To have free will is to have what it takes to act freely. When an agent acts freely—when she exercises her free will—what she does is up to her. A plurality of alternatives is open to her, and she determines which she pursues. When she does, she is an ultimate source or origin of her action. So runs a familiar conception of free will.

In this paper, we do three things. First, we put forth a novel hypothesis about judgments of moral responsibility according to which such judgments are a species of explanatory judgments. Second, we argue that this hypothesis explains both some general features of everyday thinking about responsibility and the appeal of skeptical arguments against moral responsibility. Finally, we argue that, if correct, the hypothesis provides a defense against these skeptical arguments.

When a person performs or fails to perform a morally significant action, we sometimes think that a particular kind of response is warranted. Praise and blame are perhaps the most obvious forms this reaction might take. For example, one who encounters a car accident may be regarded as worthy of praise for having saved a child from inside the burning car, or alternatively, one may be regarded as worthy of blame for not having used one's mobile phone to call for (...) help. To regard such agents as worthy of one of these reactions is to ascribe moral responsibility to them on the basis of what they have done or left undone. (These are examples of other-directed ascriptions of responsibility. The reaction might also be self-directed, e.g., one can recognize oneself to be blameworthy). Thus, to be morally responsible for something, say an action, is to be worthy of a particular kind of reaction —praise, blame, or something akin to these—for having performed it.[1.. (shrink)

A growing number of philosophers now hold that agent causation is required for agency, or free will, or moral responsibility. To clarify what is at issue, this paper begins with a distinction between agent causation that is ontologically fundamental and agent causation that is reducible to or realized in causation by events or states. It is widely accepted that agency presents us with the latter; the view in question claims a need for the former. The paper then examines a “disappearing (...) agent” argument from Derk Pereboom that is aimed at showing that free will requires agent causation that is ontologically fundamental. It is argued that the argument fails. Further, it is argued that, contrary to Pereboom’s claim, the issue raised by his disappearing agent argument is distinct from the problem of present luck that libertarian theories of free will face. The paper concludes with an assessment of the prospects for success of a disappearing agent argument showing that agent causation that is ontologically fundamental is required for agency tout court. In Free Will and Luck, Mele presents a case of an agent Ernie, whose zygote was intentionally designed so that Ernie A-s in 30 years, bringing about a certain event E. Mele uses this case of original design to outline the zygote argument against compatibilism. In this paper I criticize the zygote argument. Unlike other compatibilists who have responded to the zygote argument, I contend that it is open to the compatibilist to accept premise one, that Ernie does not act (...) freely and is not morally responsible for anything he does. I argue that compatibilists should deny premise two. Diana’s effective intention to create Ernie’s zygote such that Ernie A-s in 30 years and her intervention to bring about his A-ing mark a significant difference between Ernie and normal agents in a deterministic universe with regard to how their zygotes were created that affects whether those agents act freely and are morally responsible for so acting. Nearly all defences of the agent-causal theory of free will portray the theory as a distinctively libertarian one — a theory that only libertarians have reason to accept. According to what I call ‘the standard argument for the agent-causal theory of free will’, the reason to embrace agent-causal libertarianism is that libertarians can solve the problem of enhanced control only if they furnish agents with the agent-causal power. In this way it is assumed that there is only reason to accept (...) the agent-causal theory if there is reason to accept libertarianism. I aim to refute this claim. I will argue that the reasons we have for endorsing the agent-causal theory of free will are nonpartisan. The real reason for going agent-causal has nothing to do with determinism or indeterminism, but rather with avoiding reductionism about agency and the self. As we will see, if there is reason for libertarians to accept the agent-causal theory, there is just as much reason for compatibilists to accept it. It is in this sense that I contend that if anyone should be an agent-causalist, then everyone should be an agent-causalist. (shrink)

