From the perspective of philosophy and political science it is often pointed out that trust is of central value for democracy. The paper critically examines this claim and argues that we should not overestimate the role of trust in democracy. In order to do that, I argue for a specific understanding of the notion of trust that appropriately accounts for the distinction between trust and mere reliance. In a second step, I argue that we have no reason to put this (...) kind of trust in our elected officials and representatives, but should instead focus on legislative and institutional ways to make sure that they are reliable in particular respects. After contrasting my suggestion with the position of Hardin, I point to two advantages of my account: The avoidance of political analysis through the lens of trust allows us to react more flexibly to unforeseen circumstances and resist populist attempts to emotionalize public debates; at the same time, diffusing the tension between trust and civic vigil... Este trabajo fue pensado a modo de homenaje a Antoni Domènech, quien nos legó un Programa de Investigación sobre “las raíces históricas y conceptuales del republicanismo democrático clásico”, también valedero para el momento actual del modo de producir capitalista en el que nos encontramos al inicio de la tercera década del siglo XXI. Nos ocuparemos i) de fundamentar y mostrar la viabilidad de una Renta Básica, entendida como resguardo de un mínimum de existencia social para todos, que permitiría garantizar una (...) universalización de la libertad republicana; y también ii) abordaremos el tema de la justificación de una Renta Máxima, entendiendo que la acumulación de riqueza y, por ello mismo, de poder económico y político de los muy ricos, atenta contra el deber fiduciario de las repúblicas democráticas de garantizar una “vida normal” para todos sus habitantes. This article is envisaged as a homage to Antoni Domènech who bequeathed us a Research Programme on “the historical and conceptual origins of classical democratic republicanism”, which is also valid for the phase of the capitalist mode of production we are presently facing at the beginning of the third decade of the twenty-first century. Our aims are 1) to establish and demonstrate the viability of a basic income, which is understood as safeguarding a minimum of social existence for everyone, and that would guarantee the universalisation of republican freedom; and 2) to tackle the question of justifying a Maximum Income, in the understanding that the accumulation of wealth, and hence of the political and economic power of the very rich, is an assault against the fiduciary duty of democratic republics to guarantee a “normal” life for all citizens. Institutions undertake a huge variety of constitutive purposes. One of the roles of legitimacy is to protect and promote an institution’s pursuit of its purpose; state legitimacy is generally understood as the right to rule, for example. When considering legitimacy beyond the state, we have to take account of how differences in purposes change legitimacy. I focus in particular on how differences in purpose matter for the stringency of the standards that an institution must meet in order to be legitimate. (...) An important characteristic of an institution’s purpose is its deontic status, i.e. whether it is morally impermissible, merely permissible, or mandatory. Although this matters, it does so in some non-obvious ways; the mere fact of a morally impermissible purpose is not necessarily delegitimating, for example. I also consider the problem of conflicting, multiple, and contested institutional purposes, and the different theoretical roles for institutional purpose. Understanding how differences in purpose matter for an institution’s legitimacy is one part of the broader project of theorizing institutional legitimacy in the many contexts beyond the traditional context of the state. Jackie Scully, no verbete Bioética Feminista, exemplifica o valor da influência dessas correntes no âmago de todos os contemporâneos. Sua escrita homenageia postumamente Anne Donchin com um apanhado histórico da luta de inserção de políticas feministas na pesquisa acadêmica global. No verbete “Democracia”, os professores brasileiros Gustavo Dalaqua e Alberto Ribeiro Barros acrescentaram tópicos importantes ao tema geral, respectivamente: “Construtivismo Representativo vs. Representação Descritiva” e “Democracia Contestatória de Philip Pettit”. O texto de Thomas Christiano perpassa os principais argumentos de justificação política contra e a favor da democracia ocidental, com foco central nas concepções de liberdade e igualdade. Os verbetes dispostos nessa seleção de textos são tendenciosos na medida que expressam o interesse genuíno de cada pesquisador com os assuntos relevantes em suas pesquisas. Em virtude disso, a escolha “adota um lado” em detrimento de outros – mais especificamente: de outro que poderia ser mais “progressista”. Por si só, o livro já nasce reclamando um segundo volume, que será providenciado. Colocamos de lado qualquer exigência de “imparcialidade”, algo que não existe na Filosofia, muito menos na Filosofia Política. Sobressai, nesse aspecto, o caráter reflexivo que o assunto exige e a importância do assunto, sem o qual não teríamos a modernas concepções de representatividade, as teorias da justiça ou mesmo as ciências sociais. There is no question Arthur Ripstein’s Force and Freedom is an engaging and powerful book which will inform legal philosophy, particularly Kantian theories, for years to come. The text explores with care Kant’s legal and political philosophy, distinguishing it from his better known moral theory. Nor is Ripstein’s book simply a recounting of Kant’s legal and political theory. Ripstein develops Kant’s views in his own unique vision illustrating fresh ways of viewing the entire Kantian project. But the same strength and (...) coherence which ties the book to Kant’s important values of independence blinds the work to our shared moral ties grounded in other political values. Ripstein’s thoughts on punishment are novel in that he embeds criminal law, both in its retributivist and consequentialist facets, into Kant’s overarching political philosophy to show how criminal law can be seen as one aspect of the supremacy of public law. But a criminal law solely focused on the preservation of freedom takes little notice of the ways criminal law need expand its view to account for how a polity can restore the victim of a crime back to civic equality, reincorporate offenders after they have been punished and cannot leave past offenders isolated and likely to reoffend, resulting in the rotating door prison system and communities of innocents who remain preyed upon by career criminals. Lastly, a political theory that does not prize our civic bonds will ignore the startling balkanization of our criminal punishment practices, where policing, arresting and imprisonment become tools of racial and social oppression. In illustrating the benefits in viewing criminal law as a coherent part of Kant’s political theory of freedom, Ripstein also highlights what is absent. It then becomes clear that though Kant presents one important facet of punishment, only a republican political theory can meet the most pressing moral demands of punishment by reminding us that criminal law must be used to preserve and strengthen civic society. There seem to be good reasons that democratic institutions must be reformed in order to minimize the danger of unsustainable policy decisions infringing upon duties of intergenerational justice. This is why there exist a number of different proposals of how to reform democratic states in order to foster their duties towards the future. However, the debate lacks a systematic assessment of these suggested reforms within a coherent theoretical and norma-tive framework. This paper aims at developing such a framework. We suggest (...) two conceptual dimensions defining the spectrum of different justi-fiable institutional reforms: the relation between democracy and justice as one dimension and the conditions considered relevant for viewing democracies as responsible collective agents as the other. Depending on how we understand this relation and these conditions, it is possible to substantiate a set of types of institutional reforms that will promote democracies’ capacities to comply with their responsibilities towards the future. The Lockean theory of property licenses unilateral appropriation on the condition that there be ‘enough, and as good left in common for others’. However, the meaning of this proviso is all but clear. This article argues that the proviso is centered around the Lockean theory of freedom. To be free, I argue, we must be ‘non-subjected’ in the exercise of our rights, including our rights to appropriate. We enjoy such freedom only when the ability to exercise our rights does not (...) depend on others. That can obtain if literally enough and as good is left in common. But it can also obtain in other ways, for example through competitive labour markets. The latter offer something as good as ‘enough and as good’. (shrink)

