In ‘The making of argumentation theory’ van Eemeren and van Haaften describe the contributions made to the five components of a full-fledged research program of argumentation theory by four prominent approaches to the discipline: formal dialectics, rhetoric/pragmalinguistics, informal logic, and pragma-dialectics. Most of these approaches do not contribute to all components, but to some in particular. Starting from the pragma-dialectical view of the relationship between dialectical reasonableness and rhetorical effectiveness – the crucial issue in argumentation theory – van Eemeren and (...) van Haaften explain the positions taken by representatives from the approaches discussed and indicate where they differ from the pragma-dialectical approach. It transpires that approaches focusing on dialectical reasonableness are, next to pragma-dialectics, formal dialectics and informal logic; approaches focusing on rhetorical effectiveness are, next to pragma-dialectics, rhetoric and pragmalinguistics, and the informal logician Tindale. When it comes to the relationship between dialectical reasonableness and rhetorical effectiveness, some interest in it is shown in rhetoric and pragmalinguistics, but only in pragma-dialectics and in Tindale’s work is it a real focus. The main difference between Tindale’s view and the pragma-dialectical view is that in pragma-dialectics the decisive role in deciding about reasonableness is assigned to a code of conduct for reasonable argumentative discourse and in Tindale’s approach this role is assigned to Tindale’s interpretation of the Perelmanian universal audience. Douglas Walton’s multitudinous contributions to the study of argumentation seldom, if ever, directly engage with argumentation in mathematics. Nonetheless, several of the innovations with which he is most closely associated lend themselves to improving our understanding of mathematical arguments. I concentrate on two such innovations: dialogue types (§1) and argumentation schemes (§2). I argue that both devices are much more applicable to mathematical reasoning than may be commonly supposed.

The article develops and justifies, on the basis of the epistemological argumentation theory, two central pieces of the theory of evaluative argumentation interpretation: 1. criteria for recognizing argument types and 2. rules for adding reasons to create ideal arguments. Ad 1: The criteria for identifying argument types are a selection of essential elements from the definitions of the respective argument types. Ad 2: After presenting the general principles for adding reasons (benevolence, authenticity, immanence, optimization), heuristics are proposed for finding missing (...) reasons, for deductive arguments, e.g., semantic tableaux are suggested. Leading invasion biologists sometimes dismiss critics and criticisms of their field by invoking “the straw man” fallacy. Critics of invasion biology are also labelled as a small group of “naysayers” or “contrarians”, who are sometimes engaging in “science denialism”. Such unfortunate labels can be seen as a way to possibly suppress legitimate debates and dismiss or minimize reasonable concerns about some aspects of invasion biology, including the uncertainties about the geographic origins and complex environmental impacts of species, and the control (...) programs against species perceived as “invasive”. In assessing the quality of the debate in this area, we examine the validity of the use of various strategies, including the “straw man” concept, and explore a range of potential logical fallacies present in some recent prominent discussions about invasion biology and so-called “invasive” species. The goal is to add some clarity to the concepts involved, point out some problematic issues, and improve the quality of the debates as the discussions move forward. (shrink)

This paper offers a probabilistic treatment of the conditions for argument cogency as endorsed in informal logic: acceptability, relevance, and sufficiency. Treating a natural language argument as a reason-claim-complex, our analysis identifies content features of defeasible argument on which the RSA conditions depend, namely: change in the commitment to the reason, the reason’s sensitivity and selectivity to the claim, one’s prior commitment to the claim, and the contextually determined thresholds of acceptability for reasons and for claims. Results contrast with, and (...) may indeed serve to correct, the informal understanding and applications of the RSA criteria concerning their conceptual dependence, their function as update-thresholds, and their status as obligatory rather than permissive norms, but also show how these formal and informal normative approachs can in fact align. The quality of our public discourse – think of the climate change debate for instance – is never very high. A day spent observing it reveals a litany of misrepresentation and error, argumentative fallacy, and a general lack of good will. In this paper I focus on a microcosmic aspect of these practices: the use of two types of argument – the argumentum ad hominem and appeal to authority – and a way in which they are related. Public debate is (...) so contaminated by the misuse of the ad hominem tactic that it is important to have an understanding of one of the ways in which its use may be legitimate. So readers who might have expected an analysis of the ad hominem fallacy will, on the contrary, be presented with an account of one of the places for its potential success. In ad hominem, arguers are viewed as legitimate constitutive targets for their own argument; in authority arguments, arguers provide a legitimate constitutive warrant for an argument they deploy. These types of argument are connected in so far as the identities of persons deploying them carry the cognitive weight of the argument. If authority arguments sometimes deserve to succeed, ad hominem attacks on them are potentially legitimate. An important motivation for this analysis is that in identifying the success conditions for one of the ad hominem types we attain some clarity in the evaluation of their use. (shrink)

