RESUMEN Si bien se han sondeado diversas fuentes a través de las cuales la tradición judeo-cristiana ha legitimado el especismo, seria injustamente parcial sostener que Occidente debe únicamente a su religión más popular e influyente el trato lesivo y discriminatorio hacia las demás especies. En diversas variantes, a partir de todo tipo de argumentos y supuestos, las jerarquías discriminatorias de especies no han constituido la excepción, sino más bien la regla. Esta tendencia, que está presente en diferentes cosmovisiones occidentales -y (...) aun entre teorías como las de Darwin, que dejan sin sustento teórico los fundamentos religiosos y metafísicos que suelen avalar tales prácticas especistas-, pone de manifiesto su relación sustancial con el problema de la destrucción en cuanto el ser humano ha explotado y hecho sistemáticamente desaparecer un sinfín de especies sobre la faz de la Tierra. ABSTRACT A wide range of sources is available to support the notion that the Judeo-Christian tradition has been instrumental in legitimizing speciesism. Nonetheless, it would be unfair to claim that the West's harmful and discriminatory attitude to other species proceeds solely from its historically dominant religious tradition. The construction of discriminatory species hierarchies has been the rule rather than the exception, proceeding from a variety of arguments and suppositions. This discriminatory tendency can be found in diverse Western cosmovisions; even in Darwinian theories which reject the theological and metaphysical underpinnings previously used to shore up speciesist practices. This pervasiveness suggests that the speciesist tendency is intimately bound up with the problem of destruction, understood here as the process by which human beings have exploited innumerable species, to the point of systematically rendering them extinct. El presente ensayo se fija como propósito precisar la crítica hegeliana del Derecho natural y del Derecho abstracto y determinar una doctrina propiamente hegeliana del Derecho. En este sentido, nuestra hipótesis es que es en el contexto de la doctrina de la Sittlichkeit,que el Derecho debe ser comprendido según Hegel. En efecto, en sus Lecciones sobre la filosofía de la historia, Hegel define la Sittlichkeit como un “orden de lo sustancial de suerte que todo sujeto singular tiene la universalidad por (...) propósito, por espíritu y por costumbre ética, y que es en y por este espíritu que él quiere, actúa, vive y goza, si bien que es su naturaleza, a saber su naturaleza segunda y espiritual”2. Luego para Hegel la normatividad jurídica debe ser comprendida al interior de este campo, en un sentido social más amplio de normatividad constituido por la praxis de una comunidad que configura un campo inmanente de objetividad que estructura cotidianamente la vida de los individuos. Lejos entonces de una separación de deber y ser, Hegel nos llama a comprender la forma cómo la norma está presente en el corazón del mundo de la vida como reconciliación de lo racional con lo real en la efectividad. This paper defends the doctrine that moral requirements are categorical in nature. My point of departure is John McDowell’s 1978 essay, “Are Moral Requirements Hypothetical Imperatives?”, in which McDowell argues, against Philippa Foot, that moral reasons are not conditional upon agents’ desires and are, in a certain sense, inescapable. After expounding McDowell’s view, exploring his idea that moral requirements “silence” other considerations and discussing its particularist ethos, I address an objection that moral reasons, as McDowell conceives them, are fundamentally incomplete (...) in ways only a full-bloodedly Kantian appeal to pure practical reason can remedy. I conclude that the objection fails: ordinary moral reasons do not stand in need of a grounding in Reason. There is no prospect of deriving them from a supreme principle of morality or other canons of rationality. Ordinary reasons are sufficient in themselves, though their significance can be elucidated and illuminated by various strategies — some broadly Aristotelian, some drawing inspiration from Kant’s formula of humanity — in ways that can strengthen and vindicate them. Notwithstanding the failure of the objection, I conclude by reflecting on how Kantian insights can yet play a significant role in a McDowellian view of moral deliberation and moral education. Immanuel Kant’s Observations on the Feeling of the Beautiful and the Sublime is examined in the context of the emergence of the epistemological practice of scientific observation. By focusing on the genre-stylistic and semantic-structural features of the text the authors demonstrate the mechanisms of observation as well as the methods of describing the results characteristic of mid-eighteenth century science. The authors consider Kant’s treatise to be a hybrid text: on the one hand, it attests to the importance of the natural (...) science paradigm and the degree of its influence on the humanities in the modern period; and, on the other hand, it bears witness to the multi-genre character of philosophical treatises, combining as they do the considered and serious wisdom of philosophy, the precision of scientific