Laura Valentini’s novel theory, the Agency-Respect View, says that we have a fundamental moral duty to honor other people’s convictions, at least pro tanto and under certain conditions. I raise doubts that such a duty exists indeed and that informative conditions have been specified. The questions that Valentini faces here have a parallel in Kant’s moral philosophy, viz. the question of why one has a duty to value the other’s humanity and the question of how to specify the maxim of (...) one’s action. Die Simmel-Cassirer-Kontroverse behandelt den grundlegenden technikphilosophischen Gegensatz zwischen Kulturpessimismus und Kulturoptimismus. Diesen virtuellen Dialog beider Denker arbeitet Oliver Honer neu auf und entwickelt in einem aufsteigenden Reflexionsgang die Simmel'sche Rede von der »kulturellen Logik der Objekte« zum Begriff. Damit modelliert er das Verhältnis agierender Individuen zu ihren jeweiligen Möglichkeitsräumen und zeigt deren prekären Subjektstatus in diesen Räumen auf. Die dabei freigelegten Verhältnisse eröffnen angesichts technisch induzierter Eigenlogiken neue Wege einer dialektischen Kulturkritik.

On the currently dominant reading of the Groundwork, Kant’s derivation of ‘imperatives of duty’ exemplifies a decision procedure for the derivation of concrete duties in moral deliberation. However, Kant’s response to an often-misidentified criticism of the Groundwork by G. A. Tittel suggests that Kant was remarkably unconcerned with arguing for the practicality of the categorical imperative as a decision procedure. Instead, I argue that the main aim of Kant’s derivation of imperatives of duty was to show how his analysis of (...) the form of moral judgement is indeed presupposed in the four types of moral imperative that philosophers of his time recognized. Aesthics: Art and moral attuning. Art can help us understand everyday moral deliberation. Better perhaps than ethics. People don’t just act randomly in moral situations nor do they argue internally about which ethical principle to follow before deciding what to do. We built our moral sensitivity whilst living our lives, adhering to aesthetic norms of interaction. Regular engagement with works of art educates our moral sensitivity.

The idea that there is a distinctively practical use of reason, and correspondingly a distinctively practical form of knowledge, unites many otherwise diverse voices in the history of practical philosophy: from Aristotle to Kant, from Rousseau to Marx, from Hegel to G.E.M. Anscombe, and many others. This article develops an objection to Kant’s proof of freedom from the Critique of Practical Reason. In his proof — the fact of reason argument — Kant deduces the reality of freedom, understood as the ability to act independently of all inclinations, from our consciousness of the unconditional validity of morality. He calls this consciousness the "fact of reason". After a systematic reconstruction of the argument, I develop an objection that relies on three points: (i) the cultural embeddedness of human (...) beings ("fact of culture"), (ii) an "external" perspective on human deliberative processes, and (iii) an alternative interpretation of the unconditional validity of morality that appears in practical deliberation. Contrary to Kant’s claims, I argue that the reality of freedom cannot be deductively derived from the fact of reason. I then discuss two objections to my argument. The first objection claims that my considerations regarding the "external" perspective misunderstand Kant's methodology. The second objection states that, based on my considerations, the fact of reason ultimately turns out to be an illusion. I discuss both objections and refute them. My ultimate conclusion is that Kant's fact of reason argument is not convincing. (shrink)

This article is to explore whether the achievement of moral character is the ultimate goal of higher education from a cross cultural approach. To discuss this study logically, three major research questions are addressed. First, what are the concepts of moral, ethics, and character? Second, what is the achievement of moral character from the Eastern and the Western perspectives? Third, what is the role of higher education for the achievement of moral character? To defend these research questions, the author uses (...) a descriptive content analysis method, with a cross cultural approach. In order to explore the questions, the researcher in this study sets several limitations. Moral character is generally limited to the ancient Greek philosophy and Judeo-Christianity as well as to the classical Chinese thought and religion. Specifically, the study is mainly focused on not only Plato's "Republic" and Aristotle's "Nicomachean Ethics," but Confucius' "Analects" and Mencius' "Scripture (The Works of Mengzi)." Additionally, this paper also adjusts the lenses on moral theories, especially moral character, cardinal virtues, social harmony, and the common good. Lastly, higher education is focused on the lenses of Canada and South Korea. The significance of this study is to provide basic theories and valuable resources about moral and character education for educational theorists and practitioners, finding the theories of moral and ethics in the Eastern and the Western thoughts and religions. In this article I discuss the main theses of the realist political philosophy developed in recent years by Raymond Geuss and embodied in his famous Philosophy and Real Politics. Once the motivations behind Geuss’ project identified and its similarities and differences with the other great realistic philosophical-political project of our days, that of Bernard Williams, pointed out, I critically expose Geuss’ theses and his objections to the Kantian and Rawlsian ways of doing political philosophy. Social science research, whether observational or interventional, is confronted with situations where the dignity of participants and respect for cultural practices can be seriously affected. The aim of this article is twofold. Firstly, we will reflect on the ethical challenges facing social science research with special consideration of research in contexts of vulnerability. Secondly, we will propose the Kantian sense of respect as a normative framework to guide social science research.

