Since it appeared in 1971, John Rawls's A Theory of Justice has become a classic. The author has now revised the original edition to clear up a number of difficulties he and others have found in the original book. Rawls aims to express an essential part of the common core of the democratic tradition--justice as fairness--and to provide an alternative to utilitarianism, which had dominated the Anglo-Saxon tradition of political thought since the nineteenth century. Rawls substitutes the ideal of the (...) social contract as a more satisfactory account of the basic rights and liberties of citizens as free and equal persons. "Each person," writes Rawls, "possesses an inviolability founded on justice that even the welfare of society as a whole cannot override." This anthology of essays on the work of David Kaplan, a leading contemporary philosopher of language, sprang from a conference, "Themes from Kaplan," organized by the Center for the Study of Language and Information at Stanford University.

In constructing semantic theories of normative and evaluative terms, philosophers have commonly deployed a certain type of disagreement -based argument. The premise of the argument observes the possibility of genuine disagreement between users of a certain normative or evaluative term, while the conclusion of the argument is that, however differently those speakers employ the term, they must mean the same thing by it. After all, if they did not, then they would not really disagree. We argue that in many of (...) the cases in which this argument is deployed, the conclusion not only fails to follow from the premises, but is very likely false. Disagreements between speakers who do not mean the same things by their words are common, genuine, and not easily distinguished from ordinary disagreements over the truth of literally expressed content. We make this case by developing the notion of a metalinguistic negotiation, an exchange in which speakers tacitly negotiate the proper deployment of some linguistic expression in a context. Metalinguistic negotiations express disagreements over information that is conveyed pragmatically and about what concepts should be deployed in the context at hand. We argue that neither of these features poses any obstacle to metalinguistic negotiations serving to express genuine, substantive disagreements that can be well worth engaging in. Contrary to what has been widely assumed in the literature, many normative and evaluative disputes—among ordinary speakers and even among philosophers themselves—may be of exactly this type, a conclusion with important consequences for both the subject matter and the methodology of metanormative theory. Hurley here revives a classical idea about rationality in a modern framework, by developing analogies between the structure of personality and the structure of society in the context of contemporary work in philosophy of mind, ethics, decision theory and social choice theory. The book examines the rationality of decisions and actions, and illustrates the continuity of philosophy of mind on the one hand, and ethics and jurisprudence on the other. A major thesis of the book is that arguments drawn from (...) the philosophy of mind may be used to undermine widely-held subjectivist positions in ethics and politico-economic theory. The work is inspired by the philosophies of Wittgenstein and Davidson, but goes on to connect their arguments about interpretation with formal work in decision theory and social choice theory, and with the theory of adjudication. This paper investigates the way that linguistic expressions influence vagueness, focusing on the interpretation of the positive (unmarked) form of gradable adjectives. I begin by developing a semantic analysis of the positive form of ‘relative’ gradable adjectives, expanding on previous proposals by further motivating a semantic basis for vagueness and by precisely identifying and characterizing the division of labor between the compositional and contextual aspects of its interpretation. I then introduce a challenge to the analysis from the class of ‘absolute’ (...) gradable adjectives: adjectives that are demonstrably gradable, but which have positive forms that relate objects to maximal or minimal degrees, and do not give rise to vagueness. I argue that the truth conditional difference between relative and absolute adjectives in the positive form stems from the interaction of lexical semantic properties of gradable adjectives—the structure of the scales they use—and a general constraint on interpretive economy that requires truth conditions to be computed on the basis of conventional meaning to the extent possible, allowing for context dependent truth conditions only as a last resort. In addition to thin concepts like the good, the bad and the ugly, our evaluative thought and talk appeals to thick concepts like the lewd and the rude, the selfish and the cruel, the courageous and the kind -- concepts that somehow combine evaluation and non-evaluative description. Thick concepts are almost universally assumed to be inherently evaluative in content, and many philosophers claimed them to have deep and distinctive significance in ethics and metaethics. In this first book-length treatment of thick (...) concepts, Pekka Väyrynen argues that all this is mistaken. Through detailed attention to the language of thick concepts, he defends a novel theory on which the relationship between thick words and evaluation is best explained by general conversational and pragmatic norms. Drawing on general principles in philosophy of language, he argues that many prominent features of thick words and concepts can be explained by general factors that have nothing in particular to do with being evaluative. If evaluation is not essential to the sort of thinking we do with thick concepts, claims for the deep and distinctive significance of the thick are undermined. The Lewd, the Rude and the Nasty is a fresh and innovative treatment of an important topic in moral philosophy and sets a new agenda for future work. It will be essential reading to anyone interested in the analysis and the broader philosophical significance of evaluative and normative language. (shrink)

This paper argues against relativism, focusing on relativism based on the semantics of predicates of personal taste. It presents and defends a contextualist semantics for these predicates, derived from current work on gradable adjectives. It then considers metasemantic questions about the kinds of contextual parameters this semantics requires. It argues they are not metasemantically different from those in other gradable adjectives, and that contextual parameters of this sort are widespread in natural language. Furthermore, this paper shows that if such parameters (...) are rejected, it leads to an unacceptably rampant form of relativism, that relativizes truth to an open-ended list of parameters. (shrink)

Including contributions from David Hull, John Dupre, David Nanney, Kevin de Queiroz, and Kim Sterelny, amongst others, this book has become especially well-known for the three essays it contains on the homeostatic property cluster view of natural kinds, papers by Richard Boyd, Paul Griffiths, and Robert A. Wilson.

