This article argues that Hannah Arendt’s thought can offer significant insights on political judgement for realism in political theory. We identify a realist position which emphasises the need to account for how humans judge politically, contra moralist tendencies to limit its exercise to rational standards, but which fails to provide a sufficient conception of its structure and potential. Limited appeals to political judgement render the realist defence of the political elusive and compromise the endeavour to offer a meaningful alternative to (...) the moralist tendency to displace politics. The potential and limitations of realist discussions on judgement are made visible in relation to proto-realists Judith Shklar and Isaiah Berlin. In seeking to enrich the realist conception of the political, the article introduces the displacement critique found in the neglected Arendtian ‘realism’. It also provides the foundations for a distinctly realist account of political judgement which, we argue, requires elaboration along two dimensions: the social coding of political judgement and the political capacities that help judgement build a suitable political sphere. Political theorists have traditionally grappled with laughter by posing a simple, normative question: ‘What role, if any, should laughter play in the polis?’ However, the outsized presence of laughter in contemporary politics has rendered this question increasingly obsolete. What good does determining laughter’s role in the polis do when the polis itself is to a large extent shaped by laughter? The present essay argues that Kant’s aesthetic investigations of laughter in the Critique of Judgment and Anthropology from a Pragmatic Point (...) of View offer a much needed alternative to the normative discourse. Kant theorizes laughter as an intensely dialectical experience — at once an aesthetic judgment and an affect. Laughter in Kant enacts dissensus: it disrupts and transforms sensus communis, or the ways subjects see and hear the world in common that organize and structure a political community. The essay illustrates the advantages of a Kantian conception of the politics of laughter over the normative discourse by examining Dave Chappelle’s controversial 2019 stand-up comedy special Sticks & Stones. Since the publication of Between Facts and Norms, Habermas’s concept of communicative power has been the topic of significant discussion. This article contributes to this conversation by examining Habermas’s account of what makes communication powerful. I argue that Habermas’s conception of communicative power describes a nonviolent and noninstrumental mode of acting and being with others in language. This mode of engagement underwrites a conception of power that is structurally different from willing, one that builds meaningful worlds and (trans-)forms those engaging (...) in communicative procedures. In drawing out this aspect of Habermas’s conception, I show that he is not a rationalist and proceduralist whose account of communicative procedures protects decision-making from irrational aesthetic powers. Rather, he presents communication as a mimetic achievement, a set of aesthetic practices and experiences that affectively alter its participants. With this position, Habermas makes an important contribution to and not just against the analysis of the aesthetic dimensions of political life. In casting communication as a mimetic achievement, Habermas presents an account of how communication opens worlds and forms subjects. Yet since these aspects of communication arrive in linguistic form, he can also examine affective and aesthetic experiences within discursive procedures. We can understand world-opening and aesthetic (trans-)formation as an essential part of democratic politics while also identifying the perspectives and resources by which actors can reflect on and critically evaluate whether an opinion is justified or whether a political project is worth pursuing. Hannah Arendt’s conceptualization of political judgement has been a source of much scholarly investigation and debate in recent decades. Underlying the debate is the assumption that at least in her early writings, Arendt had an actor’s theory of judgement. In this article I challenge this common assumption. As I attempt to demonstrate, it relies on a misunderstanding, not only of Arendt’s conception of judgement, but also of her conception of agents in the public realm. Once we discard the assumption of (...) an actor’s theory of judgement, I argue, some important issues in Arendt’s theory of judgement are resolved, enabling us to perceive it as a unified, rather than self-contradictory, theory of judgement. Hannah Arendt's theory of judgment has been the object of considerable interest in the last three decades. Political theorists in particular have hoped to find in her theory of judgment a viable account of how diverse modern societies can sustain a commitment to dialogue in the absence of shared basic principles. A number of scholars, however, have critiqued Arendt's account of judgment in various ways. This article examines criticisms from Richard Bernstein, Ronald Beiner, George Kateb, Jürgen Habermas, and Linda Zerilli. (...) Lyotard’s diagnosis of a ‘postmodern condition’ has been repeatedly interpreted as a disavowal of the universal aspiration of political action and judgment. This article challenges this interpretation by showing that postmodernity involves an attempt to reconsider universality in such a way that it involves dissensus rather than consensus. I proceed by reconstructing Lyotard’s critique of the idea of consensus as a ground of political action and judgment, which in his view is based on a certain model of production of scientific (...) knowledge. Then, I analyse Lyotard’s turn to Kant’s judgment of the sublime as an alternative to a consensus-based conception of universal judgments. In the judgment of the sublime, universality stems from the disagreement between the faculties, which arouses respect for universal ideas. Analogously, political judgments stem from the disagreement between heterogeneous discourses, which produces a universal call to invent new languages that make communication possible. (shrink)

