En este artículo se debaten tres aspectos del concepto de la moral: el primero se refiere a la puesta en duda de la existencia misma, no sólo del concepto sino de la posible o imposible fundamentación de lo moral per se. En segundo lugar, la positivización del término llevado a lo normativo como una búsqueda de objetividad de lo moral y, el tercer aspecto, la crítica a la moral imperativa desde posturas dogmáticas. Se defiende que no es suficiente la perfectibilidad (...) de las leyes desde un punto de vista de la moralidad, sino que existe lo que podríamos llamar un fundamento personal, y al mismo tiempo, colectivo de comprensión del Derecho; entendido como el bienestar individual y colectivo para la realización de una vida plena en la polis. La moralidad, por tanto, si bien no es posible definirla en modo explicativo, racional, necesita de una base en valores compartidos con aspiraciones objetivistas y, al mismo tiempo, universalistas. All societies have to balance privacy claims with other moral concerns. However, while some concern for privacy appears to be a common feature of social life, the definition, extent and moral justifications for privacy differ widely. Are there better and worse ways of conceptualising, justifying, and managing privacy? These are the questions that lie in the background of this thesis. -/- My particular concern is with the ethical issues around privacy that are tied to the rise of new information and (...) communication technologies (henceforth “ICT”). The focus here is on technologies involved in processing personal data in its broadest sense, including “any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.” The issue of moral concern is commonly designated as that of 'data privacy'. -/- The first step is to consider why privacy matters, or ought to matter, in the first place. And here we run into our first difficulty, since both the conceptualisation of privacy and the justification for the right to privacy are matters for contention. On the one hand, we are animated by a moral concern for privacy in some sense; on the other, we lack the conceptual and moral resources for making sense of this concern or for promoting particular social policies and criticising others. This often-cited dichotomy and its ensuing confusion have been the central motivation for most of the philosophical literature on privacy – including this thesis. -/- In what follows, I will suggest a way out of the confusion that pervades the current debate on data privacy. I will essentially argue two claims: one, that the concept of (data) privacy is uniquely characterised by a particular context within which we exchange information; two, that because (data) privacy constitutes an intrinsic value, its moral concerns and justifications ought to be deliberated as such. -/- The first chapter sketches the current data privacy landscape by introducing a number of concepts and arguing the unique nature of the landscape. I argue that the traditional distinction between four kinds of privacy (physical, mental, decisional and informational) is no longer accurate, given the technological context that reduces, unifies and processes all aspects of people’s lives by means of digital data. In fact, to hold on to the distinction leads to a fundamental misconception of data privacy. I further argue that today’s distinction between data protection and data privacy runs the risk of ignoring the fact that the former is an inherent aspect of the latter. These arguments allow me to settle on a (provisional) definition of data privacy: controlling how data about identifiable people is processed by ICT. -/- Next, I draw a line between descriptive and normative accounts of data privacy, and explain why this book belongs to the latter category. After a brief discussion of the coherence and distinctiveness theses, and of the difference between instrumental and intrinsic theories of privacy, I introduce the problem of data privacy as a distinct, coherent, and intrinsic moral concern. Three arguments support this position: one, data privacy is a coherent moral concern because it is motivated by a singular moral concept; two, data privacy is a distinct moral concern because the privacy challenges we face today are of a fundamentally new nature – distinct from any moral concerns we’ve faced in the past; and three, data privacy is an intrinsic moral concern that is predominantly justified, not by what it instrumentally protects us from, but by what it intrinsically constitutes. -/- Chapter Two makes the case against a harm-based, consequentialist approach to data privacy. After a brief introduction to the basic tenets of consequentialism I discuss harm-based arguments in favour as well as against privacy. I explain how privacy may protect us against psychological distress, but at the same time constitute the source of that distress; how privacy may be necessary for the proper functioning of democratic societies, but at the same time provide a cloak for anti-social and immoral behaviour; and how privacy protects us against the improper use of our personal data by others, but at the same enables us to conceal information or spread false information about ourselves in ways that are harmful to others. Next, I argue that consequentialism essentially relies on two flawed presumptions – that we know what harm is, and that we know how to predict it – and discuss the controversies surrounding definitions and predictions of harm. This argument becomes especially pertinent in today’s rapidly changing technological context: we may guess, and make assumptions, perhaps even find correlations, but don’t really know or understand (yet) with any degree of certainty the harmful consequences today’s data privacy violations are causing or will eventually cause – if any. -/- I illustrate this with examples of recent data privacy violations, and with a brief overview of consequentialist arguments for and against data privacy. Those who invoke consequentialist arguments against data privacy claim that personal data is nothing more than a raw material that can be turned into something useful and valuable without harming anyone. Choosing to move fast and break things – a popular mantra that promotes the benefits of technological “permissionless innovation” over and above its risks and costs – they draw our attention to the many benefits free data flows generate. Those who rely on consequentialist arguments in