Rawls ‘s political liberalism abandons the traditional political‐theory objective of providing a philosophical account of liberal democracy. However, Rawls also aims for a liberal political order endorsed by citizens on grounds deeper than what he calls a “modus vivendi” compromise; he contends that a liberal political order based upon a modus vivendi is unstable. The aspiration for a pluralist and “freestanding” liberalism is at odds with the goal of a liberalism endorsed as something deeper than a modus vivendi compromise among (...) competing comprehensive doctrines. A liberalism that is supported “for its own sake” rather than as a compromise must necessarily be based on some conception of the good, of the sort that political liberalism eschews. (shrink)

Recent disclosures suggest that many governments apply indiscriminate mass surveillance technologies that allow them to capture and store a massive amount of communications data belonging to citizens and non-citizens alike. This article argues that traditional liberal critiques of government surveillance that center on an individual right to privacy cannot completely capture the harm that is caused by such surveillance because they ignore its distinctive political dimension. As a complement to standard liberal approaches to privacy, the article develops a critique of (...) surveillance that focuses on the question of political power in the public sphere. (shrink)

Using automated systems to avoid the need for human discretion in government contexts – a scenario we call ‘rule by automation’ – can help us achieve the ideal of a free and equal society. Drawing on relational theories of freedom and equality, we explain how rule by automation is a more complete realization of the rule of law and why thinkers in these traditions have strong reasons to support it. Relational theories are based on the absence of human domination and (...) hierarchy, which automation helps us achieve. Nevertheless, there is another understanding of relational theories where what matters is the presence of valuable relationships with those in power. Exploring this further might help us see when and why we should accept human discretion. (shrink)

