There is a long tradition comparing moral knowledge to mathematical knowledge. In this paper, I discuss apparent similarities and differences between knowledge in the two areas, realistically conceived. I argue that many of these are only apparent, while others are less philosophically significant than might be thought. The picture that emerges is surprising. There are definitely differences between epistemological arguments in the two areas. However, these differences, if anything, increase the plausibility of moral realism as compared to mathematical realism. It (...) is hard to see how one might argue, on epistemological grounds, for moral antirealism while maintaining commitment to mathematical realism. But it may be possible to do the opposite. The method of reflective equilibrium (MRE) is a method of justification popularized by John Rawls and further developed by Norman Daniels, Michael DePaul, Folke Tersman, and Catherine Z. Elgin, among others. The basic idea is that epistemic agents have justified beliefs if they have succeeded in forming their beliefs into a harmonious system of beliefs which they reflectively judge to be the most plausible. Despite the common reference to MRE as a method, its mechanisms or rules are typically expressed in (...) a metaphorical or simplified manner and are therefore criticized as too vague. Recent efforts to counter this criticism have been directed towards the attempt to provide formal explications of MRE. This paper aims to supplement these efforts by providing an informal working definition of MRE. This approach challenges the view that MRE can adequately be characterized only in the negative as a set of anti-essentialisms. I argue that epistemic agents follow MRE iff they follow four interconnected rules, which are concerned with a minimalistic form of foundationalism, a minimalistic form of fallibilism, a moderate form of holism, and a minimalistic form of rationality. In the critical spirit of MRE, the corresponding working definition is, of course, provisional and revisable. In general, the aim is to contribute to a reflective equilibrium (RE) concerning MRE. If it is successful, this working definition provides a better grasp of the most basic elements of the method and thereby enhances our understanding of it. (shrink)

While recent discussions of contextualism have mostly focused on other issues, some influential early statements of the view emphasized the possibility of its providing an alternative to both coherentism and traditional versions of foundationalism. In this essay, I will pick up on this strand of contextualist thought, and argue that contextualist versions of foundationalism promise to solve some problems that their non-contextualist cousins cannot. In particular, I will argue that adopting contextualist versions of foundationalism can let us reconcile Bayesian accounts (...) of belief updating with a version of the holist claim that all beliefs are defeasible. Despite the rapidly growing literature on realism, there’s little discussion of the ideology critique of John Rawls offered by one of its leading lights, Raymond Geuss. There is little understanding of what (most of) this critique consists in and few discussions of how Rawls’ approach to political theorising may be defended against it. To remedy this situation, this article reconstructs the realist ideology critique of Rawls advanced by Raymond Geuss, which has three prongs: (1) Rawls’ political theory offers insufficient tools (...) to uncover and address distortions of our political values, beliefs, and intuitions; (2) it unacceptably reinforces these distortions by unduly legitimating them; and (3) it diverts attention from important features of real politics. With this done, I finish by considering how Rawlsians can respond, chiefly by employing a kind of reflective equilibrium, or reflective endorsement, broad enough to encompass different forms of genealogy and ideology critique. We discuss the social-epistemic aspects of Catherine Elgin’s theory of reflective equilibrium and understanding and argue that it yields an argument for the view that a crucial social-epistemic function of epistemic authorities is to foster understanding in their communities. We explore the competences that enable epistemic authorities to fulfil this role and argue that among them is an epistemic virtue we call “epistemic empathy”.

This open access book provides the first explicit case study for an application of the method of reflective equilibrium (RE), using it to develop and defend a precautionary principle. It thereby makes an important and original contribution to questions of philosophical method and methodology. The book shows step-by-step how RE is applied, and develops a methodological framework which will be useful for everyone who wishes to use reflective equilibrium. With respect to precautionary principles, the book demonstrates how a rights-based precautionary (...) principle can be constructed and defended. The case study succeeds in demonstrating that RE can be successfully applied and puts real constraints on the justification process. This is all the more remarkable as the case study was designed as an open-ended process, without presupposing any specific results. This book will be highly relevant both to people interested in philosophical methodology and epistemology, as well as to researchers who are interested in using philosophical methods and tools and applying them to practical problems. Are intrinsic desires subject to reasoned criticism, and if they are, what is about them that makes them subject to such criticism? It is argued that though the answer given to this question in The Moral Problem is wrong, a more promising answer can be found if we attend to the metaphysics of agency.