favour of data privacy, on the other hand, insist on actual and potential misuse of personal data. Rather careful than sorry, they draw our attention to the urgent need to take back control and protect ourselves against data privacy violations – precisely because we don’t know which harm they may cause in the future. Others go one step further and argue that these violations are part of a broader ideology of power. -/- What Chapter Two demonstrates is that vague definitions, unreliable predictions and inconclusive allegations of harm from both sides of the debate perpetuate a stalemate that fails to produce morally defensible answers to our growing data privacy concerns. Deliberating about data privacy from a consequentialist perspective is a dead end. -/- Chapter Three proposes an alternative to the harm-based approach, namely that privacy is an intrinsic value that deserves moral protection for its own sake. After a brief account of what I take values to be, and why we have a need to protect them, I introduce the foundational value of respect for persons, and lay out my main argument in two steps. The conceptual component of my argument returns to the definition of data privacy I had temporarily settled on in Chapter One, but now with the added consideration of the particular context, and particular circumstances and attitudes, within which information is exchanged. This addition is crucial, as it reveals the fundamental value that is at stake in our data privacy concerns, namely the inherent value of each and every person, which we protect by upholding an ethical principle commonly known as the principle of respect for persons. It is for this reason that the violation of privacy cannot (only) be expressed in terms of harm. I further argue that the principle of respect for persons is consistent with, and in fact unthinkable without, some degree of privacy. -/- I reply to potential challenges to a value-based approach to data privacy by showing that (i) values and value trade-offs are fundamentally different from consequential benefits and cost-benefit analyses; (ii) the suspension of one value in favour of another is not inherently contradictory; what matters is morally defensible deliberation about values and valid individual consent; (iii) data privacy concerns cannot be reduced to other moral concerns and therefore deserve a specific, distinct protection. -/- Finally, because this is a thesis in applied ethics, I attempt an answer to the question as to how we ought to apply a value-based approach to practical data privacy concerns. I argue that a revised, three-pronged version of John Rawls’ reflective equilibrium, founded on the non-negotiable principle of respect for persons, is the best possible procedure to deliberate data privacy concerns in relation to other moral values. The dominant theory of the evolution of moral cognition across a variety of fields is that moral cognition is a biological adaptation to foster social cooperation. This chapter argues, to the contrary, that moral cognition is likely an evolutionary exaptation: a form of cognition where neurobiological capacities selected for in our evolutionary history for a variety of different reasons—many unrelated to social cooperation—were put to a new, prosocial use after the fact through individual rationality, learning, and the development and transmission (...) of social norms. This chapter begins with a brief overview of the emerging behavioral neuroscience of moral cognition. It then outlines a novel theory of moral cognition that I have previously argued explains these findings better than alternatives. Finally, it shows how the evidence for this theory of moral cognition and human evolutionary history together suggest that moral cognition is likely not a biological adaptation. Instead, like reading sheet music or riding a bicycle, moral cognition is something that individuals learn to do—in this case, in response to sociocultural norms created in our ancestral history and passed down through the ages to enable cooperative living. The creation of artificial moral systems requires us to make difficult choices about which of varying human value sets should be instantiated. The industry-standard approach is to seek and encode moral consensus. Here we argue, based on evidence from empirical psychology, that encoding current moral consensus risks reinforcing current norms, and thus inhibiting moral progress. However, so do efforts to encode progressive norms. Machine ethics is thus caught between a rock and a hard place. The problem is particularly acute when (...) progress beyond prevailing moral norms is particularly urgent, as is currently the case due to the inadequacy of prevailing moral norms in the face of the climate and ecological crisis. This paper makes the case for a revision of contemporary forms of political realism in political theory. I argue that contemporary realists have gone awry in increasingly centring their approach around a metaethical claim: that political theory should be rooted in a political form of normativity that is distinct from moral normativity. Several critics of realism have argued that this claim is unconvincing. But I suggest that it is also a counterintuitive starting point for realism, and one unnecessary to avoid (...) the ‘applied morality’ approach to political theory that realists oppose. Instead, realism should be methodologically orientated around what I term ‘empirically constitutive political realities’ - enduring features of real political contexts that are systematically consequential in their normative implications. Realists can persuasively argue that such empirically constitutive political realities must be attended to in political theory-building, and not merely treated as a context in which independently formulated moral theories are simply applied. This framing of realism accords real politics a genuinely foundational theoretical role, but without requiring any contentious metaethical stance about a non-moral political normativity. I explain some methodological implications that follow for realism – in particular the need to prioritise empirically grounded theorisation of real political contexts over abstract and rather essentialist claims about ‘the political’. I also argue that such a framing of realism helps engender a more accurate, less divisive, and more pluralist conception of methodological debates within political theory. (shrink)

