Must the best friends necessarily be good people? On the one hand, as Aristotle puts it, ‘people think that the same people are good and also friends’. But on the other hand, friendship sometimes seems to require that one behave badly. For example, a normally honest person might lie to corroborate a friend's story. What I will call closeness, which I take to include sensitivity to friends' subjective values and concerns as well as an inclination to take their subjective interests (...) as reasons for action, is characteristic of friendship. But this seems to require that good friends should be morally flexible, more so than is compatible with a virtuous character. This would imply tension between ideals of friendship and ideals of character. But there is an important connection between virtue and friendship which arises precisely from friends' closeness, when concern for wellbeing, another important feature of friendship, is also taken into account. This helps mitigate the tension and shows how friendship and virtue are interconnected. The connection in turn provides friendship-based reason to think the best friends must be good people, even though concerns of friendship may occasionally clash with other moral concerns. (shrink)

Digital records, from chat transcripts to social media posts, are being used to create chatbots that recreate the conversational style of deceased individuals. Some maintain that this is merely a new form of digital memorial, while others argue that they pose a variety of moral hazards. To resolve this, I turn to classical Chinese philosophy to make use of a debate over the ethics of funerals and mourning. This ancient argument includes much of interest for the contemporary issue at hand, (...) including the use of impersonators of the dead to help the bereaved to deal well with their grief. I connect this historical discussion with a modern trend in clinical psychology that reframes therapeutic interventions with bereaved individuals. The trend directs practitioners away from facilitating detachment and toward affirming continuing bonds. I conclude that these chatbots can offer an important source of support to mourners, but also discuss parameters and features of social context that will be important to avoid the moral hazards identified by sceptics. The status and functioning of shame is contested in moral psychology. In much of anglophone philosophy and psychology, it is presumed to be largely destructive, while in Confucian philosophy and many East Asian communities, it is positively associated with moral development. Recent work in human-robot interaction offers a unique opportunity to investigate how shame functions while controlling for confounding variables of interpersonal interaction. One research program suggests a Confucian strategy for using robots to rebuke participants, but results from experiments with (...) educational technologies imply a different and potentially opposing account of shame’s role in personal development. By digging deeper into the details of Confucian theorizing about shame, I identify a unifying explanation for these apparently conflicting results. I conclude by offering suggestions for future empirical research in human-robot interactions to further investigate shame’s role in moral development. (shrink)

Feminized AIs designed for in-home verbal assistance are often subjected to gendered verbal abuse by their users. I survey a variety of features contributing to this phenomenon—from financial incentives for businesses to build products likely to provoke gendered abuse, to the impact of such behavior on household members—and identify a potential worry for attempts to criticize the phenomenon; while critics may be tempted to argue that engaging in gendered abuse of AI increases the chances that one will direct this abuse (...) toward human beings, the recent history of attempts to connect video game violence to real-world aggression suggests that things may not be so simple. I turn to Confucian discussions of the role of ritualized social interactions both to better understand the roots of the problem and to investigate potential strategies for improvement, given a complex interplay between designers and device users. I argue that designers must grapple with the entrenched sexism in our society, at the expense of “smooth” and “seamless” user interfaces, in order to intentionally disrupt entrenched but harmful patterns of interaction, but that doing so is both consistent with and recommended by Confucian accounts of social rituals. This paper investigates the semantics of implicit comparatives (Alice is tall compared to Bob) and its connections to the semantics of explicit comparatives (Alice is taller than Bob) and sentences with adjectives in plain positive form (Alice is tall). We consider evidence from two experiments that tested judgments about these three kinds of sentence, and provide a semantics for implicit comparatives from the perspective of degree semantics.

Caregiving robots are often lauded for their potential to assist with geriatric care. While seniors can be wise and mature, possessing valuable life experience, they can also present a variety of ethical challenges, from prevalence of racism and sexism, to troubled relationships, histories of abusive behavior, and aggression, mood swings and impulsive behavior associated with cognitive decline. I draw on Confucian ethics, especially the concept of filial piety, to address these issues. Confucian scholars have developed a rich set of theoretical (...) resources for dealing with beloved but imperfect elders, and navigating the challenges of supporting seniors whose ethical commitments are unreliable. These resources provide a way to reconcile two important but conflicting desiderata: to value and care for seniors, but also to clear-mindedly deal with their moral shortcomings. In particular, they articulate a duty to remonstrate with our elders when they err. Confucian filial piety can helpfully inform robot design and use in geriatric care. They can be used to strengthen and protect emotional connections in important relationships, but should not be used to reinforce patient preferences when doing so damages relationships or their ability to act morally. Rather than conceive of patient wellbeing as in tension with moral behavior, and care as a burden for caregivers, not a source of value and meaning, Confucian accounts of filial piety help identify both new areas of concern and new potential in the development of caregiving technologies, ones which see these goods as complementary. There are two basic views concerning the relationship between constitutional rights and proportionality analysis. The first maintains that there exists a necessary connection between constitutional rights and proportionality, the second argues that the question of whether constitutional rights and proportionality are connected depends on what the framers of the constitution have actually decided, that is, on positive law. The first thesis may be termed ‘necessity thesis’, the second ‘contingency thesis’. Proprioception, a sense of bodily position and movement, is rarely the focus of conscious experience. If we are ordinarily conscious of proprioception, we seem only peripherally so. Thus, evidence that proprioception is present in the periphery of at least some conscious experiences seems to be good evidence that conscious experience is fairly rich. Anosognosia for paralysis is a denial of paralysis of one's limbs, usually in the wake of brain damage from stroke. Because anosognosic patients overlook their paralysis, anosognosia seems (...) be a counter-example to the claim that proprioception exists in the periphery of conscious experience. However, careful consideration of the data shows that anosognosia makes a poor counterexample to a rich theory of consciousness. Thus, we retain reason to believe that proprioception exists in the periphery of conscious experience, and so to conclude that conscious experience is relatively rich. (shrink)