The idea of reflective equilibrium remains the most popular approach to questions about method in ethics, despite the masses of criticism it has been faced with over the years. Is this due to the availability of compelling responses to the criticisms or rather to factors that are independent of its reasonableness? The aim of this paper is to provide support for the first answer. I particularly focus on the recent discussion. Some recent objections are related to general arguments against the (...) possibility of moral knowledge, such as so-called “evolutionary debunking arguments.” I argue that nothing that has come to light in that debate, or in the recent discussion about IRE more generally, decisively strengthens the case against it. If anything, the recent developments show that IRE deserves its present status. (shrink)

John Rawls’ method of reflective equilibrium is the most influential methodology in contemporary ethics.This paper argues that this influence is undeserved, for two reasons. First, reflective equilibrium fails to accomplish two tasks that give us reason to care about methodology. On the one hand, it fails to explain how (or whether) moral knowledge is possible.This is because the method is explicitly oriented towards the distinct (and less interesting) task of characterizing our moral sensibilities. On the other hand, the method fails (...) to provide an informative way of adjudicating central methodological debates in ethics. Second, where Rawls’ method –and the background methodology he uses to motivate it –do have substance, that substance is implausible. The role of dispositions in the method entails that it endorses obviously irrational inferences. Further, the method makes substantively implausible distinctions between the dispositions that are allowed to play a methodological role. Rawls' background methodology appeals to the idea of a psychology in ‘wide reflective equilibrium’. However, both formal and empirical path-dependence considerations strongly suggest that there is nothing even minimally determinate that is someone’s psychology in ‘wide reflective equilibrium’. I close by exploring salient attempts to salvage the spirit of reflective equilibrium by abandoning elements of Rawls’ approach. I argue that none of these attempts succeed. I conclude that appeal to the method of reflective equilibrium is not a helpful means of addressing pressing methodological questions in ethics. This paper is about how moral disagreement matters for metaethics. It has four parts. In the first part I argue that moral facts are subject to a certain epistemic accessibility requirement. Namely, moral facts must be accessible to some possible agent. In the second part I show that because this accessibility requirement on moral facts holds, there is a route from facts about the moral disagreements of agents in idealized conditions to conclusions about what moral facts there are. In the (...) third part I build on this route to show that (*) if there is significant moral disagreement in idealized conditions, then our understanding of morality is fatally flawed and we should accept relativism over non-naturalism and quasi-realism. So, if, like many, you think that there would be significant moral disagreement in idealized conditions, you should hold that our understanding of morality is fatally flawed and reject non-naturalism and quasi-realism. In the fourth part of this paper I show that (*) undermines the plausibility of non-naturalism, quasi-realism, and the view that our understanding of morality is not fatally flawed even if we do not have sufficient reason to believe that there would be significant moral disagreement in idealized conditions. How can we figure out what’s right or wrong, if moral truths are neither self-evident nor something we can perceive? Very roughly, the method of reflective equilibrium (RE) says that we should begin moral inquiry from what we already confidently think, seeking to find a a match between our initial convictions and general principles that are well-supported by background theories, mutually adjusting both until we reach a coherent outlook in which our beliefs are in harmony (the equilibrium part) and we (...) know why and how they support each other (the reflective part). It has been central to the self-understanding of normative ethics and other branches of philosophy in the last half a century. In this chapter, we examine the history of the idea of RE and introduce a schema for generating 256 variants. We explain why RE is subject to serious objections insofar as it purports to yield epistemic justification in virtue of achieving coherence. However, we also develop a new argument to the effect that RE is the best feasible method for us to achieve moral understanding and the ability to justify our judgments to others. It may thus be crucial for responsible moral inquiry, even if coherence among considered judgments and principles is neither sufficient nor necessary for justified moral belief. (shrink)

