This paper has two parts. In the first part, I concede an error in an argument I have given for the incompatibility of free will and determinism. I go on to show how to modify my argument so as to avoid this error, and conclude that the thesis that free will and determinism are compatible continues to be—to say the least—implausible. But if free will is incompatible with determinism, we are faced with a mystery, for free will undeniably exists, and (...) it also seems to be incompatible with indeterminism. In the second part of this paper, I will defend the conclusion that the concept of agent causation is of no use to the philosopher who wants to maintain that free will and indeterminism are compatible. I conclude that free will remains a mystery---that is, that free will undeniably exists and that there is a strong and unanswered prima facie case for its impossibility. (shrink)

This chapter defends a history-sensitive compatibilist view of free action and moral responsibility against various criticisms by compatibilists. It constructs a new argument for incompatibilism that makes vivid a problem that luck poses for compatibilism: the zygote argument. It is argued that the zygote argument is much more powerful than more familiar arguments for incompatibilism, and that, even so, compatibilism may survive the attack.

Mele's ultimate purpose in this book is to help readers think more clearly about free will. He identifies and makes vivid the most important conceptual obstacles to justified belief in the existence of free will and meets them head on. Mele clarifies the central issues in the philosophical debate about free will and moral responsibility, criticizes various influential contemporary theories about free will, and develops two overlapping conceptions of free will--one for readers who are convinced that free will is incompatible (...) with determinism (incompatibilists), and the other for readers who are convinced of the opposite (compatibilists). In this paper I seek to defend libertarianism about free will and moral responsibility against two well-known arguments: the luck argument and the Mind argument. Both of these arguments purport to show that indeterminism is incompatible with the degree of control necessary for free will and moral responsibility. I begin the discussion by elaborating these arguments, clarifying important features of my preferred version of libertarianism—features that will be central to an adequate response to the arguments—and showing why a strategy of (...) reconciliation (often referred to as “deliberative libertarianism”) will not work. I then consider four formulations of the luck argument and find them all wanting. This discussion will place us in a favorable position to understand why the Mind argument also fails. (shrink)

