This article analyses the epistemic status of law and its presumption of being a science in relation with the so-called demarcation criterion proposed by different philosophers of science. Such criteria are the main analytical elements to differentiate scientific discourses from those who are not and the ones who pretend to be. In relation to those, pseudoscience and law are treated, to finally conclude with the exposition of the case of Daubert v. Merrill Dow Pharmaceuticals, in which a judicial process defined (...) demarcation criteria. This paper shows how the demarcation criteria of science and the concept of pseudoscience cannot be applied to law science given its own rationality. (shrink)

Are we ever morally permitted to do what is morally wrong? It seems intuitive that we are, but evidence for dissociations among judgment of permissibility and wrongness are relatively scarce. Across 4 experiments (N = 1,438), we show that people judge that some behaviors can be morally wrong and permissible. The dissociations arise because these judgments track different morally relevant aspects of everyday moral encounters. Judgments of individual rights predicted permissibility but not wrongness, while character assessment predicted wrongness but not (...) permissibility. These findings suggest a picture in which moral evaluation is granular enough to express reasoning about different types of normative considerations, notably the possibility that people can exercise their rights in morally problematic ways. Online education has become an essential component of education. Thus, several factors, such as the student’s learning strategy and motivation, generally contribute to their academic success. This study investigates the relationship between learning strategies, motivation, and online learning environment among 150 first-year college students. Employing correlational design, the statistical findings of the study reveal that the r coefficient of 0.59 indicates a moderate positive correlation between the variables. The p-value of 0.00, which is less than 0.05, leads to the decision (...) to reject the null hypothesis. Plurality implies a public sphere in which different worldviews (e.g. Secular Humanist, Christian, Jewish, Muslim and others) coexist respecting each other. Banning the presence of one or several of them from the public sphere is questionable in principle, and divisive in practice.

The separation of church and state isn’t the same as separating religion from politics. Countries that have enshrined secularism have found themselves discussing religious architecture, law and clothing.

Brexit has been widely covered in the news. Much of the attention of the press in English has gone to the British perspective. This piece seeks to present a holistic view of this event, including the European perspective. It argues that, notwithstanding this break-up and the problems it highlights (especially the tiredness of citizens with traditional party politics), the European project can survive this crisis and forge ahead into the future.

A stunning phenomenon has dramatically changed the way in which we in the West regard the public sphere in particular, and democracy in general in the twenty-first century: the re-emergence of religion.

MacIntyre's is one approach among many to explain what philosophy ought to be. For Pieper (in: "Defence of Philosophy"), just to cite another one, "to engage in philosophy means to reflect on the totality of things we encounter, in view of their ultimate" or fundamental truth. And there are others. But my interest here is to explore the circumstances under which philosophers could claim a place in society due to a service they provide, as valuable as that of a mechanical (...) engineer in a factory, a waiter in a hotel or a pilot on an airplane. The circumstances, this is, which would make society see philosophers not (or not only) as oddly useless figures addressing intellectually engaging puzzles and uttering obscure conclusions, but as valuable contributors to the common good. En este contexto se sitúa el presente escrito. Se pretende describir el estado de una problemática antigua y nueva. Antigua, porque se remonta a los cimientos mismos de la filosofía y del pensar humano, varios miles de años antes de Cristo. Nueva, porque no han terminado en el siglo XX las discusiones sobre dicha problemática, ni las aplicaciones posibles que se derivan de ella. Se trata del principio de identidad. El presente trabajo partirá de la definición del principio de identidad (...) según Aristóteles. Se matizarán algunos aspectos de tal principio según otros autores que han perseguido sobre todo fines didácticos al presentarlo, ya sea para el desarrollo de la teología como para el de la epistemología o la metafísica. Finalmente, se expondrá —de una manera bastante elemental— la utilización y las conclusiones que algunos autores contemporáneos han efectuado con relación a la identidad. The work presented has the following approach: starting from the Pope's reflection on the planet and ecological problems, it is intended to show the philosophical influences that underlie Francisco's exposition. These influences make it possible to describe a philosophical profile present in the encyclical Laudato si’. In addition, since philosophy claims to know, it is not exhausted only in knowledge, but tries to know in order to act; therefore, the presence of an ethical proposal follows; and since all ethics leads (...) to action, it follows that action cannot be without some indicators, without an axiology on which human action on the planet revolves. The result is that Francisco offers an ethic of otherness that feels the other as an authentic neighbor, even those who are in the future. It is an ethic of common benefit and caring for the other whose fundamental axis is the person and for this reason he reflects the phenomenon of human life within life on Earth, with which its philosophical approach seems personalist, from a point of Christian view. In 2020, the European Union announced the award of the contract for the biometric part of the new database for border control, the Entry Exit System, to two companies: IDEMIA and Sopra Steria. Both companies had been previously involved in the development of databases for border and migration management. While there has been a growing amount of publicly available documents that show what kind of technologies are being implemented, for how much money, and by whom, there has been limited engagement (...) with digital methods in this field. Moreover, critical border and security scholarship has largely focused on qualitative and ethnographic methods. Building on a data feminist approach, we propose a transdisciplinary methodology that goes beyond binaries of qualitative/quantitative and opacity/transparency, examines power asymmetries and makes the labour of coding visible. Empirically, we build and analyse a dataset of the contracts awarded by two European Union agencies key to its border management policies – the European Agency for Large-Scale Information Systems (eu-LISA) and the European Border and Coast Guard Agency (Frontex). We supplement the digital analysis and visualisation of networks of companies with close reading of tender documents. In so doing, we show how a transdisciplinary methodology can be a device for making datafication ‘intelligible’ at the European Union borders. (shrink)