Most studies on Nietzsche seldom associate him with the dialectic method. We readily think of Socrates, Hegel, and Marx when we hear of dialectic, but very rarely, if at all, of Nietzsche. To date, very few studies on Nietzsche have claimed that one of the German philosopher's underpinning philosophical methodologies in his literary oeuvre is the dialectic. This paper thus intends to show that Nietzsche has been employing the dialectic throughout his writings, especially in his treatment of the "free spirits"-a (...) recurring subject in his different compositions. To do this, I will first revisit the meaning of dialectic in Socrates, Hegel, and Marx and subsequently argue that in Nietzsche, a type of dialectic akin to Hegel's permeates his writings. In the next parts of this paper, I will discuss in-depth how for Nietzsche, the incarnation of the free spirits involves not just one, but a continuum of triple dialectic. I will argue that to become a free spirit, one must constantly apply the dialectics of (1) criticality and openness, (2) unlearning and relearning, and (3) overcoming and becoming. These dialectics, in my view, are the necessary conditions for any individual to be truly free. In this paper, I will importantly highlight that these dialectics run through Nietzsche's works starting from the early up to the final period of his literary productivity. (shrink)

When it comes to social robotics (robots that engage human social responses via “eyes” and other facial features, voice-based natural-language interactions, and even evocative movements), ethicists, particularly in European and North American traditions, are divided over whether and why they might be morally considerable. Some argue that moral considerability is based on internal psychological states like consciousness and sentience, and debate about thresholds of such features sufficient for ethical consideration, a move sometimes criticized for being overly dualistic in its framing (...) of mind versus body. Others, meanwhile, focus on the effects of these robots on human beings, arguing that psychological impact alone can qualify an entity for moral status. What both sides overlook is the importance for ordinary moral reasoning of integrating questions about an entity’s “inner life,” and its psychological effect on us. Turning to accounts of relationships in virtue ethics, especially those of the Confucian tradition, we find a more nuanced theory that can provide complex guidance on the moral considerability of social robots, including ethical considerations about whether and how to question this to begin with. In Gaudium et Spes, the Catholic Church describes marital discernment as the married couple’s “common reflection and effort… [that] involves a consideration of their own good and the good of their children” and also as “an estimation of the good of the family… [that necessitates] prudent reflection and common decision.” With this description, we can say that the Catholic Church expects and desires married couples to resolve marital and family conflicts by coming together in discernment. And yet, how should married (...) couples discern? How should they exercise marital discernment? Since one cannot just go on discerning blindly without minding some rules, without following some basic steps, Ricoeur would emphasize that “discernment calls for a hermeneutics.” But how should hermeneutics be integrated into the process of marital discernment? This paper makes an attempt to integrate hermeneutics into the process of marital discernment by drawing some key principles from Paul Ricoeur’s hermeneutic phenomenology and Karol Wojtyła’s phenomenology of spousal love. In this paper, I aim to show that the critical appropriation of political power can be a potential tool in transforming political structures into just institutions. To achieve this aim, I will employ Ricoeur's hermeneutics of symbols because in his different political essays, he consistently regards political power as akin to a symbol. Thus, for him, the critical appropriation of political power requires a hermeneutical procedure. And so in my discussion, I will devote one section for Ricoeur's hermeneutics of symbols, (...) one for his thoughts on political power, and another one for the critical appropriation of political power through the hermeneutics of symbols. To put Ricoeur's political and hermeneutical thoughts in a better light, I will introduce these sections with a separate section on his philosophical anthropology. In my conclusion, I will affirm that transforming political structures into just institutions is very much possible through the critical appropriation of political power. It is such a potential tool in effecting these transformations because the critical appropriation of political power involves a hermeneutical procedure that follows a three-step process of reflection. And reflection, which makes way for the critical appropriation of political power, is what ensures that power rests only in the hands of those who are more likely to advance the common good, resulting into a greater possibility for the transformation of political structures into just institutions. As rational animals, human beings not only have the ability to think but also the capacity to understand. Human rationality, so to speak, is constituted by thinking and understanding. The immediate connotation of rationality, however, is almost always thinking. Hence to speak of man as an animal rationale is to speak of man as a thinking being. But following his mentor Martin Heidegger, Hans-Georg Gadamer insists that man does not only think, but most importantly understands. To understand is an essential (...) part of being human, of being rational. But what is understanding? What does it mean to understand? The issue of human understanding is not something simply epistemological; rather, it is something hermeneutical. That is to say, understanding always relates to the act of interpretation. In his monumental work Truth and Method, Gadamer diligently considers the matter of human understanding from a purely hermeneutical perspective. This paper, then, aims to synthesize Gadamer's hermeneutical theory and argues that for Gadamer, human understanding is essentially characterized by a kind of textual intercourse, that is, a dialogic interaction or an intimate exchange of horizons between an interpreting subject and a text which, in very broad terms, can