Current theoretical account of judgment has a difficult time saying anything positive about the experience of judging and, when they do offer positive accounts, they seem to overlook much that we know about the capacity already in our daily lives. Following the work of Martin Heidegger and Hubert Dreyfus, this article provides a phenomenological consideration of the structure of judging that considers judgment not as an intellectual act, but as a comportment. The article proceeds in two parts. The first offers (...) a brief consideration of the assumptions of intellectualist accounts and shows why, ultimately, they may be unable to bring judging into focus. The second section offers a phenomenological account of judging. The argument of section two is that deliberate judgment is a continuation of the structure of judgment understood as comportment and, in turn, that intellectualist accounts come onto the scene too late. Rancière’s reception among political theorists connects to what some have called an “aesthetic turn” in the study of politics. One feature of this turn is a critique of the emphasis on reason found in Rawls- and Habermas-inspired political thought. At least on the standard readings of them, Rawls and Habermas conceive of politics as a process of adjudicating competing interests and validity claims. Political theory then becomes an effort to determine the principles that should guide this adjudication and how they (...) might be institutionalized. Political theory as a discipline has long been skeptical of computational methods. In this paper, I argue that it is time for theory to make a perspectival shift on these methods. Specifically, we should consider integrating recently developed generative large language models like GPT-4 as tools to support our creative work as theorists. Ultimately, I suggest that political theorists should embrace this technology as a method of supporting our capacity for creativity—but that we should do so in a way that (...) is mindful of the content and value of theorizing, the technical constraints of the models, and the ethical questions that the technology raises. This essay explores the phenomenon of common sense through a contextual analysis of Hannah Arendt’s political application of Kant’s Critique of Judgment. I begin by tracing the development of Arendt’s thinking on judgment and common sense during the 1950s which led her to turn to the third Critique. I then consider the justification of her move by examining the philosophical context and political applications of the third Critique, arguing that within it Kant made an original and profound discovery: that the (...) phenomenon of common sense contains a hidden faculty that may anchor moral and political judgments. I conclude by arguing that Arendt was on firmer ground than is often thought in adapting Kantian common sense to politics, a fact that may afford new possibilities for the practice of moral and political thought. In the 1980s extra-parliamentary social movements and critical theories of race, class, and gender added a new sociocultural understanding of justice—recognition—to the much older socioeconomic one. The best-known form of the struggle for recognition is the identity politics of disadvantaged groups. I argue that there is still another option to conceptualize their predicament, neglected in recent political philosophy, which understands exclusion not in terms of injustice, more particularly a lack of sociocultural recognition, but in terms of a lack of freedom. (...) I draw my inspiration from Hannah Arendt's model of political action. Arendt diagnoses exclusion not solely as a mode of injustice, but as a lack of participation and public freedom. Consequently, she advocates a struggle for participation, political equality, and freedom as a strategy for emancipation or empowerment. Arendt could help feminists see that collective empowerment is made possible not by a shared identity (the target of poststructuralist critics) but by common action in the service of a particular worldly issue or common end. In other words, feminists would do well to appreciate the revolutionary quality and heritage of the feminist movement better, that is, its character as a set of practices of freedom. (shrink)

This article critically examines the different senses of judgment that are at play in Jürgen Habermas’ theory of law. The article offers a new critical reading of Habermas’ account of the legitimacy of law, and a revisionary interpretation of the reconstructive approach to political theory that underpins it. Many have been struck by Hannah Arendt’s remarks on loneliness in the concluding pages of The Origins of Totalitarianism, but very few have attempted to deal with the remarks in any systematic way. What is especially striking about this state of affairs is that the remarks are crucial to the account contained therein, as they betray a view of agency that undergirds the rest of the account. This article develops Arendt’s thinking on loneliness throughout her corpus, showing how loneliness is (...) connected to thoughtlessness. In so doing, the article also suggests a connection between Arendt’s notion of loneliness and Stanley Cavell’s notion of skepticism. This connection, it is argued, allows us not only fully to answer a question Arendt leaves unaddressed (the cause loneliness), but also allows us to see how we, as agents and users of language, are perpetually prone to loneliness. The article examines the political challenge and significance of forgiveness as an indispensable response to the inherently imperfect and tragic nature of political life through the lens of the existential, narrative-inspired judging sensibility. While the political significance of forgiveness has been broadly recognized in transitional justice and reconciliation contexts, the question of its importance and appropriateness in the wake of grave injustice and suffering has commonly been approached through constructing a self-centred, rule-based framework, defining forgiveness in terms of a moral (...) duty or virtue. Reliant on a set of prefabricated moral standards, however, this approach risks abstracting from the historical, situated condition of human political existence and thus arguably stands at a remove from the very