We consider the complex interactions between rape culture and epistemology. A central case study is the consideration of a deferential attitude about the epistemology of sexual assault testimony. According to the deferential attitude, individuals and institutions should decline to act on allegations of sexual assault unless and until they are proven in a formal setting, i.e., a criminal court. We attack this deference from several angles, including the pervasiveness of rape culture in the criminal justice system, the epistemology of testimony (...) and norms connecting knowledge and action, the harms of tacit idealizations away from important contextual factors, and a contextualist semantics for 'knows' ascriptions. The epistemology of risk examines how risks bear on epistemic properties. A common framework for examining the epistemology of risk holds that strength of evidential support is best modelled as numerical probability given the available evidence. In this essay I develop and motivate a rival ‘relevant alternatives’ framework for theorising about the epistemology of risk. I describe three loci for thinking about the epistemology of risk. The first locus concerns consequences of relying on a belief for action, where those consequences (...) are significant if the belief is false. The second locus concerns whether beliefs themselves—regardless of action—can be risky, costly, or harmful. The third locus concerns epistemic risks we confront as social epistemic agents. I aim to motivate the relevant alternatives framework as a fruitful approach to the epistemology of risk. I first articulate a ‘relevant alternatives’ model of the relationship between stakes, evidence, and action. I then employ the relevant alternatives framework to undermine the motivation for moral encroachment. Finally, I argue the relevant alternatives framework illuminates epistemic phenomena such as gaslighting, conspiracy theories, and crying wolf, and I draw on the framework to diagnose the undue skepticism endemic to rape accusations. While recent discussions of contextualism have mostly focused on other issues, some influential early statements of the view emphasized the possibility of its providing an alternative to both coherentism and traditional versions of foundationalism. In this essay, I will pick up on this strand of contextualist thought, and argue that contextualist versions of foundationalism promise to solve some problems that their non-contextualist cousins cannot. In particular, I will argue that adopting contextualist versions of foundationalism can let us reconcile Bayesian accounts (...) of belief updating with a version of the holist claim that all beliefs are defeasible. This essay is an accessible introduction to the proof paradox in legal epistemology. -/- In 1902 the Supreme Judicial Court of Maine filed an influential legal verdict. The judge claimed that in order to find a defendant culpable, the plaintiff “must adduce evidence other than a majority of chances”. The judge thereby claimed that bare statistical evidence does not suffice for legal proof. -/- In this essay I first motivate the claim that bare statistical evidence does not suffice for legal (...) proof. I then introduce and motivate a knowledge-centred explanation of this fact. The knowledge-centred explanation rests on two premises. The first is that legal proof requires knowledge of culpability. The second is that one cannot attain knowledge that p from bare statistical evidence that p. To motivate the second premise, I suggest that beliefs based on bare statistical evidence fail to be safe—they could easily be wrong—and bare statistical evidence cannot eliminate relevant alternatives. -/- I then cast doubt on the first premise; I argue that legal proof does not require knowledge. I thereby dispute the knowledge-centred explanation of the inadequacy of bare statistical evidence for legal proof. Instead of appealing to the nature of knowledge, I suggest we should seek a more direct explanation by appealing to those more foundational epistemic properties, such as safety or eliminating relevant alternatives. Ephecticism is the tendency towards suspension of belief. Epistemology often focuses on the error of believing when one ought to doubt. The converse error—doubting when one ought to believe—is relatively underexplored. This essay examines the errors of undue doubt. I draw on the relevant alternatives framework to diagnose and remedy undue doubts about rape accusations. Doubters tend to invoke standards for belief that are too demanding, for example, and underestimate how farfetched uneliminated error possibilities are. They mistake seeing how incriminating (...) evidence is compatible with innocence for a reason to withhold judgement. Rape accusations help illuminate the causes and normativity of doubt. I propose a novel kind of epistemic injustice, for example, wherein patterns of unwarranted attention to farfetched error possibilities can cause those error possibilities to become relevant. Widespread unreasonable doubt thus renders doubt reasonable and makes it harder to know rape accusations. Finally, I emphasise that doubt is typically a conservative force and I argue that the relevant alternatives framework helps defend against pernicious doubt-mongers. (shrink)