Our philosophical understanding of mental illness is being shaped by neuroscience. However, it has the paradoxical effect of igniting two radically opposed groups of philosophical views. On one side, skepticism and denialism assume that, lacking clear biological mechanisms and etiologies for most mental illnesses, we should infer they are constructions best explained by means of social factors. This is strongly associated with medical nihilism: it considers psychiatry more harmful than benign. On the other side of the divide, naturalism and reductionism (...) are on the look for failures in the biological functioning of the organism whenever a genuine mental illness occurs. Psychiatry as currently practiced, accordingly, exhibits the gaps of an ongoing research programme; a yet to be completed neuroscience would link mental illnesses with identifiable biological mechanisms. Both sides of this divide claim to be fostered by scientific discoveries and advances in neuroscience, when taken at face value. Against this background, we argue instead for a modest view. To that end, we draw attention to some nuances in the scientific realism debate. While contending that neuroscientific theories and models aim to provide true representations of their target systems, and can justifiably claim to have attained some, we argue that our confidence should not be placed beforehand in specific features of these scientific representations. Hence, it would be unwarranted to extract morals for psychiatry from posits (or their absence) in neuroscientific explanations of mental illnesses. To illustrate our position, we examine some recent discoveries in neuroscience concerning bipolar disorder. We conclude by linking our topic to a broader issue in the philosophy of medicine: insofar as psychiatry is a biomedical specialty, its classifications of health and disease are guided by pragmatic concerns, as well as by scientific discoveries. Así, puede comprobarse como en esos ideales de libertad, igualdad, tolerancia, respeto a la diferencia que propugna la Ilustración están presentes en el pensamiento de Mill y vertebran su filosofía.

Compassion and Moral Guidance es el título de la tesis doctoral del profesor Steve Bein de la Universidad de Hawai, publicada en el 2013 por la Society for Asian and Comparative Philosophy como su monografía No. 23. En este texto el autor nos pone frente a un término utilizado muy frecuentemente pero muchas veces am-biguo o que conduce a equívocos.

