This chapter outlines the main ideas of my book National responsibility and global justice. It begins with two widely held but conflicting intuitions about what global justice might mean on the one hand, and what it means to be a member of a national community on the other. The first intuition tells us that global inequalities of the magnitude that currently exist are radically unjust, while the second intuition tells us that inequalities are both unavoidable and fair once national responsibility (...) is allowed to operate. This conflict might be resolved either by adopting a cosmopolitan theory of justice (which leaves no room for national responsibility) or by adopting a ‘political’ theory of justice (which denies that questions of distributive justice can arise beyond the walls of the sovereign state). Since neither resolution is satisfactory, the chapter defends the idea of national responsibility and proposes a new theory of global justice, whose main elements are the protection of basic human rights worldwide, and fair terms of interaction between independent political communities. As Jennifer Pitts shows in A Turn to Empire, Adam Smith, Edmund Burke, and Jeremy Bentham were among many at the start of this period to criticize European empires as unjust as well as politically and economically disastrous for the conquering nations. By the mid-nineteenth century, however, the most prominent British and French liberal thinkers, including John Stuart Mill (...) and Alexis de Tocqueville, vigorously supported the conquest of non-European peoples. Pitts explains that this reflected a rise in civilizational self-confidence, as theories of human progress became more triumphalist, less nuanced, and less tolerant of cultural difference. At the same time, imperial expansion abroad came to be seen as a political project that might assist the emergence of stable liberal democracies within Europe. Pitts shows that liberal thinkers usually celebrated for respecting not only human equality and liberty but also pluralism supported an inegalitarian and decidedly nonhumanitarian international politics. Yet such moments represent not a necessary feature of liberal thought but a striking departure from views shared by precisely those late-eighteenth-century thinkers whom Mill and Tocqueville saw as their forebears. Fluently written, A Turn to Empire offers a novel assessment of modern political thought and international justice, and an illuminating perspective on continuing debates over empire, intervention, and liberal political commitments. A central theme throughout Thomas Pogge's pathbreakingWorld Poverty and Human Rightsis that the global political and economic orderharmspeople in developing countries, and that our duty toward the global poor is therefore not to assist them but torectify injustice. But does the global orderharmthe poor? I argue elsewhere that there is a sense in which this is indeed so, at least if a certain empirical thesis is accepted. In this essay, however, I seek to show that the global order not only (...) does not harm the poor but can plausibly be credited with the considerable improvements in human well-being that have been achieved over the last 200 years. Much of what Pogge says about our duties toward developing countries is therefore false. (shrink)

Abstract:While self-determination is a cardinal principle of international law, its meaning is often obscure. Yet international law clearly recognizes decolonization as a central application of the principle. Most ordinary people also agree that the liberation of colonial peoples was a moral triumph. This essay examines three philosophical theories of self-determination’s value, and asks which one best captures the reasons why decolonization was morally required. The instrumentalist theory holds that decolonization was required because subject peoples were unjustly governed, the democratic view (...) holds that decolonization was required because subject peoples lacked democratic representation, and the associative view holds that decolonization was required because subject peoples were unable to affirm the political institutions their colonial rulers imposed on them. I argue that the associative view is superior to competing accounts, because it better reflects individuals’ “maker” interests in participating in shared political projects that they value. The essay further shows that if we accept the associative view, self-determination is not a sui generis value that applies to decolonization alone. Ultimately, our intuitions about decolonization can be justified only by invoking an interest on the part of persistently alienated groups in redrawing political boundaries. The same interest may justify self-determination in additional cases, such as autonomy for indigenous peoples, or greater independence for Scotland or Quebec. (shrink)

This chapter offers a conceptual analysis of territory, distinguishes it from property accounts, and discusses different versions of property accounts, all derived from Locke’s ‘Second Treatise of Government’. It offers a conceptual analysis of territory and the various rights associated with territory. According to Locke, territorial right is established through the subjection, by free consent, of persons and their land to state authority. This theory is found to rest on a number of flawed assumptions, among them claims to natural rights (...) of property and an obvious link between private property and territorial jurisdiction. Cara Nine draws on Lockean principles to claim that a state is a collective that, like individuals, owns property, namely the territory of the state. After examining the historical antecedents of such ideas, the chapter points away from them and towards accounts of territory based on individual and collective claims of rights. (shrink)