I propose a framework, derived from moral theory, for assessing the moral status of intelligent machines. Using this framework, I claim that some current and foreseeable intelligent machines have approximately as much moral status as plants, trees, and other environmental entities. This claim raises the question: what obligations could a moral agent (e.g., a normal adult human) have toward an intelligent machine? I propose that the threshold for any moral obligation should be the "functional morality" of Wallach and Allen [20], (...) while the upper limit of our obligations should not exceed the upper limit of our obligations toward plants, trees, and other environmental entities. What is the significance of empirical moral psychology for metaethics? In this article we take up Michael Ruse’s evolutionary debunking argument against moral realism and reassess it in the context of the empirical state of the art. Ruse’s argument depends on the phenomenological presumption that people generally experience morality as objective. We demonstrate how recent experimental findings challenge this widely-shared armchair presumption and conclude that Ruse’s argument fails. We situate this finding in the recent debate about Carnapian explication and argue (...) that it illustrates the necessary role that empirical moral psychology plays in explication preparation. Moral psychology sets boundaries for reasonable desiderata in metaethics and, therefore, it is necessary for metaethics. (shrink)

The VIA Inventory of Strengths and the VIA model were originally developed to assess and study 24 character strengths. In this paper, I discuss how the VIA Inventory and its character strength model can be applied to the field of moral education with moral philosophical considerations. First, I review previous factor analysis studies that have consistently reported factors containing candidates for moral virtues, and discuss the systematic structure and organization of VIA character strengths. Second, I discuss several issues related to (...) the VIA model, including a lack of previous studies that directly support the moral justifiability of the model and the presence of a fundamental virtue component required for optimal moral functioning in virtue ethics, phronesis, practical wisdom, in the model. Finally, I propose future directions for research on the VIA model in order to address the aforementioned issues and facilitate the application of the model in moral education. (shrink)

Empirical studies of the social lives of non-human primates, cetaceans, and other social animals have prompted scientists and philosophers to debate the question of whether morality and moral cognition exists in non-human animals. Some researchers have argued that morality does exist in several animal species, others that these species may possess various evolutionary building blocks or precursors to morality, but not quite the genuine article, while some have argued that nothing remotely resembling morality can be found in any non-human species. However, these different positions on animal morality generally appear to be motivated more by different conceptions of how the term “morality” is to be defined than by empirical disagreements about animal social behaviour and psychology. After delving deeper into the goals and methodologies of various of the protagonists, I argue that, despite appearances, there are actually two importantly distinct debates over animal morality going on, corresponding to two quite different ways of thinking about what it is to define “morality”, “moral cognition”, and associated notions. Several apparent skirmishes in the literature are thus cases of researchers simply talking past each other. I then focus on what I take to be the core debate over animal morality, which is concerned with understanding the nature and phylogenetic distribution of morality conceived as a psychological natural kind. I argue that this debate is in fact largely terminological and non-substantive. Finally, I reflect on how this core debate might best be re-framed. (shrink)

Moralization is a social-psychological process through which morally neutral issues take on moral significance. Often linked to health and disease, moralization may sometimes lead to good outcomes; yet moralization is often detrimental to individuals and to society as a whole. It is therefore important to be able to identify when moralization is inappropriate. In this paper, we offer a systematic normative approach to the evaluation of moralization. We introduce and develop the concept of ‘mismoralization’, which is when moralization is metaethically (...) unjustified. In order to identify mismoralization, we argue that one must engage in metaethical analysis of moralization processes while paying close attention to the relevant facts. We briefly discuss one historical example and two contemporary cases related to COVID-19 that we contend to have been mismoralized in public health. We propose a remedy of de-moralization that begins by identifying mismoralization and that proceeds by neutralizing inapt moral content. De-moralization calls for epistemic and moral humility. It should lead us to pull away from our tendency to moralize—as individuals and as social groups—whenever and wherever moralization is unjustified. (shrink)