Reflective equilibrium —the idea that we have to justify our judgments and principles through a process of mutual adjustment—is taken to be a central method in philosophy. Nonetheless, conceptions of RE often stay sketchy, and there is a striking lack of explicit and traceable applications of it. This paper presents an explicit case study for the application of an elaborate RE conception. RE is used to reconstruct the arguments from Thomson’s paper “Turning the Trolley” for why a bystander must not (...) divert a runaway trolley from five workmen onto one. Analyzing Thomson’s resulting position with the RE-criteria has two main results: Firstly, the adjustment of one of her commitments can be defended. Secondly, no justified position in RE was reached. With respect to RE as a method, the main results from this application are: There is at least one conception of RE that is sufficiently specified to be applicable; the RE criteria put real constraints on the process of justification; and an explicit application of RE has benefits in terms of clarity while at the same time providing guidance for how the justificatory process could be continued. Ever since the introduction of reflective equilibrium in ethics, it has been argued that reflective equilibrium either leads to moral relativism, or that it turns out to be a form of intuitionism in disguise. Despite these criticisms, reflective equilibrium remains the most dominant method of moral justification in ethics. In this paper, I therefore critically examine the most recent attempts to defend the method of reflective equilibrium against these objections. Defenders of reflective equilibrium typically respond to the objections by saying (...) that either reflective equilibrium can in fact safeguard moral objectivity or alternatively, even if it cannot, that there simply are no reasonable alternatives. In this paper, I take issue with both responses. First, I argue that given the non-foundationalist aspirations of reflective equilibrium, moral objectivity cannot be maintained. Second, I argue that reflective equilibrium is not the only game in town once intuitionism has been discarded. I argue that given their own normative ambitions, combined with their rejection of intuitionism, proponents of reflective equilibrium have reason to take alternative methods of moral justification, and more specifically transcendental arguments, more seriously than they have done so far. I end by sketching the outlines of what this alternative methodology might look like. (shrink)

This is a paper about model-building and overfitting in normative ethics. Overfitting is recognized as a methodological error in modeling in the philosophy of science and scientific practice, but this concern has not been brought to bear on the practice of normative ethics. I first argue that moral inquiry shares similarities with scientific inquiry in that both may productively rely on model-building, and, as such, overfitting worries should apply to both fields. I then offer a diagnosis of the problems of (...) overfitting in moral inquiry and explain how our current practice seems worryingly susceptible to such problems. I conclude by giving suggestions for how we might avoid overfitting when doing normative ethics. (shrink)

Recent years have seen a rekindling of interest in the method of reflective equilibrium. Most of this attention has been suspicious, however. Critics have alleged that the method is nothing more than a high-minded brand of navel-gazing, that it suffers from all the classic problems of inward-looking coherence theories, and that it overestimates the usefulness of self-scrutiny. In this paper I argue that these criticisms miss their mark because they labor under crucial misconceptions about the method of reflective equilibrium. In (...) defending reflective equilibrium I put forward a handful of theses about the nature of inquiry (or, more generally, norm-governed enterprises) that form the backdrop to the method. The critics’ objections fall short, I argue, because they do not recognize reflective equilibrium’s embrace of these theses. Confronting these objections and understanding why they fail brings us to a better understanding what, exactly, the method of reflective equilibrium is. The answer I come to in the final section of the paper is that the method of reflective equilibrium is not, exactly, anything. It is a mistake to try to give a positive characterization of the view, to identify it with a concern with a particular species of data, particular procedures and methods, or even a particular conception of normative success. Instead, it should be understood as the denial of essentialism about just these matters—as a form of anti-essentialism about our epistemic inputs, methods, and goals. (shrink)

Reflective equilibrium ("RE", for short) is a method of justification which works roughly as follows: We start with our pre-theoretical judgements (about, e.g. moral issues) and try to explain them by a systematic theory. This leads to a process in which judgements and principles are mutually adjusted to each other until a state of equilibrium is reached. For more than half a century, RE has been very popular, as well as controversial, among philosophers of many persuasions. Given how frequently the (...) method is mentioned, embraced and attacked, it is surprising that only very few attempts have been made at analysing and developing RE in detail. How is moral knowledge possible? This paper defends the anti-Humean thesis that we can acquire moral knowledge by deduction from wholly non-moral premises. According to Hume’s Law, as it has become known, we cannot deduce an ‘ought’ from an ‘is’, since it is “altogether inconceivable how this new relation can be a deduction from others, which are entirely different from it” (Hume, 1739, 3.1.1). This paper explores the prospects for a deductive theory of moral knowledge that rejects Hume’s Law.

This paper investigates the ethics of regarding others as epistemically hopeless. To regard a person as epistemically hopeless with respect to p is, roughly, to regard her as unable to see the truth of p through rational means. Regarding a person as epistemically hopeless is a stance that has surprising and nuanced moral implications. It can be a sign of respect, and it can also be a way of giving up on someone. Whether it is morally problematic to take up (...) this stance, I argue, depends on the choices that one faces (or is likely to face). I close the paper by arguing against the view that there are standing moral reasons against regarding others as epistemically hopeless. (shrink)

What is the connection between justification and truth in moral epistemology? The primary goal of this paper is to argue that you cannot have justified false beliefs about your own moral obligations. The secondary goal is to explain why not. Some epistemologists embrace a global truth-connection in epistemology, according to which epistemic justification is always factive. In contrast, I endorse a local truth-connection in moral epistemology, which says that epistemic justification is factive when it concerns your own moral obligations. To (...) explain this, I appeal to a version of moral rationalism, which says there are necessary truths about morality that everyone has a priori justification to believe. (shrink)