terminology and the figurativeness of a work of fiction. Kant is perceived not only as a researcher and philosopher capable of bringing out the essence of the particular and changeable captured in observation, but as a writer with a consummate command of the apparatus for keeping the reader’s attention through linguistic devices and practices of image-creating. The authors demonstrate how the categories of the “beautiful” and “sublime” become a general framework for the description of the moral and mental properties of human nature. The authors show that Kant’s use of “aesthetic” wording in the title of his treatise does not announce that his aim is analysis of artistic perception and practices, but mainly refers to the form of his anthropological study and conceptualisation of scientific knowledge. Kant has transferred the technique of visualisation from natural sciences to the objects of philosophical inquiry, thus contributing to the development in the humanities of representative practices, the scientific method of observation as well as the corresponding epistemic and literary genre. Résumé Partant du principe que la philosophie de la connaissance de Poincaré est cohérente, j’essaie de faire voir que son conventionnalisme en géométrie et en physique n’est qu’une conséquence de son intuitionnisme. Après avoir rappelé, dans la première section, ce qu’est l’intuitionnisme et décrit ce que l’intuitionnisme de Poincaré a de spécifique, je montre, dans la deuxième section, comment celui-ci retentit sur la conception de l’espace. Dans la troisième section, j’applique les conclusions précédemment établies à la question très controversée de (...) la découverte de la relativité restreinte en renvoyant dos à dos les historiens : il n’a rien manqué à Poincaré pour découvrir la relativité restreinte, car, cette théorie étant incompatible avec son intuitionnisme, il n’avait aucune raison d’y adhérer.Taking for granted that Poincaré’s epistemology is consistent, I attempt to show that his geometrical and physical conventionalism is no more than a consequence of his intuitionism. After having rehearsed the issues defining intuitionism and describing what is particular to Poincaré’s version in the first section of the paper, I show, in the second section, how Poincaré’s intuitionism influenced his conception of space. In the last section, I apply these now established conclusions to a very contested issue, the discovery of the special theory of relativity. Rejecting the view of historians on both sides of the issue, I argue that Poincaré had everything he would have needed to discover the special theory of relativity, but that since this theory is incompatible with his intuitionism, he had no reason to adopt it. A Crítica da faculdade de julgar foi recebida com entusiasmo pelos filósofos do idealismo alemão. No caso de Friedrich Schelling, as duas partes da obra foram influentes, de modo que não só a estética kantiana, mas também a teleologia foi marcante em sua trajetória filosófica. Observaremos como o filósofo de Leonberg acolhe, na Introdução às Ideias para uma filosofia da natureza, a noção kantiana de organismo como dotado de autocausalidade, mas pensa-a nos quadros de uma filosofia pós-kantiana, buscando prescindir das (...) noções de juízo reflexionante e também da ideia de “natureza como arte” para se pensar o organismo. Como Schelling vincula essa noção com a proposta de se pensar a unidade entre natureza e espírito a partir do próprio sujeito, e não de algo exterior a ele? Como Kant reagiria a tal proposta? The Critique of Judgment was enthusiastically received by the German Idealists. In the case of Friedrich Schelling, both divisions of the work were influent, thus resulting that not only Kantian aesthetics, but also the teleology was a landmark in his philosophical itinerary. We attempt to observe how the philosopher of Leonberg receives, in the Introduction to the Ideas for a Philosophy of Nature, the Kantian conception of organism as endowed with self-causality, but at the same time thinks it within the frame of a post-Kantian philosophy, leaving aside the reflective judgment and also the idea of nature as a product of art in order to think the organism. How does Schelling connect this notion with the proposal to think the unity between nature and spirit based on the own subject, and not on something external to it? The Corporate Social Performance (CSP) model (Wood, Acad Manag Rev 164:691–718, 1991) assesses a firm’s social responsibility at three levels of analysis—institutional, organizational and individual—and measures the resulting social outcomes. In this paper, we focus on the individual level of CSP, manifested in the managerial discretion of a firm’s principles, processes, and policies regarding social responsibilities. Specifically, we address the human resources management of employees as a way of promoting CSR values and producing socially minded outcomes. We show that applying (...) the humanist philosophy to the managerial discretion of a business organization leads to the creation of an “autonomy supportive work environment”—as defined by the self-determination theory—which in turn, facilitates the internalization of social