The present reflection draws upon a tradition of energetic, world-facing critical legal scholarship to interrogate the anthropos assumed by the terminology of ‘anthropocentrism’ and of the ‘Anthropocene’. The article concludes that any ethically responsible future engagement with ‘anthropocentrism’ and/or with the ‘Anthropocene’ must explicitly engage with the oppressive hierarchical structure of the anthropos itself—and should directly address its apotheosis in the corporate juridical subject that dominates the entire globalised order of the Anthropocene age.

The recent global movement for women's human rights has achieved considerable re-thinking of human rights as previously understood. Since many of women's rights violations occur in the private sphere of family life, and are justified by appeals to cultural or religious norms, both families and cultures (including their religious aspects) have come under critical scrutiny.

The article discusses some of the major issues which need to be examined in a gendered reading of citizenship. However, its basic claim is that a comparative study of citizenship should consider the issue of women's citizenship not only by contrast to that of men, but also in relation to women's affiliation to dominant or subordinate groups, their ethnicity, origin and urban or rural residence. It should also take into consideration global and transnational positionings of these citizenships. The article challenges (...) the gender-blind and Westocentric character of many of the most hegemonic theorizations of citizenship, focusing in particular on the questions of membership in ‘the community’, group rights and social difference and the ways binaries of public/private and active/passive have been constructed to differentiate between different kinds of citizenships. The article argues that in order to be able to analyse adequately people's citizenship, especially in this era of ethnicization on the one hand and globalization on the other hand, and with the rapid pace at which relationships between states and their civil societies are changing, citizenship should best be analysed as a multi-tiered construct which applies, at the same time to people's membership in sub-, cross- and supra-national collectivities as well as in states. In response to its current crisis, scholars call for the revitalisation of democracy through democratic innovations. While they make ample use of life metaphors describing democracy as a living organism, no comprehensive understanding of ‘life’ has been established within democratic theory. The Black Lives Matter (BLM) movement articulates the urgency of refocusing on life and its meaning through radical democratic practice. This article employs a grounded theory approach, enriched with participatory methods, to develop a radical democratic concept of life in (...) conversation with BLM. It conceptualises life as the existence of a perspective that constantly transforms through its fundamental interconnectedness. Building on this concept, the article outlines four principles of a living democracy that go beyond the revitalisation discourse. A living democracy (1) safeguards the existence of all humans and nonhumans, (2) nurtures a diversity of perspectives, (3) fosters social and planetary connectivity, and (4) enables self- and collective transformation. In this essay, I argue that contemporary democratic theory gives insufficient attention to the important contributions dissenting citizens make to democratic life. Guided by the dissident practices of activist women, I develop a more expansive conception of citizenship that recognizes dissent and an ethic of political courage as vital elements of democratic participation. I illustrate how this perspective on citizenship recasts and reclaims women's courageous dissidence by reconsidering the well-known story of Rosa Parks.

A synthesis of rights and participatory approaches to citizenship, linked through the notion of human agency, is proposed as the basis for a feminist theory of citizenship. Such a theory has to address citizenship's exclusionary power in relation to both nation-state ‘outsiders’ and ‘insiders’. With regard to the former, the article argues that a feminist theory and politics of citizenship must embrace an internationalist agenda. With regard to the latter, it offers the concept of a ‘differentiated universalism’ as an attempt (...) to reconcile the universalism which lies at the heart of citizenship with the demands of a politics of difference. Embracing also the reconstruction of the public-private dichotomy, citizenship, reconceptualized in this way, can, it is argued, provide us with an important theoretical and political tool. (shrink)

