Not every speech act can be a lie. A good definition of lying should be able to draw the right distinctions between speech acts that can be lies and speech acts that under no circumstances are lies. This paper shows that no extant account of lying is able to draw the required distinctions. It argues that a definition of lying based on the notion of ‘assertoric commitment’ can succeed where other accounts have failed. Assertoric commitment is analysed in terms of (...) two normative components: ‘accountability’ and ‘discursive responsibility’. The resulting definition of lying draws all the desired distinctions, providing an intensionally adequate analysis of the concept of lying. (shrink)

Communication can be risky. Like other kinds of actions, it comes with potential costs. For instance, an utterance can be embarrassing, offensive, or downright illegal. In the face of such risks, speakers tend to act strategically and seek ‘plausible deniability’. In this paper, we propose an account of the notion of deniability at issue. On our account, deniability is an epistemic phenomenon. A speaker has deniability if she can make it epistemically irrational for her audience to reason in certain ways. (...) To avoid predictable confusion, we distinguish deniability from a practical correlate we call ‘untouchability’. Roughly, a speaker has untouchability if she can make it practically irrational for her audience to act in certain ways. Lying is an important moral phenomenon that most people are affected by on a daily basis—be it in personal relationships, in political debates, or in the form of fake news. Nevertheless, surprisingly little is known about what actually constitutes a lie. According to the traditional definition of lying, a person lies if they explicitly express something they believe to be false. Consequently, it is often assumed that people cannot lie by more indirectly communicating believed‐false claims, for instance by merely conversationally (...) implicating them. In this paper, we subject this claim to an empirical test. In a preregistered study of 300 participants, we investigate how people judge cases of implicit deceptions that would usually be excluded by the traditional definition of lying (i.e., conversational implicatures, presuppositions, and nonverbal actions). Our results show that people do in fact consider it possible to lie by indirect means, suggesting that people have a broader concept of lying than is usually assumed. Moreover, our findings indicate that lie judgments are closely tied to the extent to which agents are perceived as having committed themselves to the believed‐false claims they have communicated. We discuss the implications of our results for the traditional definition of lying and propose a new commitment‐based definition of lying that can account for the findings of our experiment. We intuitively make a distinction between _lying_ and _misleading_. On the explanation of this phenomenon favored here—the _adverbial_ account—the distinction tracks whether the content and its truth-committing force are literally conveyed. On an alternative _commitment_ account, the difference between lying and misleading is predicated instead on the strength of assertoric commitment. One lies when one presents with full assertoric commitment what one believes to be false; one merely misleads when one presents it without full assertoric commitment, by merely hinting or (...) otherwise implying it. Now, as predicted by the well-supported assumption that we can also assert with pictures, the lying/misleading distinction appears to intuitively show up there too. Here I’ll explain how the debate confronting the two accounts plays out both in general and in that case, aiming to provide support for the adverbial account. (shrink)

We conducted two experiments to determine whether common folk think that so-called _tell-tale sign_ bald-faced lies are intended to deceive—since they have not been tested before. These lies involve tell-tale signs (e.g. blushing) that show that the speaker is lying. Our study was designed to avoid problems earlier studies raise (these studies focus on a kind of bald-faced lie in which supposedly everyone knows that what the speaker says is false). Our main hypothesis was that the participants will think that (...) the protagonists from our examples lied without intending to deceive, and the results of our surveys confirmed this hypothesis: most of our participants rated tell-tale sign lies as lies not intended to deceive. Therefore, our analysis suggests that common folk think that some lies are not intended to deceive. (shrink)

One can lie by asserting non-literal content. If I tell you “You are the cream in my coffee” while hating you, I can be rightfully accused of lying if my true emotions are unearthed. This is not easy to accommodate under many definitions of lying while also preserving the lying-misleading distinction. The essential feature of non-literal utterances is their falsity when literally construed. This interferes with accounts of lying and misleading, because such accounts often combine a literal construal of what (...) is said by an utterance with a falsity requirement for lying. In the presence of non-literal lies such definitions struggle to make plau- sible predictions for non-literal lies and merely misleading utterances together. In this article I aim to fix this by extending Daniel Hoek’s pragmatic account of conversational exculpature to assertions in general. Since this mechanism is designed to compute the intended meanings of non-literal utterances, it straightforwardly predicts non-literal lies to be as such. The lying-misleading distinction is also preserved, because merely misleading utterances arise out of exploiting a different pragmatic mechanism—Gricean additive implicatures. Along the way I also draw some general lessons about assertion and implicatures. (shrink)

