This essay challenges the widely accepted principle that a person is morally responsible for what he has done only if he could have done otherwise. The author considers situations in which there are sufficient conditions for a certain choice or action to be performed by someone, So that it is impossible for the person to choose or to do otherwise, But in which these conditions do not in any way bring it about that the person chooses or acts as he (...) does. In such situations the person may well be morally responsible for what he chooses or does despite his inability to choose or to do otherwise. There has been a long-standing dispute in the philosophical literature about the conditions under which a behavior counts as 'intentional.' Much of the debate turns on questions about the use of certain words and phrases in ordinary language. The present paper investigates these questions empirically, using experimental techniques to investigate people's use of the relevant words and phrases. g.

The psychological and neurobiological processes underlying moral judgement have been the focus of many recent empirical studies1–11. Of central interest is whether emotions play a causal role in moral judgement, and, in parallel, how emotion-related areas of the brain contribute to moral judgement. Here we show that six patients with focal bilateral damage to the ventromedial prefrontal cortex (VMPC), a brain region necessary for the normal generation of emotions and, in particular, social emotions12–14, produce an abnor- mally ‘utilitarian’ pattern of (...) judgements on moral dilemmas that pit compelling considerations of aggregate welfare against highly emotionally aversive behaviours (for example, having to sacrifice one person’s life to save a number of other lives)7,8. In contrast, the VMPC patients’ judgements were normal in other classes of moral dilemmas. These findings indicate that, for a selective set of moral dilemmas, the VMPC is critical for normal judgements of right and wrong. An empirical study of people's intuitions about freedom of the will. We show that people tend to have compatiblist intuitions when they think about the problem in a more concrete, emotional way but that they tend to have incompatiblist intuitions when they think about the problem in a more abstract, cognitive way.

Philosophers working in the nascent field of ‘experimental philosophy’ have begun using methods borrowed from psychology to collect data about folk intuitions concerning debates ranging from action theory to ethics to epistemology. In this paper we present the results of our attempts to apply this approach to the free will debate, in which philosophers on opposing sides claim that their view best accounts for and accords with folk intuitions. After discussing the motivation for such research, we describe our methodology of (...) surveying people’s prephilosophical judgments about the freedom and responsibility of agents in deterministic scenarios. In two studies, we found that a majority of participants judged that such agents act of their own free will and are morally responsible for their actions. We then discuss the philosophical implications of our results as well as various difficulties inherent in such research. (shrink)

In this essay, I draw on Haidt’s and Baron’s respective insights in the service of a bit of philosophical psychoanalysis. I will argue that deontological judgments tend to be driven by emotional responses, and that deontological philosophy, rather than being grounded in moral reasoning, is to a large extent3 an exercise in moral rationalization. This is in contrast to consequentialism, which, I will argue, arises from rather different psychological processes, ones that are more “cognitive,” and more likely to involve genuine (...) moral reasoning. These claims are strictly empirical, and I will defend them on the basis of the available evidence. Needless to say, my argument will be speculative and will not be conclusive. Beyond this, I will argue that if these empirical claims are true, they may have normative implications, casting doubt on deontology as a school of normative moral thought. (shrink)

Incompatibilists believe free will is impossible if determinism is true, and they often claim that this view is supported by ordinary intuitions. We challenge the claim that incompatibilism is intuitive to most laypersons and discuss the significance of this challenge to the free will debate. After explaining why incompatibilists should want their view to accord with pretheoretical intuitions, we suggest that determining whether incompatibilism is in fact intuitive calls for empirical testing. We then present the results of our studies, which (...) put significant pressure on the claim that incompatibilism is intuitive. In recent years, there has been much concern expressed about the under-representation of women in academic philosophy. Our goal in this paper is to call attention to a cluster of phenomena that may be contributing to this gender gap. The findings we review indicate that when women and men with little or no philosophical training are presented with standard philosophical thought experiments, in many cases their intuitions about these cases are significantly different. In section 1 we review some of the (...) data on the under-representation of women in academic philosophy. In section 2 we explain how we use the term 'intuition,' and offer a brief account of how intuitions are invoked in philosophical argument and philosophical theory building. In the third section we set out the evidence for gender differences in philosophical intuition and mention some evidence about gender differences in decisions and behaviors that are (or should be) of considerable interest to philosophers. In the fourth section, our focus changes from facts to hypotheses. In that section we explain how differences in philosophical intuition might be an important part of the explanation for the gender gap in philosophy. The fifth section is a brief conclusion. Bibliography of works in experimental philosophy.