Independence is a central and recurring theme in Wollstonecraft’s work. Independence should not be understood as an individualistic ideal that is in tension with the value of community but as an essential ingredient in successful and flourishing social relationships. I examine three aspects of this rich and complex concept that Wollstonecraft draws on as she develops her own notion of independence as a powerful feminist tool. First, independence is an egalitarian ideal that requires that all individuals, regardless of sex, are (...) protected to a comparable extent in all areas of social, political and economic life, no matter whether this is in the public or private sphere. Secondly, so long as this egalitarian condition is not compromised, independence allows for individuals to perform differentiated social roles, including along gendered lines. Finally, the on-going and collective input of both women and men is required to ensure that the conditions necessary for social independence are maintained. In Wollstonecraft’s hands, then, independence is a powerful ideal that allows her to argue that women must be able to act on their own terms as social and political equals, doing so as women whose perspectives and interests may differ from men’s. Male-dominated and sex segregated elite professional and amateur sport1 in North America constitutes a "sport nexus" (Burstyn, 1999; Heywood & Dworkin, 2003) that combines economic and cultural influence to reinforce and perpetuate gender injustice. The sport nexus is an androcentric sex-segregated commercially powerful set of institutions that is highly visible and at the same time almost completely taken for granted to the extent that its anti-democratic impetus goes virtually unnoticed. The sport nexus’s hegemonic role in defining sporting norms (Coakley & (...) Donnelly, 2004) means that its role in shaping lower level amateur and recreational sporting institutions and cultures is highly significant. Fraser (2007) defines gender justice, and hence democracy, in terms of "participatory parity," that is, material and cultural equality for women. The sport nexus itself is characterized by highly gendered occupational segregation (Coventry, 2004). It further contributes to gender injustice, homophobia and transphobia by promoting the ideology of the two sex system (Fausto-Sterling, 2000) and gendering citizenship as fundamentally male (Burstyn, 1999). Feminist strategies for sport reformation attempt to reduce or eradicate the role of the sport nexus in legitimating and perpetuating gender injustice. In this article I consider the potential of these strategies and conclude with a set of recommendations for transforming organized sport at both elite and recreational levels. (shrink)

The overall aim of this article is to explore the analytical potential and normative value of Helga M. Hernes' concept about woman-friendly welfare states in analysis of Scandinavian countries. The first part discusses the underlying theoretical, political and normative assumptions about gender equality and social justice related to dimensions such as redistribution, recognition and representation. The second part addresses the analytical potential of the concepts for understanding gender equality developments in Scandinavia. The focus is on three themes related to the (...) desirability, feasibility, and theoretical strength of the Scandinavian welfare and gender equality model and the underlying normative, empirical and theoretical premises. The analysis deals with debates about the public—private split in relation to woman-friendly policies, focusing on parental leave, childcare, and age restrictions in marriages involving foreigners. State feminism is explored in relation to women's political participation and representation and women's ability to influence gender equality policies. Furthermore, national variations in views about state feminism are identified. Finally, the article addresses the role of woman-friendly policies in debates about responses of Western welfare states to globalization, ageing and multiculturalism. (shrink)

This chapter describes a philosophical approach to theorizing justice, mapping out some main strands of the tradition leading up to contemporary political philosophy. We first briefly discuss what distinguishes a philosophical approach to justice from other possible approaches to justice, by explaining the normative focus of philosophical theories of justice – that is, a focus on questions not about how things actually are, but about how things ought to be. Next, we explain what sorts of methods philosophers use to justify (...) theories of justice. Following this, in the longest section, we highlight major questions about justice that have drawn the attention of philosophers, and indicate how competing conceptions of justice have arisen from differing answers to these questions. The goal here is not to answer but to elucidate some of the larger questions about justice, as well as to establish a framework for understanding and distinguishing different kinds of claims about justice and some of the relations between them. This chapter describes how philosophical theorizing about justice can be connected with empirical research in the social sciences. We begin by drawing on some received distinctions between ideal and non-ideal approaches to theorizing justice along several different dimensions, showing how non-ideal approaches are needed to address normative aspects of real-world problems and to provide practical guidance. We argue that there are advantages to a transitional approach to justice focusing on manifest injustices, including the fact that it enables us to set (...) aside some reasonable disagreements about justice. The ‘bottom-up’ approach we advocate, for which we borrow Wolff’s term ‘real-world political philosophy’, is an empirically-informed normative analysis that attends to specific, identifiable injustices, and thus is partial, though not isolationist. We illustrate our approach by considering how different models of the nature of disability suggest different kinds of remedy for injustices faced by persons living with disabilities. We reflect on the nature and significance of vulnerabilities, and we assess the role of public opinion in normative theorizing, suggesting a particular significance for the opinions and experiences of marginalized groups. We finally reflect on the relevance of European legal and institutional frameworks for theorizing justice in Europe. (shrink)