It is a question of ascertaining, at first, the difficulties that prevented Reinhold from carrying out the long-sought deduction of a free and absolute cause for freedom of will within the framework of elementary philosophy, or in the plan of the faculty of representation in general. In a second moment, I briefly analyze the author's new strategy when trying to carrying out, or at least to deepen, his foundational approach through practical philosophy. These two movements have Kantian philosophy as a (...) background. In fact, Reinhold takes this starting point after analyzing Kant’s work and considering it problematic in some points, mainly the foundation of the effectiveness of freedom in the fact of reason. Haji argues that determinism threatens deontic morality, not via a threat to moral responsibility, but directly, because of the principle that ‘ought’ implies ‘can’. Haji’s argument requires not only that we embrace an ‘ought’ implies ‘can’ principle, but also that we adopt the principle that ‘ought’ implies ‘able not to’. I argue that we have little reason to adopt the latter principle, and examine whether deontic morality might be destroyed on the basis of the more commonly embraced ‘ought’ implies ‘can’ (...) principle alone. I argue that despite what look like initially compelling reasons why we might suppose that this weaker conclusion is similarly destructive to deontic morality, we actually have good reason to doubt that it has any practical relevance for moral deliberation at all. This chapter deals with Thomas Browne’s most famous work, Religio Medici, and especially with his account of Charity. The first paragraph focuses on Browne’s specific account of the relationship between natural and supernatural. This view is inspired by Bacon, Sebunde, and Montaigne, and is crucial to understand the background of Browne’s view about the virtue of Charity. The second paragraph is about Browne’s specific understanding of Charity, which seems to be a middle stage between the traditional, Scholastic doctrine, and the (...) Kantian idea of moral law, independent from the practical law and the desire of the subject. The third paragraph deals with Religio Medici’s reversal of the traditional “order” of Charity, as well as Browne’s accounts of abnegation and friendship as an effective way for a charity to the self which meets many aspects of Foucault’s ἑπιμέλεια έαuτου. In recent literature, it has been suggested that Lange’s social and political philosophy is separate from his neo-Kantian program. Prima facie, this interpretation makes sense given that Lange argues for an account of social norms that builds on Darwin and Smith rather than on Kant. Still, this paper argues that elements of psychophysiological transcendentalism can be found in Lange’s social and political philosophy. A detailed examination of the second edition of the History of Materialism, Schiller’s Poems, and the second edition (...) of The Worker’s Question reveals that Lange sought to develop a systematic foundation of psychophysiological transcendentalism that is presupposed in his social and political philosophy. This allows for a more detailed understanding of Lange’s practical philosophy and assures him a position in the tradition of neo-Kantian socialism. (shrink)

English title: Kant and the Right to Vote The article is a contribution to the ongoing debate in NFT about the moral responsibility of voters. Kristian Skagen Ekeli has argued that politically ignorant citizens have a duty to abstain from voting. He argues that such a duty fol- lows from Kant’s duty to respect other persons. I analyze Ekeli’s proposed duties by considering how they might fit into Kant’s system of duties. I conclude, contra Ekeli, that the Kantian duty to (...) respect persons does not give rise to a duty for politically ignorant voters to abstain from voting. -/- Denne artikkelen er et bidrag til debatten om velgeres moralske ansvar. Kristian Skagen Ekeli har i to artikler argu- mentert for at uvitende borgere har en plikt til ikke å stemme, noe han begrunner ut fra en kantiansk pliktetikk. Do we need a new ethics? And if so: why? Just because Kant's Categorical Imperative (Cat. Imp.) seems to be no longer valid? Are there, nevertheless, values that survive the so-called "decay of values"? And if there are limits of ethics, e.g. in system conditions, one can ask if new legit requests are to be made. Or can ethics even be absorbed (or "abolished") in anthropology and philosophy of history?

In this paper, we propose a conceptual model to improve moral sensitivity in human resource development (HRD) to assist human resource (HR) practitioners in contending with moral challenges in HRD. The literature on the relationship between ethics and HRD suggests that the organizational and employee development discipline deals with ethical issues at three different levels: Individual, organizational and communal, and international levels. In section I, we elaborate on moral challenges facing HRD. In section II, we conceptualize moral sensitive HRD, proposing (...) a conceptual model in virtue of some essential ethical theories and concepts that assist HRD in grappling with those problems. We will show how each theory and concept can help HRD to deal with relevant problems. In section III, we elaborate on practical approaches to implement moral sensitivity in HRD. We put forward some strategies that help HRD bring those theories and concepts to bear on the ethical problems facing this discipline. Finally, we discuss moral education through learning theories to cultivate moral concepts and ethical dimensions in HRD education. (shrink)

In this book some options concerning the greenhouse effect are assessed from a welfarist point of view: business as usual, stabilization of greenhouse gas emissions and reduction by 25% and by 60%. Up to today only economic analyses of such options are available, which monetize welfare losses. Because this is found to be wanting from a moral point of view, the present study welfarizes (among others) monetary losses on the basis of a hedonistic utilitarianism and other, justice incorporating, welfare ethics. (...) For these welfarist evaluations information about the social consequences of the four options are collected from the literature and eventually corrected; then the consequences for individual well-being are assessed based on psychological research about well-being dependent on the social situation of the individual; finally the aggregation formulas of the respective welfare ethics are applied to these data. Assessments by other types of ethics, e.g. Kantian ethic, are included. The strongest abatement option is found to be optimum with great unanimity. - In addition a cost-welfare analysis of greenhouse gas abatement is undertaken revealing efficient cost-welfare ratios for these measures and the most efficient ratio for the strongest option. - A final, more theoretical part discusses the moral obligations following from such evaluations. The notion of 'moral obligation' is explained in a way that, apart from moral goodness of the required act, reinforcement by formal or informal sanctions is another necessary condition for moral obligations. This leads to a conception of a historical morality according to which the demands of morality rise in the long run. Applying this conception to the greenhouse effect implies that presently we have the moral duty to raise the standards of greenhouse gas abatement as much as is politically feasible. (shrink)