Many philosophers appeal to intuitions to support some philosophical views. However, there is reason to be concerned about this practice as scientific evidence has documented systematic bias in philosophically relevant intuitions as a function of seemingly irrelevant features (e.g., personality). One popular defense used to insulate philosophers from these concerns holds that philosophical expertise eliminates the influence of these extraneous factors. Here, we test this assumption. We present data suggesting that verifiable philosophical expertise in the free will debate-as measured by (...) a reliable and validated test of expert knowledge-does not eliminate the influence of one important extraneous feature (i.e., the heritable personality trait extraversion) on judgments concerning freedom and moral responsibility. These results suggest that, in at least some important cases, the expertise defense fails. Implications for the practice of philosophy, experimental philosophy, and applied ethics are discussed. Incompatibilists and compatibilists (mostly) agree that there is a strong intuition that a manipulated agent, i.e., an agent who is the victim of methods such as indoctrination or brainwashing, is unfree. They differ however on why exactly this intuition arises. Incompatibilists claim our intuitions in these cases are sensitive to the manipulated agent’s lack of ultimate control over her actions, while many compatibilists argue that our intuitions respond to damage inflicted by manipulation on the agent’s psychological and volitional capacities. Much (...) hangs on this issue because manipulation-based arguments are among the most important for defending incompatibilist views of free will. In this paper, I investigate this issue from a experimental perspective, using a set of statistical methods well suited for identifying the features of hypothetical cases people’s intuitions are responding to. Results strongly support the compatibilist view—subjects’ tendency to judge that a manipulated agent is unfree was found to depend on their judgments that the agent suffers impairments to certain psychological/volitional capacities that compatibilists say are the basis for free will. I discuss the significance of these results for the use of manipulation cases in the philosophical debate about free will. (shrink)

This chapter addresses the issue of the underrepresentation of women in philosophy by presenting an account regarding gender differences in philosophical institutions. It begins with an analysis of data on the gender gap in academic philosophy; followed by a discussion about the term “intuition,”as well as the tendency to appeal to intuitions during philosophical arguments. It then presents empirical data about gender differences derived from a series of experiments such as a Gettier-style case study of Christina Starmans and Ori Friedman, (...) a philosophical thought experiment of Geoffrey Holtzman, and one of David Pizarro about moral responsibility and causal deviance, among others; one hypothesis derived from these studies pertains to the distinct differences between women and mens' intuitions regarding philosophy, with the instructors deciding that the mens' are more correct. In this paper, I first review some of the recent empirical work on the biasing effect that moral considerations have on folk ascriptions of intentional action. Then, I use Mark Alicke's affective model of blame attribution to explain this biasing effect. Finally, I discuss the relevance of this research - both philosophical and psychological - to the problem of the partiality of jury deliberation. After all, if the immorality of an action does affect folk ascriptions of intentionality, and all serious (...) criminal offenses - e.g., murder and rape - are immoral in addition to being illegal, then a juror's ability to determine the relevant mens rea (i.e., guilty mind) of a defendant in an unbiased way may be seriously undermined. People’s concept of free will is often assumed to be incompatible with the deterministic, scientific model of the universe. Indeed, many scholars treat the folk concept of free will as assuming a special form of nondeterministic causation, possibly the notion of uncaused causes. However, little work to date has directly probed individuals’ beliefs about what it means to have free will. The present studies sought to reconstruct this folk concept of free will by asking people to define the concept (Study (...) 1) and by confronting them with a neuroscientific claim that free will is an illusion (Study 2), which invited them to either reconcile or contrast free will with determinism. The results suggest that the core of people’s concept of free will is a choice that fulfills one’s desires and is free from internal or external constraints. No evidence was found for metaphysical assumptions about dualism or indeterminism. (shrink)