One of the many proposals put forth recently in the revival of bioethics concerns solidarity, which is part of the agenda for the discipline in the twenty-first century. In this article, solidarity is proposed as a bioethical value, inasmuch as it cannot be achieved without considering the person towards whom one shows solidarity and without taking into account his or her environment. It is not possible to make bioethical judgments or to accomplish in-depth biological thinking when forgetting the person who (...) is at the source or heart of the matter. Based on a study of the experience of a group of health volunteers in Medellin (Colombia), this research found evidence of the existence of three elements that, together, serve as a hinge between solidarity and bioethics. -/- Entre las muchas propuestas que se han hecho recientemente en ese resurgir de la bioética se encuentra la solidaridad, consti­tuyéndose parte de la agenda del siglo XXI sobre esta disciplina. Proponemos la solidaridad como un valor bioético puesto que así como no se puede ser solidario sin tener en cuenta a la persona con quien soy solidario y su entorno, no se pueden emitir juicios bioéticos o hacer una reflexión bioética de fondo olvidando a quien se tiene en frente. A partir de un estudio de la expe­riencia de una población de voluntarios del sector salud en Medellín, Colombia, se logró evidenciar que existen tres elementos que, en conjunto, sirven de bisagra entre la solidaridad y la bioética. The human person is an open book which should first be read by oneself in order to later be read by others. Throughout history we have seen many spoken and written narratives in different parts of the world, that along with having a historical value contribute to self-knowledge looking up ones life reflected in that who narrates its own life; within many others, we could point out the narratives of spiritual experiences, such as the Confessions of St. Augustine. This kind (...) of narrative work helps to come to the surface certain elements of oneself life that have been accumulated in the unconscious. For this reason, in the present we put emphasis on the value of the narrative work and in particular of spiritual experiences which we propose that helps to be aware of one’s own reality. We present the results of some online interviews from a religious movement which helps to clarify the influence of spiritual narratives in the awareness of one’s own life and a closer approach to God. -/- La persona humana es un libro abierto que en primer lugar debe ser leído por sí misma para luego ser leído por los demás. A lo largo de la historia se han visto numerosas narraciones orales y escritas en distintas partes del mundo que, además de tener un valor histórico, contribuyen al autoconocimiento viendo muchas veces reflejada la propia vida en la de quien la narra; entre muchas otras podríamos destacar las narraciones de experiencias espirituales, como las Confesiones de San Agustín. Este tipo de narraciones ayudan a aflorar algunos elementos de la propia vida que han quedado en el inconsciente. Por esta razón, en el presente trabajo se resalta el valor de la narración y en particular de la narración de experiencias espirituales para lograr una toma de conciencia de la propia realidad. Se presentan resultados de una encuesta realizada a jóvenes de un movimiento religioso que ayudan a esclarecer cómo la narración de las experiencias espirituales influye en la toma de conciencia de la propia vida y de su acercamiento a Dios. El presente artículo es un extracto de la Tesis Doctoral leída en la Facultad de Filosofía de la Universidad de Oviedo el 16 de abril de 2010 titulada Educación para la Libertad en el pensamiento de John Stuart Mill. Este artículo recoge de forma resumida, a lo largo de sus páginas, los aspectos más destacables de dicha Tesis Doctoral. Se subraya el aspecto de la educación como elemento fundamental en el pensamiento del filósofo inglés John Stuart Mill, en el sentido (...) de mostrar la educación como aquello que permite sacar al exterior las capacidades, talentos, destrezas que la persona posee. Al mismo tiempo es la educación, en el marco de la cultura, la que afina y refina a la persona, ayudándola a construirse como una persona que se incorpore a la ciudadanía con derechos y deberes y que ejerza esa ciudadanía responsablemente en aras del bien común. El trabajo que se presenta intenta mostrar, por un lado y siguiendo a Ortega y Gasset, la complejidad del fenómeno de la política; y por otro lado, a partir de la constatación anterior, la necesidad de una ética que haga de la política una actividad presidida por el diálogo, la integración y la búsqueda de soluciones a las complejidades de la sociedad actual. As ciências médicas, biomédicas, humanas e sociais têm avançado de forma frenética nos últimos anos. Com isso, se faz cada vez mais necessário o debate ético que visa contemplar o respeito à dignidade humana, animal e ao meio ambiente. A bioética se dedica a esse debate e se propõe a estendê-lo a setores não acadêmicos, como sociedades de proteção dos animais, dos direitos humanos e até grupos religiosos. Essa diversidade de opiniões não só é interessante, mas necessária, uma vez que (...) os valores praticados em uma sociedade provêm de uma construção social cujos blocos fundamentais têm origem na