values, citizenship behaviors, and cooperation. The objective of promoting self-determination at work (i.e., the core of a humanist management) fits well with the ontology of social responsibility since autonomy and consideration of individuals as moral actors are central tenets. Furthermore, we show that applying humanistic management philosophy to the discretion of managers can lead to socially responsible outcomes. First, intra-organizational stakeholders (e.g., employees) are treated with respect and focus is put on their well-being, satisfaction, and self-actualization at work. Second, as employees’ need of self-determination is addressed by managers, it is likely that pro-social behaviors toward other stakeholders of the organization will be adopted, leading to socially responsible outcomes for extra-organizational stakeholders (Gagné, Motiv Emot 77:58–75, 2003). Thus, this paper ultimately posits that humanistic management applied to the HRM can be a solution for developing and maintaining socially responsible outcomes as determined at the individual level of the CSP model, through managerial discretion. In philology, both 'sincerity' and 'cheng' primarily mean, 'to be true to oneself'. As a philosophical term, 'sincerity' roots in Aristotle's 'aletheutikos'. In medieval Europe, it is regarded as a neutral value that may either serve or disserve for 'truth.' As for Romantics, it is a positive value, and an individualistic concept whose two elements 'true' and 'self' refer to a person's 'true feeling' and 'individuality'. In contrast, both 'self' and 'true' in Confucianism are universalistic concepts, meaning 'good nature' common (...) to all humans, and 'true feeling' distinguishing them from beasts. Cheng itself means to face one's universal self with universal true feeling. (shrink)

Although the literature on Nietzsche is now voluminous one area where there has surprisingly been very little research concerns Nietzsche on the passions. This essay aims to correct this neglect. My focus is on illuminating Nietzsche on the passions in relation to his primary teaching on self-cultivation. To illuminate his position, I focus attention on examining his relation to Stoic teaching on the passions. If for Nietzsche the Christian mind-set involves a disturbing pathological excess of feeling, the Stoic way of (...) living results for him in a petrified of life devoid of movement and growth. After a consideration of his relation to Stoic teaching I then examine his relation to Spinoza on the emotions or affects. Whilst I acknowledge the affinities between the two thinkers and their criticisms of Stoic teaching, I maintain that it is an error to seek to construe Nietzsche and Spinoza as having an identical teaching on the passions. In the final section of the essay, I provide an appreciation of Nietzsche’s recommendation that instead of demonising the passions in the manner of the Christian psyche and its legacy, or extirpating our passions as recommended by the Stoics, we need to learn how to transform them into joys or delights. In this essay I examine the contribution a philosophy of life is able to make to our understanding of morality, including our appreciation of its evolution or development and its future. I focus on two contributions, namely, those of Jean-Marie Guyau and Henri Bergson. In the case of Guyau I show that he pioneers the naturalistic study of morality through a conception of life; for him the moral progress of humanity is bound up with an increasing sociability, involving both the (...) intensification of life and its expansion. In the case of Bergson I show that he also pioneers a novel naturalistic appreciation of morality, one that is keen to demonstrate morality’s two sources and so as to give us a firm grasp of the chances of a moral progress on the part of humanity. I suggest that of the two appreciations of morality Bergson’s is the richer since it contains a set of critical reflections on humanity’s condition that is lacking in Guyau. I conclude by suggesting that Bergson’s idea that modern humanity is confronted with the decision whether it wishes to continue living or not has lost none of its relevance today. (shrink)

A educação, segundo Kant, divide-se em física e prática. A educação física tem em vista os cuidados com o infante, a educação prática diz respeito à formação do sujeito . A formação ou educação prática, por sua vez, se divide, essencialmente, em dois momentos, disciplina e instrução. Pretendemos aqui investigar o papel da Disciplina no projeto filosófico da Educação Prática de Kant. Verificamos o constrangimento ao falar da questão da disciplina no âmbito pedagógico , desse modo, pretendemos elucidar o pensamento (...) pedagógico kantiano, uma tentativa de, ademais, revelar possíveis contribuições da modernidade às discussões contemporâneas. Para o filósofo a disciplina desempenha um papel vital na educação prática – a educação do homem livre. Procurando expor e justificar essa posição, iremos analisar alguns momentos do conjunto de preleções “Sobre a pedagogia”, porém, sem perder os vínculos com o todo do pensamento prático e teórico de Kant. L'éducation, selon Kant, est divisé en physique et