’s epistemic value either in terms of the author’s engaging in a form of telling, or instead via their showing some state of affairs to (...) obtain, a special case of which is the provision of self-knowledge. Fictional works that show rather than tell often employ thought experiments. The epistemic value of some fictional works is indicated by their enabling of empathy, itself illuminated via the psychological process of experience-taking. Whether a fictional work offers epistemic value by telling or showing, there is, in principle, no bar to its being able to deliver on what it offers, and consumers of fiction who exercise epistemic vigilance may gain either knowledge or some degree of understanding from their engagement with it. This paper shows how reasoning from best explanation combines with linguistic and factual presumptions during the process of retrieving a speaker’s intention. It is shown how differences between presumptions need to be used to pick the best explanation of a pragmatic manifestation of a dialogical intention. It is shown why we cannot simply jump to an interpretative conclusion based on what we presume to be the most common purpose of a speech act, and why, in cases of indirect speech acts, (...) we need to depend on an abductive process of interpretation. Metaphorical utterances are construed as falling into two broad categories, in one of which are cases amenable to analysis in terms of semantic content, speaker meaning, and satisfaction conditions, and where image-construction is permissible but not mandatory. I call these image-permitting metaphors, and contrast them with image-demanding metaphors comprising a second category and whose understanding mandates the construction of a mental image. This construction, I suggest, is spontaneous, is not restricted to visual imagery, and its result is typically somatically marked (...) sensu Damasio. IDM’s are characteristically used in service of self-expression, and thereby in the elicitation of empathy. Even so, IDM’s may reasonably provoke banter over the aptness of the imagery they evoke. The aim of this paper is to argue that lying differs from mere misleading in a way that can be morally relevant: liars commit themselves to something they believe to be false, while misleaders avoid such commitment, and this difference can make a moral difference. Even holding all else fixed, a lie can therefore be morally worse than a corresponding misleading utterance. But, we argue, there are also cases in which the difference in commitment makes lying morally better than misleading, (...) as well as cases in which the difference is not morally relevant. This view conflicts with the two main positions philosophers have defended in the ethics of lying and misleading, which entail either that lying is in virtue of its nature worse than misleading or that there is no morally relevant difference between lying and misleading. According to the subjective view of lying, speakers can lie by asserting a true proposition, as long as they believe this proposition to be false. This view contrasts with the objective view, according to which lying requires the actual falsity of the proposition asserted. The aim of this paper is to draw attention to pairs of assertions that differ only in intuitively redundant content and to show that such pairs of assertions are a reason to favour the subjective view of (...) lying over the objective one. In this paper I survey a range of trolling behaviors and analyze a particular species that stands out. After a brief discussion of some of the inherent challenges in studying internet speech, I describe a few examples of behaviors commonly described as ‘trolling’ in order to identify what they have in common. I argue that most of these behaviors already have well-researched offline counterparts. In contrast, in the second half of the paper I argue that so-called ‘subcultural trolling’ calls out (...) for further analysis: it cannot be fully explained using standard tools like insincerity or bullshit, or even using new tools like dogwhistling. Instead, I propose a new species of speech act force. I conclude by highlighting some implications for broader issues in pragmatics and ethics. (shrink)

In recent times, phenomena of conversational asymmetry have become a lively object of study for linguists, philosophers of language and moral philosophers—under various labels: illocutionary disablement and silencing, discursive injustice :440–457, 2014; Lance and Kukla in Ethics 123:456–478, 2013), illocutionary distortion. The common idea is that members of underprivileged groups sometimes have trouble performing particular speech acts that they are entitled to perform: in certain contexts, their performative potential is somehow undermined, and their capacity to do things with words is (...) distorted or even annulled. In this paper I will assess this idea, focusing on Rebecca Kukla’s and Rae Langton’s accounts; in particular, I will criticize the role the notion of uptake plays in their accounts, and claim that it may ultimately undermine the very idea of discursive injustice. While, according to Kukla and Langton, members of disadvantaged groups are victims of a kind of uptake failure, leading to illocutionary disablement and even silencing, in the account I present they are victims of a kind of communicative disablement. My overall aim is to develop a notion of discursive injustice that is more plausible and more effective for our broader purposes of criticising the structures of power and oppression. (shrink)