refer to any object of interpretation. One of the intellectual giants in church history who first utilized philosophy to embark on the depths of faith was St. Augustine of Hippo (a.D. 354 - 430). But what had prompted Augustine to approach faith through philosophy? What is his conception of faith? How did he arrive at a deeper and better understanding of faith via philosophy? In this paper, I will explore the saint's philosophy of faith and argue that in Augustine, we can find not just one but (...) three levels of faith, namely: the regula or doctrina fidei, the intelligentsia fidei, and the experiential fidei. In the past thirty years, however, various scholars have argued in their studies that the Zhuangzi does not only pose a hermeneutical challenge, but also carries an implicit hermeneutics. My aim in this paper is to show that underneath its parables and rhetoric, fictional and imaginary characters, as well as its inclination towards relativism and skepticism, a Zhuangzian hermeneutics comparable (...) to the hermeneutical theories of Paul Ricoeur and Hans-Georg Gadamer in the West subtly permeates the Zhuangzi. To attain this aim, I will first present and examine the three types of words in the Zhuangzi and do a Ricoeurian reading of these words. I will consequently identify the hermeneutics of skepticism implied in the Zhuangzi and argue that it is a hermeneutical approach that is dominant in the text. I will then contend that in addition to the hermeneutics of skepticism, the Zhuangzi also contains what I call a perspectival hermeneutics with a number of elements that echo Gadamer’s hermeneutical theory. President Rodrigo Duterte to this day has continued to enjoy popularity among majority of the Filipinos. And this, even as Duterte himself has continually graced the headlines, not for any outstanding humanitarian achievement, but for his typical but highly controversial personal blunders and braggadocios, outrageous remarks, and penchant for informalities. And this, too, even as no less than the U.S. intelligence department tags him as a “threat to democracy” and no less than some influential bishops in the Catholic Church accuse (...) him of already going beyond the bounds of the ethical. What could be the reasons why Duterte is still this popular among many Filipinos despite the many controversies that continue to hound him? Does this mean that today’s Filipinos have become too politically blasé to care about what’s going on in the political arena of their country? Or, could it be that Duterte’s continuing popularity actually reflects the political vision of contemporary Filipinos? To answer these questions, in this paper, I will do a Ricoeurian reading of Duterte’s popular presidency. By Ricoeurian reading, I mean that I will be using selected elements in Ricoeur’s political philosophy as evaluative tools in analyzing: 1) whether President Duterte is indeed a “threat to democracy”; 2) whether the Duterte government still falls within the ethical; and 3) whether Duterte’s popular presidency actually reflects the political vision of contemporary Filipinos. Using Richard Rorty’s concept of contingency, this paper aims to show that standardized education is problematic; it cannot truly ensure or even accurately measure quality in education. Why Richard Rorty? Why his ideas? Rorty (1931-2007) was an American contemporary philosopher who was heavily influenced by pragmatism – a philosophical approach that is more concerned about the practical consequences of ideas rather than their theoretical elaboration. What I find interesting in Rorty is the fact that his pragmatism – or neo-pragmatism to (...) be precise – holds the key to his philosophy of education. Rorty’s educational philosophy, built upon Dewey’s pragmatic philosophy of education, presents a postmodern vision of education, meaning to say, it does not readily accept and even challenges the status quo; as such, it questions the finality of established standards. Thus, on account of the characteristics that are peculiar to Rorty’s philosophy of education, he has become my logical choice: that is, I hope to attain the aim of this paper by using his neo-pragmatic and postmodern approach to education. Specifically, I will examine the problem of standardized education in the light of Rorty’s concept of contingency. To reach this end, I will first present his concept of contingency. I will next go into his philosophy of education. Then, I will give a general overview of standardized education. Finally, I will expose where the problem of standardized education lies with the aid of Rorty’s concept of contingency and, needless to say, offer Rortyan recommendations, if not outright solutions, to this problem. I further explain that what motivates Lubich to engage in different dialogues is the desire to contribute to the fulfillment of Jesus' prayer on the night before he died: "That all (...) may be one.". In quantum mechanics, the term “creativity” is amplified, since natural events form the constant transition from possibility to reality, according to the ontological probabilism of the Schrödinger equation. The completion of the quantum theory through the concept of the Grand Unified Theories, and especially through the yet incomplete superstring theory, reveals that at the micro level of creation of sub-atomic particles or space, motion literally comes prior to Being and objects are forms of a motion which suggests a constant transition (...) from possibility to reality. In non – linear physics of complex systems, the term “creativity” does not simply correspond to the initial emergence of the universe (big bang) or to the sub-atomic scale processes described by quantum mechanics, the Grand Unified Theories and the superstring theory, but is expanded to all aspects of nature: i.e. physical - chemical, ecological, psychological – mental aspect. So, through the non – linear physics theory, macroscopically viewed beings are constructed, holistic forms of motion, in order for the whole to gain a non reducible (therefore the whole is constantly being produced) ontological meaning which characterizes the operation of the part. Combining the theories of quantum mechanics and relativity, it could be stated that modern physics abolishes the customary perception concerning the natural phenomena, which were concerned as a constant transformation of a fundamental substance. On the contrary, the contemporary description of the natural world by physics and mathematics corresponds to Morphodynamics, i.e. the description of the world as creation of all cosmic shapes from a zero point, on all cosmic levels. From this point of view, zero is understood as the absence of shape, while the notion of an unshaped eternal substance is weakened and does not seem to be able to be justified by the evolution of scientific thought. The “beings” and their “substance” are assimilated to forms of movement that have already been created or that are being created, and constitute motion inside motion. (shrink)