Arguably, the existence of bald-faced (i.e. knowingly undisguised) lies entails that not all lies are intended to deceive. Two kinds of bald-faced lies exist in the literature: those based on some common knowledge that implies that you are lying and those that involve tell-tale signs (e.g. blushing) that show that you are lying. I designed the tell-tale sign bald-faced lies to avoid objections raised against the common knowledge bald-faced lies but I now see that they are more problematic than what (...) I initially thought. Therefore, I will discuss these lies in more detail, refine the existing cases, and resolve some anticipated objections. I conclude that tell-tale sign bald-faced lies are genuine lies not intended to deceive. (shrink)

The speech act of inquiry is generally treated as a default kind of asking questions. The widespread norm states that one inquires whether p only if one does not know that p. However, the fact that inquiring is just one kind of asking questions has received little to no attention. Just as in the declarative mood we can perform not only assertions, but various other speech acts, like guesses or predictions, so in the interrogative mood we can also make various (...) speech act types. I propose a speech-act-theoretic account of a distinct kind of question that I label exam questions. According to the proposed account, one performs an exam question p only if (i) one has access to the answer to p, and (ii) one does not officially know whether the hearer knows the answer to p. Exam questions satisfy all the necessary requirements of being a distinct kind of speech act. Additionally, my proposal contributes to the recent expansion of the normative approach to a variety of speech acts. (shrink)

In a recent book (_Lying and insincerity_, Oxford University Press, 2018), Andreas Stokke argues that one lies iff one says something one believes to be false, thereby proposing that it becomes common ground. This paper shows that Stokke’s proposal is unable to draw the right distinctions about insincere performative utterances. The objection also has repercussions on theories of assertion, because it poses a novel challenge to any attempt to define assertion as a proposal to update the common ground.

According to one influential argument put forward by, e.g. Chisholm and Feehan, Pfister, Meibauer, Dynel, Keiser, and Harris, asserting requires intending to give your hearer a reason to believe what you say (first premise) and, because liars must assert what they believe is false (second premise), liars necessarily intend to cause their hearer to believe as true what the liars believe is false (conclusion). According to this argument, that is, all genuine lies are intended to deceive. ‘Lies’ not intended to (...) deceive are not genuine lies because they do not involve assertions and you need to assert in order to lie. In this paper, I reject this argument by arguing that the first premise is false: intending to give your hearer a reason to believe what you say is not necessary for asserting. (shrink)

I propose an analysis of lying with uninformative speech acts. The orthodox view states that lying is restricted to assertions. However, the growing case for non-assertoric lies made by presuppositions or conventional implicatures challenges this orthodoxy. So far, the only presuppositions to have been considered as lies were informative presuppositions. In fact, uninformative lies were not discussed in the philosophical literature. However, limiting the possibility of lying to informative speech acts is too restrictive. Firstly, I show that standard, uninformative presuppositions (...) can also be lies. Secondly, I extend this picture into uninformative lies made by declarative statements. To implement my proposal, I do not need a new definition of lying. Recently popular commitment-based definitions of lying are able to properly handle uninformative lies. (shrink)

This paper investigates the norm of presupposition, as one pervasive type of indirect speech act. It argues against the view that sees presuppositions as an indirect counterpart of the direct speech act of assertion and proposes instead that they are much more similar to the direct speech act of assumption. More concretely, it suggests that the norm that governs presuppositions is not an epistemic or doxastic attitude such as knowledge, justified belief, or mere belief; it's a practical attitude, most plausibly (...) the attitude of rational acceptance. This view has important ramifications well beyond debates in philosophy of language and linguistics. It affects not only our view of which speech act sequences are fine and which are off; it bears on whether presuppositions can function as testimony, whether they can be lies, and whether they are ontologically committal, thus addressing central topics in epistemology, ethics, and metaphysics. I argue that assertoric content functions as a means for us to track the responsibilities undertaken by communicators, and that distinctively assertoric commitments are distinguished by being generated directly in virtue of the words the speaker uses. This raises two questions: (a) Why are speakers responsible for the content thus generated? (b) Why is it important for us to distinguish between commitments in terms of their manner of generation? I answer the first question by developing a novel responsibility based metasemantics. (...) The author argues that there is no such thing as a unique and general taxonomy of non-at-issue contents. Accordingly, we ought to shun large categories such as “conventional implicature”, “F-implicature”, “CI”, “Class B” or the like. As an alternative, we may, first, describe the “semantic profile” of linguistic devices as accurately as possible. Second, we may explicitly tailor our categories to particular theoretical purposes.