Incompatibilism about responsibility and determinism is sometimes directly construed as the thesis that if we found out that determinism is true, we would have to give up the reactive attitudes. Call this "the consequence". I argue that this is a mistake: the strict modal thesis does not entail the consequence. First, some incompatibilists (who are also libertarians) may be what we might call *resolute responsibility theorists* (or "flip-floppers"). On this view, if we found out that determinism is true, this would (...) not be to find out that no one is responsible; instead, what this would suggest is that incompatibilism is after all false. Second, some incompatibilists may instead deny the claim that if we found out that no one deserves the reactiveattitudes, we would have to give up the reactive attitudes. Call this position *innocent incompatibilism*. I explore several different reasons why the fact that no one deserves the reactive attitudes likely does not translate into a requirement for us to give up the reactive attitudes. The upshot: incompatibilism may be practically irrelevant, even if true. (shrink)

Some philosophers have claimed that causally determined agents are not morally responsible because they cannot make a difference in the world. A recent response by philosophers who defend the compatibility of determinism and responsibility has been to concede that causally determined agents are incapable of making a difference, but to argue that responsibility is not grounded in difference making. These compatibilists have rested such a claim on Frankfurt cases—cases where agents are intuitively responsible for acts that they couldn’t have failed (...) to perform. This essay argues, first, that the intuitive plausibility of the idea that responsibility is grounded in difference making is not completely put to rest by Frankfurt cases, even if those cases successfully show that responsibility is not grounded in difference making in the sense of access to alternative possibilities of action. It then goes on to develop a different compatibilist strategy, one according to which responsibility is grounded in difference making, but the type of difference making it is grounded in does not require access to alternative possibilities. Indeed, it is a form of difference making that is clearly compatible with determinism. (shrink)

The introduction of Autonomous Military Systems (AMS) onto contemporary battlefields raises concerns that they will bring with them the possibility of a techno-responsibility gap, leaving insecurity about how to attribute responsibility in scenarios involving these systems. In this work I approach this problem in the domain of applied ethics with foundational conceptual work on autonomy and responsibility. I argue that concerns over the use of AMS can be assuaged by recognising the richly interrelated context in which these systems will most (...) likely be deployed. This will allow us to move beyond the solely individualist understandings of responsibility at work in most treatments of these cases, toward one that includes collective responsibility. This allows us to attribute collective responsibility to the collectives of which the AMS form a part, and to account for the distribution of burdens that follows from this attribution. I argue that this expansion of our responsibility practices will close at least some otherwise intractable techno-responsibility gaps. (shrink)

Event-causal libertarians maintain that an agent’s freely bringing about a choice is reducible to states and events involving him bringing about the choice. Agent-causal libertarians demur, arguing that free will requires that the agent be irreducibly causally involved. Derk Pereboom and Meghan Griffith have defended agent-causal libertarianism on this score, arguing that since on event-causal libertarianism an agent’s contribution to his choice is exhausted by the causal role of states and events involving him, and since these states and events leave (...) it open which decision he will make, he does not settle which decision occurs, and thus “disappears.” My aim is to explain why this argument fails. In particular, I demonstrate that event-causal libertarians can dismantle the argument by enriching the reductive base in their analysis of free will to include a state that plays the functional role of the self-determining agent and with which the agent is identified. A familiar claim in the free will debate is that the freedom in dispute between compatibilists and incompatibilists is limited to the type required for an agent to deserve blame for moral wrongdoing, and to deserve it in a sense that is basic. In this paper, I seek a rationale for this claim, offer an explanation of basic desert, and then argue that the free will debate can persist even when divorced from basic desert.

