Based on an analysis of a landmark case Lim Mey Lee Susan v Singapore Medical Council in Singapore where a doctor was professionally disciplined for over-charging a wealthy patient, a judgement upheld by the Singapore High Court, this paper will discuss the notion of an ‘ethical price’ (EP) and its determination with respect to the provision of healthcare services. It will first examine the limitations of a legal approach for setting an ethical limit to pricing. From there, it will argue (...) that Confucian philosophy provides a useful ethical framework to explore EP, with focus on the context of Singapore. The following question is addressed: What is an ethical pricing standard for medical practice from a Confucian perspective? The strengths and limitations of a Confucian value base as regards the determination of an objective EP will be analysed through an examination of the shortcomings of the doctor’s behaviour in the Susan Lim case as well as other case scenarios. The paper will conclude with some practical suggestions on how Confucian-based ideas can be applied to decision-making on pricing and the importance of this for medical professionalism and ethics teaching. Not only individuals and firms, but also families engage in business as a social activity and this is true beyond the case of family businesses. Cultural differences in the way families are construed might influence the way they do business. There are different types of families, and among these are those described by Aristotelian and Confucian traditions, representing the West and the East respectively. The literature on virtue in business has been dominated by a Western—mainly Aristotelian—tradition : 8–24, 2014), neglecting (...) the role of the family and focusing on the individual. In this paper, we seek to fill this gap by explaining differences and similarities in the normative evaluation of certain family-related business attitudes and practices, in light of Confucian and Aristotelian virtue ethics standards. After comparing the structure, organization and dynamics of Aristotelian and Confucian families, we shall draw some inferences regarding “virtuous” or excellent business practices—such as nepotism, bribery, gift-giving and guanxi and attitudes—on codified rules or written norms. For this analysis we shall make use of Aristotelian and Confucian ethical accounts as well as inputs from Family Science applied to organizations, which provides conceptual categories to compare the two traditions. Thus we hope to contribute not only to the comparative study of Aristotelian and Confucian virtue ethics in business, but also to the understanding of the distinctive role of families, raising cultural awareness for what may be considered virtuous business practices according to the Aristotelian and Confucian traditions. This paper addresses the issue of ecological sustainability and the dilemma between instrumental rationality and protection of the environment through a discussion of food production. In Confucianism, all human activities, including consumption of food, are seen as inseparable from problems of value. While Confucianism stresses the importance of healthy food, it rejects viewing nature as only having instrumental value. The Confucian view of sustainability can be seen from three parts: Humans should follow the murmuring of their 'heart/mind' and seek to (...) restrict the use of natural resources as much as possible to ‘let every being manifest its mandate to the full’; Harmony with nature is a premise for sustaining humanity; and Finally, taking care of the fundamental needs of the people is a premise for ecological sustainability. On the one hand, Confucianism and Christianity advocate universal love for all humans on the ultimate basis of particular love for parents or for God respectively. On the other hand, they have to sacrifice the former for the latter in cases of conflict since they give top priority merely to the latter. In order to overcome this paradox in theory and realize the ideal of universal love in practice, they should transform their particularistic frameworks into universalistic ones and assign a (...) supreme position to their ideas of universal love for all humans, which imply in a potential way a modern, humanistic principle ‘respect the deserved rights of every human being’. This article argues that Mencius’ education is ‘holistic education’ that aims at igniting the ‘silent revolution’ from within one’s inner mind-heart to be unfolded in society, state, and the world. Mencius’ educational philosophy is based on his theory of human nature and his theory of self-cultivation. Mencius affirms the totality of human life because he insists that the ‘personal,’ the ‘socio-political,’ and the ‘cosmic’ form a continuum. On the basis of ‘totality’ of one’s life, Mencius regards the educational process as (...) the prompting of the overall awakening of the learner’s subjectivity. Moreover, Mencius considers that the human mind-heart is the creator of values and that human life is endowed with innate capacity to make moral judgments. Mencius holds that the most effective educational methodology is a sort of cultivation of the mind-heart through internal self-reflection. Moreover, Mencius insists that the principles of teaching are to be according to the student’s talent and that the teacher has to make oneself as a paradigm. In conclusion, Mencius’ educational philosophy reminds us of the importance of ‘emic’ approach of education and the true goal of education in this age of increased quantification, standardization, and commercialization. Mencius portrayed Yang Zhu as an egoist. But the seeming consensus of scholars is that Yang Zhu was not an egoist. Despite that, however, a passage in the Lüshi chunqiu, a third century BCE text, appears to confirm Mencius’s characterization. It says that Yang Zhu valued self. In this paper, I examine the meaning of guiji. Specifically, I investigate on the term ji to reveal the meaning of guiji and elaborate on its possible implications. Humanism and humanistic education have been recognised as an issue of the utmost importance, whether in the East or in the West. Underpinning the Eastern and Western humanism is a common belief that there is an essence or essences of humanness. In the Confucian tradition, the core of humanity lies in the idea of ‘ren’; in the Platonic tradition, ‘rationality’. For some critics, this belief may lead to violence as much as justice. One way to be aware of the danger (...) is not to follow the line of traditional humanism without question. The strategy that the early Daoists and the contemporary philosopher Derrida use is to challenge, question, rethink, re-examine, and reposition the meaning of self. In this article, I will first argue that the idea of non-I in early Daoism is indeed a ‘question of the self’ as well as a doubt cast upon the ‘junzi’ or sage in Confucian orthodoxy. Then, I explore the concept of human subject in Derrida. The consonance between the Daoist undoing of the self and Derrida's deconstructing subject sheds new light on our understanding of humanistic education. (shrink)