Recently, José María Ariso and Samuel Laves have critically debated whether killing innocent and non‐threatening people [=WK] is a universal moral certainty. One of the main topics of their discussion concerns the case of the pisa‐suaves, children born in the context of the Colombian civil war who grew up with the FARC guerrillas. While Laves argues that such children hold WK, Ariso rejects his claim and stresses that pisa‐suaves have no moral code of conduct. In my work, I side with (...) Laves and contend that WK is a universal moral certainty. Accordingly, I maintain that (i) either pisa‐suaves possess WK and thereby count as human moral agents, or (ii) if they do not possess any moral code of conduct, then they cannot count as human moral agents and, in turn, their existence does not undermine WK's universality. Problems with animal morality: The paper aims at discussing the category of animal morality in the light of contemporary scientific findings and theories. First, the issue of moral development is reconsidered in the context of evolutionary anthropology and primatology, then the main positions in this debate are presented. The author proposes a typology which is based on a distinction between various senses of morality, namely a descriptive, neutral, and normative sense. These three aspects of morality are explained in detail and (...) used when analyzing the problems specific to animal morality. The idea of morality applied by the leading participants of ongoing debates is also discussed. The article concludes with an observation that the main problem of these debates is not the very definition of morality and, at the same time, answering the question as to whether animals are moral beings or not, but rather what is essentially problematic are the consequences to be implied from a specific understanding of morality. One of the dominant traditions in normative ethics is characterised by the attempt to develop a comprehensive moral theory that can distinguish right from wrong in a range of cases by drawing on a philosophical account of the good. Familiar versions of consequentialism, deontology, and virtue ethics have emerged from this tradition. Yet such theories often seem to lack the resources needed to evaluate the broader contexts in which moral dilemmas arise, which may cause them to encourage moral complicity. Context-insensitive (...) complicity of this sort receives surprisingly little direct philosophical attention, despite its being a ubiquitous concern for ordinary moral agents and despite the threat it poses to this form of ethical theorising. The present paper sketches the problem more formally and canvasses some leading responses before locating its source in the implicit distinction between moral and non-moral domains at the root of much traditional normative theorising. This article seeks to revisit the distinction between the words ethics and morals. First, we understand the word ethics to be focused on the way we seek to live our own life, and hence to connote a relativistic and essentially subjective perspective, whereas we understand the word morals to be focused on the way we should live our lives together, especially through sensitivity to viewpoints other than our own. Second, we perceive a usefulness in such a differentiation when the ethical (...) values of those in a dilemmatic situation are conflicted in order to prioritize moral decision making in contemporary society. We argue that in our current era, characterized by a multiplicity of faiths and by pronounced value pluralism, a philosophical basis for moral decision making needs to be clearly attuned with intersubjectivity and interconnectivity among people. It should be able to determine principles of conduct toward others, no matter how one’s own ethical values, conceptions of the good, or life choices might differ from those of others. To do this, we relocate ethical decision making away from an essentially monological reflection on our own values and purposes into a social space wherein we have an inclusive, noncoercive, and reflective dialogue. To help bridge the explanatory gap of how normativity branched off into morality in the course of evolutionary history, I claim that morality is a form of social normativity, specifically a form of cultural normativity. Furthermore, with the origins of its behavioral capacities rooted in normative practice, morality should be considered as an exaptation, a secondary adaptation shaped through cultural selection and evolution. Cultural selection pressures differ across social groups, as well as various species. Empirical evidence has shown that animals (...) other than humans are capable of normative behavior, and that they can also be subject to processes of cultural transmission. With an inclusive approach to defining social behaviors, I argue that non-human, socio-cultural animals can engage in moral behavior. (shrink)

