People who habituate to stress show a repetition-induced response attenuation—neuroendocrine, cardiovascular, neuroenergetic, and emotional—when exposed to a threatening environment. But the exact dynamics underlying stress habituation remain obscure. The free energy principle offers a unifying account of self-organising systems such as the human brain. In this paper, we elaborate on how stress habituation can be explained and modelled using the free energy principle. We introduce habituation priors that encode the agent’s tendency for stress habituation and incorporate them in the agent’s (...) decision-making process. Using differently shaped goal priors—that encode the agent’s goal preferences—we illustrate, in two examples, the optimising behaviour of agents. We show that habituation minimises free energy by reducing the precision of goal preferences. Reducing the precision of goal priors means that the agent accepts adverse states. Acceptance or tolerance of adverse outcomes may explain why habituation causes people to exhibit an attenuation of the stress response. Given that stress habituation occurs in brain regions where goal priors are encoded, i.e., in the ventromedial prefrontal cortex and that these priors are encoded as sufficient statistics of probability distributions, our approach seems plausible from an anatomical-functional and neuro-statistical point of view. The ensuing formal and generalisable account—based on the free energy principle—further motivate our novel treatment of stress habituation. Our analysis suggests that stress habituation has far-reaching consequences, protecting against the harmful effects of toxic stress, but on the other hand making the acceptability of precarious living conditions and the development of the obese type 2 diabetes mellitus phenotype more likely. According to the so-called Classical Theory, concepts are mentally represented by individually necessary and jointly sufficient application conditions. One of the principal empirical objections against this view stems from evidence that people judge some instances of a concept to be more typical than others. In this paper we present and discuss four empirical studies that investigate the extent to which this ‘typicality effect’ holds for the concept of basic needs. Through multiple operationalizations of typicality, our studies yielded evidence for a (...) strong effect of this kind: Participants tended to recall the same core examples of the concept in a free-listing task. They judged some basic needs to be more typical than others. The items that were judged to be more typical were listed more frequently in the free-listing task. These items were listed earlier on in the free-listing task. Typical basic needs, as well as non needs, were classified faster than atypical basic needs in a reaction time study. These findings suggest that the concept of basic needs may have a non-classical structure. If so, the quest for a simple and robust intensional analysis of the concept may be futile. (shrink)

Although many studies have found a positive relationship between corporate social performance and employer attractiveness, few have examined how different forms of responsibility might mediate that attraction, particularly when those social practices afford different degrees of employee participation. The current study undertook this line of inquiry by examining prospective employees’ attraction to three common approaches to corporate social performance (CSP) that offer increasing levels of participation: donation, volunteerism, and operational integration. Unexpectedly, findings from an empirical investigation challenged the study's main (...) hypothesis; that is, prospective employees were least attracted to firms that integrated their social and financial goals. The term « subsidiarity » started to appear in managerial literature in the last few years, to advocate innovative managerial practices. The resurgence of this concept that originated from a political context can create problems. The goal of this paper is to expose the main difficulty of translating this concept from the political field to a corporate situation. Indeed, subsidiarity gives its inherent power back to the lower echelons of a political community. But the economic approach of organization theory assumes, (...) mainly by the means of agency theory, a top-down conception of the firm. Thus, it is not the lower echelons which delegates power to the higher echelons. Consequently, the subsidiarity principle seems not to be applicable to a corporate setting, unless we reverse the assumptions of economic approach of organization theory. Then, the principle of subsidiarity could be used as an illusion to con employees into believing they have legitimate power, in order to manipulate their freedom, and domesticate it for managerial ends. Given Van de Vliert's impressive dataset and prognoses, I will discuss three limitations. First, the evolutionary argument does not adequately take into account how political changes influence freedoms. Second, the operationalizations of needs and freedoms are limited and questionable. Third, a direct relationship between climate, monetary resources, and psychological variables is a simplification neglecting various intervening variables.