Bioethical discourse on organ donation and transplantation medicine covers a wide range of topics, from informed consent procedures and scarcity issues up to transplant tourism and organ trade. Over the past decades, this discourse evolved into a stream of documents of bewildering proportions, encompassing thousands of books, papers, conferences, blogs, consensus meetings, policy reports, media debates and other outlets. Beneath the manifest level of discourse, however, a more latent dimension can be discerned, revolving around issues of embodiment, the moral status (...) of the human body and the concept of bodily integrity. This publication aims to bring these “deeper” questions to the fore. What is envisioned is a “depth” ethics (the moral equivalent of a depth psychology) focussing on the tensions, conflicts and ambiguities at work in bioethical deliberations on organ transplantation, fuelling the viewpoints articulated on the more manifest levels of discourse. Organ donation reopens the question of the status of the body as something which we have, but at the same time are, and as something which constitutes a whole, while at the same time being a set of replaceable elements or parts. Opvallend is echter dat filosofen, wanneer ze toch aandacht schenken aan muziek, hun aandacht bij voorkeur op één bepaald genre richten, namelijk de opera. Filosofen zoals Søren Kierkegaard en Friedrich Nietzsche lieten hun gedachten over Don Giovanni, Parsifal en Carmen gaan, terwijl omgekeerd de filosofie van Arthur Schopenhauer de opera heeft beïnvloed via Wagner. Diens werk lijkt zich op het snijpunt van het grensverkeer tussen moderne filosofie en moderne muziek te bevinden. Het was zijn (...) ambitie de menselijke existentie en de menselijke geschiedenis in één panoramisch oeuvre te vatten, vanaf het primordiale begin tot en met de dramatische finale die ophanden leek: een catastrofale apotheose die een geheel nieuwe toekomst mogelijk zou maken. Dat is althans de verhaallijn van zijn meesterwerk Der Ring des Nibelungen. Aan het slot van Götterdämmerung lijkt zich een algehele verwoesting te hebben voltrokken: ‘Everything is destroyed and there is an enigmatic kind of hovering over the scene of destruction’ (Badiou 2010, p. 106), een ambivalente stemming van hoop en destructie zette Wagner op muziek. Voor Wagner is dan ook een hoofdrol in deze studie weggelegd: voor zijn muziektheoretische geschriften (waarin hij over een ‘muziek van de toekomst’ filosofeerde), maar meer nog voor de muzikale totaalkunstwerken die hij daadwerkelijk componeerde. Human dignity is a stubborn concept, at least for jurists and philosophers. After World War II it found its way immediately into the opening articles of the UN Charta, the Universal Declaration of Human Rights, and the German Grundgesetz, apparently out of the blue, i. e. almost without any precedent in earlier juridical docu- ments. Consequently, scholars of law still have difficulties to formulate an adequate understanding of human dignity. And although the concept has a certain tradition in philosophy, if (...) we search for an independent ethi- cally attractive understanding of human dignity, it turns out that going back to Cicero, Kant or the Christian heritage is of little help, too. Much more promising, though, is a look at the long-standing usage of the expression ‘human dignity’ and its German counterpart Würde des Menschen where something like a universal right not to be humiliated is expressed. Given this understanding, we can read the commandment to respect human dignity as the basic obligation to treat other people in a way that allows them to keep their personal, individual dignities—or at least minimally decent ones. To be sure, this formulation is just a very first, tentative step on the way to a philosophically satisfying conception of human dignity, but in the author’s opinion it is definitely a promising start for a research group. Post-mortem reproduction is a complex and contested matter attracting attention from a diverse group of scholars and resulting in various responses from a range of countries. Vietnam has been reluctant to deal directly with this matter and has, accordingly, permitted post-mortem reproduction implicitly. First, by analysing Vietnam’s post-mortem reproduction cases, this paper reflects on the manner in which Vietnamese authorities have handled each case in the context of the contemporary legal framework, and it reveals the moral questions arising therefrom. The (...) article then offers an account of Vietnamese social norms as an explanation for the tendency to conduct post-mortem reproduction. In arguing that a deeper and more thorough examination of the moral and ethical reasoning is required, the paper advocates in favour of supportive post-mortem reproduction regulation. In doing so, the paper seeks to reconcile the Vietnamese legal framework and post-mortem reproduction experiences of other countries. The article concludes that Vietnam and countries sharing the similar cultural traits should permit post-mortem reproduction explicitly. This would require full engagement with the ethical and legal issues arising, and careful promulgation of regulations and guidelines based on comparative experiences of a range of countries in handling this matter. In ‘Human Fallibility and the Need for Forgiveness’, Claudia Blöser has proposed a Kantian account of our reasons to forgive that situates our moral fallibility as their ultimate ground. Blöser argues that Kant’s duty to be forgiving is grounded on the need to be relieved from the burden of our moral failure, a need that we all have in virtue of our moral fallible nature, regardless of whether or not we have repented. Blöser claims that Kant’s proposal yields a plausible (...) account of the normative status of forgiveness. Kant classifies the duty to be forgiving as a wide duty of virtue, and according to Blöser, this means that Kantian forgiveness is elective in the sense that forgiveness is good in general but without being obligatory in each particular case. In the course of presenting her own reconstruction of Kant’s account, Blöser also objects to some aspects of an interpretation of Kant’s theory of forgiveness which I had previously defended in my paper ‘Forgiveness and Moral Development’. Although there are a lot of points of agreement between our interpretations, the aim of this article is to highlight four key points of disagreement. These issues are worth discussing because they have implications not only for a plausible interpretation of a recognisable Kantian account of forgiveness but also for wider debates in the contemporary literature on forgiveness. First, I show that Kant is not committed to a form of weak situationism as suggested by Blöser and that Kant’s grounding of the duty to be forgiving does not appeal to moral luck. Second, I argue that although Kant’s duty to be forgiving is elective in one sense of the term, it is not elective in another important sense of the term, and that it is in fact better not to interpret Kantian imperfect duties as being elective. Third, I show that awareness of moral fallibility per se does not provide a morally appropriate ground for forgiveness and offer an alternative reconstruction of Kant’s account- in which fallibility plays a role, but it is not the main reason to forgive. Finally, I argue that Blöser’s account of the need to be forgiven is not recognisable Kantian because, from a Kantian perspective, repentance is a necessary condition for the desirability and, in fact, the very possibility of ameliorating our own guilt. This paper treats of Husserl’s phenomenology of happiness or eudaimonia in five parts. In the first part, we argue that phenomenology of happiness is an important albeit relatively neglected area of research, and we show that Husserl engages in it. In the second part, we examine the relationship between phenomenological ethics and virtue ethics. In the third part, we identify and clarify essential aspects of Husserl’s phenomenology of happiness, namely, the nature of the question concerning happiness and the possibility of (...) a phenomenological answer, the power of the will, the role of vocation, the place of obligation, the significance of habituation, the necessity of selfreflection and self-criticism, the importance of sociability and solidarity, the impact of chance and destiny, and the specter of regret. In the fourth part, we establish the inextricable linkage between Husserl’s metaethics and his metaphysics. In the fi ft h part, we provide a provisional exploration of his conception of the connection between happiness and blessedness. We acknowledge that there is an extensive literature on Husserl’s phenomenological ethics, and our study has benefitted greatly from it, but we also suggest that our holistic approach critically clarifies his description of happiness, virtue, and blessedness by fully recognizing that his phenomenological metaethics is embedded in his phenomenological metaphysics. In diesem Aufsatz wird die bislang kaum beachtete frühe Moralphilosophie von Max Horkheimer aus den 1930er Jahren in ein produktives Spannungsverhältnis zu den Grundannahmen des ethischen Naturalismus gesetzt. Horkheimer versteht die Moral als ein normatives Instrument, mit dem die menschliche Gattung ihr gesellschaftliches Leben zu organisieren versucht. Die natürliche Normativität der menschlichen Lebensform ist für Horkheimer selbst historisch bestimmt, als die menschliche Lebensform sich notwendig nur historisch realisieren kann. In der bürgerlichen Gesellschaft ist diese Normativität nach Horkheimer widersprüchlich verfasst: Einerseits (...) sollen die Menschen moralischen Normen und nicht allein ihren eigenen Interessen folgen, andererseits erfordert die bürgerliche Gesellschaft gerade das rücksichtslose Verfolgen eigener Interessen, da sonst die Selbsterhaltung der Menschen gefährdet würde. Die Auswirkungen dieser Widersprüchlichkeit werden hier anhand von drei Aspekten untersucht: die Opazität und Naturhaftigkeit der bürgerlichen Gesellschaft, das Leiden der menschlichen Natur, Geschichte als Anpassungsprozess der menschlichen Natur. Abschließend wird Horkheimers Ansatz hinsichtlich seiner theoretischen Reichweite in den moralphilosophischen Diskussionen der gegenwärtigen Kritischen Theorie verortet. (shrink)