This article argues that people have legitimate interests in privacy that deserve legal protection on democratic principles. It describes the right to privacy as a bundle of rights of solitude, intimacy and confidentiality and shows that, so described, people have legitimate interests in privacy. These interests are both personal and political, and provide the grounds for two different justifications of privacy rights. Though both are based on democratic concerns for the freedom and equality of individuals, these two justifications for privacy (...) can be distinguished because the one is principally concerned with protecting the personal freedom and equality of individuals, while the other is principally concerned with their political equivalents. Feminists have often been ambivalent about legal protection for privacy, because privacy rights have, so often, protected the coercion and exploitation of women, and made it difficult to politicise personal forms of injustice. However, interpreting the content and justification of privacy rights in light of the differences between democratic and undemocratic forms of politics can enable us to meet these concerns, and to distinguish a democratic justification of privacy rights from the alternatives. Digital communication now pervades all spheres of life, creating new possibilities for commodification: personal data and communication are the new resources of surplus value. This in turn brings about a totally new category of threats to privacy. With recourse to the culture industry critique of early critical theory, this article seeks to challenge basic theoretical assumptions held within a liberal account of privacy. It draws the attention to the entanglement of technical and socio-economic transformations and aims at elaborating an alternative (...) framing which takes into account that privacy is not in the first place a pre-political space for individual freedom but a constituted sphere in which social power relations are reproduced in a particularly deceitful way. With recourse to positions of critical theory, this article revisits the conceptual ambiguity of liberation and oppression and looks to draft prospects for a socio-theoretical justification and critique of privacy, updated for the digital age. Following the tradition of critical theory, the argument focuses on (new) forms of domination in and by privacy. It aims to prepare the ground for a critique of the social’s increasing commodification as well as an idea of privacy understood as reflexive participation in social practices. (shrink)

This essay examines Irigaray's analysis of politics and the political implications of her critique of sacrificial orders that repress difference/matter. I suggest that her descriptions of a fluid “feminine” can be read as an alternative symbolic not dependent on repression. This idea is politically promising in opening a possibility for justice and a nonantagonistic intersubjectivity. I conclude by assessing Irigaray's concrete proposals for sexuate rights and a civil identity for women.

There is a basic methodological difference in the way anarchists and non-anarchists think about politics, often more implicit than explicit. Anarchists see politics and justice as being concerns of social institutions, norms, and relations generally – both inside and outside the state. Much of academic political philosophy talks of politics and justice as if they are definitionally concerns about what states should do, or our relationships with each other through the state. In this chapter, we argue that the anarchists are (...) on the right side of this difference. We call the insight that undergirds the anarchists’ understanding of politics and justice “methodological anarchism.” We seek to exorcise the policy framework in favor of methodological anarchism. Indeed, we believe it should be embraced by all political philosophers, not only the anarchists among their ranks. Political philosophers ought to abstain from the policy framework for two reasons. Firstly, it is analytically impoverished inasmuch as, when followed to its logical conclusion, it is unable to engage with enormous areas of analysis that are relevant to what makes a society just or unjust. Secondly, it instills subtle prejudice against other important approaches to mitigating injustice that are unconcerned with public policy. This also carries the danger of lending ideological support for existing injustices and thereby entrenching them. Accepting our critique of the policy framework and adopting methodological anarchism does not necessarily require the acceptance of any kind of substantive political anarchism. But it does mean thinking a bit more like an anarchist about how to make society more just – thus our characterization of it as “methodological.”. (shrink)