quandaries and imperfections of the political world, which it purports to address. Against this background, this article draws on Albert Camus’s and Hannah Arendt’s aesthetic, worldly judging sensibility and its ability to kindle the process of coming to terms with the absurd, and perhaps unforgivable character of reality after evil. As an aptitude to engage the world in its particularity, plurality and contingency rather than seeking to subdue and tame it under prefabricated standards of thought, namely, worldly judgement is able to reveal how past tragedies have arisen from the ambiguity of human engagement in the world and thereby also elicit the distinctly human capacities of beginning anew and resisting such actions in the future. As such, I suggest, it is well-suited to bring into clearer focus and confront the main political challenge and significance of forgiveness: how to acknowledge the seriousness of the wrongs committed, yet also enable the possibility of a new beginning and restore among former enemies the sense of responsibility for the shared world. Political action is unpredictable because it unfolds among a plurality of independent actors. This unpredictability generates a fundamental puzzle: If an actor cannot know where her initiative will lead, what motivates and guides her in her doings? The aim of this paper is to develop and defend the solution to the puzzle that we can find in the thought of Hannah Arendt, namely the idea that political action is – or should be – motivated and guided by principles, principles like (...) justice, equality, or honour. Such principles must be distinguished from goals because they do not designate a specific state of affairs, but are general ideas that allow for diverse implementations. I show that this distinction is of great practical importance for the actors involved, since their outlook and their attitude towards others will differ depending on whether they see their activity as aimed at a goal or as guided by a principle. This article aims to show the relevance of Hannah Arendt’s political and philosophical thought on the contemporary crisis of “political space”, bureaucratically moralised for the citizens, with a focus on the disorientation of public opinion in state affairs. In her philosophical career, Hannah Arendt investigated the functioning mechanisms of totalitarian regimes and pioneered the famous notion of the “banality of evil”, which she coined during Eichmann trial, held in Jerusalem in 1961. Arendt questions the nature of the evil that was (...) being perpetrated during the Second World War: an evil without a face and without roots, but which had claimed the lives of many people. Arendt reflects on this new type of evil that can be countered through the action of critical thinking. After the war, there was a strong need to redefine an idea of responsibility and a call for each individual to voice their ideas. Put it briefly, post-war society had to become a new philosophical and intellectual arena. Beginning with the strife between state law and moral law, I will include in my discussion Kantian famous notions of categorical imperative and reflective judgment, clarifying their use in Arendt’s conception of thinking and judging. Arendt, recognising Socrates as a critical thinker par excellence, keeps alive a dimension of living in common that protects the individual's singularity and guarantees a conscious and meaningful relationship with the otherness. Reflections on Little Rock is one of Hannah Arendt’s most controversial writings. Read from the perspective of the political philosopher, it appears even more contentious than her famous remarks in Eichmann in Jerusalem. In the last two decades, a number of critical contributions have been published addressing this essay, highlighting how it casts serious doubts on the correctness of Arendt’s dealing with the racial question and, more generally, on the tenability of central elements of her political thought – e.g., her (...) distinction between the political and the social. However, only occasional – and, as I will try to demonstrate, quite imprecise – analyses of the implications of RLR for an understanding of Arendt’s view of judgment have been produced. The aim of the present article is to reread what both Arendt’s position on judgment and its main contemporary reformulation, advanced by Linda Zerilli, imply for the making of political choices in pluralistic societies. This paper operates on the premise that a systematic formulation of ‘radicality’ is a worthwhile and potentially productive exercise within political theory. However, I argue that one continues to find a latent ‘purism’ within contemporary understandings of ‘radicality’, primarily in relation to feminism, but also elsewhere. This manifests itself in the tendency to think ‘radicality’ as a function of the inherent properties of particular types of political spaces and political practices. Within feminism, for example, I argue that the ‘radicality’ of (...) a feminist politics is thought in terms of the extent to which it adheres to a specifically ‘1970s’ feminist model of autonomous mobilization. This perspective suffers from a number of conceptual problems, necessitating a formulation of a more dynamic view of radicality with which to evaluate contemporary political practices. To this end, I seek to cast radicality as a function of equivalence (drawn from Ernesto Laclau) and (especially) imagination drawn from Linda Zerilli's Arendtian-inflected feminist theory. Thinking radicality in these terms, I argue, avoids the latent purism of many existing approaches while enabling a critical engagement sensitive to the context of the practice under investigation. This essay utilizes Plato's insights into the role of shame in dialogical interactions to illuminate the aesthetic dimensions of deliberative democracy. Through a close analysis of the refutation of Polus in Plato's dialogue, the "Gorgias", I show how the emotion of shame is central to the unsettling, dynamic, and transformative character of democratic engagement and political judgment identified by recent aesthetic critics of Habermas' model of communicative action and democratic deliberation. Plato's analysis of shame offers a friendly amendment