Despite how revered Socrates is among many educators nowadays, he can seem in the end to be a poor model for them, particularly because of how often he refutes his interlocutors and poses leading questions. As critics have noted, refuting people can turn them away from inquiry instead of drawing them in, and being too directive with them can squelch independent thought. I contend, though, that Socrates' practices are more defensible than they often look: although there are risks in refuting (...) people and posing leading questions, Socrates has sensible ways of minimizing the risks, ways that are feasible even for teachers nowadays, and there are times when the risks are worth taking. I illustrate my point by discussing Plato's _Meno_. (shrink)

We investigate how social comparison processes in leader treatment quality impact group members’ self-worth, affect, and behavior. Evidences from the field and the laboratory suggest that employees who are treated kinder and more considerate than their fellow group members experience more self-worth and positive affect. Moreover, the greater positive self-implications of preferentially treated group members motivate them more strongly to comply with norms and to engage in tasks that benefit the group. These findings suggest that leaders face an ethical trade-off (...) between satisfying the moral standard of treating everybody equally well and satisfying individual group members’ desire to be treated better than others. Moral purism is a commonly held view on moral worthiness and how to identify it in concrete cases. Moral purists long for a moral world in which (business) people—at least sometimes—act morally worthy, but in concrete cases they systematically discount good deeds as grounded in self-interest. Moral purism evokes moral cynicism. Moral cynicism is a problem, both in society at large and the business world. Moral cynicism can be fought by refuting moral purism. This article takes issue with moral purism. (...) The common strategy to tackle moral purism is to reject the exclusion thesis which states that self-interest and the ‘pure’ moral motive (and thus moral worthiness) exclude each other. We develop a different strategy. We argue that moral purists are mistaken in the way they judge moral worthiness in concrete cases. They employ the wrongprocedureand the wrongcriteria.We develop a proper procedure and proper criteria. We build on Kant, who we argue is unfairly regarded as the champion of moral purism. In order to see how Kant can develop a consistent (non-purist) philosophy, the exclusion thesis must be embedded in Kant’s transcendental philosophy. Properly embedded, Kant turns out to be both anti-purist and anti-cynical. (shrink)