In industrial societies where civil law and state institutions have become well established secular vehicles for governing the populace, it is widely assumed that the state no longer has an interest in fortifying the religious sector as a complementary source of social control. Thus, a distinction is drawn between the Islamic state that is ruled by religious law and the secular state of Western industrial societies in which religion is deemed to have lost its influence in the public sphere. This (...) dissertation argues that civil law is not religiously neutral and thus challenges a central premise of secularization theory. Introducing a new theoretical model that classifies civil law on the basis of its purpose-to protect religious liberty, engage or fortify the religious sector, or to advance universal norms-the author examines the impact of the three different types of legislation upon religious freedom and the individual autonomy of religious minorities in Sweden, an aggressively secularized industrial society. The author concludes that, viewed from the standpoint of a religious nonconformist, there is no discernible difference between living in a society that is overtly ruled by religious law (e.g., an Islamic state) and living in a "secular” society that is ruled by civil law either embedded with religious norms or designed to facilitate state appropriation of the religious sector as a complementary means of social control. In either environment, the author argues, the religious nonconformist will be forced to conform to the religious norms of the predominant religious group. (shrink)

In modern philosophy of nature the World is unified and holistic. Cosmic Universe and Human History, microcosm and macrocosm, inorganic and living matter coexist and form a unique unity manifested in multiple forms. The Physical and the Mental constitute the form and the content of the World. The world does not consist of subjects and objects, the “subject” and the “object” are metaphysical abstractions of the single and indivisible Wholeness. Man’s finite knowledge separates the Whole into parts and studies fragmentarily (...) the beings. The Wholeness is manifested in multiple forms and each form encapsulates the Wholeness. The rational explanation of the excerpts and the intuitive apprehension of the Wholeness are required to combine and create the open thought and the holistic knowledge. This means that the measurement should be defined by the ''measure'', but the responsibility for determining the ''measure'' depends on the man. This requires that man overcomes the anthropocentric arrogance and the narcissistic selfishness and he joins the Cosmic World in a friendly and creative manner. (shrink)

Philosophy in the City (or PinC, as it came to be known) is an outreach programme led by student volunteers from the University of Sheffield's Department of Philosophy. It aims to bring philosophy out of the university and into the wider urban community, stimulating young and older minds through events and activities organised with local partners, including schools, charities, and a homeless shelter. Since its inception in 2006, the project has seen hundreds of student volunteers from the university engage in (...) philosophical conversations with thousands of local residents from a wide variety of backgrounds. Sixteen years on, what can we learn from the achievements and shortfalls of this initiative? The present paper is not a systematic review of the project’s history, but a retrospective dialogue between the two authors who both participated in its foundation and its early development: Alexis Artaud de la Ferrière was the project’s first President and Joshua Forstenzer its third. In the course of this dialogue, they revisit the initial motivations and ambitions undergirding the project, discuss the obstacles faced throughout their respective tenures of leadership, and analyse the evolving mission of the project against the backdrop of historic changes in English higher education which occurred during this period. In the Critique of the Power of Judgment, Immanuel Kant characterizes the sublime as a negative pleasure derived from the encounter with something absolutely great. Some scholars have claimed that Kant’s notion of the sublime only applies to objects in nature (Abaci 2008, 239). Others contend that the object that provokes the sublime experience is not confined to objects of nature since the sublime is an experience in the mind (Clewis 2010, 169). This paper argues that Kant’s Critique and the (...) Grateful Dead’s song “The Other One” provide a framework for understanding the artistic mathematical sublime in music, wherein the pleasure and displeasure experienced when engaging with music can be identified as instances of the sublime. Beginning with an elucidation of Kant’s concepts of judgments of taste and the sublime, the paper explores their similarities and differences. Notably, his theory of the sublime is less developed than his theory of the beautiful. This provides an opportunity to interrogate arguments surrounding which objects can elicit the sublime and how artworks represent or present it to their viewers. After demonstrating a textual disparity of the role of music in Kant’s Critique, I show how music without words, also known as jams, can fit the definition of free beauty and can be classified as art. The discussion further delineates the process of experiencing the mathematical sublime and describes indicators in music theory for discerning the sublime in musical compositions. I use the Grateful Dead’s performance of “The Other One” on April 7, 1972, to illustrate how particular works of art manifest the mathematical sublime. The paper concludes by reflecting on how the qualitative description of the piece highlights why “The Other One” should be seen as both artistic (because, while the piece is coherent, there is no discernible concept that seems to unify it) and sublime (because it is mind-blowingly complex). How we engage with music like the Grateful Dead can allow us to discuss why particular works of art are meaningful to us. (shrink)

We advocate and develop a states-based semantics for both nominal and adjectival confidence reports, as in "Ann is confident/has confidence that it's raining", and their comparatives "Ann is more confident/has more confidence that it's raining than that it's snowing". Other examples of adjectives that can report confidence include "sure" and "certain". Our account adapts Wellwood's account of adjectival comparatives in which the adjectives denote properties of states, and measure functions are introduced compositionally. We further explore the prospects of applying these (...) tools to the semantics of probability operators. We emphasize three desirable and novel features of our semantics: (i) probability claims only exploit qualitative resources unless there is explicit compositional pressure for quantitative resources; (ii) the semantics applies to both probabilistic adjectives (e.g., "likely") and probabilistic nouns (e.g., "probability"); (iii) the semantics can be combined with an account of belief reports that allows thinkers to have incoherent probabilistic beliefs (e.g. thinking that A & B is more likely than A) even while validating the relevant purely probabilistic claims (e.g. validating the claim that A & B is never more likely than A). Finally, we explore the interaction between confidence-reporting