Recent advances in genomic research have led to the development of new diagnostic tools, including tests which make it possible to predict the future occurrence of monogenetic diseases (e.g. Chorea Huntington) or to determine increased susceptibilities to the future development of more complex diseases (e.g. breast cancer). The use of such tests raises a number of ethical, legal and social issues which are usually discussed in terms of rights. However, in the context of predictive genetic tests a key question arises (...) which lies beyond the concept of rights, namely, What should we want to know about our future? In the following I shall discuss this question against the background of Kant’s Doctrine of Virtue. It will be demonstrated that the system of duties of virtue that Kant elaborates in the second part of his Metaphysics of Morals offers a theoretical framework for addressing the question of a proper scope of future knowledge as provided by genetic tests. This approach can serve as a source of moral guidance complementary to a justice perspective. It does, however, not rest on the – rather problematic – claim to be able to define what the “good life” is. (shrink)

In this article, I examine anew the moral philosophy of Immanuel Kant and its contributions to educational theory. I make four claims. First, that Kant should be read as having the Categorical Imperative develop out of subjective maxims. Second, that moral self-perfection is the aim of moral education. Third, that moral self-perfection develops by children habituating the results of their moral maxims in scenarios and cases. Fourth, that character and culture, Kant’s highest aims for humanity, are the ultimate beneficiaries of (...) this process. (shrink)

Overview over some core themes re: Kantian autonomy.

Several commentators have tried to ground legal prohibitions of kidney sales in some form of Kant’s moral arguments against such sales. This paper reconsiders this approach to justifying laws and policies in light of Kant’s approach to law in his political philosophy. The author argues that Kant’s political philosophy requires that kidney sales be legally permitted, although contracts for such sales must remain unenforceable. The author further argues that Kant’s approach to laws, such as those governing kidney distribution, was formed (...) in part by considering and rejecting an assumption frequently employed in the bioethics literature, namely, that legal duties can be grounded directly in moral duties. The author explains some of Kant’s reasons for rejecting this assumption and concludes that arguments pertaining to the legality of kidney sales developed on the basis of Kant’s moral philosophy should no longer be considered tenable. Durante décadas, los teóricos interesados en la discusión de Kant sobre el bienestar han estudiado la postura de Kant sobre la cuestión de la redistribución de bienes en la sociedad. Lo han hecho tanto para aclarar su postura como para una fuente de inspiración para problemas conceptuales actuales, frente a filósofos políticos contemporáneos que intentan reconciliar el ideal de la libertad igualitaria con la necesaria interferencia asimétrica para la redistribución y la provisión social. En este artículo, comienzo por la breve (...) discusión kantiana sobre el estado del bienestar en la Doctrina del derecho e identifico cuatro premisas que Kant afirmó con claridad como características de su postura. Posteriormente, propongo las cinco vías interpretativas principales en la interpretación de la obra de Kant, las evalúo y las ordeno. La interpretación más acertada de la justificación kantiana del bienestar, que llamo la postura “genuinamente kantiana” no llega a explicar, sin embargo, la naturaleza del deber del bienestar que propone. Propongo una solución, retrotrayéndome en los textos kantianos, que unida a otras consideraciones y cuestiones, se puede entender como el punto de partida de una nueva vía de interpretar este tema. La posición sistemática de la Metafísica de las costumbres de Kant y en concreto de su segunda parte, la Doctrina de la virtud, es análoga a la del Sistema de la doctrina de las costumbres según los principios de la Doctrina de la Ciencia de Fichte. Sin embargo, en dicha obra, Fichte califica la ética kantiana de “formalista” y pretende que la suya es más concreta y aplicable por su teoría de la conciliación entre el impulso natural y el impulso (...) moral. En este artículo se explica y discute dicha postura de Fichte, mostrando que la crítica a Kant es injusta, dado que precisamente la Doctrina de la virtud ofrece, de un modo metódicamente diverso pero sólido y coherente con la ética de la autonomía, la “ética material” kantiana. Looking at two well-known discussions of Kant’s discourse on friendship, namely, the second half of Doctrine of Virtue and his Lecture on Friendship, this paper traces the points of overlap and separation whereby, through the paradigm of friendship, the morals and politics of Kant’s discourse are reconsidered. In what follows, I will show first, how Kant’s theory of friendship plays a role in his conception of social relations and morality and second, how the nature of his concerns with friendship reveals (...) both an insistence on moral duties and, in the spirit of Derrida, a difficult, if not paradoxical, politicization of these same duties. In doing so, I argue that Kant’s ideas on friendship are part of a necessary yet irreconcilable tension between political and ethical obligations. Friendship is thought necessary for the well-being of political states at the same time that its instrumentalization undermines the heterogeneous nature of ethical responsibilities and the call to particularity which distinguishes it from other forms of associations. In the end, I argue that Kant’s theory of friendship is characterized by a fundamental ambivalence whose contradictions do not pave the way for new possibilities for association, community, nationhood etc., but only highlight its aporetic underpinnings. According to the orthodox or humanist conception of human rights, individuals have a moral duty to promote the universal realization of human rights. However, advocates of this account express the implications of this duty in extremely vague terms. What does it mean when we say that we must promote human rights satisfaction? Does it mean that we must devote a considerable amount of our time and resources to this task? Does it mean, instead, that we must make occasional donations to (...) charities working to advance human rights realization? In this essay, I argue that this duty can only be constructed as imperfect. This means that it confers agent-relative discretion on us to decide when, how, and to what extent to advance the human rights of others. It also means that it is neither correlative with rights nor enforceable. As I will explain, the main reason for this is that any attempt to construct it as a perfect duty would infringe the dignity of the potential duty bearers and thereby undermine the very values that human rights practice aspires to serve. Finally, I will conclude by providing some guidelines for those who wish to comply with their imperfect duties to improve the situation of those whose human rights are in peril. (shrink)