We discuss recent work in experimental philosophy on free will and moral responsibility and then present a new study. Our results suggest an error theory for incompatibilist intuitions. Most laypersons who take determinism to preclude free will and moral responsibility apparently do so because they mistakenly interpret determinism to involve fatalism or “bypassing” of agents’ relevant mental states. People who do not misunderstand determinism in this way tend to see it as compatible with free will and responsibility. We discuss why (...) these results pose a challenge to incompatibilists. In the free will literature, some compatibilists and some incompatibilists claim that their views best capture ordinary intuitions concerning free will and moral responsibility. One goal of researchers working in the field of experimental philosophy has been to probe ordinary intuitions in a controlled and systematic way to help resolve these kinds of intuitional stalemates. We contribute to this debate by presenting new data about folk intuitions concerning freedom and responsibility that correct for some of the shortcomings of previous studies. (...) This paper relies on experimental methods to explore the psychological underpinnings of folk intuitions about free will and responsibility. In different conditions, people give conflicting responses about agency and responsibility. In some contexts, people treat agency as indeterminist; in other contexts, they treat agency as determinist. Furthermore, in some contexts people treat responsibility as incompatible with determinism, and in other contexts people treat responsibility as compatible with determinism. The paper considers possible accounts of the psychological mechanisms that underlie these conflicting (...) responses. (shrink)

Revisionism in the theory of moral responsibility is the idea that some aspect of responsibility practices, attitudes, or concept is in need of revision. While the increased frequency of revisionist language in the literature on free will and moral responsibility is striking, what discussion there has been of revisionism about responsibility and free will tends to be critical. In this paper, I argue that at least one species of revisionism, moderate revisionism, is considerably more sophisticated and defensible than critics have (...) realized. I go on to argue for the advantages of moderate revisionist theories over standard compatibilist and incompatibilist theories. (shrink)

Studies of normal individuals reveal an asymmetry in the folk concept of intentional action: an action is more likely to be thought of as intentional when it is morally bad than when it is morally good. One interpretation of these results comes from the hypothesis that emotion plays a critical mediating role in the relationship between an action’s moral status and its intentional status. According to this hypothesis, the negative emotional response triggered by a morally bad action drives the attribution (...) of intent to the actor, or the judgment that the actor acted intentionally. We test this hypothesis by presenting cases of morally bad and morally good action to seven individuals with deficits in emotional processing resulting from damage to the ventromedial prefrontal cortex (VMPC). If normal emotional processing is necessary for the observed asymmetry, then individuals with VMPC lesions should show no asymmetry. Our results provide no support for this hypothesis: like normal individuals, those with VMPC lesions showed the same asymmetry, tending to judge that an action was intentional when it was morally bad but not when it was morally good. Based on this finding, we suggest that normal emotional processing is not responsible for the observed asymmetry of intentional attributions and thus does not mediate the relationship between an action’s moral status and its intentional status. Studying the folk concept of intentional action, Knobe (2003a) discovered a puzzling asymmetry: most people consider some bad side effects as intentional while they consider some good side effects as unintentional. In this study, we extend these findings with new experiments. The first experiment shows that the very same effect can be found in ascriptions of intentionality in the case of means for action. The second and third experiments show that means are nevertheless generally judged more intentional than side effects, (...) and that people do take into account the structure of the action when ascribing intentionality. We then discuss a number of hypotheses that can account for these data, using reactions times from our first experiment. (shrink)

An important disagreement in contemporary debates about free will hinges on whether an agent must have alternative possibilities to be morally responsible. Many assume that notions of alternative possibilities are ubiquitous and reflected in everyday intuitions about moral responsibility: if one lacks alternatives, then one cannot be morally responsible. We explore this issue empirically. In two studies, we find evidence that folk judgments about moral responsibility call into question two popular principles that require some form of alternative possibilities for moral (...) responsibility. Survey participants given scenarios involving agents that fail to satisfy these principles nonetheless found these agents to be morally responsible, blameworthy, deserving of blame, and at fault for morally bad actions and consequences. We defend our interpretation of this evidence against objections and explore some implications of these findings for the free will debate. (shrink)

I discuss experimental work by Nichols, and Nichols and Knobe, with respect to the philosophical problems of free will and moral responsibility. I mention some methodological concerns about the work, but focus principally on the philosophical implications of the work. The experimental results seem to show that in particular, concrete cases we are more willing to attribute responsibility than in cases described abstractly or in general terms. I argue that their results suggest a deep problem for traditional accounts of compatibilism, (...) and that they may cast some light on the literature surrounding Frankfurt cases. I also suggest a way in which mature philosophical convictions about free will may reflect a contingent process of refining and defending either of two competing strands of intuitions, and suggest that this may partly explain the persistence of philosophical debates about free will.
