*As mentioned in Peter Coy's NYT essay "When Being Good Is Just a Matter of Being Lucky" (2023) -/- ----- -/- How is the problem of free will related to the problem of moral luck? In this essay, I answer that question and outline a new solution to the paradox of moral luck, the source-paradox solution. This solution both explains why the paradox arises and why moral luck does not exist. To make my case, I highlight a few key connections (...) between the paradox of moral luck and two related problems, namely the problem of free will and determinism and the paradox of self-creation. Piecing together intuitions, arguments, and insights from recent work on each of these three problems, I argue that the type of control necessary for moral responsibility can only be had by someone who is a genuine source of his own actions, but the relevant notion of sourcehood admits no coherent characterization. If our commonsense view of moral responsibility is incoherent, it is unsurprising that our commitment to the existence of morally responsible agents commits us to some paradoxical things—e.g. to both the existence and impossibility of moral luck. It is almost unanimously accepted that Kant denies resultant moral luck—that is, he denies that the lucky consequence of a person’s action can affect how much praise or blame she deserves. Philosophers often point to the famous good will passage at the beginning of the Groundwork to justify this claim. I argue, however, that this passage does not support Kant’s denial of resultant moral luck. Subsequently, I argue that Kant allows agents to be morally responsible for certain kinds of lucky (...) consequences. Even so, I argue that it is unclear whether Kant ultimately endorses resultant moral luck. The reason is that Kant does not write enough on moral responsibility for consequences to determine definitively whether he thinks that the lucky consequence for which an agent is morally responsible can add to her degree of praiseworthiness or blameworthiness. Moral luck occurs when factors beyond an agent’s control positively affect how much praise or blame she deserves. Kinds of moral luck are differentiated by the source of lack of control such as the results of her actions, the circumstances in which she finds herself, and the way in which she is constituted. Many philosophers accept the existence of some of these kinds of moral luck but not others, because, in their view, the existence of only some of them would (...) make morality unfair. I, however, argue that this intermediary approach is unstable, because either morality is fair in ways that rule out resultant, circumstantial, and constitutive moral luck (and this leads to moral responsibility skepticism), or morality is unfair in ways that permit the existence of those kinds of moral luck. Thus, such intermediary approaches lack the motivation that their proponents have long taken them to have. Galen Strawson’s Basic Argument is that because self-creation is required to be truly morally responsible and self-creation is impossible, it is impossible to be truly morally responsible for anything. I contend that the Basic Argument is unpersuasive and unsound. First, I argue that the moral luck debate shows that the self-creation requirement appears to be contradicted and supported by various parts of our commonsense ideas about moral responsibility, and that this ambivalence undermines the only reason that Strawson gives for the (...) self-creation requirement. Second, I argue that the self-creation requirement is so demanding that either it is an implausible requirement for a species of true moral responsibility that we take ourselves to have or it is a plausible requirement of a species of true moral responsibility that we have never taken ourselves to have. Third, I explain that Strawson overgeneralizes from instances of constitutive luck that obviously undermine moral responsibility to all kinds of constitutive luck. (shrink)

I argue that knowledge is a particular kind of concept known as a thick concept. Examples of thick concepts include courage, generosity, loyalty, brutality, and so forth. These concepts are commonly said to combine both evaluation and description, and one of the main goals of this dissertation is to provide a new account of how a thick concept combines these elements. It is argued that thick concepts are semantically evaluative, and that they combine evaluation and description in a way similar (...) to that of concepts like good qua dancer and bad qua violinist. In the final chapter, this basic idea is applied to the concept of knowledge. There, the concept of knowledge is analyzed in terms of good qua belief. The upshot is that two central epistemological problems—the Gettier Problem and the Value Problem—can be resolved. (shrink)