This paper argues that pleasure and pains are not qualia and they are not to be analyzed in terms of supposedly antecedently intelligible mental states like bodily sensation or desire. Rather, pleasure and pain are char- acteristic of a distinctive kind of evaluation that is common to emotions, desires, and (some) bodily sensations. These are felt evaluations: pas- sive responses to attend to and be motivated by the import of something impressing itself on us, responses that are nonetheless simultaneously con- (...) stitutive of that import by virtue of the broader rational patterns of which they are a part and that they serve to de?ne. This account of felt eval- uations makes sense of the way in which pleasures and pains grab our attention and motivate us to act and of the peculiar dual objectivity and subjectivity of their implicit evaluations, while o?ering a phenomenology adequate to both emotional and bodily pleasures and pains. Morality seems important, in the sense that there are practical reasons — at least for most of us, most of the time — to be moral. A central theoretical motivation for consequentialism is that it appears clear that there are practical reasons to promote good outcomes, but mysterious why we should care about non-consequentialist moral considerations or how they could be genuine reasons to act. In this paper we argue that this theoretical motivation is mistaken, and that because many arguments (...) for consequentialism rely upon it, the mistake substantially weakens the overall case for consequentialism. We argue that there is indeed a theoretical connection between good states and reasons to act, because good states are those it is fitting to desire and there is a conceptual connection between the fittingness of a motive and reasons to perform the acts it motivates. But while some of our motives are directed at states, others are directed at acts themselves. We contend that just as the fittingness of desires for states generates reasons to promote the good, the fittingness of these act-directed motives generates reasons to do other things. Moreover, we argue that an act’s moral status consists in the fittingness of act-directed feelings of obligation to perform or avoid performing it, so the connection between fitting motives and reasons to act explains reasons to be moral whether or not morality directs us to promote the good. This, we contend, de-mystifies how there could be non-consequentialist reasons that are both moral and practical. (shrink)

One of the remarkable features of the turmoil surrounding the counting and recounting of votes in the State of Florida in the 2000 US Presidential Election was the frequency with which "the Rule of Law" was invoked. Whether the antagonists in Florida knew it or not, they are in fact aspects of a venerable heritage of contestation that comes down to us as part and parcel of the Rule-of-Law tradition. The fact that "the Rule of Law" has always evoked this (...) contestation has led some to surmise that an old article by a linguistic philosopher, W.B. Gallie, entitled, "Essentially Contested Concepts" might afford the most fruitful basis for approaching the analysis of the term. (shrink)

In 1986, I argued that pains are essentially not phenomenal states. Using a Wittgen-steinian son of argument, I showed that the same sort of phenomena can be had on different occasions, and on one occasion persons be in pain, while on another occasion persons not be in pain. I also showed that very different phenomena could be experienced and, yet, organisms have the same sort of pain. I supported my arguments with empirical data from both laboratory and clinical studies. There (...) is nothing about this thesis I would now retract. However, there was a further thesis that needs to be reconsidered. I argued that phenomenal states are only accompaniments of pains, that pains are essentially a combination of cognitive, affective and behavioural/motivational states. This thesis I do now zaish to retract. I now argue that phenomenal states are necessary for pains, but still not sufficient. There must also be a cognitive state which involves an evaluation of the phenomenon as something like, 'Harm to the body'. The evaluation is a kind of de re belief, regarding the phenomenon as itself representing harm to the body. Besides admitting that phenomenal states are necessary for pains, I also now claim that other relevant belief states, affective states, and behavioural/motivational states are not necessary for pain, but normal consequences of pain. This revised theory is preferable to the 1986 one because it fits better with empirical facts (including providing better explanations for anomalous cases), fits better with certain powerful common-sense intuitions, and fits better with a larger theory of consciousness I have been developing. Among other things, it turns out that being in pain is a quite peculiar conscious state and considering it as a paradigm for consciousness is a serious mistake. (shrink)

Because “rape” has such a powerful appraisive meaning, how one defines the term has normative significance. Those who define rape rigidly so as to exclude contemporary feminist understandings are therefore seeking to silence some moral perspectives “by definition.” I argue that understanding rape as an essentially contested concept allows the concept sufficient flexibility to permit open moral discourse, while at the same time preserving a core meaning that can frame the discourse.

In virtue of what are later and an earlier group members of one and the numerically same tradition? Gallie was one of the few philosophers to have engaged with issues surrounding this question. My article is not a faithful exegesis of Gallie but develops a terminology in which to discuss issues surrounding the numerical identity of a tradition over time, based on some of his insights.