I argue against interpretations of Mencius by Liu Xiusheng and Eric Hutton that attempt to make sense of a Mencian account of moral judgment and deliberation in light of the moral particularism of John McDowell. These interpretations read Mencius’s account as relying on a faculty of moral perception, which generates moral judgments by directly perceiving moral facts that are immediately intuited with the help of rudimentary and innate moral inclinations. However, I argue that it is a mistake to identify innate (...) moral inclinations as the foundational source of moral judgments and knowledge. Instead, if we understand that for Mencius an individual’s natural dispositions (xing 性) have a relational element, then the normativity of moral judgments can be seen as stemming from the relationships that constitute the dispositions of each individual. Finally, this essay elaborates on John Dewey's account of moral deliberation as moral imagination, an account which also takes the relational quality of natural dispositions as its starting point, in order to suggest the vital role of imagination for Mencius’s own account of moral deliberation. This essay takes as its focus Japanese philosopher Nishida Kitar? (1870?1945) and his seminal first text, An Inquiry into the Good (or in Japanese zen no kenky?). Until now scholarship has taken for granted the predominantly Buddhist orientation of this text, centered around an analysis of the central concept of ?pure experience? (junsui keiken) as something Nishdia extrapolates from his early experience of Zen meditation. However, in this paper I will present an alternative and more accurate account of the origins (...) of this important work, a text often seen as marking the beginning of Modern Japanese philosophy. I will show that while Buddhism is an important part of Nishida's early intellectual development, there is ample biographical and textual evidence to suggest that zen no kenky? is at its core a text which attempts to solve key ethical problems via a modern interpretation of concepts drawn from the Confucian tradition. This analysis thus places the concept of ?Conduct? (koi), rather than ?pure experience?, at the center of the text, suggesting that ethics, rather than metaphysics, is the core theme of the book. The contemporary Chinese intellectual Kang Xiaoguang has argued that Chinese soft power should be based on Confucian culture, the most influential Chinese political tradition. But which Confucian values should form the core of China’s soft power? This paper first explores the coexistence of state sovereignty and utopian cosmopolitanism through an analysis of Confucian tradition up to contemporary Chinese nationalism. It insists on the exogenous roots of the cosmopolitan ideal and its relations with the ideal of a harmonious political order and (...) a global peace. Then, it compares the philosophy of ‘all-under-heaven’ in its classical and contemporary forms, with Mencius’ theory of a ‘hegemon’, a theory that still informs the moral language that Chinese intellectuals use to evaluate foreign policy, especially regarding morally-justified warfare. It ends on a reflection on the role that Mencius’s theory of just and unjust war can play in the contemporary Chinese context and to help understanding and defining the stance of China in the international geo-political context. This essay attempts a philosophical reflection of the Confucian ideal of “scholar-official” in Joseon Korea’s neo-Confucian context. It explores why this noble ideal of a Confucian public being had to suffer many moral-political problems in reality. It argues first that because the institution of Confucian scholar-official was actually a modus-operandi compromise between Confucianism and Legalism, the Confucian scholar-officials were torn between their ethical commitment to Confucianism and their political commitment to the state; and second, that because the Cheng-Zhu neo-Confucianism vigorously (...) imported and indigenized by Joseon Koreans exalted the family over the state, Joseon neo-Confucian scholar-officials were torn between two competing moral obligations, filiality and loyalty. The essay concludes by discussing whether, given the problems with which the ideal of the Confucian scholar-official was frequently entangled, liberal individualism should be pursued as its normative alternative. Confucianism advocates the lofty moral ideal of “humane love” (ren ai 仁愛) and condemns immoral actions. Strangely enough, however, Mencius, a “paradigmatic Confucian intellectual” who believed that “a true man cannot be corrupted by wealth, subdued by power, or affected by poverty” (Tu 1989a: 15), highly commended such typically corrupt actions as bending the law for the benefit of relatives or appointing people by mere nepotism when he talked about Shun 舜 in the text of the Mencius. In the first (...) four sections of this article, I will address the issue of how Confucianism encourages a special kind of corruption through its fundamentally consanguineous affection. Then, in the remaining sections, I will try to respond to some criticisms of my views by a few Chinese scholars. (shrink)