Consider the opening sentence of Tolkien’s The Hobbit: In a hole in the ground there lived a hobbit. By writing this sentence, Tolkien is making a fictional statement. There are two influential views of the nature of such statements. On the pretense view, fictional discourse amounts to pretend assertions. Since the author is not really asserting, but merely pretending, a statement such as Tolkien’s is devoid of illocutionary force altogether. By contrast, on the alternative make-believe view, fictional discourse prescribes that (...) the reader make-believe the content of the statement. In this paper, we argue that neither of these views is satisfactory. They both fail to distinguish the linguistic act of creating the fiction, for instance Tolkien writing the sentence above, from the linguistic act of reciting it, such as reading The Hobbit out loud for your children. As an alternative to these views, we propose that the essential feature of the author’s speech act is its productive character, that it makes some state of affairs obtain in the fiction. Tolkien’s statement, we argue, has the illocutionary force of a declaration. (shrink)

This paper will outline a novel semantics of verbs of saying and of quotation based on Austin’s (1962) distinction among levels of linguistic acts (illocutionary, locutionary, rhetic, phatic, and phonetic acts). It will propose a way of understanding the notion of a rhetic act and argue that it is well-reflected in the semantics of natural language. The paper will furthermore outline a novel, unified and compositional semantics of quotation which is guided by two ideas. First, quotations convey properties related to (...) lower-level (phonetic or phatic) linguistic acts; second, such meanings of quotations are strictly based on syntactic structure, namely a lower-level (phonetic, phonological or morpho-syntactic) structure as part of the syntactic structure that is input to semantic interpretation. Such lower-level linguistic structures will contribute properties of utterances, to the semantic composition of the sentence, in one way or another. (shrink)

This paper discusses the thesis defended by Edith Stein that certain acts can be attributed to the State. According to Stein, the State is a social structure characterized by sovereignty. As such, it is responsible for the production, interpretation, and application of law. These tasks require the performance of acts, most of which are what Stein calls “social acts” like enactments and orders. For Stein, the acts in question are made by the organs of the State, but in the name (...) of the State, and are thus attributed to the State via a relation of representation. In the first section, the paper presents Stein’s thesis that the sovereignty of the State entails a series of legal prerogatives, which in turn result in various social acts being ascribed to the State through its representatives. In the second section, the paper critically discusses Stein’s views, notably her theory of representation, and her account of the nature of the State, while emphasizing its most interesting aspects, namely, its fine-grained analyses of the various acts that are attributed to the State. Generic claims like ‘women stay home and raise children’ and ‘boys don’t cry’ are normative generics: generic claims that express a norm. The truth conditions of normative generics are even harder to account for than those for more descriptive generics like ‘ducks lay eggs.’ Until recently, such generics were treated as deviant and thus not accounted for in standard accounts of generics. But recent work on the semantics and pragmatics of normative generics has changed that. In light of this recent (...) work, I propose that a speech act analysis of normative generics as instructions will shed light on normative generics. I end by discussing the ways in which this might allow us to use generics to counter harmful speech. (shrink)

G. E. Moore famously observed that to assert ‘I went to the pictures last Tuesday but I do not believe that I did’ would be ‘absurd’. Moore calls it a ‘paradox’ that this absurdity persists despite the fact that what I say about myself might be true. Krista Lawlor and John Perry have proposed an explanation of the absurdity that confines itself to semantic notions while eschewing pragmatic ones. We argue that this explanation faces four objections. We give a better (...) explanation of the absurdity both in assertion and in belief that avoids our four objections. (shrink)