In the contemporary moral responsibility debate, most theorists seem to be giving accounts of responsibility in the ‘desert-entailing sense’. Despite this agreement, little has been said about the notion of desert that is supposedly entailed. In this paper I propose an understanding of desert sufficient to help explain why the blameworthy and praiseworthy deserve blame and praise, respectively. I do so by drawing upon what might seem an unusual resource. I appeal to so-called Fitting-Attitude accounts of value to help inform (...) a conception of desert or merit, one that can be usefully applied to discussions of moral responsibility. I argue that the view, which I call, Desert as Fittingness (DAF), merits additional attention. I do so by making two claims: First, that it does better than extant Fitting Attitude accounts of blameworthiness and praiseworthiness; second, that it has an initial plausibility with respect to informing a general account of desert. While these reasons are insufficient to show the view is true, they do make the case for taking the view seriously. (shrink)

There are two broadly competing pictures of moral responsibility. On the view I favor, to be responsible for some action is to be related to it in such a way that licenses attributing certain properties to the agent, properties like blameworthiness and praiseworthiness. Responsibility is attributability. A different view understands being responsible in terms of our practices of holding each other responsible. Responsibility is accountability, which “involves a social setting in which we demand (require) certain conduct from one another and (...) respond adversely to one another’s failures to comply with these demands” (Watson, Philos Top 24:227–248, 1996). My concern here is the relation between moral responsibility and desert. Plausibly, if someone is morally responsible for something wrong then they deserve blame, and it is on the basis of them being morally responsible and its being wrong that they deserve blame. In this paper, I try to make progress toward understanding why it would follow that being morally responsible for something supports a desert claim. I propose to do this by exploring how the “two faces” of responsibility should proceed. An important upshot is that we gain a new currency by which to evaluate extant theories of responsibility that might favor one or the other conception: do they carry plausible desert commitments? To illustrate this benefit, I argue that accountability theory carries implausible implications for deserved praise. (shrink)

Dwayne Moore (2021) argues that libertarians about free will who are reductive physicalists cannot make proper sense of free will. In doing so, he presents what he calls “the physical indeterminism luck objection” to libertarian free will. He goes on to consider three different contemporary naturalistic approaches to libertarian free will (LFW) – those of Christopher Franklin, Mark Balaguer, and Robert Kane – and argues that if understood as reductive physicalist views they all fall prey to this objection. While it’s (...) not entirely clear that Kane is a reductive physicalist, it is clear that he would reject any kind of eliminative materialism or eliminative physicalism (Kane 1996, 147). Regardless, in this essay I argue that even if Kane’s view is a kind of reductive physicalist view, it is immune to the arguments made in Moore’s essay. (shrink)

Proponents of modern Frankfurt-Style Counterexamples generally accept that we cannot construct successful FSCs in which there are no alternative possibilities present. But they maintain that we can construct successful FSCs in which there are no morally significant alternatives present and that such examples succeed in breaking any conceptual link between alternative possibilities and free will. I argue that it is not possible to construct an FSC that succeeds even in this weaker sense. In cases where any alternatives are clearly insignificant, (...) it does not appear at all obvious that the agent can be held responsible. Present popular FSCs include alternatives that are ambiguous in their significance, and when the examples are sharpened to remove this ambiguity, they lose their force. Moreover, the proponent of such examples faces a problem: We can easily construct scenarios in which any alternatives are obviously insignificant, and in such scenarios, we are not intuitively inclined to suppose the agent is responsible. The proponent of new FSCs must therefore distinguish any alternatives she includes from the sorts included in these scenarios. The difference must now be such that this helps to make it seem intuitively likely that the agent is responsible where the agent otherwise would not appear responsible, and these alternatives are irrelevant to any judgment about whether the agent is responsible. I maintain that it is impossible to achieve both of these goals at once. (shrink)