Through a comparative analysis of the stories of Abraham and Guo, this article tries to argue that some particularistic claims of Christianity and Confucianism, which regard faith in God or filial piety to parents respectively as the sole ultimate principle of human life, may constitute the spiritual mainstay of such serious evils as murdering the innocent in certain in-depth paradoxes. Only by assigning a supreme position to their universal ideas of loving all humans through their self-transformations could the two ethico-religious (...) traditions prevent those morally unacceptable evils motivated by their particularistic claims and overcome their in-depth paradoxes. Xunzi is often interpreted as offering a method for transforming our desires. This essay argues that, strictly speaking, he does not. Rather, Xunzi offers a method of developing an auxiliary motivational structure capable of overpowering our original desires, when there is a conflict. When one succeeds in transforming one’s overall character, original desires nevertheless remain and are largely satisfied. This explains why one may be motivated to follow the way even before one has developed noble intentions. On Xunzi’s view, following (...) dao provides the best chance of satisfying one’s original desires, as well as fulfilling the more noble aspirations that arise from the process. (shrink)

Confucius, Mencius, and Xunzi regard the human as an emotional being and especially consider such moral feelings as humane love, filial piety and devoted loyalty to be the constituent elements of humanity. On the one hand, they try to integrate the corresponding multiple roles of the humane person, filial son and loyal subject in harmony in order to make one become a true human in the ethical sense; on the other hand, they assign a supreme position merely to filial piety (...) or loyalty in cases of conflict because they regard one's parents or ruler as the greatest root of one's life, respectively. As a result, their ideas about humanity fall into some in-depth moral paradoxes, which might be resolved by a post-Confucian transformation of the traditional Confucian framework from particularistic consanguinism to universalistic humanism. In this essay I discuss how the relational ethic characteristic of Classical Confucianism articulates an ethic of gift exchange. I first discuss the tradition that Confucius appropriated and show that the gift was utilized to form, maintain, and symbolize social relationships in Shang, Zhou, and Warring States China. I then go on to discuss the implications of this view by addressing two difficulties of gift exchange that are often discussed in the literature: the use of gifts to indebt or control (...) others and the inability of the gift to fully express one’s sentiments. This essay not only shows that Confucian ethics has much to say on the matter but also demonstrates that ritual action is still relevant in modern contexts. (shrink)

A fair amount of recent Xunzi scholarship has focused on the problem of moral transformation. The problem being addressed supposedly arises this way. According to Xunzi, human nature is innately or inherently evil; individuals, nevertheless, can become moral agents capable to embracing and loving moral principles. Unfortunately, Xunzi does not provide any account of how individuals whose characters are inherently evil can transformed into full moral agents. Several scholars have proposed various ways in which Xunzi could address the problems, but (...) all are unsatisfactory for various reasons. In this paper, I will develop my own reading of Xunzi’s moral philosophy. My approach is to put Xunzi in the context of classical Confucianism, a tradition that shaped Xunzi’s thinking on his metaphysical assumption about the world, his reverence for the wisdom of sage kings, and his emphasis on education as the necessary condition for virtue development. This experimental essay intends to analyze interpretational cases related to the understanding of the Mencian theory of human nature. The first part introduces straightforward reading by a representative sinologist, historian, and philosopher. The second part discusses two examples that reinterpret the Mencian theory in an injective way with the Kantian theory and processing philosophy, respectively. The third part reexamines our understanding and evaluation of human nature in the Mencian theory using new discoveries of experimental psychology. The claim that there exists (...) a foundation of goodness in human nature has been revealed by both Mencius and modern psychologists from their own perspectives. It should be meaningful to further examine the rationale of acceptance of these theories. Such study also contributes to establishing a right attitude towards people and human societies, which in turn will influence the quality of our life in the long term. (shrink)