I argue that certain kinds of luck can partially determine an agent’s praiseworthiness and blameworthiness. To make this view clearer, consider some examples. Two identical agents drive recklessly around a curb, and one but not the other kills a pedestrian. Two identical corrupt judges would freely take a bribe if one were offered. Only one judge is offered a bribe, and so only one judge takes a bribe. Put in terms of these examples, I argue that the killer driver and (...) bribe taker are more blameworthy than their counterparts. I offer three arguments for that view, and, in doing so, I exemplify a general way to advance the moral luck debate. First, I argue against an account of moral responsibility that implies that the judges are equally blameworthy. Second, I argue that the killer driver is more blameworthy than the merely reckless driver. Third, I locate an alternative sense in which the agents in each case pair are morally on par. (shrink)

Every account of moral responsibility has conditions that distinguish between the consequences, actions, or traits that warrant praise or blame and those that do not. One intuitive condition is that praiseworthiness and blameworthiness cannot be affected by luck, that is, by factors beyond the agent’s control. Several philosophers build their accounts of moral responsibility on this luck-free condition, and we may call their views Luck-Free Moral Responsibility (LFMR). I offer moral and metaphysical arguments against LFMR. First, I maintain that considerations (...) of fairness that often motivate LFMR do not require its adoption. Second, I contend that LFMR has counterintuitive implications for the nature and scope of praiseworthiness and blameworthiness and that LFMR is vulnerable to a reductio ad absurdum. Third, I state some common reasons for thinking that LFMR’s commitment to true counterfactuals of libertarian freedom is problematic, and I argue that if there are no such true counterfactuals and if LFMR is true, a person is praiseworthy and blameworthy at most for a tiny fraction of her actions. Fourth, I argue that proponents of LFMR cannot escape this skeptical cost by appealing to a different kind of counterfactual of freedom. Fifth, I develop an anti-skeptical motivation to affirm the idea that luck can affect moral responsibility. (shrink)

A number of virtue epistemologists endorse the following thesis: Knowledge is true belief resulting from intellectual virtue, where Ss true belief results from intellectual virtue just in case S believes the truth because S is intellectually virtuous. This thesis commits one to a sort of contextualism about knowledge attributions. This is because, in general, sentences of the form X occurred because Y occurred require a contextualist treatment. This sort of contextualism is contrasted with more familiar versions. This essay offers a rearticulation and defence of the modal account of luck that the author developed in earlier work . In particular, the proposal is situated within a certain methodology, a component of which is paying due attention to the cognitive science literature on luck ascriptions. It is shown that with the modal account of luck properly articulated it can adequately deal with some of the problems that have recently been offered against it, and that the view has a (...) number of attractions over competing proposals, such as the lack of control account. In this paper I add credence to Linda Zagzebski's (1994) diagnosis of Gettier problems (and the current trend to abandon the standard analysis) by analyzing the nature of luck. It is widely accepted that the lesson to be learned from Gettier problems is that knowledge is incompatible with luck or at least a certain species thereof. As such, understanding the nature of luck is central to understanding the Gettier problem. Thanks by and large to Duncan Pritchard's seminal work, Epistemic Luck, (...) a great deal of literature has been developed recently concerning the nature of luck and anti-luck epistemology. The literature, however, has yet to explore the very intuitive idea that luck comes in degrees. I propose that once luck is recognized to admit degrees even the slightest non-zero degree (of the relevant sort) precludes knowledge. Connecting this to Zagzebski's thesis, I propose that a given theory of warrant must guarantee truth in order to avoid Gettier counterexamples (or subsequently deny that warrant bears any relationship to the truth whatsoever), simply because a sufficient standard analysis of knowledge cannot allow for knowledge that is even marginally lucky. Many philosophers have argued that an event is lucky for an agent only if it was suitably improbable, but there is considerable disagreement about how to understand this improbability condition. This paper argues for a hitherto overlooked construal of the improbability condition in terms of the lucky agent’s epistemic situation. According to the proposed account, an event is lucky for an agent only if the agent was not in a position to know that the event would occur. It is also (...) explored whether this new account threatens the anti- luck program in epistemology. It is widely held that whether a person is morally responsible for an outcome partly depends on whether certain causal relations obtain between that person and the outcome. This paper argues that, regardless of whether the preceding claim about moral responsibility is true, moral blameworthiness is independent of such causal considerations. This conclusion is motivated by considering cases from Carolina Sartorio and Sara Bernstein. The causal structures of these cases are complex. Sartorio and Bernstein believe that reaching conclusions about moral (...) responsibility and blameworthiness requires wading through this complexity. But it is argued here that getting clear on these causal structures does not help us assess blameworthiness (regardless of the relevance of such considerations for drawing conclusions about moral responsibility). Moral blameworthiness simply does not turn on the considerations relevant to figuring out whether an agent causally contributed to an outcome. (shrink)