Revisionism about moral responsibility is the view that we would do well to distinguish between what we think about moral responsibility and what we ought to think about it, that the former is in some important sense implausible and conflicts with the latter, and so we should revise our concept accordingly. In this paper, I assess two related problems for revisionism and claim that focus on the first of these problems has thus far allowed the second to go largely unnoticed. (...) Here I develop this new objection to revisionism and argue that, while revisionists can successfully respond to the reference-anchoring problem, the normativity-anchoring problem poses a serious objection to the view. In particular, the methodological commitments used to motivate revisionism make it uniquely difficult for revisionists to justify our continued participation in the practice of moral praising and blaming. I conclude by briefly addressing a potential objection based on a common charge against revisionism: that there is no real difference between the view and its conventional competitors and thus the normativity-anchoring problem is of little interest in the broader dialectic. An account of what sort of causal integration is necessary for an agent to exercise agency is offered in support of a soft-line response to Derk Pereboom’s four-case argument against source-compatibilism. I argue that, in cases of manipulation, the manipulative activity affects the identity of the causal process of which it is a part. Specifically, I argue that causal processes involving direct manipulation fail to count as exercises of intentional agency because they involve heteromesial causal deviance. In contrast, standard deterministic (...) causal processes do not involve heteromesial causal deviance and are agency-preserving. The upshot is that there is a relevant difference between a causal process involving direct manipulation by another agent and a deterministic causal process that involves no such intervention. If this is right, then Pereboom’s four-case argument does not pose a threat to source-compatibilist theories of free will and moral responsibility. (shrink)

In her seminal essay ‘Causality and Determination’, Elizabeth Anscombe very decidedly announced that “physical indeterminism” is “indispensable if we are to make anything of the claim to freedom”. But it is clear from that same essay that she extends the scope of that claim beyond freedom–she suggests that indeterminism is required already for animal self-movement. Building on Anscombe’s conception of causality and determinism, I will suggest that it extends even further: life as such already requires physical indeterminism. Furthermore, I show (...) that we can, on this basis, arrive at the idea of varieties of determinism, along with a corresponding variety of incompatibilist theses. From this Anscombean vantage point, the free will discussion takes on a quite different outlook. The question whether free agency can coexist with determinism on the level of blind physical forces, which preoccupies the philosopher of free will, turns out to conflate a whole series of compatibility questions: not just whether life is compatible with physical determinism, but also whether animal self-movement is compatible with ‘biological determinism’, and whether free agency is compatible with ‘animal determinism’. Non-Causal Libertarianism (NCL) is a libertarian position which aims to provide a non-causal account of action and freedom to do otherwise. NCL has been recently criticized from a number of quarters, notably from proponents of free will skepticism and agent-causation. The main complaint that has been voiced against NCL is that it does not provide a plausible account of an agent’s control over her action, and therefore, the account of free action it offers is inadequate. Some critics (mainly agent-causationists) have (...) even gone so far as to claim that NCL does not offer a plausible account of action. My goal in this paper is to defend NCL against these charges. More specifically, I deal with Derk Pereboom's Disappearing-Agent-Objection, Peter van Inwagen's Mind Argument, and with two objections to NCL by Randolph Clarke. (shrink)

In this paper, I explore the idea that someone can deserve resentment or other reactive emotions for what she does by attention to three psychological functions of such emotions—appraisal, communication, and sanction—that I argue ground claims of their desert. I argue that attention to these functions helps to elucidate the moral aims of reactive emotions and to distinguish the distinct claims of desert, as opposed to other moral considerations.

Libertarian theories of freedom and responsibility face a worry about luck: if an action is undetermined, the action cannot be legitimately attributed to the agent; instead the action is a matter of luck, and so the agent is not responsible for the action. Robert Kane defends libertarianism by appealing to self-forming actions. These actions are undetermined because the agent is attempting to act on two conflicting motives, but the agent is responsible for the outcome if she is responsible for having (...) those motives. If the agent “endorsed” both motives in earlier SFAs, Kane argues that we can hold the agent responsible for both motives, and hence responsible for the later SFA. We will further develop others’ arguments that Kane’s appeal to earlier SFAs to explain responsibility for a later SFA is unsatisfactory. We then raise a second objection to Kane’s use of SFAs. On one formulation of an SFA, the agent does three things: she exerts two efforts of will to make opposing choices, and she also acts on one of them. On another formulation of an SFA, the agent does just two things: she exerts two efforts of will to make opposing choices. One of those efforts turns out to be successful, but that success doesn’t require any further intervention from the agent. We distinguish two worries involving luck, a problem of resultant luck and a problem of constitutive luck, and show that neither model of SFAs solves both problems. (shrink)

This paper provides a brief review of some of the central elements of Robert Kane’s event-causal libertarian theory of free will. It then goes on to consider four of the central criticisms Derk Pereboom has made of Kane’s view and it shows how each of these criticisms can be reasonably answered. These criticisms are the no further power/control objection, the disappearing agent/luck objection, the randomizing manipulator objection, and the problem of responsibility for efforts of will.