to these (...) aesthetic critiques by showing how the psychological forces at the heart of shame make the outcome of our political engagements with others uncertain and unsettling, even while they make possible the kind of self-reflexivity necessary to foster the deliberative virtue of sincerity or truthfulness. In this paper, I am arguing for hermeneutic responsibility in political judgment, as it can be attributed to Arendt’s work. Political judgment is reflective judgment relying on representation by imagination and therefore only has exemplary validity. Along the line of Arendt’s Lectures on Kant’s Political Philosophy, I point out her argument for a different generality in politics than the generality of concepts. This generality of political judgment always refers back to the particular. Only by this reference to the particular, namely (...) to facts and situations of direct interaction, can the spectator, who undertakes the political judgment, create the public realm where action takes place. However, this task attributed to the spectator also implies the task of reshaping the public realm. These acts of giving an account of and reconsidering all over again facts handed over by narration and testimony imply the hermeneutic responsibility to unceasingly retrieve factual truth which is rooted in direct interaction. This article examines a population-based opportunistic screening practice for cognitive impairment that takes place at a hospital in Sweden. At the hospital, there is a routine in place that stipulates that all patients over the age of 65 who are admitted to the ward will be offered testing for cognitive impairment, unless they have been tested within the last six months or have been diagnosed with any form of cognitive impairment. However, our analysis shows that this routine is not universally (...) and mechanically applied. Rather, the health care professionals have developed and use an ethico-political judgment, concerning, for example,whomto test,whento offer the tests, andhowto explain and perform them. This article explores the role and practice of this form of judgment, emphasising its political and ethical nature. The analysis is based on qualitative interviews with professionals and patients, and draws on the theories of Aristotle and Hannah Arendt. (shrink)

El objetivo principal es reconstruir el camino entre las intuiciones provenientes del mundo del teatro y la construcción del concepto de lo público arendtiano. Después de algunas precisiones metodológicas, se enumeran las expresiones vinculadas con el ámbito teatral que se encuentran en distintas obras arendtianas. Posteriormente, se analiza la fuente de la metáfora teatral y se caracteriza el concepto (...) de espacio público a partir de ellas. Este trabajo muestra que: 1. La fuente de la metáfora teatral incluye a la tragedia antigua tanto como a formas contemporáneas de teatro. 2. The paper seeks to show that there is a distinctive and consistent method in the political thought of Hannah Arendt. It is argued that this method constitutes a salutary and potentially challenging alternative to conventional approaches in contemporary political theory. In contrast with approaches that adopt an unfortunately abstracted standpoint, resulting from the insistence that political theory answer formally to the requirements of philosophy, Arendt adopts a more mediated and phenomenologically sensitive standpoint. Rejecting influential attributions to Arendt of a method (...) resting on the use of narrative form, the paper identifies key mediations — epistemological and temporal — expressed in modulations of the theoretical voice which mark out Arendt's approach as one which aims at 'saving the appearances' of the public realm. These mediations are identified, explored and exemplified by reference to a number of Arendt's key works. This way of characterizing Arendt's distinctive method is then used to shed light on the question of the 'missing' normative dimension to her work. It is argued that Arendt sees politics as a potentially self-regulating sphere. (shrink)

ABSTRACTThe article contributes to current theoretical debates about the political significance of narrative imagination by drawing on Camus’s and Arendt’s existential aesthetic judging sensibility. It seeks to displace the prevalent tendency to probe literature for its moral-philosophical insights, and instead delves into the experiential reality of our engagement with literary works. It starts from Martha Nussbaum’s recognition of the literary ability to account for the fragility of human affairs, yet finds her reduction of narrative imagination to the role of furthering (...) moral lessons wanting politically. Against this background, the article reclaims Camus’s and Arendt’s dialogical-representative judging orientation and its insight into the narrative ability to respond to the intersubjective character of politics. As such, their aesthetic sensibility reveals the potential political significance of literary imagination in its capacity to open a public space where the contradictions of our situated existence can be confronted through politics between plural equals. This paper seeks to contribute to the literature on political judgment by proposing that the faculty of judgment is essential for responsibly coping with the undeniable fact of distant suffering and the controversial duty of humanitarian intervention. To achieve this end, Mahmood Mamdani’s text ‘The Politics of Naming: Genocide, Civil War, Insurgency’ will be mobilized for a constructive dialogue about which specific conception of political judgment is at stake when we debate a situation like Darfur today. The main claim is (...) that political judgment in times of acute crisis requires the members of the public sphere to strike a precarious balance between two contradictory impulses: the deliberative impulse to enlarge the pool of particular standpoints, and the decisionist impulse to finally bring the conversation to a halt and adopt a normative stance. The theoretical framework for this balanced view of the faculty of judgment will be articulated through a hybridization of Hannah Arendt’s notion of an ‘enlarged mentality’ and Jacques Derrida’s concept of an ‘aporetic decision’.