This paper sets out to unpack the pragmatic structure of refusal—its illocutionary nature, success conditions, and normative effects. I argue that our ordinary concept of refusal captures a whole family of illocutions, comprising acts such as rejecting, declining, and the like, which share the property of being ‘negative second-turn illocutions’. Only _proper refusals_ (i.e. negative replies to permission requests), I submit, require speaker authority. I construe the ‘refusal family’ as a subclass of the directives-commissives intersection. After defending my view against (...) a number of potential objections, I highlight how a theoretically grounded analysis of refusal is not only of intrinsic value, but may also have significant moral and legal implications. This paper identifies two distinct dimensions of what might be called testimonial strength: first, in the case of testimony from more than one speaker, testimony can be said to be stronger to the extent that a greater proportion of the speakers give identical testimony; second, in both single-speaker and multi-speaker testimony, testimony can be said to the stronger to the extent that each speaker expresses greater conviction in the relevant proposition. These two notions of testimonial strength have received scant attention (...) in the philosophical literature so far, presumably because it has been thought that whatever lessons we learn from thinking about testimony as a binary phenomenon will apply mutatis mutandis to varying strengths of testimony. This paper shows that this will not work for either of the two aforementioned dimensions of testimonial strength, roughly because less testimony can provide more justification in a way that can only be explained by appealing to the (non-binary) strength of the testimony itself. The paper also argues that this result undermines some influential versions of non-reductionism about testimonial justification. (shrink)

What type of speech act is a norm of action, when the norm is agreed upon as the conclusion of an argumentative dialogue? My hypothesis is that, whenever a norm of action is the conclusion of an argument, it should be analyzed as the statement of a norm and thus as a verdictive speech act. If the context is appropriate, and the interlocutors are sincerely (or institutionally) committed to their argumentative exchange and its conclusion, then this verdictive motivates and institutes (...) a new one with the force of an exercitive. The interlocutors’ recognition and acceptance that the new illocution has been performed lends the norm its exercitive force. (shrink)

The usual treatment of a dinner table utterance of ‘Can you pass the salt?’ is that it involves an indirect request to pass the salt as well as a direct question about the hearer’s ability to do so: an indirect speech act. These are held to involve two illocutionary forces and two illocutionary acts. Rod Bertolet has raised doubts about whether consideration of such examples warrants the postulation of indirect speech acts and illocutionary forces other than the literal ones. In (...) a recent article, Mary Kate McGowan, Shan Shan Tam, and Margaret Hall claim to show that these doubts are unfounded. The purpose of this paper is to show that they have not established this. Metaethical non-naturalists maintain that normative or evaluative properties cannot be reduced to, or otherwise explained in terms of, natural properties. They thus have difficulty explaining what these irreducibly normative properties are supposed to be, other than by saying what they are not. I offer a partial, positive characterization of irreducible normativity in naturalistic terms. At a first pass, it is this: that to attribute a normative property to something is necessarily to commend or condemn that thing, due to the nature (...) of the property attributed. This theory characterizes normativity in terms of the natural phenomenon of performing certain familiar speech acts. The hypothesis does other explanatory work as well: it provides for an account of the "queerness" of normative properties, one superior to other accounts; it explains why metaethical reductionism is bound to fail, in a way friendly to non-naturalism (as opposed to non-cognitivism); and it can help deflect arguments against non-naturalism from the "essential practicality" of normativity. Taking inspiration from Searle’s ‘The Logic of Fictional Discourse’, this essay presents an argument against different versions of the so-called ‘speech act theory of fiction’. In particular, it argues that a Uniformity Argument may be constructed, which is additional to the Determination Argument commonly attributed to Searle, and which does not rely on his presumably controversial Determination Principle. This Uniformity Argument is equally powerful against the ‘Dedicated Speech Act’ theories that Searle originally targeted, and the more recent, Grice-inspired versions of (...) speech-act approaches to fictional discourse. According to Jonathan Kvanvig, the practice of taking back one’s assertion when finding out that one has been mistaken or gettiered fails to speak in favour of a knowledge norm of assertion. To support this claim, he introduces a distinction between taking back the content of the assertion, and taking back the speech act itself. This paper argues that Kvanvig’s distinction does not successfully face close speech-act-theoretic scrutiny. Furthermore, I offer an alternative diagnosis of the target cases sourced in the (...) normativity of action. (shrink)