The well-known Kantian passage on misology in the Foundations of the Metaphysics of Morals starts making fuller sense when located within the framework of Kant writings on philosophy of history where he contrasts civilization with moralization as two different phases in the growth of humankind. In this context, the growth of commerce and manufactures plays a distinctive role, namely that of means of fostering civilization, while pursuing a deceptive goal, namely happiness. Deception plays a basic role in the growth of (...) mankind, in so far as it allows for a hidden twofold teleology in human action. Men, while following the dictates of self-love, are systematically mistaken about the results they actually contribute in bringing about. Commerce brings different peoples into mutual relationship and thus paves the way to a cosmopolitan society. The growth of the arts and sciences provides preconditions for the growth of learned institutions, a free press, and a public opinion that are the basis on which reason may start being used in its critical capacities. This, that is Enlightenment, is a preliminary step to moralization, that is the jump of individuals from a state of minority to a state where they are masters of themselves. The twofold teleology of human action makes room for a system of "pragmatic" ends, and of laws connected to the former, that may be studied rationally in themselves and yet are connected to the higher ends established by reason in its "practical" capacities. There is a fundamental incompatibility between a developmental orientation to education and instrumental and scientistic conceptions of rationality that dominate educational inquiry. An expanded conception of rationality is provided in the critical theory of Jurgen Habermas. This study draws on Habermas' work to present a theory of inquiry that is consistent with a developmental perspective. I distinguish three interdependent realms of experience--the objective world of nature, the intersubjective world of society and the subjective world of each individual. Then, I argue (...) that current conceptions of rationality tend to reduce personal and interpersonal experience to the objective material realm. Under prevailing conceptions, human action is rational when it pursues valued ends guided by knowledge about the world and effective means-ends relationships. Both theories of knowledge and theories of value in these conceptions are inadequate for a developmental orientation. -/- First, knowledge is defined as justified true belief. Theories of truth are based on the correspondence of beliefs with an external world; theories of justification are based on perceptual certainty. These conceptions objectify experience by making experience an object of natural science and instrumental action separate from and external to the person. Such conceptions reduce experience to the objective material dimension and cannot adequately account for the personal and interpersonal dimensions of human experience and understanding. -/- Second, because value claims are not capable of justification by these standards, they are considered ultimately irrational and treated as subjectively held empirical properties of individuals. The only standard of rationality is efficiency and economy in the selection of means. Ethics is reduced to empirical science. But the removal of practical questions from public discourse divests action of ethical significance. With its strict separation of descriptive and normative domains, empirical-analytic inquiry can neither acknowledge its standard of instrumental efficiency nor reach into the practical arena to guide the selection of values and ends that orient and gude human action. Practical questions that cannot be framed in terms of technical problems cannot be taken seriously. -/- Whereas these conceptions of rationality are generally derived from theories of experienced based on individual consciousness, Habermas looks to language for a more adequate account of the intersubjective nature of experience. This account provides an expanded conception of rationality with theories for justifying beliefs and actions that incorporate the personal and interpersonal dimensions of experience so critical to a developmental perspective. Through an analysis of the universal pragmatic structure of language directed to the resolution of problematic truth claims and moral claims, this study presents a consensus theory of truth (for a more adequate theory of knowledge) and a communicative theory of ethics (based on a more adequate theory of human values). -/- The concept of truth refers to a universal pragmatic convention of the unforced agreement of an ideal community of inquirers. Ethical conduct is guided by norms that reflect a rational general will and that regulate genuine human needs. Problematic truth claims and moral claims are discursively justified by the force of the better argument under the conditions of an anticipated "ideal speech situation" inherent in the very structure of communication. Furthermore, a theory of inquiry is developed in which inquiry processes are represented as historically evolved extensions of developmental process in the three realms of experience. Three interrelated forms of inquiry are derived--empirical-analytic, hermeneutic and critical. I derive each from its respective experiential realm, and indicate the logic of inquiry, object domain, and kind of knowledge gained from each. -/- An exploration of the relationship between inquiry and development provides a foundation for a developmental orientation to education. Finally, the theory is contrasted with prevailing inquiry approaches in education and illustrated with an application to a particular educational problem. (shrink)

According to many criteria, agency, intentionality, responsibility and freedom of decision, require conscious decisions. Freud already assumed that many of our decisions are influenced by dynamically unconscious motives or that we even perform unconscious actions based on completely unconscious considerations. Such actions might not be intentional, and perhaps not even actions in the narrow sense, we would not be responsible for them and freedom of decision would be missing. Recent psychological and neurophysiological research has added to this a number of (...) phenomena (the "new unconscious") in which behavior is completely unconscious or in which the decision or its execution is influenced by unconscious factors: priming, automatic behavior, habitualized behavior, actions based on plain unconscious deliberations, intrusion of information from the dorsal pathway, etc. However, since this makes up the largest part of the behavior which is generally regarded as action, intentionality, yet agency, responsibility and even compatibilist freedom of decision for the largest part of our behavior may be threatened. Such considerations have led to a lively debate, which, however, suffers from generalizations that lump all these unconscious phenomena together. In contrast, the aim of this article is to discuss individual unconscious influences on our behavior separately with respect to what extent they require changes in traditional conceptualizations. The first part (2-4) of the article outlines the "traditions" and their elaborations: the intentional causalist concept of action, an associated empirical theory of action and standard concepts of responsibility and compatibilist freedom of decision, as well as the challenges for them. In the second part (5-9), the aforementioned unconscious influences on our actions (except for automated and habitualized actions, which I discuss elsewhere) are examined: 1. unconscious priming, 2. dynamically unconscious motives, 3. dorsal pathway information influencing conscious decisions, 4. unconsciously altered execution of conscious intentions, 5. unconscious deliberations and decisions. To what extent do these phenomena C1. require a change in the concept of action, C2. curtail intentionality or agency, C3. responsibility and C4. freedom? The result is: The curtailments prove to be far less dramatic than they initially appear; they require more watchfulness but no conceptual change. (shrink)