The main aim of this paper is to propose the inclusion of the expertise of a prudent agent in the reflective equilibrium procedure, adding a disposition to identify reasonable beliefs that would be seen as the starting point of the method, which could avoid the criticism of conservatism and subjectivism. To do so, I will begin by analyzing the central characteristics of the method and its main faults. Afterwards, I will investigate the characteristics of prudence as a disposition to identify (...) the adequate means to achieve a good end. With this in mind, I will apply prudence to the procedure, so that it will be carried out by an agent who deliberates well, identifying reasonable moral beliefs and, then, we must justify them based on their consistency with ethical principles and with the factual beliefs of relevant scientific theories. Finally, I will argue that this deliberative process is consistent with ethical pluralism and democracy, and can be taken as a kind of moral knowledge. (shrink)

Contemporary political philosophers often take for granted that for political purposes all humans are to be considered of equal worth. The difficulty, as Bernard Williams observed, is to find an interpretation of this claim that does not collapse into absurdity or triviality. I show that the principal attempts to solve this problem all beg the question against an Aristotelian proponent of natural hierarchy. I then explore existing proposals for dissolving the problem of basic equality, whether by denying the need for (...) justification altogether or by reframing justification in either ostensive or coherentist fashion, showing that each fails to account for our sense that basic equality is objectively true. In response, I outline a Hegelian approach that treats the commitment to basic equality as a social fact that constrains philosophical reasoning in contemporary liberal democracies. By itself that might suggest complacent conservatism or cultural relativism, but I argue that practices and institutions that reflect and foster a commitment to basic equality have a distinct value in permitting reciprocal recognition and thereby enabling us to make a distinct class of normative claims on one another. This Hegelian resolution of the problem is dialectically superior to its rivals and therefore warrants further development. (shrink)

What can we know? How should we live? What is there? Philosophers famously diverge in the answers they give to these and other philosophical questions. It is widely presumed that a lack of convergence on these questions suggests that philosophy is not progressing at all, is not progressing fast enough, or is not progressing as fast as other disciplines, such as the natural sciences. Call the view that ideal philosophical progress is marked by at least some degree of convergence on (...) the core philosophical questions the pro-convergence thesis. I will argue that there is reason to reject the pro-convergence thesis in favor of the anti-convergence thesis, the view that significant viewpoint convergence is at odds with the aims of a philosophically ideal community. The argument centers on a thought experiment about two different philosophical communities. (shrink)

Carson Strong has recently argued that wide reflective equilibrium (WRE) is an unacceptable method of justification in bioethics. In its place, Strong recommends a methodology in which certain foundational moral judgments play a central role in the justification of moral beliefs, and coherence plays a limited justificatory role in that the rest of our judgments are made to cohere with these foundational judgments. In this paper, I argue that Strong’s chief criticisms of WRE are unsuccessful and that his proposed alternative (...) is in fact just another version of WRE. In the course of doing so, I specify which theses are central to WRE and which are not, and thus, provide a response to an additional objection, advanced by Peter Singer, that WRE is vacuous. I conclude by arguing that there may be better prospects for advancing the debate regarding methodology in bioethics if we focus on restricted epistemic and methodological theses rather than broad approaches, such as WRE, that come in many different varieties. This paper aims to flesh out the celebrated notion of reflective equilibrium within a probabilistic framework for epistemic rationality. On the account developed here, an agent's attitudes are in reflective equilibrium when there is a certain sort of harmony between the agent's credences, on the one hand, and what the agent accepts, on the other hand. Somewhat more precisely, reflective equilibrium is taken to consist in the agent accepting, or being prepared to accept, all and only claims that follow from (...) a maximally comprehensive theory that is more probable than any other such theory. Drawing on previous work, the paper shows that when an agent is in reflective equilibrium in this sense, the set of claims they accept or are prepared to accept is bound to be logically consistent and closed under logical implication. The paper also argues that this account can explain various features of philosophical argumentation in which the notion of reflective equilibrium features centrally, such as the emphasis on evaluating philosophical theories holistically rather than in a piecemeal fashion. Public justification in political liberalism is often conceptualized in light of Rawls’s view of its role in a hypothetical well-ordered society as an ideal or idealizing form of justification that applies a putatively reasonable conception of political justice to political matters. But Rawls implicates a different idea of public justification in his doctrine of general reflective equilibrium. The paper engages this second, more fundamental idea. Public justification in this second sense is actualist and fundamental. It is actualist in that it (...) fully enfranchises actual reasonable citizens. It is fundamental in that political liberalism qualifies conceptions of political justice as reasonable to begin with only if they can be accepted coherently by actual reasonable citizens. Together, these features invite the long-standing concern that actualist political liberalism is objectionably exclusionary. I argue that the exclusion objection, while plausible, is more problematic in own right than it seems if actualist and fundamental public justification hypotheticalizes and discursive respect is compatible with substantive discursive inequality. This leaves proponents and critics of political liberalism with deeper questions about the nature of permissible discursive inequality in public justification. (shrink)