This essay aims to reorient current theorizing about luck as an aid to our discerning this concept's true philosophical significance. After introducing the literature's leading theories of luck, it presents and defends counterexamples to each of them. It then argues that recent luck theorists’ main target of analysis—the concept of an event's being lucky for a subject—is parasitic on the more fundamental notion of an event's being a stroke of luck for a subject, which thesis serves as at least a (...) partial diagnosis of the leading theories’ failure. Next, it develops an analysis of strokes of luck that utilizes insights from the recent luck literature. Finally, having set out a comprehensive new analysis of luck—the Enriched Strokes Account of lucky events—the essay revisits the initial counterexamples to the literature's leading theories and argues that the Enriched Strokes Account properly handles all of them. It is further claimed that (...) once one offers a more developed notion of luck and disambiguates the problem of moral luck from the problem of epistemic luck (especially in its sceptical guise), neither of these papers is able to offer unambiguous grounds for thinking that there is a problem of moral luck. Indeed, it is shown that insofar as these papers succeed in making a prima facie case for the existence of epistemic luck, it is only the familiar sceptical variant of this problem that they identify. A surprisingly large number of scholars believe that (a) we are blameworthy, and therefore punishable, only for what we have control over; (b) we have control only over our actions and intentions, not the consequences of our actions; and therefore (c) if two agents perform the very same action (e.g., attempting to kill) with the very same intentions, then they are equally blameworthy and deserving of equal punishment – even if only one of them succeeds in killing. This paper argues (...) against these “equivalence theorists” that harmful consequences do make a moral difference, that the harm produced by the killer’s attempt retroactively makes her action more blameworthy, and therefore deserving of more punishment, than the failed attempter’s attempt. The primary argument for this “non-equivalence theory” is an analogy with gambling. Just as a gambler makes a deal with the casino to allow metaphysical luck to retroactively determine the “profit status” of her bet, so too the attempted killer makes a deal with “the casino of morality” to allow metaphysical luck to retroactively determine the moral status of her attempt. She makes the “moral deal” that if her attempt succeeds, her attempt was more blameworthy than if her attempt does not succeed. And it is the greater blameworthiness of the killer’s attempt that justifies our intuition that the killer should be punished more harshly than the failed attempter. (shrink)