In this paper we want to focus on Husserl’s critique of Kantian ethics and to develop the following questions. Against the merely empiristic orientation of Hume’s ethics, the Kantian foundation of ethics has an aprioristic character; but does this aprioristic character have to be identified with the origin of ethical principles in the pure subjectivity, and if not, which is its phenomenological signification? The sense of the Copernican revolution is that the structures of the objects are in accordance with the (...) universal structures of the finite subject; a contrario, Husserl refuses this Copernican principle and assumes that every sort of object determines a regulative structure in the subject; is it possible to apply this anticopernican principle to the ethical sphere? As opposed to the Kantian principle of the supremacy of practical reason, we find in Husserl’s thought a supremacy of the theoretical reason; but which is the sense of this inversion? The concept of foundation has in Husserlian phenomenology a cardinal importance: all sorts of truth of superior degree are founded on the inferior level of sensible truth; is it possible to apply this principle of foundation to the ethical sphere, so that ethical consciousness would be founded on feelings? At last the Kantian concept of liberty is not an empirical one, but a cosmological and practical idea; which is the phenomenological sense of liberty? (shrink)

As part of our exploration of a new conceptual framework for an economy that works for 100% of humanity, this conceptual paper asks why all talk about the purpose of organizations seems to suffer from a certain bias, namely the bias of scarcity, and how this myth of scarcity influences our understanding of corporate responsibility. The mainstream understanding of corporate purpose always contains partly normative and partly functional aspects designed to cope with the purported problem of scarcity. According to economic (...) and CSR reasoning, this bias concerning the purpose of business organizations triggers two quite distinct understandings of the essence of corporate responsibility. The economic view interprets it as responsibility towards the company, while CSR and business ethics argue that it reflects, or at least ought to reflect, a broader responsibility towards society. To overcome this responsibility gap, we need to affect a paradigm shift in economic reasoning, a shift which reconciles economic responsibility on the micro-level logic of raising profit with the greater demands of the meso, macro, and supra levels. Only then do we obtain a truly meaningful lever for changing real-world business practice from within the micro-logics of running a corporation. This paradigm shift requires a different mental model - a model of resource growth and natural abundance, rather than of scarcity - on the part of both economists and business ethicists. It can be labeled the economic model of future viability. This paper develops a conceptual argument for a future viable model of business practice which, first and foremost, takes seriously the need for the kind of micro-level decision-making which keeps individual organizations afloat, but which also, and crucially, delivers a solution for future viable business models and business behavior which breaks the apparent downward spiral of modern wealth creation, i.e. the spiral of continuous acceleration, disruption, concentration and resource exploitation, and which, thirdly, delivers a proper definition of purpose which can be applied in measurement systems which are free of biased assumptions of scarcity. Metaethical constructivism is the view that insofar as there are normative truths, they are not fixed by normative facts that are independent of what rational agents would agree to under some specified conditions of choice. The appeal of this view lies in the promise to explain how normative truths are objective and independent of our actual judgments, while also binding and authoritative for us. -/- Constructivism comes in several varieties, some of which claim a place within metaethics while others claim (...) no place within it at all. In fact, constructivism is sometimes defended as a normative theory about the justification of moral principles. Normative constructivism is the view that the moral principles we ought to accept are the ones that agents would agree to or endorse were they to engage in a hypothetical or idealized process of rational deliberation. -/- Metaethical constructivist theories aim to account for the nature of normative truths and practical reasons. They bear a problematic relation to traditional classifications of metaethical theories. In particular, there are disagreements about how to situate constructivism in the realism/antirealism debate. These disagreements are rooted in further differences about the definition of metaethics, the relation between normative and metaethical claims, and the purported methods pertinent and specific to metaethical inquiry. The question of how to classify metaethical constructivism will be addressed in what follows by focusing on the distinctive questions that constructivist theories have been designed to answer. Section 1 explains the origin and motivation of constructivism. Sections 2–4 examine the main varieties of metaethical constructivism. Section 5 illustrates related constructivist views, some of which are not proposed as metaethical accounts of all normative truths, but only of moral truths. Sections 6 and 7 review several debates about the problems, promise and prospects of metaethical constructivism. (shrink)