This paper discusses the theory of socialism endorsed by Li Dazhao, China's first Marxist, as an effort to integrate western ideas into the traditional Chinese thinking during the chaotic years of the 1920s. There are two aspects of Li's theory of socialism which, while related, are distinct: (1) a theory about the nature of socialist society, and (2) a theory about how a socialist society can be achieved in China. Li's development of (1) is influenced by his acceptance of the (...) classical Confucian notion of the Great Harmony while his account of (2) draws upon both his acceptance of the Daoist account of historical change and on classic Confucianism. Understanding his theory of socialism thus requires locating it within these two doctrines of classical Chinese philosophy. (shrink)

This paper studies the relation between modern democracy and Chinese cultural patterns. It introducing the concept of 'Multiple Others' to explain how the classical concept of harmony can help integrating cultural and social differences within a social body, thus allowing social cohesion to integrate diversity. The main classical concepts of ren, li, and yi are analyzed in both Confucianism and Daoism, and compared to the concepts of recognition and dialogue developed by modern political theorists like Ch. Confucianism is a kind of humanism. Confucian humanism presupposes, however, a divisive act that separates human and nonhuman. This paper shows that the split between the human and the nonhuman is central to Mencius' moral psychology, and it argues that Confucianism is an anthropological machine in the sense of the term used by Giorgio Agamben. I consider the main points of early Daoist critique of Confucian humanism. A comparative analysis of Herman Melville's novella 'Bartleby the Scrivener' reveals the limitation of (...) the moral will in Mencius. Finally, I refer to an incident that recently captured the imagination of Chinese netizens, and shows the contested influence of Confucian humanism in contemporary China. (shrink)

Cara sui (care of the self) is a guiding thread in Foucault's later writings on ethics. Following Foucault in that inquiry, we are urged beyond our fairly superficial conceptions of consequences, harms, benefits, and the rights of persons, and led to examine ourselves and try to articulate the sense of life that animates ethical reasoning. The result is a nuanced understanding with links to virtue ethics and post-modern approaches to ethics and subjectivity. The approach I have articulated draws on the (...) phenomenology of Levinas and Heidegger, the Virtue ethics of Baier, and the post-structuralist writing of Michel Foucault. The subject is seen as negotiable, embodied, provisional and able to be transformed in a way that denies essentialism about human beings, their moral status, and the idea of the good. The human being emerges as responsible because, properly, responsive to the context of discourse in which morality becomes articulated. When we import this style of thinking into bioethics we find that it reaches beyond issues of policy or right conduct and allows us to use the biomedical sciences and the clinical world to revise and interrogate our understanding of ourselves and the theoretical foundations of health care ethics. ABSTRACTThe purpose of this article is to explain the Mohists’ perceived inconsistences of the following three propositions in the Mojing since we attribute to them an unconditional love toward human beings: A thief is a man. Killing a thief is not killing men. A thief is a man. Loving a thief is not loving men. Zang is a man. Loving Zang is loving men. The attribution of unconditional love toward human beings is not unusual to the Mohists when we render (...) the Mohist idea of jian’ai as universal love. My interpretation first suggests that we can consistently interpret the Mohist ethical position as intentional utilitarianism. Second, I claim that Mohist universal love includes some generality, though it does not have to mean universality without exception. This Mohist generality will be explained through the generic use of nouns. (shrink)

From the ‘DuPont factory’ case in China, one can see that contemporary ecology is faced with two underlying problems: A lack of responsibility toward the environment beyond being economically profitable, and a lack of care for what is outside of one’s immediate environment. For the purpose of confronting these two problems, I suggest two Confucian concepts: 1. zhengming 正名 and 2. datong 大同 . These two concepts can be used to develop an environmental ethics and thus play a crucial role (...) in solving the two above-mentioned problems. Zhengming is originally a political concept that was put forward by Confucius. According to this concept, everyone should fulfill their duty to the utmost in accordance with their individual roles. Datong is Confucius’ political ideal and emphasizes gong 公 as a spirit for caring for tian xia 天下 .
