  1. "Epistemic Reparations and the Right to Be Known".Jennifer Lackey - 2022 - Proceedings and Addresses of the American Philosophical Association 96:54-89.
This paper provide the first extended discussion in the philosophical literature of the epistemic significance of the phenomenon of “being known” and the relationship it has to reparations that are distinctively epistemic. Drawing on a framework provided by the United Nations of the “right to know,” it is argued that victims of gross violations and injustices not only have the right to know what happened, but also the right to be known—to be a giver of knowledge to others about their (...)

Reprinted with modification and permission from Kennedy Institute of Ethics Journal. The phenomenon of medical overtesting in general, and specifically in the emergency room, is well-known and regarded as harmful to both the patient and the healthcare system. Although the implications of this problem raise myriad ethical concerns, this chapter explores the extent to which overtesting might mitigate race-based health inequalities. Given that medical malpractice and error greatly increase when the patients belong to a racial minority, it is no surprise (...)

  • Overcoming the Original Sin of the “Original Condition:” How Reparations May Contribute to Emancipatory Peacebuilding.Roddy Brett & Lina Malagon - 2013 - Human Rights Review 14 (3):257-271.
This short article explores the relationship between transitional justice mechanisms and peacebuilding by analysing the role that reparations may play in transforming or deepening conflict. Research seeks to identify potential components of an emancipatory approach to peacebuilding through the prioritisation of ‘transformative reparations’ processes, framing this proposal within the case study of collective reparations to the trade union movement in Colombia.

Wiesbaden, Deutschland: Springer Fachmedien. pp. 141-166.

  • Backward-looking reparations and structural injustice.Maeve McKeown - 2021 - Contemporary Political Theory 20 (4):771-794.
The ‘structural injustice’ framework is an increasingly influential way of thinking about historical injustice. Structural injustice theorists argue against reparations for historical injustice on the grounds that our focus should be on forward-looking responsibility for contemporary structural injustice. Through the use of a case study – the Caribbean Community 10-Point Plan for reparations from 2014 – I argue that this reasoning is flawed. Backward-looking reparations can be justified on the basis of state liability over time. The value of backward-looking reparations (...)

  • Is Rawls's theory of justice exclusively forward-looking?

This essay seeks to understand the domain and demands of reparative justice in terms of moral vulnerability. Significant harms raise the question of whether victims stand in truly reciprocal practices of accountability; if they do, they enjoy the power of calling others to account as well as bearing the liability of being accountable to others. In the aftermath of harms, victims’ moral vulnerability is tested: they may be exposed to the insult and injury of discovering that they do not enjoy (...)

  • Reconciling Historical Injustices: Deliberative Democracy and the Politics of Reconciliation. [REVIEW]Bashir Bashir - 2012 - Res Publica 18 (2):127-143.
Deliberative democracy is often celebrated and endorsed because of its promise to include, empower, and emancipate otherwise oppressed and excluded social groups through securing their voice and granting them impact in reasoned public deliberation. This article explores the ability of Habermas’ theory of deliberative democracy to accommodate the demands of historically excluded social groups in democratic plural societies. It argues that the inclusive, transformative, and empowering potential of Habermas’ theory of deliberative democracy falters when confronted with particular types of historical (...)

The aim of this article is to discuss the role that victim groups and organizations may have in framing and supporting an accountability agenda, as well as their potential for endorsing a distributive justice agenda. The article explores two empirical cases where victims' rights have been introduced and applied by victim organizations to promote accountability—Colombia and Peru. It will be argued that if transitional justice in general and victim reparations in particular are to embark in a quest for distributive justice, (...)