Some conspicuous characteristics of argumentation as we all know this phenomenon from our shared everyday experiences are in my view vital to its theoretical treatment because they should have methodological consequences for the way in which argumentation research is conducted. To start with, argumentation is in the first place a communicative act complex, which is realized by making functional verbal communicative moves.

Philosophers of science have given up on the quest for a silver bullet to put an end to all pseudoscience, as such a neat formal criterion to separate good science from its contenders has proven elusive. In the literature on critical thinking and in some philosophical quarters, however, this search for silver bullets lives on in the taxonomies of fallacies. The attractive idea is to have a handy list of abstract definitions or argumentation schemes, on the basis of which one (...) can identify bad or invalid types of reasoning, abstracting away from the specific content and dialectical context. Such shortcuts for debunking arguments are tempting, but alas, the promise is hardly if ever fulfilled. Different strands of research on the pragmatics of argumentation, probabilistic reasoning and ecological rationality have shown that almost every known type of fallacy is a close neighbor to sound inferences or acceptable moves in a debate. Nonetheless, the kernel idea of a fallacy as an erroneous type of argument is still retained by most authors. We outline a destructive dilemma we refer to as the Fallacy Fork: on the one hand, if fallacies are construed as demonstrably invalid form of reasoning, then they have very limited applicability in real life. On the other hand, if our definitions of fallacies are sophisticated enough to capture real-life complexities, they can no longer be held up as an effective tool for discriminating good and bad forms of reasoning. As we bring our schematic “fallacies” in touch with reality, we seem to lose grip on normative questions. Even approaches that do not rely on argumentation schemes to identify fallacies fail to escape the Fallacy Fork, and run up against their own version of it. (shrink)

A critical examination of the dialectical approach, focusing on a comparison ofthe illative and the dialectical definitions of argument. I distinguish a moderate, a strong and a hyper dialectical conception of argument. I critique Goldman's argument for the moderate conception and Johnson's argument for the strong conception, and argue that the moderate conception is correct.

In this overview article, we first explain what we take informal logic to be, discussing misconceptions and distinguishing our conception of it from competing ones; second, we briefly catalogue recent informal logic research, under 14 headings; third, we suggest four broad areas of problems and questions for future research; fourth, we describe current scholarly resources for informal logic; fifth, we discuss three implications of informal logic for philosophy in particular, and take note ofpractical consequences of a more general sort.

Although he does not provide a general analysis of argumentation, Aristotle is a highly influential source of modern argumentation theory. In his treatises the Topics, the Sophistical Refutations and the Rhetoric, Aristotle presents complementary aspects of a theory of sound arguments that are seen as the most effective means of persuasion. Aristotle’s central notion of a deductive argument (sullogismos) does not include references to an addressee, the situative context or non-verbal aspects of communication, and thus differs from some modern views (...) on argumentation. A deductive argument in the Aristotelian sense is a sequence of intellectual steps where the conclusion follows of necessity from the premises. Aristotle does not relativize or relax this notion but takes other factors into account by providing supplementary theoretical elements. For example, he reflects on acceptable premises (endoxa), the adjustment of rhetorical arguments to the horizon of the audience, methods of finding premises on the basis of argumentative schemes (topoi), the use of non-argumentative means of persuasion, and a framework of implicit discourse rules. Many of these themes are, albeit under a different name, still discussed in modern argumentation theory. (shrink)