Immanuel Kant’s major book on his legal and political philosophy, the Doctrine of Right, appears in 1797. Therefore, many scholars have argued that Kant’s entire legal philosophy has only been developed in the late 1790s and that it is for the most part independent from his critical writings on moral philosophy dating in the 1780s. This article, however, tries to proof the contrary by analyzing the1784 lecture notes Moral-Mrongovius II given by Christoph Coelestin Mrongovius, who attended Kant’s lecture on moral (...) philosophy at that time. Those lecture notes not only proof that Kant’s concept of right has already been worked out in 1784. Even more: Moral-Mrongovius II indicates that Kant considered his legal philosophy as an integral part of his overall critical moral philosophy. (shrink)

An existential interpretation of student angst in Chinese universities raises issues of autonomy and freedom. The governance arrangements in China create a conflict for Chinese students who in their coursework are urged to become critical-minded and open-minded. In this essay, Kant’s moral theory provides access to this phenomenon. His theory of duty–rationality–autonomy–freedom relates the liberty of thought to principled action. Kantian ideals still influence western business and university practice and they become relevant in China as that country modernises. The abilities (...) of graduates which officials say the country needs—insightfulness, creativity, innovation, progressiveness and commitment—are only achievable by professionals who are independent minded, rational and who commit to act on their own conclusions. Such people are Kant’s autonomous persons. Chinese students increasingly confront a conflicted educational environment. Universities require students to think, analyse and argue. An outcome of this deliberation is freedom, as construed by Kant as an ‘inner’construct. When students are unable to exercise Kantian freedom in matters which concern them they experience the angst of freedom. Students may carry a burden derived from bridles on information and authoritarian restrictions on dialogue. (shrink)

Kant’s repeated statement in the Critique of Pure Reason that the so-called table of judgements and, as a consequence, the table of pure concepts of the understanding or categories, is fully exhaustive is well-known. This ambitious assertion has worried and challenged generations of authors. However, thus far the entire discussion has completely disregarded the fact that in his Critique of Practical Reason Kant undertakes a coordinate venture. For the “Table of the Categories of Freedom”, which he sets out, with only (...) a few explanations, in the “Second Chapter” of the Critique, Kant makes, when looked at more closely, the very same claim to completeness. This article shows that this same claim is made, even though Kant does not state this assertion as explicitly as one might have expected. And it poses the question, which underlying, yet concealed assumptions this view might appeal to. Or is it that Kant has merely failed to provide the evidence in this case? (shrink)