In this paper, I critically examine the two dominant views of the concept of luck in the current literature: lack of control accounts and modal accounts. In particular, I argue that the conditions proposed by such views—that is, a lack of control and the absence of counterfactual robustness—are neither necessary nor sufficient for an event's being lucky. Robert Hartman’s parallelism argument aims to show that resultant moral luck exists. The gist of the argument is this: because there is circumstantial moral luck in a particular circumstantial luck scenario and that scenario is analogous in important ways to a particular resultant luck scenario, the resultant luck scenario is plausibly an instance of resultant moral luck. I argue that there is a principled way of denying that circumstantial moral luck is present in the circumstantial luck scenario. Doing so is (...) not enough, however, to reject Hartman’s general analogical line of reasoning since an alternative parallelism argument based on a resultant luck scenario and a circumstantial luck scenario of another kind can be made. Nevertheless, I argue that the analogy between the circumstantial luck scenario and the resultant luck scenario in both the alternative parallelism argument and its original counterpart is too weak to support the claim that resultant moral luck is present in the resultant luck scenario. In this paper I defend a solution to the moral luck problem based on what I call "a fair opportunity account of control." I focus on Thomas Nagel's claim that moral luck reveals a paradox, and argue that the apparent paradox emerges only because he assumes that attributions of responsibility require agents to have total control over their actions. I argue that a more modest understanding of what it takes for someone to be a responsible agent-i.e., being capable of doing (...) the right thing for the right reasons-dissolves the paradox and shows that responsibility and luck aren't at odds. It is sometimes claimed by open theists that, on Molinism, God controls who is saved and who is damned and that, as a consequence, God's judgement of us is unjust. While this charge is usually lumped under the problem of evil, it could easily be classified under the problem of soteriological luck. I argue that the open theist is impugned by this latter problem. This paper introduces and argues for the hypothesis that judgments of testimonial worth are central to our practice of normatively appraising speech. It is argued that judgments of testimonial worth are central both to the judgement that an agent has lied, and to the acceptance of testimony. The hypothesis that, in lying, an agent necessarily displays poor testimonial worth, is shown to resolve a new puzzle about lying, and the recalcitrant problem raised by the existence of bald faced lies, and (...) selfless assertions. It is then shown that the notion of testimonial worth allows us to capture the distinction between taking a speaker at their word, and treating them as a mere indicator of the truth in a way other theories fail to do. This paper warns of two threats to moral responsibility that arise when accounting for omissions, given some plausible assumptions about how abilities are related to responsibility. The first problem threatens the legitimacy of our being responsible by expanding the preexisting tension that luck famously raises for moral responsibility. The second threat to moral responsibility challenges the legitimacy of our practices of holding responsible. Holding others responsible for their omissions requires us to bridge an epistemic gap that does not arise when (...) holding others responsible for their actions—one that we might often fail to cross. Epistemologists often remark that knowledge precludes luck. A true belief based on a guess or hunch is not knowledge because it seems merely fortuitous, too much of an accident, and, well, lucky that one happened to get things right. Of course, true beliefs based on guesses and hunches are not justified. However, Gettier cases have persuasively shown that even justified true beliefs can admit knowledge‐precluding kinds of luck. So in what sense are justified true beliefs that don’t amount knowledge lucky (...) or ‘true only by chance’? I will address three different approaches to epistemic luck that have received significant attention in the recent literature: reliability approaches to epistemic luck, credit approaches to epistemic luck, and responsibilist or control approaches to epistemic luck. I will then turn my attention to the implications that epistemic luck has for other epistemic states. I will focus particularly on state of understanding and examine whether, and to what extent, understanding is vulnerable to epistemic luck. (shrink)

‘Constitutive luck’ refers to luck that affects the sort of person one is. This article demonstrates that it is a philosophically troubling sort of luck, causing problems in, at least, ethics and political philosophy. Some, notably Susan Hurley, Nicholas Rescher, and Daniel Statman, have argued that such trouble can be avoided, by pointing out that the notion of constitutive luck is incoherent. The article examines this claim by means of a discussion of the idea of luck in general, settling on (...) an account of luck in terms of the notions of chance, value, and (lack of) control. This account is then used to show that the notion of constitutive luck is not incoherent. We are stuck with the problems made by constitutive luck. (shrink)

A number of contemporary philosophers endorse a Pyrrhonian theme: that one has knowledge only if one knows or understands that one’s beliefs are reliably formed. Otherwise, one is like a man who grasps gold in the dark: such a man is successful, but his success is a matter of luck, and so not creditable to him. It is argued that the skeptical problem and the problem of moral luck share a common structure and a common solution. Specifically, a virtue-theoretic approach (...) helps us to understand important relations among luck, success and credit for success. Many philosophers hold that luck excludes control-more precisely, that an event is lucky for you only if that event lies beyond your control. Call this the Lack of Control Requirement (LCR) on luck. Jennifer Lackey [2008] has recently argued that there is no such requirement on luck. Should such an argument succeed, it would (among other things) disable a main objection to the "libertarian" position in the free will debate. After clarifying the LCR, I defend it against both Lackey's argument (...) and a novel argument different in kind from Lackey's. I undermine each of these arguments by sketching a plausible error theory for its key intuition. For each argument, there's a natural reply available to its proponents. I show that these natural replies depend on certain mistaken general principles about luck. Neither Lackey's argument nor the novel argument I consider casts serious doubt on the LCR.