I argue that the three drugs example makes trouble for the role Smith gives to being fully rational in his solution to the moral problem, given his understanding of what it takes to be fully rational. I conclude by suggesting he might have drawn on a different understanding of what it takes to be fully rational.

Thomas Scanlon and Derek Parfit have recently defended a meta-ethical view that is supposed to satisfy realistic intuitions about morality, without the metaphysical implications that many find hard to accept in other realist views. Both philosophers argue that truths in the normative domain do not have ontological implications, while truths in the scientific domain presuppose a metaphysical reality. What distinguishes Scanlon and Parfit’s approach from other realistic meta-ethical theories is that they maintain that normative entities exist in a way that (...) is different from (some) non-normative entities. Moreover, they think that this view about the way normative entities exist helps to answer the metaphysical worries that are often thought to plague non-naturalism. To make sense of this idea, I develop their view as a version of alethic pluralism: the position that there is more than one truth property. I argue, however, that when their view is developed in this way it fails to satisfy realistic intuitions about morality. This shows that on a plausible and initially promising reading of what it takes for a normative entity to exist in a way that is different from non-normative entities, Parfit’s and Scanlon’s non-metaphysical moral realism fails to be more realistic than contemporary versions of anti-realism. This paper examines the apparent tension in Michael Smith’s The Moral Problem between his commitment to convergence in ideal desires and his acceptance of agentrelative reasons, particularly those grounded in first-personal perspectives like the parent-child relationship. While Smith maintains that ideal desires are agent-invariant and converge on what is universally desirable, he also endorses agent-relative reasons that imply agent-centered normative commitments. I argue that resolving this tension requires rethinking convergence. Specifically, I propose extending the first-personal („de se“) nature of agent-relative (...) reasons to the objects of convergence, which I term „de se aims.“ By recognizing these aims as value bearers, we can reconcile agentrelativity with the universality of desirability, preserving Smith’s broader metaethical commitments. The proposal avoids the pitfalls of agent-relative value theories and illuminates the role of perspective-dependent aims in systematic justification. (shrink)

When Michael Smith published The Moral Problem, he advocated only Weak Moral Rationalism: the view that moral requirements always provide us with reasons that are relevant to the rationality of our action. But in the intervening years he has changed his position. He now holds Strong Moral Rationalism: the view that moral requirements are all-things-considered rational requirements. In this paper I argue that his change in view was motivated by two things. The first is his correct view that acting as (...) one is morally required to act is never irrational. The second is what David Copp has called The Unitary View of Reasons: the idea that there are both moral reasons for action, and non-moral ones, and both sorts count as reasons that determine what is rational to do. This combination of views pushes Smith to hold that an act counts as morally required just in case the moral reasons that favor it outweigh all other reasons, both moral and non-moral. But, I argue, there is an attractive position between Weak and Strong Moral Rationalism, which I call Moral Permissibilism. On such a view, moral requirements, while not always rational requirements (as against Strong Moral Rationalism), are always rationally permissible (as against Moral Anti-Rationalism). In order to advocate this common-sensical position, however, one must abandon the Unitary View of Reasons, and recognize that reasons of different kinds contribute to different kinds of normative verdicts. We build a model of the reflective equilibrium method to better understand under what conditions a community of agents would achieve a shared equilibrium. We find that, despite guaranteeing that agents individually reach equilibrium and numerous constraints on how agents deliberate, it is surprisingly difficult for a community to converge on a small number of equilibria. Consequently, the literature on reflective equilibrium has underestimated the challenge of coordinating intrapersonal convergence and interpersonal convergence.