ABSTRACT When one thinks about the ethics of abortion, one inevitably thinks about rights, since it is in terms of the concept of rights that much of the debate has been conducted. This is true of overtly feminist as well as non‐feminist accounts. Indeed, some early feminist writers – Judith Jarvis Thomson and Mary Ann Warren, for example – employ a model of rights that is indistinguishable, or virtually indistinguishable, from that of their non‐feminist counterparts. However, more recent feminist writers (...) have developed a different understanding of ‘a woman's right to choose.’ In this paper, I will begin by outlining the non‐feminist debate over the moral permissibility of abortion. I will suggest that this debate is irresolvable, since at its heart is an ‘essentially contested concept’, that of personhood. I will then consider the way in which some feminist writers have attempted to reconceive the terms of the abortion debate and suggest an expanded account of women's right to abortion, drawing on the work of Susan Sherwin. Finally, I will argue that there is a further element to a ‘woman's right to choose’ that expands on and provides a conceptual link between the feminist and non‐feminist understanding of abortion. Larry Temkin challenged what seems to be an analytic truth about comparatives: if A is Φ-er than B and B is Φ-er than C, then, A is Φ-er than C. Ruth Chang denies a related claim: if A is Φ-er than B and C is not Φ-er than B, but is Φ to a certain degree, then A is Φ-er than C. In this paper I advance a context-sensitive semantics of gradability according to which the data uncovered by Temkin and (...) Chang leave both statements intact. (shrink)

Although the notion of an essentially contested concept may shed light on the logic of disputes over the proper application of some key political terms, it nevertheless plays no genuine role in explaining the intractability of these disputes. The notion of an essentially contested concept is defended against some influential criticisms, showing how it is possible for one conception of an essentially contested concept to be justifiably regarded as superior to other competing conceptions. Two possible answers are distinguished to the (...) question of why disputes over essentially contested concepts should be regarded as inevitable, but neither provides us with a plausible explanation for why they are so intractable. Disagreements over the proper use of key political concepts are better explained by features of moral and political discourse, such as the short reach of ?intellectual authority? and the fact that consensus is not one of its primary aims, in conjunction with empirical hypotheses from the social sciences, rather than by essential contestedness theses. In this book, Rhodes provides a nonevaluative account of coercion. He begins with a thorough discussion of the charge that coercion is an essentially contested concept. He argues that effective communication of regulations pertaining to human conduct requires a basic level of clarity as to the kind of conduct being regulated. Accordingly, he argues that before we prescribe or proscribe conduct, we should describe it. In short, he maintains that wherever possible description should precede prescription and proscription. Rhodes begins his (...) descriptive project by providing a fundamental account of human motivation. Upon this foundation he supports his distinctions between threats, offers, throffers, and neutral proposals. He argues that all coercion claims can be understood in light of these components. He applies this analysis to three prominent accounts of coercion as advanced by F.A. Hayek, Harry Frankfurt, and Robert Nozick. After comparing and contrasting these views, Rhodes provides his own account. Rhodes's account is based upon the identification of what he refers to as perceived-threat-avoidance-behavior as a necessary condition for coercion. As a descriptive, or nonevaluative, account, Rhodes is able to identify coercion independent from normative judgments. He argues that it is not the wrongfulness of some conduct that makes it coercion, instead, it is the coerciveness of some conduct that makes it wrong. Unique to Rhodes's account, coercion is not necessarily wrong. As a descriptive account, his view permits an independent analysis of the moral status of an act of coercion. The book concludes with a discussion of the normatively significant variables of a coercion claim. (shrink)

Requires signed TDF. ;In this thesis, I argue against the following common philosophical explanations of political disagreement: firstly, the view that those who disagree about political issues do so because they completely fail to understand each other; secondly, the view that political disagreement is value-laden and persists because disputes over values, unlike disputes over facts, are not amenable to rational resolution; thirdly, the general view that moral and political arguments are, in (...) principle, rationally unsettlable. I also consider the view that moral and political reasoning is open-ended and, as a result, that there is always something inconclusive about political argument. I argue that there are, indeed, a number of ways in which moral and political reasoning is open-ended, but maintain that none of these ways is sufficient to explain fully the existence and intractability of moral and political disputes in developed capitalist societies. ;I defend an alternative conception of how political disagreement should be explained. I make a distinction between rational and non-rational explanations of political disagreement and claim that, in general, philosophical explanations of political disagreement are rational ones because they appeal simply to the reasons those who disagree about political issues have for making the judgements they do. Instead, I urge that we should seek non-rational explanations for the holding of political beliefs and then construct explanations of political disagreement out of them. I defend an empirical model which attempts to do this. This model appropriates some aspects of an account of the construction of gender proposed by N. Chodorow, and employs the results of some research performed by C. Gilligan on the different ways in which men and women reason about moral and political issues. I apply the model to the work of two contemporary political theorists: John Rawls and Robert Nozick. (shrink)
