To have free will is to have what it takes to act freely. When an agent acts freely—when she exercises her free will—what she does is up to her. A plurality of alternatives is open to her, and she determines which she pursues. When she does, she is an ultimate source or origin of her action. So runs a familiar conception of free will.

It is widely thought that, to be morally responsible for some action or omission, an agent must have had, at the very least, the general ability to do otherwise. As we argue, however, there are counterexamples to the claim that moral responsibility requires the general ability to do otherwise. We present several cases in which agents lack the general ability to do otherwise and yet are intuitively morally responsible for what they do, and we argue that such cases raise problems (...) for various kinds of accounts of moral responsibility. We suggest two alternative approaches to thinking about the connection between moral responsibility and abilities to do otherwise, one of which denies that there is any ability-to-do-otherwise requirement on moral responsibility and the other of which requires only an opportunity to do otherwise. We also argue that a general-ability-to-do-otherwise requirement not only faces counterexamples but also lacks positive motivation. (shrink)

Nearly all defences of the agent-causal theory of free will portray the theory as a distinctively libertarian one — a theory that only libertarians have reason to accept. According to what I call ‘the standard argument for the agent-causal theory of free will’, the reason to embrace agent-causal libertarianism is that libertarians can solve the problem of enhanced control only if they furnish agents with the agent-causal power. In this way it is assumed that there is only reason to accept (...) the agent-causal theory if there is reason to accept libertarianism. I aim to refute this claim. I will argue that the reasons we have for endorsing the agent-causal theory of free will are nonpartisan. The real reason for going agent-causal has nothing to do with determinism or indeterminism, but rather with avoiding reductionism about agency and the self. As we will see, if there is reason for libertarians to accept the agent-causal theory, there is just as much reason for compatibilists to accept it. It is in this sense that I contend that if anyone should be an agent-causalist, then everyone should be an agent-causalist. (shrink)

A familiar feature of our moral responsibility practices are pleas: considerations, such as “That was an accident”, or “I didn’t know what else to do”, that attempt to get agents accused of wrongdoing off the hook. But why do these pleas have the normative force they do in fact have? Why does physical constraint excuse one from responsibility, while forgetfulness or laziness does not? I begin by laying out R. Jay Wallace’s (Responsibility and the moral sentiments, 1994 ) theory of (...) the normative force of excuses and exemptions. For each category of plea, Wallace offers a single governing moral principle that explains their normative force. The principle he identifies as governing excuses is the Principle of No Blameworthiness without Fault: an agent is blameworthy only if he has done something wrong. The principle he identifies as governing exemptions is the Principle of Reasonableness: an agent is morally accountable only if he is normatively competent. I argue that Wallace’s theory of exemptions is sound, but that his account of the normative force of excuses is problematic, in that it fails to explain the full range of excuses we offer in our practices, especially the excuses of addiction and extreme stress. I then develop a novel account of the normative force of excuses, which employs what I call the “Principle of Reasonable Opportunity,” that can explain the full range of excuses we offer and that is deeply unified with Wallace’s theory of the normative force of exemptions. An important implication of the theory I develop is that moral responsibility requires free will. (shrink)

Seemingly one of the most prominent issues that divide theorists about free will and moral responsibility concerns whether the ability to do otherwise is necessary for freedom and responsibility. I defend two claims in this paper. First, that this appearance is illusory: everyone thinks an ability to do otherwise is necessary for freedom and responsibility. The central issue is not whether the ability to do otherwise is necessary for freedom and responsibility but which abilities to do otherwise are necessary. Second, (...) I argue that we cannot determine which abilities are necessary until we have determined the nature and justification of moral responsibility. Thus, theorizing about moral responsibility ought to take pride of place in theorizing about free will. (shrink)

Anscombe’s “Causality and Determination” is often cited in the contemporary free will debate, but rarely discussed in much detail. It’s main contribution, it is thought, is the defense of an alternative to deterministic causation, thus clearing the way for an incompatibilist analysis of free actions in terms of probabilistic causation. However, in this paper I will show that the contemporary probabilistic analysis of free action actually stands in direct conflict with Anscombe’s lecture. Instead, I will argue, its true value for (...) incompatibilist accounts of free will lies in Anscombe’s thought that there are various fundamentally different kinds of causality. This variety, I argue, allows for a revised conception indeterminism and an understanding of free will as the manifestation of a particular sort of agent-causal power. (shrink)