discourse (e.g., "I am confident that...") and belief-reports about probabilistic discourse (e.g.,"I think it's likely that.."). Is consistency the sort of thing that could provide a guide to mathematical ontology? If so, which notion of consistency suits this purpose? Mark Balaguer holds such a view in the context of platonism, the view that mathematical objects are non-causal, non-spatiotemporal, and non-mental. For the purposes of this paper, we will examine several notions of consistency with respect to how they can provide a platon-ist epistemology of mathematics. Only a Gödelian notion, we suggest, can provide a satisfactory guide to (...) a platonist ontology. Is consistency the sort of thing that could provide a guide to mathematical ontology? If so, which notion of consistency suits this purpose? Mark Bala-guer holds such a view in the context of platonism, the view that mathematical objects are non-causal, non-spatiotemporal, and non-mental. Balaguer's version of Platonism, Full-Blooded Platonism (FBP), is the view that "there are as many abstract mathematical objects as there could be-i.e., there actually exist abstract mathematical objects of all possible kinds" (Balaguer, 2017, p. 381). He continues: Since FBP says that there are abstract mathematical objects of all possible kinds, it follows that if FBP is true, then every purely mathematical theory that could be true-i.e., that is internally consistent-accurately describes some collection of actually existing abstract objects. Thus it follows from FBP that in order to acquire knowledge of abstract objects, all we have to do is come up with an internally consistent purely mathematical theory (and know that it is internally consistent). Nearly thirty years ago, Robert Alexy in his book The Concept and Validity of Law as well as in other early articles raised non-positivistic arguments in the Continental European tradition against legal positivism in general, which was assumed to be held by, among others, John Austin, Hans Kelsen and H.L.A. Hart. The core thesis of legal positivism that was being discussed among contemporary German jurists, just as with their Anglo- American counterparts, is the claim that there is no necessary connection (...) between law and morality. Robert Alexy has argued, however, that the law, besides consisting conceptually of elements of authoritative issuance and social efficacy, necessarily lays a claim to substantial correctness, which is derived from analytical arguments. Furthermore, if this claim to substantial correctness necessarily requires the incorporation of moral elements into law, then the ‘necessary connection thesis’, as defended by non-positivism, can be justified. Some of the most significant objections to this sort of claim, stemming from the Anglo-American world, are those introduced by Joseph Raz. In his ‘Reply’ to Robert Alexy, Raz raises at least three interesting criticisms, including, first, the ambiguity of ‘legal theory in the positivistic tradition’, second, the indeterminate formulations of the ‘separation thesis’, and, third, the necessary claim of law to legitimate authority as a moral claim. As a point of departure, I will argue that Raz’s three criticisms are misleading. For they do not enhance our understanding of the genuine compatibility or incompatibility between legal positivism and non-positivism. Despite the frequently reformulated theses of legal positivism and the various kinds of opponents responding thereto, the essential divergence between legal positivism and non-positivism was and remains the answer to the question of the relation between law and morality. Furthermore, I will clarify that in the strictest sense there can be three and only three logically possible positions concerning the relation between law and morality: the connection between them is either necessary, or impossible (i. e. they are necessarily separate), or contingent (i. e. they are neither necessarily connected nor necessarily separate). The first position is non-positivistic, while the latter two positions are, indeed, both positivistic, but in different forms: one may be called ‘exclusive’ legal positivism, the other ‘inclusive’ legal positivism. I will continue by showing that these three positions stand to one another in the relation of contraries, not contradictories, and that, taken together, they exhaust the logically possible positions concerning the relation between law and morality, never mind the tradition or authority from which these positions are derived. Raz mentions, however, many changeable formulations of the separation thesis, which even leads him to acknowledge ‘necessary connections between law and morality’. One who is trying to understand legal positivism would no doubt be puzzled by this claim. Nevertheless, I will argue that this is an alternative strategy of legal positivism, and it points to naturalistically oriented view. Although this necessary separation between law and morality, understood naturalistically, strikes one as strengthening the separation, in the end it leads to a weakened notion of necessity. This weakened necessary separation thesis, however, cannot be justified through the so-called claim of the law to legitimate authority, defended by Raz, for it is difficult to answer the question of whether a normally justified but factual authority can gain legitimate authority. Finally, the necessary connection between law and morality in a strong sense can still be justified by the claim of law to correctness, as per Alexy’s argument. (shrink)

In Against Purity, Alexis Shotwell takes up a multiplicity of tasks with respect to what I think of as non-ideal ethical theory. In what follows, I trace the relationship of her work to that of non-ideal theorists whose work influences mine. Then, more critically, I probe her analysis of gender voluntarism in Chapter 5, “Practicing Freedom: Disability and Gender Transformation,” partly to better understand what she takes it to be, and partly to advance a cautious defense of some of (...) the moral functions of individualistic performances of gender voluntarism that non-ideal theory leads me to value. I conclude that my interest in retaining a positive account of individualistic gender voluntarism as a form of resistance to a hostile world is due to my tendency to take non-ideal theory as a recommendation for some pessimism, whereas Shotwell’s similar commitments turn out to inform her more optimistic philosophy. We are currently experiencing a planetary crisis that will lead, if worst comes to worst, to the end of the entire world as we know it. Several feminist scholars have suggested that if the Earth is to stay livable for humans and nonhumans alike, the ways in which many human beings – particularly in the wealthy parts of the world, infested with Eurocentrism, colonialism, neoliberalism, and capitalism – inhabit this planet requires radical, ethical, and political transformation. In this article, we (...) propose that feminist theory, particularly feminist posthumanities, and Black feminist and decolonial thought, together with creative practices such as writing, have much to contribute to transformative planetary activism that imagines different and other kinds of worlds