família e nos diversos grupos sociais nos quais os indivíduos estão inseridos desde o seu nascimento. A proposta deste livro é fomentar esse debate, fornecendo conceitos e visões sobre temas selecionados da pesquisa e da prática médica, biotecnológica e de áreas correlatas. Em um contexto mundial de intolerância política, social, étnica e de gênero, oportunidades de debate também possuem um papel social de auxiliar no desenvolvimento consciente da cidadania e do respeito ao próximo. Palliative care seeks to provide holistic care to improve the quality of life for the sick, especially as they approach the end of their lives. Addressing the spiritual dimension of the human person is useful because it provides answers to the meaning of life. Spiritual care has been shown to be of great benefit to patients. Therefore, this paper explores the importance of the spiritual dimension in palliative care; highlight the act of listening as a key part of spiritual care, (...) showing that physician burnout is the main obstacle to improving listening as an appropriate service that is both comforting and healing. -/- Los cuidados paliativos buscan ofrecer una atención holística para brindar una mejor calidad de vida a los enfermos, especialmente cuando se aproximan al fin de su existencia. Profundizar en la dimensión espiritual de la persona humana resulta útil puesto que ofrece respuestas al sentido de la vida. Se ha constatado que la atención espiritual aporta grandes beneficios para el paciente. Es por eso que en este trabajo hemos querido profundizar en la importancia de la dimensión espiritual en los cuidados paliativos; se destaca la actitud de la escucha como pieza clave de dicha atención espiritual, lo que evidencia que el burnout de los médicos es el principal obstáculo para potenciar la escucha como una adecuada disposición que resulte consoladora y sanadora. On the other hand, the authors show between the lines, and sometimes more clearly, the importance of teamwork in research groups, a key element to avoid errors, validate procedures or instruments and increase the reliability of the results, as well as the importance of criteria of validity, reliability, precision, relevance, transparency and credibility, among others. -/- Uno de los grandes retos para los estudiantes de cualquier disciplina es poder poner en práctica los conocimientos aprendidos en la teoría. La salud pública no se escapa de este desafío. Research Methods for Public Health es un libro que busca ayudar a comprender de manera sencilla cómo introducirse en la práctica de la investigación en salud pública. Este libro se destaca por su fácil lectura, pero especialmente porque pone el énfasis en la existencia de los métodos cuantitativos y cualitativos, así como en la combinación de ambos métodos. Por otro lado, los autores dejan ver entrelíneas, y a veces más claramente, la importancia del trabajo en equipo en los grupos de investigación, elemento clave para evitar errores, validar procedimientos o instrumentos y aumentar la confia-bilidad de los resultados, así como la importancia de criterios de validez, confiabilidad, precisión, relevancia, transparencia y credibilidad, entre otros. The human person has been analyzed from several points of view throughout the history. Great theologians, philosophers, anthropologists and sociologists and other specialists have written extensively on the subject. The philosophical contribution centered on the human person has been significant throughout history. In the last century, Romano Guardini, who received the Erasmus Prize for Best European Humanist and called "Master of Life" offers a view of reality man-centered, through a thin, deep and coherent approach on the individual. His work has (...) been labeled by some philosophers within the personalist current, and although his contributions were many, we want to highlight the elements of the meeting, the language and the self-acceptance. In this paper we propose how this approach to the human person can become an intinerary embodied in reality, that can help today to seek clarification and start delving into own personal knowledge enlightened by faith. -/- La persona humana ha sido analizada desde varios puntos de vista a lo largo de la historia. Grandes teólogos, filósofos, antropólogos y sociólogos entre otros especialistas han escrito profusamente acerca del tema. El aporte de una filosofía centrada en la persona humana ha sido significativo a lo largo de la historia. En el último siglo, Romano Guardini, quien recibió el Premio Erasmo al Mejor Humanista Europeo y llamado “Maestro de Vida”, propone una visión de la realidad centrada en el hombre, a través de una aproximación fina, profunda y coherente sobre la persona humana. Su trabajo ha sido catalogado por algunos filósofos dentro de la corriente personalista, y si bien sus aportes fueron muchos queremos resaltar los elementos del encuentro, el lenguaje y la aceptación de sí mismo. En este trabajo proponemos cómo dicha aproximación a la persona humana se puede convertir en un itinerario encarnado en la realidad que puede ayudar hoy en día a quienes buscan esclarecer y comenzar a ahondar en el propio conocimiento personal iluminados por la fe. El presente artículo trata, desde una perspectiva histórica, mostrar el debate entre la Razón y la Fe en la Historia de la Filosofía.

