In this paper the authors give a brief overview of the theoretical background of their research project “Linguistic indicators of argumentative moves.” Starting from the pragma-dialectical ideal model of a critical discussion, they design dialectical profiles for capturing the moves that may or must be made at a particular stage or sub-stage of such a discussion. They explain how these dialectical profiles can be methodically exploited for systematically identifying the verbal expressions that can be indicative of any of these moves (...) in argumentative practice. This volume gives a theoretical account of the problem of analyzing and evaluating argumentative discourse. After placing argumentation in a communicative perspective, and then discussing the fallacies that occur when certain rules of communication are violated, the authors offer an alternative to both the linguistically-inspired descriptive and logically-inspired normative approaches to argumentation. The authors characterize argumentation as a complex speech act in a critical discussion aimed at resolving a difference of opinion. According to the pragma-dialectical approach to argumentation, for analysing argumentative discourse, a normative reconstruction is required which encompasses four kinds of transformations. It is explained in this paper how speech act conditions can play a part in carrying out such a reconstruction. It is argued that integrating Searlean insights concerning speech acts with Gricean insights concerning conversational maxims can provide us with the necessary tools. For this, the standard theory of speech acts has to be amended in several respects and (...) the conversational maxims have to be translated into speech act conditions. Making use of the rules for communication thus arrived at, and starting from the distribution of speech acts in a critical discussion as specified in the pragma-dialectical model, it is then demonstrated how indirect speech acts are to be transformed when reconstructing argumentative discourse. In this paper, a case study is presented of constitutional debates about abortion. An analysis is given of arguments from the Roe v. Wade case for definitions concerning the key notions of `person' and `human life'. The paper illustrates how the Court has gradually taken a more pragmatic or rhetorical position on definitional matters crucial to the purpose of regulating abortion.

Claims about the occurrence of future events play an important role in pragmatic argumentation. Such claims can be supported by inductive arguments employing anecdotal, statistical, or causal evidence. In an experiment, the actual and perceived persuasiveness of these three types of evidence were assessed. A total of 324 participants read a newspaper article in which it was claimed that the building of a cultural centre would be profitable. This claim was supported by either anecdotal, statistical or causal evidence. The statistical (...) evidence proved to be more convincing than the anecdotal and causal evidence. Although the latter two evidence types were equally unconvincing, the anecdotal evidence was perceived as less persuasive than the causal evidence. Therefore, the actual and perceived persuasiveness of the evidence did not correspond. These results partly replicate the results obtained in previous experiments. They also underscore the need to distinguish between the perceived and the actual persuasiveness of an argument. (shrink)

The problem with the pragma-dialectical view, it has been argued, is that it takes argumentation as aiming at consensus rather than truth or justified belief. The pragma-dialecticians often imply that an argumentative process aiming at consensus in a way constrained by the “Ten Commandments” will in the long run converge on epistemically favourable standpoints. I will argue that they are right provided pragma-dialectics is construed, as they say, as a theory of criticism; pragma-dialectics and the other theories of argumentation have (...) in common the requirement to account for the fallacies. According to van Eemeren, argumentation theory is a hybrid discipline, because it requires a multidisciplinary, if not interdisciplinary approach, combining descriptive and normative insights. He points out that modern argumentation theorists give substance to the discipline by relying either on a dialectical perspective, concentrating on the reasonableness of argumentation, or on a rhetorical perspective, concentrating on its effectiveness. Both the dialectical and the rhetorical perspective are interpreted in ways related to how they were viewed by Aristotle, but in modern argumentation (...) theory the relationship between the two, captured in Aristotle’s term antistrophos, is lost. According to van Eemeren, this relationship, which he considers crucial to a full-fledged argumentation theory, has been recovered in extended pragma-dialectics with the help of the theoretical notion of ‘strategic manoeuvring.’. In this paper we defend a particular version of the epistemic approach to argumentation. We advance some general considerations in favor of the approach and then examine the ways in which different versions of it play out with respect to the theory of fallacies, which we see as central to an understanding of argumentation. Epistemic theories divide into objective and subjective versions. We argue in favor of the objective version, showing that it provides a better account than its subjectivist rival (...) of the central fallacy of begging the question. We suggest that the strengths of the objective epistemic theory of fallacies provide support for the epistemic approach to argumentation more generally. (shrink)