and futures based on an ethical consideration of nonhuman others and collective caring for the planet. The recent debate over “republican” conceptions of freedom as non-domination has re- invigorated philosophical discussions of freedom. However, “neo-Roman” republicanism, which has been characterized as republicanism that respects equality, has largely ignored the work of Alexis de Tocqueville, although he too took his task to be crafting a republicanism suited to equality. I therefore provide a philosophical treatment of the heart of Tocqueville’s republicanism, including an analysis of his conception of freedom as freedom in combined action and a philosophical (...) reconstruction of his primary argument for the importance of this kind of freedom. A comparison of Philip Pettit’s and Tocqueville’s republicanism exposes limitations in the neo-Roman conception of freedom as non-domination and its ideal of the free citizen and shows why neo-Roman republicanism, to live up to its motivating ideals, should accommodate elements of “neo- Athenian” republicanism and freedom in combined action. Back in Ancient India, Shankaracharya postulated a philosophy which is now known as Advaita. According to Advaita philosophy, the ‘jivãtma’ (individual soul) and ‘Brahmãtma’ (universal soul) are one and the same and these are the only ‘real’ things that exist. Everything else is an illusion. To challenge this almost unshakeable viewpoint, I bring to the fore a book authored by a Nobel Laureate. In 1935, Alexis Carrel’s revolutionary book entitled “Man the Unknown” was published. Though controversial in terms of (...) its content, it delineates the unexplored aspects of the human being – the understanding of mental processes and consciousness, which he claims humans have not mastered. Throughout the book, Carrel suggests that there is something that is unknown in the homo sapiens and hence he titles his work “Man the Unknown.” Based on this, I argue that both the esoteric East and the pragmatic West have not uncovered something “hidden” –the unknown factor/element. Substantial evidence exists for this contention in the scientific community. For example, questions such as among identical twins diagnosed with depression, why does one medication cure depression for one twin and have no effect on the other twin? Ceteris paribus, why does therapy work for one client but not for another client with the same disorder? These questions do not have clear, crystallized answers. Perhaps, if such a thing like an unknown element exists, it would pave the way for the postulation of the Grand Theory of the behavioural sciences. (shrink)

Right from traditional African philosophy, down to its modern and contemporary era, there has been a strong link between African philos ophy and language, underlined by the principle of complementarity. At a time like ours when many African governments have failed in national develop ment, especially in their ability to improve the social welfare of her people through th e provision of social amenities like quality education, portable water, transportation, good roads, good medical amenities, security of lives and property, basic infrastructur e, etc., this work employs Igwebuike philosophy, another African category, as a framewor k for Africa’s development. It develops a model of development which is inclusive and wholistic, and traces Africa’s problem of underdevelopment to the employment of no n-inclusive political and economic institutions. The concept of human dignity has been criticized as either too thick or too thin. However, according to the non-positivistic standpoint, the legal normativity of human dignity can be justified and thus strengthened by means of its moral correctness. From the individual perspective, Mencius’ understanding of human dignity as an intrinsic value and Kant’s formula of ‘man as an end in itself’ can be adequately understood based on the differentiation of, as well as the connection between, principium diiudicationis and principium (...) executionis, between will and choice, and between homo phaenomenon and homo noumenon (that is, ‘humanity in the personality’). From the social perspective, since the dual dimensions of the individual and the social person are both fictive constructions, even Radbruch, once as a supporter of social law, has not replaced the concept of ‘legal person’ and, in the post-War period, acknowledges individualistic human dignity as the criterion for applying the famous ‘disavowal formula’. On the one hand, human dignity shows at least a weak normative character, which requires, firstly, balancing between the exercise of state powers and the constitutional review under the guidance of the dual dimensions of man and, secondly, optimization of the principle of human dignity in individual cases. On the other hand, through the necessary connection between the concept of dignity and that of personality, human dignity can exhibit a strong normative character, which unavoidably requires a metaphysical justification. Wir wissen, dass eine Transformation von globalem Ausmaß bereits begonnen hat, und wir wissen, dass ihre Entfaltung nicht vorhersehbar ist. Wir können sicher sein, dass es eine Herausforderung sein wird: Wir werden inmitten tiefgreifender Veränderungen leben, unser Überleben wird ständig auf dem Spiel stehen. Werden wir das Verständnis, die Weisheit erreichen, um diese Herausforderung zu bestehen? Hier sind einige Gedanken und Überlegungen, die uns helfen, den Zustand zu erreichen, in dem wir eine positive Antwort geben können. -/- Zurückblicken, um nach (...) vorne zu sehen -/- Dies wird nicht das erste Mal in der Geschichte sein, dass für die Menschheit eine Periode der Transformation auf globaler Ebene angebrochen ist. Der Wissenschaftsphilosoph Holmes Rolston wies darauf hin, dass unsere „große Geschichte“ drei solcher Transformationen umfasst – wahre „Urknalle“.1 Die erste war der physische Urknall, der vermutlich vor etwa 13,8 Milliarden Jahren stattfand. Es gebar das manifeste Universum mit seinen Quantenteilchen, vielfältigen Arten von Energien und Milliarden von Galaxien. Es führte zur Bildung von Sonnensystemen mit Sonnen und Planeten und Energieflüssen, die die Entwicklung von lebenden (glücklich gelegenen) Planeten ermöglichen, die aktive Sonnen umkreisen. Eine weitere grundlegende Transformation – ein „zweiter Urknall“ – war die Entstehung lebender Organismen in den komplexen Systemen, die sich auf der Erde und vermutlich auch auf anderen Planeten entwickelt haben. Es wird angenommen, dass diese Transformation vor etwa 3,8 Milliarden Jahren stattgefunden hat. Es begann mit der Entstehung einzelliger Prokaryoten in der Ursuppe, die die Oberfläche des Planeten bedeckte. Der „dritte Urknall“ soll vor etwa 120.000 Jahren stattgefunden haben. Es hat das Bewusstsein unserer Spezies grundlegend verändert – „entwickelt“. Homo soll sapiens geworden sein. Zu den evolutionären Vorteilen des weiterentwickelten Bewusstseins gehörte eine flexiblere und schnellere Form der Kommunikation. Die Kommunikation war nicht mehr auf halbautomatische Reaktionen beschränkt, die durch wiederkehrende Bedingungen und Ereignisse ausgelöst wurden; Anstatt sich auf Zeichen zu beschränken, basierte die menschliche