The terms ‘compatibilism’ and ‘incompatibilism’ were introduced in the mid-20th century to name conflicting views about the logical relationship between the thesis of determinism and the thesis that someone has free will. These technical terms were originally introduced within a specific research paradigm, the classical analytic paradigm. This paradigm is now in its final stages of degeneration and few free-will theorists still work within it (i.e. using its methods, granting its substantive background assumptions, etc.). This chapter discusses how the ambiguity (...) of the terms ‘incompatibilism’ and ‘compatibilism’ took root as the classical analytic paradigm declined and why this matters to the contemporary debate. Among other things, I explain why the ambiguity of these anachronistic terms, though relatively innocuous when they were first introduced, is now encouraging theorists to tolerate and perpetuate serious philosophical errors (e.g. to conflate relations as different in kind and importance as correlation and causation, to promote uncontentiously invalid arguments, and to equivocate in ways that keep the free-will debate mired in pseudo-stalemates). I also suggest a new framework for anyone looking for relief from the confusion and deadlock created by quixotic attempts to redefine classical narratives and jargon so that they adequately describe the dialectical contours of the contemporary free-will debate. In addition, this new framework allows philosophers to start cross-pollinating work on free will and other famous problems of luck and control, e.g. the paradox of moral luck. Libertarians in the contemporary free will debate find themselves under attack from two angles. They face the challenge of defending the necessity of indeterminism for freedom against the philosophical mainstream position of compatibilism. And second, they are increasingly forced to argue for the very possibility of indeterministic free will, in the face of the so-called luck objection. Many contemporary libertarians try to overcome the second problem by adopting the causal theory of action. We argue that this move at the same (...) time undermines their ability to answer the first challenge. On the basis of this, we suggest that CTA might be a theory of action that is biased towards compatibilism. We thus argue that the best strategy for the libertarian is to insist that intentional action itself requires indeterminism. Recent agent-causal accounts offer a promising way of developing such an alternative libertarianism, but we argue that they currently suffer from problems similar to the ones we identify for the event-causalist. If we are correct, then this has an important implication for the contemporary free will debate: action theory should take centre stage. (shrink)

The Luck Problem has existed in one form or another since David Hume, at least. It is perhaps as old as Stoic objections to the Epicurean swerve. Although the general issue admits of different formulations with subtly different emphases, the characterization of it that will serve as my target focuses on “cross-worlds” luck, a kind of luck that arises when the decision-making of agents is indeterministic.

I motivate a dilemma to show that nothing can be obligatory for anyone regardless of whether determinism or indeterminism is true. The deterministic horn, to which prime attention is directed, exploits the thesis that obligation requires freedom to do otherwise. Since determinism precludes such freedom, it precludes obligation too. The indeterministic horn allows for freedom to do otherwise but assumes the burden of addressing whether indeterministically caused choices or actions are too much of a matter of luck to be obligatory (...) for anyone. I critically discuss a response to the deterministic horn that invokes the distinction between alternatives compatible with determinism and those incompatible with determinism. (shrink)

Seth Shabo has presented a new argument that attempts to codify familiar worries about indeterminism, luck, and control. His ‘Assimilation Argument’ contends that libertarians cannot distinguish overtly randomized outcomes from exercises of free will. Shabo claims that the argument possesses advantages over the Mind Argument and Rollback Argument, which also purport to establish that indeterminism is incompatible with free will. I argue first that the Assimilation Argument presents no new challenges over and above those presented by the Rollback Argument, and (...) second that the Rollback Argument itself neither presents a deep challenge to, nor raises the cost of, accepting libertarianism. Libertarianism has, seemingly, always been in disrepute among philosophers. While throughout history philosophers have offered different reasons for their dissatisfaction with libertarianism, one worry is recurring: namely a worry about luck. To many, it seems that if our choices and actions are undetermined, then we cannot control them in a way that allows for freedom and responsibility. My fundamental aim in this paper is to place libertarians on a more promising track for formulating a defensible libertarian theory. I begin by (...) arguing that Robert Kane's influential formulation of libertarianism actually generates an acute worry about luck, showing specifically that Kane's recipe for solving the problem of luck and his attendant conception of the location and role of indeterminism derived from it are deeply problematic. I then offer a reformulation of libertarianism ? particularly a new conception of the location and role of indeterminism ? that is capable of avoiding the problems that beset Kane's theory and that, I argue, places libertarians on a more promising track for formulating a defensible theory. The Assimilation Argument purports to show that libertarians cannot plausibly distinguish supposed exercises of free will from random outcomes that nobody would count as exercises of free will. If this argument is sound, libertarians should either abandon their position or else concede that free will is a mystery. Drawing on a parallel with the Manipulation Argument against compatibilism, Christopher Franklin has recently contended that the Assimilation Argument is unsound. Here I defend the Assimilation Argument and the Rollback Argument, a second (...) challenge to libertarianism that Franklin rejects. My aim in doing so is to underscore the force of these challenges, and thereby to resist what appears to be an emerging trend in the literature. By not coming to grips with the kind of power that libertarians must secure, many writers have recently downplayed or dismissed the pressing worry for libertarianism. (shrink)