When we participate in political debate or protests, we are judged by how we look, which clothes we wear, by our skin colour, gender and body language. This results in exclusions and limits our freedom of expression. The Politics of Becoming explores radical democratic acts of disidentification to counter this problem. Anonymity in masked protest, graffiti, and online de-bate interrupts our everyday identities. This allows us to live our multiple selves. In the digital age, anonymity becomes an inherent part of (...) everyday communication. Through our smart devices we express our selves differently. As cyborgs, our identities are disrupted and reassembled. We curate self-representations on social media, create avatars, share selfies and choose the skin colour of our emojis. The Politics of Becoming encourages us to engage in a revolution of the self. Democratic pluralism is not only a matter of institutional design but also about how we express our identities. This article compares the social movement mobilization that led to reforms in police and judicial handling of battering in the United States to the movement ideology, organization, and tactics that resulted in analogous policy reform in the processing of dowry burnings and beatings in India. Using field notes and secondary sources from both countries, the article examines how both movements redefined violence against women in families as a public issue, then looks at how movement demands affected policy reform in each (...) country. The analysis questions the current conceptualization of social movement success. Social movements theory assumes that entry into the polity of liberal, democratic states constitutes success in the sense of social change. Yet the cases analyzed suggest that assumptions about the gender neutrality of state response to movements prevents researchers from critically examining the outcomes of social movement mobilization. Moreover, institutionalization of women's movement demands and organization may diminish the capacity of such movements to control the social construction of domestic violence against women by providing protection without empowerment. This paper queries the absence of disabled voices in contemporary citizenship literature. It argues that the language and imagery of the citizen is imbued with hegemonic normalcy and as such excludes disability. Feminist perspectives, such as those which argue for a form of maternal citizenship, largely fail to acknowledge disability experiences. Exclusionary practices are charted and links are made between gender, race and disability in this process. A citizenship which acknowledges disability is fundamental to re-imaging local, national and international collectivities.

Since coming to power in 2010, the UK Coalition government has enacted a series of cuts to public spending, under the auspices of austerity. Underpinning these cuts is a neo-liberal model of citizenship, in which citizens are expected to be autonomous, independent and economically productive, and in which the responsibilities of citizenship outweigh the rights. This model of citizenship is characterised by a paradoxical approach to social reproduction. The Coalition government has taken a significant interest in social reproduction as a (...) means of creating the next generation of ‘good’ neo-liberal citizens; yet, the current austerity measures involve the withdrawal of state support for social reproduction activities. Drawing on participant observation carried out with migrant women's groups in Sheffield and Manchester, as well as interviews with group members, this article demonstrates how the government's paradoxical approach to social reproduction, combined with gendered and racialised discourses of citizenship and ‘Britishness’, have led to policies that place ethnic minority migrant women in an untenable situation. The social reproduction activities of ethnic minority migrant women are the subject of intense government interest, because of the concern that they will be unable to produce ‘good’ neo-liberal citizens. In some cases, this has led to government policies clearly intended to dissuade ‘undesirable’ migrants from having children. In other cases, migrant women are expected to show their commitment to integration, both for themselves and their children, specifically by learning English, even as the government has drastically cut funding for English as a Second or Other Language (ESOL) classes. While seemingly paradoxical, this is in keeping with a racialised neo-liberal model of citizenship under which the ‘responsible’ migrant mother should be able to parent and learn English without government assistance. Nonetheless, these policies are actually self-defeating, as they prevent migrant women from exhibiting the very characteristics of neo-liberal citizenship that they are ostensibly trying to encourage. The gendered assumptions embedded in the construction of the rational individual are well established in Western feminist thought but inapplicable to describe societies operating on different principles, such as East European state socialism. This article identifies the communist subject as the building block of communist political ideology and argues that this formulation was no less male biased than its counterpart, the rational individual under liberal capitalism. In state socialist Hungary this male bias came to be expressed differently: Women were integrated (...) into society through membership in a social group perceived as relatively homogeneous regarding interests and obligations and with gender-specific qualities and privileges. These qualities were considered inferior to men's since women—because of household responsibilities—were not capable of total devotion to the communist party. The author explores this construction of the female communist subject through a content analysis of classified materials from the archives of the Hungarian Socialist Workers' Party. (shrink)

Although pragmatism and feminism share a number of key features, pragmatist philosophy has had little influence on feminist thought. This article explores the reasons for this failed rendezvous. Focusing particularly on Rorty’s neo-pragmatism, it is argued that neo-pragmatism’s lack of an adequate political theory, particularly regarding key issues in current feminist theory such as the conceptualization of the relations between the public and private spheres and the understanding of subjectivity, is a particularly important factor here. Earlier versions of pragmatist thought, (...) however, might make more useful contributions to current feminist debates, particularly on the issues of rationality and ethics of care. (shrink)