Kommunikation auf einvernehmlich entwickelten Symbolen. -/- Die Entwicklung der Symbolsprache war ein großer Sprung. Einerseits brachte es soziale Strukturen hervor, die auf kollektiv erworbener Bedeutung beruhten, und andererseits produzierte es verbesserte manipulative Fähigkeiten. Gesellschaften könnten sich auf der Grundlage gemeinsamer Kulturen entwickeln, die mächtige Technologien einsetzen. Homo sapiens begann andere Arten zu dominieren und wurde zu einem Schlüsselfaktor in der Evolution des Lebens in der Biosphäre. Der dritte Urknall erzeugte eine Explosion der menschlichen Bevölkerung, aber er brachte nicht die Weisheit hervor, die sicherstellen würde, dass die erweiterte Bevölkerung das Gleichgewicht aufrechterhalten könnte, das für das Gedeihen des Lebens auf diesem Planeten unerlässlich ist. Diese Gleichgewichte wurden immer mehr beeinträchtigt. Der kurzsichtige Einsatz von Technologie und die Missachtung natürlicher Kontrollmechanismen brachten die Menschheit dorthin, wo sie heute ist: an einen „Chaos-Punkt“, an dem die Wahl klar ist: zwischen Zusammenbruch und Durchbruch.2 Eine weitere globale Transformation ist unvermeidlich geworden und ist es noch tatsächlich im Gange: ein vierter Urknall. Es ist an der Zeit, die Lehren aus der Geschichte zu ziehen. Der Aufbau unserer Herrschaft auf dem Planeten hängt davon ab, ob wir die Herausforderung dieser Transformation meistern. -/- Die erste und grundlegende Lektion ist einfach und offensichtlich. Wir haben uns von der natürlichen Welt getrennt und müssen zurückkommen – nicht um Wilde und „Primitive“ zu werden, sondern Wesen, die auf die Welt um sie herum eingestimmt sind, die im Einklang mit den Rhythmen und Gleichgewichten der Natur leben und kompatibel erschaffen und nachhaltige eigene Rhythmen und Balancen. Wir sind nicht mehr auf die Rhythmen und Balancen der Natur ausgerichtet. Obwohl wir durch unsere biologische Evolution in diese Rhythmen und Balancen „eingebaut“ sind, haben wir unsere eigenen künstlichen Rhythmen und gefährlichen Balancen geschaffen, die die natürlichen Rhythmen ignorieren und oft mit ihnen in Konflikt stehen. Mit der Sonne aufzugehen und sich mit der Sonne zurückzuziehen bedeutet, sich an den zirkadianen 24-Stunden-Rhythmus anzupassen, der durch die Bewegung der Erde um die Sonne geschaffen wurde, und die sogenannten primitiven Menschen leben immer noch in Harmonie damit, und das tun die meisten auch die restlichen indigenen und traditionellen Kulturen. Aber moderne Menschen missachten die Rhythmen und Gleichgewichte der Natur und glauben, dass sie sie ersetzen können, indem sie Lichter und andere künstliche Annehmlichkeiten mit dem Umlegen eines Schalters ein- und ausschalten. Doch der menschliche Körper passt sich nicht den künstlichen Rhythmen an, und wir leiden unter den Folgen. -/- 3Die Wirksamkeit des Immunsystems ist beeinträchtigt, und trotz einer Flut von biochemischen Medikamenten breiten sich Krankheiten aus. Moderne Bevölkerungen sind Stadtbewohner und haben nur begrenzten Kontakt mit der Natur. Sie leben in einer künstlichen Welt und denken, dass es die reale Welt ist. Sie halten sich anderen Lebensformen überlegen und glauben, die Natur nach Belieben beherrschen zu können. Noch vor fünfzig Jahren musste die Tierintelligenzforscherin Jane Goodall gegen die damals noch vorherrschende Überzeugung ankämpfen, dass ChiMenschen sind biochemische Reiz-Reaktions-Mechanismen, keine lebenden und fühlenden Wesen. Heute erkennen wir, dass nicht nur höhere Säugetiere, alle lebenden Organismen und sogar Bäume und Pflanzen sensible Lebewesen sind und sich in dieser Hinsicht nicht grundlegend von uns unterscheiden. Es liegt im besten Interesse unseres körperlichen und geistigen Wohlbefindens, dass wir diese Missverständnisse und fehlerhaften Verhaltensweisen korrigieren. Wenn wir dies tun, gewinnen wir unsere natürliche Gesundheit und Vitalität zurück. Die heilende Wirkung natürlicher Substanzen und Lebensweisen war schon in der Antike Heilern und Weisen bekannt. Seit Hippokrates, der als Vater der modernen Medizin gilt, suchen Mediziner nach Substanzen und Methoden, die das Gleichgewicht und die Verbindung zwischen Mensch und Natur wiederherstellen. Heute wird dieser Anspruch überschattet von einer oft kommerziell motivierten Abhängigkeit von synthetischen Substanzen und naturverachtenden Praktiken. Die Szene ist nicht nur negativ: Wie wir sehen werden, gibt es positive Entwicklungen in allen Bereichen des menschlichen Strebens, einschließlich Heilung und Medizin. Die Verbindung mit der Natur ist ein Hauptziel der alternativen Heilmethoden, die als Informations- und Energiemedizin bekannt sind. Diese Form der Heilung erlebt in verschiedenen Teilen der Welt, vor allem im Orient, eine Renaissance. Shirin yoku, die japanische Kunst des Waldbadens, ist ein Paradebeispiel. Um es zu praktizieren, müssen wir in einen Wald gehen und uns auf seine Rhythmen und Energien eingestimmt fühlen – den Wind durch die Blätter rauschen hören, das Lichtspiel auf der Oberfläche eines Teichs spüren, mit den Wolken schweben, wenn sie sich durch den Himmel bewegen. Psychotherapeuten finden, dass sogar die Geräusche der Natur, das Zwitschern der Vögel, das Rauschen der Bäche heilend wirken. Einfach in einem Wald zu sein oder neben einem Baum zu stehen, beruhigt und heilt das Nervensystem. Eine weitere wesentliche Aufgabe ist es, positive Entwicklungen in der Gesellschaft zu erkennen und daran anzuknüpfen. -/- Es gibt positive Entwicklungen in der Gesellschaft, und es gibt gesunde, lebensspendende und erhaltende Prozesse in der Natur. Wir könnten wieder in die Natur eintauchen und an positiven Entwicklungen in der Gesellschaft teilhaben. Und doch gelingt uns das nicht. Wir beschreiten einen Weg, der eher zum Zusammenbruch als zum Durchbruch führt. Wir müssen überdenken, wie wir gehen, und vor allem, wohin wir gehen. Wir sind eine von mehr als hundert Millionen Arten in der Biosphäre, wobei jede Art Millionen und in einigen Fällen Milliarden von Individuen umfasst. Unter all diesen Arten und Individuen befinden wir uns in einer privilegierten Position: Wir haben ein hoch entwickeltes Gehirn und Bewusstsein. Dies ermöglicht uns zu fragen, wer wir sind, was die Welt ist und wie wir in der Welt leben können und sollen. Ein fortgeschrittenes Bewusstsein ist eine einzigartige Ressource, und wir machen keinen guten Gebrauch davon. Wir stellen nicht die richtigen Fragen und suchen nicht nach den richtigen Antworten, sondern gehen einfach vorwärts und vertrauen auf das Glück. Wir haben unsere Zahl erhöht, aber nicht die Vorteile, die unser Bewusstsein denen verleihen könnte, die wir in die Welt bringen. Wir haben ausgeklügelte Technologien entwickelt und angewendet, um unseren Bedürfnissen und Wünschen gerecht zu werden, haben aber die Mehrheit der fortgeschrittenen Arten beschädigt oder zum Aussterben gebracht. Fünfzig Prozent aller Wildtiere auf dem Planeten sind verschwunden, und jeden Tag verschwinden vierundvierzigtausend Populationen lebender Arten. Wir sind zu einer Gefahr für das Leben in der Biosphäre geworden. Die Geschichte lehrt uns, dass Urknalle, globale Transformationen, nicht unbedingt eine gerechte und blühende Welt hervorbringen; sie können zu einem Zusammenbruch führen. Wir haben