This article explains the design and development of the pragma-dialectical approach to fallacies. In this approach fallacies are viewed as violations of the standards for critical discussion that are expressed in a code of conduct for reasonable argumentative discourse. After the problem-solving validity in resolving differences of opinion of the rules of this code has been discussed, their conventional validity for real-life arguers is demonstrated. Starting from the extended version of the theory in which the strategic maneuvering taking place in (...) argumentative discourse is included, the article explains that the violations of the rules that are committed in the fallacies involve derailments of strategic maneuvering. This culminates in a discussion of the exploitation of hidden fallaciousness as an unreasonable way of increasing the effectiveness of argumentative discourse – a vital topic of research in present-day pragma-dialectics. Recent work on conditional reasoning argues that denying the antecedent [DA] and affirming the consequent [AC] are defeasible but cogent patterns of argument, either because they are effective, rational, albeit heuristic applications of Bayesian probability, or because they are licensed by the principle of total evidence. I characterize the deductivist ideal of justification and, following to a great extent Toulmin’s work The Uses of Argument, I try to explain why this ideal is erroneous. Then I offer an alternative model of justification capable of making our claims to knowledge about substantial matters sound and reasonable. This model of justification will be based on a conception of justification as the result of good argumentation, and on a model of argumentation which is a pragmatic linguistic reconstruction of Toulmin’s (...) model of argument. Informal logic began in the 1970s as a critique of then-current theoretical assumptions in the teaching of argument analysis and evaluation in philosophy departments in the U.S. and Canada. The last 35 years have seen significant developments in informal logic and critical thinking theory. The paper is a pilot study of the influence of these advances in theory on what is taught in courses on argument analysis and critical thinking in U.S. and Canadian philosophy departments. The current dominant approach on the assessment of critical thinking takes as a starting point a conception of criticality that does not commit to any substantive view or context of meaning concerning what issues are relevant to be critical about in society or in life. Nevertheless, as a detailed examination of the identification of assumptions shows, when going from the theory of critical thinking to the praxis of producing and evaluating arguments, the critical person will inevitably make such commitments from (...) particular perspectives, using particular contexts of meaning. But then she may fail to take notice of relevant ones and may end up using her critical powers in a mercenary way. It is then proposed, in the context of assessment of critical thinking, to choose and use some privileged contexts of meaning, while making them available for critical scrutiny and allowing for the possibility that new ones be brought up by those being assessed. The present study examined how the pre-war debate of the US decision to invade Iraq (in March 2003) was discursively constructed in the US/British mainstream newspaper opinion/editorial (op/ed) argumentation. Drawing on theoretical insights from critical discourse analysis and argumentation theory, I problematised the fallacious discussion used in the pro-war op/eds to build up a ‘moral/legal case’ for war on Iraq based on adversarial (rather than dialogical) argumentation. The proponents of war deployed ‘instrumental rationality’ (ends-justify-means reasoning), ‘ethical necessity’ (Bush’s ‘Preemption Doctrine’) (...) and ‘humanitarian virtue’ (the bombing of Iraq to ‘save’ Iraqis from Saddam’s pestilent tyranny) to justify the pending invasion of Iraq. Their arguments intertextually resonated with Bush administration’s ‘war on terror’ rhetoric in a way that created a form of indexical association through ‘recontextualisation’. The type of arguments marshalled by the pro-war op/ed commentators uncritically bolstered the set of US official ‘truth claims’ and ‘presuppositions’. (shrink)