This paper develops a novel, neo-republican account of just state surveillance in the information age. The goal of state surveillance should be to avoid and prevent domination, both public and private. In light of that conception of justice, the paper makes three substantive points. First, it argues that modern state surveillance based upon information technology and predicated upon a close partnership with the tech sector gives the state significant power and represents a serious potential source of domination. Second, it argues (...) that, nonetheless, state surveillance can serve legitimate republican ends and so unilateral and private technological attempts to block it may be wrongful. Third, it argues that, despite the serious normative failings of current institutions, state surveillance can be justly regulated and made accountable through a legal liability regime that incentivizes tech company intermediaries to ally with civil society groups in order to safeguard the privacy rights of potential subjects of state surveillance. After defining the essential elements of Aristotelian citizenship, the article proposes to apply these criteria in its search for the equivalent of a citizen within the corporate polis. It argues that shareholding managers are the best positioned among a firm's constituents or stakeholders in fulfilling the role of corporate citizens. Greater participation by management not only in the control but also in the ownership of firms brings about benefits for the firm as a whole and for the managers themselves, as (...) organizational citizenship behavior literature, among others, suggests. Is implementing the beneficent nudge program morally permissible in worlds like ours? I argue that there is reason for serious doubt. I acknowledge that beneficent nudging is highly various, that nudges are in some circumstances morally permissible and even called for, and that nudges may exhibit respect for genuine autonomy. Nonetheless, given the risk of epistemic injustice that nudges typically pose, neither the moral permissibility of beneficent nudging in the abstract, nor its case-by-case vindication, appears sufficient to justify implementing a (...) nudge program in worlds like ours. Drawing on Miranda Fricker’s account of epistemic injustice, I argue that the cogent defense of any nudge program, relative to worlds like ours, stands in need of serious attention to its potential for fostering or sustaining epistemic injustice. A more specific point hinges on recognizing a form of epistemic injustice not enough attended to in the literature to date, which I call reflective incapacitational injustice. This includes relative disadvantages in the attaining of the capacity to engage in critical reason, such as the capacity to go in for potentially critical reasoned deliberation and discursive exchange concerning ends. Since Cass Sunstein’s First Law of behaviorally informed regulation would be taken, in worlds like ours, to justify indeterminately many nudges leading to such epistemic injustice we have general grounds for doubting the moral permissibility of this nudge program. We should hence oppose the implementation of any such program until it is shown not to violate the demands of epistemic justice. (shrink)

This paper defends a distinctly liberal approach to public health ethics and replies to possible objections. In particular, I look at a set of recent proposals aiming to revise and expand liberalism in light of public health's rationale and epidemiological findings. I argue that they fail to provide a sociologically informed version of liberalism. Instead, they rest on an implicit normative premise about the value of health, which I show to be invalid. I then make explicit the unobvious, republican background (...) of these proposals. Finally, I expand on the liberal understanding of freedom as non-interference and show its advantages over the republican alternative of freedom as non-domination within the context of public health. The views of freedom I discuss in the paper do not overlap with the classical distinction between negative and positive freedom. In addition, my account differentiates the concepts of freedom and autonomy and does not rule out substantive accounts of the latter. Nor does it confine political liberalism to an essentially procedural form. (shrink)