In this paper, the aim is to explore how there can be a role for expression of affect in illocution, drawing upon some ideas about expression put forward by Karl Bühler. In a first part of the paper, I map some active discussions and open questions surrounding phenomena that seem to involve “expression of affect”. Second, I home in on a smaller piece of that larger puzzle; namely, a consideration of how there may be non-conventional expression of affect. I provide (...) some examples of what I take that to involve and set out some premises for approaching it. In a third section, I motivate such an interest by pointing to a question in speech act theory concerning ‘force conventionalism’. This is whether and how illocution can be performed non-conventionally—that is, whether (at least some) utterances can be communicated with illocutionary force without need of convention. I propose that where expression of affect may occur non-conventionally, it may in turn constitute one important route through which at least some kinds of illocution are achieved. In the fourth part of the paper, I sketch an account of such non-conventional expression of affect for the purposes of illocution, by exploring a broadly Bühlerian account of some affects; namely, that some affects are teleological in character, that coordinations may be involved in their satisfactional states, and that uptake of the expressed affect constitutes one subset of such satisfactional states. That exposition points to the contemporary relevance of the “action theory of expression” proposed by Bühler. (shrink)

In this paper I challenge the common wisdom (see Dummett and Davidson) that sentences are the minimal units with which one can perform a speech act or make a move in the language game. I thus sit with Perry and Stainton in arguing that subsentences can be used to perform full-fledged speech acts. In my discussion I assume the traditional framework which distinguishes between the proposition expressed and the thought or mental state (possibly a sentence in Mentalese) one comes to (...) grasp when using/understanding an utterance (or sentence-in-a-context) expressing a proposition. Unlike Stainton, I will argue that the proposition expressed by a subsentential assertion and its corresponding thought are not the end product of a pragmatic process of free enrichment. I shall defend the view that a thought may concern something without the thinker having to represent that very thing. This should help us to resist the view that with the utterance of a subsentence enrichment is mandatory. I will further argue that subsentences and their corresponding thoughts are situated. Because of that we can successfully interact and engage in joint ventures using subsentences and be guided by thoughts without having to enrich them. The fact that the actors’ unenriched thoughts are co-situated may suffice to explain the positive outcome of their joint project. Last but not least, I will also show how the picture I propose gains further support by taking on board Perry’s distinction between reflexive truth conditions and incremental truth conditions (or official content). Since competent speakers can grasp an utterance’s reflexive truth conditions without having to grasp its official content (roughly, the proposition expressed) they can successfully interact without their thoughts having to undergo a process of free enrichment. Moreover, if I’m right in arguing that an utterance’s reflexive truth conditions are the best tool to classify the semantic features of one’s mental state (or sentence in Mentalese), we can further explain mental causation and linguistic communication without appealing to free enrichment. A number of philosophers have become interested in the ways that individuals are subject to harm as the performers of illocutionary acts. This paper offers an account of the underlying structure of such harms: I argue that speakers are the subjects of illocutionary harm when there is interference in the entitlement structure of their linguistic activities. This interference comes in two forms: denial and incapacitation. In cases of denial, a speaker is prevented from achieving the outcomes to which they are (...) entitled by their speech. In cases of incapacitation, a speaker’s standing to expect certain outcomes is itself undermined. I also discuss how individual speakers are subject to interference along two dimensions: as exercisers of certain non-linguistic capacities, and as producers of meaningful speech. (shrink)