According to the normative approach, speech acts are governed by certain norms. Interestingly, the same is true for classes of speech acts. This paper considers the normative treatment of constatives, consisting of such classes as assertives, predictives, suggestives, and more. The classical approach is to treat these classes of illocutions as species of constatives. Recently, however, Simion (Shifty Speech and Independent Thought: Epistemic Normativity in Context, Oxford University Press, 2021) has proposed that all constatives (i) are species of assertion, and (...) (ii) are governed by the knowledge norm. I defend the classical treatment of constatives and show that Simion’s conclusion is untenable. No taxonomy of speech acts can accommodate such a view. More importantly, we can test whether a particular speech act is an assertion or not. I propose five tests of assertion, the passing of which is a necessary condition for being an assertion. Some constative speech acts fail these tests. Thus, contrary to Simion, not all constatives can be regarded as species of assertion. (shrink)

Does lying require a speaker to explicitly express something (she believes to be) false, or is it also possible to lie with deceptive implicatures? Given that consistency with ordinary language is a desideratum of any philosophical definition of lying, several studies have addressed this question empirically in recent years. Their findings, however, seem to be in conflict. This paper reports an experiment with 222 participants that investigates the hypothesis that these conflicting results are due to variation regarding whether or not (...) the speaker’s intention to deceive and the implicated content are made explicit. It is found that the presence versus the absence of such explicitness has a strong impact on people’s lie judgements, and can thus account for the conflicting results in the literature. (shrink)

Testimony is a source of knowledge. A speaker asserts what a hearer may therefore come to know. Assertion has widely been treated as the exclusive or at least the paradigmatic vehicle for testimony. I argue that we testify not only by asserting something, but also by taking something for granted within some other utterance. In philosophy of language, this is called semantic presupposition. The very reasons leading theorists of testimony have for thinking that assertion can be testimony are equally reasons (...) for thinking semantic presupposition can be testimony. (shrink)

The aim of this paper is to argue that lying differs from mere misleading in a way that can be morally relevant: liars commit themselves to something they believe to be false, while misleaders avoid such commitment, and this difference can make a moral difference. Even holding all else fixed, a lie can therefore be morally worse than a corresponding misleading utterance. But, we argue, there are also cases in which the difference in commitment makes lying morally better than misleading, (...) as well as cases in which the difference is not morally relevant. This view conflicts with the two main positions philosophers have defended in the ethics of lying and misleading, which entail either that lying is in virtue of its nature worse than misleading or that there is no morally relevant difference between lying and misleading. According to the subjective view of lying, speakers can lie by asserting a true proposition, as long as they believe this proposition to be false. This view contrasts with the objective view, according to which lying requires the actual falsity of the proposition asserted. The aim of this paper is to draw attention to pairs of assertions that differ only in intuitively redundant content and to show that such pairs of assertions are a reason to favour the subjective view of (...) lying over the objective one. It is widely held that there is a distinctive norm of assertion. A plausible idea is that there is an analogous, perhaps weaker, norm for indirect communication via implicatures. I argue against this type of proposal. My claim is that the norm of assertion is a social norm governing public updates to the conversational record. Off the record implicatures are not subject to social norms of this type. I grant that, as happens in general with intentional actions, off the record (...) communicative acts may be subject to normative assessments on different levels (for instance, regarding their moral or prudential appropriateness). However, such assessments do not generate distinctive norms that apply to all cases of implicature. (shrink)

In a recent paper, James Edwin Mahon argues that literary artworks—novels in particular—never lie because they do not assert. In this discussion note, I reject Mahon’s conclusion that novels never lie. I argue that a central premiss in his argument—that novels do not contain assertions—is false. Mahon’s account underdetermines the content of literary works; novels have rich layers of content and can contain what I call ‘profound’ assertions, and ‘background’ assertions. I submit that Mahon therefore fails to establish that novels (...) never lie. (shrink)