pratique. L'éducation physiquevise à prendre soin de l'enfant, l'éducation pratique concernant la formation du sujet . La formation pratique, à son tour, est divisé essentiellement en deux moments, la discipline et l'instruction. Nous avons l'intention ici d’examiner le rolê de la discipline dans le projet philosophique de la éducation pratique chez Kant. Nous vérifions la contrainte pour discuter de la question de la discipline dans l'éducation , donc nous avons l'intention d'élucider la pensée pédagogique de Kant, une tentative, par ailleurs, révéler d'éventuelles contributions de la modernité aux débats contemporains. Pour lê philosophe la discipline joue un rôle vital dans la l'éducation pratique – l'éducation d’être libre. Vous cherchez à exposer et justifier cette position, nous allons examiner quelques instants de la série de conférences «Sur la pédagogie» sans perdre les liens avec toute la réflexion théorique et pratique de Kant. During the coronavirus pandemic, communities have faced shortages of important healthcare resources such as COVID-19 vaccines, medical staff, ICU beds and ventilators. Public health officials in the U.S. have had to make decisions about two major issues: which infected patients should be treated first, and which people who are at risk of infection should be inoculated first. Following Beauchamp and Childress’s principlism, adopted guidelines have tended to value both whole lives and life-years. This process of collective moral reasoning has revealed (...) our common commitment to both Kantian and utilitarian principles. For Kant, respecting people’s rights entails that we ought to value whole lives equally. Therefore we ought to allocate resources so as to maximise the number of patients who survive to discharge. By contrast, the principle of utility has us maximise life-years so that people can satisfy more of their considered preferences. Although people are treated impartially in the utilitarian calculus, it does not recognise their equal worth. Subjecting Kantian ethics and utilitarianism to the process of reflective equilibrium lends support to the idea that we need a pluralistic approach that would accommodate our moral intuitions regarding both the equal value of whole lives and the additive value of life-years. Referring to the phenomenon of structural injustice resulting from unintended consequences of the combination of the actions of many people, Iris Marion Young claims for a new understanding of responsibility. She proposes what she calls a social connection model of responsibility which assigns responsibility to individuals also for participating in ongoing structural and social processes. To remedy structural injustice Young claims for collective action of various actors in society and assigns different degrees of responsibility depending on the agent’s position within (...) the structural process. However, although Young mentions power, privilege, interest, and collective ability as parameters influencing the degree of an actor’s responsibility to contribute to structural change she does not elaborate which responsibilities concern which groups in society. As we will outline in our contribution, we hold the tenet of subsidiarity to be a useful supplement to the conception of Iris Marion Young which would allow for assigning such responsibilities to different layers in society. However, since the tenet of subsidiarity is only a supple principle which does not distinguish between different kinds of duties, we propose to enrich the tenet of subsidiarity by the Kantian conception of perfect and imperfect duties. En último término, lo que aquí se explora -siguiendo siempre a Derrida- es una comprensión de la experiencia estética como sustracción, como (...) fractura del campo subjetivo por efecto de la introducción de una presencia irreductible.: This article presents a detailed account of the aesthetic subject’s deconstruction as developed by Jacques Derrida in his confrontation with Kant’s famous and influential Critique of judgment. At the same time, it places this enterprise in the context of Derrida’s corpus by making explicit the vast conceptual network that lies behind it. In the last analysis, what is here explored - following Derrida’s lead - is an understanding of aesthetical experience as subtraction, as a breach into the subjective field through the introduction of an irreducible non-presence. The ideological underpinning that guides our interaction with non-human animals needs revision. The traditional outlook, according to which humans have a higher moral status vis-à-vis non-human animals, is now otiose. If these claims are to be justified, what ideological framework would serve this end? What are the moral implications of endorsing the view that humans possess no higher moral status than non-human animals? This work takes as foundation Charles Darwins theory of evolution, which affirms that humans emerged from the long (...) chain of evolutionary history, where non-human animals have been the carriers of the genes that shaped humans. A revisit to the discourse on the moral implication of humans cruelty to their ancestors and neighbours becomes pertinent. This essay goes against the mainstream and dominant perspective that non-human animals exist to serve human ends and as such can be treated with disdain. The thesis of this paper goes beyond Peter Singers submission that sentience is the basis for conferring moral worth on non-human animals. It affirms that in addition to sentience, good neighbourliness is a factor in determining the moral worth of non-human animals. It submits that cruelty to reared and domesticated animals may produce violent and wild species of these animals kind in a future evolution, thereby endangering the lives of future human generation, through negative alteration of genes. In the end, this paper proposes the principle of biological altruism as a suitable norm for determining the moral worth of non-human animals. (shrink)