Legal rationalist: law claims to give its subjects reasons for action. Normative reasons intuition: Reasons for action being key, the obvious way to establish that law makes a practical difference in people's deliberations is by arguing that the law claims to give reasons for action to its subjects. Explanatory Reasons Intuition: "And while it is possible to be confused about our normative reasons, it seems unlikely that everyone is confused all the time; so the fact that people consistently take the (...) law as their motivating reason and guide their conduct by the law does seem to suggest that the law does provide normative reasons for its subjects." And if it’s a necessary feature of law that it claims authority, then the argu- ment seems to establish that law claims to provide reasons for its subjects. Schematically the argument as a whole goes like this: The law claims to be a legitimate authority. If a legitimate authority directs a subject to φ the subject is obligated to φ ). The fact that an agent is obligated to φ is a reason for her to φ. So the law claims that its directives are reasons......Obligations as Reason-Giving : the fact that A is obligated to φ is itself a reason for A to φ. Unfortunately for the Legal Rationalist, OAR is false. Legal obligation has certain features which mean that the fact that a certain action’s being legally obligatory cannot itself constitute a reason to perform that action." Will explain away the intuitions in terms of triggering, and show how law can make a normative difference that is consistent with the falsity of OAR. Law's claim, and normative impact, can be captured exclusively in terms of second-order reasons. But deliberation is cut off because the law has reached some sort of conclusion or answer or verdict on the question of whether or not to φ. The legal obligation not to φ contains a practical verdict about φing: it is not to be done. This idea – that the legal obligation not to φ provides or contains a verdict that φing is not to be done – is the idea that legal obligation is verdictive. For something to be verdictive is for it to express or embody a verdict or conclusion as to what ought to be done. It is plausible to say that wrongness is verdictive. So to say that such-and-such an action would be wrong is to express a verdict on that action – it is one which should not be done. To get a handle on the idea of the verdictive it helps to contrast it with the contributory. A contributory consideration is one which contributes to the verdict, by increasing the weight on the verdict’s side. So that φing would harm someone, or would cause extreme suffering, or would have costs that vastly outweighed any benefits, say, would be contributory considerations on the side of the verdict that φing would be wrong." "Wrong" is verdictive, and so it cannot itself be a reason for the action - it cannot be a reason for itself. Obligation and wrong in law are very close, and obligation should be treated as verdictive. This shows us that OAR is false. (shrink)

Slote has argued that empathy plays a crucial role in such speech acts as questions and assertions. After clarifying some of the aims and limitations of speech act theory, providing an account of empathy and its potential epistemic value, and sketching the role that some speech acts play in expressing psychological states, we consider Slote’s argument for the place of empathy in questions and assertions. We show that the most that Slote has established is that some cases of questioning and (...) asserting depend upon on empathetic engagement between speaker and addressee. That, however, is no basis for concluding that empathy plays a crucial role in either of these illocutions. (shrink)