The new dispositionalists defend the position that an agent in a deterministic Frankfurt-style case has the ability to do otherwise, where that ability is the one at issue in the principle of alternative possibilities. Focusing specifically on Kadri Vihvelin's proposal, I argue against this position by showing that it is incompatible with the existence of structurally similar cases to FSCs in which a preemptive intervener bestows an agent with an ability.

The problem of luck is advanced and defended against libertarian theories of responsibility-enabling ability. An outline of an account of ability is articulated to explore some features of the sort of ability moral responsibility requires. The account vindicates the luck objection and suggests a novel puzzle: Libertarianism is structurally barred from answering the problem of luck because responsibility requires, but inherently lacks, an explanation from reason states to actions that preserves reliability of connection between responsibility-grounding reasons-sensitivity and action.

This article clarifies the Buddhist position on freedom and responsibility, while arguing for three central claims. The first is that it is an open question whether Buddhists endorse causal determinism or causal indeterminism. The second claim is that the most promising contemporary interpretations of the Buddhist view fail in important respects. The final claim is that the best interpretation of the Buddhist position on freedom and responsibility is Buddhist Perspectivalism, the view that we should view ourselves as genuinely free and (...) responsible, while viewing others as neither free nor responsible. Since our moral and legal judgments are focused on our decisions and actions, one would expect information about the neural underpinnings of human decision-making and action-production to have a significant bearing on those judgments. However, despite the wealth of empirical data, and the public attention it has attracted in the past few decades, the results of neuroscientific research have had relatively little influence on legal practice. It is here argued that this is due, at least partly, to the discussion on (...) the relationship of the neurosciences and law mixing up a number of separate issues that have different relevance on our moral and legal judgments. The approach here is hierarchical; more and less feasible ways in which neuroscientific data could inform such judgments are separated from each other. The neurosciences and other physical views on human behavior and decision-making do have the potential to have an impact on our legal reasoning. However, this happens in various different ways, and too often appeal to any neural data is assumed to be automatically relevant to shaping our moral and legal judgments. Our physicalist intuitions easily favor neural-level explanations to mental-level ones. But even if you were to subscribe to some reductionist variant of physicalism, it would not follow that all neural data should be automatically relevant to our moral and legal reasoning. However, the neurosciences can give us indirect evidence for reductive physicalism, which can then lead us to challenge the very idea of free will. Such a development can, ultimately, also have repercussions on law and legal practice. (shrink)

Hobart’s classic 1934 paper “Free Will as Involving Determination and Inconceivable Without It” has been widely cited as an example of an argument for the view that free will requires the truth of determinism. In this paper, I argue that this reading of Hobart’s paper is mistaken and that we should instead read Hobart as arguing that an agent exercises their free will only if the proximate causes of the agent’s action deterministically cause their action. After arguing that Hobart’s view, (...) rightly understood, escapes the problems typically raised for Hobart’s compatibilism, I also argue that Hobart’s view is problematic for different reasons. Nevertheless, I argue that there is a crucial insight to be gleaned from Hobart’s paper—one that provides compatibilists with a new recipe for challenging libertarian accounts of free will. (shrink)