I provide a manipulation-style argument against classical compatibilism—the claim that freedom to do otherwise is consistent with determinism. My question is simple: if Diana really gave Ernie free will, why isn't she worried that he won't use it precisely as she would like? Diana's non-nervousness, I argue, indicates Ernie's non-freedom. Arguably, the intuition that Ernie lacks freedom to do otherwise is stronger than the direct intuition that he is simply not responsible; this result highlights the importance of the denial of (...) the principle of alternative possibilities for compatibilist theories of responsibility. Along the way, I clarify the dialectical role and structure of “manipulation arguments”, and compare the manipulation argument I develop with the more familiar Consequence Argument. I contend that the two arguments are importantly mutually supporting and reinforcing. The result: classical compatibilists should be nervous—and if PAP is true, all compatibilists should be nervous. Alfred Mele’s zygote argument is widely considered to be the strongest version of the manipulation argument against compatibilism (about free will and determinism). Opponents have focused largely on the first of its two premises and on the overall dialectic. My focus here will be on the underlying thought experiment—the Diana scenario—and on the second premise of the argument. I will argue that reflection on the Diana scenario shows that the second premise does not hold, and we will see that my (...) objection to the second premise helps to defend the claim that manipulation arguments face, in general, a dilemma. Derk Pereboom's Four-Case Argument is among the most famous and resilient manipulation arguments against compatibilism. I contend that its resilience is not a function of the argument's soundness but, rather, the ill-gotten gain from an ambiguity in the description of the causal relations found in the argument's foundational case. I expose this crucial ambiguity and suggest that a dilemma faces anyone hoping to resolve it. After a thorough search for an interpretation which avoids both horns of this dilemma, I conclude (...) that none is available. Rather, every metaphysically coherent interpretation invites either a hard- or soft-line reply to Pereboom's argument. I then consider a recharacterization of the dilemma which seems to clear the way for the defence of a revised Four-Case Argument. I address this rejoinder by identifying a still more fundamental problem shared by all viable interpretations of the manipulation cases, showing that each involves a type of manipulation which undermines the victim's agency. Because this diagnosis supports a soft-line reply to every viable interpretation of the argument and can be endorsed by any compatibilist, I consider it the final piece of the Soft-line Solution to the Four-Case Argument. Finally, I suggest a new taxonomy of manipulation arguments, arguing that none that employs the suppressive variety of manipulation found in Pereboom's argument offers a threat to compatibilism. Think of the last thing someone did to you to seriously harm or offend you. And now imagine, so far as you can, becoming fully aware of the fact that his or her action was the causally inevitable result of a plan set into motion before he or she was ever even born, a plan that had no chance of failing. Should you continue to regard him or her as being morally responsible—blameworthy, in this case—for what he or she did? (...) Many have thought that, intuitively, you should not. Recently, Alfred Mele has employed this line of thought to mount what many have taken to be a powerful argument for incompatibilism: the “Zygote Argument”. However, in interesting new papers, John Martin Fischer and Stephen Kearns have each independently argued that the Zygote Argument fails. As I see it, the criticisms of Fischer and Kearns reveal some important questions about how the argument is meant to be—or how it would best be—understood. Once we make a slight (but important) modification to the argument, however, I think we will be able to see that the criticisms of Fischer and Kearns do not detract from its substantial force. There are several argumentative strategies for advancing the thesis that moral responsibility is incompatible with causal determinism. One prominent such strategy is to argue that agents who meet compatibilist conditions for moral responsibility can nevertheless be subject to responsibility-undermining manipulation. In this paper, I argue that incompatibilists advancing manipulation arguments against compatibilism have been shouldering an unnecessarily heavy dialectical burden. Traditional manipulation arguments present cases in which manipulated agents meet all compatibilist conditions for moral responsibility, but are (allegedly) not responsible (...) for their behavior. I argue, however, that incompatibilists can make do with the more modest (and harder to resist) claim that the manipulation in question is mitigating with respect to moral responsibility. The focus solely on whether a manipulated agent is or is not morally responsible has, I believe, masked the full force of manipulation-style arguments against compatibilism. John and Mary have fully consensual sex, but they do not want to have a child, so they use contraception with the intention of avoiding pregnancy. Unfortunately, although they used the contraception in the way in which it is supposed to be used, Mary has become pregnant. The couple decides to have the baby, whom they name ‘Ernie’. Now we fill in the story a bit. The universe is causally deterministic, and 30 years later Ernie performs some action A and (...) thereby brings about event E. We also stipulate that Ernie meets plausible compatibilist conditions for acting freely . That is, we suppose that there are no uncontroversially freedom- and responsibility-undermining conditions present in the context in which Ernie performs A, and, further, that Ernie meets plausible compatibilist conditions for acting freely. Let us say, for example, that one adopts the theory according to which the freedom-relevant condition on moral responsibility is that the agent exhibits ‘guidance control’ of his action and . On this approach, one acts freely in so far as one acts from one's own, suitably reasons-responsive mechanism. We can then simply stipulate that, in the relevant context, Ernie acts from his own, suitably reasons-responsive mechanism . If one prefers a different set of compatiblist-friendly conditions for acting freely, one can simply stipulate that Ernie meets them; indeed, the plausible compatibilist-friendly conditions seem to be compatible with each other, and thus Ernie could presumably meet all of them in the relevant context. In such a case, and given that the epistemic condition on acting freely and moral responsibility is met, I am inclined to say that Ernie …. (shrink)

In Free Will and Luck, Mele presents a case of an agent Ernie, whose zygote was intentionally designed so that Ernie A-s in 30 years, bringing about a certain event E. Mele uses this case of original design to outline the zygote argument against compatibilism. In this paper I criticize the zygote argument. Unlike other compatibilists who have responded to the zygote argument, I contend that it is open to the compatibilist to accept premise one, that Ernie does not act (...) freely and is not morally responsible for anything he does. I argue that compatibilists should deny premise two. Diana’s effective intention to create Ernie’s zygote such that Ernie A-s in 30 years and her intervention to bring about his A-ing mark a significant difference between Ernie and normal agents in a deterministic universe with regard to how their zygotes were created that affects whether those agents act freely and are morally responsible for so acting. In this paper, I introduce a problem to the philosophy of religion – the problem of divine moral standing – and explain how this problem is distinct from (albeit related to) the more familiar problem of evil (with which it is often conflated). In short, the problem is this: in virtue of how God would be (or, on some given conception, is) “involved in” our actions, how is it that God has the moral standing to blame us for performing those (...) very actions? In light of the recent literature on “moral standing”, I consider God’s moral standing to blame on two models of “divine providence”: open theism, and theological determinism. I contend that God may have standing on open theism, and – perhaps surprisingly – may also have standing, even on theological determinism, given the truth of compatibilism. Thus, if you think that God could not justly both determine and blame, then you will have to abandon compatibilism. The topic of this paper thus sheds considerable light on the traditional philosophical debate about the conditions of moral responsibility. (shrink)