Robert Kane has for many years claimed that in our underivatively free actions, what he calls “self-forming acts”, we actually try to do both of the two acts we are contemplating doing and then we ultimately end up doing only one of them. This idea of dual willings/efforts was put forward in an attempt to solve luck problems, but Randolph Clarke and Alfred Mele argue that for this to work agents must, then, freely engage in the dual efforts leading up (...) to their SFAs. In response, Kane has said they do so freely by meeting compatibilist criteria of freedom. In Free Will and Luck , Mele argues that this move is deeply problematic. In this essay, I defend Kane's position. In doing so, I clarify important differences between the SFAs of adults and those of young children, making more clear the connections between SFAs, character, and responsibility. (shrink)

Some compatibilists have responded to the manipulation argument for incompatibilism by proposing an historical theory of moral responsibility which, according to one version, requires that agents be morally responsible for having their pro-attitudes if they are to be morally responsible for acting on them. This proposal, however, leads obviously to an infinite regress problem. I consider a proposal by Haji and Cuypers that addresses this problem and argue that it is unsatisfactory. Most contemporary accounts of moral responsibility take desert to play a central role in the nature of moral responsibility. It is also assumed that desert is a backward-looking concept that is not directly derivable from any forward-looking or consequentialist considerations, such as whether blaming an agent would deter the agent from performing similar bad actions in the future. When determining which account of moral responsibility is correct, proponents of desert-based accounts often take intuitions about cases to provide evidence either in (...) favor of or against a proposed theory. In this paper, I discuss two experiments that test whether folk intuitions accord with what desert-based accounts would predict. Results suggest that moral responsibility intuitions are sensitive to forward-looking considerations, thus posing a problem for desert-based accounts of moral responsibility. If appealing to intuitions about cases is a valid method of discovering the nature of moral responsibility and desert, it seems either desert is not entirely backward-looking or moral responsibility is not exclusively desert-based. These experimental results also suggest that consequentialist accounts of moral responsibility, which have largely been abandoned due to their counterintuitive nature, are perhaps not so counterintuitive after all. In this paper I argue that Pereboom’s empirical objection to agent causation fails to undermine the most plausible version of agent-causal libertarianism. This is significant because Pereboom concedes that such libertarianism is conceptually coherent and only falls to empirical considerations. To substantiate these claims I outline Pereboom’s taxonomy of agent-causal views, develop the strongest version of his empirical objections, and then show that this objection fails to undermine what I consider the most plausible view of agent-causal libertarianism, namely, reconciliatory integrationist (...) agent-causalism. I then strengthen my criticism of Pereboom by responding to three objections to my view. I show that these objections, though initially challenging, fail to undermine my argument. I therefore conclude that, to this extent, agent-causal views remain a viable option in the contemporary free will debate. (shrink)

As a neurodevelopmental condition that affects cognitive functioning, autism has been used as a test case for theories of moral responsibility. Most of the relevant literature focuses on autism’s impact on theory of mind and empathy. Here I examine aspects of autism related to executive function. I apply an account of how we might fail to be reasons responsive to argue that autism can increase the frequency of excuses for transgressive behavior, but will rarely make anyone completely exempt from moral (...) responsibility in general. On this account, although excuses may apply more often to autists than to others, the excuses that apply to autists are just the same excuses that can apply to anyone. (shrink)

While skeptical arguments concerning free will have been a common element of philosophical discourse for thousands of years, one could make the case that such arguments have never been more numerous or forceful than at present. In response to these skeptical attacks, some philosophers and psychologists have expressed concern that the widespread acceptance of such skeptical attitudes could have devastating social consequences. In this paper, I set out to address whether such concerns are well-founded. A lengthy reply to 13 critical discussions of _Meaning in Life: An Analytic Study_ collected in an e-book and reprinted from the _Journal of Philosophy of Life_. The contributors are from a variety of philosophical traditions, including the Anglo-American, Continental and East Asian (especially Buddhist and Japanese) ones.