What does it take for an argument to be a success? Peter van Inwagen argues that an argument for conclusion c is one that, when ideally presented in the company of an ideal opponent, would be convincing to an audience of ideal neutral agnostics about c. He goes on to argue that, by this criterion, there are (almost certainly) no successful arguments for substantive philosophical conclusions. I outline several problems with both van Inwagen's account of success and the others in (...) the literature, and argue for an alternative conception--one that allows for the existence of successful arguments for substantive philosophical conclusions. This alternative conception of success is individualistic, in that it relativizes success to the individual evaluating it. I argue that this form of relativism is not as bad as it seems. (shrink)

According to Roderick Chisholm, there are three ways of responding to the Problem of the Criterion and they all leave something to be desired. Michael DePaul, Paul Moser, and Earl Conee have each proposed variations of a fourth way of responding to this problem that rely on reflective equilibrium. We argue that these four options for responding to the Problem of the Criterion leave one with a tough choice: accept one of the three that Chisholm describes or DePaul’s reflective equilibrium (...) approach and beg the question or accept a reflective equilibrium response of the sort Conee and Moser propose and embrace epistemic circularity. The idea of using biomedical means to make people more likely to behave morally may have a certain appeal. However, it is very hard to find two persons – let alone two moral philosophers – who agree on what it means to be moral or to act morally. After discussing some of the proposals for moral enhancements that all ethicists could agree on, I engage more closely with the recent idea of “procedural moral enhancement” that aims at improving deliberative processes (...) instead of particular moral views, motivations, or dispositions. I argue that it is better understood as a contribution to moral epistemology and should thus be labeled “moral-epistemic enhancement”. I then defend perspective-taking as a moral epistemic capacity which can be enhanced by both traditional and non-traditional biomedical means; a capacity which almost always contributes to the epistemic value of moral decision-making. Perspective-taking seems to be an uncontroversial non-trivial capacity for moral decision-making reasonably widely shared by proponents of ethical beliefs within the academic community. The enhancement of this capacity is thus a good candidate for an uncontroversial non-trivial moral enhancement. (shrink)

I identify the central theses of True Enough and argue that Elgin's principal argument for her non-factive view of understanding fails. This argument emphasizes the cognitive contributions of science (and other disciplines) that occur via false claims. Careful reflection reveals that it is actually Elgin’s view that mishandles those contributions. Her non-factive view is also unable to accommodate other types of epistemic improvement, and makes a range of simple comparisons of understanding impossible.

The lingering mystery of John Rawls’s reflective equilibrium is that its nature is unclear. Rawls at times suggests he is merely describing people’s conceptions of justice, whereas at other times he implies that his reflective equilibrium is a way to justify his conception of justice. Faced with seemingly conflictual passages, most scholars privilege the justificatory ones. However, I argue that this is not an effective strategy because understanding how the descriptive and justificatory aspects of reflective equilibrium fit together is the (...) key to unlocking its nature and actual force. This paper compares Rawls’s method to the philosophical method of later Wittgenstein in his so-called private language argument to argue how the descriptive and justificatory aspects of Rawls’s reflective equilibrium fit together. In my view, both philosophers’ methods are descriptive clarifications of our unclear conceptions. However, their clarification is not just descriptive; they also aim at their readers achieving enlightenment. Importantly, I argue, that enlightenment offers us justification of the conception resulting from their clarification. Hence, their methods are justificatory as well. Finally, I claim that this way of understanding reflective equilibrium makes us realise how Rawls could respond to a prominent objection to it. (shrink)

Metaethics is often dominated by both realist views according to which moral claims are made true by either non-natural or natural properties and by non-cognitivist views according to which these claims express desire-like attitudes. It is sometimes suggested that constructivism is a fourth alternative, but it has remained opaque just how it differs from the other views. To solve this problem, this article first describes a clear constructivist theory based on Crispin Wright’s anti-realism. It then outlines an argumentative strategy that (...) can be used to argue against constructivist views about practical reasons. The rest of the article explains how the outlined constructivist metaethical framework, reasons, and contractualism in normative ethics can still be used to create a new viable metaethical constructivist position about right and wrong. The motivating question of this paper is: ‘How are our beliefs in the theorems of mathematics justified?’ This is distinguished from the question ‘How are our mathematical beliefs reliably true?’ We examine an influential answer, outlined by Russell, championed by Gödel, and developed by those searching for new axioms to settle undecidables, that our mathematical beliefs are justified by ‘intuitions’, as our scientific beliefs are justified by observations. On this view, axioms are analogous to laws of nature. They are postulated (...) to best systematize the data to be explained. We argue that there is a decisive difference between the cases. There is agreement on the data to be systematized in the scientific case that has no analog in the mathematical one. There is virtual consensus over observations, but conspicuous dispute over intuitions. In this respect, mathematics more closely resembles stereotypical philosophy. We conclude by distinguishing two ideas that have long been associated -- realism (the idea that there is an independent reality) and objectivity (the idea that in a disagreement, only one of us can be right). We argue that, while realism is true of mathematics and philosophy, these domains fail to be objective. One upshot of the discussion is that even questions of fundamental physics may fail to be objective in roughly the sense that the question, ‘Is the Parallel Postulate is true?’, understood as one of pure mathematics, fails to be. Another is a kind of pragmatism. Factual questions in mathematics, modality, logic, and evaluative areas go proxy for non-factual practical ones. -/- . (shrink)