The moral philosophy of Socrates, Aristotle, and Plato from ancient Greek became the basis of most of the western ethics. These days, ethics can be divided based on its inquiries for example, normative, descriptive, metaethics, and applied ethics or based on its theories like utilitarianism, emotivism, and universal ethics. In context with applied ethics that examines issues involving emerging technologies, this study will look into the (...) ethics of Malaysian stem cell technology based on written literature. It was mainly to identify Malaysian literature on stem cell ethics through conventional search since the mainstream international database indicated an obvious shortage. The critical review of this literature will facilitate in the understanding of unique position of Malaysia towards stem cell and its ethics in reference to the limited number. Despite the limitation, this can be a preliminary study urging for more inquiries and exploration to fulfil the multiple perspectives in ethics such as the diversity of Malaysian ethics, the impact of ethics in stem cell regulation in Malaysia, and if western contemporary ethics influences Malaysian ethics particularly involving stem cell technology. This inaugural handbook documents the distinctive research field that utilizes history and philosophy in investigation of theoretical, curricular and pedagogical issues in the teaching of science and mathematics. It is contributed to by 130 researchers from 30 countries; it provides a logically structured, fully referenced guide to the ways in which science and mathematics education is, informed by the history and philosophy of these disciplines, as well as by the philosophy of education more generally. The first handbook to cover the (...) field, it lays down a much-needed marker of progress to date and provides a platform for informed and coherent future analysis and research of the subject. -/- The publication comes at a time of heightened worldwide concern over the standard of science and mathematics education, attended by fierce debate over how best to reform curricula and enliven student engagement in the subjects There is a growing recognition among educators and policy makers that the learning of science must dovetail with learning about science; this handbook is uniquely positioned as a locus for the discussion. -/- The handbook features sections on pedagogical, theoretical, national, and biographical research, setting the literature of each tradition in its historical context. Each chapter engages in an assessment of the strengths and weakness of the research addressed, and suggests potentially fruitful avenues of future research. A key element of the handbook’s broader analytical framework is its identification and examination of unnoticed philosophical assumptions in science and mathematics research. It reminds readers at a crucial juncture that there has been a long and rich tradition of historical and philosophical engagements with science and mathematics teaching, and that lessons can be learnt from these engagements for the resolution of current theoretical, curricular and pedagogical questions that face teachers and administrators. Socio-technical systems (STS) have become prominent platforms for online social interactions. Yet, they are still struggling to incorporate basic social ideas for many different and new online activities. This has resulted in unintended exposure of users’ personal data and a rise in online threats as users have now become a desirable target for malicious activities. To address such challenges, various researchers have argued that STS should support user-oriented configurations to protect their users from online social abuse. Some methodologies have also (...) been proposed to appreciate the integration of social values in the design of information systems, but they often lack an application mechanism. This paper presents a framework for the application of the socio-technical design methodology to incorporate social standards in the design of STS. The proposed framework exemplifies the socio-technical design approach by considering a list of social standards, followed by their mapping onto corresponding technical specifications. Based on these two sets, the framework highlights various individual, inter-group, and intra-group interactions and their supporting tools for STS governance. A conversation about the integration of social standards in STS is already materializing, therefore, a comprehensive framework to apply these standards in STS is entailed. (shrink)

Employees’ may view prohibitive voice—that is, expressing concerns about harmful practices in the workplace—as a moral yet interpersonally risky behavior. We, thus, predict that prohibitive voice is likely to be influenced by variables associated with moral and relational qualities. Specifically, we hypothesize that employees’ moral identity internalization—i.e., the centrality of moral traits in their self-concept—is positively associated with their use of prohibitive voice. Furthermore, we hypothesize that this association is stronger when employees enjoy a higher quality relationship with their leader. (...) In addition, drawing on the literature on moral symbolism, we hypothesize that workgroup moral identity symbolization—i.e., the extent to which workgroup members symbolically display moral traits—moderates the relationship between moral identity internalization and prohibitive voice in a compensatory manner. That is, workgroup moral identity symbolization enhances employees’ use of prohibitive voice when employees’ moral identity internalization is low. Data collected from hospital employees and their supervisors and coworkers support these hypotheses. These findings suggest new ways to promote prohibitive voice and, thereby, protect organizational stakeholders from harmful behaviors. (shrink)

The past in which theory of this kind had its origins is notably similar to the present. For this is theory–practical theory–which articulates a critique of critiques, and the critiques it criticizes, rejects and replaces have much in common whether one looks at them in their fifth century B.C. Hellenic (Sophistic) or their modern (Enlightenment, Nietzschean or postmodern) forms.

Within the context of applied bioethical reasoning, various conceptions of the human body are focused upon by the author in relation to normative notions of autonomy.