This study aimed to determine the effectiveness of using Team Assisted Individualization (TAI) as cooperative learning teaching approach to improve students’ mathematical cognition. A quantitative research design via experimental design using one group pretest and post-test was employed. This only concentrated on specific students’ processing speed and working memory and included 67 grade 9 students from a public school in the Philippines. The findings showed that the components of TAI were moderately effective under the placement test, effective under the teams, (...) teaching group, student creative, team study, fact test and team score than whole class and highly effective under team recognition, Furthermore, there is a significant difference between the pre-test and post-test scores in each completed stage, and TAI approach is an effective strategy in improving the mathematical cognition of students. This study argues that TAI approach may be utilized in mathematics classrooms to improve the mathematical cognition of students. The gravity of the lessons or topics may be put into consideration to balance the learning and performances of students. (shrink)

In a world in which emotions and feelings occupy a dominant place in daily human life and especially in decision-making circumstances, it is important for us to ask ourselves whether it is possible to talk about “new” ethics or “renewed ethics.” Actually, we do not face a re-creation of principles and values, but rather we face a need for deepening our understanding of human anthropology. Thinkers such as Dietrich von Hildebrand have proposed that affectivity can shed light on ethics comprehension. (...) By means of a study of some of the works of this contemporary philosopher, we state that ethics is the result of a harmony between a clear objective comprehension of reality and a straight comprehension of that reality within the sphere of an educated, formed and well-known affectivity of the human person, which would lead us beyond the common place understanding of ethics as something rigid and full of rules and restrictions. -/- En un mundo en el que las emociones y los sentimientos ocupan un lugar preponderante en la vida cotidiana de las personas y especialmente en las decisiones que toman, cabe preguntarnos si podemos hablar de una nueva ética o de una ética renovada. En realidad no nos enfrentamos a una recreación de nuevos principios y valores, sino a una necesidad de ahondar en la antropología de la persona humana. En esta profundización se ha revalorado el importante papel que juega la afectividad en la vida humana. Pensadores como Dietrich von Hildebrand han propuesto que la afectividad puede dar luces en la comprensión de la ética. A partir de un estudio de algunas de las obras de este filósofo contemporáneo proponemos que la ética vendría siendo el resultado de una armonía entre la clara comprensión objetiva de la realidad y una recta comprensión de dicha realidad dentro de una esfera afectiva educada, formada, y ante todo conocida por la propia persona, lo cual nos conduce más allá de una ética entendida muchas veces como algo rígido lleno de normas y restricciones. As one tries to grasp love and its images within José Leonilson's production, a multiplicity of aspects and meanings are seen that also relate to Louise Bourgeois's oeuvre in regard to the interest in human relations. Through a comparative approach to both artists' poetics, an understanding is created that love is not a simplistic action and all the words read in or applied to their visual discourse must be considered within a wide range of love in visual and literary images. The structuralist reconstruction of the metabolic biochemistry here presented is a more complete and revised version than the one presented in Donolo, Federico & Lorenzano (2006). This version, as the previous one, continues with the reconstructive task initiated by César Lorenzano (2002), but advances further on those elements which remained pendent of reconstruction: applications subsequent to the paradigmatic one, for being these “too diversified and numerous” (p. 210).In line with which is said before, the objective of this new reconstruction is (...) to make the theoretical network of the biochemistry wider, in order to be able to capture the many successful applications (paradigmatic examples or exemplars) which appear in modern university textbooks. In order to accomplish this, major conceptual precisions are being introduced which will have repercussions in a modification and increased complexity of the fundamental law implicit in the text books, but still conserving the previous basic idea. Individualism or communalism? This is a very important question about how societies can live, develop, work and solve problems. Throughout history, this question has been considered from philosophical, sociological, anthropological, psychological, political, economic, and even theological or spiritual perspectives. Perhaps we will not find a solution, and the possibilities of reconciling these two concepts seem slim. Today, with Carolyn Smith-Morris' book, we approach the question from the experience of Indigenous communities. The title of the book is "Indigenous Communalism," but the (...) author will point out several times throughout the book that we cannot fully understand communalism without considering individualism. In her own words, the goal of this book “has been to initiate more overt attention to the individual and communal together, encapsulating (without resolving) the tensions that create human societies, and to value Indigenous communalism as the central feature of Indigeneity that it is” (Smith-Morris, 2020, p. 136). -/- ¿Individualismo o comunalismo? Esta es una pregunta muy importante sobre cómo las sociedades pueden vivir, desarrollarse, trabajar y resolver problemas. A lo largo de la historia, se ha reflexionado sobre este tema desde los puntos de vista filosófico, sociológico, antropológico, psicológico, político, económico, e incluso, teológico o espiritual. Quizás no encontremos ninguna solución y parecen pocas las posibilidades de conciliar estos dos conceptos. Hoy, con el libro de Carolyn Smith-Morris, que se titula en español Comunalismo indígena, abordamos la cuestión desde la experiencia de las comunidades indígenas. En esta línea, la autora señalará varias veces que no podemos entender plenamente el comunalismo sin tener en cuenta el individualismo. En sus propias palabras, se refiere a que su objetivo fue “iniciar un esfuerzo de atención más abierto a lo individual y lo comunal juntos, encapsulando (sin resolver) las tensio-nes que crean las sociedades humanas, y valorar el comunalismo indígena como la característica central de la indigeneidad que es” (Smith-Morris, 2020: 136). This article intends to analyze the performance and the efficiency of companies and to identify the key factors that may explain it. It was selected a sample with 15 enterprises: 7 Portuguese and 8 Ukrainian ones, belonging to several industries. Financial and non-financial data was collected for 6 years, during the period of 2009 to 2014. Research questions that guided this work were: Are the enterprises efficient/profitable? What factors influence enterprises’ efficiency/performance? Is there any difference between Ukrainian and Portuguese enterprises’ (...) efficiency/performance, which factors have more influence? Which industrial sector is represented by more efficient/profitable enterprises? The main results showed that in average enterprises were efficient with low level of profitability. According to gained results several indicators were highlighted so that companies would pay more attention to them. (shrink)