In my paper ‘Three Forms of Internalism and the New Evil Demon Problem,’ I argued that the new evil demon problem, long considered to be one of the biggest obstacles for externalism, is also a problem for virtually all internalists. In (McCain 2014a) and in his recent book (McCain 2014b), Kevin McCain provides a challenging and thought provoking reasons for thinking that many internalists do not have any such problem. In this paper, I’ll provide some replies to McCain. Of note, (...) I’ll show that a Frankfurt-style counterfactual intervener, who commonly appears in the free will literature, can also serve as a new evil demon in the epistemology literature. (shrink)

Neuroscientists have located brain activity that prepares or encodes action plans before agents are aware of intending to act. On the basis of these findings and broader agency research, activity in these regions has been proposed as the neural realizers of practical intention. My aim in this paper is to evaluate the case for taking these neural states to be neural representations of intention. I draw on work in philosophy of action on the role and nature of practical intentions to (...) construct a framework of the functional profile of intentions fit for empirical investigation. With this framework, I turn to the broader empirical neuroscience literature on agency to assess these proposed neural representations of intention. I argue that while these neural states in some respects satisfy the functions of intention in planning agency prospective of action, their fit with the role of intention in action execution is not well supported. I close by offering a sketch of which experimental task features could aid in the search for the neural realizer of intention in action. (shrink)

I want to suggest that it would be bad if compatibilism were true, and that this gives us good reason to think that it isn't. This is, you might think, an outlandish argument, and the considerable burden of this paper is to convince you otherwise. There are two key elements at stake in this argument. The first is that it would be ‐ in a distinctive sense to be explained ‐ bad if compatibilism were true. The thought here is that (...) compatibilism ultimately presents us with a picture on which, in principle, powerful manipulators can effectively guarantee that finite moral agents should become blameworthy. To my mind, this isn't just false ‐ though I think that it is ‐ it is also such that it would be bad (unfortunate, undesirable…) if it were true. The second is that the fact that it would be ‐ in this sense ‐ bad if true gives us reason to think that it isn't. It may be bad that there is no afterlife. But that, in itself, hardly gives us reason to think that there is an afterlife. That is true, but ‐ as others before me have suggested ‐ when the object of the relevant badness is morality itself, the inference seems secure. A more general aim of the paper is to investigate the nature of this very form of argument in itself, and I compare my argument (inter alia) to a recent argument from Sayre–McCord against the possibility of genuine moral dilemmas. It is widely believed that an agent can be morally responsible for something only if they were able to do otherwise. But what kind of ability to do otherwise is needed? Despite the obvious disagreements, incompatibilist and compatibilist leeway theorists tend to agree that, at the very least, an agent needs the ‘general’ ability to do otherwise. Cyr and Swenson [Cyr, T. W., and P. Swenson. 2019. “Moral Responsibility Without General Ability.” The Philosophical Quarterly 69/274: 22–40. https://doi.org/10.1093/pq/pqy034.] offer a series (...) of putative counterexamples to this thesis. Using their discussion as a jumping off point, I distinguish between two ways in which an ability can be general. I argue that these two types of generality – and the corresponding types of non-generality – are orthogonal and that therefore the question ‘Does moral responsibility require the general ability to do otherwise?’ needs precisifying. In failing to distinguish the two types of generality, Cyr and Swenson’s discussion comes to erroneous conclusions. I show that the ability to do otherwise only needs to be general in one of the ways identified. I also argue that the granularity of description employed in characterising the ability to do otherwise and the granularity of description employed in ascribing responsibility need not match in order for an agent to be morally responsible. The brain disease model of addiction is widely endorsed by agencies concerned with treating behavioral disorders and combatting the stigma often associated with addiction. However, both its accuracy and its effectiveness in reducing stigma have been challenged. A proposed alternative, the “choice” model, recognizes the residual rational behavior control capacities of addicted individuals and their ability to make choices, some of which may cause harm. Since harmful choices are ordinarily perceived as blameworthy, the choice model may inadvertently help justify stigma. (...) This paper seeks to fully naturalize the choice model by highlighting the determinants of voluntary action and thus increase its potential for destigmatizing addiction. In light of a deterministic understanding of behavior, it is unreasonable to suppose that addicted individuals could have made different choices in becoming addicted and in subsequent situations. To the extent that stigma is motivated by the supposition that addicted individuals could have chosen otherwise in actual situations, a deterministic understanding of addictive behavior promises to mitigate blame and stigma. This paper offers a novel interpretation of Descartes's conception of freedom that resolves an important tension at the heart of his view. It does so by appealing to the important but overlooked distinction between possessing a power, exercising a power, and being in a position to exercise a power.