This dissertation is about the partiality problem for fitting attitude (FA) analyses of value. More specifically, it is about whether and how the problem might be resolved. In Chapter 1, I set the stage by offering a short introduction to the topic and a rationale for investigating it. I then give a more detailed account of FA analyses of value in Chapter 2, including a brief outline of their history and appeal, before explaining more thoroughly just what the partiality problem (...) is for such analyses in Chapter 3, where I distinguish between several different versions of the problem, identify two broad strategies for resolving it and put forward six evaluation criteria in terms of which the plausibility of a resolution can be assessed. According to FA analyses of value, what it is for something to have value is, roughly, for it to be fitting to have a certain sort of attitude toward it. To have a positive value, such as being good, is to be something that it is fitting to favor (to have a pro-attitude toward); to have a negative value, such as being bad, is to be something that it is fitting to disfavor (to have a con-attitude toward); and to have a relational or comparative value like being better than, worse than, equally good as or equally bad as something else is to be something that it is fitting to favor more than, disfavor more than, favor equally much as or disfavor equally much as the other thing. The partiality problem is, roughly, that there are situations in which two things seem to have equal value, which, if things are as they seem and FA analyses of value are correct, means that it is fitting to respond to them equally – to be impartial between them. However, in these situations, there are some people for whom it does not seem fitting to respond in that way because they stand in a certain relationship to one of the bearers of value. For these people, it seems that the fitting response is an unequal or partial response, not an impartial one. If such intuitions about fitting partiality and value are veridical, then how can FA analyses of value be correct? The rest of the dissertation is then a critical, in-depth study of a wide range of responses to the partiality problem. In Chapter 4, I examine the first of the two response strategies, which is to deny the veracity of at least one of the intuitions that generate the problem without making any changes to the FA analyses themselves. I then turn to the second strategy, which is to try to accommodate the intuitions by revising the FA analyses in some suitable manner. In Chapters 5–13, I consider the possibility and plausibility of solving the problem by revising the FA analyses on the basis of: the distinction between intrinsic and extrinsic properties (Chapter 5), the notion of basic value (Chapter 6), the notion of agent-relative value (Chapter 7), the notion of an impartial observer (Chapter 8), the distinction between moral and non-moral fittingness (Chapter 9), a sui generis notion of fittingness (Chapter 10), the distinction between pro tanto and overall fittingness (Chapter 11), the distinction between actions and attitudes (Chapter 12) and the notions of evaluative distance and perspective (Chapter 13). My assessment is that none of these responses is entirely plausible. Thus, in Chapter 14, I conclude that although the partiality problem may not be irresolvable, it is yet to receive a fully plausible resolution. I also discuss the ramifications of this conclusion. After expressing our gratitude to the commentators for their valuable analyses and assessments of Principles of Biomedical Ethics, we respond to several particular critiques raised by the commentators under the following rubrics: the compatibility of different sets of principles and rules; challenges to the principle of respect for autonomy; connecting principles to cases and resolving their conflicts; the value of and compatibility of virtues and principles; common morality theory; and moral status. According to the work of Alasdair MacIntyre, there is an incommensurability between different theories of normative ethics. MacIntyre’s view on the incommensurability of ethical discourse casts doubt upon the pluralistic proposal of Magelssen and colleagues, since the insights gained from the various theories will themselves be incommensurate with one another. However, since there are obvious benefits provided both by arguments for pluralism and the insights of Magelssen and colleagues, I utilize some later work of MacIntyre to offer an alternative means (...) of conceiving of the role of ethical theories not as providing direct insights, but rather as imagined perspectives which will give rise to practical knowledge for the clinical ethicists, which can be used in developing their conclusions. This article builds upon the distinction between pluralism and plurality, the latter in the sense of variety or diversity. Plurality is an empirical fact, such as the biological diversity of the human species. In contrast, pluralism is a normatively underpinned social pattern according to which the diversity of interests, opinions, values, ideas, etc., of individuals and groups is recognized as a constitutive element of a political order. Pluralism can materialize only if a political order is not based upon the claim (...) of one undisputable truth. An embryonic form of pluralism through law emerged in ancient Greece with the institution of courts in which the parties to a legal dispute could argue over what the law said and hence officially present divergent meanings of justice. For the modern development the separation of law and justice was a major step towards pluralism insofar as the authority of the polity and the binding force of the law were no longer based upon the contention of one exclusive truth – auctoritas, non veritas facit legem. This Hobbesian principle banned religious, moral, philosophical and political discourses to the pre-political domain of privacy and secrecy from which pluralism could not result. Referring to the distinction between regulative and constitutive norms I submit that only the latter, not the former, can function as sources of pluralism. (shrink)

Questions regarding the nature of moral judgment loom large in moral philosophy. Perhaps the most basic of these questions asks how, exactly, moral judgments and moral rules are to be defined; what features distinguish them from other sorts of rules and judgments? A related question concerns the extent to which emotion and reason guide moral judgment. Are moral judgments made mainly on the basis of reason, or are they primarily the products of emotion? As an example of the former view, (...) Kant held all moral requirements to be derived from a principle of rationality (the categorical imperative). As an example of the latter, Hume famously claimed that reason is “the slave of the passions” and that moral judgments stem from the moral emotions. When addressing these issues, philosophers have largely relied on the traditional tools of philosophical analysis, along with introspection, anecdotal evidence and armchair speculation. In recent years, however, a rich body experimental psychology has emerged which, in the view of a growing number of philosophers, casts important new light on these venerable questions. Our aim, in this chapter, is to illustrate how empirical methods can help move traditional philosophical debates forward in interesting and important ways. Since space does not permit an exhaustive survey of the relevant experimental work, we will focus on a few of the most compelling examples. (shrink)