Have you ever kept a diary of your personal life? For many people, keeping a written record of their experiences, thoughts, feelings, travels or encounters with people is a common practice. For others, it is not. Perhaps for some it is something completely foreign. For Russian Orthodox priest Alexander Schmemann it was clearly not. His diary, two volumes of almost 600 pages each, has given an insight into the life, worries, joys and even disappointments of one of the most influential (...) theologians of the 20th century. On this occasion we would like to refer to the first volume and scrutinize a little of what this work brings to the world today. ¿Ha llevado usted un diario de su vida personal? Para muchas personas, llevar un registro escrito de sus vivencias, pensamientos, sentimientos, viajes o encuentros con personas es una práctica común. Para otros no. Quizá para algunos esto es algo completamente ajeno. Es evidente que para el sacerdote ortodoxo ruso Alexander Schmemann no lo fue. Su diario, dos tomos de casi 600 páginas cada uno, ha dejado ver a fondo la vida, preocupaciones, alegrías, e incluso desilusiones de uno de los teólogos más influyentes del siglo XX. En esta ocasión queremos referirnos al primer tomo y escudriñar un poco qué aporta esta obra al mundo de hoy. (shrink)

This contribution explores disability rights protection in Inter-American States within the framework of the OAS and in the context of the obligations established under the CIADDIS and the CRPD. Following the classical division between ‘primary’ and ‘secondary’ rules, the contribution first sketches key regulatory initiatives in the area of disability rights and second considers compliance and enforcement mechanisms. Along these lines, the first section illustrates similarities and differences between the CIADDIS and the CRPD and, within this framework, essential regional regulatory (...) initiatives. The second section assesses disability rights in select countries, based on periodic reports under the CIADDIS and CRPD. The section examines the four largest countries by population in the region, notably, the United States of America (US), Mexico, Brazil and Colombia. The third section explores the enforcement of disability rights via key cases before the Inter-American Commission on Human Rights (IAComHR) and the Inter-American Court of Human Rights (IACtHR). The purpose is providing a comprehensive understanding of disability rights in the region and identifying key regulatory problems and ways forward. (shrink)

Rules are meant to apply equally to all within their jurisdiction. However, some rules are frequently broken without consequence for most. These rules are only occasionally enforced, often at the discretion of a third-party observer. We propose that these rules—whose violations are frequent, and enforcement is rare—constitute a unique subclass of explicitly codified rules, which we call ‘phantom rules’ (e.g., proscribing jaywalking). Their apparent punishability is ambiguous and particularly susceptible to third-party motives. Across six experiments, (N = 1440) we validated (...) the existence of phantom rules and found evidence for their motivated enforcement. First, people played a modified Dictator Game with a novel frequently broken and rarely enforced rule (i.e., a phantom rule). People enforced this rule more often when the “dictator” was selfish (vs. fair) even though the rule only proscribed fractional offers (not selfishness). Then we turned to third person judgments of the U.S. legal system. We found these violations are recognizable to participants as both illegal and commonplace (Experiment 2), differentiable from violations of prototypical laws (Experiments 3) and enforced in a motivated way (Experiments 4a and 4b). Phantom rule violations (but not prototypical legal violations) are seen as more justifiably punished when the rule violator has also violated a social norm (vs. rule violation alone)—unless the motivation to punish has been satiated (Experiment 5). Phantom rules are frequently broken, codified rules. Consequently, their apparent punishability is ambiguous, and their enforcement is particularly susceptible to third party motives. (shrink)