Este ensayo se ocupa de discutir el renacimiento de la tradición republicana en los últimos años, particularmente gracias a pensadores como Quentin Skinner, Maurizio Viroli y Philip Pettit. Se aborda esta tradición en sus principales elementos constitutivos, a saber: 1) el concepto de república propiamente dicho; 2) el papel central de las virtudes cívicas; 3) la concepción republicana de libertad; y 4) el concepto de gobierno de las leyes. Se desarrolla, en primer lugar, un breve análisis de estos cuatros elementos, (...) al mismo tiempo que se ponen en evidencia algunos problemas históricos y teóricos. A continuación, se compara la posición de los teóricos republicanos, tanto clásicos como contemporáneos, con la propia de la tradición liberal-democrática, que, para aquéllos, constituye el principal blanco de esta polémica. The notion of the common good has been cited as a key constituent of citizenship education in England, within which the development of a concern for the common good represents a key disposition. The term has, however, received little critical attention to date within the discourse of the subject, either in terms of its theoretical basis or its educational function and form. For this reason to develop the common good represents an ill‐defined aim of the citizenship education in schools. This (...) article seeks to redress this by critically engaging with different formulations of the common good within recent civic republican political theory. More specifically, it attempts to delineate between notions of the common good that are essentially moral and notions that emphasise political understandings of the term, and which, in so doing, minimise the moral. On the basis of this exploration a number of issues are raised for citizenship education in England and it is suggested that to fail to view the common good as a moral enterprise is inherently problematic. In order to vindicate rational-choice theory as a mode of explaining social patterns in general - social patterns beyond the narrow range of economic behaviour - we have to recognize the legitimacy of explaining the resilience of certain patterns of behaviour: that is, explaining, not necessarily why they emerged or have been sustained, but why they are robust and reliable. And once we allow the legitimacy of explaining resilience, then we can see how functionalist theory may also serve us well (...) in social science; we lose the basis - the empty black box argumenton which the rational-choice critique of the theory has mostly been grounded. Democracy is shown to be a non-instrumental good-in-itself (as well as an instrument in securing other goods) by extrapolation from the Aristotelian premise that humans are political animals. Because humans are by nature language-using, as well as sociable and common-end-seeking beings, the capacity to associate in public decisions is constitutive of the human being-kind. Association in decision is necessary (although insufficient) for happiness in the sense of eudaimonia. A benevolent dictator who satisfied all other conditions of justice, harms her subjects (...) by denying them opportunity to associate in the decisions by which their community is governed. (shrink)

Some theorists, worried about liberalism’s potential as a foundation for public health ethics, suggest that republicanism provides a better background of justification for public health policies, interventions, etc. In this article, this suggestion is put to the test, and it is argued that (i) contemporary (civic) republicanism and liberalism are not nearly as opposed as it is sometimes suggested, and that (ii) the kind of republicanism which one leading scholar in the field, Bruce Jennings, as an alternative to liberalism, does (...) not reflect the contemporary understanding of republicanism as held by, e.g. Phillip Pettit et al. Most criticism and exposition of John Rawls’s political theory has focused on his account of distributive justice rather than on his support for liberalism. Because of this, much of his argument for protecting the basic liberties remains under explained. Specifically, Rawls claims that representative citizens would agree to guarantee those social conditions necessary for the exercise and development of the two moral powers, but he does not adequately explain why protecting the basic liberties would guarantee these social conditions. This gap (...) in his argument leads to two problems. First, the Rawlsian argument for the priority of liberty would fail if the gap could not be filled. His argument would still support the protection of individual freedoms, but these freedoms would be treated like other primary goods and regulated by the difference principle. Second, without a full argument, there is not sufficient reason to favor Rawls’s left-liberal conception of the basic liberties over a more right-leaning conception that would prioritize the protection of free-market rights. To address these two problems, this paper fills in the gap in order to better explain Rawls’s full argument for egalitarian liberalism. (shrink)