I address the worry that reflective equilibrium is too weak as an account of justification because it fails to let differing views converge. I take up informal aspects of convergence and operationalise them in a formal model of reflective equilibrium. This allows for exploration by the means of computer simulation. Findings show that the formal model does not yield unique outputs, but still boosts agreement. I conclude from this that reflective equilibrium is best seen as a pluralist account of justification (...) that cannot be accused of resulting in an “anything goes” relativism. (shrink)

The COVID-19 pandemic has coincided with the proliferation of ethical guidance documents to assist public health authorities, health care providers, practitioners and staff with responding to ethical challenges posed by the pandemic. Like ethical guidelines relating to infectious disease that have preceded them, what unites many COVID-19 guidance documents is their dependency on an under-developed approach to bioethical principlism, a normative framework that attempts to guide actions based on a list of prima facie, unranked ethical principles. By situating them in (...) relation to the key philosophical debates concerning bioethical principlism, we aim to explore the limits and limitations of pandemic ethical guidance documents as, specifically, ethics documents – documents that fulfil the functions of ethics as a fundamentally normative discipline. This means not only determining whether such ethical guidance documents can, in principle, provide adequate action guidance and action justification, but also, more importantly where pandemics are concerned, determining whether they support consistent decision making and transparent processes of justification. Having highlighted the problems with merely furnishing ethical guidelines with substantive ethical content in terms of principles and values, we argue that organizations that develop these documents should, instead, focus on the procedural dimensions of action guidance and action justification, which extend to questions regarding the make-up of the committees, panels and groups that develop such guidelines, the public transparency of justifications for specific pandemic-related advice or interventions and the development of explicit procedures for transparent and consistent decision making. Ordinary Language Philosophy has largely fallen out of favour, and with it the belief in the primary importance of analyses of ordinary language for philosophical purposes. Still, in their various endeavours, philosophers not only from analytic but also from other backgrounds refer to the use and meaning of terms of interest in ordinary parlance. In doing so, they most commonly appeal to their own linguistic intuitions. Often, the appeal to individual intuitions is supplemented by reference to dictionaries. In recent times, (...) Internet search engine queries for expressions of interest have become quite popular. Apparently, philosophers attempt to surpass the limits of their own linguistic intuitions by appealing to experts or to factual uses of language. I argue that this attempt is commendable but that its execution is wanting. Instead of appealing to dictionaries or Internet queries, philosophers should employ computer-based linguistic corpora in order to confirm or falsify hypotheses about the factual use of language. This approach also has some advantages over methods employed by experimental philosophers. If the importance of ordinary language is stressed, the use of linguistic corpora is hardly avoidable. In Being Realistic About Reasons,T.M. Scanlon develops a non-naturalistic realist account of normative reasons. A crucial part of that account is Scanlon’s contention that there is no deep epistemological problem for non-naturalistic realists, and that the method of reflective equilibrium suffices to explain the possibility of normative knowledge. In this critical notice we argue that this is not so: on a realist picture, normative knowledge presupposes a significant correlation between distinct entities, namely between normative beliefs and normative facts. Distributive egalitarians believe that distributive justice is to be explained by the idea of distributive equality (DE) and that DE is of intrinsic value. The socio-relational critique argues that distributive egalitarianism does not account for the “true” value of equality, which rather lies in the idea of “equality as a substantive social value” (ESV). This paper examines the socio-relational critique and argues that it fails because – contrary to what the critique presupposes –, first, ESV is not conceptually distinct from (...) DE, and second, the idea of ESV cannot serve as a “foundation” or “root” of distributive egalitarianism. (shrink)