In 1988, J. Ivlev proposed some (non-normal) modal systems which are semantically characterized by four-valued non-deterministic matrices in the sense of A. Avron and I. Lev. Swap structures are multialgebras (a.k.a. hyperalgebras) of a special kind, which were introduced in 2016 by W. Carnielli and M. Coniglio in order to give a non-deterministic semantical account for several paraconsistent logics known as logics of formal inconsistency, which are not algebraizable by means of the standard techniques. Each swap structure induces naturally a (...) non-deterministic matrix. The aim of this paper is to obtain a swap structures semantics for some Ivlev-like modal systems proposed in 2015 by M. Coniglio, L. Fariñas del Cerro and N. Peron. Completeness results will be stated by means of the notion of Lindenbaum–Tarski swap structures, which constitute a natural generalization to multialgebras of the concept of Lindenbaum–Tarski algebras. "God wants to marry us" (p. 14, 97, 122), es decir, Dios quiere casarse con nosotros, es el tema central del presente libro, y según otros autores, es también el sentido real de la Biblia. La Biblia no es un libro que nos enseña cómo encontrar a Dios, sino el libro que nos revela cómo Dios nos busca incansablemente y nos relata las innumerables veces y maneras en las que Dios trata de hacerse el encontradizo para que el ser humano (...) lo acoja en su corazón. Pues bien, este es el principal argumento del autor de este libro. La obra de Christopher West es a todas luces teológica, y nos deja ver, con sencillas palabras, la profundidad de la teología del cuerpo propuesta por el Papa Juan Pablo II. Aquí encontraremos que el significado de la vida del ser humano está impreso en su propio cuerpo, en su sexualidad. Cabe anotar que se requiere algún mínimo de conocimiento teológico para leer este libro con facilidad, y da por sentado un cierto conocimiento de la Sagrada Escritura, la cual es citada 213 veces, además de las veces que hace referencia al capítulo quinto de la carta de San Pablo a los Efesios. De todas maneras, el estilo fluido y cercano del autor, así como la mención a algunos ejemplos de la vida cotidiana, permite que el contenido del libro se vaya asimilando poco a poco. (shrink)

Understanding sexual abuse es un libro que sorprenderá al lector por varias razones. En primer lugar, es un testimonio de la vida real del autor como víctima de abuso sexual en su niñez por una de las personas más cercanas a su familia. En segundo lugar, no es el típico libro sensacionalista que busca llamar la atención ni generar lástima ni victimizarse ni buscar fondos para alguna ONG de prevención de abuso sexual; más bien, el autor, con mucha apertura interior, (...) humildad, valentía, así como con un elevado profesionalismo, describe lo profundo que pueden ser las heridas de este tipo de abuso y lo crudo e injusto que es este crimen. En tercer lugar, la manera como el autor se aproxima al tratamiento de un trauma como el abuso sexual, permite que el lector se identifique plenamente con el autor, si ha sido abusado sexualmente, o si no, que aun así pueda tomar muchos elementos para sanar traumas de su propia vida, a pesar de no tratarse de abuso sexual, y sobre cómo acompañar a otras personas que han sufrido este tipo de abuso; he aquí la riqueza de este libro. Tema rada su dva tipa emergencije unutar razumevanja bioloških entiteta: a) epistemološka i b) ontološka emergencija. Iako postoji obimna literatura posvećena ovom pojmu (njegovim tipovima, čak i vrstama), tvrdimo da se pojam ontološke emergencije najčešće pogrešno primenjuje u naučnim i filozofskim objašnjenjima kompleksnih sistema, stoga ga formulišemo na drugačiji način. Da bismo istakli u čemu je distinktivno svojstvo jednog tipa u odnosu na drugi, i time dali doprinos boljem razumevanju kompleksnosti biosfere, za tip a) koristimo konvencionalno prihvaćen model za reprezentovanje (...) genetičkih regulatornih mreža, dok za tip b) obrazlažemo zašto treba da bude predstavljen egzaptacijama. Cilj naše analize je da ukaže, polazeći od osnovnih pretpostavki sistemske biologije, na koji način pojam emergencije ima značajno mesto u današnjoj filozofiji nauke i teorijskoj biologiji. (shrink)