Are slurring statements, when applied to members of the slurred group, true, false, or a little bit of both? Intuitions are mixed. And investigating more truth-value judgments is unlikely to cure the stalemate we find ourselves in. Truth-value judgments are just not up to the task. In their place, I propose we look to judgments of lying instead. This change in focus provides a new and better tool for understanding the complex semantics and pragmatics of slurs. As I argue, it (...) also suggests that slurring statements encode, conventionally implicate and presuppose the same information as statements with the slur's neutral counterpart. A dogwhistle, in its most centrally-discussed sense, seeks to obscure part of its meaning from part of its audience. Yet, as many have noted, dogwhistles that are flaunted at an opposing group play a prominent role in political speech. I call these speech acts 'brazen dogwhistles'. This paper deals first with theoretical concerns, exploring the features of brazen dogwhistles, arguing that we have good reasons to consider them to be dogwhistles, and making room for them in a broadly Saul-style account. (...) In the second half, this paper addresses lessons more closely tied to the political project of reducing the pernicious effects of dogwhistles. It explores how dogwhistles can be used in a targeted way in smaller settings and sheds light on the role of active audience interpretation, suggesting that the best response to a potential dogwhistle is to withhold the benefit of the doubt. Suppose you assert a proposition p that you falsely believe to be false with the intention to deceive your audience. The standard view has it that you lied. This paper argues against orthodoxy: deceptive lying requires that p be in actual fact false, in addition to your intention to deceive by means of untruthfully asserting that p. We proceed as follows. First, an argument is developed for such falsity condition as the non-psychological component of lying. The problem with the standard (...) view, we profess, is exactly that lying is a purely psychological relation between disbelief, assertion, and intention. Then, by scrutinising familiar cases, we revisit the alleged intuitive support for the existence of true lies. It turns out these intuitions can be explained away once we reflect on the characteristic deceptive hallmarks that are associated with the distinction between lying and botched attempts at lying. Finally, we examine the morality of lying in the light of said falsity condition. The resultant view emphasises our moral sensitivity to the practical consequences of acts of lying, while still accommodating those moral considerations that pertain exclusively to the psychological components of lying. There is a clear intuitive difference between lying and attempting to mislead. Recent efforts to analyse this difference, and to define lying in ways that respect it, are motivated by the conviction that the difference is important or significant in some way. Traditionally, the importance of the lying-misleading distinction has been cashed out in moral terms, but this approach faces a number of challenges. The purpose of this paper is to suggest and develop a different way in which the lying-misleading (...) distinction might be important: it might matter aesthetically. I propose that the aesthetic significance of the distinction inheres in a more prominent experienced disharmony in lying as compared with attempting to mislead. (shrink)

Sam Berstler defends a general moral advantage for misleading over lying by arguing that liars, but not misleaders, act unfairly toward the other members of their linguistic community. This article spells out three difficulties for Berstler’s account. First, though Berstler aims to avoid an error theory, it is dubitable that her account fits with intuitions on the matter. Second, there are some lies that do not exhibit the unfairness Berstler identifies. Third, fairness is not the only morally relevant difference between (...) lying and misleading. (shrink)

This paper develops an account of accuracy and truth in pictorial assertion. It argues that there are two ways in which pictorial assertions can be indirect: with respect to their content and with respect to their target. This twofold indirectness explains how accurate, unedited pictures can be used to make false pictorial assertions. It captures the fishiness of true pictorial assertions involving target-indirectness, such as true pictorial assertions involving outdated pictures. And it raises the question whether target-indirectness may also arise (...) in linguistic assertion. (shrink)