ABSTRACT Rima Basu and I have offered separate accounts of wokeness as an anti-racist ethical concept. Our accounts endorse controversial doctrines in epistemology: doxastic wronging, doxastic voluntarism, and moral encroachment. Many philosophers deny these three views, favoring instead some ordinary standards for epistemic justification. I call this denial the standard view. In this paper, I offer an account of wokeness that is consistent with the standard view. I argue that wokeness is best understood as ‘group epistemic partiality’. The woke person (...) does extra epistemic work before forming a negative belief about a member of an oppressed social group. Just as we do extra epistemic work when forming belief about our friends, so the woke person does for members of oppressed social groups. I first outline the account. I then raise questions about the scope of wokeness and belief formation. After this, I demonstrate that the group partiality view is consistent with the standard view in epistemology. The partiality view, therefore, should appeal to epistemologists who have adopted the standard view because it is consistent with ordinary standards of justification. I conclude that wokeness as a concept in epistemology should not be controversial for those who endorse the standard view. (shrink)

Epistemologists focus primarily on cases of knowledge, belief, or credence where the evidence which one possesses, or on which one is relying, plays a fundamental role in the epistemic or normative status of one's doxastic state. Recent work in epistemology goes beyond the evidence one possesses to consider the relevance for such statuses of evidence which one does not possess, particularly when there is a sense in which one should have had some evidence. I focus here on Sanford Goldberg's approach (...) ("Should Have Known," Synthese, forthcoming; and "On the Epistemic Significance of Evidence You Should Have Had," Episteme 2016, this issue); but the discussion will interest anyone working on epistemic defeat. I’m going to argue for a set of restricted skeptical results: roughly put, we don’t know that fire engines are red, we don’t know that we sometimes have pains in our lower backs, we don’t know that John Rawls was kind, and we don’t even know that we believe any of those truths. However, people unfamiliar with philosophy and cognitive science do know all those things. The skeptical argument is traditional in form: here’s a skeptical hypothesis; you can’t epistemically neutralize (...) it, you have to be able to neutralize it to know P; so you don’t know P. But the skeptical hypotheses I plug into it are “real, live” scientific-philosophical hypotheses often thought to be actually true, unlike any of the outrageous traditional skeptical hypotheses (e.g., ‘You’re a brain in a vat’). So I call the resulting skepticism Live Skepticism. Notably, the Live Skeptic’s argument goes through even if we adopt the clever anti-skeptical fixes thought up in recent years such as reliabilism, relevant alternatives theory, contextualism, and the rejection of epistemic closure. Furthermore, the scope of Live Skepticism is bizarre: although we don’t know the simple facts noted above, many of us do know that there are black holes and other amazing facts. (shrink)

Epistemic invariantism is the view that the truth conditions of knowledge ascriptions don’t vary across contexts. Epistemic purism is the view that purely practical factors can’t directly affect the strength of your epistemic position. The combination of purism and invariantism, pure invariantism, is the received view in contemporary epistemology. It has lately been criticized by contextualists, who deny invariantism, and impurists, who deny purism. A central charge against pure invariantism is that it poorly accommodates linguistic intuitions about certain cases. In (...) this paper I develop a new response to this charge. I propose that pure invariantists can explain the relevant linguistic intuitions on the grounds that they track the propriety of indirect speech acts, in particular indirect requests and denials. On an ‘internalist’ picture, knowledge isn’t necessary for understanding the nature of perception and perceptual experience. This contrasts with the ‘knowledge first’ picture, according to which it’s essential to the nature of successful perceiving as a mental state that it’s a way of knowing. It’s often thought that naturalistic theorizing about the mind should adopt the internalist picture. However, I argue that a powerful, recently prominent framework for scientific study of the mind, ‘predictive processing,’ instead supports the knowledge first picture. (...) Under predictive processing, it’s intrinsic to successful perceiving that it’s a state with the kind of modal robustness that’s distinctive of knowledge, which gives us reason to think of successful perceiving along knowledge first lines. Furthermore, I argue that the predictive processing framework encourages us to