The purpose of this paper is to contextualize the study of metaphors within constructivist-informed research, in the hope that this process will orient cognitive scientists to the usefulness of implementing qualitative research methodologies, especially to using the person of the researcher as the primary research instrument. First, I explore some of the differences between Johnson and Lakoff’s Contemporary Metaphor Theory (CMT) and approaches evolving from it on one hand, and the clinical approach to metaphor based on a constructivist therapy model, (...) on the other. CMT has been one of the most significant forces that helped shift cognitive science toward an embodied approach to cognition. While it has succeeded to place physical experience back where it belongs in reason and meaning, CMT has, however, also fallen into some positivist traps which lead to problems such as a dualism, a split between the knower and the known, and with that, to a distrust of introspective, first-person accounts. In the process of finding conceptual metaphors — generalizations that govern metaphorical expressions — CMT often deletes the idiosyncratic characteristics and presuppositions implicit in linguistic metaphors; it divorces them from people’s sensory experiences, the “here and now” and the intent of their communications. The constructivist approach to metaphor that I present here accepts as a priori assumptions much of what workers of CMT are out to prove. In particular, it takes the correlation of conceptual metaphors and physical experience, as well as the unity of language and thought as pragmatic givens. Emulating the constructivist therapist’s approach to metaphors, I show how it is possible to deconstruct conceptual metaphors into minute sensory distinctions, using one’s own person as the main tool, for the purpose of helping people change their experiences in desired ways, at will. I illustrate this process by numerous examples from a wide field of applications, including mathematics education and psychotherapy. (shrink)

No es usual leer un libro de un gran teólogo y a la vez de un gran artista. Ubicándonos en el siglo XXI, es fácil reconocer al personaje del cual estamos hablando: Marko I. Rupnik. La sensibilidad artística, unida a la profundidad teológica y a su ascendencia espiritual católica oriental, hacen de los escritos del padre Rupnik grandes novedades para la teología occidental actual. En su libro According to the Spirit, el padre Rupnik propone, siguiendo los lineamientos del papa Francisco, (...) que será una teología espiri-tual que exprese la renovación de la vida eclesial, la que podrá afrontar el periodo épico de transición en el cual nos encontramos. La Iglesia Católica necesita una nueva mentalidad que corresponde a una vida nueva, pero basada en una vida según el Espíritu, una vida espiritual que le haga espacio interior al Espíritu, recibiéndolo como un don, que nos libere del apego a nosotros mismos. Las aproximaciones exis-tenciales, así como la profundidad teológica y los matices fruto de la sensibilidad espiritual del padre Rupnik, hacen del libro una aguda, dura y muy acertada crítica a la situación actual de la Iglesia Católica, en sus métodos teológicos, evangelización y respuesta a las necesidades del mundo de hoy. Reactivity, or the phenomenon by which subjects tend to modify their behavior in virtue of their being studied upon, is often cited as one of the most important difficulties involved in social scientific experiments, and yet, there is to date a persistent conceptual muddle when dealing with the many dimensions of reactivity. This paper offers a conceptual framework for reactivity that draws on an interventionist approach to causality. The framework allows us to offer an unambiguous definition of reactivity and distinguishes (...) it from placebo effects. Further, it allows us to distinguish between benign and malignant forms of the phenomenon, depending on whether reactivity constitutes a danger to the validity of the causal inferences drawn from experimental data. Giere’s analysis of the epistemic role of fiction in science and literature is the representative of antifictionists. Our research finds the three inconsistencies in his main paper regarding the comparison of fiction in scientific models and literary works. We analyze his argument and offer our solution to the issue favoring the perspective of fictionalism. Further, we support a typological differentiation of false representation in science into fictional and fictitious. The value of this differentiation we demonstrate by giving the example of (...) digital organisms in system biology. The paper aims to help better understanding of fiction in science and to avoid the oversimplification of literary fiction. (shrink)

Nesta comunicação pretende-se desenvolver a relação entre violência e política enquadrada no pensamento de Hannah Arendt e a partir de duas obras fundamentais, On Revolution (1963) e On Violence (1970). Investigando-se sobre o que constitui cada experiência em particular, a da violência (ainda que sob a forma da guerra ou da revolução) e a da política, esta relação permitirá equacionar criticamente as possibilidades e os limites das sociedades democráticas actuais como o resultado da tradição política e das revoluções da modernidade.