I examine Manuel Vargas's revisionist justification for continuing with our responsibility-characteristic practices in the absence of basic desert. I query his claim that this justification need not depend on how we settle questions about the content of morality, arguing that it requires us to reject the Kantian principle that prohibits treating anyone merely as a means. I maintain that any convincing argument against this principle would have to be driven by concerns that arise within the sphere of moral theory itself, (...) whereas Vargas's argument draws solely on concerns about the expensive metaphysics involved in a libertarian conception of freedom. I argue that this amounts not just to changing the concept of free will by stipulation, but also (more problematically) to changing our moral principles by stipulation. (shrink)

Revisionists claim that the retributive intuitions informing our responsibility-attributing practices are unwarranted under determinism, not only because they are false, but because if we are all victims of causal luck, it is unfair to treat one another as if we are deserving of moral and legal sanctions. One revisionist strategy recommends a deflationary concept of moral responsibility, and that we justify punishment in consequentialist rather than retributive terms. Another revisionist strategy recommends that we eliminate all concepts of guilt, blame and (...) punishment, and treat dangerous criminals as we treat people with contagious diseases. I argue against both strong and moderate revisionism that it is not unfair to hold persons desert -entailingly responsible insofar as they take an interest in being treated as appraisable, and that it is unfair to persons not to treat them as desert -entailingly responsible contrary to their interests in being treated as such. The interest-based argument, I conclude, give us a justification for communicating retributive attitudes, but may still require a weak revision of our retributive practices, in the direction of a communicative theory of punishment. The immediate aim of this paper is to articulate the essential features of an alternative compatibilist position, one that is responsive to sources of resistance to the compatibilist program based on considerations of fate and luck. The approach taken relies on distinguishing carefully between issues of skepticism and pessimism as they arise in this context. A compatibilism that is properly responsive to concerns about fate and luck is committed to what I describe as free will pessimism, which is to be (...) distinguished from free will skepticism. Free will skepticism is the view that our vulnerability to conditions of fate and luck serve to discredit our view of ourselves as free and responsible agents. Free will pessimism rejects free will scepticism, since the basis of its pessimism rests with the assumption that we are free and responsible agents who are, nevertheless, subject to fate and luck in this aspect of our lives. According to free will pessimism, all the major parties and positions in the free will debate, including that of skepticism, are modes of evasion and distortion regarding our human predicament in respect of agency and moral life. Peter Strawson defends the thesis that determinism is irrelevant to the justifiability of responsibility-attributions. In this paper, I want to examine various arguments advanced by Strawson in support of this thesis. These arguments all draw on the thought that the practice of responsibility is inescapable. My main focus is not so much the metaphysical details of Strawsonian compatibilism, but rather the more fundamental idea that x being inescapable may be reason for us to regard x as justified. I divide Strawsonian (...) inescapability arguments into two basic types. According to arguments of the first type we cannot give up the practice. According to arguments of the second type we should not give up the practice. My reasons for revisiting these Strawsonian inescapability arguments are, first, to establish that these are different and to some extent conflicting arguments. Second, I hope to show that none of Strawson’s inescapability arguments are convincing. Third, I discuss the possibility that the practice of responsibility is inescapable in a different, more pessimistic sense than envisaged by Strawson. What may be inescapable under conceivable scenarios is the conflict of theoretical and practical considerations in the justification of the practice. (shrink)