I wish to argue in favor of a particular orientation, one expressed in Brockriede’s remark that “aruments are not in statements but in people.” While much has been gained from textual analyses, even more will accrue by additional attention to the arguers. I consider that textual materials are really only the artifacts of arguments. The actual arguing is done exclusively by people, either the argument producers or receivers, and never by words on a page. This article combines a pragma-dialectical conception of argumentation, a sociological conception of legitimacy and a sociological theory of the political field. In particular, it draws on the theorization of the political field developed by Pierre Bourdieu and tries to determine what new insights into the concept of strategic maneuvering might be offered by a sociological analysis of the political field. I analyze a speech made by the President of Romania, Traian Băsescu, following his suspension by Parliament in April 2007. I (...) suggest that the argument developed in this speech can be regarded as an example of adjudication and I discuss its specificity as an adjudication in the political field in an electoral campaign. I also try to relate legitimation as political strategy to strategic maneuvering oriented to meeting the contradictory demands of the political field, which I see—following Bourdieu—as involving a double political game, a game of democratic representation and a game of power. As a way to advance integration between traditional readings of the medical encounter and argumentation theory, this article conceptualizes the doctor–patient interaction as a form of info-suasive dialogue. Firstly, the article explores the relevance of argumentation in the medical encounter in connection with the process of informed consent. Secondly, it discloses the risks inherent to a lack of reconciliation of the dialectical and rhetorical components in the delivery of the doctor’s advice, as especially resulting from the less than ideal conditions (...) of the internal states of the doctor and the patient, and the lack of symmetry in their status. The traditional concepts of rhetorical strategy and argumentative fallacy cannot be readily reconciled. Doing so requires escaping the following argument: All argumentation involves rhetorical strategies. All rhetorical strategies are violations of logical or dialectical ideals. All violations of logical or dialectical ideals are fallacies. Normative pragmatics provides a perspective in which rhetorical strategies can be seen to have the potential for constructive contributions to argumentation and in which fallacies are not simply violations of ideals. One kind of constructive contribution, framing (...) moves, is illustrated with the case of Lyndon Johnson’s 1964 TV campaign commercial known as the Daisy ad. (shrink)

This paper explores the possibilities for strategic maneuvering of the argumentative technique that Perelman and Olbrechts-Tyteca (The New Rhetoric. A Treatise on Argumentation, University of Notre Dame Press, Notre Dame/London, 1969) called dissociation. After an exploration of the general possibilities that dissociation may have for enhancing critical reasonableness and rhetorical effectiveness, the use of dissociation in the successive stages of a critical discussion is examined. For each stage, first, the dialectical moves that dissociation can be employed in are specified, then, (...) the specific ways in which dissociation contributes to fulfilling the dialectical tasks that are associated with these moves are delineated, and, finally, the rhetorical gain that␣dissociation can bring in the fulfillment of these tasks is discussed. Some general conclusions are drawn for research that aims at understanding the potential of an argumentative technique for strategic maneuvering. (shrink)

The thesis is defended that rhetoric is not, as is often said, a discipline which is hierarchically subordinate to dialectic. It is argued that the modalities of the links between rhetoric and dialectic must be seen in a somewhat different light: rhetoric and dialectic should be viewed as two complementary disciplines. On the basis of a historical survey of the views of various authors on the links between rhetoric and dialectic, it is concluded that efforts to establish clear boundaries or (...) unequivocal conceptual or moral hierarchical relationships between the two disciplines have failed and that therefore, they must be conceived as being mutually dependent.