Objetivamos com este artigo, que é uma revisão de literatura, discutir sobre a autonomia a partir de enfoques da Filosofia, da Psicologia e da Sociologia. As contribuições de autores como Rousseau, Kant, Freud, Adorno, Agamben, Piaget, Kamii, Martins, Freire, Barguil, dentre outros, enriquecem uma leitura interdisciplinar da complexa relação entre autonomia e Educação. Concluímos que a autonomia não é uma característica do (...) sujeito, mas uma prática indispensável para o seu desenvolvimento individual e social, bem como para fortalecer o processo democrático. In the perspective of the philosophical archaeology proposed, here, the arkhé towards which archaeology regresses must not be understood in any way as an element that can be situated in chronology ; it is, rather, a force that operates in history—much in the same way in which Indoeuropean words express a system of connections among historically accessible languages, in which the child in psychoanalysis expresses an active force in the psychic life of the adult, in which the big bang, which (...) is supposed to have originated the universe, continues to send towards us its fossil radiation. But the arkhé is not a datum or a substance. It is much rather a field of bipolar historical currents within the tension of anthropogenesis and history, between point of emergence and becoming, between arch-past and present. And as such—that is to say, to the extent to which it is something that it is necessarily supposed to have factually happened, and which yet cannot be hypostatized in any chronologically identifiable event—it is solely capable of guaranteeing the intelligibility of historical phenomena, of ‘saving’ them archaeologically within a future perfect, yet not grasping its origin, but rather its history, at once finite and untotalizable. The integration of personalism into business ethics has been recently studied. Research has also been conducted on humanistic management approaches. The conceptual relationship between personalism and humanism , however, has not been fully addressed. This article furthers that research by arguing that a true humanistic management is personalistic. Moreover, it claims that personalism is promising as a sound philosophical foundation for business ethics. Insights from Jacques Maritain’s work are discussed in support of these conclusions. Of particular interest is his distinction (...) between human person and individual based on a realistic metaphysics that, in turn, grounds human dignity and the natural law as the philosophical basis for human rights, personal virtues, and a common good defined in terms of properly human ends. Although Maritain is widely regarded as one of the foremost twentieth century personalist philosophers, his contribution has not been sufficiently considered in the business ethics and humanistic management literature. Important implications of Maritainian personalism for business ethics as philosophical study and as practical professional pursuit are discussed. (shrink)

دیدگاه کریستین وُلف دربارۀ ‌‌ادراک حسی که چارچوبی لایب‌‌‌نیتسی دارد، اساس استتیک او را برمی‌‌‌سازد. او با توجه به ماهیت واضح ولی مغشوشِ ‌‌ادراک حسی در این چارچوب، مفهوم کمال و لذت را تبیین می‌‌‌کند و از همین معبر ره به تعریف زیبایی می‌‌‌برد. به این ترتیب، از نظر او، کمال همانا توافق یا هماهنگی کثرات یا انبوهی از اشیاء یا اجزای آن‌هاست؛ لذت، حاصل شهود کمال در اشیاء است؛ و زیبایی هم عبارت است از کمال شیْ‏ء از آن حیث (...) که برای ایجاد لذت در ما مناسب است. با این اوصاف، در این مقاله قصد داریم ماهیت ‌‌ادراک حسی نزد او و رابطۀ ادراک حسی، کمال و لذت را با زیبایی در استتیک او بکاویم تا مشخص شود چگونه علم استتیک به‌‌‌طور عام از دل مباحث معرفت‌‌‌شناختی و به‌‌‌طور خاص از بطن ‌‌ادراک حسی بیرون می‌‌‌آید. در نهایت‌‌، با در نظر داشتن این مهم که خود او مستقیماً داعیۀ نظریۀ مستقلی در حوزۀ استتیک نداشته، نقد و نظری بر لوازم مربوط به استتیک او خواهیم داشت تا حدود و ثغور نظریۀ عقل‌‌‌گرایانۀ مفرط او در برخورد با مسائلی چون دایرۀ شمول زیبایی، مراتب زیبایی و اختلاف‌‌‌نظرهای ذوقی مشخص شود. با تأمل در فلسفۀ ملاصدرا می‌توان دریافت که انسان موجودی است دارای استعدادهای نامحدود که با به فعلیت رسیدن در این عالم معنا پیدا می‌کند و چون به عنوان موجودی محدود تعلق وجودی به وجود لایتناهی دارد، تلاش می‌کند وجود خود را تحقق و معنا بخشد. لذا باتوجه به وجود تعلقی انسان و نقش عالم در معنا بخشی به وجود او، می‌توان به نسبت انسان با عالم و حرکت به سوی حق‌تعالی که غایت همۀ حرکت های اوست، پی برد. اما (...) وقتی دکارت «من» را در جایگاه «سوژه» و عالم