This volume seeks to further the use of formal methods in clarifying one of the central problems of philosophy: that of our free human agency and its place in our indeterministic world. It celebrates the important contributions made in this area by Nuel Belnap, American logician and philosopher. Philosophically, indeterminism and free action can seem far apart, but in Belnap’s work, they are intimately linked. This book explores their philosophical interconnectedness through a selection of original research papers that build forth (...) on Belnap’s logical and philosophical work. Some contributions take the form of critical discussions of Belnap's published work, some develop points made in his publications in new directions, and others provide additional insights on the topics of indeterminism and free action. In Nuel Belnap’s work on indeterminism and free action, three formal frameworks figure prominently: the simple branching histories framework known as "branching time;" its relativistic spatio-temporal extension, branching space-times; and the “seeing to it that” logic of agency. As those frameworks provide the formal background for the contributed papers, the volume introduction gives an overview of the current state of their development. It also introduces case-intensional first order logic, a general intensional logic offering resources for a first-order extension of the mentioned frameworks and a recent research focus of Belnap’s. The meaning of an utterance is often enriched by the pragmatic context in which it is uttered. This is because in ordinary conversations we routinely and uncontroversially compress what we say, safe in the knowledge that those interpreting us will ‘add in’ the content we intend to communicate. Does the same thing hold true in the case of legal utterances like ‘This constitution protects the personal rights of the citizen’ or ‘the parliament shall have the power to lay and collect (...) taxes’? This article addresses this question from the perspective of the constitutional originalist—the person who holds that the meaning of a constitutional text is fixed at some historical moment. In doing so, it advances four theses. First, it argues that every originalist theory is committed to some degree of pragmatic enrichment, the debate is about how much. In this paper, I examine the terms on which John Simmons rejects all arguments for a moral obligation to obey the law and so defends “philosophical anarchism.” Although I accept his rejection of several criteria on which others might and often do insist, I criticize his reliance on the conditions of “generality” and “particularity.” In doing so, I propose an alternative to his influential conception of legitimacy.

The debate over the merits of originalism has advanced considerably in recent years, both in terms of its intellectual sophistication and its practical significance. In the process, some prominent originalists—Lawrence Solum and Jeffrey Goldsworthy being the two discussed here—have been at pains to separate out the linguistic and normative components of the theory. For these authors, while it is true that judges and other legal decision-makers ought to be originalists, it is also true that the communicated content of the constitution (...) is its original meaning. That is to say: the meaning is what it is, not what it should be. Accordingly, there is no sense in which the communicated content of the constitution is determined by reference to moral desiderata; linguistic desiderata do all the work. In this article, I beg to differ. In advancing their arguments for linguistic originalism, both authors rely upon the notion of successful communications conditions. In doing so they implicitly open up the door for moral desiderata to play a role in determining the original communicated content. This undercuts their claim and changes considerably the dialectical role of linguistic originalism in the debate over constitutional interpretation. (shrink)

The Assurance View, as advanced by Angus Ross and Richard Moran, makes the epistemology of testimony a matter of interpersonal commitments and entitlements. More specifically, I argue, their position is best understood as claiming that for someone’s belief to be testimonially justified is for some speaker to bear illocutionary responsibility for its truth. With this understanding in hand, I present a problem for the view that has so far escaped attention, a problem deriving from the wide freedom we have to (...) retract our assertions. Retraction dissolves the illocutionary responsibilities that were set up by preceding speech acts; but in some circumstances the epistemic significance of a retraction is effectively nil. We can therefore construct cases in which the responsibilities undertaken in testimony have been canceled, while the justification for belief based on it remains in place—and that shouldn’t be possible, if the Assurance View has things right. The paper examines Johann Georg Hamann’s influence on Ludwig Wittgenstein’s late philosophy. Wittgenstein’s letters, diaries and Drury’s memoirs show that Wittgenstein read Hamann’s writings in the early 1930s and 1950s. Wittgenstein’s diary notes and the Cambridge lectures show that Wittgenstein’s discussion of Hamann’s views in 1931 corresponds to adopting a Hamannian view of symbols and rule-following. The view of language as an intertwining of signs, objects and meanings in use forms a common core in the philosophies of Hamann and Wittgenstein. (...) The harmony of language and reality takes place in communicative use, so non-communicative private languages and pre-linguistic ideal forms of representation are not possible. Powerful transformer models based on neural networks such as GPT-4 have enabled huge progress in natural language processing. This paper identifies three challenges for computer programs dealing with metaphors. First, the phenomenon of Twice-Apt-Metaphors shows that metaphorical interpretations do not have to be triggered by syntactical, semantic or pragmatic tensions. The detection of these metaphors seems to involve a sense of aesthetic pleasure or a higher-order theory of mind, both of which are difficult to implement into computer programs. Second, the (...) contexts relative to which metaphors are interpreted are not simply given but must be reconstructed based on pragmatic considerations that can involve presuppositional pretence. If computer programs cannot produce or understand such a form of pretence, they will have problems dealing with certain metaphors. Finally, adequately interpreting and reacting to some metaphors seems to require the ability to have internal, first-personal experiential and affective states. Since it is questionable whether computer programs have such mental states, it can be assumed that they will have problems with these kinds of metaphors. (shrink)