The present research reveals the nature of moral philosophy in the human universe based on retrospective analysis and synthesis of the positions of modern sciences related to the problem of scientific searching practices and offers the author’s concept. In the process of achieving the pursued goal, the raised problem is actualized through the prism of a view on the activities of the relevant scientific communities, in particular, AME, APNME, ESMP — associations of moral education and moral philosophy, which study various (...) aspects of moral development and highlight the results in the journals founded by them: Journal of Moral Education, Journal of Moral Philosophy, Philosophical News, Moral Capital. Based on the retrospective study of moral philosophy in the human universe, it is proven that for many centuries, philosophers-moralists have been trying to clarify the specifics of the world of human freedom, their confession of moral norms, and rules accepted in society. Based on the analysis of modern paradigms of moral philosophy and moral psychology, which are related to each other, it is established that the universe contributes to the identification of moral values and their acceptance in the internal plan of human actions. The scientific research results made it possible to outline the author’s concept of the studied phenomenon and determine its main components. It is established that the basis of the universe in its significance for man provides an interaction process that is directly reflected in the formation of moral consciousness, the basis of which is moral philosophy with a system of moral values. In turn, this affects the formation of man’s moral self-consciousness, which contains such constructs as moral intuition, moral judgments, and moral behavior. In conclusion, it is postulated that man as a part of the single whole world acts as a builder of their own moral being, creating their moral “I” and producing their universe. (shrink)

Moral dilemmas have long been debated in moral philosophy without reaching a definitive consensus. The majority of value pluralists attribute their origin to the incommensurability of moral values, i.e. the statement that, since moral values are many and different in nature, they may conflict and cannot be compared. Neuroscientific studies on the neural common currency show that the comparison between allegedly incompatible alternatives is a practical possibility, namely it is the basis of the way in which the agent evaluates choice (...) options. Indeed, both in economic and moral decision-making, the value of options is represented and directly compared in the ventromedial prefrontal cortex. Therefore, we contend that moral dilemmas do not originate from value incommensurability and, on the basis of the neuroscientific discoveries on the neural currency, we derive the implications for the philosophical debate on moral dilemmas. We also provide a possible connection between the experience of moral dilemmas and their neural representation: one of the causes of the individual’s indecision is the neural tie, i.e. the condition in which two options have the same value at neural level, and her regret could be due to the motivational force of the rejected option that is still signalled by affective processes in the brain. We apply this interpretation and the common currency hypothesis to vocational decisions and propose that, although from the agent’s perspective the options are qualitatively different, they may be nevertheless equivalent at neural level. This can be seen as a reason for downgrading the importance commonly attributed to the risk of making the “wrong choice”. (shrink)

Programmatic concepts have elements that point in a valued direction or name a desired goal. We provide a detailed analysis of the nature of programmatic concepts and cite examples of the programmatic elements found in conceptions of scientific literacy. Next we describe what values underlie these elements and what theories of value might be brought to bear in assessing them. We present an analysis of approximately 70 conceptions of scientific literacy found in the literature since the year 2000. We identify (...) the goals that each of these conceptions of scientific literacy implies and uncover the programmatic elements that are used to justify these goals. Our purpose is to present a sufficiently wide range of views to have a good representation of goals and programmatic elements. Third, we point to a number of pitfalls in any attempt to make preferential selections among the programmatic elements of conceptions of scientific literacy. (shrink)

This article examines the relationship between economic rationality and the possibility of a moral science of business ethics. The purpose of this inquiry is to consider whether a universal and non-controversial moral science of business ethics can be defined satisfactorily, and linked to economic rationality of managers and other stakeholders of firms operating in market economies. Economic rationality connotes economic efficiency, meaning a strictly instrumental maximization of actor utility from limited resources. This rationality is a universal and value free (or (...) value neutral) axiom: actors should and generally will be rationally efficient. Utilitarianism accepting aggregation across values is the moral framework associated with market exchange. Business ethics is about normative valuation of motives, actions, and consequences. This article argues that the common foundation across relevant ethical frameworks – moral common sense, Kantianism, virtue theory, religion as a belief system, and utilitarianism – is a first or axiomatic principle of no harm without acceptable justification. A moral science of business ethics proceeds from this no harm axiom. (shrink)