Research conducted on Brain-Computer Interfaces has grown considerably during the last decades. With the help of BCIs, users can gain a wide range of functions. Our aim in this paper is to analyze the impact of BCIs on autonomy. To this end, we introduce three abilities that most accounts of autonomy take to be essential: the ability to use information and knowledge to produce reasons; the ability to ensure that intended actions are effectively realized ; and the ability to enact (...) intentions within concrete relationships and contexts. We then consider the impact of BCI technology on each of these abilities. Although on first glance, BCIs solely enhance self-determination because they restore or improve abilities, we will show that there are other positive, but also negative impacts on user autonomy, which require further philosophical and ethical discussions. The question of whether AI systems such as robots can or should be afforded moral agency or patiency is not one amenable either to discovery or simple reasoning, because we as societies constantly reconstruct our artefacts, including our ethical systems. Consequently, the place of AI systems in society is a matter of normative, not descriptive ethics. Here I start from a functionalist assumption, that ethics is the set of behaviour that maintains a society. This assumption allows me to exploit the (...) theoretical biology of sociality and autonomy to explain our moral intuitions. From this grounding I extend to consider possible ethics for maintaining either human- or of artefact-centred societies. I conclude that while constructing AI systems as either moral agents or patients is possible, neither is desirable. In particular, I argue that we are unlikely to construct a coherent ethics in which it it is ethical to afford AI moral subjectivity. We are therefore obliged not to build AI we are obliged to. The double subjectivity of conscience and the need to test conscientious objections -/- Abstract In spite of the collapse of the traditional objective concept of conscience and the subsequent subjectivation of conscience, conscientious objections are still often considered as a valid ground for exemption from legal and professional obligations. Conscientious objections are seen as more serious than ordinary moral objections. It is not evident why this is so. I argue, with Niklas Luhmann, that the function of conscience is to protect (...) the moral core of a person’s identity. Overruling conscientious objections threatens this core. Claims of conscience are usually founded on the right of freedom of conscience. This right is not absolute. I discuss the view of Richard Arneson who rejects the right of freedom of conscience and defends the right against conscience. I agree with Arneson that, at the one hand, conscientious objectors may constitute a threat to the social and legal order when their objections are not recognised and, at the other hand, too easy giving in to conscientious objections may also threaten the viability of social and legal order. That is why it is needed to determine when conscientious objections cannot be taken at face value, but should be subjected to a series of tests. The aim of these tests is to contain the number of objectors. I discuss 6 criteria for determining whether conscientious objections ground an exemption to legal and professional obligations. At the end of the article I discuss the conscientious objections of medical doctors. (shrink)

Ideal agents are role models whose perfection in some normative domain we try to approximate. But which form should this striving take? It is well known that following ideal rules of practical reasoning can have disastrous results for non-ideal agents. Yet, this issue has not been explored with respect to rules of theoretical reasoning. I show how we can extend Bayesian models of ideally rational agents in order to pose and answer the question of whether non-ideal agents should form new (...) degrees of belief in the same way as their ideal counterparts. I demonstrate that the epistemic and the practical case are parallel: following ideal rules does not always lead to optimal outcomes for non-ideal agents. (shrink)

Based on the dispute between Protagoras and Socrates on the origin of ethics, one can ask the question of whether the principle of ethics is reason orfeeling/emotion, or whether ethics is grounded on reason or feeling/emotion. The development of Kant’s thoughts on ethics shows the tension between reason and feeling/emotion. In Kant’s final critical ethics, he held to a principle of “rational a priori.” On the one hand, this is presented as the rational a priori principle being the binding principle (...) of judgment. On the other hand, it is presented as the doctrine of “rational fact” as the ultimate argument of his ethics. Husserl believed that Kant’s doctrine of a rational a priori totally disregarded the a priori essential laws of feeling. Like Husserl, Scheler criticized Kant’s doctrine of a rational a priori, and therefore developed his own theory of an “emotional a priori”. Both of them focused their critiques on the grounding level of ethics. Scheler, however, did not follow Husserl all the way, but criticized him and reflected on his thoughts. At last, he revealed the primary status of a phenomenological material ethics of value. (shrink)

Hans-Georg Gadamer é reconhecido como um dos mais importantes filósofos do famoso linguistic turn. Malgrado a aparente recepção de seus debates filosóficos no campo da hermenêutica jurídica e, mais recentemente, da ética do direito, o seu conceito de direito ou, mais precisamente, os fundamentos de uma possível filosofia do direito gadameriana nunca foram submetidos a uma investigação jusfilosófica mais detalhada. Em parte porque a maioria dos comentadores da obra de Gadamer continua a ler seus escritos com uma forte referência às (...) categorias ontológicas da sua obra magna, Verdade e Método. Neste ensaio, entretanto, propõe-se o estudo de alguns conceitos fundamentais da obra de Gadamer, em especial, os desenvolvidos em seus escritos posteriores, a fim de proporcionar uma visão mais adequada acerca dos fins, estrutura e fundamentos da sua ideia de direito. A tese principal deste estudo consiste em apresentar uma das possíveis interpretações do conceito aristotélico de phronesis como a principal fonte da contribuição de Gadamer para a filosofia prática e, por conseguinte, para o direito. Como consequência, será possível esclarecer, de forma não ontológica, os pontos básicos do projeto ético proposto por Gadamer e a fricção praxis-theoria presente no seu conceito de direito. (shrink)