را به عنوان«ابژه» در برابر آن بنا نهاد، «سوبژکتیویسم» و تقابل بین انسان با عالم به عنوان یکی از مهم‌ترین آثار آن در فلسفۀ غرب پدید آمد. در این مقاله هدف تبیین نسبت انسان و عالم است با التفات به حیثیت وجود تعلقی او در فلسفۀ صدرایی در مقابل ثنویت انسان و عالم که از آثار اجتناب ناپذیر «سوبژکتیویسم» است و بالاخره رسیدن به اینکه تعلق و وابستگی انسان به خداوند در حرکت جوهری و به تبع آن فقر جوهری است که انسان صدرایی را از سوبژکتیویسم و هر نوع تفکر خودبنیادی امتیاز می‌بخشد. Value conflicts between individualism and collectivism are common. In philosophy, such conflicts have been conceptualized as conflicts between individuality and conformity, among other things. This article develops a more detailed conceptual framework by combining philosophical analysis with empirical observations. The focus is on value conflicts pertaining to LGBT (lesbian, gay, bisexual, and transgender) factors in a non-individualist society (Georgia). Conservative or traditional norms sometimes constrain LGBT individuals by influencing them to adapt to social expectations. The phenomenon is intuitively clear and (...) has been reported on in numerous quantitative investigations. A qualitative study has been conducted on how LGBT individuals in Georgia experience the constraining influence of such norms. Deep interviews (n=8) have clarified how, more precisely, the effects of those influences should be conceptualized. The results indicate that important distinctions between different types of influences, as well as different objects of influence, have been overlooked in previous philosophical inquiries about value conflicts in this context. The conceptual framework developed throughout the article should be of use to philosophers and social scientists studying individualism and collectivism, and to policymakers working with LGBT issues. This book introduces the reader to Whitehead’s complex and often misunderstood metaphysics by showing that it deals with questions about the nature of causation originally raised by the philosophy of Leibniz. Whitehead’s philosophy is an attempt at rehabilitating Leibniz’s theory of monads by recasting it in terms of novel ontological categories.

Research into Kelsen’s conception of judicial justice seems at first sight contradictory to his own Pure Theory of Law. Upon closer consideration this prima facie contradiction turns out to be only an appearance due to the paradoxical effect that is produced by Kelsen’s pure theory of law itself. By revealing three paradoxical effects of Kelsen’s work in this article, I try to show that research into a Kelsenian representation of judicial justice is not only possible but also meaningful. The first (...) paradox originates from Kelsen’s formalised and value-free concept of law, which unexpectedly confronts the judge with his moral responsibility for the material valuation of the law. Secondly, a paradox arises from Kelsen’s rationalised notion of relative justice, which in fact forces the judge to be absolutely convinced of the moral rightness of his judgement. The third paradox is a result of Kelsen’s idea of objectivised ‘social peace’, by which the judge just realises the subjective and irrational demands of justice. From my analysis of these three seeming contradictions in Kelsen’s pure theory of law emerges an apparent Kelsenian representation of judicial justice. Starting from his pure theory of law it should be possible to conceive of a ‘pure’ form of administration of law, which would stipulate social peace as a condition for the ‘purity’ of a judicial judgement. I even imagine that Kelsen considered peace as a conditio tacita for the validity of the whole legal order, just as he regarded the basic norm as conditio per quam and effectivity as conditio sine qua non for the validity of the legal order. In any case, according to Kelsen’s conception of judicial justice, social peace proves to be the implicit or tacit condition for a ‘pure’ judgement. With that this ‘pacifying jurisprudence’ can be understood as a surprising paragon of a ‘pure’ administration of justice, on the understanding that peace is not a sufficient but an obvious condition for a just administration of law. That this should also apply mutatis mutandis for Kelsen’s concept of the legal order as a whole will be made subject of further research. (shrink)

Scientific theories are pure theoretical models integrated by a categorical scaffolding. Marx built a pure theoretical model that he called the capitalist mode of production; the historicity of its categories expresses the modes of production from which the capitalist comes and others that followed different paths. It also implies the existence of social formations in which a dominant mode of production and dominated forms of production coexist. The agrarian community is the highest form reached in the community entity and from (...) it comes the peasant economic unit generated in the parcelling of the land during the ancient form and gestation of capitalism, which is why the construction of a peasant mode of production does not proceed. Tomamos como certo que os nossos sentidos nos colocam em contato com o ambiente ao nosso redor. Enquanto caminhamos em uma rua, vemos obstáculos