Many people are vaguely disquieted by developments (real or imagined) that could alter minds and bodies in novel ways. Romantics and Greens tend to idealize the natural and demonize technology. Traditionalists and conservatives by temperament distrust radical change. Egalitarians worry about an arms race in enhancement techniques. And anyone is likely to have a "yuck" response when contemplating unprecedented manipulations of our biology. The President's Council has become a forum for the airing of this disquiet, and the concept of "dignity" (...) a rubric for expounding on it. This collection of essays is the culmination of a long effort by the Council to place dignity at the center of bioethics. The general feeling is that, even if a new technology would improve life and health and decrease suffering and waste, it might have to be rejected, or even outlawed, if it affronted human dignity. Kateb asserts that the defense of universal human rights requires two indispensable components: morality and human dignity. For Kateb, morality and justice have sound theoretical underpinnings; human dignity, by virtue of its “existential” quality, lacks its own theoretical framework. This he proceeds to establish with a critique of the writings of canonical Western political philosophers and contemporary thinkers like Peter Singer and Thomas Nagel. The author argues that while morality compels just governments to prevent, reduce, or eliminate human suffering inasmuch (...) as it is possible, people possess and are entitled to dignity by mere virtue of their “status” as human beings. Der Rückgriff auf die Menschenwürde ist in der modernen angewandten Ethik verbreitet, sein Stellenwert ist aber, wie sich auch in vielen Beiträgen dieses Buches zeigt, moraltheoretisch höchst umstritten. Es ist nicht nur unklar, ob die Menschenwürde tatsächlich ein eigenständig zu respektierendes Gut ist, sondern vor allem, was Menschenwürde überhaupt ist und welches Verhalten sie von uns fordert. Diese Unklarheiten wecken wiederum Zweifel daran, ob es sinnvoll ist, der Menschenwürde einen prominenten Platz in der Ethik zuzuweisen (jenseits eines „Präambel- und Bekenntnisdaseins“, (...) wie Martina Herrmann es in ihrem Beitrag ausgedrückt hat). Das Ziel meines Beitrags ist es, zu zeigen, dass dies nicht nur sinnvoll, sondern sogar notwendig ist, weil man ohne Rückgriff auf die Menschenwürde dem besonderen ethischen Charakter bestimmter Handlungen nicht gerecht werden kann, deren Verwerflichkeit darin liegt, ihre Opfer zu demütigen, zu erniedrigen, zu entwürdigen. Die Konzentration auf Missachtungen der Menschenwürde macht aber nicht nur die Notwendigkeit deutlich, die Würde moralphilosophisch ernst zu nehmen, sie eröffnet zugleich eine Chance für ein angemessenes Verständnis. In der 1785 veröffentlichten Grundlegung zur Metaphysik der Sitten formuliert Kant erstmals die Prinzipien einer universalistischen Ethik der Autonomie, deren Einfluß bis heute ungebrochen ist. Schon beim Übergang von der gemeinen zur philosophischen Vernunfterkenntnis findet man die Hauptgedanken: In der Ethik geht es nicht primär um das gute Leben und das Glück, und es geht auch zunächst nicht darum, welche Handlungserfolge erzielt werden; Gegenstand moralischer Hochschätzung sind vielmehr Intentionen und Maximen. Gut ist, was für alle vernünftigen Wesen gilt, weil es (...) von ihnen als autonomen und vernünftigen Wesen gewollt wird. Die Schrift ist kurz, einfach gegliedert und verständlich geschrieben. Sie eignet sich daher als Einführung in Kants Ethik, enthält aber zugleich als Grundlegung alle wesentlichen Gedanken seiner praktischen Philosophie. Auf der Grundlage der Originalausgabe von 1785/86 wurde der Text völlig neu erstellt. Eines der wichtigsten Bücher der Philosophiegeschichte liegt damit in einer zuverlässigen und preisgünstigen Neuausgabe vor. (shrink)

Schopenhauer plädiert in seiner Schrift "Über die Grundlagen der Moral" für einen deskriptiven und nicht für einen präskriptiven moralphilosophischen Ansatz. Trotz seiner Wertschätzung für Kant unterzieht er dessen Ethik einer eingehenden Kritik und ersetzt deren oberstes Prinzip, den kategorischen Imperativ, durch das Gefühl des Mitleids.