What makes two sentences inconsistent? Expressivists understand the meaning of a sentence in terms of the mental state it expresses. In order to explain the inconsistency between two sentences, the expressivist must appeal to some inconsistency feature of the mental states expressed. A simple explanation is that two sentences, e.g., “murder is wrong” and “murder is not wrong” are inconsistent by virtue of expressing mental states that disagree. Schroeder argues that the expressivist lacks a plausible explanation of the disagreement. Baker (...) & Woods argue that Schroeder is wrong. With these authors, I agree that expressivists have an explanation of disagreement, but this does not adequately explain why two sentences are inconsistent. The reason is that two intuitively inconsistent sentences do not necessarily express mental states that disagree. Moreover, assuming that the expressivist gives a structurally identical explanation for moral and non-moral language, the problem generalizes to non-moral language. It is also argued that the problem extends to thought. How expressivists can and should conceive of inconsistency thus remains a challenge. (shrink)

John Austin (1911-1960) è stato uno dei filosofi britannici più influenti del suo tempo, per il rigore del pensiero, la personalità straordinaria e il metodo filosofico innovativo. A parere di John Searle Austin era molto amato e molto odiato dai contemporanei – disorientati da un pensiero che sembrava distruggere più che costruire, sfidare l'ortodossia della filosofia tradizionale ma anche dell'allora imperante empirismo logico, senza sostituirvi nessuna confortante nuova ortodossia. L'opera di Austin è tuttavia oggi poco conosciuta e gli elementi di (...) novità della sua riflessione non sufficientemente apprezzati. Costituiscono un'eccezione due risultati, universalmente riconosciuti e celebrati: da un lato la tecnica di analisi filosofica – quella versione della "filosofia linguistica" praticata da Austin con la pazienza, il rigore e il talento di un entomologo; dall'altro la teoria degli atti linguistici. Austin viene ricordato soprattutto per aver evidenziato la dimensione performativa che permea ogni nostro proferimento: con uno slogan diventato famoso, ogni dire è anche un fare. Una tesi con ripercussioni in aree di ricerca molto diverse, dalla filosofia del linguaggio all'etica, dalla filosofia politica al diritto, dalla linguistica alla filosofia femminista. Ci concentreremo qui sui contributi di Austin alla filosofia del linguaggio, ma faremo cenni anche estesi ai suoi contributi in epistemologia e teoria dell'azione, nonché al vivace dibattito che a partire dalla teoria degli atti linguistici si è sviluppato negli anni '60 e '70. Un dibattito che è tornato ad accendersi in tempi recentissimi nelle discussioni su libertà di espressione e censura. (shrink)