A range of important ethical issues emerges from a consideration of the past interaction between colonizing and colonized peoples. This article first seeks to describe the key characteristics of colonialism as a system of domination and subjugation, before considering the legitimacy of contemporary judgments on the morality of historical colonialism. It then examines how the particular character of colonialism complicates arguments relating to the rectification of injustice. It concludes by asking what lessons those interested in ethics can learn from the (...) diverse body of work produced by writers in the postcolonial tradition. (shrink)

This chapter examines two basic philosophical challenges for the idea of reparations for past injustices (using colonialism as the focal point). The first challenge is that requiring people today to make reparations for an injustice they themselves did not commit is unfair. The second is that if reparative claims are invoked because of lingering injustices, then recalling the past is in fact normatively redundant if lingering present injustices can be handled by forward-looking principles. In response to the first challenge, I (...) argue that the unfairness worry is deflected if we adopt a collectivist-model of responsibility, ie, one that holds states instead of individuals to be the responsible actor. Against the redundancy objection, I suggest that reparative arguments can supplement and reinforce forward-looking distributive principles. (shrink)

Recent scholarship on John Stuart Mill has illuminated his arguments about the normative legitimacy of imperial rule. However, it has tended to ignore or downplay his extensive writings on settler colonialism: the attempt to create permanent "civilized" communities, mainly in North America and the South Pacific. Mill defended colonization throughout his life, although his arguments about its character and justification shifted over time. While initially he regarded it as a solution to the "social problem" in Britain, he increasingly came to (...) argue that its legitimacy resided in the universal benefits—civilization, peace, and prosperity—it generated for humanity. In the final years of his life Mill seemed to lose faith in the project. Finally recognizing the prevalence of colonial violence and the difficulty of realizing his grand ambitions, yet refusing to give up on colonization altogether, his colonial romance gave way to a form of melancholia. This article addresses the claim that some contemporary states may possess obligations to pay reparations as a result of the lasting effects of a particular form of historic imperialism: colonialism. Claims about the harms and benefits caused by colonialism must make some kind of comparison between the world as it currently is, and a counterfactual state where the injustice which characterised so much of historic interaction between colonisers and the colonised did not occur. Rather than imagining a world a world (...) where there was no such interaction, this article maintains that the appropriate counterfactual is one where relations between different communities were characterized by an absence of domination and exploitation. This means that current day states may possess reparative duties which are much more extensive than is often supposed. (shrink)

The subject of empire has emerged as a central concern in political theory. Edmund Burke and John Stuart Mill have been at the center of much recent scholarship on this topic. A number of depictions of Burke as a critic and Mill as a defender of empire rely largely on their writings about India. This article focuses instead on Burke and Mill's writings on the West Indies and America from the standpoint of both thinkers' connection to Scottish Enlightenment historiography. It (...) argues that Burke 's embrace of the notion of a civilizing process helps explain his dismissive treatment of Africans and Indians in the Americans and makes it clear that he was no simple defender of cultural pluralism and difference. Conversely, it argues that Mill's essay, "The Negro Question," and his public criticism of martial law in Jamaica suggest his doubts about the civilizing effect of British rule. By re-examining their writings from this particular geographical and theoretical perspective, the article challenges the new scholarly orthodoxy surrounding Burke 's and Mill's views of the imperial project. The world in which we live is largely the product of the rise, competition, and fall of empires. This chapter examines European, and principally British, ideologies of imperialism during the last two hundred years. The chapter starts by distinguishing between imperial imaginaries, ideologies, and theories, before dissecting elements of the western imperial imaginary, focusing in particular on notions of civilizational hierarchy. The rest of the article examines three ideal-typical aspects of imperial ideology: justification; governance; and resistance. Ideologies of justification provide (...) reasons for supporting or upholding imperial activity, seeking to legitimate the creation, reproduction, or expansion of empire. Ideologies of governance articulate the modalities of imperial rule in specific contexts. Finally, ideologies of resistance reject imperial control. (shrink)
