In this paper, I want to look at some questions that arise when we try to abandon the conceptual and political framework of the nation-state. Is it impossible to conceive the unity of the state apart from the unity of the nation? Are shared political values insufficient to account for the existence of bounded states and special duties to one's own country? In the first section I will discuss the view that the idea of the modern state is incoherent and (...) that it tacitly relies on the social idea of membership provided by the nation. The following section will give an alternative to the nationalist account of the exist ence of bounded communities and suggest why Habermasians and Rawlsians are right in thinking that the shared value of justice can be sufficient for political unity. Finally, I give a brief indication of the rel evance of this discussion to the idea of European Union. These essays by eminent European intellectual and cultural historian Anson Rabinbach address the writings of key figures in twentieth-century German philosophy. Rabinbach explores their ideas in relation to the two world wars and the horrors facing Europe at that time. Analyzing the work of Benjamin and Bloch, he suggests their indebtedness to the traditions of Jewish messianism. In a discussion of Hugo Ball's little-known _Critique of the German Intelligentsia_, Rabinbach reveals the curious intellectual career of the Dadaist and antiwar activist (...) turned-nationalist and anti-Semite. His examination of Heidegger's "Letter on Humanism" and Jaspers's _The Question of German Guilt_ illuminates the complex and often obscure political referents of these texts. Turning to Horkheimer and Adorno's _Dialectic of Enlightenment_, Rabinbach offers an arresting new interpretation of this central text of the critical theory of the Frankfurt School. After drawing a distinction between a cosmopolitan attitude and institutional cosmopolitanism, this paper reconstructs Habermas’s account of the relationship between morality and law in order to argue that this account can be the basis of a cosmopolitan attitude which, although insufficient, on its own, to ground cosmopolitan institutions, can, nonetheless, motivate interest in institutional cosmopolitanism. The paper then examines Habermas’s proposal for institutionalizing a system of cosmopolitan governance. It distinguishes and explores the reach and limitations of three arguments in favor (...) of institutional cosmopolitanism not always adequately differentiated in Habermas’s work: (a) an argument from the weakness of the nation state, (b) an argument from the democratic deficit of nationalism, and (c) an argument from the state’s incapacity to guarantee human rights.