que temos de contornar ou remover. Mesmo de costas, podemos ouvir a bicicleta que se aproxima e dar passagem. Em suma, por meio de experiências perceptivas (visuais, auditivas, olfativas etc.), ficamos conscientes de objetos ou eventos que estejam ocorrendo ao nosso redor. Além disso, com base no que percebemos, podemos formar e manter crenças acerca do ambiente (...) e, assim, adquirir conhecimento perceptivo acerca do mundo. A importância desse conhecimento acerca do que está ao nosso alcance perceptivo é inestimável para a nossa sobrevivência e a condução de nossos projetos cotidianos. Contudo, podemos querer saber (1) se de fato temos acesso ao mundo físico circundante por meio das nossas experiências perceptivas, e (2) se e como essas experiências justificam as nossas crenças acerca do que percebemos. Esses problemas são centrais para a epistemologia da percepção, embora não sejam os únicos. Nessa entrada, abordaremos esses dois problemas. (shrink)

Stephenson (2022) has argued that Kant’s thesis that all transcendental truths are transcendentally a priori knowable leads to omniscience of all transcendental truths. His arguments depend on luminosity principles and closure principles for transcendental knowability. We will argue that one pair of a luminosity and a closure principle should not be used, because the closure principle is too strong, while the other pair of a luminosity and a closure principle should not be used, because the luminosity principle is too strong. Mise en abyme is a term from literary theory denoting a work that doubles itself within itself, for example a story placed within a story or a play within a play. Proliferating in experimental fiction in midcentury France, this technique had a strong impact on contemporary literary theory, but also, as this book project argues, on post-Heideggerian and post-structuralist philosophy. The Little Crystalline Seed focuses on how three of these thinkers invoke the concept of mise en abyme in order to (...) establish ontologies that deviate from that of Heidegger. Iddo Dickmann demonstrates how the concept served in modeling Derrida's logic of supplementarity, Blanchot's philosophy of "ambiguity" and mechanism of Désouvrement, and Deleuze's philosophy of difference, time and repetition. Exploring the interpretative and generative potential of the mise en abyme for continental thought, Dickmann illustrates points of resonance between various philosophical topics such as aesthetics, ethics, time, logic, mirroring, play, and signification. The present text deals with the question of the meaning of life in theexistentialist theory oft heNorwegian philosopher Peter Wessel Zapffe(1899–1990). In his book On the Tragic (1941), Zapffe sketched a theory of the human condition where the meaning of life plays a decisive role together with the human need for justice. This paper aims to reconstruct the central elements of Zapffe’s analysis and to discuss them critically by focusing on his claim that human beings need a fundamental meaning of (...) life as a whole that transcends meaning in life. I pay particular attention to Zapffe’s claim that life is meaningless, since the meaning of life is fundamentallylacking.I conclude that Zapffe’s analysis is problematic for reasons both internal and external to his theory. Does epistemology collapse for lack of resources other than logic, conceptual analysis and descriptions of one’s own apparent experiences, thoughts and beliefs? No, but understanding how and why not requires, Kant noted, a ‘changed method of thinking’. Some of these methodological changes are summarised in §2 in order to identify a philosophical role for thought experiments to help identify logically contingent, though cognitively fundamental capacities and circumstances necessary to human thought, experience and knowledge. Purpose. This paper aims to show how the views of Kant persist in the modern debate on social justice and to outline the practical and political potential contained in his understanding of a just state system and international justice. To that end, I will present what Kant meant by a just state system and just relationships between states. Then, I will reference his understanding of social justice against three fundamental models of social justice thus far established in the philosophical tradition: (...) the legal, distributive, and contractual justice. Finally, I will explain how the Kantian understanding of social justice is reflected in select modern interpretations of a just state system and justice in international relationships, and how we can grasp the current practice and the expected development of sociopolitical life in the framework of social justice as understood by Kant. Originality. The article presents the theoretical-conceptual and practical-political relevance of the concept of social justice, developed by I. Kant. It was shown that Kant considered justice to be the basis of all correct social relations, both at the level of individual states and in the sphere of international relations. According to Kant, the only just state system is a republic. In his opinion, justice in the field of international relations requires that they be based on the