Pereboom’s Four-Case Argument was once considered to be the most powerful of the manipulation arguments against compatibilism. However, because of Demetriou’s :595–617, 2010) response, Pereboom has significantly weakened his argument. Manipulation arguments in general have also been challenged by King : 65–83, 2013). In this paper, I argue that the Four-Case Argument resists both these challenges. One upshot is that Pereboom doesn’t need weaken his argument. Another is that compatibilists still need a response the Four-Case Argument. And another is that (...) we get a much better understanding of the Four-Case Argument, and of manipulation arguments more generally, than is currently available in the literature. (shrink)

According to the incompatibilist, however, once we became aware that agents had been manipulated (...) or ‘set up’ in the relevant way, we should no longer judge that they are responsible for their behavior, nor should we hold them responsible for it by blaming them, in case what they did was wrong. In this paper, I aim to shift the debate to different terrain. The focus so far has been simply on what we may or may not permissibly say or do concerning manipulated agents. But I believe a powerful new incompatibilist argument can be mounted from considering whether the manipulators themselves can justifiably blame the agents they manipulate in compatibilist-friendly ways. It seems strikingly counterintuitive to suppose that they may do so. The argument of this paper, however, is that, given the right story, incompatibilism provides the best explanation for why this is so. In short, the compatibilist must say that, while such manipulated agents are still responsible, the manipulators lack the moral standing to blame them. But I argue that, on compatibilist assumptions, this explanation ultimately fails. (shrink)

In this paper I discuss two kinds of attempts to qualify incompatibilist and compatibilist conceptions of freedom to avoid what have been thought to be incredible commitments of these rival accounts. One attempt -- which I call soft libertarianism -- is represented by Robert Kane''s work. It hopes to defend an incompatibilist conception of freedom without the apparently difficult metaphysical costs traditionally incurred by these views. On the other hand, in response to what I call the robot objection (that if (...) compatibilism is true, human beings could be the products of design), some compatibilists are tempted to soften their position by placing restrictions on the origins of agency. I argue that both of these attempts are misguided. Hard libertarianism and hard compatibilism are the only theoretical options. (shrink)

The strategy I have defended involves drawing a distinction between those who can and cannot legitimately hold an agent responsible in circumstances when the agent is being covertly controlled (e.g. through implantation processes). What is intuitively unacceptable, I maintain, is that an agent should be held responsible or subject to reactive attitudes that come from another agent who is covertly controlling or manipulating him. This places some limits on who is entitled to take up the participant stance in relation (...) to agents who are rational self-controllers but nevertheless subject to covert control.26 In this way, what is compromised by conditions of covert control is not the responsibility of the agent as such. It is, rather, the participant stance of those other agents who covertly control him. Clearly it is possible to establish these specific limits on who can hold these agents responsible without denying that the agents themselves remain free and responsible. When we take this approach we will find that we are no longer faced with an unattractive choice between simply “biting the bullet” or having to “spit it out”. All we need to do is chew carefully, until there is nothing left that we find too hard to swallow. (shrink)

Analytic philosophers have a tendency to forget that they are human beings, and one of the reasons that P. F. Strawson’s 1962 essay, “Freedom and Resentment”, has been so influential is that it promises to bring discussions of moral responsibility back down to earth. Strawson encouraged us to “keep before our minds...what it is actually like to be involved in ordinary interpersonal relationships”, which is, after all, the context in which questions about responsibility arise in the first place. In this (...) essay I explore what we can learn about ordinary interpersonal relationships from three works of literature – Shakespeare’s King Lear, Jane Austen’s Persuasion, and Graham Greene’s The End of the Affair. My intention is to try to heed Strawson’s advice without imposing upon the data any particular theoretical agenda, and my hope is that the data collected will prove useful for future theorizing about responsibility. Patrick Todd has recently fashioned a novel argument for incompatibilism, the Moral-Standing Zygote Argument. Todd considers much-discussed cases in which a manipulator causes an agent in a deterministic scenario to act morally wrongly from compatibilist-friendly conditions for freedom and moral responsibility. The manipulator, Todd contends, does not have the standing to blame the manipulated agent, and the best explanation for this is that incompatibilism is true. This is why the manipulated agent is not blameworthy. In this paper, I counter Todd (...) on behalf of the compatibilist, arguing that the best explanation for the manipulator's lack of moral standing to blame is due to the manipulator's intending to cause the manipulated agent to do wrong.