Many of the social deprivations of Mexico will be worsened due to the SARSCOV2 pandemic. Namely, the insufficient access to public health, lack of labor rights, and the unsuccessful government’s response to eradicate male violence against women. The historical unconcern in promoting a culture rooted in mutual aid and self-care has provoked many citizens are disconnected from their social and health rights. Thus, people’s inability to carry through one direction –stay home- is unfulfilled, in part, due to structural inequalities. I (...) affirm that effective liberty could be obtained by approving a Universal Basic Income from a feminist perspective. I conclude that the aftermath of COVID-19, which will define everyday life for a while, require the endorsement of such measure. Diana Meyers argues that breaking the silence of victims and attending to their stories are necessary steps towards realizing human rights. Yet using highly personal victims' stories to promote human rights raises significant moral concerns, hence Meyers suggests that before victims' stories can be accessed and used, it is morally imperative that requirements of informed consent and non-retraumatization are secured. This article argues that while Meyers' proviso is important, and necessary, it may not be sufficient. First, one potential problem with (...) seeking to secure “informed consent” is that one has to ask for the consent, and in the act of asking one is potentially retraumatizing the victim. I propose that the fundamental values of justice embodied in the South African constitutional democracy require men to be feminist. These values provide the best safeguard of the important interests and values of both women and men. Men who accept these values can support the main concerns of feminism. The slogan “the personal is political” captures the distinctive challenge to the public-private divide posed by contemporary feminists. As such, feminist activism is not necessarily congruent with civic engagement, which is predicated on the paradoxical need to both bridge and sustain the public-private divide. Lee argues that rather than subverting the divide, the politics of the personal offers an alternative understanding of civic engagement that aims to reinstate individuals’ dignity and agency.

This article argues that although marriage has been a historically productive and important site of feminist inquiry, feminist theorizations of the institution of marriage have reached something of a stalemate. Moreover, contemporary debates on the merits of same-sex marriage risk disarming feminist marriage critiques while simultaneously replicating their limitations. Cosmopolitanism and statism represent the two dominant liberal theoretical standpoints in the current debate on global distributive justice. In this paper, I will develop a feminist argument that recommends that statist approaches be rejected. This argument has its roots in the feminist critique of liberal theories of social justice. In Justice, Gender, and the Family Susan Moller Okin argues that many liberal egalitarian theories of justice are inadequate because they assume a strict division between public and private spheres. I will (...) argue that this inadequacy is replicated in statist approaches to global justice. To demonstrate this, I will show how an analogue of Okin's critique of Rawls's A Theory of Justice can be extended to his The Law of Peoples. I will conclude that statist theories inevitably assume a strong divide between public and private spheres and that by doing so they allow for situations marked by gross injustice which anyone concerned with the welfare of the world's most vulnerable should find unacceptable. Las éticas dominantes desde la modernidad hasta nuestros días se han centrado en la universalidad, la imparcialidad, los principios morales, etcétera. Murdoch apunta a que la moralidad tiene que ver, (...) más bien, con nuestra capacidad de responder a otros individuos particulares, particularidad que no es reducible a ninguna forma de universalidad o imparcialidad compleja. ABSTRACT The Irish philosopher Iris Murdoch proposes a moral theory based on love. This "ethics of love" is constituted by loving attention and imagination. According to Murdoch, moral theories such as the Kantian one present important problems as they consider morality a matter of "moral algorithms". Dominant ethics from modernity until today have focused on universality, impartiality, moral principles, and so on. Murdoch points out that morality has to do, rather, with our ability to respond to other particular individuals, a particularity that is not reducible to any form of universality or complex impartiality. On the basis of in-depth interviews with 75 divorced New York fathers, the phenomenon of postdivorce paternal absence is investigated. The accounts provided by the interviewees suggest that father absence is more than a literal practice: it is also a perceived option and a standard of comparison. Father absence is a strategy of action, the objective of which is to control situations of conflict and tension and emotional states. That the majority of the fathers in the study shared common explanations (...) with regard to father absence is an indiction of their participation in a “masculinist discourse of divorce.” A primary theme in the discourse is the rhetoric of rights. In 2012 the Spanish government implemented the Royal Decree Law 16/2012 by which undocumented migrants are denied free access to the Spanish healthcare system. In the midst of unemployment, poverty and cuts in social protection, undocumented migrant women are facing multidimensional exclusions whereby austerity measures are having different consequences for women, especially for those who bear the greater brunt of caring roles in the form of mothering. Drawing upon qualitative research in the form of semi-structured interviews in Madrid, this article (...) examines the structural vulnerabilities of undocumented migrant mothers and analyses the gendered processes that provoke them. At a time in which the borders of Europe are reinforced and internal political and economic tensions question this fortress, migrants become shock absorbers for national anxieties. The article argues that the Royal Decree Law, following neoliberal discourses of citizenship and social rights and saturated by patriarchal normative understandings of women’s place in society and care, turns undocumented migrant mothers into disposable and invisible reproductive bodies deprived of rights. This article examines a peculiarity dating from Classical times, namely, that democracy may be achieved, in practice, independently of and prior to its articulation as theory. This peculiarity has implications for the way in which the history of democratic theory is understood, and also for the place of the democratic theorist in society. Paul Feyerabend, Richard Rorty, Chantal Mouffe and John Keane are theorists of democracy, but they all depart, first, from the commitment to the universal truth‐claims that underpin other (...) schools of democratic thought, and, second, from the concomitant belief in the priority of theory over practice. In doing so, they make it difficult to theorise how democracy might be brought about, except, circularly, where it already exists. On the one side, Feyerabend, Rorty and, to a lesser extent, Keane, assume that ‘democracy’ already exists, so that its realisation requires no theory. On the other, Mouffe argues that ‘democracy’ does not yet exist in practice, but her attempts to theorise its realisation are not convincing. (shrink)