Este artículo tiene como objetivo analizar las menciones y usos que realiza Nicolás Maquiavelo de la figura de Moisés en Il principe y en los Discorsi. Maquiavelo realiza un particular tratamiento que es necesario seguir de cerca: es a partir de su análisis que podemos encontrar insumos para interrogar cómo operan los liderazgos en la obra maquiaveliana y cómo los líderes interactúan con el pueblo a través de un círculo pasional que se genera entre ambos. A estos efectos, procederemos en (...) este artículo del siguiente modo: en primer lugar, restableceremos secuencialmente las menciones a Moisés en la obra de Maquiavelo. Solo una vez proporcionada esta reconstrucción nos dirigiremos al tratamiento de los ejes temáticos que resultan relevantes -la ausencia de la religión en Moisés, la crueldad, la tensión entre virtud y fortuna, y la relación entre líder y pueblo- con el fin de pensar la innovación teórica que estos ejemplos ilustran. Republicanism is increasingly attracting more attention from political philosophy. However, a mere hermeneutical approach it is usually used, which tends to neglect the political, social and economic circumstances that shaped this tradition of thought. This article addresses the modern conception of republican freedom with the North American and the French case through the work of two of their most representative figures, Thomas Jefferson and Maximilien Robespierre. The article defends that the political, juridical and economic government – the republican political economy– (...) devised by both, keeps important similarities that the current political philosophy cannot ignore. To illustrate this relationship, it is shown that both thinkers received a deep and similar influence of natural law philosophy and of fiduciary theory when thinking and trying to implement their models of government and their idea of ownership. This study compares Philip Pettit’s account of freedom to Hegelian accounts. Both share the key insight that characterizes the tradition of republicanism from the Ancients to Rousseau: to be subordinated to the will of particular others is to be unfree. They both also hold that relations to others, relations of recognition, are in various ways directly constitutive of freedom, and in different ways enabling conditions of freedom. The republican ideal of non-domination can thus be fruitfully understood in light of the (...) Hegelian structure of ‘being at one with oneself (Beisichsein) in another’. However, while the Hegelian view converges with Pettit on non-domination and recognition, their comprehensive theories of freedom are based on radically different metaphysics. This article tackles the theories of global justice whose “Chinese-style” cosmopolitanism is espoused by the notion of tianxia 天下. Specifically, I first examine the Chinese-style cosmopolitanism driven by the reinterpretation of tianxia. In doing so, I claim that it retains the very fallacy that can be found in liberal cosmopolitanism in failing to provide us with a regulative principle through which different justifications for justice can be steered toward a democratic deliberation between states. Second, through analyzing Dialogue on Mount Uisan (...) by Hong Daeyong 洪大容, I explore an alternative conception of tianxia in which all countries are placed on an equal footing rather than in a hierarchy. Finally, putting forward the ethics of differences in Dialogue on Mount Uisan, I will suggest a principle of reciprocity in which non-domination as a regulative principle can help better establish a discursive stance between states without a central hegemon. En este artículo propongo una justificación de la democracia, y de la autoridad política derivada de ella, a partir del ideal republicano de libertad como no-dominación. Argumento que los procedimientos democráticos tienen valor por sí mismos porque son mecanismos de decisión donde hay libertad de forma recíproca. Después muestro que la autoridad debe ser adecuadamente controlada para evitar que exista dominación, razón por la cual tiene que concebirse como una relación fiduciaria, en la que los gobernantes actúan como agentes de (...) la ciudadanía. Finalmente, establezco la necesidad de que los gobernantes cumplan con deberes fiduciarios y que los ciudadanos desarrollen virtudes cívicas. In this article I propose a justification of democracy, and of the political authority derived from it, based on the republican ideal of freedom as non-domination. I argue that democratic procedures have value in themselves because they are decision-making mechanisms where there is freedom on a reciprocal basis. I then show that political authority must be adequately controlled in order to avoid the existence of domination. This is why it must be conceived as a fiduciary relationship, in which the rulers act as agents of the citizenry. Finally, I establish the need for rulers to comply with fiduciary duties and for citizens to develop civic virtues. (shrink)

The coercive authority of the Kantian state is rationally grounded in the ideal of equal external freedom, which is realized when each individual can choose and act without being constrained by another's will. This ideal does not seem like it can justify state-mandated economic redistribution. For if one is externally free just as long as one can choose and act without being constrained by another, then only direct slavery, serfdom, or other systems of overt control seem to threaten external freedom. (...) Yet Kant endows the freedom-based state with considerable powers of economic redistribution. I argue that recent commentary has misunderstood both Kant's account of why poverty is a form of freedom-threatening dependence and the extent of the Kantian state's powers for remedying poverty. Criticizing Arthur Ripstein and the Kantianism of the “Toronto-School,” I argue that the most salient notion of dependence at issue within the Kantian framework is not the direct control of the choice-making capacities of another but asymmetrical influence in a power relationship. For Kant, poverty is fundamentally a problem of structural disempowerment. (shrink)

Neste artigo o autor relaciona os pensamentos políticos de Locke e Sidney para defender que Locke não pode ser inserido na tradição republicana da qual os escritos de Sidney fazem parte. Isto porque: 1) inexiste na teoria política lockeana uma visão de que a virtude cívica seja o suporte para instituições livres, tal como existe na referida tradição evocada por Sidney; 2) Locke reconhece o fundamento constitucional da prerrogativa do rei, o que para os republicanos, Sidney entre eles, é incompatível (...) com a liberdade; 3) Locke retrata um povo excessivamente cordato e permissivo com o uso do poder por parte do governante, e também pouco disposto ao exercício do direito de resistência. Diferentemente, Sidney recorre à história para defender que os povos livres revelam as qualidades necessárias para conduzir essa resistência, já que o reconhecimento de que o governo de si mesmo e a resistência à tirania é uma questão de dignidade do homem como ser de liberdade. It has become a commonplace in neo-republican thinking to claim that if the notion of rights can be allowed a place in republican political theory, it can never achieve the prominence that liberalism allegedly grants it. Philip Pettit’s book, Republicanism, provides several arguments to buttress this thesis. This article aims at examining these arguments in order to show that once properly stated, they must on the contrary be considered as powerful arguments to the effect that republicans take rights very seriously.