The Role of Motivation in Complex Problem SolvingPrevious research on Complex Problem Solving (CPS) has primarily focused on cognitive factors as outlined below. The current paper discusses the role of motivation during CPS and argues that motivation, emotion, and cognition interact and cannot be studied in an isolated manner. Motivation is the process that determines the energization and direction of behavior (Heckhausen, 1991).Three motivation theories and their relation to CPS are examined: McClelland’s achievement motivation, Maslow’s hierarchy of needs, and Dörner’s (...) needs as outlined in PSI-theory. We chose these three theories for several reasons. First, space forces us to be selective. Second, the three theories are among the most prominent motivational theories. Finally, they are need theories postulating several motivations and not just one. A thinking-aloud protocol is provided to illustrate the role of motivational and cognitive dynamics in CPS. Problems are part of all the domains of human life. The field of CPS investigates problems that are complex, dynamic, and non-transparent (Dörner, 1996). Complex problems consist of many interactively interrelated variables. Dynamic ones change and develop further over time, regardless of whether the involved people take action. Literature reviews have repeatedly emphasized the need to further investigate relationships between corporate social responsibility and micro-organizational variables. The present research attempts to address this call by examining the direct and indirect relationship between individual perceptions of CSR and employees’ organizational citizenship behaviors. Multiphasic data from 207 workplace supervisor–subordinate dyads recruited from an online panel were analyzed to show that organizational identification mediated the relationship between CSR and OCBs. Furthermore, supervisor transformational leadership style moderated the mediation, such that the indirect (...) effect of the organizational identification on the relationship between CSR and OCBs became nonsignificant under low transformational leadership. Software piracy is a serious problem in the software industry. Software authors and publishing companies lose revenue when pirated software rather than legally purchased software is used. Policy developers are forced to invest time and money into restricting software piracy. Much of the published research literature focuses on software piracy by end-users. However, end-users are only able to copy software once the copy protection has been removed by a ‘cracker’. This research aims to explore why, if copy protection is so (...) difficult to remove, do crackers invest their skill and time in this activity instead of more lucrative and legal employment. This study develops a framework of neutralisation, justification and motivation and goes directly to the initial software crackers to determine what motivates their activities. The study first applies this framework in an anonymous online survey of crackers. The study then conducts cognitive interviews with eight crackers to explore and further validate the survey’s findings. The study finds the challenge of removing the copy protection from software as the strongest motivation for the actions of crackers. Desire for social participation, while found to be rewarding, was considered unnecessary for crackers to continue their actions. Higher social status was not a motivational factor but was a perceived by-product of cracking. The study also raises areas for future research. (shrink)

Statements of need are used promiscuously by caretakers and children. The term may refer to mere wants (desire), to wants that have become socialized into secondary needs, to needs inferred by adults based on interpretations of future adaptive requirements, as well as to fundamental needs required for a child's well-being. It is important to distinguish the various uses of the term, first, because need carries an imperative-it would be unethical to frustrate a child's basic needs. Second, when confounding meanings, there (...) is the risk that what appears as an expression of concern-'you need to'-is more arbitrarily coercive than benevolent. Because even genuine needs are multiple and often in tension (protection and independence), separating meanings does not necessarily determine appropriate responses. Carroll shaped the corporate social responsibility discourse into a four-dimensional pyramid framework, which was later adapted to corporate citizenship and sustainability approaches. The four layers of the pyramid—structured from foundation to apex as economic, legal, ethical, and philanthropic responsibilities—drew considerable managerial attention. An important criticism of the economic foundation of the Carroll pyramid concerns the identification and ordering of the four dimensions, which are inadequately justified theoretically. The authors of this article propose an alternative approach that builds on the public (...) value concept, which integrates a microfoundation of psychological research into basic human needs. Drawing on their Swiss Dialogue process, the authors argue that a four-dimensional pyramid does have heuristic value for managers. The advantage of this alternative pyramid logic is that it may be contingently adapted to different cultural contexts, because it allows adaptive internal reordering. (shrink)

The Oxford English Dictionary defines fulfilment as ‘satisfaction or happiness as a result of fully developing one's potential or realizing one's aspirations; self-fulfillment’. Not only has the idea of fulfilment underpinned ‘approximately twenty centuries of philosophy’ as Lefebvre notes, it plays an indispensable role in both popular and scholarly accounts of education and upbringing. Experiences of education, of upbringing and of ‘life lessons’, however, are so often not about the fulfilment of oneself, about the discovery and actualisation of one's full (...) potential. Such experiences instead involve moments of sometimes irreparable failure and loss—a matter that has not received a great deal of attention in educational research and theory. After briefly examining the way that fulfilment is favourably framed both in humanistic psychology and in neo-humanist Bildungstheorie, this paper considers some of the exceptions to the nearly ubiquitous identification of education with fulfilment: Arthur Schopenhauer's view of the irrationality of human (developmental) experience and Ludwig Wittgenstein's use of the term ‘conditioning’ (Abrichtung) in some of his accounts of learning and socialisation. We then focus on failure and loss in education through an overview of the pedagogical theory of O.F. Bollnow. Bollnow, as is gradually being recognised in English-language scholarship, saw moments of uncertainty, disorientation and above all crisis as indispensable in educational experience—for both student and teacher. In this way, we show that instead of being the pursuit of self-fulfilment, education is unavoidably a matter of difficulty, disruption and also failure. It reshapes us, and this reshaping can be seen as being as much about formation as it is about deformation. (shrink)