The purpose of this article is to discuss Kant’s concept of juridical state as the foundation of the contemporary rule of law. Therefore, the article tries to answer two questions: (1) what character can be attributed to Kant’s concept of juridical state taking into account the obligations arising from it; (2) can the analysis of the Kantian juridical state have any impact on the contemporary understanding of the rule of law and if so, what can this impact be. In order (...) to accomplish this task, moral presuppositions of Kant’s juridical state are discussed, according to the commonly accepted view that Kant’s political philosophy is closely linked with his moral and ethical reflection. Then, two interpretations of Kant’s juridical state – the liberal one and the authoritarian one – are analysed. The crucial difference between these interpretations lies in establishing the circumstances in which the duty of obedience to state power should be carried out. Then, Kantian juridical state is compared with two ways of understanding the rule of law – the material one and the formal one – in order to evaluate whether the rule of law should be considered as continuity of or rupture with the Kantian concept. Se examina la relación, ampliamente discutida, entre ética y derecho en el marco de la filosofía práctica kantiana. Para esclarecer algunas observaciones de La metafísica de las costumbres, se analiza el concepto de derecho y la distinción entre legislación ética y jurídica. Con la consideración de la libertad como derecho innato se reconstruyen diversas interpretaciones sobre la relación entre ética y derecho, para mostrar que, pese a la relación inescindible ente ambos, su especificidad no permite considerar la filosofía jurídica como (...) mera derivación de la filosofía moral. The article examines the -widely argued- relationship between ethics and right within the frame of Kant's practical philosophy. In order to clear up some observations made on The Metaphysics of Morals, the article analyzes the distinction between legal and ethical legislation. Taking into consideration freedom as an innate right, the article reconstructs various different interpretations regarding the relationship between ethics and right. This tries to show that, although the relationship in question is inseparable, its specificity does not allow to consider philosophy of law as a mere derivation of moral philosophy. (shrink)

Orientada por um interesse sistemático e tendo por base o capítulo sobre a Arquitetônica da Razão Pura da Crítica da razão pura, a presente investigação procura esclarecer a reformulação por que passam na filosofia crítica kantiana as disciplinas tradicionais da metafísica racionalista, mais precisamente a metaphysica generalis e a metaphysica specialis, (...) reconfiguradas em uma analítica do entendimento e em uma fisiologia da razão, respectivamente, e ancoradas no projeto propriamente kantiano de uma Metafísica dos Costumes e uma Metafísica da Natureza. RESUMO O artigo tem como objetivo pôr em questão duas objeções comumente lançadas contra a "Metafísica dos Costumes", a saber, a sua falta de "clareza sistemática" quando comparada com outras obras críticas centrais de Kant, e também a admissão aparentemente equivocada da legalidade como conceito legítimo de um sistema metafísico prático. Argumentar-se-á que a identificação do ato do livre arbítrio como conceito supremo do sistema permite responder às críticas lançadas ao, por um lado, apresentar um princípio de ordenação sistemática empregado (...) de forma análoga em outras obras reconhecidamente sistemáticas, e, por outro, justificar a posição central ocupada no sistema pelo ato correto ou conforme ao dever, ensejando a possibilidade de que tanto o Direito quanto a legalidade ética sejam concebidos como autênticos elementos de uma "Metafísica dos Costumes". ABSTRACT This paper casts doubt on two objections commonly raised against the "Metaphysics of Morals", namely, its lack of "systematic consistency" when compared with other central works of Kant's critical philosophy and also the apparently misleading admission of legality as a legitimate concept of his practical metaphysical system. It will be argued that the identification of the act of free choice as the supreme concept of the system allows us to face these criticisms firstly by presenting a principle of systematic arrangement which is employed in other admittedly systematic works, and secondly by justifying the central position occupied by the right act, or the action in conformity with duty in Kant's system of morals, which allows for the possibility that both Law and ethical legality be considered as authentic elements of a "Metaphysics of Morals".