This paper engages with debates around transformations in the production and circulation of images and the changes in modes of perception that these offer. Paul Virilio has argued that technological developments have produced a shift in the site of meaning‐production from the material reference space of the image to the time of visual contact by the viewer. I consider what significance these temporalities have in relation to social difference, and I develop debates around the performative to consider how the viewer (...) is constituted in visual performativity. This focus on time and performativity opens up questions of how vision may constitute the agency, intention and responsibility of the viewer. Drawing on an example of visual irony in advertising, I explore how the temporal suspension of meanings allows for a suspension of the terms of intent and responsibility. This visual performative accesses and reworks the terms of social difference and privilege in what I have called ‘retroactive intentionality’. (shrink)

Home museums in Israel and Germany produce a representational space in which the public figure, usually a ‘great man,’ is effectively ‘dragged home’ to the so-called private sphere so as to make the domestic worthy of musealization. Based on three years of ethnographic research in nine such museums, this article shows that when the sphere most identified with women is represented through the life and work of the men who lived there, the place of the wife and children is sidelined, (...) belittled, and at times concealed. In representing famous persons through material space and objects in the private abode, museal techniques determine which specific domestic areas, such as the kitchen and the bedroom, become the prime location of telling stories about women who lived in the house. They provide a shared perspective for visitors who find the stories about the wives endearing, recognizing home through them. (shrink)