The article aims to bridge divides between political theory and management and organization studies in theorizing workplace democracy. To achieve this aim, the article begins by introducing a new definition of democracy which, it is contended, is better suited than mainstream accounts to highlight the democratizing potential of employee involvement. It then defines employee involvement as an offshoot of early twentieth-century humanistic psychologies, from which it inherits an emancipatory ambition. In a third step, the article presents employee involvement as a (...) set of organizational practices liable to transform dominant patterns of authority and social interaction in the workplace. The article concludes by contending that, apart from representation/participation and the employee’s voice, employee involvement must be considered the third necessary pillar of workplace democracy, endowed with distinctive normative features that neither representation/participation nor voices can aptly capture. Libertarianism has a problem, perhaps an insurmountable one, and its problem lies squarely in the domain from which it is sourced: the intellectual and political elite of the West. As such, it rests on an ontological viewpoint far outside the purview and experience of quotidian man. Furthermore, it rests on an epistemology of the person as sovereign, Natural Law, which requires a concomitant education or understanding of the Classics, or at least self-awareness and the ability to think logically. Many non-intellectuals (...) are either uninterested or incapable of following the Libertarian arguments of personal sovereignty and instead submit. This unconscious submission to the authority of a government, father figure, or other self-appointed “authority” relieves the individual of the psychological pain of breaking out of the herd. C. G. Jung (1875-1961) was adamant that to be an individual is a radical act: “To develop one’s own personality is indeed an unpopular undertaking, a deviation that is highly uncongenial to the herd, an eccentricity smelling of the cenobite, as it seems to the outsider [11, Para. 298]. Further, Alexander Hamilton (1755 or 1747-1804) noted that the elite are more than happy to have the masses submit to their authority without question as it advances their control: “a fondness for power is implanted in most men, and it is natural to abuse it when acquired” [9]. Any first step in organisational adaptation starts with individuals’ responses and willingness (or otherwise) to change an aspect of themselves given the transcontextual settings in which they are operating (Bateson in Small arcs of larger circles: framing through other patterns, Triarchy Press, Axminster, 2018). This research explores the implications for organisational adaptation strategies when Artificial Intelligence (AI) is being embedded into the ecology of the organisation, and when employees have a dominant fixed or growth mindset (Dweck in Mindset: changing the (...) way you think to fulfil your potential. Robinson, London, 2017). Research participants were supplied with a single scenario based in 2030, where—as a result of Artificial Intelligence technology implementation—employees were going to be displaced. Using Torbert’s (Organizational wisdom and executive courage, New Lexington Press, San Francisco, 1998) ‘first, second and third person’ research theory, participants were asked to independently review their thoughts, sense, and image of the future from a fixed mindset position (considered to be the worst case), then from a growth mindset perspective (best case), and then do the same collectively. Five key findings are outlined which support the principle that having a growth mindset is a key component of adaptive capacity and futures literacy. The five key findings conclude that AI adaptation processes need to include compassion and authenticity, embodiment, fundamental needs and motivations, mutual learning and considering what lies beyond the edges of the organisation (Bateson in Small arcs of larger circles: framing through other patterns, Triarchy Press, Axminster, 2018). The term entheogen refers to drugs—including the artificial substances and active principles drawn from them—which are known to produce ecstasy and have been used traditionally in certain religious and shamanic contexts. The entheogenic experiences provoked by entheogens are described by users in myriad ways, including in spiritual, religious, philosophical, and secular contexts. Entheogenic experiences have shown that they can create opportunities for individuals to generate meaning, including novel philosophical insights, which users claim to gain by way of experience. As such, (...) entheogenic experiences exhibit the ability to influence a change in a user’s fundamental philosophical commitments, or live options, including their ethical dispositions. Given that these new live options are rooted in experience, their veracity gains further credence for users than those commitments they have come to hold by way of abstraction. By philosophically investigating the phenomenology of entheogenic experiences, this work argues that entheogens have ethical import. (shrink)