Algorithmic systems are increasingly used by state agencies to inform decisions about humans. They produce scores on risks of recidivism in criminal justice, indicate the probability for a job seeker to find a job in the labor market, or calculate whether an applicant should get access to a certain university program. In this contribution, we take an interdisciplinary perspective, provide a bird’s eye view of the different key decisions that are to be taken when state actors decide to use an (...) algorithmic system, and illustrate these decisions with empirical examples from case studies. Building on these insights, we discuss the main pitfalls and promises of the use of algorithmic system by the state and focus on four levels: The most basic question whether an algorithmic system should be used at all, the regulation and governance of the system, issues of algorithm design, and, finally, questions related to the implementation of the system on the ground and the human–machine-interaction that comes with it. Based on our assessment of the advantages and challenges that arise at each of these levels, we propose a set of crucial questions to be asked when such intricate matters are addressed. (shrink)

Una perspectiva reciente sobre los fundamentos normativos del derecho público ha propuesto concebir las relaciones entre ciudadanía y Estado como una “relación fiduciaria”, usando deberes fiduciarios del ámbito iusprivado para justificar limitaciones jurídicas y morales al poder del Estado. La gobernanza fiduciaria también ha sido señalada como una característica distintiva del republicanismo y la soberanía popular, ya que sitúa a la comunidad política como fideicomitente y beneficiaria de cualquier acto administrativo. En este artículo se revisan algunas concepciones protomodernas del gobierno (...) considerando sus justificaciones explícitamente fiduciarias. Concluye con una interpretación fiduciaria del iusnaturalismo Leveller, especialmente necesario para entender la relación de la gobernanza fiduciaria con la democracia. A recent perspective on the normative foundations of public law has proposed to conceive citizen-state relationships as a “fiduciary relationship”, using private-law fiduciary duties to justify legal and moral constrains on state power. Fiduciary governance has also been pointed as a distinct feature of republicanism and popular sovereignty, since it places the political community as trustor and beneficiary of any administrative act. This paper reviews some early modern conceptions of government considering their explicit fiduciary justifications. It concludes with a fiduciary account of Leveller natural law, especially needed to understand the relationship between fiduciary governance and democracy. (shrink)

Aulisio and Arora argue that the moral significance of value imposition explains the moral distinction between traditional conscientious objection and non-traditional conscientious objection. The former objects to directly performing actions, whereas the latter objects to indirectly assisting actions on the grounds that indirectly assisting makes the actor morally complicit. Examples of non-traditional conscientious objection include objections to the duty to refer. Typically, we expect physicians who object to a practice to refer, but the non-traditional conscientious objector physician refuses to refer. (...) Aulisio and Arora argue that physicians have a duty to refer because refusing to do so violates the patient’s values. While we agree with Aulisio and Arora’s conclusions, we argue value imposition cannot adequately explain the moral difference between traditional conscientious objection and non-traditional conscientious objection. Treating autonomy as the freedom to live in accordance with one’s values, as Aulisio and Arora do, is a departure from traditional liberal conceptions of autonomy and consequently fails to explain the moral difference between the two kinds of objection. We outline how a traditional liberal understanding of autonomy would help in this regard, and we make two additional arguments—one that maintains that non-traditional conscientious objection undermines society’s autonomy, and another that maintains that it undermines the physician-patient relationship—to establish why physicians have a duty to refer. Informal justice often is castigated as rough justice, procedurally unauthorized and substantively unrationalized and prone to error. Yet those same features are present, to some extent, in formal justice as well: they do not form the basis for any sharp categorical contrast between formal and informal justice. Furthermore, some roughness in justice may be no bad thing. Certain of those elements of roughness in formal justice are inextricably bound up with other features of formal justice that are rightly deemed morally (...) important. And rough informal justice can sometimes be used to change formal justice in more just directions. (shrink)