Assuming that an agent can be morally responsible for her forgetting to do something, we can use recent psychological research on prospective memory to assess the psychological assumptions made by normative accounts of the moral responsibility for forgetting. Two accounts of moral responsibility (control accounts and valuative accounts) have been prominent in recent debates about the degree to which agents are blameworthy for their unwitting omissions. This paper highlights the psychological assumptions concerning remembering and forgetting that characterise the accounts. The (...) paper then introduces and reviews recent empirical literature on prospective memory. Finally, it uses the literature to assess the various assumptions. One important implication is that a direct capacitarian control account implies implausible assumptions about the psychological capacity for remembering. A second important implication is that an indirect capacitarian control account and a valuative account highlight different but complementary aspects of remembering and forgetting. (shrink)

Libertarian views of freedom claim that, although determinism would rule out our freedom, we are nevertheless free on some occasions. An odd implication of such views (to put it mildly) seems to be that indeterminism somehow enhances or contributes to our agency. But how could that be? What does indeterminism have to offer agency? This paper develops a novel answer, one that is centred around the notion of explanation. In short, it is argued that, if indeterminism holds in the right (...) places, then the best explanation of the history of the world necessarily cites facts about our agency. Along the way, alternative proposals regarding the significance of indeterminism are considered and, ultimately, rejected in favour of the one developed in this paper. (shrink)

The issue of whether and how we have the control necessary for freedom and moral responsibility is central to all control accounts of freedom and moral responsibility. The problem of luck for libertarians aims to show that indeterministic agents are ill‐equipped with the control required for freedom and moral responsibility. In view of this, we must either endorse scepticism about the possibility of free and morally responsible agents, or make some form of, possibly revisionary, compatibilism work.In this paper, I shall (...) offer a new solution to the problem of luck for libertarians. After outlining the problem of luck, I shall argue that, given a particular approach to mental causation, indeterminism can be viewed as an essential requirement of free and morally responsible action. After this, I shall distinguish between different types of inability and show how this provides us with a solution to the problem of luck. Finally, I shall consider some advantages and objections to the proposed solution. (shrink)

If indeterminism is to be necessary for moral responsibility, we must show that it doesn’t preclude responsibility (the Luck Problem) and that it might enhance it (the Enhancement Problem). A ‘strong luck claim’ motivates the Luck Problem: if an agent’s choice is undetermined, then her mental life will be causally irrelevant to her choice, whichever way she decides. A ‘weak luck claim’ motivates the Enhancement Problem: if an agent’s choice is undetermined, then even if her mental life is causally relevant (...) to her choice, whichever way she decides, we cannot explain how she _settles_ her choice. Only the weak luck claim is plausible. However, its plausibility depends on our accepting that we could only settle our choices if they are settled by additional exercises of agency. If we instead understand the process of settling decisions in procedural terms, we can begin to sketch a solution to the Enhancement Problem. (shrink)

The aim of this paper is to challenge libertarian accounts of free will. It is argued that there is an irreconcilable tension between the way in which philosophers motivate the incompatibilist ability to do otherwise and the way in which they formally express it. Potential incompatibilist responses in the face of this tension are canvassed, and it is argued that each response is problematic. It is not claimed that incompatibilist accounts in general are incoherent, but rather that any incompatibilist account (...) that requires that an agent have alternative possibilities at the point of a free action fails. I offer a brief review of, and critical response to, Neil Levy’s fascinating recent book Hard Luck, where he argues that no one is ever free or morally responsible not because of determinism or indeterminism, but because of luck. Two of Levy’s central arguments in defending his free will nihilism concern the nature and role of explanation in a theory of moral responsibility and the nature of akrasia. With respect to explanation, Levy argues that an adequate theory of moral responsibility (...) must be able provide contrastive explanations of why an agent performs one action rather than another, and that libertarians lack the resources to provide such explanations. With respect to akrasia, Levy argues that it is impossible to be directly morally responsible for akratic actions. In response I argue that any sense of contrastive explanation that can reasonably be thought to be a requirement on an adequate theory of moral responsibility is a sense that agent-causal libertarians can secure. I then argue that the agent-causal theory of free will offers an alternative and attractive understanding of motivation and self-control that makes it plausible to think that we can be morally responsible for akratic actions.