Despite their contemporaneity and obvious similarities, Richard Price and Immanuel Kant are rarely discussed together. This essay examines the common background of their work, similarities in their methodology and principles, and their common concern with connecting rationalist philosophical systems with knowledge at the level of ordinary life and politics – all this despite their lack of reference to each other. Their normative principles are assessed in connection with major documents and political events in their revolutionary era. A concluding section evaluates (...) their work in relation to contemporary discussions that concern the relationship between pre-reflective and reflective levels of moral knowledge. Como devemos conduzir nossas investigações morais para decidir no que acreditar sobre questões morais? Como a plausibilidade de juízos, teorias e princípios morais deve ser avaliada? Como devemos tentar remover nossas dúvidas quando estamos incertos sobre o que é certo ou errado, bom ou mau, justo ou injusto? O método do equilíbrio reflexivo, desenvolvido por John Rawls em A Theory of Justice e desde então adotado por um crescente número de filósofos, é uma tentativa de responder a questões como essas. (...) O equilíbrio reflexivo pode ser interpretado de vários modos, muitos dos quais completamente incompatíveis entre si, mas as duas visões mais representativas do método são os modelos coerentista e intuicionista. Neste artigo o meu objetivo é argumentar que nós deveríamos entender o equilíbrio reflexivo como um método intuicionista de investigação moral. Assim, eu comparo essas duas visões, como elas diferem no modo como concebem o funcionamento e os objetivos do método, para defender que a tradição coerentista de interpretação do método reduz a investigação moral a uma mera busca por coerência, com isso ignorando a função metodológica que intuições morais desempenham em nossas reflexões morais. Em contraste, a interpretação intuicionista oferece um modelo de investigação que integra intuição morais com a busca por coerência, explicando por que e como esses dois elementos funcionam em conjunto em nossas reflexões morais. A minha alegação é a de que apenas quando o equilíbrio reflexivo é interpretado de acordo com esse modelo intuicionista que ele pode ser visto em uso na prática reflexiva de filósofos morais reconhecidamente competentes, como John Rawls, Judith Jarvis Thomson e Peter Singer. We argue that Reasons Fundamentalism, as defended by T.M. Scanlon, faces two important difficulties—one ontological, the other epistemological—namely theontological proliferation problemand thereliability challenge.We suggest that formal constructivism can avoid these difficulties, and that Scanlon would do well to adopt it. We also show that Scanlon’s three main objections to this view depend either on a misunderstanding of what formal constructivism is or on a question-begging argument in favour of realism.

This dissertation is a contribution to the field of empirically informed metaethics, which combines the rigorous conceptual clarity of traditional metaethics with a careful review of empirical evidence. More specifically, this work stands at the intersection of moral psychology, moral epistemology, and philosophy of action. The study comprises six chapters on three distinct (although related) topics. Each chapter is structured as an independent paper and addresses a specific open question in the literature. The first part concerns the psychological features and (...) cognitive function of moral intuition. Chapter 1 (“Moral intuition, strength, and metacognition”) is focused on the concept of intuitive strength, which is one of the defining features of moral intuition. I provide a metacognitive account of intuitive strength and show why such a view is preferable to emotional or quasi-perceptual accounts. Then, in Chapter 2 (“Dual process reflective equilibrium”), I will discuss the interplay between intuition and reflection in moral reasoning. I will contend that the influential “default-interventionist” model of reasoning, theorized by Greene, is insufficiently supported by the evidence. In light of some recent studies, I outline an account of moral reasoning in which intuition and reflection are not in conflict but cooperate to reach a reflective goal. I call this model dual process reflective equilibrium. The aim of the first part is descriptive, i.e., it argues for an accurate understanding of moral intuition and reasoning in light of the available empirical evidence. In contrast, the second part addresses a normative question: is a subject epistemically justified in forming a belief on the basis of a moral intuition? Skeptics of moral intuition argue that accepting moral intuitions should be the exception rather than the rule to the extent that epistemically defective processes determine the content of moral intuitions. Chapter 3 (“Moral intuitionism and the reliability challenge”) introduces the recent empirical challenges to the reliability of moral intuitions and elaborates a promising strategy for defending intuitionism. In short, I consider whether subjects can track the reliability of their intuitions with their confidence. In Chapter 4 (“The argument from limited cognitive resources”), I evaluate a different strategy to defend moral intuitionism. Specifically, I develop an argument according to which accepting moral intuitions is legitimate because it is the most rational option that a subject has, given her limited resources. The third and final part of the dissertation concerns the role of moral intuitions in action. The influence of automatic processes on moral conduct raises different challenges to moral philosophy. The first challenge is to explain how a subject can be motivated by certain values without the mental effort of deliberation. Chapter 5 (“Caring, moral motivation, and automatic conduct”) tackles this issue. Chapter 6 (“Moral sensitivity as skillful automaticity”) aims to explain how moral agents can be sensitive to good reasons through automatic mental processes. (shrink)