In argumentation, metaphors are often considered as ambiguous or deceptive uses of language leading to fallacies of reasoning. However, they can also provide useful insights into creative argumentation, leading to genuinely new knowledge. Metaphors entail a framing effect that implicitly provides a specific perspective to interpret the world, guiding reasoning and evaluation of arguments. In the same vein, emotions could be in sharp contrast with proper reasoning, but they can also be cognitive processes of affective framing, influencing our reasoning and (...) behavior in different meaningful ways. Thus, a double (metaphorical and affective) framing effect might influence argumentation in the case of emotive metaphors, such as “Poverty is a disease” or “Your boss is a dictator,” where specific “emotive words” (disease, dictator) are used as vehicles. We present and discuss the results of two experimental studies designed to explore the role of emotive metaphors in argumentation. The studies investigated whether and to what extent the detection of a fallacious argument is influenced by the presence of a conventional vs. novel emotive metaphor. Participants evaluated a series of verbal arguments containing either “non-emotive” or “emotive” (positive or negative) metaphors as middle terms that “bridge” the premises of the argument. The results show that the affective coherence of the metaphor's vehicle and topic plays a crucial role in participants' reasoning style, leading to global heuristic vs. local analytical interpretive processes in the interplay of the metaphorical and the affective framing effects. Woods and Walton deserve credit for including a discussion of “economic reasoning” and its susceptibility to the “fallacy of composition.” Unfortunately, they did not sufficiently pursue the topic, and argumentation scholars have apparently ignored their pioneering effort. Yet, obviously, economic argumentation is extremely important, and economists constantly harp on this fallacy. This paper calls attention to this problem, elaborating my own approach, which is empirical, historical, and meta-argumentational.

How do Dutch people let each other know that they disagree? What do they say when they want to resolve their difference of opinion by way of an argumentative discussion? In what way do they convey that they are convinced by each other’s argumentation? How do they criticize each other’s argumentative moves? Which words and expressions do they use in these endeavors? By answering these questions this short essay provides a brief inventory of the language of argumentation in Dutch.

This paper surveys the contributions to the study of argumentation in the two decades since the work of Toulmin and Perelman. Developments include Radical Argumentativism (Anscombre and Ducot), Communication and Rhetoric (American Speech Communication Theory), Informal Logic (Johnson and Blair), Formal Analyses of Fallacies (Woods and Walton), Formal Dialectics (Barth and Krabbe), and Pragma-Dialectics (van Eemeren and Grootendorst). From the survey it is concluded that argumentation theory has been considerably enriched. If the contributions can be made to converge, a sound (...) basis will be created for developing educational methods for producing, interpreting and evaluating argumentative discourse. Thus, argumentation theory may be instrumental in improving the quality of democracy by furthering a reasonable management of differences of opinion. (shrink)

During the past thirty years the pragma-dialectical theorizing has developed in various steps from designing an abstract ideal model for critical discussion to examining strategic manoeuvring in the various argumentative activity types in which argumentative discourse manifests itself in argumentative reality. The response to the theoretical proposals that have been made includes, next to approval, also various kinds of criticisms. This paper explores the nature and thrust of these criticisms. In doing so, a distinction is made between criticisms concerning the (...) dialectical and the pragmatic dimensions of pragma-dialectics, the scope of the theory, the rhetorical dimension and moral quality, the treatment of the fallacies, and the epistemic dimension. ‘In Context’ is aimed at giving contextualization its rightful place in the study of argumentation. First, Frans H. van Eemeren explains the crucial role of context in a reconstructive analysis of argumentative discourse. He distinguishes four levels of contextualization. Second, he situates his approach to context in the field of argumentation studies by comparing it with Walton’s approach. He emphasizes the importance of distinguishing clearly between a normatively motivated theoretical ideal model and empirically-based communicative activity types. Third, van Eemeren concentrates (...) on the ‘macro-level’ of contextualization: contextualization in institutionalized communicative activity types. He makes clear that the macro-context of a communicative activity type can be characterized argumentatively by describing the disctinctive features of the empirical counterparts of the four stages of a critical discussion in the activity type concerned. Fourth, he points out what the consequences of the macrocontextualization of argumentative discourse in a certain communicative activity type are for the strategic maneuvering that may takes place and the identification of fallacies as derailments of strategic maneuvering. Fifth, van Eemeren draws some general conclusions regarding the role of contextualization in the analysis and evaluation of argumentative discourse. (shrink)

This is a critical appreciation of Govier’s 2006 ISSA keynote address on the fallacy of composition, and of economists’ writings on this fallacy in economics. I argue that the “fallacy of composition” is a problematical concept, because it does not denote a distinctive kind of argument but rather a plurality, and does not constitute a distinctive kind of error, but rather reduces to oversimplification in arguing from micro to macro. Finally, I propose further testing of this claim based on examples (...) involving public vs. private debt in economics; oligarchic tendencies in politics, and the emergence of societal wholes in sociology.