Take determinism to be the thesis that for any instant, there is exactly one physically possible future, and understand incompatibilism regarding responsibility to be the view that determinism is incompatible with moral responsibility. Of the many different arguments that have been advanced for this view, the crux of a relatively traditional one is this: If determinism is true, then we lack alternatives. If we lack alternatives, then we can't be morally responsible for any of our behavior. Therefore, if determinism is (...) true, then we can't be morally responsible for any of our behavior. The second premise is a version of the principle of alternate possibilities : persons are morally responsible for what they have done only if they could have done otherwise. This principle, in conjunction with the assumptions that responsibility requires control, and that this control consists in the freedom to do otherwise, provides the vital bridge from the initial premise to the skeptical conclusion. Some incompatibilists, joining ranks with various compatibilists, have sought to reject this principle by invoking so-called ‘Frankfurt examples.’. (shrink)

Free determined decisions are free decisions that are causally determined by the character of the agent. Robert Kane is a libertarian about free will who believes some of our free decisions are determined in this way. According to Kane, for a determined decision to be free it must proceed from the agent's character and the agent must have shaped that character through previous undetermined free decisions. In recent writings, Mark Balaguer has argued that human beings may well possess libertarian freedom, (...) but he rejects Kane's view that free determined acts must proceed from a character that is constructed from prior undetermined free decisions. This essay explains Balaguer's argument for rejecting the Kanean view and critically responds to it in defense of Kane's position on free determined decisions. (shrink)

In the debate on free will and moral responsibility, Saul Smilansky is a hard source-incompatibilist who objects to source-compatibilism for being morally shallow. After criticizing John Martin Fischer’s too optimistic response to this objection, this paper dissipates the charge that compatibilist accounts of ultimate origination are morally shallow by appealing to the seriousness of contingency in the framework of, what Paul Russell calls, compatibilist-fatalism. Responding to the objection from moral shallowness thus drives a wedge between optimists and fatalists within the (...) compatibilist camp. (shrink)

What are the freedom-relevant conditions necessary for someone to be a morally responsible person? I examine several key authors beginning with Harry Frankfurt that have contributed to this debate in recent years, and then look back to the writings or Søren Kierkegaard to provide a solution to the debate. In this project I investigate the claims of semi-compatibilism and argue that while its proponents have identified a fundamental question concerning free will and moral responsibility—namely, that the agential properties necessary for (...) moral responsibility ascriptions are found in scenarios where the agent acts on her own as opposed to her action resulting from freedom undermining external causes such as manipulation, phobias, etc.—they have failed to show that the freedom-relevant agential properties identified in those actual-sequence scenarios are compatible with causal determinism. My argument is that only a voluntarist-libertarian theory can adequately account for the kinds of cases that the semicompatibilist identify. I argue that there are three freedom-relevant conditions necessary for someone to be a morally responsible person: a hierarchical understanding of human desires [specifically and mental states generally], an incompatibilist (non-deterministic) understanding of human action, and a historical understanding of character development. The ability to reflect critically about one’s own desires and emotions, and thus to have a kind of self-knowledge and understanding with regard to the springs of one’s own actions, is required to make it possible for the agent to be the “source” of her own actions and character. The non-deterministic understanding of human action is needed for a similar reason: if determinism is true, then every action a person performs can be ultimately traced to and exhaustively explained in terms of factors outside the agent’s control, thus making the agent’s responsibility for his actions an illusion. And finally,human nature must be such that, over time, one’s choices leave a dispositional residue self-understanding and motivation in the person’s self, out of which, in mature understanding and motivation, the person acts as a fully responsible agent. While agreeing with Fischborn’s (2018) contention that, according to one traditional definition of compatibilism, my position should be classified as that of a libertarian incompatibilist, I argue here for a different view of compatibilism. This view involves, on the one hand, local probabilistic causation of decisions (rather than universal strict determinism) and, on the other, free will conceived as involving decisions generated by a decision-making process carried out by the brain, which consciously contemplates different alternatives and could in principle have (...) been different from what it was, implying that the agent could in normal conditions have done otherwise in the same circumstances. After discussing different views of causation (including determinism) and of free will, I make a revision of some passages from my earlier work, quoted by Fischborn. I conclude that what is crucial in the question of (in)compatibilism is the (in)compatibility between freedom of decisions and natural causation of human actions. According to this looser and, I argue, more pertinent view of compatibilism, I maintain my previous classification of my position on the matter as compatibilist. (shrink)