Governance theories impact how corporations are run, which in turn impacts societal well-being. This dynamic is commonly accepted, as evidenced by the flood of articles exploring the links between corporate governance and corporate social responsibility. This article supplements current corporate governance theories with Catholic social thought to address burgeoning societal issues such as the increasing trust gap, income inequality, and an overemphasis on financial compensation as the primary way to motivate senior managers. The authors propose a shift away from agency (...) theory and stakeholder theory, both of which, with their limited depictions of the motivations of managers, have contributed to excessive executive compensation. Instead, the authors develop an alternative—justice stewardship theory—which integrates organizational justice theory, the principles of stewardship theory, and the insights of 150 years of CST. A few years ago, I wrote on the need for expansion of the environmental areas of bioethics, and covered some of the topics touched on here. Sadly, although it is possible to find some notable exceptions, bioethics does not provide much of an ethical base for considering human-nature relationships. Here I’m not going to deal with these philosophical issues or others about the nature of ethical decision-making. The rapid worsening of the human predicament means that applied ethical issues with a (...) significant environmental connection (what I call “ecoethics”), must be dealt with without waiting for the more interesting theoretical issues to be resolved. I define ecoethics very broadly to deal with dilemmas over a vast range of scales, and believe they now should penetrate virtually all areas of human activities. Ecoethics must struggle with issues of intra-generational (and interperson/group/nation) equity and the dilemmas of discounting by distance (valuing distant persons/events/costs/benefits less than those closer to the observer in physical or mental distance). Ecoethics also deals with the difficult dilemma of inter-generational equity—of discounting the future. That is especially troublesome when actions today can have significant environmental consequences 50 or more generations from now. Here I would like to highlight the ubiquity of those questions and the importance of seeking answers. (shrink)

This article explores the links between psychology – specifically, psychological needs, motivations, and coping mechanisms – and the sales of backlist titles during the COVID-19 pandemic. It shows how select titles on spirituality as well as The Boy, the Mole, the Fox and the Horse by Charlie Mackesy and Man’s Search for Meaning by Viktor E. Frankl help readers to attribute meaning to the pandemic and in turn, to cope with the struggles of the pandemic. The article concludes that such (...) books are connected by their psychological value to readers – the psychological needs they fulfil – and that books from disparate genres and on varying topics can help readers cope in similar ways. The field of positive psychology has burgeoned since its formal inception with Martin Seligman’s 1998 APA presidential address. Aimed at better baking the positive half of the psychology “cake”, the gains in research and practice over the past decade and a half have been substantial. Among the chief reasons for the rapid growth and development in this field is the express emphasis on a positivistic scientific methodology. While this methodology has undoubtedly contributed much to the evolution and growth of the (...) field, the empirical emphasis has arguably resulted in the concomitant neglect of the more qualitative complexities of optimal human functioning. The present paper contributes to the discussion regarding the role of method in the field of positive psychology and, using as case studies two papers from the field of phenomenology, argues specifically for the utility of phenomenological psychological methods in the baking of the metaphorical psychology cake. The case studies effectively serve to illustrate the manner in which phenomenological methods, through their focus on rich description and resistance to an interpretative framework, are condusive to contributing to methodological pluralism within positive psychology and thereby providing additional means whereby not only to continue the baking of the positive psychology cake, but, more particularly, to ensure that it is baked thoroughly by adjusting the oven’s heat to the optimal level. In the crucible of the pandemic, it has never before been clearer that, to ensure the relevance and even the survival of the discipline, nursing must cultivate a radical imagination. In the paper that follows, I trace the imperative for conjuring a radical imagination for nursing. In this fever dream for nursing futures, built on speculative visions of what could be, I draw on anarchist, abolitionist, posthuman, Black feminist, new materialist and other big ideas to plant seeds of generative insurrection (...) and creative resistance. In thinking through a radical imagination, I unpack the significance of reparatory history for nursing, a discipline founded on normative whiteness. From there, I consider what it would take to shift the capitalist frame of healthcare to one of mutual aid, which requires the deep work of abolition. With a radical imagination that breaks down the enclosures that contain us through reparatory history, mutual aid and abolition, kinship becomes urgently possible. (shrink)

