Moira Gatens investigates the ways in which differently sexed bodies can occupy the same social or political space. In the philosophical works of Emmanuel Levinasʼs early career, it is in a phenomenology of Eros that he claims to have uncovered the site of what he calls ʻtranscendenceʼ. This is no small claim. According to the argument of the later Totality and Infinity (1961), the history of Western philosophy is to be thought as the history of the ʻphilosophy of the sameʼ. Within this polemical generalization almost the whole of Western philosophy is characterized as a totalizing discourse which aims (...) to reduce everything to the categories of a thematizing consciousness. Conceptual structures are employed (or presupposed) in order to make diverse phenomena commensurable within a system, and according to Levinas this operation always constitutes a reduction of what is ʻotherʼ to the order of the ʻsameʼ. In agreement with a certain transcendentalism which is itself implicated in Levinasʼs critique, these structures of thought are then equated with consciousness itself; the thematizing project is one of mastery in which noemata will of necessity conform to noesis, in which the object is constituted for and by the subject. The experience of transcendence, so rare in this version of philosophyʼs history, is the experience of whatever is and truly remains other than me, recalcitrant to mastery through conceptualization and to the transcendental project of the subject to construe everything as originating from within itself. If, then, it is first of all in the erotic relation that the possibility of the experience of transcendence is said to arise, Eros can in no sense be dismissed as an unimportant or peripheral theme for Levinas, and a full investigation is warranted, especially given the current interest in Levinasʼs work, interest which is not limited to the discipline of philosophy. Furthermore, as the notion of Eros is closely associated, textually and conceptually, with what Levinas calls ʻthe feminineʼ, critical attention has been excited amongst feminist scholars of various persuasions, with claims – both positive and negative – being made for Levinasʼs significance as a resource for feminist philosophy and feminist politics. If assertions of a ʻLevinasianʼ feminism, no matter how qualified, tend to rest on the idea that Levinasʼs phenomenology of Eros, and analyses of ʻthe feminineʼ mark a break in or a new departure from a ʻmasculinistʼ tradition, this article seeks, in part, to argue to the contrary. Pateman challenges the way contemporary society functions by questioning the standard interpretation of an idea that is deeply embedded in American and British political thought: that our rights and freedoms derive from the social contract explicated by Locke, Hobbes, and Rousseau and interpreted in the United States by the Founding Fathers. The author shows how we are told only half the story of the original contract that establishes modern patriarchy. The sexual contract is ignored and thus men's patriarchal right over (...) women is also glossed over. No attention is paid to the problems that arise when women are excluded from the original contract but incorporated into the new contractual order. One of the main targets of the book is those who try to turn contractarian theory to progressive use, and a major thesis of the book is that this is not possible. Thus those feminists who have looked to a more "proper" contract- one between genuinely equal partners, or one entered into without any coercion- are misleading themselves. In the author's words, "In contract theory universal freedom is always a hypothesis, a story, a political fiction. Contract always generates political right in the forms of domination and subordination." Thus the book is also aimed at mainstream political theorists, and socialist and other critics of contract theory. The author offers a sweeping challenge to conventional understandings- of both left and right- of actual contracts in everyday life: the marriage contract, the employment contract, the prostitution contract, and the new surrogate mother contract. By bringing a feminist perspective to bear on the contradictions and paradoxes surrounding women and contract, and the relation between the sexes, she is able to shed new light on fundamental political problems of freedom and subordination. ABSTRACT This paper argues that generosity as a moral virtue is only consistently and fully possible to practise in the kind of polity that upholds natural individual human rights, including the basic negative right to private property. The paper sketches a characterisation of generosity and explains the sense in which it can be a moral virtue. Some of the assumptions underlying the concept of moral virtue are considered and it is argued that contrary to some recent claims, it is possible (...) to conceptualise as well as to practise moral virtues in our age. Yet it is also shown that certain political prerequisites are necessary for practising generosity. Furthermore, it is shown that there cannot be any generosity involved in a polity in which one is forced to share one's wealth with those who might be the beneficiaries of generous conduct. Finally, it is argued that even in a polity with a very limited government some acts of official generosity are possible. (shrink)

This essay explores the criteria for lesbian identity attribution through the case study of "male lesbians": biological males who claim to be lesbians. I analyze such sex/gender identity attribution through the lens of postmodernism, which provides a workable theoretical framework for "male lesbian" identities. My conclusions explore the historicity and cultural constructedness of the body's sex/gender identities, revealing the limitations of both "the postmodernized body" and "the essentialized modernist body.".

Examining Levinas's critique of the Heideggerian conception of temporality, this book shows how the notion of the feminine both enables and prohibits the most fertile territory of Levinas's thought. The author suggests that though Levinas's conception of subjectivity corrects some of the problems Heidegger's philosophy introduces, such as his failure to deal adequately with ethics, Levinas creates new stumbling blocks, notably the confining role he accords to the feminine. For Levinas, the feminine functions as that which facilitates but is excluded (...) from the ethical relation that he sees as the pinnacle of philosophy. Showing that the feminine is a strategic part of Levinas's philosophy, but one that was not thought through by him, the author suggests that his failure to solidly place the feminine in his thinking is structurally consonant with his conceptual separation of politics from ethics.