David Armstrong once argued that to solve the problem of induction with inference to the best explanation we need an anti-Humean conception of law. Some Humeans have argued that this argument begs the question against Humeanism. In this paper, I propose a new argument for the same conclusion which is not vulnerable to this criticism. In particular, I argue that explanationist approaches to the problem of induction that are combined with Humeanism is internally incoherent.

This thesis investigates the conceptual relationship between laws of nature and free will. In order to clarify the discussion, I begin by distinguishing several questions with respect to the nature of a law: i) do the laws of nature cover everything that happens? ii) are they deterministic? iii) can there be exceptions to universal and deterministic laws? iv) do the laws of nature govern everything in the world? In order to answer these questions I look at three widely endorsed accounts (...) of laws: "Humean" regularity accounts, laws as relations among universals, and the dispositional essentialist account. I argue that there is nothing in the very nature of a law - in any of the accounts surveyed - that implies a positive answer to questions (i) and (ii). I show that this has important consequences for the free will problem. I then turn to the compatibility of free will and determinism. I focus on the Humean view and the dispositional essentialist account of laws. And the bulk of this discussion concerns the consequence argument, especially the question of whether the laws of nature are "up to us". I show that, on the dispositional conception of laws, there is no sense in which the laws of nature are up to us, contrary to the Humean view. However, this does not mean that there is no room for free will on the dispositional account. I argue that free will requires the laws of nature to be limited in scope, rather than being indeterministic. I conclude by showing that this allows one to resist the claim that indeterminism rules out free will. (shrink)

Since philosophers generally agree that free will is understood partly by the relation it holds to moral responsibility, achieving a better understanding of free will requires that we have a clear idea of the sort of moral responsibility to which free will is thought to be connected. I argue that examining the substantive differences that exist between compatibilists and incompatibilists reveals a specific notion of moral responsibility that is best suited for philosophical debates regarding free will. Upon examination, it becomes (...) apparent that the primary substantive disputes between compatibilists and incompatibilists—as well as between libertarians and skeptics—have to do with the issue of whether retributivist reward or punishment is ever appropriate for certain kinds of agents. Drawing from this, I suggest that participants in the free will debate adopt a particular understanding of moral responsibility that can ground the propriety of retributivist justice. (shrink)

Manuel Vargas advocates a revised understanding of the terms “free will” and “moral responsibility” that eliminates the problematic libertarian commitments inherent to the commonsense understanding of these terms. I argue that in order to make a plausible case for why philosophers ought to adopt his recommendations, Vargas must explain why we ought to retain the retributivist elements that figure prominently in both commonsense views about morality and philosophical discussions concerning free will and moral responsibility. Furthermore, I argue that his revisionist (...) account lacks the resources necessary to accommodate retributivist attitudes and practices. (shrink)

In the contemporary debate between determinism and indeterminism, quantum mechanics are used by libertarianists, both as a resource to escape the determinism imposed by classical physics, and as a tool to search for a ground to the possibility of free will and moral responsibility. This paper will show that every defense of free will based on quantum mechanics has to overcome at least two objections: on the one hand what I have decided to call the scale principle, and, on the (...) other hand Robert Kane´s luck principle. As will be shown, to answer the first objection does not imply answering the second. Through an analysis of the most recent proposals attempting to solve the latter, this paper will try to conclude that none of the proposals offers a convincing explanation of how quantum mechanics can help to solve the problem of free will. Instead, quantum mechanics seem to contribute to its complication. (shrink)