die Schwelle eines vierten Urknalls erreicht, und wir tun nicht, was wir können, um einen Zusammenbruch abzuwenden. Der Großteil der heutigen Bevölkerung ist frustriert und depressiv und wird gewalttätig. Menschen leiden unter einer veränderten -/- über Klima, Umweltverschmutzung und unzählige Formen der Umweltzerstörung. Millionen durchstreifen den Planeten auf der Suche nach einem Ort, an dem sie nur überleben können. Die Lehren der Geschichte liegen vor uns, und wir ignorieren sie. Dennoch könnten wir die Lektionen lernen und unsere Wege korrigieren. Wir sind durchaus in der Lage, auf diesem Planeten zu leben, ohne das Gleichgewicht und die Ressourcen zu zerstören, die für ein gesundes Leben für uns und andere Arten erforderlich sind. Keine Spezies müsste dezimiert, unterworfen oder zum Aussterben getrieben werden, um uns am Leben zu erhalten. Wir könnten nachhaltig leben, mit anderen Arten koexistieren und die Grenzen des Lebens auf dem Planeten respektieren. Wir könnten die Verfügbarkeit lebenswichtiger Ressourcen für alle Menschen und Bevölkerungsgruppen sicherstellen. Dennoch treiben wir unzählige Arten zum Aussterben und schädigen die gemeinsame Umwelt. Die bloße Tatsache, dass wir es geschafft haben, als biologische Spezies fünf Millionen Jahre und als bewusste Spezies fünfzigtausend Jahre zu überleben, ist ein Beweis dafür, dass unsere grundlegende Natur nicht das Problem ist. Es ist nicht die Masse der menschlichen Bevölkerung, die dafür verantwortlich ist, zu einer Geißel des Lebens auf dem Planeten zu werden, sondern nur ein Teil. Die Frage ist, warum dieses Segment unhaltbare und jetzt kritische Bedingungen für geschaffen hat die höheren Formen des Lebens auf der Erde? Und kann es sich rechtzeitig ändern und transformieren, um eine große Katastrophe zu vermeiden? Theologische und mystische Annahmen wurden manchmal als Grund dafür angeführt, dass wir zu dem wurden, was wir sind, aber unser Verhalten göttlichen oder anderen transzendenten Ursachen zuzuschreiben, ist nicht die Antwort. Wir sind weder Engel noch Teufel. Wir wurden zur Geißel, zu der wir unbeabsichtigt geworden sind. Zu Beginn des Neolithikums begann ein Teil der Menschheit, die Ressourcen des Planeten ohne Rücksicht auf irgendetwas und irgendjemanden zu nutzen und sich nur darauf zu konzentrieren, seinen eigenen Komfort und seine eigene Macht zu verbessern. Auf einem endlichen und voneinander abhängigen Planeten führte dies zu unausgewogenen und unhaltbaren Bedingungen. Der egozentrische Umgang mit Ressourcen hat das Netz des Lebens beschädigt. Die menschliche Spezies wurde zu einer Bedrohung für alles Leben auf dem Planeten und auch für sich selbst: Die Gesundheit des Netzes des Lebens ist eine Vorbedingung für die Gesundheit der dort lebenden Spezies. Dies ist eine relativ junge Erkenntnis. Jahrtausendelang gingen die Menschen ihren Daseinsaufgaben nach, ohne sich bewusst zu sein, dass die unreflektierte Verfolgung ihrer eigenen Interessen um sie herum zum Fluch des Lebens wird. -/- Wir sind zu einem Fluch für das Leben auf diesem Planeten geworden; Wir haben die Welt zu einem Spielzeugladen gemacht, in dem wir die leistungsstarken Spielzeuge bauen, die unseren wahrgenommenen Interessen dienen. Wir spielen mit unseren Spielsachen unabhängig davon, ob sie wirklich unseren Bedürfnissen dienen, und ohne Rücksicht auf die Bedürfnisse anderer. Wir setzen die Energie des Atoms frei und nutzen sie, um Systeme anzutreiben, die unsere Bedürfnisse befriedigen. Wir leiten Elektronenströme in integrierte Schaltkreise und verwenden die Schaltkreise, um die Technologien zu beherrschen, die unseren Anforderungen an Kommunikation und Information dienen. Wir spielen im globalen Spielzeugladen ohne Rücksicht auf die Folgen für andere und für den gesamten Laden. Dies ist ein kurzsichtiges und gefährliches Verhalten. Wir greifen auf Energie auf eine Weise zu, die nicht unseren wirklichen Bedürfnissen dient, sondern nur unseren kurzfristigen, egozentrischen Bedürfnissen. Ähnlich kurzsichtig manipulieren wir Informationen. Atomkraft, selbst für friedliche Zwecke, und künstliche Intelligenz, selbst wenn sie gut gemeint ist, sind gefährliche Spielzeuge. Sie können zu technologischen Überschreitungen werden, die am Ende unser Leben und das gesamte Lebensnetz in der Biosphäre schädigen. Wir sind an sich gut, aber egozentrisch und kurzsichtig. Aber das kann nicht unwidersprochen bleiben. Die Zeit, in der wir naiv mit mächtigen Spielzeugen spielen konnten, ist vorbei. Ihre unvorhergesehenen „Nebenwirkungen“ sind zu einer Bedrohung für alles Leben auf dem Planeten geworden, einschließlich unseres eigenen. -/- Vorwärts gehen. -/- Wir sind an der Schwelle des vierten Urknalls angekommen. Was machen wir jetzt? Wenn wir gedeihen oder auch nur überleben wollen, muss sich unser Bewusstsein ändern. Gelingt dies nicht, wird der nächste Urknall unser letzter sein. Eine globale Transformation ist ein riskanter Prozess: Soll sie nicht zum Zusammenbruch, sondern zum Durchbruch führen, muss sie gesteuert werden. Wir können mit der bewussten Führung unserer Evolution beginnen, indem wir Gandhis Rat folgen: Sag anderen nicht, was sie tun sollen; Werde du selbst zu dem, was sie und die Welt werden sollen. Unsere wesentliche Aufgabe ist es, die Transformation der Welt zu werden. Wir müssen Ausdruck eines reifen und gesunden Lebens in der Biosphäre sein. Wenn diese kritische Masse erreicht wird, wird der „vierte Urknall“ nicht das Ende des Lebens auf dem Planeten markieren. Es wird eine disruptive globale Transformation sein, aber keine destruktive. Es wird eine neue Phase in der Amtszeit der Menschheit auf dem Planeten auslösen und nicht das Ende dieser Amtszeit. Es ist an der Zeit, die Lehren aus der Geschichte zu ziehen – zurückzublicken, um nach vorne zu sehen. Das Überleben einer fortgeschrittenen Spezies und die Zukunft des Lebensnetzes auf diesem Planeten liegt in unseren Händen. Noch nie waren so viele von der Weisheit so weniger abhängig. Wir müssen erwachen – um erwachsen zu werden. Die Kraft des Bewusstseins zu nutzen, die in unseren Händen liegt. Es ist nicht an der Zeit zu fragen, ob wir den vierten Urknall, die bereits begonnene globale Transformation, überstehen werden. Es ist an der Zeit, sich daran zu machen, es zu schaffen. (shrink)

I defend social media’s potential to support Aristotelian virtue friendship against a variety of objections. I begin with Aristotle’s claim that the foundation of the best friendships is a shared life. Friends share the distinctively human and valuable components of their lives, especially reasoning together by sharing conversation and thoughts, and communal engagement in valued activities. Although some have charged that shared living is not possible between friends who interact through digital social media, I argue that social media preserves the (...) relevantly human and valuable portions of life, especially reasoning, play, and exchange of ideas. I then consider several criticisms of social media’s potential to host friendships, and refute or weaken the force of these objections, using this conception of a distinctively human shared life. I conclude that we should use the shared life to evaluate features of specific social media and norms for users’ conduct. (shrink)