In recent years Community Supported Agriculture (CSA), an innovative grassroots movement connecting consumers with a local farm, has rapidly spread across Germany and other industrialized countries. An increasing number of consumers who are dissatisfied with conventional food supply chains have signed up to receive fresh produce, support a local community and protect the environment. So far little is known, though, about the underlying value structures of CSA. Nevertheless, identifying factors influencing consumers’ interest in CSA is regarded as a major aim (...) of contemporary CSA research. This research aims to provide insights into CSA members’ value structures, and delineates CSA members by comparing their value structures to those of the German population in general. Schwartz’s Portrait Value Questionnaire was used in a standardized online survey of CSA members to mirror the dataset which is available to the German public via the European Social Survey. A total sample of 205 CSA members was used to examine common value structures by comparing them with the German public. This study’s findings strongly indicate that a CSA membership goes along with a characteristic value pattern: CSA members highly appreciate self-transcendence and openness to change, but tend to reject conservation and self-enhancement values. Addressing members’ preference for openness to change and self-transcendence may help CSAs to reduce fluctuation rates. It might also enhance CSA marketing strategy by addressing potential members’ interests more precisely. Therefore, identifying and communicating common values of a CSA might be a key factor in determining its long-term success and stability. (shrink)

This theoretical paper addresses issues associated with the hierarchical concept of the “pyramid of wisdom” to suggest that progressive organisations can implement management systems that capture and apply personal and organisational talents at various levels. A phenomenological hermeneutic approach is used to re-conceptualise components of practical wisdom in organisations. After briefly examining what constitutes Western and Eastern wisdom traditions, the paper provides various hierarchies associated with a postulated model of the pyramid of wisdom. It is argued that understanding how wisdom (...) develops in an organisation can lead to new approaches to strategic reflection, to alternative notions of leadership, and to more holistic and democratic ways of expressing authority. Without understanding of, and practice within, the pyramid of wisdom, the personal and organisational roads to success are likely to be bleak, illusions overpowering, and accomplishments short-lived. Love, sex, and physical intimacy are some of the most desired goods in life and they are increasingly being sought on dating apps such as Tinder, Bumble, and Badoo. For those who want a leg up in the chase for other people’s attention, almost all of these apps now offer the option of paying a fee to boost one’s visibility for a certain amount of time, which may range from 30 min to a few hours. In this article, I argue (...) that there are strong moral grounds and, in countries with laws against unconscionable contracts, legal ones for thinking that the sale of such visibility boosts should be regulated, if not banned altogether. To do so, I raise two objections against their unfettered sale, namely that it exploits the impaired autonomy of certain users and that it creates socio-economic injustices. (shrink)

Human need and related concepts such as basic needs have long been part of the implicit conceptual foundation for social work theory, practice, and research. However, while the published literature in social work has long stressed social justice, and has incorporated discussion of human rights, human need has long been both a neglected and contested concept. In recent years, the explicit use of human needs theory has begun to have a significant influence on the literature in social work.

Clinical practice is a part of the integral learning method in nursing education. The use of information and communication technologies (ICT) in clinical learning is highly encouraged among nursing students to support evidence-based nursing and student-centered learning. Through the information-processing lens of the mindsponge theory, this study views performance expectancy (or perceived usefulness) and effort expectancy (or perceived ease of use) as results of subjective benefit and cost judgments determining the students’ ICT using intention for supporting clinical learning, respectively. Therefore, (...) the study examines whether effort expectancy moderates the relationship between performance expectancy and the intention to use ICT among Moroccan nursing students. The Bayesian Mindsponge Framework (BMF) analytics was employed on a dataset of 702 Moroccan nursing students. We found that nursing students’ performance expectancy is positively associated with the intention to adopt ICT and social media, while effort expectancy positively moderates this relationship. Moreover, the model with effort expectancy as the moderator was discovered to have a significantly larger weight than the model with effort expectancy as the direct predictor, validating our information-processing reasoning. This study provides a new perspective on the interplay between the benefit and cost perceptions of ICT use to support clinical learning methods in nursing education. Moreover, given the limited education resources, especially in developing countries like Morocco, we recommend nursing education and training prioritize communicating the benefits of ICTs and social media over ease of use. Doing so would help improve the effectiveness and efficiency of nursing education and training while lowering costs. (shrink)

Based on the properties and mechanism of serendipity presented in former chapters, this chapter discusses how to create an environment for higher serendipity encounters and attainment possibilities. We examine four types of environments with different navigational and useful information concentration combinations. Building a pro-serendipity culture will help create environments that value and supports serendipity across fields. Additionally, we also address the notion that serendipity is a skill. To validate the new theory of serendipity that we have presented, the case of “floppy-eared-rabbit” with Dr. Lewis Thomas and Dr. Aaron Kellner was used as an example. We go through each important stage in the story and explain the events in terms of serendipity’s conditionality, survival motives, and information process. The characteristics of serendipity gain and loss phenomena are also interpreted in a similar manner.