Is normative theory grounded in ontology and if so, how? Taking a debate between Kwame Gyekye and Thaddeus Metz as my point of departure, my aim in this article is to show that something normative does indeed follow from ontological views: The social ontological, I maintain, circumscribes the normative without, however, fully determining its content. My argument proceeds in two steps: First, I argue that our social ontological position constrains what kind of normative theory we may plausibly defend. A relational (...) ontology as defended by Gyekye entails a relational normative theory, whereas an atomist ontology calls for an individualist normative approach and a collectivist ontology for a strong communitarian one. Second, this link between the ontological and the normative has substantive implications for how to interpret the normative content of a theory; it entails interpreting normative values in light of the appropriate kind of normative thought. I illustrate the importance of this implication by showing that it suggests a decidedly relational reading of the core value of well-being in Gyekye’s moderate communitarianism, that resolves the alleged tension between communal and individual values in his account. In this paper I propose and develop a social account of global autonomy. On this view, a person is autonomous simply to the extent to which it is difficult for others to subject her to their wills. I argue that many properties commonly thought necessary for autonomy are in fact properties that tend to increase an agent’s immunity to such interpersonal subjection, and that the proposed account is therefore capable of providing theoretical unity to many of the otherwise heterogeneous requirements (...) of autonomy familiar from recent discussions. Specifically, I discuss three such requirements: (i) possession of legally protected status, (ii) a sense of one’s own self-worth, and (iii) a capacity for critical reflection. I argue that the proposed account is not only theoretically satisfying but also yields a rich and attractive conception of autonomy. (shrink)

This paper places Adam Smith within the long republican tradition, and offers an emancipatory reflection on the possible space of republican freedom within societies that harbour certain degrees of market activity. In doing so, it seeks to offer some criteria on the kind of political-institutional action that can be taken in modern societies in order to constitute markets that respect, and even promote, republican freedom. The paper is divided into four sections. Section 1 shows why Adam Smith's ethical-political analysis, which (...) was very influential in the shaping of classical political economy, can be presented as part of the broad republican tradition. Section 2 reflects on the possibilities for a realisation of republican freedom within markets. What I call 'commercial republicanism' is here analysed as a project for modern societies. Section 3 assesses the difficulties for commercial republicanism to unfold within capitalist societies, the structural features of which prevent individuals and groups from enjoying the kind of undominated social relations the republican tradition has always pleaded for. Finally, section 4 draws some conclusions on the epistemic and political meanings of commercial republicanism as an emancipatory project for contemporary societies. (shrink)

Workplace democracy is often defined, and has recently been defended, as a form of intra-firm governance in which workers have control rights over management with no ownership requirement on their part. Using the normative tools of republican political theory, the paper examines bargaining power disparities and moral hazard problems resulting from the allocation of control rights and ownership to different groups within democratic firms, with a particular reference to the European codetermination system. With various qualifications related to potentially mitigating factors, (...) such as workforce and shareholder composition or risk aversion and reallocation, the paper contends that forms of workplace democracy in which workers control and own the firm, such as cooperativism, are preferable to other forms, such as codetermination, in which ownership and control rights are formally separated. Pettit endorses a ‘republican’ conception of social freedom of the person as consisting of a state of non-domination, and takes this to refute Mill’s ‘liberal’ claim that non-domineering but coercive interference can compromise social freedom of choice. This paper argues that Pettit’s interpretation is true to the extent that Mill believes that the legitimate, non-arbitrary and just coercion of would-be dominators, for the sake of preventing them from dominating others, can render them unfree to choose to do so without rendering (...) them socially unfree (qua dominated) persons in their own right. However, contra Pettit, Mill is correct to reject the ‘republican’ view for at least two reasons. Firstly, it enables him to avoid commitment to the implausible implication that would-be dominators who sincerely deny any interest in a shared system of basic liberties are automatically rendered unfree persons by the coercion necessary to uphold such a system. Secondly, it enables him to avoid begging the question against ‘immoralists’ like Nietzsche, whose opposition to systems of reciprocal non-domination is at least partly motivated by the losses of social freedom of choice they entail for those they deem to be worthy of dominating others. Philip Pettit is the most important contemporany advocate of the republican tradition in political philosophy. He advances a concept of freedom as non-domination, and constrasts it with the liberal conception of freedom as non-interference. He claims that two features distinguish domination from interference: The capacity of interference , and the fact that the interference is arbitrary. I shall argue that Pettit´s republicanism is not sufficiently differente from liberalism, certainly not from John Rawls´s liberalism. The only relevant difference between republicanism and (...) liberalism is related to : the notion of arbitrariness. Yet this difference makes republicanism an unattractive version of liberalism, insofar as it, paradoxically, allows for republicanism to legitimize a grave form of domination, paternalism, and, in general, domination coming from the state. This problem gets exacerbated by Pettit´s consequentialist framework. (shrink)