As information technologies have become synonymous with progress in modern society, several ethical concerns have surfaced about their societal implications. In the past few decades, information technologies have had a value-laden impact on social evolution. However, there is limited agreement on the responsibility of businesses and innovators concerning the ethical aspects of information technologies. There is a need to understand the role of business incentives and attitudes in driving technological progress and to understand how they steer the ethics discourse on (...) technology. In the information technology industry, there is an observed trivialization of ethics supported by a business driven and technology-centric approach to ethics. This trivialization rests on hardened beliefs, ideologies, and arguments which hint at reduced accountability for business and tend to individualize social responsibility. The phenomenon of ethics trivialization needs to be duly addressed to resolve the tensions between business needs and ethical concerns. This paper has identified from literature and conceptually analyzed the beliefs and ideologies underlying ethics trivialization which undermine ethics in business contexts. The paper has attempted to address the business concerns indicated by this phenomenon as well as highlight the weaknesses of its assumptions, rhetoric, and justifications. The aim of this paper is to systematically present the justifications in favor of and against the practice of ethics trivialization in the information technology domain, thereby highlighting the need to develop frameworks for assessment of ethical responsibility, accountability, and democratization of the value trade-offs involved in the design of technologies. One of the most important assumptions in liberal societies is that citizens should be tolerant of a diversity of values. We are challenged by this assumption to justify restraint when we confront what we oppose, disapprove of, or perceive to be immoral, even if we have the power to suppress perceived immoralities. Based on the work of Elliot Turiel, Jonathan Haidt, and Gerald Gaus, the argument developed in this article is that the best way to address the challenge is to (...) distinguish between public morality and other normative categories such as convention and private morality. Public morality circumscribes what should not be publicly tolerated. Conventional and private immoralities that are not prohibited by public morality should be tolerated. (shrink)

The study uncovers the drama of Stei Baita (Romania), a former uranium mine, which experienced during the communism period, an intensive industrialization. This shaped the territorial pattern, cultural, economic and social relationships, with a tremendous impact on the quality of the environment which was sacrificed against a rapid of a so-called economic growth. Stei Baita is a classic example of legacy mine land and the authors aim is to capture and assess all important aspects of sustainable development within this study-case (...) of disadvantaged community living in a radon prone area. More specifically, authors introduce their responses to several questions: (1) What do we know about social, economic and environmental capital of the selected settlement?; (2) Is the legacy of a uranium mine the platform of debate for negotiating for sustainable development?; and (3) What is the role of ethics in the current context of Stei Baita? Within the framework of analysis, equity, seen as part of ethics, is valued both as the premise of the debate and mandatory requirement for human development that should target sustainability. Authors have not discussed truths, but positions on identified problems by investigating community members’ perceptions. Thus, peculiarities of this community are dealt within a thematic context (e.g., resources and environment, individual development, social system). Finally, ethics is valued as social construct built by negotiating interpretations of morally desirable situations and behaviors accepted in a particular society at a certain historical moment. This view is consistent with ethical relativism which denies the existence of a unique moral truth and which sets the understanding of Stei Baita context on the path of the “new ethics”. The “new ethics” depicts the world in nuances, allowing society to surpass obstacles to the progress of understanding. (shrink)

This paper discusses one of the advantages of applying formal methods in ethics. First, an approach from democratic morality—which is a special case of contractualist ethics that brings together theories of legal and moral philosophy—will be adopted, in order to argue for the non-trivial thesis that moral norms are increasingly democratically motivated. To accept this thesis also as a desired way of justifying ethical principles raises some issues, such as the problem of providing adequate principles for moral opinion pooling. Secondly, (...) it is therefore shown how formal criteria of rationality provide at least a partial solution to such problems. Research into television's ethical value has mostly focused on scandal genres, such as Big Brother, Jersey Shore, and Jerry Springer. Only recently have researchers started to explore television's moral content with a broader focus. In this study we explore and describe the types of morality and moral content of a night of Dutch prime time television with an open and inductive approach through a qualitative content analysis. Our results revealed 13 types of morality and a basic differentiation between morals that (...) react on violations and transgressions, focusing on restricting behavior, and morals that are focused on ideals and values and stimulate social behavior. Lastly, we differentiated three moral meta-themes that permeate all genres, as well as six moral themes that arose only in specific genre-clusters. (shrink)