principles of federal unification of individual states. The concept of social justice developed by Kant can be identified as a form of classically understood contractual justice. In addition, Kan’s notion of justice was correlated with the works of modern authors: John Rawls, Robert Nozick and Otfried Höffe, showing identical and different elements in them. Conclusions. The reflections above suffice to assert that the Kantian understanding of social justice primarily involves the following observations: 1. under a relevant contract, interested parties institute a public authority, i.e. a republican state or a federal institution endowed with judicial or executive powers ; 2. the institution of public authority remains fair in dealings with the governed; 3. the public authority has the right to intervene only in the circumstances of threat to the external freedom, equality and independence of the governed individuals; 4. the public authority is responsible only for guaranteeing just relations between individuals and the enforcement of their contracts. Furthermore, Kantian understanding of justice falls within the scope of the classical notion of contractual justice and remains present in the modern debates on justice, as exemplified by the thought of Rawls, Nozick and Höffe. Finally, the Kantian understanding of social justice remains topical and worthy of consideration during the design and the development of current and future solutions for a just public order, both at the national and international level. A detailed, clear, and comprehensive overview of the current philosophical debate on. The question of when, and under what circumstances, the practice of torture might be justified has received a great deal of attention in the last decade in both academia and in the popular media. Many of these discussions are, however, one-sided with other perspectives either ignored or quickly dismissed with minimal argument. In On the Ethics of Torture, Uwe Steinhoff provides a complete account of the philosophical debate surrounding (...) this highly contentious subject. Steinhoff’s position is that torture is sometimes, under certain narrowly circumscribed conditions, justified, basing his argument on the right to self-defense. His position differs from that of other authors who, using other philosophical justifications, would permit torture under a wider set of conditions. After having given the reader a thorough account of the main arguments for permitting torture under certain circumstances, Steinhoff explains and addresses the many objections that have been raised to employing torture under any circumstances. This is an indispensible work for anyone interested in one of the most controversial subjects of our times. (shrink)

Do we need a new ethics? And if so: why? Just because Kant's Categorical Imperative (Cat. Imp.) seems to be no longer valid? Are there, nevertheless, values that survive the so-called "decay of values"? And if there are limits of ethics, e.g. in system conditions, one can ask if new legit requests are to be made. Or can ethics even be absorbed (or "abolished") in anthropology and philosophy of history?

Leibniz Reinterpreted tackles head on the central idea in Leibniz's philosophy, namely that we live in the best of all possible worlds. Strickland argues that Leibniz's theory has been consistently misunderstood by previous commentators. In the process Strickland provides both an elucidation and reinterpretation of a number of concepts central to Leibniz's work, such as 'richness', 'simplicity', 'harmony' and 'incompossibility', and shows where previous attempts to explain these concepts have failed. We give some lectures on the work on formal logic of Jacques Herbrand, and sketch his life and his influence on automated theorem proving. The intended audience ranges from students interested in logic over historians to logicians. Besides the well-known correction of Herbrand’s False Lemma by Goedel and Dreben, we also present the hardly known unpublished correction of Heijenoort and its consequences on Herbrand’s Modus Ponens Elimination. Besides Herbrand’s Fundamental Theorem and its relation to the Loewenheim-Skolem-Theorem, we carefully investigate Herbrand’s (...) notion of intuitionism in connection with his notion of falsehood in an infinite domain. We sketch Herbrand’s two proofs of the consistency of arithmetic and his notion of a recursive function, and last but not least, present the correct original text of his unification algorithm with a new translation. Em tempos de cultura digital, observa-se o acesso a uma quantidade incomensurável de informações sem que sejam feitas relações que poderiam transformá-las em conceitos. Uma vez que prevalece o uso instrumental de tais informações, arrefece concomitantemente a postura ética que o questiona. É nesse contexto que o professor ocupa um posto decisivo no que diz respeito à organização e à discussão de tais informações com seus alunos. Este artigo tem como objetivo argumentar que a postura de Pedro Goergen como educador (...) oferta aos alunos um tipo de relação que faz com que a própria figura do professor seja eticamente ressignificada nessa sociedade de cultura digital.