The present study examines cross-cultural differences in people’s concept of lying with regard to the question of whether lying requires an agent to _say_ something they believe to be false. While prominent philosophical views maintain that lying entails that a person explicitly expresses a believed-false claim, recent research suggests that people’s concept of lying might also include certain kinds of deception that are communicated more indirectly. An important drawback of previous empirical work on this topic is that only few studies (...) have investigated people’s concept of lying in non-Western samples. In the present study, we compare people’s intuitions about lying with indirect deceptions (i.e., presuppositions, conversational implicatures, and non-verbal actions) in a sample of _N_ = 255 participants from Russia and _N_ = 300 participants from the United Kingdom. Our findings show a strong degree of similarity between lie ratings of participants from Russia and the United Kingdom, with both samples holding it possible for agents to lie with deceptive statements and actions that do not involve the agent _saying_ something they believe to be false. This article focuses on `therefore' constructions such as ‘The switch is on, and therefore the lights are on’. We submit that the contribution of `therefore’ is to express a dependence as part of the core content of these constructions, rather than being conveyed by conventional implicature (Grice 1975, Potts 2005, Neta 2013) or a triggered presupposition (Pavese 2017, forthcoming, Stokke 2017). We argue that the standard objections to this view can be answered by relying on the general projection hypothesis defended (...) by Roberts et al. (2009) and Simons et al. One recurrent objection against minimalism is that minimal contents have no theoretical role. It has recently been argued that minimal contents serve to draw the distinction between lying and misleading. In Sect. 1 and Sect. 2 I summarise the main argument in support of that claim and contend that it is inconclusive. In Sect. 3 I discuss some cases of lying and some of misleading that raise difficulties for minimalism. In Sect. 4 I make a diagnosis of the failure of (...) minimalism with those cases. In Sect. 5 I strengthen the case against minimal contents by addressing two received says-based definitions of lying. My analysis of the failure of minimalism suggests that the distinction between lying and misleading, at least in some important cases, calls for a kind of utterance content that is grounded on conventions of language. I extend the literature on norms of assertion to the ubiquitous use of graphs in scientific papers and presentations, which I term “graphical testimony.” On my account, the testimonial presentation of a graph involves commitment to both (a) the in‐context reliability of the graph's framing devices and (b) the perspective‐relative accuracy of the graph's content. Despite apparent disagreements between my account and traditional accounts of assertion, the two are compatible and I argue that we should expect a similar pattern of (...) commitments in a set of cases that extends beyond the graphical one. I end by demonstrating that the account resolves apparent tensions between the demands of honesty and the common scientific practice of presenting idealized or simplified graphs: these “distortions” can be honest so long as there's the right kind of alignment between the distortion and the background beliefs and values of the audience. Sam Berstler has recently argued for a fairness-based moral difference between lying and misleading. According to Berstler, the liar, but not the misleader, unfairly free rides on the Lewisian conventions which ground public-language meaning. Although compelling, the pragmatic and metasemantic backdrop within which this moral reason is located allows for the generation of a vicious explanatory circle. Simply, this backdrop entails that no speaker has ever performed an assertion. As I argue, escaping the circle requires rejecting Berstler’s fairness-based reason against (...) lying. The problem is a general one: the wrong of lying cannot be founded on the goods of language. (shrink)

The traditional conception of lying, according to which to lie is to make an assertion with an intention to deceive the hearer, has recently been put under pressure by the phenomenon of bald-faced lies i.e. utterances that _prima facie_ look like lies but because of their blatancy allegedly lack the accompanying intention to deceive. In this paper we propose an intuitive way of reconciling the phenomenon of bald-faced lies with the traditional conception by suggesting that the existing analyses of the (...) phenomenon overlook a non-obvious category of hearers whom the speakers of bald-faced lies intend to deceive. Those hearers are institutions represented by the people involved, such as courts or secret police. We also criticize two recent rival accounts (Jessica Keiser’s and Daniel Harris’s) that attempt to save the traditional conception by saying that some bald-faced lies are not assertions, because they are conventional—rather than illocutionary—speech acts. Says-based definitions of lying require a notion of what is said. I argue that a conventions-based notion of utterance content inspired by Korta and Perry’s (in: Tsohatzidis (ed), John Searle's philosophy of language: Force, meaning, and thought, Cambridge University Press, 2007a) _locutionary content_ and Devitt’s (Overlooking conventions. The trouble with linguistic pragmatism, Springer, 2021) _what is said_ meets the desiderata for that theoretical role. In Sect. 1 I recall two received says-based definitions of lying and the notions of what is (...) said that have been proposed for them. In Sect. 2 I recall the desiderata that a notion of content must fulfil in order to cover the role of what is said in says-based definitions of lying. In Sect. 3 I discuss the points that Korta and Perry’s _locutionary content_ and Devitt’s _what is said_ have in common with respect to the centrality that linguistic conventions have for the constitution of utterance contents. In Sect. 4 I argue that a conventions-based notion of utterance content meets the desiderata for the role of what is said in says-based definitions of lying and has some important advantages over the notions of what is said that have been so far proposed. In Sect. 5 I point out the impact that the debate over the definition of lying has on the semantics/pragmatics divide in philosophy of language. (shrink)