While we cannot ensure the occurrence of serendipity due to its nature of unexpectedness, we can try to prepare the optimal conditions to improve the possibility. This chapter first describes two types of unexpected information: within or from beyond one’s perceivable range. Next, we describe four stages of the serendipity attainment process: navigation, noticing, evaluation, and implementation. On this basis, we discuss six scenarios in the order of serendipity encounter and attainment probability, which are determined by information availability in the (...) environment and the mindset in terms of information processing. The serendipity attainment process has a higher success rate when acquiring precise navigation and employing the 3D principles of creativity (best expertise within discipline, the best expertise out of discipline, and discipline process). After employing the mindsponge mechanism and 3D information process of creativity to explain the serendipity process in previous chapters, we realize that it may be helpful to delve into the relations between serendipity and the formulation of new values and information connections through non-linear processes. Thus, this chapter summarizes some preliminary attempts to use non-linear information processes to explain serendipity. We also briefly mention the benefits of information exchange among members of social groups and explain this approach.

In order to set a ground for the new hypotheses, theory, and conceptual framework of serendipity, the current chapter aims to review the research landscapes, definitions, types, influential factors, and processes of serendipity. First, bibliometric analyses of 2982 documents retrieved from the Web of Science database were employed to examine the intellectual and conceptual structures in the research field of serendipity. Three major research lines are found: 1) information-seeking behaviors, 2) serendipity in business and sciences, and 3) serendipity in recommender (...) systems. Then, a narrative review of the most notable documents and studies was done to overview the serendipity’s definitions, types, influential factors, and processes. Based on the review, we stipulate the literature gap in which the newly proposed hypotheses, theory, and conceptual framework will fit in. (shrink)

Need considerations play an important role in empirically informed theories of distributive justice. We propose a concept of need-based justice that is related to social participation and provide an ethical measurement of need-based justice. The β-ε-index satisfies the need-principle, monotonicity, sensitivity, transfer and several »technical« axioms. A numerical example is given.

El “Foro de Montreal sobre el desarrollo socialmente responsable de la inteligencia artificial” fue una conferencia que inició en noviembre de 2017, donde más de 400 participantes de diversos sectores y disciplinas discutieron las implicaciones éticas y sociales de la IA. La conferencia también condujo a la creación de la “Declaración de Montreal para un desarrollo responsable de la inteligencia artificial” que se dio a conocer a finales de 2018 con más de 500 signatarios. La declaración describe 10 principios y (...) 59 recomendaciones para guiar el desarrollo de la IA de manera que respete la dignidad humana, la autonomía, la justicia y la democracia. Los principios de la ética de la IA de Montreal también han sido criticados. Por ejemplo, se argumenta que no cubre el posible uso malicioso de la IA para actividades como la guerra, la vigilancia o la propaganda personalizada, y no ofrecen orientaciones ni mecanismos específicos para su aplicación y cumplimiento. De cualquier modo, se considera un importante paso en el desarrollo de la ética de la IA y ha sido amplia- mente reconocida por su enfoque global e integrador, y como punto de referencia para los esfuerzos posteriores. The dissertation deals with the questions surrounding the legal, ethical and strategic aspects of armed drones in warfare. This is a vast and complex field, however, one where there remains more conflict and debate than actual consensus. -/- One of the many themes addressed during the course of this research was an examination of the evolution of modern asymmetric transnational armed conflict. It is the opinion of the author that this phenomenon represents a “grey-zone”; an entirely new paradigm of warfare. (...) International terrorism has not been dealt with in a cohesive fashion. Any international prosecution of terrorism which has been conducted has been either “sectoral” adopting a piecemeal typological approach or has been carried out at the domestic level. -/- A novel approach to the problem, of sub-national actors with transnational reach, was proposed, by attributing certain groups with a new legal personality, that of “Stateless International Entities”, or “SIEs”. Those groups who possess, for all intents and purposes, the same attributes as those of States, could then be judged for their behavior before an international tribunal. Other important topics addressed in this research include an examination of important case law, targeted killing, autonomy, preemption versus prevention, imminence versus intent, the find, fix and finish paradigm, the impact of the media, and the role of the CIA, and finally, the flawed reasoning which adopts technology as a form of strategy.
