This book continues and revises the ideas of justice as fairness that John Rawls presented in _A Theory of Justice_ but changes its philosophical interpretation in a fundamental way. That previous work assumed what Rawls calls a "well-ordered society," one that is stable and relatively homogenous in its basic moral beliefs and in which there is broad agreement about what constitutes the good life. Liberal egalitarians agree that the state should protect and promote the freedom of the individual and strive to establish equality of opportunity and resources. They tend to disagree, however, about what these principles entail concerning the state's attitude to the success or failure of the different national cultures which co-exist in many modern political communities. To some it seems obvious that, given the profound importance of culture in shaping a person's identity and outlook, treating people in accordance with liberal egalitarian (...) principles means ensuring the equal survival and success of the cultures to which they belong. Actual practice seems to accord with this conviction to at least some degree in many places in the world: in countries like Canada, Belgium, Spain, and the United Kingdom, to mention just a few, minority cultures are provided with at least some of the political and financial resources needed to ensure their own survival and flourishing. Nationalism is often dismissed today as an irrational political creed with disastrous consequences. Yet most people regard their national identity as a significant aspect of themselves, see themselves as having special obligations to their compatriots, and value their nation's political independence. This book defends these beliefs, and shows that nationality, defined in these terms, serves valuable goals, including social justice, democracy, and the protection of culture. National identities need not be illiberal, and they do not exclude other sources of personal (...) identity, such as ethnicity or religion. An ethics that gives weight to special relationships is more effective in motivating people to pursue justice and other values because it connects peoples’ duties to their identity; but this is consistent with recognizing some universal values, such as human rights. There are strong reasons for making the boundaries of states and nations coincide wherever possible, but in other cases, nations can achieve forms of self‐determination that fall short of full sovereignty. Multicultural arguments in favour of identity politics and special rights for minority groups ignore the benefits that such groups derive from participating in a shared national identity and the kind of democratic politics that such an identity makes possible. Although national identities are often said to be in decline in an increasingly globalized world, they serve such important purposes that our aim should be to rebuild them in a form that makes them more accessible to excluded cultural minorities. By analogy to Macpherson 's "protective" and "self-developmental" models of liberal democracy, there might be two distinct models of liberal multiculturalism. On the protective-style model, the aim is to protect minority cultures against assimilationist and homogenizing intrusions of the majority. On the other model, here dubbed "polyglot multiculturalism," the majority might expand its own "context for choice" by having more minority cultures from whom to borrow. This book makes a significant contribution to the contemporary debate about multiculturalism and democratic theory. It reflects upon the ways in which claims about culture and identity are advanced by immigrants, national minorities, aboriginals, and other groups. It argues that liberal democrats should provide recognition and support for minority cultures and identities, and examines case studies from a number of different societies to show how theorists can learn about justice.

All major western countries today contain groups that differ in their religious beliefs, customary practices or ideas about the right way in which to live. How should public policy respond to this diversity? In this important new work, Brian Barry challenges the currently orthodox answer and develops a powerful restatement of an egalitarian liberalism for the twenty-first century. Until recently it was assumed without much question that cultural diversity could best be accommodated by leaving cultural minorities free to associate in (...) pursuit of their distinctive ends within the limits imposed by a common framework of laws. This solution is rejected by an influential school of political theorists, among whom some of the best known are William Galston, Will Kymlicka, Bhikhu Parekh, Charles Taylor and Iris Marion Young. According to them, this 'difference-blind' conception of liberal equality fails to deliver either liberty or equal treatment. In its place, they propose that the state should 'recognize' group identities, by granting groups exemptions from certain laws, publicly 'affirming' their value, and by providing them with special privileges or subsidies. In Culture and Equality, Barry offers an incisive critique of these arguments and suggests that theorists of multiculturism tend to misdiagnose the problems of minority groups. Often, these are not rooted in culture, and multiculturalist policies may actually stand in the way of universalistic measures that would be genuinely beneficial. (shrink)

In this piece, I tackle a current subject of popular controversy—whether growing multilingualism in the United States imperils the future of American democracy. I offer a positive theory, centered on the value of democratic participation, of how a society like the United States should approach the multilingualism of its population. I conclude that embracing bilingualism in individuals and multilingualism in society is more likely to make linguistic pluralism socially functional and to sustain the vitality of public and social institutions than (...) demanding public monolingualism. I begin by demonstrating that current approaches to language diversity in constitutional democracies, including our own, are largely remedial in nature. They focus either on ensuring the survival of particular minority groups historically present and marginalized in a given nation-state, or on helping immigrants overcome language barriers as they assimilate into the dominant language of the society in question. On its own, this remedial conception cannot ensure that linguistic diversity complements, rather than undermines, democratic institutions, because it does not account for the variety of linguistic interests present in a multiethnic society. I then address this limitation by offering an alternative, participatory theory of language difference. I base my conception of participation on principles of decentralized decisionmaking. This focus requires considering how to expand the individual’s associative options and improve access to the mid-level social institutions where we live out most of our lives, such as the workplace and the public schools. In accommodating speakers of multiple languages in a given institution, we should focus on promoting social investment by individuals and groups, as well as preserving individual control over matters of deeply personal concern, rather than on the survival of particular languages or cultures. In developing this framework, I draw from the experiences of other multilingual societies and legal systems, but I present the United States as a case study to explain what a participatory approach would look like in practice. I focus on the major sites of language conflict in the United States— the political arena, the debate over official English, the workplace, and the public schools—and argue that a multilingual understanding of these sites and the legal rules that structure them best promotes participation.