Obgleich die Ausdrücke ‚moralische Pflicht’ und ‚moralische Verantwortung’ auf den ersten Blick nahezu austauschbar scheinen, ist in einigen Debatten dennoch fast ausschließlich von moralischer Verantwortung die Rede. Dies gilt insbesondere für die moralische Beurteilung von individuellen Handlungen in kollektiven Kontexten. Hier scheint die Rede von einer ‚kollektiven Verantwortung‘ besonders attraktiv zu sein. In diesem Aufsatz setze ich mich diesem Trend entgegen und argumentiere dafür, dem Pflichtbegriff in kollektiven Kontexten gegenüber dem Begriff der Verantwortung den Vorrang zu geben. Mein Fokus liegt (...) hierbei auf einer bestimmten Art von Handlungen in kollektiven Kontexten, nämlich auf Handlungen in sogenannten Aggregatkollektiven. Von Aggregatkollektiven verursachte Schäden sind häufig kumulative Schäden, bei denen die Handlungen der Mitglieder eines Aggregatkollektivs einzeln betrachtet keinen merklichen Unterschied für das Auftreten des Schadens machen. Die Rede von Verantwortung legt ein Haftbarkeitsmodell moralischer Verantwortung nahe, welches sich in Bezug auf Handlungen in Aggregatkollektiven als problematisch erweist. Ich zeige, dass Kants Konzeption unvollkommener Pflichten eine vielversprechende Alternative zu dem kausal gefärbten Begriff der moralischen Verantwortung darstellt. Durch den Spielraum, den unvollkommene Pflichten Akteuren lassen, bieten sie eine ähnliche Offenheit wie der Begriff der moralischen Verantwortung. Anders als die Zuschreibung von Verantwortung vermeidet die Rede von unvollkommenen Pflichten jedoch die in kollektiven Kontexten oft inadäquate und kontraproduktive Assoziation von Haftung und Schuld. Im diesem Aufsatz nehme ich die Popularität des Verantwortungsbegriffs in der Alltagssprache zum Anlass, um seinem Verhältnis zum Pflichtbegriff auf den Grund zu gehen. Dabei unterziehe ich den Verantwortungsbegriff zunächst einer allgemeinen Analyse. Anschließend diskutiere ich in Gestalt von Indeterminismus, Amoralismus und Interaktionismus drei Modi der missbräuchlichen Verwendung dieses Begriffs. Dabei handelt es sich jedoch bei genauerer Betrachtung um allgemeine rhetorische Verschleierungsstrategien, die nicht an die Verwendung des Verantwortungsbegriffs gebunden sind, sondern in der kommunikativen Bezugnahme auf moralische Forderungen generell auftreten (...) können. Dies verdeutlicht auch die anschließende Analyse des Pflichtbegriffs, der einige grundlegende Ähnlichkeiten zum Verantwortungsbegriff aufweist. Ex negativo zeigt sich so jedoch, wie ein nicht missbräuchlicher Rekurs auf beide philosophischen Grundbegriffe möglich ist. Darüber hinaus werden auch die Unterschiede dieser Termini deutlich. Der Pflichtbegriff ist trotz einiger wesentlicher Gemeinsamkeiten weniger vielseitig als der Verantwortungsbegriff und daher zumindest in der Auseinandersetzung mit einigen Themen der praktischen Philosophie weniger gut als Grundbegriff geeignet. Gleichwohl zeigt sich, dass die Frage „Verantwortung oder Pflicht?“ uns vor eine falsche Alternative stellt, wenn sie im ausschließenden Sinn verstanden wird. (shrink)

Traditionelle Personenbegriffe der abendländischen Philosophie rekurrieren oft auf rationale Fähigkeiten wie Vernunft- bzw. Moralfähigkeit oder reflexives Selbstbewusstsein als Grundlage von individuellem moralischem Status bzw. der korrelierenden moralischen Verpflichtung. Dem steht die Erfahrung besonderer moralischer Verpflichtungen etwa gegenüber Kindern, Menschen mit besonderen Bedürfnissen oder Tieren entgegen, die durch ratiozentristische Engführungen aus dem Blick zu geraten drohen. Die gegenwärtigen Diskurse um die Begriffe der Vulnerabilität und Anerkennung sind deshalb eine wichtige Ergänzung, um einerseits die Selektivität klassischer moralphilosophischer Konzeptionen zu mindern, indem sie (...) auf eine universal geteilte Bedürftigkeit statt auf Kompetenzen als Anker der Moralität hinweisen, sowie andererseits auch positive Fürsorgepflichten für angewiesene Wesen zu begründen. Allerdings bedarf diese Ergänzung, wie argumentiert wird, ihrerseits einer Erweiterung, weil sie erstens von der kontingenten Anerkennung der Vulnerabilität in einem jeweiligen Ethos abhängt, ohne selbst hinreichende normative Kriterien an die Hand zu geben, zweitens von geteilten, jedoch nicht singulären Ansprüchen und Bedürfnissen ausgeht und drittens den Motivationsgrund der Verpflichtung nicht klärt, weil sie von Allokationsstrukturen und nicht von konkreten Begegnungen ausgeht. Eine Korrektur von der Phänomenologie der Leiblichkeit her, deren Implikationen für moraltheoretische Fragestellungen in den folgenden Ausführungen skizziert werden, scheint daher angezeigt. Forgiveness is clearly an important aspect of our moral lives, yet surprisingly Kant, one of the most important authors in the history of Western ethics, seems to have very little to say about it. Some authors explain this omission by noting that forgiveness sits uncomfortably in Kant’s moral thought: forgiveness seems to have an ineluctably ‘elective’ aspect which makes it to a certain extent arbitrary; thus it stands in tension with Kant’s claim that agents are autonomous beings, capable of determining (...) their own moral status through rational reflection and choice. Other authors recognise that forgiveness plays a role in Kant’s philosophy but fail to appreciate the nature of this duty and misrepresent the Kantian argument in support of it. This paper argues that there is space in Kant’s philosophy for a genuine theory of forgiveness and hopes to lay the grounds for a correct interpretation of this theory. I argue that from a Kantian perspective, forgiveness is not ‘elective’ but, at least in some cases, morally required. I claim that, for Kant, we have an imperfect duty of virtue to forgive repentant wrongdoers that have embarked on a project of self-reflection and self-reform. I develop a novel argument in support of this duty by drawing on Kant’s theory of rational agency, the thesis of radical evil, Kant’s theory of moral development, and the formula of humanity. However, it must be noted that this is a conditional duty and Kant’s position also entails that absence of repentance on the part of the wrongdoer should be taken as evidence of a lack of commitment to a project of self-reflection and self-reform. In such cases, Kant claims, we have a perfect duty to ourselves not to forgive unrepentant wrongdoers. I argue that this duty should be understood as one of the duties of self-esteem, which involves the duty to respect and recognise our own dignity as rational beings. (shrink)