While the common law may result in justice between heterosexual intimate partners in particular claims for a beneficial interest in the family home, it does so on its own terms—terms drawn up according to contractarian principles reflecting male sex-right, that subsist even as the world and the institution of marriage (and marriage-like relationships) have changed. This paper uses examples from the case law across four common law jurisdictions to expose the terms on which the contractarian nature of intimate partner trusts (...) permits claims for a distribution of intimate partners’ property, and how it excludes. In particular, it identifies the pervasiveness of the sexual contract in subsuming women’s expression of individualism to those of her intimate partner, and the implications of this for the derivation of a property interest in the family home. After beginning by situating the author's (possible) relation to Derrida's expression, ‘democracy to come’, the article proceeds from the position that Derrida's phrase is to be understood as part of a political intervention. Indeed, the inseparability of democracy and deconstruction confirms this. After setting out some of the pertinent features of ‘democracy to come’ – seen, in part, in the General Will – the notion of political community in the thought of Hannah Arendt is brought into question, if not deconstructed. (...) Political community as presented by Arendt is seen to limit the inclusiveness of democracy. In the final section, the article suggests that Agamben's critique of the very structure of the nation-state opens the way for a renewal of the notion of the human in the ‘community to come’. This article explores EU gender policy through the lens of the `Wollstonecraft dilemma', a guiding conceptual device that helps to summarize women's difficult path towards equality in a patriarchal system. EU gender policy reflects the contradictions women must face in their struggle for equality, which are common to most public gender policies. All provisions devised to progress in gender equality have negative retroactive effects on women, due to the patriarchal context in which they are applied. Empirical evidence from the Spanish (...) case offers further support to the argument, showing how EU gender policy is still trapped in the `Wollstonecraft dilemma'. A more holistic approach to EU gender policy, able to tackle all the areas of which patriarchy is composed, and an improved monitoring of EU gender policy implementation in the member states, could both generate a more effective gender policy in the EU and make further progress in solving the dilemma. This paper analyzes how military service can be a source of women’s antiwar voices, using the Israeli case of “Women Breaking the Silence”. WBS is a collection of testimonies from Israeli women ex-soldiers who have served in the Occupied Palestinian Territories. The WBS testimonies change the nature of women’s antiwar protest by offering a new, paradoxical source of symbolic legitimacy for women’s antiwar discourse from the gendered marginalized position of “outsiders within” the military. From this contradictory standpoint, the women soldiers (...) offer a critical gendered voice, which focuses on criticism of the combat masculinity and gendered identification with the Palestinian “other.” While they reaffirm the republican ethos that grants political dominance to male soldiers, they also deconstruct the image of hegemonic masculinity as the emblem of the nation and undermine gendered militarized norms. The article considers the changing position of women and the family from the Second World War until today using the UK as its example. It offers a theoretical perspective by setting out to examine the possibility that the rise of second-wave feminism both reflected and spearheaded an aspect of demographic transition to non-replacement populations. It considers the tension between the formation of ‘sexual difference’ to enable reproduction and what it calls the ‘engendering of gender’ in lateral relations which are indifferent (...) to procreation. With the achievements of feminism as a political vanguard and the demographic transition as its socioeconomic base, women were no longer defined by the family; their definition ceased to depend on procreation. The article proposes that the new use of the term ‘gender’ entered the political arena to become a key concept of feminism to indicate non-procreative sexuality and sexual relations that need not be heterosexual or biologically procreative. Judith Butler’s well-known suggestion that ‘gender’ troubles the status quo in a revolutionary manner cannot be sustained. Rather than disturbing the universe, the advent of ‘gender’ reflects the transition to a new demographic order. (shrink)

RESUMEN Este artículo trata de la marginación de la mujer de los espacios públicos y políticos en Europa y en el mundo indígena de Ecuador. Esta situación de exclusión y marginación se origina en pensadores como Locke, Rousseau, Kant y Hegel, quienes se encargaron de justificar epistemológicamente la exclusión de la mujer de los asuntos públicos en todos los ámbitos; es decir, redujeron el actuar de la mujer al espacio de lo privado, a lo doméstico, a los asuntos de la (...) familia. Sin embargo, es interesante constatar que algunos filósofos fueron sensibles al tema de lo femenino, es el caso de Condorcet y Stuart Mill, aunque su gran aporte no logró cambiar la mentalidad de la época. ABSTRACT This article deals with the marginalization of women from public and political spaces in Europe and in the indigenous world of Ecuador. This situation of exclusion and marginalization originates in thinkers such as Locke, Rousseau, Kant, and Hegel, who were responsible for epistemologically justifying the exclusion of women from public affairs in all areas; that is to say, they reduced the act of women to the space of the private, to the domestic, to the affairs of the family. However, it is interesting to note that some philosophers were sensitive to the issue of the feminine, in the case of Condorcet and Stuart Mill, although their great contribution did not change the mentality of the time. Different paradigms or perspectives function as the point of departure and framework for research. In this article ethical issues in the positivist and constructivist paradigms are presented. The article points out that more or less the same ethical codes are used in these paradigms, but with some nuanced interpretations. CHAT (cultural historical activity theory) is presented as a third paradigm. While conducting research, one intention within this paradigm is to change and improve practice. This means that the researcher and the (...) research participants during the research process together set the goals for the work and try to change practice en route to these goals. The relation between the researcher and the research participants is different than in the other two presented paradigms. This means that research in the CHAT paradigm also needs to be guided by different ethical codes. The purpose of this article is to show how some of the traditional ethical codes which direct research both in the positivist and constructivist paradigm change and are also inadequate in the CHAT paradigm. The article presents and discusses ethical codes that challenge the researchers’ communicative, social and knowledge competence. (shrink)