[ENG] The aim of this paper is to analyze the „possibility puzzle” presented by Shapiro (2011) in the context of the debate between conventionalism and non-conventionalism in speech act theory. Conventionalism claims that for every speech act there is a pattern (convention) which determines its illocutionary force. To perform a felicitous speech act is to fulfil necessary and sufficient conditions for this particular speech act. Non-conventionalism criticizes the view that for every speech act there is a conventional pattern and hidden (...) conditions, which are to be fulfilled. This view maintains the conventional thesis for the so-called strict conventional speech acts (e.g. performatives), but negates using universal quantifier for so-called communicative speech acts whose aim is, in short, to express an intention and force someone to act by virtue of this intention. As in (Shapiro 2011), Phil said: in order for someone to have the power to make, change and apply rules, there has to be a rule that empowers someone to do so. This objection concerned „The First Legis- lator” only from the conventional perspective on speech acts. If it can be maintained that The First Legislator’s speech acts may be non-conventional, then Phil’s argument misses the point. Finally, I will emphasize that only lawyers analyze „the very first speech acts” whereas for philosophers, the problem of e.g. „the very first question” is less absorbing. -/- [PL] Celem niniejszego artykułu jest przedstawienie tak zwanej Aporii Phila (possibility puz- zle) przedstawionej przez Shapiro (2011) w kontekście sporu konwencjonalizm–nonkon- wencjonalizm w teorii aktów mowy. Konwencjonalizm utrzymuje, że dla każdego aktu mowy istnieje konwencja, która determinuje moc illokucyjną aktu. Wykonać w pełni for- tunny akt mowy to spełnić wystarczające i konieczne warunki określone dla danego aktu mowy. Nonkonwencjonalizm krytykuje pogląd, że dla każdego aktu mowy istnieje okre- ślona konwencja oraz ukryte warunki, które należy spełnić. Ten pogląd utrzymuje kon- wencjonalną tezę dla tak zwanych stricte konwencjonalnych aktów mowy (na przykład performatywów), ale neguje użycie dużego kwantyfikatora dla tak zwanych komunika- cyjnych aktów mowy, których celem jest, w skrócie, wyrażenie pewnej intencji i zmusze- nie kogoś poprzez jej wyrażenie do określonego postępowania. Phil, bohater historii z książki Shapiro (2011), podkreślił, iż zawsze musi istnieć reguła upoważniająca do two- rzenia prawa. Ten zarzut dotyczący „Pierwszego Legislatora” jest zasadny tylko z per- spektywy konwencjonalizmu. Jeżeli można utrzymywać, że akt mowy Pierwszego Legislatora może być nonkonwencjonalny, wtedy argument Phila jest nietrafny. Na końcu scharakteryzowany jest następujący fenomen: tylko prawnicy analizują „pierwsze akty mowy”, natomiast dla filozofów problem „pierwszego pytania” nie jest tak absorbujący. (shrink)

In this paper, I will critically assess the expressive justification of punishment recently offered by Christopher Bennett in The Apology Ritual and a number of papers. I will first draw a distinction between three conceptions of expression: communicative, motivational, and symbolic. After briefly demonstrating the difficulties of using the first two conceptions of expression to ground punishment and showing that Bennett does not ultimately rely on those two conceptions, I argue that Bennett’s account does not succeed because he fails to (...) establish the following claims: punishment is the only symbolically adequate response to a wrongdoing; and punishment is permissible if it is the only symbolically adequate response to a wrongdoing. My paper reflects on the debate about reasons for action and action explanations between Wittgensteinian teleological approaches and causalist theories inspired by Davidson. After a brief discussion of similarities and differences in the philosophy of language, I sketch the prehistory and history of the controversy. I show that the conflict between Wittgenstein and Davidson revolves neither around revisionism nor around naturalism. Even in the philosophy of mind and action, Davidson is not as remote from Wittgenstein and his followers as is (...) commonly assumed: there are numerous points of contact of both a biographical and a substantive kind. The real conflict concerns the difference between Davidson’s official subjectivist approach to reasons for action, according to which they are mental states of believing and desiring on the one hand, and an objectivist approach, according to which reasons for action are what is believed or desired, non-mental facts or states of affairs. This paper aims to explain Henry of Ghent's views on what kind of language is appropriate in theology, and why. It concentrates on a number of questions of the Summa quaestionum ordinariarum , which are devoted to his take on how theologians should explain their discipline to students, and to the meaningfulness in general of theological language. The paper delves into the technical terms sensus and insinuare , and compares Henry's account with H.P. Grice's views on (speaker-)meaning and his notion (...) of `conversational implicatures', thus showing that Henry emphasises the performative features of linguistic use. (shrink)