The harm principle, understood as the normative requirement that conduct should be criminalized only if it is harmful, has difficulty in dealing with those core cases of criminal wrongdoing that can occur without causing any direct harm. Advocates of the harm principle typically find it implausible to hold that these core cases should not be crimes and so usually seek out some indirect harm that can justify criminalizing the seemingly harmless conduct. But this strategy justifies criminalization of a wide range (...) of conduct on the basis of the fear, worry, and anxiety it generates among those who are not the direct victims of the conduct, and thereby undermines the limiting role of the harm principle by permitting the very move it was meant to prevent: the criminalization of harmless conduct on the ground of others’ feelings about it. The best way to avoid this dilemma is to recognize that people have rights, operating independently of the harm principle, to be treated in certain ways just because they are persons. The existence of such rights provides a ground for both criminalizing conduct and limiting the scope of criminalization because these rights point both to conduct that people must be permitted to engage in and conduct that might well be criminalized. A complete account of criminal law will therefore require the harm principle to work together with an independent account of rights. (shrink)

Dieses Buch ist der Versuch, diese Ansicht näher zu fassen und zu begründen. Das Instrumentalisierungsverbot spielt nicht nur in unserer Alltagsmoral, sondern auch in moraltheoretischen Diskussionen eine wichtige Rolle. Verschiedenste Praktiken werden mit der Begründung als unzulässig kritisiert, dass mit ihnen Menschen instrumentalisiert würden. Doch was heit es, die anderen blo als Mittel zu behandeln? Es besteht, so wird in diesem (...) Buch argumentiert, ein Zusammenhang zwischen unzulässiger Instrumentalisierung und Verletzung der Würde von Personen. In der Explikation des Würdebegriffs wird dieser Zusammenhang entfaltet. Die unzulässige Instrumentalisierung von Personen verletzt in bestimmten Fällen deren Würde, in anderen Fällen Ansprüche, die in der Würde von Personen begründet sind. Die Würde von Personen wird dabei als Anspruch auf Selbstachtung gefasst. Selbstachtung wird nicht im Sinne der Selbstwertschätzung verstanden. Im Blick steht vielmehr ein normatives Verständnis von Selbstachtung, wonach Personen ein Leben in Selbstachtung führen, sofern ihr Selbstverfügungsrecht von anderen und ihnen selbst geachtet wird. Der Anspruch auf Selbstachtung wird als Anspruch darauf begriffen, über wesentliche Bereiche des eigenen Lebens verfügen zu können. Diese Überlegungen zu Würde und Selbstachtung werden moraltheoretisch eingeordnet und abschlieend auf paradigmatische Fälle der praktischen Ethik angewendet, bei denen es um die Instrumentalisierung von Menschen geht. The paper argues for attaching a significant role to the dignity of offenders as a limitation on the scope of substantive criminal law. Three different aspects of human dignity are discussed. Human dignity is closely connected with the principle of culpability. Respecting the dignity of offenders requires that we assign criminal liability according to the actual attitudes of the offenders towards the interests protected by the offence. The doctrine of natural and probable consequence of complicity, which allows us to assign (...) liability for mens rea offenses to a negligent offender, violates the dignity of the offender; it treats the incautious offender as if she had willfully expressed disrespect towards the protected interest. The human dignity core of privacy is invaded by criminalizing the private possession of child pornography. By extending the prohibition of the creation, sale and distribution of child pornography to the private possession of pornography, the State attempts to control the way the individual expresses an essential part of the self—his sexual fantasies—within himself. Dignity demands that our actions convey an attitude of respect towards human beings. The expressive meaning of disrespect is culture-dependent. The historical association with totalitarian regimes explains our reluctance to impose a legal duty to report past crime: the individual who is legally required to turn a suspect into the police is viewed as an “informant.”. That an intimate connection exists between the notion of human dignity and the notion of humiliation seems to be a commonplace among philosophers, who tend to assume that humiliation should be explained in terms of (violation of) human dignity. I believe, however, that this assumption leads to an understanding of humiliation that is too "philosophical" and too detached from psychological reality. The purpose of the paper is to modify the above connection and to offer a more "down to earth" account (...) of humiliation that does not depend on metaphysical or axiological questions concerning the unique dignity enjoyed by all human beings qua human beings. The paper argues for a subjective-psychological notion of self-respect in the explication of humiliation, instead of an objective-normative one. To be humiliated means to suffer an actual threat to or fall in one's self-respect. (shrink)