L’objectif de cet article est de montrer que le républicanisme d’entreprise développé par Hsieh ne protège pas les travailleurs contre l’ensemble des interférences arbitraires. Comme ils sont fondés uniquement sur la contestation des décisions, les arrangements institutionnels que Hsieh propose n’arrivent pas à saisir l’ensemble des formes que peut prendre la domination. Pour ce faire, nous utiliserons la critique développée par McCormick des institutions républicaines. Pour exploiter cette critique et l’appliquer au contexte d’entreprise, nous aurons besoin de présenter les arguments (...) en faveur du parallèle État-entreprise. Nous verrons ensuite que la critique de McCormick appliquée à l’entreprise nous permet de défendre l’idée selon laquelle il est nécessaire d’aller plus loin que le républicanisme d’entreprise pour réaliser la liberté républicaine. El presente artículo comienza reconstruyendo las razones por las cuales las teorías modernas se concentran en la ciudadanía como una garantía muy importante de legitimidad -arguyendo que la ciudadanía está intrínsecamente ligada a una forma republicana de orden político. La segunda parte del artículo muestra que, bajo las actuales condiciones de la globalización, la ciudadanía crea o mantiene un orden transnacional multinivel que impide que otras personas y políticas puedan realizar una ciudadanía (completa), y que incluso contribuyen a violaciones directas (...) de exigencias legítimas por parte de no-ciudadanos. La tercera parte discute críticamente las propuestas de Archibugi, Owen y Baubóck acerca de cómo repensar la ciudadanía transnacional o formas equivalentes de participación y control. En la parte final, el artículo aboga por una conexión entre la concepción de la ciudadanía constelación y una forma específica de democracia transnacional. Tal conexión permitiría a la ciudadanía seguir siendo el factor clave para la legitimidad. This article starts by reconstructing the reasons for the modern focus on citi-zenship as a major guarantee for legitimacy - arguing that citizenship is intricately linked to a republican form of political order. In its second part this paper shows that under the current conditions of globalization citizenships creates or maintains a transnational multi-level order which prevents other persons and polities from realizing (full) citizenship, and even contributes to direct violations of legitimate claims of non-citizens. The third part of the article critically discusses proposals by Archibugi, Owen and Baubóck, how to rethink transnational citizenship or equivalent forms of participation and control. And in its final part it advocates linking the conception of constellational citizenship to a specific form of trans-national democracy. With such a link citizenship could continue to be the key factor for legitimacy. (shrink)

There is a kind of power no one should have over anyone else, even if they don’t do anything with this power, or even if they only use this power for good. The republican tradition of political philosophy calls this kind of power domination. Here, I develop a theory of domination, and use this theory to advance our understanding of political legitimacy and justification. My account of domination refines recent neo-republican attempts to identify dominating social power with the capacity to (...) interfere arbitrarily with the choices of others. I argue that this capacity is not sufficient for domination. Instead, domination requires that one agent possess “impositional” power over someone else: power enough to make their refusal to cooperate more costly than cooperation across a wide range of forms that cooperation might take. But not all impositional power is domination; impositional power is domination to the extent that those wielding it do so in “deliberative isolation”—in accord only with their own sense of what’s best. The nature of domination, what it takes to minimize it, and its connection to deficits in political values like freedom and equality, are the subject of Chapter 2. The remainder of the dissertation uses the results of that chapter to construct a non-voluntarist alternative to the standard liberal account of how to reconcile political power with freedom and equality. Chapters 3 and 4 show how consent—actual or hypothetical—is not necessary to legitimize political power. What is necessary is that such power enable us to fulfil our duties against dominating others, while remaining accountable to us so that the state does not itself become a source of domination. How duties against domination can legitimize states is the primary subject of Chapter 3. Chapter 4 turns to the question of what we owe our fellow citizens as we cooperate together in the task of holding the state accountable. To nudge is to design choice contexts in order to improve choice outcomes. Richard Thaler and Cass Sunstein emphatically endorse nudging but reject more restrictive means. In contrast, I argue that the behavioral psychology that motivates nudging also motivates what may be called jolting — i.e. the design of choice content. I defend nudging and jolting by distinguishing them from the sometimes oppressive means with which they can be implemented, by responding to some common arguments against nudging, and by showing (...) how respect for preferences over option sets and their aggregate properties may require the trimming of option sets, as well as helpful choice contexts.