conceptualize experiences which don’t amount to knowledge along knowledge first lines, as states which by their nature fall short of knowledge. According to the relevant alternatives theory of knowledge (RA), I know that p only if my evidence eliminates all relevant alternatives to p . Jonathan Schaffer has recently argued that David Lewis's version of RA, which is perhaps the most detailed version yet provided, cannot account for our failure to know in cases involving missed clues, that is, cases in which we see but fail to appreciate decisive evidence. I argue, however, that Lewis's version of RA survives exposure to missed (...) clue cases. Moreover, even though Schaffer maintains that Lewis's Rule of Belief provides no protection against missed clue cases, I argue that we should credit the Rule of Belief with ensuring the survival of Lewis's version of RA. To resolve the lottery paradox, the “no-justification account” proposes that one is not justified in believing that one's lottery ticket is a loser. The no-justification account commits to what I call “the Harman-style skepticism”. In reply, proponents of the no-justification account typically downplay the Harman-style skepticism. In this paper, I argue that the no-justification reply to the Harman-style skepticism is untenable. Moreover, I argue that the no-justification account is epistemically ad hoc. My arguments are based on a rather surprising finding (...) that the no-justification account implies that people living in Taiwan typically suffer from the Harman-style skepticism. (shrink)

The general principle of epistemic closure stipulates that epistemic properties are transmissible through logical means. According to this principle, an epistemic operator, say ε, should satisfy any valid scheme of inference, such as: if ε(p entails q), then ε(p) entails ε(q). The principle of epistemic closure under known entailment (ECKE), a particular instance of epistemic closure, has received a good deal of attention since the last thirty years or so. ECKE states that: if one knows that p entails q, and (...) she knows that p, then she knows that q. It is widely accepted that ECKE constitutes an important piece of the skeptical argument, but the acceptance of an unrestricted version of ECKE is still a matter of debate. On the side of the defenders of ECKE, one finds Stine (1976), Brueckner (1985), Vogel (1990), and Feldman (1995). Others proposed a refutation or a limitation of the principle, like Dretske (1970), Nozick (1981), Hales (1995), Williams (1996), and Sosa (1999). As it turns out, the relevant alternatives view (RAV) elaborated by Dretske, which restricts the scope of ECKE, has been discussed extensively and acknowledged as one of the most important contributions. There is nonetheless a major unsolved difficulty pertaining to Dretske-RAV: the notion of relevant alternatives is defined in such a way that it is bounded by counterfactual possibilities. This ontological import leaves open the door to the skeptic. Some have tried to give more precision to this notion, like Stine (1976), who appealed to a Gricean approach to define relevant alternatives in conversational contexts. My proposal is in accordance with the gist of Dretske’s strategy, i.e. to restrict the validity of ECKE, and I claim that in order to escape the difficulties inherent to RAV one has to introduce a more robust notion, the notion of epistemic context. Epistemic contexts are a subclass of propositional contexts. In that perspective, the closure property is expressed in terms of a property of a relation between epistemic contexts. ECKE holds when and only when either the epistemic context of the premisses is the same as the epistemic context of the conclusion, or the epistemic context change between the premisses and the conclusion is permissible. Permissibility of epistemic context change is a function of consistency. By means of this epistemic context approach, I will show that: (1) epistemic contexts are defined by basic propositions (unchallenged justified beliefs), (2) ECKE holds only under very specific constraints, and (3) the skeptical argument involves a non-permissible change of epistemic context and, by the same token, cannot rely upon ECKE. External world skeptics argue that we have no knowledge of the external world. Contextualist theories of knowledge attempt to address the skeptical problem by maintaining that arguments for skepticism are effective only in certain contexts in which the standards for knowledge are so high that we cannot reach them. In ordinary contexts, however, the standards for knowledge fall back down to reachable levels and we again are able to have knowledge of the external world. In order to address the objection (...) that contextualists confuse the standards for knowledge with the standards for warranted assertion, Keith DeRose appeals to the knowledge account of warranted assertion to argue that if one is warranted in asserting p, one also knows p. A skeptic, however, can maintain a context-invariant view of the knowledge account of assertion, in which case such an account would not provide my help to contextualism. (shrink)
